I've covered the problems and failures in NY-23's recent Special Election for U.S. House in a number of previous articles here at The BRAD BLOG, detailing some of the early problems with results as they emerged, pointing out that, thanks to Republican precedent in 2006, it now no longer really matters whom the actual voters may have voted for, but arguing that a full manual hand-count of paper ballots would be appropriate nonetheless.

Over the holiday weekend, the good Richard Hayes Phillips --- author of the book Witness to a Crime, in which he painstakingly detailed, ballot by ballot, the scandal which was the Ohio 2004 Presidential Election --- reported on some curious numbers he's now found in that election, over at the right-leaning Gouverneur Times. As luck would have it, Richard is a resident of NY-23 himself, and seems to be finding that both "impossible" and then many more "improbable" tallies were certified, as NY tested its Seqouia/Dominion e-voting systems on live voters, in a real, live election, for the first time earlier this month.

Both of his pieces are worth a quick read over there.

And now, the Gouverneur Times has asked me to put together a bit of a "backgrounder" for them on all of these e-voting nightmares, and how they pertain to NY-23, since it seems that right-wingers, for some odd reason, are somewhat lacking (up until now anyway) in real information on just how dangerously insane our privatized system of e-voting in public elections has become. Too much time spent being fooled by ACORN-conspiracists like Andrew Breitbart and Fox "News," I guess.

My piece for them, "NY-23, Sequoia and the Private Corporate Takeover of Your Once-Public Democracy," as written over the weekend, following the latest in a string of embarrassing "concessions" and "un-concessions" by the Conservative Party's Doug Hoffman, is now their front page lead story if you (or Breitbart) care to give it a look.

An update to the reports of an e-voting 'virus,' and other failures, in New York's recent Special Election for the U.S. House...

John Conklin, the Director of Public Information for New York State's Board of Elections has now issued a statement in response to the Gouverneur Times' article by Nathan Barker last week, alleging a "VIRUS in the VOTING MACHINES" [caps in original headline] which, the paper says, "tainted the results" of the recent Special Election for the U.S. House in NY's 23rd Congressional district.

We responded to Barker's detailed article ourselves over the weekend at some length, noting both the accurate and inaccurate information and assertions included in the online publication's coverage.

Conklin's response has drawn two responses in turn from the Gouverneur Times, as the right-leaning publication appears to have joined in the fight for election integrity, at least on behalf of their favored Conservative Party candidate whose apparent election loss has indeed been "tainted" by the very same concerns about which The BRAD BLOG has been warning for years. We're happy to see their new-found concerns, even as Republican partisans in political alignment with the Times have been ignoring and/or disparaging similar reports for years following elections in which Democrats have been the apparent victims of similarly failed voting systems...

Recent allegations from the Right of malware on voting machines in New York's November Special Election may be overblown, but the long-overdue general concerns are right on point...

On Thursday, Nathan Barker of upstate New York's Gouverneur Times --- a far-Right online publication (featuring columns by the likes of Michelle Malkin, Oliver North, Chuck Norris, and all the rest of the wingnutters) --- filed a lengthy, and somewhat breathless, report alleging a computer virus had infected several of the new e-voting systems in first-time use during the November 7th Special Election in NY's 23rd Congressional district between Democratic candidate Bill Owens, Conservative Party candidate Doug Hoffman, and Republican Dede Scozzafava (who dropped out of the race just prior to Election Day and threw her support to the Democrat).

Barker charged that a "VIRUS in the VOTING MACHINES" [his caps] resulted in "tainted results," "casting doubt on the accuracy of counts retrieved from any of the machines" used in the election.

Owens was reported to have won the election by a small margin on Election Night --- made smaller as errors were discovered during the post-election canvass --- before being hastily sworn in to the U.S. House just a few days later, in time to provide a crucial Democratic vote in favor of the health care insurance reform bill.

Barker's detailed report clearly offers a hard-right undertone, obviously in support of the Conservative Party candidate Hoffman. The article also advances several unsubstantiated conspiracy theories and features a number of out-and-out inaccuracies as well. A number of the piece's key allegations, though important, are also disputed by election officials, and at least one lead member of New York's election integrity community --- which is, itself, split between supporters of the new optical-scan e-voting systems and those calling for the retention of the Empire State's long-used mechanical lever voting machines.

Nonetheless, Barker raises a number of significant points and important concerns, about which The BRAD BLOG has been warning for years, often in the face of derision, notably from the same Rightwing circles crying foul now, who had previously dismissed such concerns as those of 'tin-foil hat wearing, sore losers and conspiracy theorists' despite actual hard evidence and scientifically-sound details proffered about such concerns.

It's somewhat amusing to see some on the Right, now that they have concerns about a close election, suddenly find religion on the very issues they'd derided as nonsense so stridently in the past. It's very tempting to either disregard them now entirely, or torture them mercilessly on that point. But we'll try to take the high road here since their central concerns, now that they've finally arrived and no matter how long overdue, have been ones that we've shared for years, whether or not they might have stood to adversely affect Democrats, Republicans or independents.

The bottom line is that whether a computer virus, malicious or otherwise, affected the results of the NY-23 Special Election or not --- we've seen no actual evidence that it did, and state officials offer a differing explanation for the e-voting system failures that did occur --- it certainly could have. The direct threat to democracy inherent in the concerns expressed by Barker (whether substantiated or not), underscore the foolishness of using such secret vote-counting systems at all. In New York --- where voters, in real elections, are essentially being forced to serve as beta testers of these new, federally-uncertified systems, made by a company with a long track-record of failure, lies, obfuscation, near-bankruptcy, secretive foreign ownership, election disaster after disaster, and dissembling to the media, as well as federal, state and local officials --- the foolishness is all the more apparent, unnecessary, unfortunate and a clear and present threat to democracy itself...

We're watching results as they're coming in tonight, while continuing to comb through various problem reports as they've been coming in throughout the day (the usual "hiccups" "glitches" "snags" and "snafus" reportage --- anything but the proper word for them all: "failure"!)

As we always find necessary to remind readers on such nights, the bulk of election failures tend to reveal themselves in the hours and days --- and sometimes even weeks --- after Election Day.

With that in mind, of the most potential note that we've seen so far today --- though mostly downplayed as minor "glitches" in most of the stories reporting them --- we've found reports of: Diebold touch-screen machine failure in OH's Montgomery and Greene Counties; new e-pollbooks failing in Suffolk County, NY; new Sequoia/Dominion optical-scan systems failing in St. Lawrence County, NY, and; Sequoia touch-screen failures in Essex, Somerset and Goucester Counties, NJ.

Fortunately, turnout has been light today, so the problems that have cropped up seem to have been handled by quickly replacing machines (a luxury available during slow, off-year elections when there are extra machines to go around) or in such a way that delays --- and the voter disenfranchisement that goes with them --- were minimal. At least as so far reported.

Whether any of the results tabulated in secret, with secret software, are actually accurate, well, that's anyone's guess as usual. In any case, we're monitoring, and will let ya know if there's anything you need to know about. Please feel free to let us know about anything you think we should know about in comments.

Other than that, we're just stunned that ACORN did such a terrible job, yet again, at "stealing the election" in New Jersey!

UPDATE 9:29pm PT: New Sequoia op-scan systems fail in Fulton County, NY and are impounded by court order. Emergency paper ballots are used. Fulton is part of the hotly contested NY-23 Congressional special election.

Paging the E-Voting Geek Squad!

Following public records requests in Riverside County, CA, the Election Defense Alliance has received a public copy of code used to program a recent election on an e-voting system made by Sequoia Voting Systems, Inc.

The result is a first-of-its kind public examination of such code, as now underway on a wiki page called the "Sequoia Voting System Study Project" which was created by the group this week.

"For the first time ever, the internal guts of a modern voting system will be publicly examined in a collaborative, open fashion," the page explains before explaining that the code, prior to being released, was first given to Sequoia by Riverside County to strip out whatever they regarded as proprietary information.

"As near as we can tell," the wiki page notes, "instead of stripping out proprietary stuff of any sort, Sequoia simply committed vandalism: they stripped the Microsoft SQL header data off the top, expecting that this would ruin access to the data under any possible database utility, making the contents unreadable."

But according to project participant Jim March --- a long time citizen e-voting watchdog and inveterate software geek --- Sequoia didn't succeed...

In letter to federal Election Assistance Commission, investigators from CA's unprecedented e-vote review blast the approval of flawed protocols in certification tests for new Diebold e-voting system...

A group of computer scientists and security experts from California's 2007 landmark "Top-to-Bottom Review" (TTBR) of electronic voting systems have sent a two-page letter [PDF] of condemnation to the U.S. Election Assistance Commission (EAC), taking the federal body to task for their approval of misused security findings from the TTBR in recent certification testing for a new e-voting system made by Diebold/Premier.

The voting system, Premier's Assure 1.2 --- made by Premier Election Solutions, Inc. (formerly named Diebold Election System, Inc. and recently purchased by Election System and Software, Inc.) --- was granted federal certification by the EAC last August under new test protocols which "should not have received the EAC's approval," according to the letter penned by Aaron Burstein and Joseph Lorenzo Hall, and signed by twelve other investigators and participants in the TTBR project.

The letter was addressed to the EAC's Director of Testing and Certification Brian Hancock, a longtime official at the commission with a disturbing background of helping to hedge test results for other electronic voting systems...

Media, Congress yawn...

RAW STORY's coverage of the news, and the release of the video demonstration of how to hack a Sequoia AVC Advantage electronic voting machine, began this way last week:

A team of computer scientists at University of California, San Diego, the University of Michigan and Princeton University announced a new way to electronically steal votes Monday.

"We wanted to find if a real criminal could do this, starting from scratch, with no access to source code or other closely guarded technical information," the announcer begins. "We faced several challenges: getting a voting machine, figuring out how it works, discovering a weakness, overcoming the machine's security features and constructing attack software."

"In the end we found that it is possible to undetectably change votes and that such an attack takes a lot less time and money than one might expect," the announcer said.

A Princeton professor was able to acquire five voting machines for just $82 that had been resold on a government surplus website. The acquired machines were originally sold by Sequoia Voting Systems.

Hacks of our electronic voting systems used to be big news. Now though, it's been done so many times, and is apparently so simple to do, that the news hardly registers in the corporate mainstream media (if it ever did in the first place). Yet, almost nothing has been done about virtually any of it to date.

We reported on the Princeton professor, Andrew Appel, acquiring the five Sequoia AVC machines two and a half years ago, that he was able to pick the lock "in seven seconds", and change the chips inside to do anything he might want the machine to do, including change votes after the close of polls on Election Day. The five machines that Appel purchased for $82 on the Internet were purchased by New Jersey just a few years earlier for $10,000 a piece. The state still uses the same hackable, 100% unverifiable voting machines, despite numerous failures during actual elections.

At the time of Appel's purchase, Sequoia Voting System had been touting their "tamperproof products, including ... the AVC Advantage," which, they said, "are sought after from coast to coast for their accuracy and reliability."...

Extra votes haunt two recent elections, run by two different companies, in two different places

Two stories of thousands of "phantom votes" being added to election result totals by electronic voting system were in the news over the past couple of days.

One is some news in the older story of 1,500 votes added to a precinct's results in D.C.'s primary election last September. The maker of the failed voting system, Sequoia Voting Systems, Inc., originally tried to blame "static electricity" and then "human error" for the failure. But as the D.C. City Council was having none of it, the company has now agreed to allow an independent inspection of its hardware and software, in order to avoid yet another expensive court battle for the beleaguered company.

The other story concerns nearly 5,000 "phantom" ballots added by the ES&S AutoMark optical-scan system used in last week's Rapid City (Pennington County), South Dakota, City Council race, for some still unknown reason, currently chalked up for now to "software glitch." The discovery of the failure led to a change in the originally reported election results.

Roe to Rove: 'You guys wouldn't be in White House without Tom'
So what did he mean by that?...

Late this week, Politico's Anne Schroeder ran details of a purported public showdown, in a D.C. steakhouse, between Karl Rove and Jason Roe, the former Chief of Staff to FL's former Republican U.S. House Rep (and alleged vote-rigging conspirator) Tom Feeney.

During the exchange between Rove and Roe, as reported by Schroeder, Rove tells Roe that he has a file on Feeney, and Roe, who was angry with Rove for cracks he'd made on Fox "News" at Feeney's expense just after the extremely corrupt FL Republican had lost his 2008 election, says angrily to Rove: "You guys wouldn't be in the White House without Tom."

Given the coverage we've offered over the years on Feeney, and former Republican computer programmer Clint Curtis' allegations against him, several folks --- including our friends Marcy Wheeler of emptywheel and Patty Sharaf, filmmaker of Murder, Spies & Voting Lies: The Clint Curtis Story --- sent us the link to the Politico article, asking our opinion on what Roe may have meant by that crack.

"I follow the vote. And wherever the vote becomes an electron and touches a computer, that's an opportunity for a malicious actor potentially to...make bad things happen," CIA cybersecurity expert Steven Stigall explained, in a stunning presentation to a U.S. Election Assistance Commission (EAC) field hearing held one month ago in Orlando.

As initially reported earlier this week by Greg Gordon at McClatchy, "Stigall said that voting equipment connected to the Internet could be hacked, and machines that weren't connected could be compromised wirelessly. Eleven U.S. states have banned or limited wireless capability in voting equipment, but Stigall said that election officials didn't always know it when wireless cards were embedded in their machines."

"The CIA got interested in electronic systems a few years ago," Gordon reports Stigall as explaining at the EAC hearing, "after concluding that foreigners might try to hack U.S. election systems."

But as disturbing as Stigall's presentation was, what's almost as disturbing is that it took more than 11 days, McClatchy's coverage, a number of FOIA requests from VotersUnite's John Gideon (a frequent guest blogger here), and a couple of articles from BRAD BLOG alum, Michael Richardson of the Examiner (his coverage is here and here), before the EAC finally released the complete transcript of the meeting [WORD], including Stigall's remarks.

"The presenter did not provide the presentation, 'Computers and Elections: The Growing Potential for Cyber Vote Fraud', to the EAC, so we have no materials responsive to your request," Gideon was told in response to his Freedom of Information Act (FOIA) request to the EAC, as reported by Richardson. "We received the transcript on March 16, 2009, and it will be publicly available in the next few days."

As of last night, 10 days since the EAC admits they received the transcript of their own event which had taken place 20 days earlier, they had neither sent it to Gideon in response to his request, nor posted it on their website. As of this morning, a month since the hearing, it's finally up on their website, thanks in part, no doubt, to the pressure brought on the EAC by the public to do so. Even then, Stigall's remarks are not posted separately, as other presentations are, but rather, one has to go looking for the full transcript of the actual event to find it. So why both the delay and obfuscation from the famously dysfunctional (a nice way to put it) federal agency? Make your own best guesses, since there is no official explanation for the moment.

Happily, there were others at the meeting who had transcribed the CIA cybersecurity expert's startling remarks --- decimating the idea of supposedly "secure" e-voting --- independently, who then helped to bring it to the public's attention. Clearly, the strongly pro-e-voting EAC had/has little intention of doing so themselves.

Stigall's presentation, and we've got much more of it excerpted below, include a passel of disturbing thoughts. Many of them we've tried to impart on these pages for years, including comments which point up the dangers we've tried to warn about concerning pre-election voting machine "sleepovers" at the houses of pollworkers, and more indications of the dangers of Sequoia Voting Systems clandestine, on-going relationship with the Hugo Chavez-tied Venezuelan e-voting firm Smartmatic, as we reported exclusively here one year ago --- to little interest from the corporate media, despite Sequoia's claims to federal investigators that they had severed all ties with the firm...

Michelle Shafer is the "Baghdad Bob"-in-chief of the e-voting industry. She's the VP and spokesperson for Sequoia Voting Systems and spokesperson for the e-voting industry as a whole via the Election Technology Council (ETC), a "trade group" created and sponsored by the nation's top four e-voting companies (ES&S, Sequoia, Diebold/Premier, and Hart Intercivic) to help spread their anti-science, anti-reality, pro-e-voting propaganda.

In the very last line of an article published on Thursday, on yet another e-voting related issue (which we may cover in more detail later), Michelle "Baghdad Bob" Shafer is quoted thusly:

Sequoia spokeswoman Michelle Shafer noted, however, that no electronic voting system has been compromised in an election.

As irony would have it, Thursday was also the very same day that news broke of the arrest of a cabal of election official insiders --- including a circuit court judge, the school superintendent, and a number of both Democratic and Republican polling place judges --- charged with having used the electronic voting system to compromise election after election, from 2002 to 2006 in Clay County, Kentucky.

Of course, very strong evidence exists that many other elections have been similarly manipulated on electronic voting systems by election insiders (see here, for just one example), including by both election officials and employees of the various private vendors whom Shafer represents. Much of that evidence, however, has been held at arm's length from citizen election integrity advocates under the absurd argument that that information is a proprietary, legally-protected trade secret. That specious argument has been made for years by the very government-funded corporate welfare queens, like Shafer's companies, that have been paid by our government to privatize our public elections.

So it's been difficult, at least until last week, to point disinformation experts like Shafer to the very evidence that reveal her statement, repeated time and again, to be a lie --- thanks in no small part to the "trade secret" claims of folks like Shafer. Get it? It's a helluva self-perpetuating scam...

At least $160k is billable to Sequoia Voting Systems, as per state requirements for use of touch-screen systems
Registrar Barbara Dunmore, one of worst in nation, fights on behalf of voting machine company, as county's $90 million budget shortfall grows...

With the entire state of California facing a massive budget crisis, and most, if not all, of its counties facing shortfalls this year, Riverside County's Registrar of Voters, Barbara Dunmore, is refusing to collect at least $160,000 from Sequoia Voting Systems for the cost of manually counting paper trails produced by their touch-screen voting systems last November.

California counties which choose to use touch-screen voting systems to serve disabled voters are required to tally all of the so-called "paper trails" by hand after elections, as per requirements for their use as imposed by Sec. of State Debra Bowen in 2007, due to security concerns with such systems.

The cost for that tally is to be covered by the voting machine company, as per Bowen's certification documents, which state: "Elections officials are required to conduct the audits, and the vendor is required to reimburse the jurisdiction."

Nonetheless, Dunmore, who has an extraordinary history of failure during her tenure as Registrar, in both the distant and recent past, has failed to seek reimbursement. And her office now seems to now be fighting, on behalf of Sequoia, to keep the beleaguered e-voting supplier from having to pay the costs, despite clear terms of use for such systems in this state...

In New Jersey there is a lawsuit that has been going through the court process since 2004. The complaint asks the State Superior Court to block the use of nearly 8,000 Sequoia Advantage Direct Recording Electronic (DRE touch-screen) because they “cannot be relied upon to protect the fundamental right to vote.” This lawsuit probably played some large part in legislation that required voting machines used in the state to be outfitted with a Voter-verifiable Paper Audit Trail (VVPAT).

Sequoia Voting Systems has not been able to meet the legislative deadlines, for a VVPAT printer, which have been moved a couple times. In fact only recently it was announced that the legislature may introduce new legislation to repeal the previous legislation. This move would probably have given more strength to the lawsuit.

Now, suddenly, the state has announced that they will require the Sequoia DREs being used in 18 counties to be refitted with VVPAT printers. It seems clear that this move by the Secretary of State is an attempt to make the lawsuit moot. The state will surely argue that because the DREs are refitted with printers there is no need to change to optical-scan technology.

One question that the state and Sequoia must answer though: Is there a printer in development or developed by Sequoia for use on the Advantage? If not, the state continues to be in violation of the law and it seems that they are being aided and abetted in that by Sequoia.

Also there are hints in the Houston media of problems in the vote count last Nov. Look for more on that over the next week or more....

Andrew Appel Answers to Official Smears from Sequioa Voting System's VP, Spokeswoman Michelle Shafer
'False Assertions' Made in Wake of Prof's Court-Ordered Report Finding Major Flaws in Company's Voting Machines...

In an October BRAD BLOG article we reported that a court-ordered report highly negative of Sequoia Voting Systems products being used throughout New Jersey could soon be released to the public. Prior to the release date, and then again last week, Sequoia Voting Systems attacked both the report and its author, Princeton University computer science professor Andrew Appel.

On December 18, Sequoia issued a press release with a misleading title and subtitle:

PLAINTIFF'S EXPERT, PRINCETON'S ANDREW APPEL, TWICE VIOLATES COURT'S PROTECTIVE ORDER IN ELECTRONIC VOTING CASE INVOLVING THE STATE OF NEW JERSEY AND SEQUOIA VOTING SYSTEMS

Appel ordered by judge to apologize and pay motion legal fees to Sequoia Voting Systems in Reed Guscoria, et al., Plaintiffs vs. James E. McGreevey, et al., Defendant

And, on the company's blog, written by VP of Communications and External Affairs Michelle Shafer, she continues the lie:

VIOLATION OF PROTECTIVE ORDER IN NJ BY PRINCETON'S ANDREW APPEL, AN APOLOGY AND PAYMENT OF LEGAL FEES TO SEQUOIA.

In an email to this writer, Professor Appel responded to what he says are "false statements about me in two recent press releases" from Sequoia. The BRAD BLOG posts his response in full below, with his express permission...
