What a way to "celebrate" Martin Luther King Day this year on The BradCast. Fifty-eight years since the passage of the Voting Rights Act and 10 years since the rightwingers on the U.S. Supreme Court gutted one of its central provisions, our even farther rightwing courts now appear to be gunning for much of the rest of the landmark civil rights voting law. [Audio link to full show is posted below this summary.]

First up today, while GOP-appointed federal judges are finding new ways to allow racial discrimination at the voting booth, Republicans --- including a top election official in upstate New York, and the wife of a U.S. House candidate in Iowa --- are nabbed by the Justice Department for committing mass vote fraud with absentee ballots.

The DoJ announcements in those cases come after a year in which Republicans filed a record number of anti-voting lawsuits --- in hopes of preventing (certain) voters from voting and/or having their votes counted as cast --- under the pretend guise of fighting fraud. They also come just days after Ohio's supposedly "moderate" GOP Governor signed new legislation to make it more difficult for (certain) voters to vote at all in upcoming elections.

Voting rights advocates in the Buckeye State charge the new measure will create barriers to the ballot for the elderly, rural voters and members of the military. But if it makes it more difficult for minority voters to vote, it may soon be impossible for groups like the League of Women Voters or the NAACP or the ACLU to file lawsuits charging violations of anti-discrimination laws under the Voting Rights Act.

When SCOTUS gutted Section 5 of the VRA in 2013 --- the part that required new election laws in jurisdictions with a history of racial discrimination at the polling place to be precleared by federal authorities before they could go into effect --- the rightwing majority on the High Court claimed the provision was antiquated and no longer necessary. Besides, even though thousands of discriminatory laws had been blocked by Section 5 since 1965, there was always Section 2, which blocks racially discriminatory voting laws in all 50 states.

After all, as an ACLU attorney was forced to point out during a federal appeals court hearing this week: “For over 40 years, dozens of federal courts have heard hundreds of Section 2 claims brought by federal plaintiffs.”

Unfortunately, that lawyer was defending the use of Section 2 before a three-judge panel, where she had to add that, “In that time, not one court denied the plaintiffs their day in court because of a lack of private action.”

The hearing in question came this week after a lower, federal district Court judge in Arkansas tossed out a challenge to a new state House district map implemented by state Republicans. The map includes 11 black majority districts, when the population of the state suggests there should be 16 such districts.

But Judge Lee Rudofsky, a Donald Trump appointee, dismissed the challenge to the new map, declaring that Section 2 of the VRA does not allow private individuals and groups, like the ACLU or NAACP, to file suit against such laws. Only the U.S. Attorney General may do so, he held.

As our guest explains today, Rudofsky's court "the first court in the history of the country to find that there is no private right of action" in Section 2. For a host of reasons, it's an absurd argument. And yet, this week at the U.S. 8th Circuit Court of Appeals, according to CNN, two of the three judges on the appeals panel (all of them are Republican appointees) appeared open to the idea that there is no right to private action under Section 2, because the federal statute doesn't specifically say as much. Never mind that private parties have been suing for decades under Section 2, including at the U.S. Supreme Court, where the Justices never said a word against it.

We're joined to explain this newly-attempted GOP voter suppression nightmare by JONATHAN TOPAZ, the ACLU Voting Rights Project staff attorney who served as the trial attorney on the initial case that was tossed by Judge Rudofsky last year.

"I think it's hard for most people to fathom that this is a question that needs to be litigated in 2023," Topaz tells me. "There have been hundreds of cases over the course of Section 2's history litigated by private plaintiffs, and many of those cases --- at least 10 at the Supreme Court, and at least 18 in the 8th Circuit where we were arguing earlier this week --- were brought by private plaintiffs."

"Congress had opportunities --- in 1982 when they amended the Voting Rights Act, as recently as 2006 when they reauthorized the Voting Rights Act --- to correct any mistakes it saw out there as private plaintiffs brought cases across the country, which would have been purportedly in open defiance of what Congress had intended, and Congress never saw fit to correct anyone," he explains.

Topaz goes on to cite a case as recently as 1996 when "five justices of the Supreme Court --- so, a majority --- held that there was a private right of action under Section 2 of the Voting Rights Act." Of course, our newly corrupted, stolen, and extremist rightwing majority on the High Court has had no trouble of late reversing its own precedents whenever they feel like it. So this case, which will almost certainly end up at SCOTUS no matter what happens at the 8th Circuit, could tee up a potentially near-fatal blow to the already teetering VRA.

"Section 2 is one of the crown jewels of American legislative history," Topaz argues today. "It's one of the finest statutes ever passed. Section 2 is absolutely essential in terms of ensuring equal voting access around the country. And we will do everything we can do defend it."

In the meantime, as he observes, this particular fight has prevented the courts from deciding on the merits of the original case, which means that --- even if it's ultimately settled at SCOTUS in favor of the ACLU --- "there will have been several elections taking place with discriminatory maps in Arkansas."

In 1957, in his "Give us the Ballot" speech eight years before passage of the VRA, MLK reportedly said: "So long as I do not firmly and irrevocably possess the right to vote I do not possess myself. I cannot make up my mind --- it is made up for me. I cannot live as a democratic citizen, observing the laws I have helped to enact --- I can only submit to the edict of others."

We should be both relieved and outraged!

Relieved that, earlier this month, the Center for Disease Control (CDC) and Food & Drug Administration (FDA) approved a new round of booster shots specifically re-designed to address new variants of the deadly COVID virus.

Outraged because, despite the expenditure of tens of billions of U.S. taxpayer dollars on research and development (R&D), the pharmaceutical industry's refusal to waive its "gifted" patent rights prevented a global rollout of the COVID vaccines. In turn, that refusal resulted in the need for the new booster shots.

Outraged because the industry's refusal to waive their patent rights has produced "excess mortality" with COVID that, as of the beginning of this month, has killed at least 6.5 million people worldwide, with no end in sight.

Outraged because this will, in all likelihood, not be the last newly reconstituted booster shot needed. It is the considered opinion of two thirds of the world's epidemiologists that the failure to provide global vaccinations will give rise to mutations that "could render current COVID vaccines ineffective."

And, yes, the patent rights were, indeed, a gift --- from the United States to the Pharmaceutical Industry...

"A republic," Ben Franklin famously said, "if you can keep it."

After more than 230 years, the great American experiment --- constitutional democracy --- has arrived at a moment of grave national peril, once again testing Franklin's warning. Like the Confederates who fired on Fort Sumter at the outset of a bloody Civil War, a major segment of our polity today is being led by racist and seditious reactionaries --- "domestic enemies" of the very Constitution they solemnly swore to uphold and defend.

This unscrupulous lot call themselves "Republicans". Yet, they have absolutely nothing in common with the Party once led by Abraham Lincoln, an intellectual giant, who extolled the need to see that "government of the People, by the People and for the People shall not perish..."

The right to vote is foundational to all other rights. By way of more than 253 restrictive bills, introduced in 43 States, these elected autocratic "American Fascists" seek to strip that foundational right from millions of their fellow Americans.

The For the People Act of 2021, recently passed by Democrats in the House as H.R.1, is a comprehensive election, campaign, ethics and voting rights reform measure that would, among other things, eliminate partisan gerrymandering of Congressional Districts, curb dark money campaign contributions, and preempt many state-based GOP voter suppression and intimidation laws, schemes and tactics. The Senate version of the bill, S1, is co-sponsored by 49 of the chamber's 50 Democrats.

If, at this critical moment, all 50 Senate Democrats do not agree to eliminate the filibuster, at least for Voting Rights-related legislation, in order to pass S1 before the end of the year, a clear path will have been paved for the GOP to retake majority control of both Houses of Congress in 2022 and recapture the Presidency in 2024 through a combination of extreme partisan gerrymandering and surgically precise voter suppression.

What better moment for Georgia's freshman Democratic Senator, Reverend Raphael Warnock, to call upon our better angels to save our democracy in a maiden address on the Senate floor (see video and link to transcript below) that amounted to what has been aptly described as a "Voting Rights Speech for the Ages"...

With the avalanche of news over the weekend and right up until airtime, we've got nothing but news on today's show. Most of it emanates out of Congress in one way or another, though we take a short side-journey to debunk a major lie over the weekend by Donald Trump. Even that, however, is ultimately about his fate in Congress as well. [Audio link to show follows below.]

Among the stories covered on today's wildly news-packed BradCast...

• Former North Carolina Sen. Kay Hagan died on Monday at age 66, after a three year battle with encephalitis. We share some thoughts on the distinguished record of public service from the state's first female Democratic Senator.;

• Former Democratic Rep. John Conyers died at the age of 90 on Sunday. The champion for civil rights and equal justice and longtime Chair of the House Judiciary Committee served 53-years in the House, making him the longest-serving African-American in Congressional history, before abruptly resigning in 2017 in the wake of sexual misconduct allegations which he refuted. He stated during his resignation that he believed he was unlikely to receive due process during the peak of the "#MeToo" era. We share a number of his many lasting accomplishments today, including his successful 15-year fight to adopt a national Martin Luther King Day holiday, a years-long effort he began just four days after the civil rights legends' assassination. (Conyers was the only candidate for Congress ever endorsed by MLK.) We also share a number of personal reflections on our years working with Conyers and his office in various ways at The BRAD BLOG, particularly during the darkest years of the George W. Bush Administration. (As mentioned on the program, here is the kind message he sent to the blog in 2005, and here is his guest blog from later that same year.);

• And, speaking of a lack of due process, rising-star freshman Rep. Katie Hill announced her own resignation from Congress on Sunday, less than a year after flipping the last Republican-controlled House seat in Los Angeles County in her 2018 election. The 32-year old California Democrat was granted a position on Leadership in the House and a plum position on the House Oversight Committee. However, allegations about an affair with a legislative staffer, which she denies, in violation of House rules was at the center of a complaint filed with the House Ethics Committee. The publication of illicit photographs and text messages attributed to the Congresswoman, which she charges were released by her estranged "abusive" husband, made her ability to fight the charges "untenable," according to House Speaker Nancy Pelosi who praised Hill. Seen as a voice for Millennial voters, Hill describes the released photos as unlawful "revenge porn," while many supporters feel she should not have stepped down;

• On the GOP side of the aisle, the woes are far worse. Yet another senior Republican House member, Rep. Greg Walden announced on Monday that he will not seek re-election, even as the Oregon lawmaker was thought likely to be reelected to long held seat in . He is the 19th House Republicans, many of them senior members who are current and former committee chairs, to declare their intent to retire next year, all but conceding that Republicans have little or no chance of winning back the U.S. House majority in 2020;

• On Sunday, Donald Trump announced that a targeted mission by U.S. special forces succeeded in killing long-sought ISIS leader Abu Bakr al-Baghdadi in northwestern Syria. After Trump's brief announcement, in which claimed that al-Baghdadi blew himself up with a suicide vest and "died like a dog", "crying", "whimpering" and "screaming", Trump went on to sing his own praises during an insane question and answer period with the press for a good 45 minutes. He claimed that the killing of al-Baghdadi was a much bigger deal than the killing of Osama bin Laden during the Obama Administration, and that he, unlike anybody else, had called for the killing of bin Laden long before the 9/11 terror attacks, in his book "The America We Deserve".

  Multiple fact-checks by multiple news outlets, however, detail that Trump did nothing of the kind in his book, where he barely referenced bin Laden in a single passage. He did not calling for him to be killed, though he did recognize him as "public enemy Number One," which also serves to debunk his own claim at the Sunday presser that "nobody had ever heard of Osama bin Laden" until 9/11. Trump's bizarre spectacle on Sunday, trumpeting his triumph and offering easily debunked false assertions, serves to add a question mark to his claims about al-Baghdaddi --- Russia's foreign ministry is dubious about the kill --- and otherwise serves to underscore what a horrible fact and character witness Donald Trump is for himself, given the ongoing impeachment inquiry he is now facing in the U.S. House;

• Speaking of which, former Deputy National Security Adviser Charles Kupperman, who worked directly under former NSA John Bolton, failed to show up for his deposition before House impeachment investigators today, after seeking a ruling from a federal judge as to whether he was legally required to comply with a House subpoena. His testimony, if and when it happens, is expected to underscore concerns that Bolton reportedly had about the quid pro quo pressure campaign Trump was running against Ukraine while withholding nearly $400 million in military assistance to the country in exchange for a promise from its President to investigate 2020 candidate Joe Biden and a rightwing conspiracy theory concerning Ukraine's involvement in the 2016 Presidential election;

• The Ukraine scandal left Vice President Mike Pence going to extraordinary lengths to avoid answering --- four times --- a simple question on Face the Nation on Sunday as to whether or not he knew about the strong-arm scheme before Trump's infamous July 25 phone call with Ukrainian President Volodymyr Zelensky, as corroborated last week by the explosive testimony of top U.S. envoy to Ukraine Bill Taylor and, apparently, by others as well;

• All of which has left Republicans in the U.S. Senate wildly anxious about their own likely votes for or against Trump's removal from office in an impeachment trial, as they worry that independent voters may soon be turning against the President. According to a recent Reuters poll, they already are. Bigly.

On today's BradCast: It was a huge night in Wisconsin on Tuesday, as a progressive candidate for the state Supreme Court trounced a so-called 'conservative' who was backed by another full court press by state and national GOP groups. [Audio link to show follows below.]

It was the first such victory for a progressive vying for an open seat on the state's high court in almost 25 years. Or, as our guest today, author/journalist and Wisconsin's own JOHN NICHOLS describes it: "The first statewide race that really pitted left against right in this kind of way, in the country, in 2018. And the progressives won. And they didn't win by a little."

In fact, the reported results find that progressive Milwaukee County Circuit Court Judge Rebecca Dallet crushed Sauk County Judge and GOP attorney Michael Screnock, "literally a point-man for much of [Gov. Scott] Walker's agenda", says Nichols, by 12 points. Walker also saw his ballot proposition that would have done away with the statewide office of Treasurer --- allowing the executive office more control over billions in public education funds and tens of thousands of square miles of public lands --- defeated by an even larger margin.

For his part, Walker, who faces re-election this November, took to Twitter to warn again of a "#BlueWave" coming this November, a continuation of the "WAKE UP CALL" panic he first unleashed after a long-held Republican seat in the State Senate was lost to a Democrat in a special election in January. Nichols observes: "One of the most disciplined political figures in the United States, a guy who really, by any measure, keeps his calm through some of the toughest political fights you've seen, appears to be losing it. He appears to be freaked out by election results he can't control."

"I must say it's especially nice to be talking about something good happening in Wisconsin, rather than our many complex and sad stories," adds Nichols, describing last night's outcome as "the first genuinely good election night for Wisconsin progressives" in many years.

Nichols and I also discuss --- and, yes, debate --- the danger to democracy posed by partisan judicial elections like those in the Badger State and elsewhere across the country. And The Nation's Washington Correspondent and longtime Associate Editor of Madison, Wisconsin's Capital Times also rings in with his thoughts on whether U.S. House Speaker Paul Ryan (R-WI) could actually be unseated this November and/or whether he might drop out of the race all together.

Also today: Progressives in Alaska appear to have defeated a so-called "bathroom bill" referendum in Anchorage that would have gutted the city's anti-discrimination law for transgender people; GOP-backed legislation to replace 100% unverifiable touch-screen voting systems with HAND-MARKED paper ballots moves forward in Missouri's state legislature, despite shameful resistance from Democrats; And Pennsylvania begins to move away from 100% unverifiable touch-screen voting, but leaves the door wide open for unverifiable computer-marked paper ballots, using weasel words in its announcement for vendor bids, seeking systems that feature a "voter-verifiable paper ballot or voter-verifiable paper record of votes cast by the voter" (as opposed to systems featuring hand-marked voter-verifIED paper ballots.)

Finally, we pause to honor the memory of Dr. Martin Luther King, Jr., who was assassinated 50 years ago today --- while the fight for "what kind of nation we are and what direction we want to move in," as Bobby Kennedy asked on the night of King's death, still continues...

On today's BradCast, we're still fighting for the right to vote and to have that vote counted, 60 years after MLK's "Give Us the Ballot" speech, 50 years after the passage of the hard-won Voting Rights Act, 4 years after the U.S. Supreme Court gutted it, and one day after what my guest today describes as a "really wicked decision" by the Court on Thursday to set aside a landmark ruling on gerrymandering that was meant to finally correct a grave injustice to voters in 2018. With Republicans in the U.S. House, on Thursday, having passed a short-term stopgap spending bill to keep the U.S. Government from shutting down beginning on Friday night at midnight, Republicans in the U.S. Senate are still racing to figure out how to overcome a filibuster of the same bill. The measure includes support for kids that rely on the currently-expired Children's Healthcare Insurance Program (CHIP), but leaves some 800,000 kids of immigrants who came here with their parents still facing deportation as early as March, after Trump ended Obama's Deferred Action for Childhood Arrivals (DACA) program. So, once again, rather than simply including a fix to DACA, Republicans are using children as human shields to try and force Democrats to vote with them for a short-term bill to avoid a shutdown of the federal government. It would be the first such shutdown in U.S. history while the House, Senate and White House are all controlled by the same party.

Sick of this sort of BS? If so, you can theoretically do something about it this year at the ballot box. But the GOP's stolen U.S. Supreme Court isn't making it easy. On Thursday, SCOTUS stayed a landmark ruling by a lower federal court panel that had ordered North Carolina to immediately redraw the state's U.S. House district maps, since the Republican majority legislature admitted that they, unconstitutionally, drew them to ensure a Republican advantage. Though it's largely a 50/50 state, NC Republicans hold 10 seats in the U.S. House to the Democrats' 3.

That's just one of the ways that Republicans hope to keep cheating voters this year in order to hang on to power as the mid-terms approach. Another way was through Trump's discredited and now disbanded "Presidential Advisory Commission on Election Integrity", run by the GOP "voter fraud" fraudster and Kansas Sec. of State Kris Kobach. He had hoped to use the Commission to make it harder (for certain people) to vote, but he faced yet another embarrassment in court this week. When Kobach's Commission was originally shut down a week or two ago, there was a cry from voting rights advocates for a national committee to study and call out the real scourge of American democracy: voter suppression.

That call may have been answered this week with the formation of the non-partisan National Commission for Voter Justice, co-chaired by my guest today, BARBARA ARNWINE, former longtime Executive Director of the Lawyer's Committee for Civil Rights Under Law and now President and Founder of the Transformative Justice Coalition. Arnwine explains the new Commission's mission, responds to the "wicked" SCOTUS ruling on NC maps and other recent voting rights issues, and details many of the threats to democracy that must be overcome in 2018, more than sixty years after, as she and John Nichols note at The Nation this week, Martin Luther King, Jr. delivered his landmark "Give Us the Ballot" address on the steps of the Lincoln Memorial in 1957.

"We gotta remember, we are looking at the Roberts Court. This is a man who made his life ambition the evisceration and the weakening of the Voting Rights Act. In fact, if he had had his way, there wouldn't be a Voting Rights Act, as he wrote many, many years ago," Arnwine says in response to the SCOTUS stay on the NC redistricting ruling and a similar one in Texas. "They are fine with these kinds of schemes --- gerrymandering and other devices and tactics that deny people the right to vote --- because they believe in their hearts that the result is fair, it's a result that they want, and it's a result that puts people into power that they favor. And that's wrong."

"We believe that democracy should be for every single voter. That's why we created the National Commission for Voter Justice, because every voter should have the right to be able to vote and to have their vote counted," the animated Arnwine explains. "Democracy should always be about a competition of ideas, a competition of the best candidates, and then the people make their choices. Politicians should never pick who their constituents are. The constituents should pick the politicians. We are in a reverse democracy right now."

It has, sadly, been that way for a while. I recalled today, while prepping for the show, that Arnwine and I were on a National Public Radio show back in 2008, facing off against the notorious GOP "voter fraud" fraudster Hans von Spakovsky, who, I suspect, was very used to getting away with his lies before that show. I also recall Arnwine's testimony to the Baker/Carter Commission on Voting Rights which was a panel created by Republican Party vote suppressors in 2005 to push for Photo ID voting restrictions. In comparison to the Trump/Kobach Commission, however, that panel was blue ribbon! The fight for democracy is never ending, it seems.

"Democracy is never permanent. It requires vigilance. It requires engagement. It requires organizations to monitor, to advocate for it," Arnwine tells me. "But it shouldn't be as bad as it is in the United States. That's the problem. The problem is that even with the fact that you've got to constantly seek it, it shouldn't be this bad. We should not have millions upon millions of voters finding themselves blocked from the polling booth. We shouldn't have three-hour lines. We shouldn't have machinery that everybody knows is worthless."

"But that's why the National Commission for Voter Justice is going to be coming to every area where we can," she says. "We're going to have over 20 hearings around the country, so that we can hear directly from voters what they are encountering, what their experiences are and, more importantly, what some of the solutions are, helping people to advocate for those changes."

Today on The BradCast, special coverage in commemoration of the 50th anniversary of the Voting Rights Act of 1965 --- the crowning jewel legislation of the civil rights movement, written with the blood and tears of thousands, and now under fire today as it has never been since its passage helped lift the nation out from under the shackles of the Jim Crow era.

Sam Walker historian at Selma, Alabama's National Voting Rights Museum and Institute, at the foot of the Edmund Pettus Bridge, joins us to discuss the Act's history and legacy --- from the circumstances of the courageous Bloody Sunday march from Selma to Montgomery that finally resulted in the passage of the VRA, to the release of the movie Selma last year.

Among other things, he reminds us of the difficulty African-Americans faced in simply trying to register to vote in the deep south prior to the VRA. "Two days a month --- the first Monday and the third Monday --- were the only two days you could go and attempt to register," he told me. "Those were the days when they would see people coming and they would lock the door when they tried to come inside....You still couldn't register because you couldn't get inside the building to sign up."

Walker, who we haven't had on the show since the 40th anniversary of the VRA back in 2005, shares stories that need to be heard, even today. One, for example, about his meeting, years later, with one of the state troopers who took part in the beatings on Bloody Sunday. Another, about the importance of cameras and national media on that infamous day in Selma.

"The people in the media had their cameras set up when the attack happened, so when people were being beaten and tear-gassed, all those scenes were captured by the TV cameras and by the news media on camera. And that started a new momentum to try to get the right to vote for all our citizens." Sound familiar?

Then, former DoJ Civil Rights Voting Section attorney Katherine Culliton-González of the Advancement Project, joins us to discuss the ongoing legal battles in the fight for voting rights across the country in the wake of the U.S. Supreme Court gutting the VRA's landmark Section 5 provision in 2013 --- and the battle to restore it.

"All we have to do is look around us and unless they're living in a bubble, they can see that's there's been a renaissance in discrimination in voting since they took away that protection," she explains. From Congress to Texas to North Carolina to Wisconsin and beyond, the fight continues 50 years later.

"There are many, many voting changes across the country, and particularly in the South, at the local level that do all kinds of maneuvers of politicians trying to manipulate the vote. Moving poling places away from people of color - that happens a lot in the Native American community, the African-American community. We've seen laws requiring documentary proof of citizenship that have a strong disparate impact on the Latino community and the African-American community. For example, if you're a naturalized citizen and you don't have those papers, it's going to cost you at least $600 to get what's needed" to vote, she says. "All of this would have been subject to Section 5 of the Voting Rights Act."

Culliton-González reminds us, as the NC NAACP civil rights leader Reverend William Barber says, "this is our Selma".

Finally, civil rights icon Rep. John Lewis (D-GA), beaten by state troopers on Bloody Sunday as he courageously and stoically helped lead the march across the Edmund Pettus bridge as a 25-year old, discusses the importance of LBJ signing the Act in 1965. It's one of many historical sounds and songs that help us mark this historic day.

President Barack Obama offered a stirring speech this afternoon at the entrance to the Edmund Pettus Bridge to commemorate the 50th Anniversary of the Bloody Sunday March in Selma, Alabama in 1965.

The brutal police violence brought against courageous, peaceful marchers that day, and the subsequent peaceful marches that followed it, led directly to the passage of the landmark Voting Rights Act of 1965, widely regarded as one of the most important pieces of legislation in our nation's history.

The transcript of Obama's speech today is posted in full below. But, here is the portion of his remarks calling for the restoration of the VRA which was renewed for 25 years in 2006 by George W. Bush (one of very few Republican officials in attendance today), but then gutted by the U.S. Supreme Court in 2013...

Oh, and happy Martin Luther King Day.

What was the one, most important takeaway from today and Saturday's 50th Anniversary commemoration of MLK's "March on Washington for Jobs and Freedom"? The one issue that seemed to make it into the remarks of just about everyone who spoke?

That's what we discussed during the first part of today's KPFK/Pacifica Radio BradCast, along with sound clip highlights from some of the most notable speakers. (Hint: If you didn't hear the fiery remarks of Rep. John Lewis --- the youngest speaker at the original 1963 remarks --- on Saturday, you'll now get to hear them in full.)

In the second part of the show, we were joined by Trevor Timm of the Electronic Frontier Foundation (EFF) and the Freedom of the Press Foundation to discuss the release of the secret FISA Court's 2011 decision finding the government had misled the court multiple times, and collected the emails of tens of thousands of Americans not involved in terrorism in any way; and about the massive secrecy state we discussed in The BRAD BLOG's special investigative report this week.

UPDATE 7/29/13: The arrestee seen above has now been identified, as 83-year old Robert Plummer, Jr. of Carthage NC. He is, according to We Act Radio, "a Korean War Vet who was one of the first African-American Navy UDT divers (AKA Frogmen, the precursors to the US Navy SEALs)."

When asked about his voting rights concerns in NC, as seen their video posted below, Plummer responds: "I am very despondent on that matter, because that's what I went to war for --- for protection of voting rights. And I can't see us going and saving democracy all over the world when our voting rights are being deteriorated right here in the United States."

He also says his arrest last week was not his first run in with the law. He says he was arrested on the Edmund Pettus bridge with Martin Luther King during the 1965 march for voting rights on Bloody Sunday in Selma, AL. Though, when asked for details by the reporter in the video, he demurred, saying, "I don't want to go back that far. I'm a young man!"

When asked if he was going to keep fighting for voting rights, he responded: "Most emphatically"...

UPDATE 7/30/2013: I've now spoken to Plummer, to invite him on to my radio show. Unfortunately, he has bible class tomorrow at his church, where he is a Deacon, and won't be able to join me. But he was an extraordinarily pleasant man, with a sharp sense of humor. He confirmed the information above, and added these thoughts during our conversation when I asked why he was willing to be arrested at the Capitol. His reply:

He also added, as he was looking up the phone number of his church for me on his iPad and his new "32gigabites iPhone", that he is "half way up to speed on what is going on," because, after all, he says, "I'm an old pirate, man."

Last week, The BRAD BLOG's legal analyst Ernest Canning reported on the lawsuit filed by the League of Women Voters, the NAACP and the ACLU in Pennsylvania, together with the Homeless Advocacy Project and the Advancement Project, against the state Republicans' new polling place Photo ID restriction passed into law in March.

The law, unless it's blocked, is set to make it much harder, if not impossible for many previously-legal student, elderly, minority and urban dwelling voters to cast their vote this November.

Canning predicts, however, that, like a similar GOP law in Wisconsin this year, and one in Missouri back in 2006, the new attempt to remove voting rights will be found in violation of the fundamental right to vote guaranteed under Pennsylvania's state Constitution. We'll see if he's correct.

In the meantime, the lawsuit, Applewhite vs Commonwealth of Pennsylvania [PDF] names 11 plaintiffs, the majority of whom have tried to get a birth certificate in order to then obtain their so-called "free" ID to vote from the state under the new law --- only to be told there is no record of their births. Several of those plaintiffs, not surprisingly, were born in the Jim Crow south and are now facing the forces of disenfranchisement again under the GOP law this year even up in the Keystone State in 2012.

We interviewed one of the plaintiffs in the case recently, 90-year old Joyce Block, on our KPFK/Pacifica Radio show. That interview is here.

Last week, MSNBC's Al Sharpton interviewed the lead plaintiff in the complaint, 92-year old Viviette Applewhite who marched for civil rights alongside Rev. Martin Luther King Jr. in Georgia, and who has been voting in Presidential elections without a problem for more than 50 years. She has never had a driver's license and, though she says she paid a fee for a birth certificate from the state, she has never received it.

Despite the fact that state officials have been unable to produce evidence of in-person, polling place impersonation --- the only type of voter fraud that could possibly be deterred by polling place Photo ID laws --- Republicans seem more than happy to disenfranchise long-time voters like Applewhite and potentially tens of thousands of others this year.

Applewhite says she believes it's all little more than an effort to stop President Obama from being re-elected, and she fears there are far more people than many realize who will be disenfranchised this year unless the law is overturned.

"Looks like most of the people in my building, they're senior citizens, but they don't have the proper thing to vote with," she says near the end of the interview, "and it's going to be a whole lotta people that's not going to be able to vote"...

Judith Browne Dianis, civil rights litigator at the Advancement Project also appears in the interview above and correctly notes: "This is not about preventing fraud, it's about preventing voting."

She is supported in that contention, ironically enough, by PA's Republican Governor Tom Corbett, seen in a clip above exhorting his supporters to help him keep turnout below 50% during his recent election. Moreever, just after Corbett signed the GOP's voter suppression bill in March, he lied to the media by claiming that it was needed since Pennsylvanians had seen 112% voter turnout in some precincts. Longtime election watchdog Marybeth Kuznick of VotePA, however, told us the Governor's claim was "ludicrous."

Today on KPFK/Pacifica Radio's The BradCast I spoke to Pamela Smith, President of Verified Voting Foundation and Dan McCrea, President of the Florida Voters Foundation about the recent mess in Palm Beach County, FL where the electronic Dominion/Sequoia optical-scanners declared several losing candidates as the "winners" in a March 13th election. It took approval of a court to carry out a hand-count last weekend to determine the real winners of the elections.

So do either Smith or McCrea have confidence that the same problem hasn't already occurred or won't occur again in the 14 states (including many swing states and even Wisconsin) which use identical computer systems to tabulate votes? Do they think enough is enough and it's time to simply hand-count paper ballots, as per "Democracy's Gold Standard"? You'll have to listen to find out.
