With the bipartisan January 6 Committee having postponed today's hearing, we take the opportunity on today's BradCast to spend some time rebutting the disgraced former President's supposed rebuttal to the two damning hearings held to date. But, of course, we've got much more as well, including election results from Tuesday and evidence of both voting system problems and bad faith elected MAGA officials already trying to disenfranchise 2022 voters. [Audio link to full show is posted below this summary.]

Among the stories covered on today's program...

  • An error caused by paper jams during ballot scanning on Election Day at the precincts on the state's computer tabulators in Iowa during their June 7 primaries has reportedly resulted in a whole bunch of recounts across the state. Cedar Rapid's KCRG cites an email from the Sec. of State's office which has lead to those recounts, in hopes of reconciling the number of ballots misreported by the scanners as cast with the number of voters who actually signed in to vote.
  • Noteworthy election results from four states which held primaries on Tuesday (Maine, Nevada, North Dakota and South Carolina) and one (Texas) which purposely held a low-turnout U.S. Special Election yesterday, instead of at the same time as their regular primaries in March or primary runoffs in May. While we cover a lot of Tuesday's races, and why they matter (or don't), the most disturbing one is likely the Secretary of State's race in Nevada, where a 2020 election denialist by the name of Jim Marchant has apparently won a 38% plurality to become the GOP's nominee to become the critical swing-state's chief election official in advance of the 2024 election.
  • The dangers of an election denier like Marchant, who served as one of the state GOP's fake electors in 2020, and who has said he wouldn't have certified Joe Biden's victory over Donald Trump that year had he been SoS at the time, is a stark warning of what lies ahead. But we're already seeing the dangers of brain-poisoned MAGA Mobsters in positions of elected authority. The three-person County Commission in a very right-leaning rural county in New Mexico, is refusing to certify results from their June 7 primary. Even though votes are cast on hand-marked paper ballots across the state, the County Commission unanimously voted against certification of primary results, citing distrust of the County's digital ballot scanners made by Dominion Voting. They have no evidence of fraud, which might otherwise allow a court to order the hand-count they are seeking. They just don't trust the results in the County where Trump won 62% of the vote in 2020. The Republican County Clerk is furious and the Democratic Sec. of State is now suing the County Commission ahead of this Friday's deadline for County certification. Expect much more of this in the months and years ahead. We've long warned about exactly this type of fallout from our irresponsible rush to the use secret vote casting and counting systems made by private vendors and the avenues it opens for opportunists to claim fraud without any evidence of same.
  • On Monday night, after the bipartisan U.S. House Select Committee investigating the January 6, 2021 attack on the Capitol and other efforts by Trump to steal the 2020 election, our corrupt former President issued a 12-page rebuttal [PDF] to the Committee's first two hearings. We rebut his dumb rebuttal today. It leans heavily on tired, long-ago debunked nonsense, such as his lead in some swing-states on Election Night "inexplicably" disappearing (after heavily-Republican polling place ballots were quickly tallied before the arduous task of opening and verifying and counting heavily-Democratic vote-by-mail ballots one-by-one) and how thousands attended his rallies, while Biden chose not to hold super-spreader events during the worst pandemic in 100 years. Much of Trump's (ghost-writer's) claims were already debunked during the Committee hearings to date, which he seems to presume that his supporters didn't watch or are too dumb to understand.

    Trump's ghost-writer spends most of the rebuttal ink citing what is laughably described as "indisputable proof" of "Ballot Trafficking" presented in the repeatedly debunked 2000 Mules movie. That's a pretend documentary film created by a long-discredited GOP "election integrity" group named True the Vote and a rightwing activist named Dinesh D'Souza who actually pleaded guilty himself to several federal election fraud crimes before he was later pardoned by Trump.

    As noted, the film has been repeatedly debunked, including by us, several times by now. Months before it was even released, the Georgia Bureau of Investigations (GBI) and FBI concluded the group's claims about cell phone data purporting to reveal evidence of "ballot harvesting" by "mules" of tens or hundreds of thousands of fraudulent ballots cast in drop-boxes, in fact, reveals no crimes at all. A GA state Board of Elections investigation after the movie's release found that supposed "ballot mules" in Atlanta, shown via security camera footage in the film, were just regular voters legally casting their own ballot and those of direct family members. None of the "mules" are ever seen in the film visiting a drop-box or multiple boxes more than once.

    But, perhaps the most stinging rebuttal came from Trump's own Attorney General, Bill Barr this week. During sworn testimony to the J6 Committee, shared by the panel on Monday, Barr laughed out loud at even the mention of the name of the film, before going on to explain how he found it to be "singularly unimpressive," "indefensible," and that it failed to "establish widespread illegal harvesting." That, of course, is a long way from the "indisputable proof" Trump's dumb rebuttal claimed it to be.

  • Finally, speaking of the House J6 Committee, Republican Vice Chair Liz Cheney released a video teaser on Tuesday for its next upcoming hearing scheduled for Thursday. This one will focus on the pressure Trump placed on Vice President Mike Pence to help him steal the 2020 election by tossing out valid Electoral College votes on January 6, 2021. Cheney's teaser video includes testimony from one of Trump's top White House attorneys who says he warned outside lawyer John Eastman, who developed the scheme for Pence to toss out the votes, to "get a great f'ing criminal defense lawyer," adding "you're gonna need it."

As we were forced to ask several times on today's BradCast: What the hell is up with Republicans and election fraud in Michigan?! But it's not only in Michigan today, as it turns out. [Audio link to full show follows this summary.]

In upstate New York, in a Rensselaer County city named Troy on Wednesday, a Republican city councilwoman named Kim Ashe-McPherson pleaded guilty to federal charges related to the submission of three fraudulent absentee ballots in both her primary and general election last year. It's a somewhat remarkable and expansive story of apparently a whole bunch of Republican criming going on in Troy and Rensselaer County, with the Albany Times Union describing Ashe-McPherson as "the first person snared in a federal grand jury investigation examining widespread ballot-fraud allegations in Rensselaer County."

Another separate probe by State Police appears to be examining fraud in Troy's Mayoral race, while the GOP Mayor and a whole bunch of GOP County officials have been subpoenaed and/or had their phones seized by law enforcement in recent months. Ashe-McPherson's absentee ballot fraud was apparently carried out with the help of an unnamed insider official at the Rensselaer County Board of Elections. "Earlier this year," the paper notes, "Jason Schofield, the Republican commissioner for the county's Board of Elections, was subpoenaed in connection with the federal investigation." But there's a whole lot of other GOPers who also seem tied into this, and may end up in handcuffs in the days ahead.

Is it any wonder that Republicans accuse Democrats of voter fraud all the time, given that Republicans seem to be constantly committing it themselves?

But things are even more insane in the great state of Michigan. You'll recall that recently, 5 of 10 Republican Gubernatorial candidates vying for the GOP nod to take on Michigan's Democratic Gov. Gretchen Whitmer this November were disqualified from the ballot, after the state Bureau of Elections discovered they had submitted some 68,000 fraudulent petition signatures between them in an attempt to qualify for the ballot. Well, the trouble continues for at least one of the remaining candidates who did manage to qualify without cheating.

All of the GOP gubernatorial hopefuls in MI are 2020 election deniers (despite Joe Biden having defeated Donald Trump in the state by about 150,000 votes, as confirmed by a months long investigation by the GOP-controlled state Senate). But one of the most ardent of the deniers --- and a leading candidate now that the others have been disqualified --- 40-year old Ryan Kelley, was arrested and charged by federal officials on Thursday for his role in the January 6, 2021 insurrection at the U.S. Capitol.

Kelley stands accused, according to the criminal complaint, of disruptive conduct, injuring public property and entering restricted space without permission. Documents filed in court allege he is seen on video that day waving crowds into the Capitol after police lines were defeated. He faces up to a year in prison and a fine as high as $100,000. Perhaps this will actually help his bid for the GOP nomination on August 2nd!

But that's not all we have to report out of MI today, particularly when it comes to GIO election fraud.

Last week, the organizer of a GOP petition effort to qualify a ballot initiative known as "Secure MI Vote", announced they missed the deadline to submit the number of signatures needed. Why did the effort behind this scheme to supposedly curb election fraud with severe new restrictions on voting fail? Election fraud, of course! The organizers discovered some 20,000 signatures they had gathered were fraudulent! (Hey, at least they checked them before turning them in, unlike those 5 GOP Gubernatorial candidates!)

The scheme, however, is even slimier than it sounds. Most of the provisions in the so-far-failed initiative had already been passed by the GOP state legislature, but vetoed by Democratic Gov. Whitmer. But, thanks to a loophole in MI state law, once a ballot initiative qualifies for the ballot, the Legislature is then welcome to pass it into law on a simple, veto-proof majority vote. That was the plan that seems to have failed here.

We're joined today to discuss the entire fine mess by NANCY WANG, Executive Director of the non-partisan, pro-democracy group Voters Not Politicians which, in 2018, enlisted volunteers (rather than corrupt paid contractors) to collect more than 400,000 signatures to place an initiative on MI's ballot for an Independent Redistricting Commission. The measure was successfully adopted by state voters.

"There are so many things wrong right now with the GOP and what they're trying to do with voting rights in Michigan," Wang explains. "What's really caught them is this mixture of incompetence and hypocrisy. They're selling themselves to the voters as the party that's going to 'protect' us from fraud. The only fraud they can demonstrate in our election is what they have inside their own camp. It's ironic, at the very least, that they have been the victim of their own fraud, when they've tried to victimize voters with all of these shenanigans."

Wang walks us through those "shenanigans" and various "loopholes" in state law that allow, for example, petition gathers to be paid by the signature and to lie to voters about the initiative they are asking them to sign on to. In this case, while the GOP group was clear that this measure would never actually be on the ballot, signature gatherers reportedly told prospective signers that the plan was simply to put these issues --- like instituting extreme Photo ID restrictions and restricting absentee voting --- before voters.

"This group is headed by the GOP, funded by the GOP, and they're using the citizens' petition process, lying to voters to sign this thing so that they can do an end-run around the voters," charges Wang. "They're never going to put these provisions on the ballot, they were very clear about that. They were just going to ride this loophole to the legislature to get these voter suppression measures passed." Not that that's what their signature gatherers told people on the ground, however.

"It's about dishonesty. It's about misleading voters. It's about trying to game the system of citizens' petitions. I don't think you could put anything in place that would stop people who don't have any limits whatsoever, any standards that they'll abide by, to further their agenda," Wang tells me.

Next, a story we ran out of time for on our previous BradCast, covering results and other fallout from Tuesday's midterm primaries in seven states. You may recall our coverage of a voting system disaster in Clackamas County, Oregon a couple of weeks ago, where a problem with smeared barcodes printed on vote-by-mail ballots resulted in them being rejected by the computer tabulators. The local County Clerk, in that case, ordered tens of thousands of those otherwise perfectly valid ballots to be duplicated by hand, one-by-one, so they could be run through the tabulators, rather than simply counting them in public by hand.

Well, guess what? It appears the very same thing happened in San Joaquin County, California this week, with 25 to 30% of the County's mail ballots being rejected by the computer scanners. And, once again, rather than hand-counting them, the County is duplicating each and every one of them by hand, this time with the help of about 13 employees from the printing company who screwed up in the first place.

I don't know about you, but I don't want my ballot "remade" behind closed doors by either a County election official OR some schmoe from a commercial printing outfit. But maybe that's just me. In any event, San Joaquin voters may have to wait a bit longer than usual this year for final results in their critical midterm primaries.

Compare and contrast on today's BradCast. Shoddy treatment of real election observers versus velvet glove treatment of wingnut con-artists claiming the 2020 election was stolen. In one case, longtime non-partisan election integrity observers are locked out from overseeing public election processing before this past week's critical primary elections in a North Carolina county. In the other, longtime phony GOP "voter fraud" fraudsters pretending to be election integrity advocates see their false claims in a propaganda film expensively debunked by both law enforcement and state election officials in Georgia. [Audio link to full show follows below this summary.]

First up, it's the fraudsters who recently released a propaganda documentary into theaters called 2000 Mules. We debunked the film's central claims in detail on this program when it was first released about two weeks ago, as it began trending in rightwing social media circles along with claims from many easily-duped folks that the film proves the election was stolen from Donald Trump.

A number of media outlets explained at the time why it doesn't even come close to doing any such thing. The film relies on cell phone geolocation tracking data and some security camera footage of absentee ballot drop-boxes in several swing states won by Joe Biden to claim that thousands of "ballot mules" illegally "harvested" tens of thousands of fake ballots (from somewhere or other) and deposited them unlawfully to steal the election from Trump. Supposedly, all of those ballots were unlawful votes for Biden, but there is no evidence for that either.

The film was produced and directed by a longtime rightwing activist named Dinesh D'Souza (who pleaded guilty to actual federal election fraud crimes some years ago, before being pardoned by Donald Trump). D'Souza highlights the claims of a longtime, dark money-funded, many times discredited, fake "election integrity" group from Texas calling themselves True the Vote. But, apparently, not mentioned in the film is that their cell phone "evidence" of repeated visits within 100 feet of drop-boxes and security camera footage was already reviewed and rejected by both the FBI and the Director of the Georgia Bureau of Investigation (GBI) before the film was even released earlier this month. A September 30, 2021 letter from GBI Director D. Victor Reynolds explains that, after a full investigation, and consultation with the FBI, the data submitted "does not rise to the level of probable cause that a crime has been committed."

That finding was further buttressed this week when Georgia's state Board of Elections dismissed the groups allegations of fraud by tracking down those shown on camera as depositing multiple ballots into drop-boxes. As Washington Post reports, state investigators tracked down the voters shown in the film and were able to confirm the ballots they deposited were actually those of direct family members, which is perfectly lawful in the state.

It's unknown how many tax-payer dollars were wasted by state (and federal) officials on these wild goose chases into perfectly legal voting, based on D'Souza and True The Vote's absurd claims.

Meanwhile, things were very different this past week in North Carolina, where actual election integrity advocates were prevented from doing their work of overseeing elections on behalf of the public and were even threatened with arrest in Wake County, the closely divided swing-state's most populous county.

We're joined today by two guests we've known for a while and who have been on the show in the past. LYNN BERNSTEIN is the founder of Transparent Elections NC and JOHN BRAKEY is the Director of AUDIT-USA. (Listeners will remember Brakey as the guy who originally exposed on this program, and later in video that went viral, that election denialists in Maricopa County, Arizona last year were examining paper ballots under microscopes for evidence of bamboo fibers to prove their false claim that thousands of fraudulent ballots were somehow cast from someone or another in Asia. Brakey served for months as a public observer of that failed "forensic audit" by the now-defunct Cyber Ninjas in Phoenix.)

This week, the groups of both Bernstein and Brakey published a press release announcing that the two had been barred from the grounds of the Wake County Board of Elections in advance of last Tuesday's midterm primary tabulation. The announcement charged they "were threatened with arrest and prevented from observing routine election administration activities by Wake County election administrator Gary Sims, in violation of North Carolina State Election Law."

We've got audio clips today of the pair being told they were not allowed on the grounds of the Wake County BOE, and of Bernstein's husband Nick being escorted out during the public comment period by law enforcement at a BOE meeting on Monday.

So, what's going on here? Bernstein, an aerospace engineer, trained international election observer and longtime election integrity advocate, claims that "Sims has personally harassed me at Board of Elections meetings in front of the Board and he also threatened to call the police on me when I came to observe on Election Night for the 2020 primary, when I was an at-large observer for the Wake County Democratic Party." She says she and Brakey arrived outside the Wake BOE last week for only minutes before "the police arrived and said we were banned forever" from the grounds of the public facility.

Brakey, who was in town to help oversee tabulation and other often dull, but incredibly important public election oversight procedures, says "It's election time, and this is what I do. I travel the country and I try to work with and mentor other election transparency activists." He tells us that Sims was "out there in four minutes" after they arrived at the BOE and "he was steaming just having [Bernstein] there."

But why was all of this even happening? And why is Wake, according to Bernstein, the only county in the state that does not allow observers of the tabulation on Election Night? "If there's a motive behind all of this, it is not election fraud or anything like that," Brakey tells me. The pair speculate it has something to do with Sims hoping to move the County from their current hand-marked paper ballot system to an expensive, unverifiable touchscreen Ballot Marking Device computerized system for voters. Bernstein has long opposed moving to that type of system, as has Brakey (along with most cybersecurity and voting systems experts.)

Tune in for many more details on all of this, but I wanted to give this incident and both of these folks the highlight they deserve for what seems to be an outrageous attempt to prevent their important work bearing witness for the public when it comes to our public elections. "The actual act of voting is a secret process," Brakey notes. "Counting is a public process. It used to be, and it must be again."

We are more than happy, of course, to welcome Wake's Election Administration Gary Sims to respond on the program with his side of the story as well if he chooses to do so. We'd love to have him!

Finally, we close today with a few thoughts on all of the above, and a bit of listener email regarding trillions of tax-payer dollars in subsidies ("socialized welfare") to fossil fuel companies --- the most profitable companies in the world --- even as clean, renewable energy companies continue to struggle without the same kind of financial support from the government...

What's the difference between a white supremacist mass murderer in Buffalo, NY and a GOP candidate for the U.S. Senate? Well, in terms of their racist rhetoric not a heck of a lot, it seems. That and many more reasons to both pay close attention and be skeptical of "conventional wisdom" regarding this November's critical midterm elections on today's BradCast, as American Democracy v. Violent Strongman Authoritarianism is most definitely on the ballot in every state this year. [Audio link to full show follows this summary.]

Among the stories underscoring all of that on today's program...

  • A number of the attorneys who helped Donald Trump try to steal the 2020 election have had their law licenses suspended or are facing permanent disbarment. One attorney who has yet to be held accountable in any way, however, is Sen. Ted Cruz, who volunteered to represent Trump in two different bogus election challenges before the U.S. Supreme Court; knowingly spread false claims of fraud; and then voted against certification of Joe Biden's Electoral College victory even after Trump's deadly insurrection at the U.S. Capitol. A bipartisan group is now hoping to change that. This week, they filed a complaint with the State Bar of Texas, seeking an investigation into possible disbarment for the sleazy Texas Senator/still-licensed attorney.
  • Speaking of sleazy still-licensed Texas attorneys, the state's chief law enforcement officer, Attorney General Ken Paxton now says he has been sued by the Texas State Bar for misconduct. Paxton has already been charged with several securities fraud felonies; is being investigated by the FBI for abuse of power and bribery after a federal criminal complaint by eight of his top former deputies; and brought a laughable case to the U.S. Supreme Court seeking to toss the 2020 election results in four states that were not Texas. It is for his help in trying to steal the election for Trump at SCOTUS that has resulted in the state Bar's lawsuit against him. Paxton is running for re-election anyway. On Tuesday he's in a runoff election with the state's Land Commissioner George P. Bush (the very Trumpy son of Jeb and nephew of the guy who made "one of the biggest Freudian slips of all time" at Southern Methodist University yesterday.) No sooner did Paxton get sued by the state bar then he turned around and opened an investigation into the Texas Bar Foundation for "facilitating mass influx of illegal aliens" --- ya know, the stuff that racist "great replacement" conspiracy theories are made of.
  • And speaking of the racist "great replacement" conspiracy theory, as repeatedly cited by the white supremacist domestic terrorist who murdered 10 and wounded 3 others in a Buffalo supermarket in a predominantly black neighborhood last weekend, a whole bunch of Republicans running for the U.S. Senate this year have been using nearly identical rhetoric to that racist murderer for a very long time. The once-fringe, now mainstream rightwing theory claims that Democrats are hoping to replace white American voters with immigrants, Jews and people of color to control the electorate with one-party rule. Or something. And, in the wake of Trump's embrace of white nationalism as President, AP highlighted a bevvy of mainstream GOP Senate candidates this year --- either running for reelection or for the party's nomination --- whose rhetoric on immigration directly echoes the same baseless, racist fear-mongering. Their list includes Blake Masters in Arizona; A.G. Eric Schmitt and disgraced former Gov. Eric Greitens in Missouri; GOP Senate nominee J.D. Vance in Ohio; and two-term U.S. Senator Ron Johnson of Wisconsin. The full list of elected and hopeful GOP officials who also espouse rhetoric shared by rightwing domestic terrorists is obviously much, much longer.
  • And speaking of domestic terrorists, the U.S. House passed the Domestic Terrorism Prevention Act (again) on Wednesday. All Democrats voted for it. Every Republican, except for retiring Illinois Rep. Adam Kinzinger, voted against it. Democrats vow to bring it up in the Senate next week. It may be a heavy lift over the undemocratic 60-vote filibuster threshold in the upper chamber. Too bad it wasn't called the Domestic Terrorism by Non-White People Prevention Act. It might have easily passed in both chambers, as most legislation related to terrorism that doesn't target white supremacists tends to.
  • And, speaking of extremism, on Thursday, the Oklahoma legislature passed a new law that, if signed by the Governor, would ban nearly all abortions starting at fertilization, which would make it the nation's strictest abortion law. It would also, in turn, make certain forms of birth control --- like IUDs, The Bill, Plan B, which don't necessarily prevent fertilization, but prevent implantation of a fertilized egg --- a form of "abortion" or, in Oklahoma, a homicide. More Republican-controlled states are likely to follow suit, despite the vast majority of Americans who support abortion rights. Please keep all of this in mind in November.
  • And, speaking of this November, polling last month from the Harvard Youth Poll suggests --- contrary to "conventional wisdom" --- that young voters are very eager to vote this year. The number who say they are "definitely" voting in the 2022 election is almost identical to the number who said same before the 2018 "blue wave" election. That could be good news for Democrats. Again, please ignore "conventional wisdom" in these decidedly unconventional times.
  • And, speaking of young people, even in deep "red" Wyoming, they don't dig attacks on LGBTQ+ people --- yes, even trans people --- as the state's U.S. Senator Cynthia Lummis found out the embarrassing way during a commencement address she gave over the weekend at the University of Wyoming. It took a while, but now she "apologizes" if she offended anyone with her remarks that were broadly booed during the speech at the school once attended by Matthew Shepard, the young gay man who was brutally beaten and left to die on a fence nearly 25 years ago. He became one of the namesakes of the landmark Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.
  • And, speaking of civil rights for all --- and of keeping Big Government and the GOP's stolen and packed Supreme Court out of our bedrooms and doctor's offices --- support for abortion rights has reached a record high in a new NBC News poll following the leak of SCOTUS' draft opinion overturning Roe v. Wade and its 50 years of protection for reproductive rights. The poll also finds support for same-sex marriage (perhaps next on the chopping block after Roe's Constitutionally established right to privacy is killed) at an all time high, while approval for the High Court is at an all time, 30-year low in this particular poll.

The clean up on aisle 45 seems to never end on The BradCast. But a whole bunch of experts (including our guest today) suggests our disgraced former President is inching ever closer to some very bad news --- at least in New York. [Audio link to full show is posted at end of this summary.]

First up, some other news not getting enough coverage today...

  • Our climate emergency continues to worsen, as 10 inches of rain fell in three hours in a mountainous tourist area near Rio in Brazil on Tuesday. As of airtime at least 58 were confirmed killed by the downpour and the deadly mudslides it triggered. That comes on the heels of at least 40 killed in similar storms in Brazil last month, as the nation's President, Jair Bolsonaro, has allowed for the acceleration of deforestation in the Amazon rainforest, contributing to our worsening climate crisis and resulting in these deadly, extreme weather disasters.
  • The Biden economic boom continues, despite corporate media's continuing obsession with inflation. On Wednesday, the Commerce Department reported consumer spending surged in January, and at much higher numbers than can be attributed to inflation. Retail sales nearly doubled what Dow Jones had previously estimated would be seen in January. A separate report today also found that industrial production spiked three times higher than estimates for last month.
  • Donald Trump's disgraced Interior Secretary, Ryan Zinke, "misused his public office for private gain" and lied about it to government ethics officials, according to a report [PDF] released Wednesday by the Department's Inspector General. Despite vowing, upon his confirmation as Trump's Interior chief in 2017, to disassociate with a foundation he worked with and a related commercial venture while serving as Secretary, Zinke was found to have communicated with the group dozens of times via email and text; had private meetings with them in D.C.; and played an "extensive, direct, and substantive role" in a commercial development project that would also benefit a private commercial project of his own in Montana. The I.G. reportedly referred the matter to Biden's Dept. of Justice, which --- for reasons unknown --- declined to bring criminal charges against Trump's disgraced former Interior chief. And, because no accountability was ever brought over this matter --- or a host of other personal Zinke scandals revealed while he served under Trump --- the wildly corrupt Zinke is now running again for high office in Montana, hoping to win back his old U.S. House seat this year.

Then, it's on to our guest today, for insight on a number of related matters.

Earlier this week, it was revealed that Trump's longtime accounting firm, Mazars USA, informed him and his family business last week that they would no longer be doing business with them. Moreover, they informed Trump that nearly 10 years of annual financial statements they'd prepared for him and the Trump Organization should no longer be relied upon to be accurate in any way, as it was based on faulty information supplied by Trump.

The company informed Trump that Statements of Financial Condition created from 2011 to 2020 were being retracted and that, due to a "conflict of interest", they would no longer be working for his company. The news came via a court filing on Monday by New York state Attorney General Letitia James in response to the attempt by Trump and his children to avoid depositions in James' civil investigation into alleged bank, tax and insurance fraud by all of them. The Manhattan D.A. is also running a concurrent criminal probe into many of the same matters.

Since that news became public this week, a number of legal experts have explained that Mazars' "conflict of interest" almost certainly means the firm is now cooperating with New York prosecutors against Trump and his businesses. Longtime Trump investigative reporter David Cay Johnston told CNN on Tuesday that he believes Trump and his company and maybe even his kids, will, in fact, be indicted on racketeering charges in the state.

We're joined today by former Asst. U.S. Attorney RANDALL D. ELIASON, who spent years as Chief of the DoJ's Public Corruption/Government Fraud section in D.C. He's now a law professor at George Washington University Law School where he is an expert in white collar criminal law. Eliason offers helpful insight into Trump's increasingly serious New York troubles and discusses his recent opinion piece at Washington Post calling on Attorney General Merrick Garland to explain himself in regard to the DoJ's probe (or lack thereof) into the 10 or more obstruction of justice allegations detailed by Robert Mueller in the report on his Special Counsel investigation.

On the New York matter(s), Eliason cites a recent comment he'd heard that Mazars' dumping of Trump suggests "the ship is leaving the rats." He charges that the financial firm is clearly "trying to distance themselves, and that suggests they see something bad coming down the road for their client." He concurs that "the most likely explanation for what's going on is that Mazars is now cooperating, either in the criminal case or the civil case, or both, and potentially testifying against Trump and the Trump Organization. That definitely creates a conflict of interest, to where they'd say, 'Well, I can't be your accountant anymore because now I'm actually a witness against you.'"

Eliason also offers a very helpful explanation of what racketeering charges actually are, and how, if Johnston is right, that might play into the New York state prosecutions and even the investigation by Fulton County, Georgia District Attorney Fani Willis into Trump's conspiracy to steal the 2020 election in the Peach State. Eliason further helps us understand how both the NY state Attorney General and Manhattan D.A. could both ultimately bring charges for the same set of fraud crimes, but as a civil matter (resulting in fines and other such penalties) by the A.G. and as a criminal indictment (potentially resulting in prison time) by the D.A.

As to the curious case of Merrick Garland, as Eliason highlighted in his recent Post op-ed, he does not count himself among those who think that Biden's Attorney General is necessarily dropping the ball. But he does believe an explanation is warranted to the American people regarding any potential investigations of Trump on the many cases of obstruction painstakingly spelled out in Mueller's Special Counsel report on Russian interference in 2016 and Trump's related firing of FBI Director James Comey.

On Monday, the statute of limitations into the oldest such obstruction allegation cited by Mueller has now run out. (That, as Eliason detailed at the Post, was "Trump’s alleged request to then-FBI Director James B. Comey to drop the criminal investigation of disgraced former national security adviser Michael Flynn. Other acts of possible obstruction soon will be similarly time-barred.")

"This clock is ticking away," Eliason tells me today. "Given the size of the investigation, the seriousness of the investigation, the detail in that report, even though DoJ doesn't normally comment on cases that it's not going to bring, or that it's not prosecuting, in this case they should. They should tell us something about what's happened with that Mueller Report now that we have an administration in office that is not filled with Trump appointees."

Eliason spells out why he believes that, while the DoJ doesn't usually comment on such cases, "this is a unique case" where "a lot of people are really convinced that the evidence of obstruction was pretty overwhelming" and that "it's bad for the Department and bad for the country if that just is allowed to fade into the distance and nobody ever says, 'Hey, we did take a look at this, and here's what we decided.'"

In fact, Eliason believes there is evidence to suggest that Garland is carefully looking at Trump's potential criminal exposure in regard to the January 6 insurrection at the U.S. Capitol, but is less certain about his handling of the Mueller allegations and thinks "there should be some closure on that.".

All of this, of course, as the clock may also be ticking toward an announcement by Trump that he plans to run for President again in 2024. How would that affect any potential federal indictments against the twice-impeached former President? We discuss that matter --- "practically speaking, that gets really hairy --- as well.

Finally, in our closing few minutes, a few more thoughts on Trump's worsening New York woes from someone else with a unique perspective. George Conway, the longtime Republican attorney and husband of Trump's former Campaign Manager and White House aide Kellyanne Conway, tells CNN why he believes the Mazars news to be far worse for Trump than his two impeachments as President...

Three years ago this month on The BradCast, we spoke with the Executive Director of the National Butterfly Center in deep south Texas in the Rio Grande Valley as Trump's Dept. of Homeland Security was busting locks on the 100-acre wildlife sanctuary to roll in heavy construction equipment to build Trump's dopey border wall. Last week, the Center was forced to temporarily shut its doors due to worsening violent threats and menacing from Trump's MAGA mob. Last night, she met with the FBI. Today, the Center's Executive Director joins us again to discuss the increasing madness of what is going on down there now, more than a year after Trump was tossed out of office. [Audio link to full show is posted below this summary.]

BUT FIRST, a couple of amusing and/or encouraging updates to other stories we've been covering in some detail on this program.

We have new news out of North Carolina, where Republican MAGA Congressman Madison Cawthorn's eligibility to run for reelection is being challenged at the State Board of Elections by state voters working with the Constitutional law experts at the non-partisan Free Speech for People good government group. The complaint to the SBE alleges that Cawthorn, who participated in the January 6 rallies and their planning, is ineligible to run for federal office in the state, based on Section 3 of the Constitution's 14th Amendment which bars from federal office those who previously took an oath to defend the Constitution and then "engaged in insurrection or rebellion" against it. Rather than defend himself in a Board hearing, as required by state law, Cawthorn filed suit last week in federal court charging the state Board has no right to determine whether he meets eligibility requirements for the ballot. In their response to the suit this week, CNN reported last night, the Board disagrees. Their motion explains that "States have long enforced age and residency requirements, without question and with very few if any legal challenges. The State has the same authority to police which candidates should or should not be disqualified per Section 3 of the Fourteenth Amendment."

The case obviously has serious implications for a number of other MAGA Caucus members of Congress who participated in the January 6th insurrection and huge implications for Donald Trump's ability to be on the ballot in 2024 in the critical swing-state, if he decides to run again. We discuss that and a few more follow up details on the heels of today's update, following on our in-depth conversation last week about the original complaint with Constitutional law expert John Bonifaz, Co-Founder and President of Free Speech for People.

NEXT, following up on a story we covered in great detail last year, the disgraced and very Trumpy Mesa County, Colorado County Clerk, Tina Peters, was arrested on Tuesday. And the video of her being taken into custody by law enforcement officials is pretty hilarious. You may recall that, in 2020, in the middle of the night, Peters snuck into the secured room where voting equipment is kept in her County with an unauthorized person. They turned off the security cameras and made copies of hard drives containing the critical Election Management System (EMS) software on the county's Dominion Voting Systems machines. That proprietary software was subsequently leaked onto the Internet as Peters participated in a loony "Cybersecurity Forum" with "Stop the Steal" conspiracist and MyPillow CEO Mike Lindell just days before the same critical software was to be used in several California counties during the GOP's failed attempt to recall the state's Democratic Gov. Gavin Newsom.

Peters was removed from her duties by the state's Secretary of State and is now being investigated by the state's Attorney General. But her arrest on Tuesday was reportedly related to her use of an iPad to unlawfully record a court hearing for one of her deputies who was also removed from office in relation to the software theft. And, yes, the video of Peters' arrest, as you'll hear, is kinda hilarious.

THEN, we're joined by MARIANNA TREVIÑO-WRIGHT, Executive Director of the National Butterfly Center in far south Texas, which was forced to close its doors indefinitely last week. The sad --- but, hopefully temporary --- news comes on the heels of increasingly violent threats and targeting by Trump's MAGA mobsters over the past three years. She explains how those threats have worsened during that time and in recent days, ever since the Center attempted to sue the Trump Administration in 2017 to stop construction of his border wall on and near the Center's property on the banks of the Rio Grande River in the city of Mission. (We interviewed Treviño-Wright about that on this program in February of 2019.)

The targeting that the Center has endured, as she explains today, includes "outrageous lies" beginning in the fall of 2019, when Steve Bannon and supporters of his fraudulent "We Build the Wall" project (for which he was indicted and later pardoned by Trump) claimed that the wildlife preserve and study area was actually "a cartel front and engaged in human trafficking, that we were selling women and children in to sex slavery [and] that there were dead bodies and terrorists on the property."

"They tell these lies because they work," Treviño-Wright tells me today, citing the QAnon "Pizzagate" lie that almost turned deadly and the 2019 massacre at a Walmart in El Paso, just days after a nearby "We Build the Wall" rally. Two weekends ago in Mission, there was a "We Stand America" rally featuring Trump's disgraced National Security Advisor and QAnon hero Michael Flynn, which coincided with a physical altercation at the Center with a MAGA Congressional candidate from Virginia. There were also a number of rightwing media outlets who shot videos outside the sanctuary, suggesting that the Center was a way-point for human traffickers.

After the 2019 targeting, Treviño-Wright says, "the militia arrived, and a whole bunch of angry people unleashed a torrent of hate, of threats --- by mail, by phone, email, you name it. They came here to tell us to our face what despicable human beings we were, how we should be hanged and burned and all of that."

But menacing "indirect threats" have worsened in recent days, leading to her meeting on Tuesday night with the FBI to discuss a neo-Nazi who, she explains, has "gone to federal prison three times, most recently for his role in inciting the Tree of Life Synagogue massacre," who has recently moved to Texas. "He has been posting online messages using my photo and workplace, and urging the members of his church in his holy war to find out where I live, and everything they can about my children," Treviño-Wright details. You may or may not be shocked by what she says she was told last night by the FBI.

In the meantime, she tells me that the Board of Directors at the North American Butterfly Association, which runs the Center, "is actively seeking to engage licensed security professionals to do the assessments necessary and make the recommendations for training, for physical assets that we need on the property, and maybe even for additional personnel, so that we can re-open safely." But, she laments, "armed guards at a nature center is not at all the kind of look we are going for."

Citing the Lone Star State's Republican Gov. Greg Abbott's policies allowing for indiscriminate, unlicensed open or concealed carry of firearms, Treviño-Wright describes charges it's "the wild wild West down here," though not due to "the things that Fox News and other are saying" about some sort of "crisis" at the border. "The call is coming from inside the house," she asserts. "That's where we are in the United States now. The terrorism is home-grown, and it's our own neighbors and relatives."

Treviño-Wright goes on to offer a timeline for when the Center may be able to re-open to the public; how members of the public can help in the meantime (a membership with the Center, she explains, "comes with benefits for people across the United States" and will help to continue paying employees during these weeks they are forced to remain closed); the status of the Center's ongoing lawsuit to stop the nearby construction on the river, which she says the Biden Administration is continuing under the guise of "levee repair"; and much more --- including some actual good news on butterfly survival if you can imagine such a thing!

She is a fantastic guest and, frankly, a great American. Please tune in for our conversation today.

FINALLY, we close with late breaking word from WaPo that the National Archives has reportedly asked the Dept. of Justice to investigate whether Trump's mishandling of Presidential records --- including absconding to Mar-a-Lago with some 15 boxes of them --- is a criminal violation of the Presidential Records Act. (Which, of course it is. The question is whether Merrick Garland's DoJ will do the right thing and take action on it. Don't hold your breath...)

I'm somewhat afraid to get my hopes up about the idea of Donald Trump and his accomplices being held accountable for their crimes, despite seeing the bipartisan House Select Committee investigating Jan. 6 doing their work. I can't wait to see their hearings.

But I also remember being confident when Robert Mueller was investigating, knowing a report was on the way. And we know how that went. Trump's minions were able to preempt the release of the report and put out a completely fabricated synopsis of its findings.

I remember Peter Strzok, the FBI counter-espionage agent who first opened an investigation into Russian tampering into the 2016 election. And then watched Trump bully and eviscerate him after private texts with a coworker surfaced, allowing the entire narrative to be hijacked. The Washington Post put together adevastating supercut of Strzok's testimony before Congress, if you need a refresher --- or, for some reason, want to get really angry.

So, I'll be cautiously optimistic that good will prevail, even if I wouldn't bet on it.

My guest today is PETER STRZOK, FBI veteran and New York Times bestselling author of COMPROMISED: Counterintelligence and the Threat of Donald J. Trump. His book has just been released in paperback and includes a new afterword with fresh reporting on the flood of Trump intelligence revelations that have come to light since it was first released.

I really enjoyed our conversation, and wish he were still on the job.

We started the show with a bit of the latest news. And I figured, after being so serious with Strzok, we could end on a lighter note. So, I shared a couple of songs that deal with the Spotify/Joe Rogan/Neil Young issue. First, a new little ditty from Steven Page, former lead singer of Barenaked Ladies called "Choose Young". Guest: The Nation's John Nichols on that and other progressive wins and losses this year; Also: In the spirit of the season, lauding not one, but TWO Republicans (and one of them is Trump!)...

On today's BradCast, we continue to catch up with a few of our favorite progressive journalists as the year grinds down. And, yes, there are still a few things to celebrate before Christmas. [Audio link to full show is posted below this summary.]

This week, unionized Kellogg's workers in four states --- Michigan, Nebraska, Pennsylvania and Tennessee --- approved a new five-year contract after a long, 11-week strike. The corporate cereal behemoth had recently threatened to replace the strikers with new, permanent (scab) workers. But, according to members of the Bakery, Confectionery, Tobacco Workers and Grain Millers (BCTGM) International Union, the loud support of lawmakers, including the President of the United States and members of his Administration, Sen. Bernie Sanders, as well as state and local officials in Michigan and elsewhere, buoyed their resolve to keep going. And it worked! The BCTGM President noted this week that the new contract includes wage increases, cost-of-living adjustments, expanded health and retirement benefits and "does not include any concessions."

The victory for 1,400 workers, at a company which touted its workers just last year, during the darkest days of the pandemic, as "essential workers helping to feed the nation," was one of several for unionized labor this year. Our guest today, author and longtime progressive journalist JOHN NICHOLS of The Nation and Madison, Wisconsin's Capitol Times, joins us to help explain why.

"What's happened again and again" this year at companies like Kellogg's, John Deere and elsewhere, Nichols explains, "is that initially, the company bargains in the old-fashioned way. 'We're going to be tough with you...We'll permanently replace you.' All the old tricks." But, in a labor market with very low unemployment, where it is now difficult to find skilled workers or those willing to work in difficult, often dangerous conditions for low pay and benefits, "it's not going to work in this situation. The end result is the companies blinked."

But we've got much more than just the rise of labor in 2021 to catch up on with Nichols today in a lively, wide-ranging conversation on that...

  • on how the Protecting the Right to Organize (PRO) Act would help a broad swath of workers across the country;
  • on Joe Manchin and the (theoretical) death of Biden's Build Back Better Act and what the West Virginia Democratic Senator's betrayal to his own party and his own constituents may mean for the future of the filibuster and federal voting rights legislation;
  • on Nichols' fascinating new article for The Nation on the FBI's weird scrutiny of It's a Wonderful Life as a Communist tool back in the 1950s (they thought it made Mr. Potter --- and capitalism --- look bad);
  • and on his upcoming new book calling for accountability --- akin to that which came out of FDR's Pecora Commission following the Great Depression --- for Coronavirus Criminals and Pandemic Profiteers. "In every chapter in the book," Nichols explains, "I find individuals who died, and I track through the cabinet members, the judges, the CEOs, whoever, who could have taken actions that would have let that person live."

That's just a taste. Tune in for much more today with the great Mr. Nichols!

Then, yes, in the spirit of the holidays (and, perhaps, in hopes that it may save even one life), we laud two Republicans today for (barely) doing the right thing this week. One is Congressman Tom Rice of South Carolina, who now says he regrets voting against Joe Biden's certification in two states following the Trump-incited attack on the U.S. Capitol on January 6th. ("There was a coward in that equation," Rice told Politico. "But it wasn’t Mike Pence.") And, perhaps most begrudgingly of all, we laud Trump himself for saying out loud during a wingnut interview this week: "The vaccine worked. But some people aren't taking it. The ones that get very sick and go to the hospital are the ones that don't take the vaccine. ... If you take the vaccine, you're protected. Look, the results of the vaccine are very good...People aren't dying when they take the vaccine."

Yes, the bar is admittedly very low at this point, but we've gotta start somewhere if we want to figure out how to repair this broken nation (and planet.)

Speaking of...the fine folks at ExxonMobil were apparently able to fit in one last disaster before year's end, with an explosion in the middle of the night at one of their refineries near Houston that injured four workers, three of whom were airlifted from the scene. The company downplayed the incident, as usual, describing it as "a fire occurred at our facility". The Houston County Sheriff's office described a "major industrial accident". We hope to learn more soon.

No room for that story today, however, in our final Green News Report of the year (we're standing down next week, Nicole Sandler will be filling in for us for most of it), as Desi Doyen joins us for a round-up of the disasters and successes in the environmental world in 2021, and much more...including one more victory for labor and union workers, as the Biden Administration mobilizes to rid the nation of millions of lead pipes...

If there's one guy you really don't want vowing to dog you, it may be Rhode Island's Democratic Sen. Sheldon Whitehouse, easily one of the most persistent Senators in the upper chamber. If you're Trump's FBI Director or, especially, Supreme Court Justice Brett Kavanaugh, that's probably not good news. But it's just one of the stories covered on today's BradCast. [Audio link to full show is posted below this summary.]

Here's a quick summary of many more of them...

  • No, the disappearance of 350,000 votes from CNN's California Recall Election Night live ticker is not proof that it was stolen. Especially when there is a perfectly plausible (and checkable) explanation for it.
  • After the well-publicized testimony of U.S. gymnasts in the Senate Judiciary Committee on Wednesday, regarding the FBI's years-long failure to adequately investigate hundreds of allegations of sexual assault against now-convicted team physician Larry Nassar, Sen. Sheldon Whitehouse had a few related questions for Trump-appointed FBI Director Christopher Wray about another similarly flubbed investigation --- perhaps more accurately described as a Trump Administration/FBI cover-up --- regarding serious allegations of sexual assault against a young girl by a now sitting Supreme Court Justice. After alleged sexual assaulter Brett Kavanaugh, Donald Trump's second nominee to be packed onto the U.S. Supreme Court by Republicans, Whitehouse vowed to Christine Blasey Ford, Kavanaugh's main accuser, that he would get to the bottom of the FBI's clearly whitewashed pre-confirmation "background check" probe of Kavanaugh. It's three years later and Whitehouse has not forgotten. As he explained while pressing Wray during Wednesday's hearing, he has been waiting all of that time for answers and documents from the FBI. He made clear to Wray that he will not stop until he gets them. As evidenced by his nearly ten years of weekly "Time to Wake Up" climate addresses on the floor of the U.S. Senate, the Rhode Island Senator does not back down easily.
  • The COVID pandemic continues to worsen in the U.S., with no end in sight. That, of course, thanks to the voluntarily unvaccinated. Hospitals across the entire state of Idaho are now rationing care under "critical care standards" that allow them to try and save the lives of those most likely to survive, while offering comfort and best wishes to those unlikely to make it. Similar "death panels" are now in place or "imminent" in other states with similarly low vaccination rates, mostly run by Trumpy, denialist, Republican Governors. While the vast majority of those paying the worst price are the unvaccinated, their selfishness comes at an unspeakable to cost to many who are vaccinated, as we detail today. Those include the Alabama man who died last week in Mississippi after his Trump Country Alabama hospital had to call 43 hospitals before finding one, 200 miles away, that could give him care; the Illinois woman with a comorbidity who died after becoming infected with a breakthrough COVID case after visiting a family friend in Mississippi whose husband had died in the state with one of the lowest vaccine uptake rates; the man in Hawaii who remains in excruciating pain today, because he can't get a non-emergency operation for kidney stones due to lack of oxygen supply for all but COVID patients on all of the islands. Yes, the voluntarily (and selfishly) unvaccinated continue to bring pain, harm, sadness and death to far more people than just themselves...which is already bad enough.
  • Finally, Desi Doyen joins us for our latest Green News Report, featuring news on Nicholas, the latest storm to make landfall in our latest record hurricane season, exacerbating recovery in Louisiana, where folks are just beginning to recover from Hurricane Ida the week before last; Biden's continuing push for his landmark climate infrastructure plan; States now beginning to hold plastic producers to account for their pollution; and Vermont stepping up as the latest state to sue fossil fuel giants for decades of deadly lies about climate change...

We've got quite a few updates on a number of stories we've been covering of late on The BradCast. Some of them not necessarily happy and others quite astounding. As well as some mainstream media failure, and other news from this seemingly endless Summer. [Audio link to full show is posted below this summary.]

Among the stories covered on today program...

  • Even as infections, hospitalizations and deaths continue to soar in their states, more politically ambitious Trumpy Rightwing Governors are leading their constituents on a death march by banning mask mandates by small local governments and school districts. Happily, a number of the school districts are putting the health and safety of their children above the authoritarian edicts of their Governors, as well as over the deadly demands of too many brainwashed, disinformed parents fighting to endanger their own children and themselves.
  • We've got updates today on several stories we've covered in recent weeks, including the anti-vax parents of four children in Texas, who both changed their minds about vaccinations just before they were intubated several weeks ago. Also, updates on some of the Rightwing anti-vax radio hosts who have either recently died or are now hospitalized in grave condition from COVID. Also, yet another far-right radio host --- this one a Christian broadcaster who derided COVID vaccines as "government control" on his daily "Prophecy Today" program --- has now died from...you guessed it.
  • A disturbed far-right Trumper from North Carolina brought Capitol Hill to a standstill today --- requiring evacuations from the U.S. Capitol to the U.S. Supreme Court --- after pulling his license plate-free pickup truck onto the sidewalk in front of the Library of Congress and threatening to detonate a bomb. During the 5-hour standoff with police, which thankfully ended peacefully, media outlets reviewed the man's Facebook Live-streamed rants and other videos. He reportedly railed against Joe Biden, "Nancy", "antifa" and the Democrats, demanding they all resign en masse; declared "the revolution is here" and that he is the "last generation" of those willing to stand up for America. He said that Trump will be reinstated and posted video from his participation at "Stop the Steal" and "Million MAGA March" rallies. So, how did Associated Press, at least for a time today (via the Internet Archives), lead their description of the man's politics? By claiming that in one of his videos he "said he loved the president, Democrat Joe Biden." --- Really, AP?
  • We've also got a few quick updates today on the Trump-loving Mesa County, Colorado County Clerk, Tina Peters, who, as we have been reporting in some detail over the past week, allegedly entered a secure area of the County's Election Division in the middle of the night with two accomplices last May, turned off the security cameras, and allowed two hard drives containing Dominion Voting's Election Management System (EMS) software to be copied in full. During one of her several appearances on stage last week at MyPillow CEO Mike Lindell's failed three-day "Cyber Symposium" where he didn't reveal the promised "proof" that China stole the election for Joe Biden, the extremely sensitive contents of those hard drives were released into the Internet wilds for download by thousands. That, in the middle of California's critical Gubernatorial Recall election, where some 60% of the state will rely on that same, proprietary Dominion EMS software. Peters claimed during Lindell's forum that she was being "persecuted" by CO's Democratic Sec. of State Jenna Griswold because she's a "conservative Republican". Griswold has now removed Peters from her role, as Mesa's now-former chief election official is facing a criminal probe by the County's conservative Republican District Attorney. This week, the FBI joined that investigation, as federal crimes may have been violated in the theft and release of that software. And today, VICE reports, Peters is on the lam, being sheltered in a "safe house" somewhere by the MyPillow guy (who already faces a $1.3 billion lawsuit [PDF] from Dominion himself.) Will the "persecution" never end?
  • Finally, Desi Doyen joins us for our latest Green News Report, with grim news of deadly climate change-fueled extreme weather from Haiti to both coasts of the U.S. to much of Europe; and some happier news this week from the Biden Administration...

Lengthy opinion exposes century of entrenched racism, corruption and indifference but overlooks extreme predatory capitalist inequality...
UPDATE, 9/24/21: 9th Circuit Overturns Injunction

Even if it withstands Los Angeles County's appeal to the 9th Circuit, the well intended decision, handed down last month by veteran U.S. District Court Judge David O. Carter in a federal lawsuit filed by the LA Alliance for Human Rights, will, at best, ameliorate but not eliminate the nightmare of homelessness at the heart of a place that dares to call itself the City of Angels.

In support of legal grounds for federal court intervention, such as the Equal Protection Clause of the 14th Amendment, Judge Carter laid out, in compelling detail, the link between LA's deadly "crisis of homelessness" and "entrenched structural racism". The validity of that link was underscored by the fact that African-Americans account for only 8% of the general population in the County; yet they account for 42% of the now more than 66,000 unhoused residents.

Judge Carter's lengthy, 110-page decision contains a deep dive into a sordid history of systemic racism in Southern California and its disparate impact on people of color. This, in the Court's view, has given rise to what California Governor Gavin Newson, in his Feb. 19, 2020 State of the State Address, referred to as "the wrenching reality of families, children and seniors living unfed on a concrete bed." The Court condemned the City and County's deliberate decisions to perpetuate unspeakable squalor by attempting to physically contain it within a 50-square-block downtown Skid Row and by policing policies that criminalize homelessness.

The Court described the mishandling of funds intended to provide shelter as the product of "corruption" and "deliberate indifference" towards the unhoused, who suffer from rampant crime, drug addiction, mental illness and deaths caused by all manner of disease. In 2016, for example, LA voters passed a $1.2 billion bond measure that was supposed to create up to 10,000 homes. Over the ensuing four-years, the City erected only 489 housing units (apartments) at a median cost of $531,000 per unit --- units that have been disproportionately occupied by the unhoused who are white.

To rectify this, the Court, by way of a preliminary injunction, ordered an audit of all relief funds and the placement of $1 billion from Mayor Eric Garcetti's "Justice Budget" into an Escrow Account. Judge Carter appointed a Special Master to assist with the implementation of the Court's directives. Despite protestations that they lacked the necessary funds and an objective reality that one can't expect to extract blood from a stone, the Court also ordered the City and County to provide shelter to all unhoused residents within 180 days. (The preliminary injunction will not take effect prior to June 15 by reason of a temporary 9th Circuit administrative stay).

As we observed in 2019, the source of LA's homeless crisis lies not only in a legacy of systemic racism, but also in extreme inequality, which is tied to neoliberal capitalism. This entails a radical form of market fundamentalism, which has been at the center of U.S. economic policies since the Reagan administration.

LA's homelessness crisis will not end absent the federal government's adoption of what former U.S. Labor Secretary Robert Reich has described as "Bidenomics"...

Guest: Climate and energy journalist David Roberts of Volts; Also: MN cop charged in shooting; FBI, DHS knew Capitol was the 'target' on Jan. 6; Biden declares 'It's time to end the forever war'...

On today's BradCast: Joe Biden is on a "go big" roll that has stunned even many long time progressives. Another one of them joins us on today's show to sing the praises (mostly) of his $2.25 trillion infrastructure, jobs and climate proposal known as the American Jobs Plan. It will be paid for --- at least in very small part --- by ending long time direct subsidies (yes, government socialism) to the Fossil Fuel Industry. But, even on that, the industry is getting a break that they shouldn't. [Audio link to full show is posted below this summary.]

First up today, however, some noteworthy news headlines...

  • The white Brooklyn Center, Minnesota police officer who resigned yesterday after shooting black motorist Daunte Wright during a traffic stop on Sunday, has been charged with second-degree manslaughter after days of protest and unrest. The city's Police Chief, who also resigned on Tuesday, has said that the 26-year veteran officer, Kim Potter, meant to taze the 20-year old Wright, but shot him instead.
  • A scathing new Inspector General's report finds that U.S. Capitol Police were instructed by leadership not to use their best crowd-control weapons on January 6th, despite clear intelligence from the FBI and Dept. of Homeland Security warning that "Congress itself is the target" for protests by Donald Trump supporters who were scammed by his false claims that the Presidential election was stolen. In the days before the assault, pro-Trump social media sites included explicit details regarding plans by MAGA Mob extremists to target both the Capitol and members of Congress, including maps of underground tunnels at the Capitol building and threats calling for "violence" and "war". While DHS and the FBI were aware of these threats --- and, therefore, so was Trump --- for reasons that still remain unclear, the Capitol Police were left wildly unprepared for the deadly siege.
  • And, in perhaps the most critical news of the day, President Biden announced, in no uncertain terms, his plans to remove all U.S. troops (other than those needed to protect diplomats) from Afghanistan no later than September 11th of this year, the twentieth anniversary of the 9/11 attacks. He explained his reasoning and responded to critics of the move in remarks at the White House today, declaring that "It's time to end the forever war." We share extended excerpts from his address.

Then, we're joined by the great energy and climate journalist DAVID ROBERTS --- formerly of Vox, now publishing his own must-read newsletter called "Volts" --- for insight into Biden's plans to pay for what Roberts characterizes as a remarkably progressive infrastructure, jobs and climate proposal.

Introduced two weeks ago, the American Jobs Plan is to be paid for largely by an increase on the corporate tax rate. But, as Roberts detailed in a recent Volts article, it will also include a repeal of some of the permanent subsidies to the Fossil Fuel industry which they have enjoyed for decades, as written into the tax code. While many progressives are pleased about that, including Roberts, the fact is that those direct subsidies to the industry, as he points out, amount to a very small fraction of the cost of Biden's ambitious plan. Indeed, at some $35 billion for the entire industry, spread out over ten years, it also amounts to a very small amount of the true cost of the "indirectsubsidies" or "externalities" which the public pays for to boost profits for the polluting industry.

The direct subsidies, says Roberts, are "a drop in the bucket" compared to "the total amount of money that would be raised if you went after the indirect subsidies" with a carbon tax that accounts for the true cost of the industry's "products that produce a lot of social harm.  Harm in terms of air pollution that they generate, which then produces health costs, and people miss work. There's the climate damages that they do when they're burned. There's land pollution. There's abandoned oil and gas wells at the end of their life. Those cost a lot of money" to clean up, which the companies rarely, if ever, do.

"The oil and gas industry itself doesn't pay any of those costs. So when your product imposes all these costs and you don't pay them, the public steps in and pays them. Like the kids with asthma who are paying, rather than the fossil fuel companies." Roberts suggests "those externalities, as they're called, have always been the premise for a carbon tax, why we would want to put a tax on carbon so that you can recoup all these damages that the oil and gas industry are not paying for."

Still, setting aside how the package is to be paid for, Roberts concedes that he is "pleasantly surprised" about the "super-big and ambitious" package which includes, as he also details, a whole bunch of cool stuff that has received little coverage, since there is actually so much packed into the sweeping, long-overdue proposal.

How to get it passed, however --- and, specifically approved by "our emperor and benefactor Joe Manchin, long may He reign" --- is another matter, which we discuss in detail today as well.

"Where we are is so ludicrously far away from where we need to be, that it becomes difficult to judge anything in the middle," Roberts argues. "Is this a good big step or is it a grossly inadequate step? Yes. It's both. Everything we're going to do on climate change for the next decades will fit that description. It's going to be big and not big enough."

GA's new Senator appeals to our better angels to save our democracy...

"A republic," Ben Franklin famously said, "if you can keep it."

After more than 230 years, the great American experiment --- constitutional democracy --- has arrived at a moment of grave national peril, once again testing Franklin's warning. Like the Confederates who fired on Fort Sumter at the outset of a bloody Civil War, a major segment of our polity today is being led by racist and seditious reactionaries --- "domestic enemies" of the very Constitution they solemnly swore to uphold and defend.

This unscrupulous lot call themselves "Republicans". Yet, they have absolutely nothing in common with the Party once led by Abraham Lincoln, an intellectual giant, who extolled the need to see that "government of the People, by the People and for the People shall not perish..."

The right to vote is foundational to all other rights. By way of more than 253 restrictive bills, introduced in 43 States, these elected autocratic "American Fascists" seek to strip that foundational right from millions of their fellow Americans.

The For the People Act of 2021, recently passed by Democrats in the House as H.R.1, is a comprehensive election, campaign, ethics and voting rights reform measure that would, among other things, eliminate partisan gerrymandering of Congressional Districts, curb dark money campaign contributions, and preempt many state-based GOP voter suppression and intimidation laws, schemes and tactics. The Senate version of the bill, S1, is co-sponsored by 49 of the chamber's 50 Democrats.

If, at this critical moment, all 50 Senate Democrats do not agree to eliminate the filibuster, at least for Voting Rights-related legislation, in order to pass S1 before the end of the year, a clear path will have been paved for the GOP to retake majority control of both Houses of Congress in 2022 and recapture the Presidency in 2024 through a combination of extreme partisan gerrymandering and surgically precise voter suppression.

What better moment for Georgia's freshman Democratic Senator, Reverend Raphael Warnock, to call upon our better angels to save our democracy in a maiden address on the Senate floor (see video and link to transcript below) that amounted to what has been aptly described as a "Voting Rights Speech for the Ages"...

Guest: Migration Policy Institute's Sarah Pierce; Also: More 'Clean up on Aisle 45' news on the FBI, Kavanaugh and the Vindman family...

We've got quite a bit of 'Clean up on Aisle 45' news on today's BradCast, particularly at the U.S. southern border. [Audio link to today's full show is posted below this summary.]

But first, a few noteworthy 'Clean up" news items. Rhode Island's Democratic Sen. Sheldon has written a letter to Joe Biden's newly confirmed Attorney General Merrick Garland, requesting an investigation into what he describes as the "fake" investigation the FBI apparently made into sexual assault allegations against Brett Kavanaugh before his confirmation to a lifetime appointment as a U.S. Supreme Court Justice. That confirmation, by the way, happened only thanks to Senate Republicans willingness to do away with the filibuster on Supreme Court Justices. Of course, it wasn't only sexual assault allegations against Kavanaugh that deserved a real probe by the FBI. There is still the matter of what happened to the $60,000 to $200,000 worth of credit card debt that Kavanaugh carried the year before his nomination, which magically disappeared by the time he was tapped by Trump to help pack the stolen Republican majority on the U.S. Supreme Court.

Also today, Army Lt. Col Yevgeny Vindman --- twin brother of Lt. Col. Alexander Vindman, who testified against Donald Trump during his first impeachment --- will now be promoted to Colonel under the Biden Administration. That, despite a revenge campaign leveled against the Vindman family by the former disgraced President, which resulted in some negative job reviews for Yevgeny during his time as deputy legal advisor on Trump's National Security Council. Shortly after the impeachment, Trump fired both men from their NSC posts and Yevgeny filed a whistleblower complaint over the retaliation with the Pentagon's Inspector General. The IG's report has not yet been released.

Then, for the biggest 'Clean up on Aisle 45 ' news of the day, we move down to the U.S. Southern Border, where Republicans have been taking a cue from the former disgraced President to claim a massive "Biden border crisis!" is current under way, not two months into the new President's tenure. Sadly, corporate media have taken that cue as well. As they do.

House minority leader Kevin McCarthy (R-CA) traveled to the border this week and, among other apparent lies, claimed that terrorists from Yemen, Iran and Turkey were "rushing" the border "all at once." While that is almost certainly untrue, there has been an increase over the past two months in unaccompanied children, seeking asylum at the border, after making the arduous journey from beleaguered Central American "Northern Triangle" countries of El Salvador, Guatemala and Honduras. Thanks to the influx of unaccompanied kids, a hollowed out asylum system left behind by the previous administration, along with pandemic social distancing requirements, Custom and Border Patrol (CBP) facilities meant to house children before they are handed over to the Dept. of Health and Human Services to find sponsored shelters are running out of space. The influx is also leading to many being held in the CBP facilities beyond the 72-hour legal limit, even as the Biden Administration has, for the time being, left many of Trump's policies in place, expelling families and single adults fleeing from gang violence, climate change and poverty in their troubled nations.

So, what is actually going on at the border right now? Is it really a crisis? And how much is the Biden Administration, not even two full months on the job, to blame? We're joined today by SARAH PIERCE, immigration attorney and Policy Analyst for the U.S. Immigration Policy Program at the Migration Policy Institute to help us separate fact from breathless, GOP/media-inflated fiction.

"I think there is a significant challenge at the southern border," she explains. "I don't think we can call it a crisis yet. But we could certainly be moving in the direction of a crisis.  We had a really fast acceleration in the number of unaccompanied child migrants arriving at the southern border between January and February. But we still haven't reached record numbers of children arriving at the southern border. We saw records during 2019 and 2014 that we haven't yet broken."

"But our facilities are limited because of the pandemic," she continues, "and so that is making what would already be a challenge even more difficult as the administration scrambles to bring beds back online, and move children out of Border Patrol custody as quickly as they possibly can."

Pierce explains how bad the situation currently is; whether she believes the Biden Administration is taking the appropriate measures to handle it; whether GOP claims about terrorists rushing the border or becoming "super-spreader caravans" are in any way true; and whether the situation can be handled at all without Congressional action (which seems a long shot while the filibuster remains in place, with Republicans seeking distraction from their failure to vote for the COVID relief bill and relying on alarmist rhetoric about the border to try and hold on to their base).

The Biden Administration "inherited a really, really big challenge and a system that was just gutted by the prior administration. So, whether or not they'll be able to do this all, while also dealing with what could very well be a crisis in the near future at the southern border, is a really big question."

She also offers, among other direct answers, a response to my question about the oft-repeated spurious claim that Trump's infamous family separation policy that resulted in those horrific "kids in cages" photographs was was actually begun by the Obama Administration. The answer will probably not shock you.

Callers ring in on demands for accountability following last week's deadly, Trump-incited riot at the U.S. Capitol. But timing looms large before Inauguration Day, and as the MAGA Mob gears up for more violence...

We open up the phone lines on today's BradCast for the first time since Donald Trump's deadly attempted coup at the U.S. Capitol last week, to get feedback from callers on whether it makes sense to impeach him again with just about a week and a half left in his term. (For the record, my own opinion is "YES!," and I explain why throughout the course of today's show.) [Audio link to full show is below the summary.]

We start with some of the latest breaking news...

  • Trump's illegally appointed Acting Homeland Security Chief Chad Wolf announced, just before air time, that he is stepping down after being critical of Trump following last week's insurrection that killed at least five people, including a Capitol Police officer. Wolf called the riot "tragic and sickening".
  • The FBI has reportedly notified all 50 states of the possibility of armed attacks on state houses, as Trump's MAGA Mob are continuing to tell each other that Trump will be inaugurated on January 20th (he won't be) and that we should all prepare for a national emergency in which Trump invokes the Insurrection Act and begins "high profile arrests" between now and Inauguration Day. All of that, his minions have convinced themselves, come amid what they describe to each other as "a battle for our republic against elites that are attempting the very coup that they are accusing Trump of doing."
  • Over the weekend, however, House Speaker Nancy Pelosi informed House Dems that if Trump refused to resign, she would hold a vote on a resolution calling for Vice President Mike Pence to invoke the 25th Amendment to remove Trump from power. If that doesn't work (it doesn't appear that it will), a vote on a second Impeachment could be held in the House as early as Wednesday. We share the Article [PDF], formally filed in the House today by Reps. Jamie Raskin (D-MD), Ted Lieu (D-CA), David Cicilline's (D-RI), and Jerry Nadler (D-NY) for "Incitement of Insurrection", on today's program.
  • Over the weekend, both Democrats (like AOC) and Republicans like Sen. Pat Toomey (PA), Lisa Murkowski (AK), Ben Sasse (NE) and Trump ally and former Governor of New Jersey Chris Christie all suggested they might support impeachment and removal of the President. As Christie noted, "If inciting to insurrection" isn't an impeachable offense then "I don't really know what is."
  • Nonetheless, a number of Republicans are suggesting that if either the 25th or impeachment are invoked, it would lead to further violence. As Rep. Kevin Brady (R-TX) pathetically tweeted on Saturday, "Those calling for impeachment or invoking the 25th Amendment in response to President Trump's rhetoric this week are themselves engaging in intemperate and inflammatory language and calling for action that is equally irresponsible and could well incite further violence." --- In other words, if you hold anybody accountable for inciting violence, you are inciting the same people to more violence. So, best to do absolutely nothing, apparently. Very patriotic and courageous, Congressman.
  • On Sunday night, the PGA pulled their planned 2022 Championship from Trump's Bedminster, NJ golf resort, adding to the schadenfreude already most likely being enjoyed by anti-Trumpers since Twitter permanently banned him from the social media platform late on Friday.

As to the timing of how to pull off an impeachment with just days left in Trump's Presidency, it's important to understand --- as we discussed with former federal prosecutor Ben Clements on last Friday's show --- that an official doesn't even have to still be in office to be impeached. There is historical precedent for that. Clements, and others, argue it's important to impeach Trump if only to convict him at trial so that he cannot run for public office ever again.

It should also be noted that the House may vote to impeach this week or next, but wait until after Biden is sworn into office before sending the Articles to the Senate for a trial. That's what some Dems are now calling for. Rep. James Clyburn wants to wait until Biden's first 100 days are over. Others suggest waiting just long enough to allow Biden's cabinet to be sworn in, since all Senate business must stop when a Senate impeachment trial begins. With Chuck Schumer as Majority Leader, after Biden and Vice President-elect Harris are sworn in, a real trial could be held in the Senate, with dozens and dozens of witnesses, unlike the show trial McConnell held to quash the charges Trump was previously impeached for last year.

So, lots to chew over on today's program, and lots of callers ringing in with thoughts on all of the above...
