Pete Peterson claimed to 'agree' with Rand Paul's position on voting restrictions, but won't say why, even after the KY Senator flipped

The leading Republican candidate for Secretary of State in California does not want to go on record as to why he once claimed to agree with Sen. Rand Paul (R-KY) that GOP polling place Photo ID restrictions are "offending people".

Pete Peterson is, according to a mid-April Field Poll [PDF], leading a large field of candidates of all parties to become the next chief election official in the Golden State. He's a public policy adviser at Pepperdine University's Davenport Institute (which is funded in part by Charles Koch) and, according to that poll, leads his nearest competitor, Democratic state Sen. Alex Padilla, by double-digits in the state's upcoming June 3rd "Top-Two" primary contest.

Earlier this month, Paul offered a wobbly position on Republican polling place Photo ID restriction laws, at first seeming to buck his own his own party's years-long strategy to impose such disenfranchising statutes in states around the country. "Everybody's gone completely crazy on this voter ID thing," the Senator told the New York Times during an an interview. "I think it's wrong for Republicans to go too crazy on this issue because it's offending people."

On the day the NYT article ran, Peterson --- a Republican running for statewide office in a very "blue" state --- quickly allied himself with Paul, tweeting that he "agree[d] w Rand on his points re voter ID".

But, as we noted when The BRAD BLOG covered Paul's remarks, the Kentucky Republican and 2016 Presidential hopeful, was cagey in his comments to the Times. He didn't declare such laws to be wrong, per se, even though they may serve to remove the voting rights of millions of otherwise perfectly legal (and largely Democratic-leaning) voters. He said only that such restrictions were "offending people". He also later seemed to flip his position on the matter.

Just after the initial comments, however, and Peterson's tweeted claim to agree with him, we asked the candidate to clarify exactly what it was that he was agreeing with in Paul's remarks...

10th Circuit stays order compelling EAC to add 'Proof of Citizenship' requirement to federal voter registration form...

Early last week, with little attention in the media, the U.S. 10th Circuit Court of Appeal applied the brakes, for now, to one of the newest voter suppression schemes on the bleeding front edge of the GOP's ongoing War on Voting.

The insidious new Republican scheme, if it manages to overcome continuing challenges in court, such as the stay and appeal it now faces in the 10th Circuit, could result in thousands of otherwise eligible voters in Kansas and Arizona (and elsewhere, if the effort is allowed to move forward in KS and AZ) unable to even register to vote, much less cast a ballot on Election Day.

An investigative report by the Arizona Republic last year found the evidence for the purported basis of the new law --- claims by Republicans that non-citizens are casting ballots in the state --- to be "nearly non-existent".

Judith Brown Dianis, a civil rights litigator at The Advancement Project, described the nearly decade-long, coordinated, nationwide GOP voter suppression effort as "the largest legislative effort to roll back voting rights since the post-Reconstruction era". While appearing before a U.S. Senate Subcommittee in 2011, she described the effort as one designed to make "it harder to register to vote, harder to cast a ballot and harder to have a vote counted."

One of the primary GOP efforts to make it "harder to cast a ballot" can be found in the spate of polling place Photo ID laws that Republicans have sought to justify on the basis of what amounts to a phantom menace. Cases of in-person voter impersonation --- the only type of voter fraud that can be prevented by Photo ID --- are about as scarce as hen's teeth.

The same can be said about baseless GOP claims of an epidemic of voter fraud in the form of votes cast by non-citizens --- an allegation that is now being used as part of the new Republican ploy to prevent perfectly lawful citizens from even registering to vote...

Sacramento Bee does a lousy job of helping voters understand why that matters...

California is making it slightly more difficult for millionaires and billionaires like the Koch Brothers to secretly and fraudulently influence elections in the state.

As the Sacramento Bee tried to report it...

Nonprofit organizations that make political contributions in California will have to disclose more information about the source of their money under a law Gov. Jerry Brown signed Wednesday.

Senate Bill 27 was inspired by the 2012 ballot measure wars in California, when two out-of-state nonprofit groups poured $15 million into fighting Proposition 30 and supporting Proposition 32. Because of the groups' nonprofit status, they were not required to report where their donations originally came from, leading some to describe the contributions as "dark money."

"Leading some to describe"? It was dark money! The groups did not disclose who the donors were when they spent millions and millions of that dark money to try and fraudulently effect election outcomes in the state!

It was all money laundered through Koch Brothers front groups, as the SacBee failed to note for some reason, but as the Mercury News reported last year when the scheme finally came to light...

WATCH: 'Governor Christie and the Kochtopus'...

Over the weekend, Showtime's James Cameron-produced environmental documentary series, Years of Living Dangerously, released an online-only video segment focused on NJ Gov. Chris Christie's still-unexplained flip on the Regional Greenhouse Gas Initiative (RGGI).

RGGI is the very successful cap and trade system created by northeastern states to help curb global warming gasses. The video segment cites a piece of our exclusive 2011 blockbuster report featuring audio recordings of that year's secret Koch Brothers' Summer Seminar near Vail, CO, where Christie appeared as the billionaires' super-secret, superstar keynote speaker...

The video, as Grist describes it, "featuring food writer Mark Bittman grilling [Koch-funded] Americans for Prosperity henchman Steve Lonegan about climate change, muses on the possibility that Koch money funded Christie’s rapid retreat on New Jersey’s part in the regional cap-and-trade system RGGI." That is, of course, one of the issues we first posited when initially breaking the story, based on comments made during Christie's introduction at the seminar by David Koch.

Here is the complete audio (and transcript) of Christie's address and his intro by Koch, who calls the Governor his "true political hero" while describing another secret meeting the pair had in New York City before Christie suddenly pulled NJ out of RGGI in May of 2011, just weeks before the Vail confab.

"Another example of Governor Christie's commitment to the free enterprise system is that only a few weeks ago he announced that New Jersey would be withdrawing from the [Regional] Greenhouse Gas Initiative," Koch said proudly during his remarks to cheers and applause. The fossil fuel magnate then went on to lie to the crowd that RGGI "would have raised energy costs, reduced economic growth and led to very little, if any, benefit for the environment." On mention of the word "environment" a "boo" is heard on the audio from amongst the gathered millionaires and billionaires in attendance.

As I wrote at Mother Jones at the time (in the article seen briefly in the video as a clip of the Koch audio "obtained by a journalist" is played):

"Five months ago we met in my New York City office and spoke, just the two of us, for about two hours on his objectives and successes in correcting many of the most serious problems of the New Jersey state government," Koch said. "At the end of our conversation, I said to myself, 'I'm really impressed and inspired by this man. He is my kind of guy.'"

The crowd cheered loudly as Koch, whose estimated $22 billion personal fortune derives from his family's oil refinery empire, described Christie's unilateral withdrawal, on behalf of New Jersey, from a regional cap-and-trade market created by 10 northeastern states to curb industrial greenhouse gas emissions. (He neglected to mention that, in announcing the withdrawal in late May, Christie had acknowledged in no uncertain terms that climate change is real and that human activities contribute to it. "It's time to defer to the experts," he'd said.) There was an extended ovation when Koch, just before turning over the floor, expressed his hope of seeing Christie "on a larger stage where, God knows, he is desperately needed."

UPDATED: Wisconsin Republicans will appeal to 7th Circuit...

This week's federal court decision to strike down Wisconsin's polling place Photo ID law has national significance and does not bode well for Republicans who have been attempting to advance such electoral schemes in recent years, as based on misleading "facts", wild claims and dishonest interpretations of case law and court precedent.

The court's landmark decision in the Wisconsin case contains a methodology for testing the law's constitutionality that, if applied by other courts in similar federal challenges to similar laws in other states, would likely mark the beginning of the end for Republican-enacted, polling place Photo ID restrictions. We describe that possibility as "likely", given that a careful reading of prior case law suggests that six of the Supreme Court's nine Justices have already subscribed to legal opinions that are consistent with the methodology used by the federal court in Wisconsin.

In late 2011, shortly after the filing of the first of the two federal cases that resulted in this week's ruling finding that Wisconsin's polling place Photo ID law (Act 23) violated both the U.S. Constitution and Section 2 of the Voting Rights Act (VRA), The BRAD BLOG explained why the issues before the federal bench in Wisconsin "could reverse similar laws nationwide."

The 90-page decision and order [PDF] that U.S. District Court Judge Lynn Adelman meticulously crafted, not only after a full trial on the merits, but over a span of more than 3 1/2 months following it, suggests that our earlier prediction may have been an understatement.

In declaring Wisconsin's Republican-enacted Photo ID law unconstitutional and a violation of federal law, Judge Adelman applied a very specific test for the law, one called for by the U.S. Supreme Court back in 2008. That same test, measuring the potential benefits of such laws against their possible harm to voters' rights, if similarly applied elsewhere, would likely invalidate most, if not all of the similar restrictions which have been rammed through numerous GOP-majority state legislatures over the past six years.

While stopping short of describing Republican "justifications" for such laws as a mere pretext for voter suppression, Judge Adelman's decision persuasively finds that the core GOP claims about the supposed need for polling place Photo ID restrictions cannot withstand judicial scrutiny when tested against a fact-based reality in a court of law. The judge found, in no uncertain terms, that such laws are constitutionally infirm because, without legitimate state interests for such restrictions, they serve only to disproportionately disenfranchise the poor, the elderly and minority voters...

During Thursday's Green News Report, we briefly discussed Charles Koch's claim in his Wall Street Journal op-ed this week, that he and his brother David, are using their inherited fossil-fuel millions to discredit global warming science (and other inconvenient realities), simply because they are fighting "to restore a free society and create greater well-being and opportunity for all Americans." Sure they are.

Over at the Washington Post's "Plum Line" blog, Paul Waldman has another thought on the Koch op-ed this week, which was published at virtually the same moment as the rightwing judicial activists on the U.S. Supreme Court trashed 40 years of campaign finance law in order to allow the approximately 600 Americans who had already maxed out their previously allowed $125,000 per-election-cycle donations to political candidates and parties to be "free" to give millions to candidates and parties instead.

Waldman avers that the Koch op-ed and the SCOTUS McCutcheon decision "are parts of the same effort," which, he argues convincingly, is "Nothing less than the construction of a new version of liberty."

In his WSJ piece, Koch joined a growing procession of billionaire Rightwingers recently whining aloud about their perceived persecution at the hands of...well, anyone who doesn't share their political views and who doesn't have the "freedom" to also have billions, inherited or otherwise, in their bank accounts.

"Instead of encouraging free and open debate, collectivists [ed note: apparently he means anyone who is not a Republican?] strive to discredit and intimidate opponents," Koch bemoans. "They engage in character assassination," he complains, before adding parenthetically,"(I should know, as the almost daily target of their attacks.)"

"Poor" fellow. Waldman, however, sees the Koch Agonistes very differently...

Oh, the irony of Newt Gingrich never ends...

Newt Gingrich says all the attention to be paid in Las Vegas by GOP officials and wannabe presidents this weekend to billionaire campaign donor Sheldon Adelson-a patron of Gingrich's 2012 White House bid-is something that won't go away until genuine campaign finance reform occurs.

"Whether it's the Koch brothers or [George] Soros on the left or Sheldon," said the former House speaker in an interview with National Journal on Friday, ticking off other campaign mega-donors, "if you're going to have an election process that radically favors billionaires and is discriminating against the middle class-which we now have-then billionaires are going to get a lot of attention."

Gingrich was asked about the gathering of some top Republicans in Las Vegas for what officially is the spring meeting of the Republican Jewish Coalition.

Some have even taken to dubbing the event the "Sheldon Primary," for the casino mogul who almost single-handedly bankrolled Gingrich's presidential candidacy in 2012 and is said to be looking for another horse to back for the White House in 2016.

Well, it just makes sense. Republicans aren't actually running on anything in 2014 other than "Democrats are no good! Also, Obamacare!"

As Jesse LaGreca points out, however, "50+ repeal votes, a SCOTUS decision and a Presidential election, still no GOP alternative to Obamacare, just trolling & BS."

So, it's not much to run on. But that's okay. The Rs have an advantage this year thanks to the D's huge wins in 2008, leaving Dems with much more territory to defend this year in the U.S. Senate. More importantly, while Republicans have little or no policy initiatives to actually run on --- or, at least, few they'd like to mention out loud --- they don't really need to. The Koch Brothers are so desperate to see Republicans back in power, and all the swell goodies that come with it, they are unleashing everything they can to simply buy their way back into greater control of our nation's once-of-the-people, by-the-people, for-the-people government.

At the same time, unfortunately, Democrats aren't running on much more themselves. "We're not crazy Republicans!" may be true, but it doesn't give American voters much to vote for, especially while the Kochs are outspending outside Democratic-leaning groups 10 to 1 so far this year. So it all makes sense that with the Kochs' money running this year in lieu of actual Republicans with policies, Democrats seem to be set on simply run against the Kochs. That appears to be the plan. Or, at least the one that's working for them so far, according to Dave Weigel at Slate today:

I've seen some numbers from fundraising emails from one [Democratic] campaign that were sent from roughly mid-January to mid-March, pretty bad news cycles for the party. Nineteen emails didn't mention the Kochs. They raised, in total, $48,146.30, for an average of $2,534.02 per message.

But five emails mentioned, in at least some way, the Koch brothers. Those asks raised $32,668.72, an average of $6,533.74 per email. The Democratic base, which has been hearing about and fearing the Kochs for nearly four years, responds to this stuff.

So, running against The Koch Brothers brings in three times as much money as running on...whatever else the Dems have been trying to run on so far this year.

It'd be nice if the Democrats gave voters something concrete to vote for. It might even solve their oft-cited problem of D voters not turning out for mid-terms. Why should they, after all? That's not a criticism, that's an actual question. Why should voters turn out? What are they supposed to be voting for?Democrats might want to start thinking about offering a concrete reason or three. But, in lieu of that, running against the two privileged sons of an oil baron who are willing to spend as much of their father's hard-earned money as they need to in hopes of buying the United States whole hog will have to suffice, apparently. In 2014, with few, if any, policy promises (so far) presented to voters, Koch is it.

Unfortunately, for every dollar raised by the Dems, the Kochs can just cut a check for three or ten more. So, if you'd like to start questioning the Democrats' 2014 election strategy, now would be a good time.

You also might want to ask them why they aren't doing much more to fight against the madness unleashed by the infamous Citizens United in 2010 and the way that Republicans (particularly the Kochs and Karl Rove) have gamed every last inch of whatever scraps are left of campaign finance law in this country. Come to think of it, a hard promise to pass laws to effectively overturn Citizens United and restore campaign finance enforcement at the FEC would be just one concrete policy that Americans might actually turn out to vote affirmatively for. And, Democrats could beat up on the Kochs all they like in the bargain. Win-win! So, of course, Democrats probably won't do it.

Koch Bros. 'enormous money' in 'elections between Republicans and Republicans' responsible for new GOP 'silence' on climate...

During last Tuesday's Green News Report, we briefly discussed the U.S. Senate "all nighter" on climate change, where 28 Democrats and 1 Republican (Inhofe, the GOP's "Denier-in-Chief" who stuck around long enough to mock the effort) stayed up all night making speeches calling for climate change action in hopes of drawing attention to the issue.

We mocked it ourselves a bit, suggesting that Democrats might have carried out such a stunt during the day, instead of in the middle of the night when most people were asleep, if they really wanted folks to notice. In the meantime, our friend Kenny Pick of Turn Up the Night has been slogging through CSPAN's 17-hour video posting of the session and sends us a clip that caught his eye.

In it, Sen. Sheldon Whitehouse (D-RI), co-sponsor along with Sen. Barbara Boxer (D-CA) of the Senate #Up4Climate event, focuses a laser light on the U.S. Supreme Court's infamous 2010 Citizens United decision as a turning point --- a very bad one --- for climate change denialism, specifically on the flip-flopping by Republicans on an issue they actually did once appear to care about...

If the FEC is too (purposely) gridlocked to do it, state Attorneys General should take action...

Last year, as we reported at the time, California Republicans who sought to sabotage the roll-out of the Affordable Care Act, sent out deceptive mailers to constituents at taxpayer expense directing them to a fake "Obamacare" website.

This year, picking up on the idea that duping the public (committing fraud) is the key to their success, the National Republican Congressional Committee (NRCC) was recently found to have created at least eighteen websites built to appear to support Democratic candidates while, in actuality, using the sites to fund raise against those same candidates.

The website seen in the graphic above, for example, appears to support Arizona Democratic Rep. Ann Kirkpatrick's re-election bid --- unless you are very careful to read the fine print. The site, AnnKirkpatrick.com, "might greet visitors with a welcoming photo of the Arizona congresswoman and a screaming 'Kirkpatrick for Congress' logo, but that design belies its true agenda," according to the Los Angeles Times. That agenda, they say, includes duping supporters of Democratic candidates into donating towards their defeat --- a tactic, which, the non-partisan Campaign Legal Center's senior counsel Paul S. Ryan describes as a "slam dunk" violation of Federal Election Commission (FEC) Rules.

As we've recently been reporting, however, "slam dunk" violations of federal campaign finance laws and FEC rules are anything but a "slam dunk" when it comes to their actual enforcement by the FEC...
