On today's BradCast we'd be delighted to NOT cover Donald Trump. But, frankly, as annoying as it is, that would be journalistic malpractice for a number of reasons. We discuss the journalists' dilemma in covering Election 2016, and try our best to otherwise focus today on substance that both matters and is otherwise being ignored by the corporate media amidst the madness. To that end, the U.S. Dept. of Justice investigation of the Baltimore Police Department in the wake of the 2015 Freddie Gray killing sets off troubling, if all too familiar, alarm bells. Nonetheless, the findings represent yet another success of the Black Lives Matter movement.

Then Carroll Muffett of the Center for International Environmental Law (CIEL) joins us to discuss startling new revelations from their "Smoke & Fumes" investigation detailing a treasure trove of old tobacco industry documents illustrating that Big Oil did not, in fact, model their decades of science denial after Big Tobacco. As it turns out, it was Big Tobacco who lifted their playbook from Big Oil!

Over the past year we've covered the explosive discovery of company documents revealing that Exxon knew of the dangers of man-made climate change from the burning of fossil fuels as early as the 1970s, and began secretly funding climate science denial organizations not long thereafter. But CIEL's new investigation now details how some 100 recently-noticed documents unearthed from among 14 million at the Tobacco Archives (a public University of California website database of industry documents made available via U.S. smoking and health litigation) offer jaw-dropping revelations suggesting Big Oil's anti-science scam actually began as long ago as the late 1940s. That work resulted in collusion with the tobacco industry in the 50s, to seemingly help avoid accountability and legislation --- no matter the cost to the public --- that might cut into profits for both industries.

"The [tobacco industry's] 'Smoke and Fumes Committee' had its genesis in the oil industry's efforts to respond to bad press, bad science, and the risk of regulations resulting from the L.A. smog crisis of the late 1940s and early 1950s," Muffett explains. "So, in late 1946, a group of oil industry executives came together and decided that they needed to create a joint effort to fund pollution science, and then combine that pollution science with an active PR effort that was designed to shape the public's opinion on the science related to environmental issues and air pollution issues."

"The tobacco companies themselves, when they were looking at how to develop their own deception campaigns around smoking, looked again and again and again to the oil industry for people, for models, and even for advice," he tells me, describing what has been found in the documents so far. "The links between the industries were far more extensive than we ever anticipated. What was truly novel in what we found was that it's not that Oil is the new Tobacco but that Tobacco was at one time the new Oil."

We go on to discuss how the recent discoveries are likely to effect ongoing investigation and litigation into ExxonMobil's deceitful practices by more than a dozen state Attorneys General; the "completely unprecedented" nature of U.S. House Republicans on the Science Committee attempting to intimidate those AGs and environmental groups with subpoenas; and the accompanying irony of the fossil fuel industry attempting to hide behind constitutional First Amendment protections for fraudulent practices (a tactic which failed when Big Tobacco used a similar defense during litigation in the 80s and 90s.)

On today's BradCast, voters head to the polls in West Virginia and Nebraska; The Philippines elects its own version of Trump (but worse); and the FDA issues deadly new rules that may wipe out an industry and help kill hundreds of thousands, if not millions, of American. [Link to full audio below.]

First up, it's Primary Election day again, this time in West Virginia and Nebraska (Republicans only). In WV, many voters will be forced to vote once again on 100% unverifiable touch-screen systems, though Donald Trump tells voters not to vote at all, at least until the general election. At the same time, new polling from Quinnipiac [PDF] shows Hillary Clinton virtually tied with or losing to Trump in three key swing-states (OH, FL and PA), while Sanders outpaces Clinton in each, beating Trump in all three crucial states.

Meanwhile, in elections overseas, London elects its first Muslim as Mayor, though he's worried he may not be able to visit other Mayors in the U.S. if Trump becomes President and, in The Philippines, it looks as if they have elected a new President who is even more disturbing than Donald Trump. So, yes, it can happen.

Then: the FDA issues insane new rules for electronic cigarette and e-liquid manufacturers which could end up killing the vaping industry that is currently helping to prevent the tobacco-related deaths of some 500k Americans each year. Chris Hughes, President of the PA Chapter of the Smoke Free Alternatives Trade Association, and owner of the Fat Cat Vapor Shop, explains the new onerous regulations and how Democrats are supporting them despite scientists and experts, such as those at UK's Royal College of Physicians who recently announced: "in the interests of public health it is important to promote the use of e-cigarettes...as widely as possible as a substitute for smoking."

If the misguided FDA rules are finalized, it could cost as much as $1 million to receive approval for every single vaping product, e-liquid flavor (including each level of nicotine). The only companies likely to afford that process are the Big Tobacco companies that the bulk of the vaping industry is hoping to put out of business. In turn, millions of folks who have quit smoking by moving to vaping (which has almost none of the dangers of tobacco cigarettes) are likely to begin smoking again. "People smoke for the nicotine but die from the tar," explains Hughes, adding, "there are over 7,000 chemicals in cigarette smoke. And many of them act in concert with nicotine to make it more addictive." That is not the case for vaping products!

As someone who, thanks to vaping, was able to quit the deadly habit after decades of smoking myself, this is a very disturbing development. It's made even more disturbing by the particular big name Democrats (some of the otherwise best Dems --- Hughes names names!) who support the new regulations that will only help both Big Tobacco and, as Hughes notes, "the same giant pharmaceutical corporations that make nicotine patches, lozenges and gums [and inhalers!] and view my business, and thousands of other small businesses in the country, as competitors."

"This plan, if its fully implemented," he says, "will close every vape shop like mine in the United States. The only other thing we can say certainly will happen is smoking rates will skyrocket again across all demographics. There are currently over 9 million adults using these products regularly in the U.S. and those people will seek an alternative product. The alternative for them may be to go back to smoking in many instance. Half of those people will die prematurely as a result of smoking. And that's the catastrophe."

While I try to contain my rage here, even in writing this item, Hughes suggests those who would like to support the effort to kill smoking by saving vaping should stop by the Consumer Advocates for Smoke-free Alternatives Association (CASAA.org). They offer a number of things you can do immediately. He also suggest you "call your representatives and tell them --- politely --- that you feel very strongly that the Senators should re-evaluate their stance on vapor products."

"It's difficult to understate the significance of this agreement," Dr. Michael E. Mann tells me on today's BradCast. "I think we are witnessing the end of the age of fossil fuels and the beginning of a new age of a clean global energy economy."

Mann, the Director of the Earth System Science Center at Pennsylvania State University, creator of the infamous "hockey stick graph", and author of The Hockey Stick and the Climate Wars: Dispatches from the Front Lines, was speaking, of course, of the historic U.N. Paris Agreement, where negotiators from some 200 nations unanimously agreed over the weekend to curb the release of greenhouse gases that cause global warming, in hopes of staving off the worst effects of climate change.

The landmark COP21 accord has been some 21 years in the making, if not many more, as explained during today's show. While cautioning that "the devil is in the details" and "reductions that we'll get out of this agreement alone won't be enough to keep us below dangerous levels of warming," Mann says the agreement finally "starts to put us on the path to avoiding dangerous climate change."

But is it too little too late? Is it even possible to keep global temperatures from rising no more than 2 degrees Celsius above pre-industrial times, as called for by the agreement (which also asks nations to keep that rise no higher than 1.5C, if possible)? Mann tells me he believes there is still time to avoid the worst consequences of man's behavior and decades of inaction.

"I can give that answer confidently, as a scientist who studies the numbers. Yes, it is absolutely still physically possible," he says. "What is more in question, of course: is it doable? Is it achievable? And that's a matter of political will. That's really the only limitation."

We discuss those political limitations and much more today, including Mann's op-ed in last week's New York Times slamming Rep. Lamar Smith (R-TX), Chair of the U.S. House Science Committee, for his "assault on climate science," as well as Smith's published response to that op-ed. "There's not a truthful word in his statement," Mann retorts.

I also ask the professor about former NASA scientist Dr. James Hansen's assertion that the Paris Agreement is a "fraud" because it fails to include a specific global price on the release of carbon into the atmosphere; about the increasing calls for investigation and prosecution of ExxonMobil for obscuring their own scientists' findings about the "potentially catastrophic" effects of global warming as early as 1977; about that satellite data set cited by Republican climate deniers to suggest that global warming has either paused or doesn't exist at all; and a few more of what I characterize as my own "dumb science questions" about the effects of climate change on weather predictions and El Niño.

On today's BradCast we are joined by Sharon Eubanks, the former federal prosecutor who served as the U.S. Dept. of Justice's lead counsel in the historic U.S. v. Phillip Morris USA case. It's an enlightening, eye-opening, and extraordinarily timely conversation. (Link to the complete audio is below.)

We now know, thanks to the investigative work of journalists at Inside Climate News and at the Los Angeles Times, that Exxon scientists, as early as 1977, knew about the "potentially catastrophic" dangers of global warming caused by the burning of fossil fuels.

Rather than take action to inform the world and save the planet, however, Exxon executives decided to spend millions of dollars, over the ensuing years, funding global warming denialist organizations in an apparent attempt to obscure their own science and mislead the public about the known harms of using their product.

On today's program, Eubanks, who is now in private practice after successfully carrying out the largest civil Racketeer Influenced and Corrupt Organizations (RICO) enforcement case ever filed, explains the currently known parallels between her case against Big Tobacco and the quickly mounting evidence against Big Oil which, she explains on The BradCast today, appear to be "very similar, if not identical".

"The [tobacco] industry sent out its talking heads to say how ridiculous it was when we first filed the suit, that we would file it under RICO," she tells me, after detailing exactly what a RICO case is. "It's an effective way to deal with this type of fraudulent conduct."

In the potential case against Big Oil and their advocates in the denial industry, she says, based on what the documents from insiders at Exxon have now revealed, "an investigation is warranted."

So, what are the parallels between the Big Tobacco case and what seems to have been carried out by Big Oil in this case? Eubanks says the evidence, so far, is "very similar, if not identical, to what the court was looking at in the tobacco litigation."

In Judge Gladys Kessler's 1,683-page finding [PDF] in the tobacco case, Eubanks explains, the court "noted that the industry mounted a coordinated, well-financed, sophisticated public relations campaign to attack and distort the scientific evidence demonstrating the relationship between smoking and disease, claiming that the link between the two was still an open question. Now, if you compare that to what we know about the Exxon documents so far, and just substitute, instead of 'adverse health effects', 'adverse climate effects', and substitute for 'smoking', 'carbon pollution', it seems to me that the activities surrounding that --- mounting a well-coordinated, well-financed public relations campaign to distort the scientific evidence and promote that there was an open question --- is the same thing we see that the [fossil fuel] industry is doing here."

"It seems to me, and this is what an investigation would reveal, that they were financing these activities by giving money and instructions --- not just money but instructions, as well --- to various groups who would be the deniers of climate change, when in fact Exxon knew climate change was real, and they knew, as well, that we had a limited amount of time on our hands to figure out how to address this."

And what of the "free speech" argument that the Fossil Fuel industry's advocates seem to be forwarding right now to justify misleading the public? Does the company and/or the industry have a Constitutional right to lie, as some have posited?

"The companies certainly were responsible for contradicting their own evidence that they had about climate change," Eubanks tells me. "Whether that's something they can do as a 'right' is something that is yet to be demonstrated. Certainly the tobacco industry was not allowed to go forward with that type of misconduct."

Did someone or something flip election results last week in Ohio's statewide ballot initiative Issue 3 to legalize marijuana? We try to get to the bottom of that question --- and many others --- on today's BradCast. (Audio is linked below.)

As initially reported by Ohio's Bob Fitrakis and Harvey Wasserman, and later by Steve Rosenfeld, screenshots captured from several different media outlets on Election Night last week show what appear to be impossible results on both Issue 3 and on Issue 1, a ballot measure for redistricting reform in the Buckeye State.

For example, according to screenshots from Dayton's WHIO-TV website, as published in the Fitrakis, Wasserman and Rosenfeld articles, Issue 3 reportedly had 969,662 "Yes" votes with 39% of precincts reporting. But later in the night, with 45% of precincts, there were only 614,866 "Yes" votes on Issue 3. That's a seemingly impossible drop of more than 300,000 votes in the initiative that is said to have ultimately failed, according to the unverified election night results reported by the OH Sec. of State.

Similarly, screenshots of results on Issue 1, which ended up reportedly passing, saw "No" votes drop impossibly from 990,555 to 486,596 later in the evening.

What explains these numbers? I spoke to Matt McClellan, Communications Director for Ohio Sec. of State John Husted (R) earlier today. He says that WHIO and the other media outlets whose screenshots were cited by Fitrakis, Wasserman and Rosenfeld, were all Cox Media outlets and "the problem was on their end."

"Someone was manually entering data," McClellan told me. "When they noticed the mistake, they made a correction." He went on to say that the Secretary of State's website had no such discrepancies or irregularities throughout the evening. His office does not take their own screenshots throughout the night, so we can't confirm that either way, at the moment, though McClellan says the office "went back and double-checked to make sure" after the issue was initially reported.

In response to the Sec. of State office's assertions (we offer more detail on them during the show), Fitrakis shared pre-election tracking poll results with me, that suggest the marijuana initiative should have passed, rather than lost, by a 2 to 1 margin. "Tracking polls suggest more that [results] were flipped than not flipped," he told me today. Fitrakis was is skeptical of the explanation from Husted's office, while adding that if Cox is manually entering results on the fly on Election Night, "then they need to stop, because it's absurd."

For the record, our calls to try and confirm the OH SoS' claims with WHIO and/or Cox Media have not yet been returned. But, again, much more detail during the program.

As if all of that isn't enough of a mess, the citizen movement to demand a hand count of the questionable results of last week's Kentucky Governor's race continues to grow. A petition has been posted to Change.org asking KY SoS Allison Lundergan Grimes to carry out a hand count of paper ballots statewide. So far, more than 10,000 have signed on to the effort, as we discuss today as well.
