On today's BradCast: The good news just seems to keep on coming. We'll take it while it lasts! Tuesday brought huge election victories for democracy and progressives in Chicago and Wisconsin! [Audio liNk to full show follows this summary.]

In Chicago, Democratic progressive teacher and union member Brandon Johnson defeated conservative, self-proclaimed "tough on crime" Democrat Paul Vallas to become the new Windy City Mayor in a stunning victory.

But the biggest election of the night, and perhaps of 2023, was the Wisconsin state Supreme Court victory of liberal Milwaukee Judge Janet Protasiewicz over far-right former state Supreme Court Justice Dan Kelly, a Republican activist supported by anti-choice groups who advised his party in their failed attempt to overturn the state's 2020 election. Her victory creates a progressive majority on the high court for the first time in 15 years.

In a closely divided state where elections are traditionally very close, often within 1 or 2 points, Protasiewicz reportedly blew Kelly away by a whopping 11 points as of this afternoon's tally. It was Kelly's second defeat in running for the Supreme Court in as many years.

And it comes not a moment too soon. The Badger State's new, 4 to 3 progressive high court majority will likely face a host of critical issues for both the state and nation in the years ahead, including an 1849 abortion ban which Republicans are hoping to enforce; wildly gerrymandered state and Congressional district maps in one of the most gerrymandered states in the nation; voting rights issues; and hopes by Republicans of trying to steal the 2024 Presidential election.

We're delighted to be joined once again today to discuss all of this good news by Wisconsin's favorite son and progressive journalist, JOHN NICHOLS of The Nation, and co-author, with Bernie Sanders, of the new book, It's Okay to be Angry About Capitalism.

Nichols says Tuesday's mayoral race in Chicago was "one of the most significant election results in the country for urban politics in quite awhile." He describes the previously little-known Johnson as having built a "multi-racial, multi-ethnic, multi-generational rainbow coalition" that propelled him to victory. "He beat the guy that everybody bet was going to be the next mayor of Chicago. Brandon Johnson will take office as a progressive who ran on taxing the rich, reforming the police, and investing money in public education, public health, and public services. A pretty remarkable win."

But the bulk of our time is spent discussing the extraordinary, long-awaited Supreme Court victory in Wisconsin, which, with some $45 million spent on both candidates, clocks in as the most expensive judicial race in U.S. history.

"It was a bitter race. It was an intense race," Nichols tells me in trying to explain Kelly's incredible election night remarks in which he attempted to eviscerate his opponent in one of the most incredible sore-loser "concession" speeches in modern memory. Kelly described the contest as "the most deeply deceitful, dishonorable, despicable campaigns I have ever seen run for the courts," going on to attack Protasiewicz as "a serial liar" who has "demeaned the judiciary."

"It's going to go down in history," Nichols says referring to Kelly's election night outburst. "I've seen bitter concessions. I've seen angry concessions. I have seen refusals to concede. I have never, up until now, seen a concession that literally made people cringe."

We've got a lot to discuss about the new majority on the state's high court; what it means for Wisconsin moving forward; whether Republicans, with a narrow state Senate Special Election victory last night will attempt to impeach Protasiewicz with their newly won, gerrymandered super-majority in the upper chamber; and why Nichols, as he reports at The Nation today, believes this was "the most important election of 2023...for any American who cares about democracy, fair elections, voting rights, and much more."

Despite the good news, however, Nichols reminds us that WI is still a closely divided state, capable of wild swings. "The bottom line is this: Don't take your eyes away from Wisconsin," he advises. "It is a battleground state. This is the state of Robert M. LaFollette, the greatest progressive ever to serve in the U.S. Senate, and of Joe McCarthy, the most reactionary person, I would argue, to serve in the U.S. Senate. Those realities still exist. And this Supreme Court race is a very encouraging result as part of a very encouraging pattern in Wisconsin. But when you take your eyes off the prize, when you aren't paying attention, patterns can shift back."

Finally today, with all of the encouraging news of late, a few reminders that all of this good news at the national level, where Republican policies are wildly unpopular, also means that Rightwingers are embracing violent responses and GOP-controlled states are upping their desperation in hopes of holding on to control by hook and by crook. In many such states, it's not creeping authoritarianism in play, it's actual authoritarianism.

In Tennessee, for example, state Republicans are hoping to expel three Democratic state House members who dared support peaceful protesters calling for gun safety measures following last week's school shooting in Nashville. In Texas, GOP state lawmakers have quietly introduced a bill to allow the Sec. of State to overturn election results in the state's most populous and Democratic-leaning County; and in Florida, authoritarian Gov. Ron DeSantis is deploying Big Government weaponization against those, like the Walt Disney Company, who disagree with his anti-freedom, anti-LGBTQ policies...

Today on The BradCast: Nobody knows what we'll learn when the indictment against Donald Trump is unsealed, hopefully on Tuesday, when he will reportedly surrender to arrest and arraignment in downtown Manhattan. But that hasn't kept Fox "News" and the rest of the Republican Party (including even folks like Jeb Bush, whose own political career was destroyed, in no small part, by Trump) from lying about all of it. It's what they do. [Audio link to full show follows this summary.]

We'll find out soon enough what the charges are, as brought by Manhattan District Attorney Alvin Bragg against the disgraced former President. But among the lies that Fox and friends are having trouble keeping straight: Is the indictment a "political prosecution" mean to harm Trump's chances of re-election in 2024? If so, why do they all keep claiming that the indictment is gonna help him win in 2024?

For the record, new polling since the indictment was confirmed last week show a huge bump for Trump in the Republican Primary contest against Ron DeSantis and others. On the other hand, new polling since last Thursday also reveals that a majority of Americans, in every single demographic, approve of Trump being indicted. We'll see if that holds after we finally learn what's in the New York charges.

But, as we now know, in no uncertain terms as of Judge Eric Davis' Friday blistering ruling against Fox in Dominion's $1.6 billion defamation suit, lying in order to dupe viewers is no accident. It is actually the Fox business model. They are not a news outlet and never have been. They are Republican activists and propagandists. Period. And the evidence in the case now makes all of that "CRYSTAL clear," as the court noted.

Of course, the Republican Party and Fox "News" also like to pretend that the Department of Justice declined to prosecute the charges they believe Bragg will be unveiling this week. They claim the DoJ examined, but decided against bringing charges related to Trump's hush-money payoff to porn star Stormy Daniels just before the 2016 election, and about the payments he made while serving in the White House to keep it all quiet.

But DoJ didn't decline to prosecute. In fact, Trump's own DoJ prosecuted Trump's own attorney Michael Cohen, who pleaded guilty and was sentenced to three years for his part in the conspiracy. At the time of Cohen's sentencing, both he and Trump's own DoJ admitted the scheme was "directed by" and "for the benefit of" Trump himself. That, before Trump's own Attorney General Bill Barr ordered the probe be shut down, according to Geoffrey Berman, Trump's own U.S. Attorney in New York. DoJ didn't "decline to prosecute," as Jeb and Fox and the rest of the Republicans have been lying.

Of course, given who Jeb's brother and father were, its little wonder he has joined the parade of Republican who now oppose criminal accountability for former Presidents of the United States.

A jury will now decide whether defamation was done with 'actual malice' and, if so, how much the voting machine company is due in damages...

"Through its extensive proof, Dominion has met its burden of showing there is no genuine issue of material fact as to falsity. Fox therefore had the burden to show an issue of material fact existed in turn. Fox failed to meet its burden," the Judge found, before using italics and all-caps to emphasize the central point. It "is CRYSTAL clear that none of the [Fox] Statements relating to Dominion about the 2020 election are true."

In a no-uncertain terms defeat for Fox, the 130-page Order [PDF] handed down on Friday by Delaware Superior Court Judge Eric M. Davis found, as a matter of law, that the Fox "News" Network (FNN), during its post-election coverage of the 2020 Presidential Election, published four categories of false statements about Dominion Voting Systems. No evidence was presented by the Republican propaganda outlet to counter those material facts.

The court also found, as a matter of law, that Fox' statements amounted to "defamation per se," a finding that establishes that damages are to be presumed in the voting machine company's $1.6 billion dollar lawsuit.

All of the Fox motions for Summary Judgement to dismiss the case were "DENIED" by the court. Dominion's motion for Summary Judgement on Liability were "GRANTED in part and DENIED in part."

Barring a settlement by the parties, the case is now scheduled to proceed to trial in mid-April. Some of Fox' top stars, including Sean Hannity, Tucker Carlson and Maria Bartiromo are believed likely to be called to the stand as witnesses...

On the other hand, Donald Trump's statement at his own social media website says he's been "INDICATED". But why quibble? The news caught us mid-BradCast today. We did our best to make sense of it all on the fly. [Audio link to full show follows this summary.]

First up, we were covering the newly unredacted evidence from Dominion Voting System's $1.6 billion defamation lawsuit against the wildly corrupt Fox "News" outfit, regarding the Republican propaganda outlet's knowing lies and evidence-free claims that the voting machine company somehow helped to steal the 2020 Presidential election from Donald Trump. Dominion didn't, and Fox knew as much, according to their own "Brain Room", which they ignored. (Yes, they have a "Brain Room", apparently, at Fox. So, that must be where they keep them?) As bad for Fox as the previously released evidence was, this is the stuff they had redacted from that, for some reason, until a judge ordered it released on Wednesday. So, imagine how bad this stuff is? You don't have to. We discuss it on today's show before today's big breaking news.

Then, we were covering the hilarious case of Disney out-foxing (no pun intended) Florida's Republican Gov. Ron DeSantis and his attempt to weaponize the state government against them. That, because Disney dared speak out against his "Don't Say Gay" law which was written to allow the government to ban discussion of sexual orientation and general identity in ALL public school grades. (Not just K through 3.) So, how did Disney out-fox, DeSantis? It's pretty hilarious. So, tune in to find out.

Next, we were going to cover a whole bunch of important labor union news from this past week...BUT...news then broke of Trump's indictment by a criminal grand jury in New York.

Thus, we moved our latest Green News Report with Desi Doyen from the end of the show to the middle, to buy some time to figure out the breaking news hubbub. Sadly, there's some pretty important news in today's GNR, including the fact that electricity generated renewables outpaced coal last year for the first time in the U.S. That big news will all almost certain be forgotten because...well...

TRUMP WAS INDICTED today. Reportedly, the charges are in relation to his secret hush-money payoff of porn star Stormy Daniels just before the 2016 election, in hopes of improving his chance of winning. But we don't know, because the indictment by a New York grand jury is still sealed until next week.

The charges, brought by Manhattan District Attorney Alvin Bragg, whatever they are, represent the first indictment of a U.S. President in history. Trump will reportedly surrender next week in NYC, according to his attorney Joe Tacopina. He will then be finger-printed, booked and perhaps hand-cuffed before his arraignment. We'll see if that all happens.

Accountability still matters. Even for apparent Presidential misdeeds from more than 40 years ago, as discussed on today's BradCast. [Audio link to full show follows this summary.]

Last week, New York Times' Peter Baker had quite a scoop. Ben Barnes, an 85-year old, longtime Democratic operative from Texas, detailed his claim that he and former Democratic Texas Governor turned Republican Presidential candidate John Connally took a trip through Middle Eastern capitals in the summer of 1980 to help convince Iran to not release the 52 Americans being held hostage until after that year's election.

His claim was that Connally, eyeing a cabinet role in the Reagan Administration, was hoping to send the message to Iran that they would get a better deal with Reagan than with Carter. Barnes said the pair were debriefed upon returning stateside by Reagan campaign manager and, later, CIA Director, William Casey. The campaign was reportedly terrified that Carter would win the release of the hostages that year in what would become known as the "October Surprise".

Instead, the hostages were ultimately released within an hour after Reagan being sworn in in January of 1981.

Our guest today, RUSS BAKER, (no relation to the Times' Peter Baker), is a longtime investigative journalist, author and now Editor-in-Chief of WhoWhatWhy.org. He has personally known Barnes for years and tells us that he isn't buying his story in the Times, said to have been revealed now by Barnes because the 98-year old Carter, who recently began hospice care, deserves to know the truth about what really happened.

Baker has been investigating the claim for decades that Casey himself engineered the "traitorous" deal on behalf of the Reagan camp and finds that explanation far more plausible than the Barnes/Connally scheme. Baker wrote his own response to Peter Baker's exclusive in a detailed newsletter article over the weekend headlined "The Iran Hostages, Carter, Reagan, and Bush: What the NY Times ‘Scoop’ Missed."

But whether it happened as Barnes claims or in some other way, Russ Baker, author of the 2009 best seller, FAMILY OF SECRETS: The Bush Dynasty, America’s Invisible Government, and the Hidden History of the Last Fifty Years explains why all of this still matters 43 years later; how the corporate media has largely ignored what would have been an extraordinary scandal by the Reagan campaign, George Bush Sr.'s role in all of this, and how different the world would likely be today if not for Reagan's defeat --- by hook or by crook --- of Carter.

"If Reagan had not been elected, I think it's safe to say that George HW Bush would not have been elected President himself," Baker tells me. "Then we wouldn't have had the Gulf War. His son wouldn't have become President and we wouldn't have had the Iraq War. You might not even have had 9/11, frankly, because a lot of the anger that generated these activities that led to 9/11 [which] had to do with policies that were carried out by these presidencies. Maybe even more importantly, there are huge differences between Democratic and Republican Administrations around climate change. Think of what would have happened if Al Gore had been President. You can be pretty sure we would have had a very different policy years ago about climate change. So our very ability to continue to live on Earth may have been affected by all of these things."

"I don't think they would have changed the media ownership laws. I think there would have been a lot more regulation. I don't think you would have even had a Rupert Murdoch and a Fox News. I don't think you would have had the current composition of the Supreme Court and all of their rulings for business and the wealthy. I think campaign contributions would have been restricted, and that would have changed Congress itself," He continues. "So whatever you want to pick, I think it basically was a coup, by making sure Carter didn't get re-elected. And all of these regimes since then were extensions of that coup government. With some partial breaks, I would say --- people like Clinton and Obama, very very limited in their ability to do much. I think their hands were largely tied. So a very profound change to everything as a result of this October Surprise situation."

As to the corporate media's failure in all of this, it's not that they won't hold Presidents and candidates accountable, says Baker, as he lists a bunch of Democratic candidates and Presidents whose "scandals" have been covered in great detail by the media, "but they seem to go hard only on certain people, and not always for the right reasons."

There is much more to tune in for in today's conversation that it'd be impossible to summarize here.

Finally, we close with some news of the day, including the huge, deadly tornado that ravaged parts of rural Mississippi over the weekend, and the connection to climate change, as Desi Doyen joins to explain.

Also, we have the latest on today's mass shooting at a private Christian elementary school in Nashville, Tennessee, where three 9-year old and three adults were murdered by an assault weapon-wielding 28-year old woman. It was the 129th mass shooting of the year in the U.S., according to CNN and the Gun Violence Archive.

As the breaking news of the shooting was being broadcast live today on Fox "News", a woman whose family was victim to another recent school shooting in a different state happened to be visiting Nashville. She briefly took over the cameras to explain how tired she was of all of this. Fox, after breaking away and then returning to the woman several times, finally cut her off, with anchor John Roberts concurring that he and his colleagues are, in fact, also becoming tired of the carnage. But are they really? You certainly wouldn't know it from all the activism that Fox "News" does in favor of elected officials who continue to block any and all rational gun safety legislation.

We have a few words for Roberts and Fox in response at the end of today's program...

Uncertainty and necessity of Trump indictment(s); Bragg ponders 'perp walk' protocol; MAGA fears a protest 'trap'; Fox 'News' eating its own...

Looks like Donald Trump was not "ARRESTED ON TUESDAY" as he lied (again) to his easily-duped followers over the weekend. But, just to put this up front on today's BradCast: We reject the notion that indicting the former President in relation to a hush-money payment made to help him win the 2016 Presidential election --- and the payments made while he was in the White House to cover it all up --- is a "minor crime" not worth indicting a former President for. [Audio link to full show follows this summary.]

That point is explained in much more detail on today's program, along with other related stories and important points, as the GOP begins to collapse in on itself...

  • Given that no U.S. President has ever been indicted, nobody knows how (or if) this will work out, and what will happen after Manhattan District Attorney Alvin Bragg in New York (or Fani Willis in Georgia, or Special Counsel Jack Smith at the federal level), actually brings an indictment against Trump. That is, presuming one or more of them actually do, as we also discussed with callers on yesterday's program.
  • A so-called "liberal" at Facebook was critical of our coverage yesterday, even if he doesn't appear to have either listened to it, or even read the item we posted along with it. His critique seems to be that, on this week's 20th Anniversary of George W. Bush's unlawful, accountability-free invasion of Iraq and the war crimes that followed it (as discussed yesterday as well), we shouldn't be wasting time discussing accountability for Donald Trump. He is wrong for a host of reasons...
  • ...Several of which also happen to be discussed in Will Bunch's newsletter at Philly Inquirer today, headlined "U.S. presidents and their crime spree since 1968." Bunch concludes his piece with this on-point observation:

    So let me get this straight: We look the other way when our leaders oversee war crimes or greenlight torture or commit quasi-treason with foreign adversaries because the American presidency is too big to fail, but we're also going to ignore a cut-and-dried lower-level crime because it's too small? I'd argue that charging Trump with violating a law that applies to 333 million other Americans is a first baby step toward undoing 55 years of gross injustice, and it's long overdue. We need to rediscover that it's still illegal even when a president does it.
  • Meanwhile, as GOP House Judiciary Committee Chair Jim Jordan (along with the Republican chairs of the Oversight and Administration Committees) is demanding NY D.A. Bragg come in to testify and turn over all documents from his criminal grand jury probe of Trump --- before any indictment has even been issued --- it seems worth noting that Congressional subpoenas are now optional. Jordan and House Speaker Kevin McCarthy and several other GOP members made that clear last year when they ignored similar requests from the House January 6 Committee and faced no accountability for their Contempt. Nonetheless, they are apparently hoping to weaponize the federal government at this point to prevent elected state law enforcement officials from doing their job of fighting crime.
  • All of that, while Bragg is reportedly considering whether Trump will be forced to carry out the same "perp walk" that all other white collar criminals facing felony crimes in NYC must face, or whether a former President should be given special consideration for some reason.
  • At the same time, in the wake of Trump exhorting supporters to "PROTEST, PROTEST, PROTEST!!!", very few seem to be answering his call so far. That may be because many of them reportedly believe it's all a trap by the Feds! (Marjorie Taylor Greene, however, believes there's no need to protest, because any indictment of Trump only assures he will be re-elected in 2024. Maybe. Though it begs the question as to how other Republicans, like Jordan and Trump himself, can claim that indictments are only being brought to hurt his chances in 2024.)
  • And while all of those rightwingers collapse in on themselves, Fox "News" appears to be doing the same thing. A producer named in Dominion Voting Systems' $1.6 billion defamation suit against the Republican propaganda outlet is now suing Fox, claiming misogyny by Tucker Carlson and his staff and that she and Maria Bartiromo are being sacrificed by the company for their false reporting on fraud in the 2020 Presidential election. She is also charging she was coerced by Fox attorneys into offering misleading testimony in the Dominion lawsuit. As Media Matters' Angelo Carusone told us on this show several weeks ago regarding the damage that Dominion's suit may due to Fox: "It's sort of like a Jenga puzzle. Pulling one block is not going topple it down, but its certainly gonna make it a lot more vulnerable to toppling. The tiniest little breeze will probably knock the rest of it over." --- Well, it's getting pretty windy at Fox "News" these days.
  • Finally, Desi Doyen joins us for our latest Green News Report, including news on the 12th(!) major winter storm now slamming California this season; unprecedented heat records smashed in Argentina; and the latest warning from the U.N. that the window for avoiding catastrophic, irreversible damage to the climate is almost closed, requiring an unprecedented worldwide effort to radically cut fossil fuel emissions before the end of this decade...

On today's BradCast: If lying to Americans about crime failed to result in a "red wave" for Republicans in 2022, perhaps lying to them about "woke" banks will do the trick in 2024! I'm sure it'll work. [Audio link to full show is posted below this summary.]

Among the many stories and important context offered on today's program...

  • Moody's considers downgrading the U.S. banking sector in the wake of several bank failures in recent days, even while declaring that the industry's outlook remains strong.
  • Inflation has eased slightly over the past month, according to the U.S. Bureau of Labor Statistics. Wall Street rejoices.
  • Elizabeth Warren, as usual, was right when she warned in 2018 that rolling back the Dodd-Frank Act (enacted to prevent bank failures after the 2008 banking crisis) to loosen regulations and oversight of banks like Silicon Valley Bank and Signature Bank would end in disaster. As she noted at the time, before Donald Trump signed the bill to loosen restrictions on financial institutions: "Washington is about to make it easier for the banks to run up risk, make it easier to put our constituents at risk, make it easier to put American families in danger, just so the C.E.O.s of these banks can get a new corporate jet and add another floor to their new corporate headquarters." As usual, we should have heeded her warning.
  • Today we explain exactly happened that resulted in the failure and subsequent federal takeover of SVB and Signature by the FDIC, in case it hasn't yet been made clear. And, while the unnecessary failures stem directly from loosening government oversight and restrictions on banks to gamble with depositer funds, as allowed by Congress and Trump in 2018, what didn't cause it, is "wokeness." That's the explanation from Fox "News" over the past few days for what happened.
  • The cause of the bank failures was also not ESG (Environmental Social Governance) or DEI (Diversity, Equity and Inclusion, as Fox itself boasts about on its own company's website) or CRT or LGBTQ or anything else that Fox and Ron DeSantis are lying about to Americans about.
  • But what does appear to be true, when it comes to the latest Fox/DeSantis boogeyman of "woke", is that Americans have no problem with being "informed, educated on, and aware of social injustice," the definition of "woke" according to most Americans in a new USA Today/Ipsos poll. The same survey also finds Americans overwhelmingly (75% to 21%) in opposition of book banning by state's such as DeSantis' Florida.
  • 81-year old Republican minority Senate Leader Mitch McConnell has now been released from the hospital after suffering a concussion from a fall last week. But he has checked into inpatient rehab for some reason. We truly hope he will be okay, if only because he may now be the only thing still holding together Congressional GOP support for Ukraine in its war against imperialistic invading Russia.
  • As we learned on Monday night via Tucker Carlson on Fox, DeSantis is now against supporting Ukraine in what he now describes as a "territorial dispute" with Russia, the authoritarian-led nation that has invaded it. As it turns out, DeSantis, while a member of Congress, was strongly in favor of the U.S. supporting Ukraine with lethal aide against Putin. That was before he became a contender for the 2024 GOP Presidential nomination and decided to be against it. The survival of democracy in Europe is, apparently, no longer important for either of the GOP's two 2024 front-runners. Donald Trump has said his "peace plan" is to allow Russia to "take over" parts of Ukraine.
  • But some good news for democracy out of New Mexico, where the state legislature finally passed a voting rights bill on Monday that will expand the franchise to all residents who are now out of prison; strengthen access to the ballot for Native Americans; make Election Day a state holiday; and significantly strengthen the state's automatic voter registration program.

Russia's missile assault on Ukraine; Trump's 'peace plan' censored by Hannity; Dominion will win Summary Judgement against Fox, attorney explains; 1/6 rioters trashed Senator's office; Finchem sanctioned in AZ; La Nina finally over; NY on verge of indicting Trump?...

It's another news-packed BradCast today, including some details and context you likely have not heard elsewhere.

Among our many stories today...

  • More war crimes by Russia, as the imperialistic aggressor nation launched a brutal, nationwide missile assault against Ukraine on Thursday. They claimed the bombardment was a "retaliation strike" for "terrorist actions" said to involve an attack by Ukrainian nationals who crossed the border into Russia's Bryansk region. There was no apparent evidence of such an attack as of this morning, but golly it must be bad when someone crosses your border to attack you.
  • Donald Trump has been claiming he has a plan to end the war in Ukraine "immediately". He revealed his ingenious plan on Sean Hannity's radio show this week. Apparently, the secret is to allow Russia to "take over" parts of Ukraine. When Hannity aired parts of that radio interview on his Fox "News" show later that night, they conspicuously, and clumsily, removed that part of Trump's comments. We share the evidence today.
  • It was efforts like that --- seemingly to protect the disgraced former President --- that helped Fox "News" find itself as defendant in a $1.6 billion defamation suit by Dominion Voting Systems which charges the Republican propaganda mill knowingly, and with "actual malice" lied about the company's voting systems after the 2020 election. The voluminous, well-documented allegations demonstrating that Fox knew it was lying about false fraud claims have been well covered elsewhere. But today we take a few minutes to share some specific thoughts from an attorney who predicts that Dominion will win their motion for Summary Judgement on liability in the case, leaving only the need for a jury trial on damages. It's actually less a prediction than a matter of law, according to the argument. We explain that argument today, as we haven't heard it offered broadly elsewhere.
  • This week, Fox' Tucker Carlson has been busy attempting to rewrite the history of Trump's deadly January 6, 2021 insurrection as little more than a peaceful "sightseeing" tour by those who "revered" the Capitol. His laughable segments have been roundly criticized from all quarters and are based on what is purportedly previously unseen security camera footage from the Capitol given to him exclusively by House Speaker Kevin McCarthy. But, in addition to the evidence of the deadly riot that you have already seen with your own eyes, NBC News offered some previously unseen video today of the 1/6 trashing of a Republican Senator's office, by a guy who drove a stun gun into a police officer's neck that same day. Apparently, Tucker has yet to reveal that video to his viewers.
  • Arizona's failed 2022 Republican Sec. of State candidate and 2020 election denier Mark Finchem was sanctioned by a state judge this week for "groundless" claims that he lost his 2022 election due to fraud. The judge ordered him to pay attorney fees for the winning Democratic Secretary of State and Gubernatorial candidates after noting that "none of Contestant Finchem’s allegations, even if true, would have changed the vote count enough to overcome the 120,000 votes he needed to affect the result of this election." Nonetheless, Finchem still refuses to concede and says he will appeal the court's decision.
  • The three-year La Nina --- which increases Atlantic hurricane activity and worsens western drought, among other things --- is now officially over, according to NOAA. We explain what that means...and doesn't.
  • Desi Doyen joins us for our latest Green News Report, with even more bad news than usual, most of which comes courtesy of the corrupt Big Oil industry.
  • And, finally, just before our hour is up, breaking news out of New York suggesting the Manhattan District Attorney is on the precipice of filing criminal charges against Donald J. Trump...

Guests: Political scientists Tarah Williams and Andrew Bloeser of Allegheny College; Also: Tucker, House GOP stepping on rakes...

Much of our politics in the U.S. these days warrants more mockery and less outrage. Some, however, warrants more concern than Americans may yet fully appreciate. We discuss all of the above on today's BradCast. [Audio link to full show is posted below this summary.]

First up, we started the year with many Democrats troubled by what Republicans might do with their Committee "investigations" upon gaining back majority control of the U.S. House. We advised at the time that the promised Committee probes of stuff like Hunter Biden and the so-called "weaponization" of the U.S. Government were more likely than not to backfire on Republicans.

If last week's impressively aggressive response by House Democrats to Chair Jim Jordan's supposed FBI "whistleblowers" is any indication, things are already going quickly South for them. The Dems' 300+ page report [PDF] details the testimony and backgrounds of the first of these "whistleblowers" to be interviewed by the new House Select Subcommittee on the "Weaponization of the U.S. Government." They turn out not to be whistleblowers at all, but paid Donald Trump shills and disgruntled conspiracists who are unable to cite any actual violations of law, according to the Democrats report.

In a similar vein, we strongly recommend mockery as the correct response to Tucker Carlson's silly, cherry-picked segments this week, supposedly based on 40,000 or so hours of U.S. Capitol security camera footage from January 6, 2021, turned over to him by House Speaker Kevin McCarthy. Tucker is hoping to rewrite the history and known facts of Trump's deadly insurrection as little more than "sightseeing" and "mostly peaceful chaos". As it turns out, the U.S. Capitol Police chief, top elected Republicans in the Capitol that day, and, yes, even Fox "News" itself, seem to strongly disagree with Tucker's attempted revision of history.

But, while much of the phony outrage by far-right trolls like Carlson and Jordan deserve more laughter and mockery than outrage or panic from Dems, there is still plenty to be concerned about in our post-Trump politics, according to fascinating findings from researchers based on a nationally representative survey of 1,500 Americans from strong Democrats to independents to strong Republicans.

One of the most alarming findings is that "majorities of every political stripe agree or strongly agree with" the statement that "the only way our country can solve its current problems is by supporting tough leaders who will crack down on those who undermine American values. "

That, of course, sounds somewhat like authoritarianism, though the researchers left concepts like "current problems", "crack[ing] down", and "American values" intentionally vague in their survey for reasons they explain on today's program.

We're joined today by two of the report's four authors, Allegheny College Asst. Professor of Political Science TARAH WILLIAMS and Associate Professor ANDREW BLOESER, Director of the college's Center for Political Participation. Their recent article, summarizing their study's findings, leads with the troubling news of majorities, across all partisan lines, who support "crack[ing] down on those who undermine American values."

"It was fairly remarkable," Williams explains. "We anticipate that those who are answering this as Strong Democrats vs. Strong Republicans may have quite different visions of those folks who undermine American values. But the fact that there is this visible support across the board, we thought was really quite concerning."

The researchers discuss findings on partisan positions regarding things like "bending the rules" or "using rough language" to criticize political rivals or to "get things done," as well as how Americans feel about shutting down news organizations "attempting to undermine American values". Unsurprisingly (if still disturbingly) 72% of self-identified "strong Republicans" either agree or strongly agree with shutting down news organizations. Troubling in another way, a third (33%) of Strong Democrats feel the same way!

As to why some of the terms used in the survey are left intentionally vague, Bloeser explains, "Respondents may have their own ideas about what 'American values' mean to them. The next critical question is, 'What would you do in the service of your values? You believe that you are right, therefore, are you willing to say some groups in society should be, in a very blanket way, criticized, demeaned? Do you think that we should shut down the free press, something that is clearly anti-democratic? Do you think that it's fair for a leader to bend the rules for some groups in society to the detriment of others?' So you might have a variety of different goals that you think are noble in mind, but at the point where you're willing to undermine democracy, you're trading in something pretty significant there."

"Significant proportions of people across the political spectrum, but especially on the political right - Republicans and Strong Republicans --- are willing to say that crackdowns on entire groups, shutting down the free press, and bending the rules for people like them would be acceptable in service of what they think America should be. And that really is the pattern that we want be concerned about."

"It's not a tie," Bloeser is careful to note. "We certainly see it more on the political Right among self-identified Republicans. But the fact that some of those attitudes also exist fairly widely among Democrats should also be a concern. Because when one group starts to see another group as an existential threat, these are the things that can pull apart the fabric of society, and that can really undermine democracy."

Their study, published by Cambridge University Press, is titled "Are Stealth Democrats Really Committed to Democracy?" Williams makes clear that the reference is to small "d" democrats, as opposed to the Democratic Party.

"'Stealth democracy' is a notion that there are some individuals who would prefer a government that they don't really have to see," she tells me. "They don't like high-conflict politics. They think people making compromises is weak or failing to represent values. And they think it's a slog, which, let's be honest, policy-making is. So for those reasons, people who tend to be stealth democrats tend to prefer this expedient process that in a lot of ways looks distinct from what we think about as the necessary machinations of democracy."

As I note in response, "stealth democracy" sounds a whole lot like autocracy to me. Neither Williams nor Bloeser seem to disagree...

There's a reason we don't spend much time discussing the Right's phony "culture war" BS on The BradCast. Today, we talk about why. [Audio link to full show follows below.]

We go into much more detail on the program, but perhaps the biggest reason is likely that most of these so-called "culture wars" aren't any such thing. But talking about it, helps to make them appear to be such a thing. Whether it's outrage over BLM or CRT or, more lately, ESG, the GOP and FNC and all of their various corporate sponsors (mostly from the oil and gas industry), prefer spending time on ginned-up, phony nonsense to keep their readers, listeners and viewers angry, so they don't notice how the Republican Party has absolutely nothing but pain and thievery to offer them.

When the non-wingnut corporate media and Democrats jump in to respond to those ginned-up issues, sadly, the Right has succeeded in creating yet another "partisan" "culture war" out of whole cloth, in which they are able to claim there is a pitched partisan battle between "both sides". They've been mastering this scam for years, and the media and Dems have been falling for it for years as well.

One might think, for example, that the nation is bitterly divided in the "culture war" over abortion rights, one of the GOP's decades-old stand-bys. In fact, it's not much of a partisan or left/right or Republican/Democratic issue at all. The vast majority of Americans, across party lines, support reproductive freedom. And a recently released detailed survey from PRRI (of about 23,000 people in all 50 states!), demonstrates that there is not one single state in the union where a majority of the population supports the overturning of Roe v. Wade. Not one. Not even in the Deep South.

But maybe if you're furious enough about "ESG" you won't notice the Constitutional freedoms the GOP has just stolen from all of us. What's ESG? Well, the folks who watch Fox "News" almost certainly know what it is. It stands for "Environmental Social Governance." And, while the corporate concept has been around for about 20 years, Republicans, with the encouragement (and lots of money) from the fossil fuel industry, have only recently decided to become furious about it. Yup, they're hoping --- and the media are helping --- to turn it into yet another pretend "culture war".

Republican Presidential hopefuls like Florida's Ron DeSantis, Texas' Greg Abbott and former Vice President Mike Pence are all over those "woke" corporations who consider things like the health of the environment when making investments and other business decisions. As discussed today in some detail, Republicans have now decided that sort of thing must stop immediately! Failing to invest as much money as possible, including public funds, in the fossil fuel industry that is helping to wipe out humanity, will almost certainly result in grandma's retirement fund going bankrupt! Or something. And it now appears we're all gonna be dumb enough (again) to help these fake Fox "News" and fossil fuel industry outrages become a real thing.

Just this once --- hopefully, today only --- we're gonna talk about it so you understand exactly what's going on and how you're getting played...so hopefully we'll all stop falling for these scams over and over again.

Also today, a follow-up to a story we covered last week, when Kris Mayes, the new Democratic Attorney General of Arizona, released documents from her office that the previous Attorney General, Republican Mark Brnovich, appears to have forgotten to release before leaving office in January.

Among other things, the documentation reveals that Brnovich's office spent some 10,000 taxpayer-funded hours in 2021 investigating phony claims of election fraud in the state's 2020 Presidential election, assigning everyone in the office to the matter at one point. And though the probe was completed by March 2022, Brnovich never bothered to release the findings, that there was no evidence the election was stolen from Trump in Arizona, to the public. Instead of letting his state and the nation know, during his failed run for the state GOP nomination for U.S. Senate last year, Brnovich lied about the investigation. He told state lawmakers and the public that his office had found "serious vulnerabilities", even while he was ignoring his own staff's recommendations to come clean about the facts.

We covered those disturbing revelations from Mayes last week. And now, the state's new Democratic Governor, former Sec. of State Katie Hobbs, has filed a complaint against Brnovich with the state bar association. Hopefully, that complaint will result in sanctions or even disbarment for the state's corrupt, former top attorney, who was already under sanctions from the state bar association, as it turns out, when he misled the public last year about all of this.

Today on The BradCast: It's truly remarkable that the former President's Republican supporters keep lying on his behalf, despite losing elections and more in the bargain. They continue to pay an extraordinary price, even as they continue to lie and lose in the process. They'll figure this out eventually, right? [Audio link to full show follows this summary.]

Among the stories covered on today's program (after a thought or two on this weekend's coast-to-coast climate chaos, including an incredibly rare blizzard warning here in Los Angeles!)...

  • New polling finds Joe Biden's approval ratings have been quietly, but steadily rising over the past several months. Donald Trump's are hitting new lows among his own party faithful.
  • Arizona's former Republican Attorney General, Mark Brnovich, knew there was no evidence of fraud in the 2020 Presidential election, but he kept that finding a secret while lying about it during his unsuccessful run for the 2022 GOP U.S. Senate nomination. According to documents released by Kris Mayes, Arizona's new Democratic A.G., even after the failed Cyber Ninjas "audit" of the 2020 Presidential election confirmed Biden's victory over Trump in the state, Brnovich directed "all hands" in the A.G.'s office to investigate claims of election fraud. Some 10,000 taxpayer-funded hours were spent with no evidence of a stolen election to show for it. But, while the state probe was all but completed by March of 2022, Brnovich pulled a "Bill Barr" by releasing a memo falsely claiming the office had found "serious vulnerabilities", even after his own investigators specifically refuted the assertions in the memo. He ignored them.

    The actual findings of the expensive state investigation, though completed, were never released before he was replaced by Mayes in January. Despite his hard work at lying for Trump, he lost the U.S. Senate primary anyway to Blake Masters, who lied even harder for the disgraced former President. Masters then went on to lose the general election to Democrat Mark Kelly.

    As the Washington Post's exclusive notes, Brnovich and Masters were hardly the only ones who lied about 2020 fraud in AZ before then going on to lose their elections last year. GOP Sec. of State candidate Mark Finchem lost to Democrat Adrian Fontes. Finchem, previously a state Rep, repeatedly claimed a "source" had told him that 30,000 votes were stuffed into ballot boxes before admitting privately to Brnovich's investigators "he did not have any evidence of fraud and that he did not wish to take up our time." It's one thing to lie to GOP voters. They have come to expect that by now. But its unlawful to lie to state law enforcement officials, as Finchem and other officials who also clammed up before actual investigators, clearly knew.

  • AZ's GOP candidate for Governor, Kari Lake, also lied about 2020 fraud before going on to lose her 2022 race to Democrat Katie Hobbs. And Lake is still lying and losing in her challenge to last year's election. First, she lost in court in December when a state judge dismissed her demand for a new election finding "no basis justified settings aside the election results." She lost again last week at the appeals court which determined "Lake's only purported evidence...was, quite simply, sheer speculation." After her second loss, loser Lake tweeted out, along with a fundraising link: "BREAKING: I told you we would take this case all the way to the Arizona Supreme Court, and that’s exactly what we are going to do. Buckle up, America!" (Please hold your laughter until the end.)
  • Despite all of the lies and losses, the Republican National Committee is now planning to increase their lies based on false 2020 election fraud claims in advance of 2024. Why not? It's worked so well until now! In the meantime, it was reported on Wednesday that Ivanka Trump and Jared Kushner were subpoenaed to testify before the federal grand jury investigating the January 6 insurrection and related matters. And today, a federal court judge said Trump himself can now be deposed in lawsuits filed by former FBI employees Peter Strzok and Lisa Page who charge he unlawfully targeted them for retribution during the investigation of Russian interference in the 2016 election.
  • And then there is long time liar and loser Steve Bannon, one of Trump's several criminal 2016 campaign managers, who later went on to be fired as a White House political advisor. Bannon was recently sentenced to four months in prison for Contempt of Congress after refusing to testify in response to a subpoena from the House January 6 Committee. Still out of prison pending appeal, Bannon's legal problems have only gotten much worse since his conviction. New York state has indicted him for money laundering, scheming to defraud, and conspiracy. And today we learned that last week his own lawyers sued him for failure to pay nearly half a million dollars in legal fees! (Okay, now you can go ahead and laugh.)
  • Then there's longtime GOP political operative Jesse Benton, who has worked for Ron Paul, Rand Paul, Mitch McConnell, Trump and many others over the years. He was pardoned by Trump after being found guilty of bribing an official for an endorsement of Ron Paul during the 2012 GOP Iowa Caucus. Last week, Benton was sentenced to 18 months in prison for an entirely separate felony related to accepting $100,000 from a Russian national who wanted a photo with Trump during the 2016 election.
  • Finally today, we move on to our latest Green News Report with Desi Doyen, as Republicans continue to pretend to be concerned about the toxic chemical train derailment in Ohio several weeks ago. It's all quite pathetically amusing to watch, as Trump turned the poisoned rural town of East Palestine into a 2024 campaign stop this week and Fox "News" boneheads like Brian Kilmeade actually begin to demand regulations of the rail industry! Not unlike the regulations that the Obama Administration had put in place years ago, before the Trump Administration subsequently rolled them all back.

Liars and losers gonna keep lying and losing...

Guest: Angelo Carusone of Media Matters; Also: GA Special Grand Jury forewoman hints at coming indictments; O'Keefe out at Project Veritas after 'bullying', 'financial malfeasance'...

"Industrial-scale defamation is not free speech," our guest on today's BradCast insists, as very real accountability for many liars and scoundrels and fake news con-artists on the Right gets closer with each passing day. [Audio link to full show follows this summary.]

FIRST: The forewoman of the Special Grand Jury in Georgia which recently completed its work in Fulton County, suggests multiple people have been recommended to District Attorney Fani Willis for indictment. "It is not a short list," teases Emily Kohrs about who her panel suggested to Willis should be charged in the investigation of the attempt to steal the 2020 Presidential election in the Peach State by Donald Trump and his top supporters. While Kohrs did not offer specific names, she did say, "you're not going to be shocked. It's not rocket science," before offering other somewhat cryptic --- if tantalizing --- hints.

NEXT: More accountability for right-wing liars. In this case, James O'Keefe, the Republican activist and scam-artist who initially made his name in 2010 by releasing deceptively edited videos which falsely suggested he dressed up as a 70s-era Blaxploitation pimp to walk into ACORN offices for advice on sex trafficking and how to avoid taxes. In fact, he never dressed as a pimp in those office, and never received any such advice. (See our full Special Coverage here.) Years --- and millions of dollars of dark-money later --- O'Keefe is now reportedly out at Project Veritas, his own ironically-named fake news and entrapment organization. Its Board of Directors detailed "financial malfeasance" by O'Keefe, and claims that he bullied staffers. Yes, the scammer who bilked Rightwingers out of millions, using hidden video "stings" to pretend to be a journalist uncovering "waste, fraud and corruption" on the Left, is seemingly undone by his own waste, fraud and corruption. Go figure.

THEN: We're joined by ANGELO CARUSONE, President and CEO of media watchdog Media Matters for America, to discuss Dominion Voting's $1.6 billion defamation suit against Fox "News", after the network's executives, hosts and guests repeatedly offered massive lies to their audience about election fraud following the 2020 Presidential election.

Of course, like us, Carusone has been watching Fox lie on air for years now. So, is there something different this time around? Carusone explains why he believes the revelations from hundreds of insider texts, emails and depositions in Dominion's redacted 192-page brief [PDF], released last week in its motion for summary judgement against Fox, is seemingly very different from the lies that Fox has been caught telling in the past.

We discuss how "for so long the commercial media enabled Fox," allowing it to be regarded as an actual news organization, when it is not. Non-Rightwing corporate media outfits "actually enabled Fox News in a way, by treating them as anything other than the partisan political operation that we all know they are." Carusone argues that what is revealed in the Dominion brief "is so incontrovertible that even the enablers can't engage in the type of enabling --- or even just silence --- that they previously had for too long."

We discuss the "hypocrisy" of Fox' First Amendment defense and their claims that Dominion has "cherry-picked quotes stripped of key context," given that cherry-picking out of context quotes is actually the Fox 'News' business model!

We discuss what the hell happened to formerly respectable --- before joining Fox --- financial news reporters like Maria Bartiromo and Lou Dobbs, who seemed to lead the coverage of phony 2020 fraud claims at the network by featuring Trump's loony attorneys like Sidney Powell and Rudy Giuliani as guests, despite the fact that they had offered less than zero evidence in support of outrageous claims that Dominion's voting systems flipped millions of votes to steal the election for Joe Biden from Trump.

And, perhaps most crucially, we discuss what may happen if Fox loses this one, and how a judgement of $1.6 billion may be the least of the company's problems. "It's not just going to end at the $1.6 billion," says Carusone, "because what ends up happening is that shareholders themselves then begin to sue for breach of fiduciary duty. Because it's very apparent that the Murdochs made misrepresentations about the nature of this litigation for quite some time." While losing the case means losing a lot of money, Carusone argues, "it will set them up for additional litigation that will compound the problem. They won't be able to sustain that from a financial perspective. It puts control of the company in jeopardy."

Additionally, he explains, it will weaken their position with cable companies, from whom Fox currently receive the bulk of its revenue, particularly as advertisers have fled their toxic air to the point where MyPillow guy, Mike Lindell, is now their single largest client. "It's sort of like a Jenga puzzle," Carusone tells me. "Pulling one block is not going to topple it down, but it's certainly going to make it a lot more vulnerable to toppling. And this one is a pretty key part of that piece --- just the tiniest little breeze will probably knock the rest of it over."

Also: Computer tabulators declared losing candidates to be winners in at least two states in the November, 2022 mid-terms...

Yes, it's possible that two seemingly conflicting things can be true at once. On today's BradCast we report on two different cases where that is true, regarding Russia's war on Ukraine and Dominion Voting Systems' defamation case against Fox "News". [Audio link to full show is posted below this summary.]

First up today, on Presidents' Day, Joe Biden made a surprise visit to Ukraine to meet with its President Volodymyr Zelenskyy just days before the first anniversary of Russia's horrific invasion of its sovereign neighbor. It was also just days after Vice President Kamala Harris declared at the Munich Security Conference over the weekend that the U.S. believes Russia has committed "crimes against humanity" in their unlawful invasion.

In his remarks, President Biden described "a brutal and unjust war," as air raid sirens were heard during his visit to the Ukrainian capital. "One year later, Kyiv stands," said Biden after meeting with Zelenskyy at Mariinsky Palace. "And Ukraine stands. Democracy stands. The Americans stand with you, and the world stands with you." As we discuss, yes, it's possible to understand various diplomatic missteps taken by the U.S. and NATO in Eastern Europe following the fall of the Soviet Union, while still being able to hold the correct party accountable --- in this case, Russia --- for unjustifiable and continuing atrocities.

As yet another war in defense of democracy rages in Europe against a tyrannical autocracy, a decades-long champion of democracy in the U.S. and across the world is now in his final hours. On Saturday, the Carter Center in Atlanta announced that "After a series of short hospital stays," 98-year old former President Jimmy Carter has "decided to spend his remaining time at home with his family and receive hospice care instead of additional medical intervention."

We share some thoughts today on the legacy of our 39th President, including some of his comments last year on the first anniversary of the Donald Trump-incited Republican attempt to overthrow the U.S. Government on January 6, 2021. "One year on, promoters of the lie that the election was stolen have taken over one political party and stoked distrust in our electoral systems," Carter wrote at New York Times. "These forces exert power and influence through relentless disinformation, which continues to turn Americans against Americans."

The "relentless disinformation" of Fox "News" has been on full display for the past several days, following last week's redacted unsealing of Dominion Voting Systems' 192-page motion [PDF] seeking summary judgment in its $1.6 billion defamation suit against the right-wing fake news outlet. As the striking filing reveals in detail, Fox hosts and executives alike knew they were broadcasting fake, evidence-free claims of election fraud by Trump and his supporters following the 2020 election. They didn't much care. Instead, they feared losing viewers and chose to put company profits above both truth and the health of American democracy.

Dominion may prevail in this case. We hope they do. Even as we have been no friend to the company or any of the other oft-failed, private computer voting and tabulation firms over the past 20 years. In fact, some of the news misreported by Fox and Trump's supporters like Sidney Powell and Rudy Giuliani was taken directly from some of our accurate, exclusive reporting from years ago. But, again, two seemingly conflicting things can be true at once. Fox lied about election fraud and should be held accountable for that, and Dominion and other voting system vendors have repeatedly failed in American elections.

By way of fresh evidence to support that charge, we close with details on voting system failures in both New Jersey and California in November of 2022. In both cases, the systems ended up naming candidates who actually lost to be the winners and vice versa. In Monmouth County, NJ, the ES&S voting tabulators allowed duplicate votes to be uploaded to it twice. It wasn't discovered until last month. In Alameda County, CA, the tabulators were programmed incorrectly to do the impossible math of Ranked Choice Voting (RCV) elections in the Bay area. It was discovered in late December last year by a pro-RCV organization who happened to run the math on their own computers and discovered the error.

In both cases, the errors were discovered after losing candidates were certified as winners. How many places did that happen but wasn't ever discovered, because human beings rarely bother to count ballots to make sure the computers did so accurately. This is what comes of outsourcing public elections to private companies and running elections on computer systems that are virtually impossible to oversee by the American public.
