On today's BradCast, the Presidential Primary battle between Hillary Clinton and Bernie Sanders becomes a fight over the official party platform and whether progressive reform can actually happen from within; Donald Trump wants the U.S. to torture again; and California goes to pot. [Audio link to show posted below.]

In the wake of this week's horrific terror attack at Turkey's Ataturk Airport in Istanbul, the presumptive GOP nominee Donald Trump wants to "Make America Commit War Crimes Again" as he calls for the U.S. to once again implement torture policies such as waterboarding. In the meantime, new Pew polling shows Trump's support from nation's outside of the U.S. is dismal, often in single digits. While back here at home, according to new Quinnipiac poll out today, he remains "neck-and-neck" nationally with presumptive Democratic nominee Hillary Clinton whose favorability ratings are also dismal, though not as bad as Trump's.

But as Bernie Sanders supporters quickly move toward Clinton, representatives for the two popular Democratic rivals hash out the party's official platform document to be adopted by delegates at the Democratic National Convention in July.

Salon political reporter Ben Norton joins us to discuss progress of the talks, specifically the Clinton camp's refusal to allow a demand for a $15/hour federal minimum wage mandate in the non-binding party manifesto, as well as the failure by Clinton surrogates to agree to more progressive language on a number of issues, from Israel to fracking to trade policies.

Norton goes on to report that the fight between surrogates for the two candidates at the DNC Drafting Committee's platform talks echoes the long Democratic primary race, suggesting, as he sees it, that the party, ultimately, may not be able to reform from within. "You have the Sanders' appointees pushing for more progressive measures, and the Clinton appointees opposing those measures. I think in some ways, we did see some progress, but overall I think there's reason to be pessimistic for a potential Clinton presidency, given the way that this has represented itself at the DNC committee drafting," Norton explains. "It really reflects the war going on within the Progressive community."

Real progressive policy change, he argues, will require new candidates to step up at the local and state level --- even as independents or under the banner of a third party, if necessary --- to take up the fight and seek office, he notes, just as Sanders did when he initially ran for office in Vermont decades ago.

Finally today, more calls for 'Texit'! California announces that an initiative to allow the recreational use of marijuana will be on the statewide ballot this November, and Colorado finds that teen use of pot has actually fallen below the national average since the state adopted a similar policy in 2014.

Some state Democrats back 'compromise' legislation that leaves otherwise legally registered voters at risk of disenfranchisement...

Missouri Republicans hope to work around a series of adverse state court rulings by way of a ballot measure that would amend the Show-Me State Constitution and require that citizens present state-approved Photo ID at the polls before voting.

The legislation to place the issue on the ballot was approved by the state Senate 24-8 last Wednesday. The next day it was adopted in the House 110-39. The wide margin in both chambers, likely enough to override a veto by Democratic Governor Jay Nixon, was the product of a purported "compromise" that would permit voters who can't obtain the necessary documentation to sign an affidavit to that effect and cast an otherwise normal ballot. The "compromise" language was struck after days of filibusters in the state Senate by Democrats.

But Republican State Senator Bill Kraus told PBS that the stipulation would be temporary and that Missouri could have "strict Photo ID" in the near future, once the state constitution has been amended to allow for it. It wouldn't be the first "Missouri Compromise" to go awry...

The fires in the tar sands oil region of Canada and the lawsuits (yes, two of them filed today) result in a busy breaking news edition of The BradCast today. [Audio posted below.]

First up, Desi Doyen joins us for an update on the devastating climate-driven wildfires that have devastated the town of Fort McMurray, Alberta, in the heart of Canada's oil sands region where many workers from the oil sands mines live and work. Cooler weather, and even a bit of rain, helped keep the fires from growing to a full half-a-billion acres, as feared on Saturday. Still, the scenes of neighborhoods completely destroyed from the fire are heartbreaking. Some 88,000 residents remain evacuated, even as the irony of this particular region being devastated by climate-induced fires remains palpable.

Then, on to North Carolina Republicans' latest self-induced disaster. Late last week, the U.S. Dept. of Justice warned the state that their anti-LGBT law (HB2) was in violation of the federal Civil Rights Act. They were given until today (Monday) to let the DoJ know how they planned to respond in order to avoid the potential loss of more than $2 billion dollars in federal education funding. That response came today in the form of a suit filed against the DoJ by NC. The DoJ quickly responded in kind, with U.S. Attorney General Loretta Lynch announcing a lawsuit against NC for violation of the Civil Rights Act. She described HB2 as "state-sponsored discrimination," and told the transgendered community: "We see you. We stand with you…And please know that history is on your side."

Democratic NC state Rep. Chris Sgro, who also serves as president of Equality NC, joins us today to talk about the entire fine mess, even as news of the various suits were still breaking. He tells me that the state has already lost about half a billion to their economy, even before the potential loss of federal education funding, as businesses react to the "terrible anti-LGBT, anti-worker, anti-education bill that we know is in violation of the Civil Rights Act".

"This is not pro-business conservatism," Sgro tells me. "This bill wasn't about enabling local government. They went in and they were the big government who stripped local rights. And they are the anti-business party right now. If they really want to be pro-business, pro-growth, they have to act as quickly as possible to overturn House Bill 2. That's the only answer at this point."

(And how did Jim Gilmore 'win' an entire Massachusetts town?!)

On today's BradCast we examine what the big Super Tuesday wins mean, and don't, for both Donald Trump and Hillary Clinton, as well what the media is both misreporting and failing to report at all. [Audio linked below.]

First, the GOP is now in full panic mode following Trump's seven-state victory yesterday, as the DNC and corporate media use misleading numbers to describe Clinton's own seven-state victory. In addition to the general horse-race numbers, and the Republican drama, we examine how the MSM continues to ill-serve the public in their coverage of the Democratic race to date, specifically when it comes to the unpledged so-called "SuperDelegates".

We also look at a few more of the more than 2,000 reports of voting problems that came into the non-partisan Election Protection coalition yesterday; More touch-screen trouble, this time in TN; And what the hell happened in Chelsea, MA, where former VA Gov. Jim Gilmore(!?!), who dropped out of the race weeks ago, crushed the Republican Primary competition, at least according to the paper-ballot optical-scan computers that tallied the results last night?...

The paper ballots in Chelsea were initially tabulated by the same type of op-scan systems used in states all over the country and shown to be capable of flipping elections without notice in the jaw-dropping finale of HBO's Emmy-nominated 2006 documentary Hacking Democracy. Today, the numbers have now been "corrected" [PDF] by the clerk's office [Update: The link to the document at the Chelsea government site is now broken, so here's a copy of the PDF that had been linked there] and, apparently, chalked up to "the computer system that reported the results". Ya don't say. Was it anything like this similar failure from Stoughton, WI in 2014?

Also today: Listener email in response to my interview earlier this week with Current Affairs magazine editor Nathan J. Robinson, who had offered his persuasive case, based on his recent feature article, for why Trump is likely to win the Presidency if Democrats fail to nominate Bernie Sanders. We look at the arguments from a number of you who disagreed with Robinson.

On today's BradCast, we expose a dangerous, deceptive new scheme to hoax California voters into allowing Internet Voting across the entire state. Plus, we discuss Obama's final State of the Union and take calls on all of the above.

First (after an official welcome to our newest affiliate --- the great am950 KTNF in Minnesota!), I explain the newly proposed California ballot initiative describing itself as the "Election Data Security & Military Ballot Access Act". The initiative is nothing of the sort. It is little more than a very well-financed and completely deceptive scam to force Internet Voting into the Golden State by describing it as something other than it is.

Rather than use the words "Internet Voting" or even "Internet" in any way, the 46-page initiative describes the proposed, dishonest new scheme as "electronically delivered vote-by-mail"!

Who's behind it? We still don't know. But it was submitted recently to the state Attorney General by the high-priced Sacramento law firm of Olson Hagel & Fishburn LLP and needs to be, at the very least, retitled before it ends up on the state ballot.

This is important even if you don't live in California! When it comes to voting systems, what happens here (where we have the most electoral votes in the nation) is often adopted by states across the country!

Election Integrity expert and advocate Jim Soper of CountedAsCast.org and the CA Voting Rights Task Force, joins us from the state capitol building in Sacramento to discuss the deceptive initiative and a similar (if somewhat less deceptive) legislative initiative sponsored by Democratic Assemblyman Phil Ting (San Francisco). The latter, happily, was killed in committee today, Soper reports.

He explains why the ballot initiative is so misleading, why Internet Voting is a horrific idea --- as virtually every computer scientist and security expert has demonstrated over and again --- and asks listeners to contact the CA Attorney General by Thursday, when the comment period on the initiative is supposed to end.

Both election integrity advocates and dissembling GOP proponents of Photo ID voting restrictions were taken by surprise in late 2013 when 7th Circuit Court Judge Richard A. Posner said, during an interview with HuffPo Live, that the landmark 2008 Supreme Court decision on the matter "would have been decided differently" if the Court had known then "about the abuse of voter identification laws."

That, in and of itself, was a remarkable turn of events. What was ultimately to come was even more so.

Crawford v. Marion County Election Board is the case which Republican proponents of strict Photo ID voting laws now (incorrectly and often disingenuously) cite as giving them carte blanche to enact similar laws in other states, irrespective of the extent to which photo ID laws serve to disenfranchise demographic groups --- minorities, students, the poor, women --- that all tend to vote for Democrats.

Posner is not just any judge. He is a renowned legal scholar and Reagan appointee to the federal bench, who has served on the U.S. 7th Circuit Court of Appeal since 1981. More importantly here, Posner was the author of the 7th Circuit's opinion in Crawford. In that case, Posner rejected an allegation that Indiana's polling place photo ID restriction was unconstitutional. That decision was affirmed at the time by the U.S. Supreme Court.

Posner, who is, as Yale Law Professor Fred Shapiro notes, the most cited jurist of the 20th Century, was not alone in his view in 2013 year that Crawford "would have been decided differently" if the Court knew then what it knows now.

Former Supreme Court Justice John Paul Stevens, the author of the plurality opinion in Crawford --- an opinion that was joined by Chief Justice Roberts and Justice Kennedy --- told the Wall Street Journal following Posner's remarks at the time, that he "always thought that [dissenting Justice] David Souter got the thing correct, but my own problem with the case was that I didn't think the record [before the Court in 2008] supported everything he said in his opinion." Souter would have struck down the Indiana law as unconstitutional because, as he argued at the time, it "threatens to impose nontrivial burdens" upon the right to vote.

Joined by four other 7th Circuit jurists last October, Posner penned an extraordinarily powerful and compelling dissent [PDF] in Wisconsin's photo ID voting case. The previously missing evidence is now in, as the judge meticulously detailed in the opinion. GOP claims that photo ID restrictions are needed to combat "voter fraud", he wrote, are "a mere fig leaf for efforts to disenfranchise voters likely to vote for the political party that does not control the state government"...

There is only one motivation for imposing burdens on voting that are ostensibly designed to discourage voter-impersonation fraud, if there is no actual danger of such fraud, and that is to discourage voting by persons likely to vote against the party responsible for imposing the burdens.

Posner's carefully crafted dissent does more than establish why the U.S. Supreme Court should ultimately sustain the District Court's finding that Wisconsin's photo ID law is both unconstitutional and a violation of the Voting Rights Act --- a finding later echoed by a federal District Court in Texas as well. Posner's dissent obliterates the factual premise that had served as a pillar upon which his, and subsequently the Supreme Court's, decisions in Crawford were based.

Polling place photo ID laws do not promote voter confidence in the integrity of elections, as Posner and the Crawford Supreme Court plurality had erroneously assumed. The assertion that they do was a "mistake" --- Posner's mistake! --- and he now admits as much, with the support of devastating new data from recent studies to back him up.

His powerful dissent amounts to more than just a response to the Wisconsin GOP's new Photo ID voting law. It is an elegant plea that the U.S. Supreme Court finally right a grievous wrong that he was personally responsible for. Posner presents an astonishing, air-tight case for ruling that all "strict Photo ID laws," which, as he demonstrates, have only been enacted in states sporting GOP-controlled legislatures, must now be struck-down as unconstitutional...

Just getting back on the grid today after a few days off of it, so getting caught up with much, including today's release of the legal memo [PDF] detailing the Obama Administration's claim of legal authority for the 2011 targeted drone killing of U.S. citizen and alleged terrorist Anwar al-Awlaki in Yemen.

(Three other U.S. citizens were also killed in drone strikes abroad, including al-Awlaki's 16-year old son one month after his father, though the Administration contends those killings were incidental deaths during strikes targeting others...as if that makes them less awful somehow? In any event...)

As the Washington Post notes, portions of the document are redacted, including "paragraphs that presumably explained why the Justice Department's Office of Legal Counsel determined that killing Awlaki in a drone strike would not violate the Fourth Amendment, which guarantees due process to U.S. citizens accused of crimes."

The paper adds, however, that "the memo provides previously unknown details about the reasoning behind one of the most controversial counterterrorism operations carried out by the U.S. government since the Sept. 11, 2001, attacks."

But what caught my eye in particular today, was the Congressional Progressive Caucus' somewhat snarky, if very clever, promotion of their press release in response to the released (and redacted) memo, which Roll Call's Steven Dennis describes as "Progressive Caucus Trolls Obama on Drone Memo"...

Dem Governor Mark Dayton breaks with party on proposed e-cig regulations, says bill goes 'too far' by banning use indoors...

Finally, I'm no longer the only progressive taking to the air waves to call bullshit on the Democrats' deadly and stupid War on People Trying to Quit Smoking with E-cigs.

On Thursday I was invited to discuss the issue with Ian Levitt of the Daily Report, the afternoon drive time show on KTNF, Minnesota's great Progressive AM950. Minnesota now joins the growing list of places where legislatures are considering a ban on vaping in public spaces because...well, I guess because they want more people to keep smoking rather than quitting via the non-smoking alternative of vaping. (I'm sure there must be some other reason --- and we discussed that a bit during the show --- but whatever that reason is, as is the case here in Los Angeles, it sure isn't based on science or public health benefits, as my interview with L.A. City Councilman Paul Koretz, who sponsored and voted for the ban here, made very clear a few weeks ago!)

It's time that Progressives (not to mention Democrats, but I don't necessarily hold out much hope for them) get on the right side of this issue. Here's my conversation about e-cigs and ill-considered bans against them, with Levitt yesterday...

To his great credit, according to the Star Tribune, MN's Democratic Gov. Mark Dayton has signalled the state's proposed ban goes "too far". So the bill has been sent back to committee in the state Senate.

"Dayton said he would sign a bill to restrict children's ability to buy e-cigarettes and to keep the product out of schools, but he would likely oppose making them subject to the indoor air law," the paper reports. "Dayton told the Star Tribune that he's not convinced there is definitive evidence that secondhand vapor poses a danger similar to secondhand smoke."

Here in Los Angeles, while the City Council voted to ban e-cig use like cigarettes, in public spaces such as parks, beaches, restaurants, bars, clubs, work spaces etc., Mayor Eric Garcetti has yet to approve the new ordinance. He can be contacted here, if you'd like to ring in with your thoughts on the new ban which is sure to make it harder for smokers to vape and, therefore, to quit smoking entirely.

Finds Republican-enacted statute would disenfranchise 'hundreds of thousands' of legal voters for 'no compelling state interest'...

A Pennsylvania Photo ID law that one Republican lawmaker once boasted would deliver the Keystone State to Mitt Romney in the 2012 Presidential Election was struck down by a Pennsylvania trial court.

Judge Bernard L. McGinley of the Commonwealth Court of Pennsylvania ruled that several sections of Act 18, the Republican-sponsored polling place Photo ID statute that was signed into law by Gov. Tom Corbett (R) in March of 2012, violated the Pennsylvania Constitution. The court, which previously prevented the law from taking effect by the issuance of a preliminary injunction, ordered that Act 18's in-person Photo ID requirement be permanently enjoined.

That ruling does not come as a surprise.

In May of 2012, The BRAD BLOG predicted that the plaintiffs in Applewhite vs Commonwealth of Pennsylvania would likely establish that Act 18's polling place Photo ID restrictions violate of that state's constitution. The lawsuit --- named after its 93-year old lead plaintiff Vivian Applewhite, who had voted for 50 years without a problem until 2012 --- alleged that the Act's Photo ID restrictions would deny or significantly impair the right to vote. That right, according to the Keystone State's constitution, is considered "fundamental."

Under judicially recognized Equal Protection standards, a law that impairs or abridges a "fundamental right" cannot survive a constitutional challenge unless the law is narrowly tailored to serve a "compelling state interest." That interest, we observed in our original article, cannot be found in what amounts to the "phantom menace" of in-person voter impersonation --- a point PA Republicans later conceded via a formal, in-court stipulation, entered near the outset of the case, in which they acknowledged they were "not aware of any incidents of in-person voter fraud in Pennsylvania and do not have direct personal knowledge of in-person voter fraud elsewhere."

While he included additional reasons for issuing the permanent injunction, Judge McGinley's lengthy decision [PDF] reveals that our original assessment of the case, and our prediction about its likely outcome, were spot on...

What do Minnesota, Wisconsin, Utah, and Arkansas all have in common? If you said "None of those teams are in the 2013 NCAA Men's Final Four," you wouldn't be wrong this year, though you also wouldn't be correct - at least within the boundaries of our topic for today.

If your answer was, "All four states have experienced massive oil spills within the last year - and three within the last two weeks," you'd be correct, unfortunately.

The latest disaster this weekend saw thousands of barrels of thick tar sands oil spewing from a ruptured Exxon Mobil pipeline into a residential neighborhood in central Arkansas. Twenty-two homes had to be evacuated, in a spill that literally saw oil running down residential streets and between houses. Take a look...

Of course, since it was a holiday weekend, smack-dab in the middle of Congress' latest two-week vacation, it was nearly impossible to find a politician of any kind with something serious to say about the latest disaster. That doesn't surprise us, since politicians of all kinds have been slipping and dancing around the issues of oil and environmental safety for far too many years now.

For all the work the Obama Administration has done on environmental issues --- like requiring much better fuel standards for cars and trucks, or clamping down on emissions --- the fact of the matter is, none of that will matter if President Obama and other politicians don't stop the Keystone XL pipeline route through Nebraska and all the way down to the Gulf of Mexico.

No matter what the decision is on the Keystone pipeline, the most important liquid flowing through Nebraska over the next hundred years won't be oil --- something a task force in the Nebraska Legislature made very clear last week...
