On today's BradCast: The story of Donald Trump's firing of FBI Director James Comey turns even more bizarre and takes a decidedly thuggish turn (don't worry, your President is 'not a crook') and Vice President Mike Pence gets tapped to head Trump's new "voter fraud" commission, despite his own (much overlooked) record of stoking false GOP allegations of "voter fraud" and helping to shut down a major registration drive in his home state, just before last year's Presidential election, while campaigning for Veep and serving as Governor of Indiana.

First, the Trump/Comey affair turns more insane and Godfather-like by the hour...or Nixon-like, if you prefer, now that Trump has hinted there may be audio recordings of his private conversation with the now-former FBI Director. We bring you up to date on the latest madness and lies on that quickly moving soap opera, which continues to tie the White House into knots.

We then turn to the Executive Order signed this week by the President amidst all the Comey fallout, which creates a new sham commission, by fiat, to examine Trump's false claims that as many as five million votes were illegally cast in the 2016 election. The so-called "Election Integrity Commission" --- which, according to the Order, is to look at only voter and voter registration fraud, rather than voter suppression, which is a far more extensive problem or concerns about the vulnerability of vote casting and counting systems --- is to be headed up by Vice President Mike Pence and Kansas' notorious vote-suppressing Secretary of State Kris Kobach.

While many may be familiar, by now, with Kobach's years-long storied history of fraudulent 'voter fraud' claims, many are likely unaware of Pence's efforts last year during the campaign, while serving as Indiana's Governor, to suppress a major voter registration drive targeting African-Americans in Indiana, with false claims of "voter fraud" and the outrageously heavy-handed use of his State Police force.

On today's show, we detail how the offices of the Indiana Voter Registration Project were raided and shut down, with computers, cell phones and paperwork confiscated by Pence's cops, just days before the state's October 11, 2016 voter registration deadline. The effort (also aided and abetted by the state's Republican Sec. of State Connie Lawson, who is also set to serve on Trump's phony commission), served to shut down the major registration drive by a Democratic-leaning organization and resulted in the Marion County Prosecutor demanding an end to misleading and suppressing public statements from Superintendent of the State Police. It did not, however, despite claims of "thousands" of fraudulent forms, result in any arrests, and it was all quickly forgotten, as usual, after Election Day. In all, some 50,000 valid registrations may have been scuttled in the Hoosier State, thanks to the false claims of forged and fraudulent registration forms across dozens of counties in what Pence described to brain-addled supporters on the campaign trail as a "vigorous investigation into voter fraud".

Finally today: The White House lies about the number of new manufacturing and coal jobs created last month and North Carolina receives just 1% of their requested funding for Hurricane Matthew relief from Congress and the President...

On today's BradCast, a story out of Georgia serves as a jarring reminder that we'd better not wait until 2018 to be concerned about the integrity and public oversight of our electronically tabulated elections. Also, the political blame game is underway regarding the Republicans' planned use of the "nuclear option" in the U.S. Senate. [Audio link to show posted at bottom of article.]

Early last month, someone reportedly hacked into the voting records database at Kennesaw State University's Center for Election Systems, which is contracted to maintain and program all of Georgia's 100% unverifiable touch-screen Diebold voting systems and electronic poll books. The state still uses the same unverifiable 2002 voting systems that, as we reported more than a decade ago, were hacked in a minute's time by researchers at Princeton University, where they were able to implant a virus that could pass itself from machine to machine and flip the results of an election with little or no possibility of detection.

The recent hack at Georgia's KSU, which the Atlanta Journal-Constitution described at the time as possibly compromising some 7.5 million voter records, resulted in a quiet FBI investigation, and comes as special elections are about to be held in a number of states to fill U.S. House seats vacated by Republican members of Congress tapped to serve in the Trump Administration.

One of those special elections is in Georgia on April 18, where the contest to fill GOP Rep. Tom Price's seat in CD-6 (he's now Trump's Secretary of Health and Human Services) is drawing both national attention and a lot of money from both Democrats and Republicans. With a suprisingly popular 30-year old Democrat, Jon Ossoff, poised to potentially upset a splintered GOP field in the otherwise solidly Republican district, the race is being regarded as a potential bellwether for the 2018 elections.

Longtime computer scientist and voting systems expert Barbara Simons of VerifiedVoting.org joins me today to explain the ongoing concerns about the still-mysterious Georgia hack, Verified Voting's effort to get answers about it from GA's Republican Sec. of State Brian Kemp; the group's request to have him to offer paper ballots to voters in the wake of the reported "massive data breach"; and this weekend's similarly cryptic news that the FBI has now concluded its investigation.

As we discuss what we know, and don't, about the GA hack, Simons, co-author of Broken Ballots: Will Your Vote Count? and a member of the U.S. Election Assistance Commission's Board of Advisers since 2008, tells me that "it's a national scandal" that the state is still using those unverifiable systems for all elections.

Simons had also joined a number of renowned voting systems experts to plea with the Hillary Clinton campaign last year to seek a public hand-count of the Presidential election in several states, given questions about the exceedingly close race and the surprising results in a number of them. When Clinton declined to file for that common sense oversight, Green Party candidate Jill Stein responded affirmatively to the same plea. Nonetheless, as we also discuss today, hand-counts in Wisconsin, Michigan and Pennsylvania were largely blocked, thanks to efforts by Team Trump, state Republicans and even some Democrats.

We discuss all of that, the years-long effort to institute legislative safeguards against electronic voting and computerized tabulation systems; and why even paper ballots tallied by computers leave the public uncertain about the accurate results of elections. "Paper ballots in and of themselves are not sufficient. That lesson was very clear from the 2016 election," she tells me, as I ask about what I see as the need to publicly hand-count hand-marked paper ballots on election night in order to restore public confidence and oversight of results. "The problem is we have some very bad laws," she responds, offering her thoughts on legislative changes that are needed, short of ditching the computers entirely, in order to respond to what she sees as "a national security issue" in our elections.

Today, the President of the United States was ordered to pay $25 million in a fraud settlement to some 4,000 Americans. But, incredibly enough, that news has been barely noticed.

On today's BradCast [audio link to show posted at end of article], as the frenzied pitch of investigation into Team Trump and Russia ticks up a notch from 10 to at least 11, a former CIA Director bothers to notice the vulnerability of our nation's electronic voting systems...but fails to appreciate, or even understand, the actual threat. And North Carolina picked a very strange way this week to "celebrate" the 7th International Transgender Day of Visibility. And, this time, both Republicans and Democratic elected officials share the shame.

First up, a quick thought on today's federal court approval of a settlement requiring President Donald Trump to pay $25 million to those defrauded by his Trump University scam.

Then, James Woolsey, Bill Clinton's former CIA Director and short-term member of Trump's transition team, tells CNN that the media is focused on "the wrong issue" in the Trump/Russia investigations. Never mind his "government by tweet" or questions about the Republican Chair of the House Intel Committee caught colluding with the White House amidst their investigation. The real concern, he argues, should be that "25 percent, approximately, of our voting machines in the United States do not have paper backups, so if the electronics have been tampered with, you will never know, and you can’t do a recount. ... The rest is very minor by comparison."

He has more to say on the matter, some of which he is right about, some of which he is either wildly naive, misinformed, or hoping to misinform the public. So I have a few things to say myself in response to it all, as you might imagine.

Next, facing the loss of billions to their economy, North Carolina Republicans on Thursday finally "repealed" their discriminatory anti-LGBTQ "bathroom bill" (HB2) by replacing it with another (HB142) which LGBTQ advocates charge is nearly as odious and, in some measures, even worse than the original. This time, however, the new legislation was signed into law by a Democratic governor.

Attorney Tara Borelli of Lambda Legal, which has sued to block the state's law, joins us to explain the beguiling "fake repeal" and shameful reasons it was jammed through the state assembly in just hours yesterday.

"If you're struggling to figure out how HB142 fixes things in any real way for LGBT people, join the club," she tells me. "We, and a host of others, are incredibly disappointed, outraged, and frustrated with this so-called 'compromise' repeal deal. HB142 simply took a bunch of the bad old provisions of HB2 and perpetuated them, and further enshrined them into North Carolina law." Borelli details how and why state lawmakers "have tried to put, just to be blunt, a lot of lipstick on the pig" and why they were in such a hurry to do it.

Finally, Desi Doyen joins us for the latest Green News Report on the beginning of push-back from Dems and environmentalists in the wake of Trump's executive order on Tuesday, attempting to gut Obama's climate and environmental policies and legacy...

On today's BradCast, a former evangelical Christian who, after decades of participating in the political rightwing anti-abortion con has since seen the light, joins us to explain what Democrats need to do in order to encourage his "brainwashed" former followers to realize they've been scammed by Donald Trump. [Audio link to show at end of article.]

But first up today, U.S. officials admit some 200 Iraqi civilians in Mosul may have been killed during a U.S. bombing campaign last week, in what has become a startling and savage escalation in the so-called "War on Terror" since Trump has taken office. While the Obama Administration had carried out similar campaigns, the increase in indiscriminate lethality by the new President's campaigns in Iraq, Syria and Yemen is both alarming and vastly underreported or downplayed by U.S. media --- not to mention, counter-productive in the so-called "War on Terror".

Meanwhile, in North Carolina, the GOP's anti-LGBT "bathroom bill" is costing the state economy thousands of jobs and billions of dollars, according to a new analysis by the Associated Press. That, even as Republicans in other states, like Texas, are quickly moving to enact similarly "conservative" anti-LGBT laws in their own state.

Then, as Trump's approval rating continues to plummet to record lows, even his numbers among his own base of supporters --- white, male Republicans --- are beginning to erode. Still, overall support for the President remains high among Republicans as a whole, for now.

Author Frank Schaeffer, who formerly spent decades along with his father, theologian Dr. Francis Schaeffer, creating (and profiting from) the far right anti-abortion political movement, joins us to discuss how he believes Democrats can win back both the White House and Congress, from the perspective of someone who, for many years, had preyed on the fears and false facts favored by rightwing, so-called "values voters". You can't convince them of facts, a fired-up Schaeffer tells me today, but you can drop a lit metaphorical match into their gas tanks by helping them understand how Trump himself has "betrayed them."

"The over-arching bloc of people without whom [Trump] could not have been elected are white evangelicals, and that's my stomping ground." Schaeffer explains. "This was all before I left the evangelical world and changed sides both, you might say, theologically and politically. When it comes to understanding the brain of the evangelical movement, I know what I'm talking about. From birth, people raised in the fundamentalist subculture are taught to mistrust, distrust, renounce so-called 'world facts'. So, when science says that evolution proves something, or that the Earth is very old, or there wasn't a Noah's ark, you are taught from birth they are lying. We have our own facts. We have our own truth. That truth is in the Bible and our denomination's interpretation of it."

You can't convince these folks with facts alone that they are wrong, he argues, but you can help them see how they have been scammed. "If you come up with a fact-based argument, people's eyes in the evangelical world just glaze over, and instead of talking to you about the issue or the facts, all you get back is this stream-of-consciousness which is really more of a Pavlovian reaction and brain-washing," he says. "So, [Trump] had a built-in audience that liked what he was saying just because he's giving the finger to the established order of science, university teaching, learning --- and all those other things that so-called 'secular' people live by."

"That group of people is going to be looking at what he's doing to them when they lose healthcare," Shaeffer, whose latest book is Why I am an Atheist Who Believes in God, observes. "They're going to be looking at the fact that in that new budget of his, Meals on Wheels doesn't show up for their grandma anymore on that farm in Omaha. They're going to see one tweak too many ... That drip-drip-drip-drip of actual evidence in their own lives --- not reason, not argument --- but things going wrong because he is a fool, he is a charlatan, he is a faker, he is a fraud. In other words, when they wake up in the position your average Trump University student woke up in, finding their degree was worthless, they are going to simply start losing faith."

But will they? Haven't these same folks fallen for the same con many times in the past? Schaeffer, who worked with past Republican Presidents, responds to that question, and many others today in a lively (and angry) dressing down of both Trump and his supporters, who, Schaeffer insists, he still knows all too well.

Finally today, a pro-Trump demonstration in California over the weekend ends with a counter-demonstrator being repeatedly beaten with a "Make American Great Again" sign, and the pipeline oil spill reported last December in North Dakota, not far from the site of the controversial Dakota Access Pipeline, turns out to have been at least three time larger than originally reported...

Guest: Attorney Mark Joseph Stern of Slate...

On today's BradCast, as dark as yesterday's show was, today is somewhat the opposite, with a whole bunch of encouraging news from the courts and the people across these United States. [Audio link to show follows below.]

Attorney and legal journalist Mark Joseph Stern of Slate joins us to break down the full 4th Circuit Court of Appeals' potentially landmark decision upholding the state of Maryland's ban on semi-automatic "weapons of war" and the U.S. Supreme Court's ruling today on a race-based death penalty case out of Texas.

On MD's ban on military-style assault weapons, enacted by the legislature following the 2012 Sandyhook Elementary school massacre, the full court's majority ruling, including a number of Republican-appointed judges, soundly rejected the opponents argument that, as Stern says, "once enough people own a certain type of gun, the 2nd Amendment magically begins to protect it." He explains what may happen next with this case as it moves toward the Supreme Court and offers his thoughts on why GOPers and the NRA are suddenly unconcerned with their "states rights" arguments when it comes to guns.

On the SCOTUS death penalty case, granting a repreive, for now, to a Texas man on death row since 1997, Stern explains how the case underscores that "people who are sentenced to death in this country get the worst lawyers sometimes...It's really quite shocking." Incredibly enough, Chief Justice John Roberts eloquently agreed --- at least in this case.

Trump's lies distract from his Admin's dangerous actions on free speech, environment, voting rights and more. Guest: ACLU's Julie Ebenstein...

Never mind his inauguration crowd size or his claims to be "a very big person when it comes to the environment", or even his false claims about "voter fraud". On today's BradCast, while it may be hard to imagine, and the corporate media may have yet to fully notice, Donald Trump's actions speak much louder than his obnoxious words and virtually non-stop stream of public lies. [Audio link to show posted below.]

Don't be distracted by what Donald Trump says. Pay attention to what he does. To that end, while folks were debating his "alternative facts" on the crowd size at his inauguration, the new Administration was busy shutting down the Twitter accounts and ability for federal employees to communicate with the press and public at the Department of Interior, the National Park Service, the EPA and other federal agencies.

While claiming to be a champion for the environment this morning, he then signed an Executive Action to move forward with approval of the dirty and dangerous KeystoneXL and Dakota Access Pipelines by the afternoon.

While the new President continued to pretend that millions of illegal votes were cast in the 2016 election (even the New York Times called it a "Lie" in their headline!), he and his supporters fought successfully to stop the post-election "recounts" in all three states where evidence of such illegal votes --- if it actually existed (it doesn't) --- might have been revealed.

While the Administration claimed last week that their work wouldn't begin until Monday, their new Dept. of Justice leadership was taking action on Inauguration Day to undermine a long-standing lawsuit against Texas' unlawful Photo ID voting restrictions. Yes, Republican Trumpers understand the importance of voting laws and procedures --- even when it's not an election year. Do Democrats and progressives?

Julie Ebenstein, staff attorney at the ACLU Voting Rights Project, joins us to explain what exactly the Trump DoJ did on Friday in the Texas case and what it may signify for that case and others like it, what it all may mean for the future of the currently-gutted Voting Rights Act, and how the ACLU and other private plaintiffs plan to continue the fight for voting rights with or without the Trump Administration's DoJ on their side.

"There's certainly concern that DoJ will shift and no longer take the same positions that it's taken in the Texas and North Carolina cases --- and a lot of concern for future cases, for future protection of people's voting rights," Ebenstein tells me. "If the Department of Justice does not provide and enforce the same robust protections of the Voting Rights act, it's diluting the already scarce resources that are out there to challenge these laws." But, she vows, "we'll continue to do the work we've always done. There are certainly cases where private organizations like the ACLU will go forward without any Department of Justice involvement. We're going to keep doing what we do, no matter what we see coming."

Public outrages forces GOP to reverse plan to gut Congressional oversight on first day, U.S. media inappropriately credit Trump...

On today's BradCast, Desi and I are back from holiday break, and just in time for the start of the new Congress, where the GOP had hoped to break the U.S. House even further by gutting the independent Office of Congressional Ethics. [Audio link to show posted below.]

First: A huge thanks to Nicole Sandler and Angie Coiro for filling in for us while we were gone and allowing us some much-needed time off! Please support them, their work and all independent media, wherever you can find it! As today's show makes clear, it's more important now than ever!

The U.S. House watchdog office was formed by Democrats in 2008 after the massive Jack Abramoff influence-peddling and bribery scandals of the George W. Bush era. After voting last night --- with no advance notice or public debate --- to hobble the OCE, Republicans were forced to reverse their plans thanks to public outrage expressed through phone calls to Congress. Nonetheless, Donald Trump is being inappropriately credited by the corporate media for the reversal, despite the lack of evidence that he actually opposed the move or that his tweets were responsible for the GOP changing course.

The episode suggests that public opinion, outrage and shaming may still matter in these United States, even in the Age of Trump, and even if the corporate media fail to notice. But we'll see.

At the same time, as NBC News guts their own news reporting outlets, they've announced today they are hiring Fox "News" star Megyn Kelly for untold millions. And, in Wisconsin, the agency responsible for environmental protection has solved Climate Change...by simply changing their website to pretend it no longer exists.

But, hey, "It's a New Year and Time to Face Reality". All of that and more on today's BradCast!...

Guest: Univ of Chicago's Daniel Nichanian on proactive, state-by-state measures that Democrats can and must take to expand voting rights...

On today's BradCast: Enough playing defense. It's time for Democrats to go on the offense, in states all across the country, to expand the franchise, in numerous ways, rather than simply defending against increasing Republican efforts to restrict voting rights. And where they won't, it's time for progressives to hold them accountable for it. [Audio link to show follows below.]

Today I'm joined by Daniel Nichanian, election expert and post-doctoral fellow in political science at the University of Chicago to discuss his "Voting Rights Manifesto: A State-by-State Plan to Defend Democracy", as recently published in Vox.com's "Big Ideas" series.

Nichanian explains where and how Democrats can and must take action, right now, even during the Trump years, to expand voting rights and access to the polls. Yes, it can (and must) be done in states across the country where Democrats still have control of legislatures and governorships. In many cases, as he describes, Dems don't even need to control both.

No need to wait for and hope that Congressional Republicans to restore the Voting Rights Act, which they probably will never actually do. There are many ways for Democrats to expand voter registration (such as automatic universal registration and other reforms), expand the pool of those eligible to vote (restoring millions of felons' voting rights, for example), ways to make it easier to vote (early voting and easier access to absentee voting), and many other tools to take a proactive stand in the new year.

"The Democratic Party has not been at the forefront of the voting rights issue in the past two years," Nichanian observes. "The issue has really come to a head since the wave of Republican takeovers of state houses in 2010 and 2014, when the Republican Party really prioritized, in state after state, putting in place a very ambitious and consistent agenda of its own to curtail voting rights. The extent to which the Republican Party has prioritized this issue, it keeps taking Democrats by surprise." But, he explains, "when the Democratic Party has power, in many places, they really don't get their act together to think about what has to be done on this issue, and actually get it done."

We discuss how Democrats can do so. We also try and hold them accountable for not having done so to date in so many places where they should have by now --- even in places like New York and California. I'm hoping the conversation, and Nichanian's piece at Vox, might give us all something positive to work for in the new year, even at the same time as progressives build the resistance against the destructive, anti-democratic agenda of Donald Trump and the GOP.

The Arctic has turned freakishly warm over the past two months of what is likely to be the warmest year ever recorded on the planet (for the third year in a row). She also has some good news as the year wraps up, however: A new poll finds that Trump's voters actually support regulations on the burning of carbon that causes global warming and, something that even Trump can't change, solar power is now the world's cheapest form of energy. Take that, Big Oil, Big Coal and 2016!...

On today's BradCast, it's not much discussed by the media, but the cost of killing "ObamaCare" is more than simply a political one for millions of Americans. And the brazen GOP coup in North Carolina's state government is not only a fait accompli, but likely a model for Republican controlled states everywhere. [Audio link to show posted below.]

There's a lot of talk of late about the politics of "repealing and replacing" the Affordable Care Act by the incoming Republican Administration and GOP majorities in both the U.S. House and Senate. But there's not as much discussion in the media about the very real costs --- to actual human beings --- of repealing the measure, or of those who will be devastated by its loss, both medically and financially. All of this comes with more than 20 million more Americans now enjoying access to healthcare thanks to the ACA, and, just last week, the largest single day of sign-ups ever for the federal program.

But Republicans may no longer fear any political ramifications for anything with their gerrymandered stronghold of Congress and control of the nation's public airwaves.

That argument seems to be bearing itself out in North Carolina right now, where the GOP state legislature --- which already enjoys a super-majority in both chambers of the state assembly --- has successfully carried out a brazen power grab to strip power from the Executive Branch now that a Democrat has narrowly won election as Governor.

In NC and in Wisconsin alike, Republicans have recently been found by federal courts to have unconstitutionally gerrymandered state election districts. And, in both states, the GOP has passed wildly radical laws that hurt Democrats and progressive, no matter how unpopular (or unconstitutional) those laws may be or the ensuing uprisings at both state capitols. Both states are likely to be a model for GOP legislators in the rest of the country.

Repubs playing for keeps, Dems still bringing butter knives to gun fights...

On today's BradCast, Republicans are flexing their muscles and demonstrating their willingness to break all norms --- and even laws and the Constitution when necessary --- in order to take power and hold onto it at all costs, while Democrats continue to be caught flat-footed. [Audio link to show is posted below.]

An unprecedented attempted power grab is now underway at the capitol in Raleigh, North Carolina, where Republican lawmakers, stinging from having lost the Governorship and their majority on the state's Supreme Court last month, have suddenly convened an emergency "special session" to strip power from the incoming Democratic Governor.

The naked lame duck coup attempt by the GOP --- which already enjoys a super majority in both chambers of the statehouse --- would take away Executive Branch powers previously granted to the outgoing Republican Governor. If successful, the "sore loser power grab" as some are calling it, strips the incoming Democrat of control of state and county boards of election(!), limits his ability to make appointments, shifts power from the newly Democratic-majority high court back down to the Republican-controlled state court of appeals, and keeps Republican state employees in place across many state agencies.

All of those attempts to effectively undo the will of millions of voters also comes on the heels of a federal court order for new special elections for the state legislature in 2017, after finding that Republicans had unconstitutionally gerrymandered 28 statehouse districts following the 2010 census. (And that, not long after a federal court found Wisconsin Republicans had also done so.)

With a similarly unprecedented coup at the federal level --- for example, a stolen U.S. Supreme Court majority --- Republicans in a number of other states are also quickly working to pass newly restrictive laws to make it harder for Democrats to even take part in elections around the nation.

It's difficult to win a war when you're fighting against a dishonest opponent who has no interest in playing fairly. The questions then remain: When will Democrats figure that out? What do they intend to do about it? And who, if anyone, will emerge to lead the way in the current Democratic power vacuum more than a month since Election Day?

On today's BradCast, we cover an enormous amount of news, breaking and otherwise, on both the Presidential "recount" story in three different states, as well as the fight against the Dakota Access Pipeline in North Dakota. And we speak to Green Party candidate Jill Stein's campaign manager, David Cobb, about the ongoing and "escalating" legal battles and fights for citizen oversight of election results in Wisconsin, Michigan and Pennsylvania. First today, the latest on the breaking news over the weekend in the story of the denial of a permit for the controversial pipeline in ND, where thousands of native Americans have been protesting for months against its construction near tribal lands. On Sunday, in a huge victory, the U.S. Army Corps of Engineers denied an easement to Dallas-based Energy Transfer Partners that would have allowed them to complete the pipeline by building on disputed land near and beneath Lake Oahe, the Standing Rock Sioux's source of drinking water. The victory, while monumental --- even as the protests and violent attempts by law enforcement to stop them have been almost entirely ignored by mainstream corporate media --- may be short-lived, depending on legal actions and decisions made by the next President. Desi Doyen joins us for the latest.

At the same time, over the weekend, the corporate media was busy misreporting and misleading the legal maneuvers of Green Party Presidential candidate Jill Stein, who has dropped just one of the statewide voter-initiated suits demanding a PA "recount", in favor of a federal filing [PDF] today, on Constitutional grounds, seeking federal intervention for a statewide count and forensic analysis of 100% unverifiable voting systems used there. Stein and her attorneys held a press conference and rally today outside of Trump Tower in Manhattan, to explain the efforts.

Also, a federal judge this morning ordered [PDF] the state of Michigan to being counting ballots today, after successful maneuvers by Team Trump delayed the start of that effort late last week and had hoped to further delay or deny citizen oversight of results entirely. MI's Attorney General (a Trump supporter) falsely argued in his filing and during an unusual emergency hearing in federal court on Sunday, that the count might endanger the state's Electoral College votes. U.S. District Judge Mark Goldsmith ordered the counting to begin at noon today, however, finding that any further delay "would likely violate [plaintiffs'] right to vote under the First and Fourteenth Amendments" and that "there is a credible threat to the voters' right to have a determination made that Michigan's vote for president was properly tabulated." The MI GOP has vowed to appeal both the federal and state cases against counting ballots.

My guest today, Stein's campaign manager David Cobb, the Party's 2004 Presidential nominee --- who, himself, called for the partial statewide count that happened after that year's Presidential contest in Ohio --- joins us to discuss the latest developments in the ongoing counts and court cases in all three states, and to explain why Stein and the Green Party "are demanding integrity in the election system."

In PA, he explains (as we long have as well), that "there is no way to properly verify the DRE --- direct recording electronic --- equipment, otherwise correctly known as 'black box voting'. It's terrible to begin with and they should never be used. ... The real gain here is forensic experts getting an opportunity to get their hands on these machines --- and that is exactly what we are seeking in all three states --- but, in Pennsylvania, in federal court specifically, because of the completely outrageous system of recount provisions in the state." (To get an idea how horrific they are, check out my interview with VotePA's Marybeth Kuznik from last week, or read today's filing [PDF] in federal court.)

"I really want to underscore," he tells me, "we are escalating the fight into federal court in Pennsylvania precisely because the Pennsylvania laws are so horrible."

"These black box voting machines are hackable," he continues. "If any nefarious individual can get their hands on them, there are ways to manipulate them. That's the reason it's so important to have these forensic studies done. So that we can literally verify the vote. What is Donald Trump afraid of?"

We also discuss the efforts of the Green Party going back to Cobb's own attempted "recount" in Ohio, when two top election officials in the state's largest county, Cuyahoga (Cleveland), were found guilty and sentenced to the maximum sentence in prison for having rigged the 2004 Presidential "recount".

"We are demanding that every vote counts, so count every vote! It's just that simple. At the end of the day, if we do not have confidence in the election system, we cannot have confidence in our government itself," he argues.

Finally, speaking of counting votes (or not), North Carolina's abhorrent Republican Gov. Pat McCory has announced he is giving up his own battle for a statewide recount (which we supported) and has conceded the race to the state's Democratic candidate Attorney General Roy Cooper, becoming the first Governor to lose a re-election bid in state history...

On today's BradCast: As we first broke last week, Green Party Presidential candidate Jill Stein has now filed for 'recounts' (attempts at first time hand-counts and forensic audits, in any event) in Wisconsin, Pennsylvania and soon in Michigan. Independent candidate Rocky De La Fuente has also filed in WI. [Audio link to show is at end of article.]

Today we catch up on all that the calls for "recounts" have led to over the weekend and since the holiday break last week, including: News on the more than $6M raised by Stein to pay for the counts so far (the number that both she and the attorneys seeking the counts had told me about last Monday before any of this had become public); the Clinton Team (somewhat) joining the effort; Donald Trump demeaning it as a "scam" and offering wildly false claims of "voter fraud"; Stein's emergency effort to draft needed voter volunteers for filings in PA; the legal question (and now lawsuit) over whether WI will "recount" paper ballots by hand or by the same computers that tallied them in the first place; whether there will be sufficient time for any kind of proper public counting before the federally mandated December 13 deadline; and whether there is anything to count in PA at all, where they still shamefully force voters to use 100 percent unverifiable touch-screens across most of the state.

We are joined by long-time election fraud investigator and author Richard Hayes Phillips, to discuss all of that and his detailed report about the unusually large apparent voter turnout numbers in many rural WI municipalities and the difficulty citizens have in verifying and overseeing those numbers. As Phillips explains, there are horrible public reporting requirements for both results and for same-day voter registration provisions in the state.

"At a minimum, the problem is a lack of transparency," Phillips tells me today. "We have no way of knowing how many registered voters there are [in WI]. If you don't know how many registered voters there are, you don't know if too many ballots were cast." His report finds that, based on the latest state-reported voter registration numbers, there were "193 towns with turnout of 90% or better, 25 towns with turnout of 95% or better, and 7 towns with turnout of 100% or better." Those exceedingly high turnout numbers are likely lower in reality, due to same-day registration in WI, but the lack of reporting requirements for those numbers is "unacceptable".

"This is the period of time during which we must analyze those numbers to decide whether or not to challenge the election, and we don't have reliable numbers to use!" Philips, who personally examined tens of thousands of ballots and poll books and much more in Ohio after the disputed 2004 election there, resulting in his book Witness to a Crime: A Citizens' Audit of an American Election, says WI's turnout numbers remind him of a number of counties where he found fraud in Ohio, where there was some 80% turnout reported.

He also warns --- as I have, very loudly, for many years --- that there are almost no ballots to actually count in PA. "The five biggest cities in Pennsylvania that have no paper record of anybody's vote, except for absentee ballots, which only amount to 1 or 2% of the ballots," he says. "My God, if Wisconsin and Michigan which are very close were to actually flip and fall to Hillary Clinton's column, we will face a constitutional crisis, because this whole election will come down to Pennsylvania and the vote cannot be verified. I want America to know this."

Also hearkening back to Ohio in 2004, Phillips notes that there are tens of thousands of ballots with no vote at all for President in MI --- even near Detroit --- according to the state's unverified optical-scan tabulators. It's impossible to know how people voted, unless paper ballots are actually counted by human beings, he confirms. "Who knows who these ballots are actually marked for?"

"I'm not a shill for Hillary Clinton. I didn't even vote for her. But I want everyone's vote to count," he argues. "I want the winner to win and the loser to lose." Crazy idea, I know. Please take some time to listen to today's program...

On today's BradCast: Will the 2016 Presidential election be publicly hand-counted (what some call a 'recount')? Should it be? Experts, citing anomalies in the reported results and other concerns, are beginning to say 'yes'. But action would need to be taken --- and a lot of money raised --- by one or more of the Presidential candidates quickly in order for that to happen. [Audio link to full show follows below.]

I haven't been the only one asking questions about the reliability of the reported results of the November 8, 2016 election and whether voters should have confidence in the computer-tallied results. As we've been reporting since Election Day, there are a lot of folks looking at the numbers and asking questions about what actually did --- or didn't --- happen. A number of world class computer science, voting system and election integrity experts are beginning to urge for a public count of the election in a number of key states.

With approximately 100,000 total votes (out of more than 13 million cast), reportedly separating Clinton and Trump in the states of Wisconsin, Michigan and Pennsylvania alone, I can confirm that a number of those experts believe it would be a worthwhile exercise to file for hand-counts to make sure the results are correct. (Remember, just 50,000 votes recorded for Clinton instead of Trump across those three states would mean she, not Trump, becomes the next President of the United States.)

Today we look at just a few of the anomalies that have been widely cited today by some of the nation's top election experts, such as more votes reportedly cast in the Presidential election than the "Total Votes Cast" in a number of Wisconsin counties --- at least according to the counties' initially reported results.

Author and long-time election integrity journalist Steven Rosenfeld of Alternet recently wrote about just some of the concerns being analyzed and noted by experts that both he and I have been speaking with in the days since the election. He joins me to discuss concerns and discrepancies in several states where hand-counted "recounts" could, potentially, flip the results of the Electoral College and the Trump/Clinton election along with it.

"The big point here is we don't really know --- still --- what the actual count is," Rosenfeld tells me. "I, like everybody else, would like to really know what happened. And I can accept the results if I know that they're true and accurate...so let's make sure that people's votes are accurately counted. "

We also discuss the challenges that would be faced by a candidate calling for such a count and the money (lots of it, about $2 million per state) that they would need to raise in a hurry in order to get such a hand-count and a forensic analysis of voting systems and tabulators in the states where experts are saying the effort may be well worth it.

Journalist David Dayen of New Republic, the Fiscal Times and The Intercept, joins us to discuss how President Obama has one last "trump card" to play, if he wishes to block Republicans from out-and-out theft of the nation's highest court, at least for a while. But would Obama do it? Could he do it legally? And would Democrats end up being sorry if he did? We discuss that, whether Democrats will continue to "bring a butter knife to a gunfight", and much more today with Dayen, author of Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud..

Meanwhile, down in North Carolina, where voters appear to have elected a liberal majority to the state Supreme Court and may have rejected their controversial Republican Governor's re-election bid by a slim margin, the Republican-majority state legislature has a scheme to overturn the will of the voters in both the gubernatorial contest and at the NC high court. Because that's how the GOP rolls (and Democrats don't).

Finally, Desi Doyen joins us for the latest Green News Report, with a slim ray or two of optimism, believe it or not, as Sen. Bernie Sanders offers a way for Obama to (permanently?) block the Dakota Access Pipeline from being built, and international U.N. climate negotiators vow to keep reducing greenhouse gas emissions, no matter how Trump plans to undermine efforts to curb global warming...
