North Carolina Republicans are now seeking to delay the full federal trial challenging their massive election reform law, which has been described as the worst-in-the-nation and as a "monster" voter suppression law.

The tactic threatens to, once again, undermine any ruling by the court, should it be made too close to the state's 2016 elections. The trial in the case had previously been set, according to a timetable established in federal court in December of 2013, to take place during the July 2015 trial calendar. State Republicans, however, now argue that a separate state court challenge to one section of its massive voter suppression law, scheduled during the same period next summer, will "severely prejudice" their ability to defend themselves in the federal case which follows it.

Plaintiffs argue in response that the move is "another step in Defendants continued attempts to delay the ultimate resolution of this action."

The attempt to re-schedule comes from the same North Carolina Republicans who, this past October, successfully persuaded the U.S. Supreme Court to stay an appellate court order restoring a number of voter registration and voting provisions that were blocked by the state GOP's law, simply because the court order restoring those voting rights was issued too close to the Nov. 4, 2014 election.

The state's argument at the time was that "Court orders affecting elections...can themselves result in voter confusion and consequent incentive to remain away from the polls. As an election draws closer, that risk will increase."

The trial which the state is now attempting to stall is in response to the same federal lawsuit involving legal challenges to the state's Voter Information Verification Act ("VIVA"). This site, and many others, described the legislation as the "nation's worst voter suppression law since the Jim Crow era," when state Republicans enacted the extraordinarily wide-reaching restrictions on voting and registration in NC within days of the U.S. Supreme Court gutting a key portion of the Voting Rights Act in the summer of 2013...

Early data suggest new 'discriminatory', 'unconstitutional' Republican voting restriction seems to have worked well for them...

Despite a larger population and a contested race for an open gubernatorial seat, turnout in the state of Texas was reportedly down this year, as compared to the last mid-term election in 2010, by more than a quarter of a million votes.

That data point --- a decrease of some 271,000 total voters this year --- is one of several, at least anecdotal early indicators that suggest the Texas GOP's strategy of suppressing the vote this year with polling place Photo ID restrictions seems to have worked.

Since 2003, Texas law had already required every voter to present an ID when voting at the polls in the Lone Star State. But the newer draconian restrictions that have been so controversial were finally in place for a federal general election for the first time this year, after state Republicans have been attempting to enact them since at least 2007.

We've spent quite a bit of time over the past year(s) reporting on the GOP attempt to implement these new polling place Photo ID voting restrictions, with all evidence suggesting that they are meant only to suppress the votes of minorities, students, the poor and other disproportionately Democratic-leaning constituencies.

In virtually every instance that the new, exceedingly restrictive law has come before federal authorities, it has been found plainly discriminatory. The law was struck down in 2012 as a discriminatory violation of the Voting Rights Act by both the U.S. Department of Justice as well as a three-judge federal panel on the D.C. District Court. It was struck down once again this year by a U.S. District Court in Texas after a full trial and a 147-page ruling [PDF] which found the law to be "purposefully discriminatory", an "unconstitutional poll tax", and likely to disenfranchise some 600,000 legally registered Texas voters as well as more than a million eligible voters.

Nonetheless, the U.S. Supreme Court allowed it to stay in place during this year's election, as the Republicans who run the state of Texas appeal the lower court's unambiguous ruling.

In the meantime, early data coming in from Texas suggests the law appears to have had its intended effect...

It's been happening for years now. On the day after elections like last Tuesday's, media figures begin navel gazing to figure out how pre-election polls, created by dozens of independent pollsters using dozens of different methodologies, could all find the same thing but turn out to be so wrong once the election results are in.

The presumption is that the results are always right, and if they don't match the pre-election polling, its the polling that must be wrong, as opposed to the election results.

On Wednesday morning, after Tuesday's mid-term election surprise in which Republicans reportedly won handily in race after race despite pre-election polls almost unanimously predicting much closer races or outright Democratic victories, FiveThirtyEight statistics guru Nate Silver declared "The Polls Were Skewed Toward Democrats".

His analysis of aggregated averages from dozens of different pollsters and polls this year found that the performance of Democrats was overestimated by approximately 4 percentage points in Senate races and 3.4 points in gubernatorial contests. Silver's assessment relies on a "simple average of all polls released in the final three weeks of the campaign," as compared to the (unofficial and almost entirely unverified) election results reported on Tuesday night. He doesn't suggest there was anything nefarious in the polling bias towards Dems this year, simply that the pollsters got it wrong for a number of speculative reasons.

Citing the fact that nearly all of the polls suggested Democrats would do much better than they ultimately did, when compared to the reported election results, Silver asserts it wasn't that the polls were more wrong that usual, per se, but that almost all of them were wrong in a way that appears to have overestimated Democratic performance on Election Day.

"This year's polls were not especially inaccurate," he explains. "Between gubernatorial and Senate races, the average poll missed the final result by an average of about 5 percentage points --- well in line with the recent average. The problem is that almost all of the misses were in the same direction."

Silver is much smarter than I when it comes to numbers; I'm happy to presume he has the basic math right. But he seems to have a blind spot in his presumption that the pre-election polls were wrong and the election results were right. That, despite the lack of verification of virtually any of the results from Tuesday night, despite myriad and widespread if almost completely ignored problems and failures at polls across the country that day, and despite systematic voter suppression and dirty tricks that almost certainly resulted in election results (verified or otherwise) that were skewed toward Republicans...

Despite 'army' of monitors and new smartphone app, discredited org uncovers just 18 'irregularities', 0 polling place impersonation...

For some reason, this tweet of mine, from about 4am on Election Night, has become very popular...

Perhaps we can chalk up its popularity to the joke it makes of right wing groups like "True the Vote" which has, since its dubious inception, received and spent a fortune over the years tripping over its own wingnut feet to publish fake "voter fraud!" data, find itself tossed out of courts, harass legal voters attempting to cast legal votes, and otherwise make repeated jackasses of themselves by attempting to perpetuate the well-worn, but fact-shy Republican hoax that there is a massive Democratic voter fraud epidemic at our polls.

TTV was made even more famous lately when they were cited, by name, by 7th Circuit Court of Appeals judge Richard Posner, a very well-respected Reagan-appointed conservative jurist, in his recent opinion on Wisconsin's Photo ID voting law. In Posner's devastating, must-read dissent decrying such discriminatory laws, the most well-cited legal scholar of the 20th century, according to the Yale Law School's Journal of Legal Studies, described the group's "evidence" of voter impersonation fraud as "downright goofy, if not paranoid," citing "the nonexistent buses that according to the 'True the Vote' movement transport foreigners and reservation Indians to polling places" to illegally cast a ballot.

The solution to the pretend problem that TTV lies to its followers about, is, of course, polling place Photo ID restrictions that, as Judge Lynn Adelman of the U.S. District Court in Wisconsin wrote in striking down that state's discriminatory, unconstitutional law after a full trial earlier this year, serve only to "prevent more legitimate votes from being cast than fraudulent votes."

So the group's newest embarrassing failure to uncover virtually any "voter fraud" at the polling places it monitored in dozens of states during Tuesday's mid-term general elections --- with an army of righteous and disinformed civilian wingnuts armed with a brand-new smart phone app --- comes as little surprise. It is, however, kind of amusing...

While most of the media is reporting the huge Republican takeover of the U.S. Senate tonight, and the big GOP wins in a whole bunch of Governor's races, Reuters notices that there were a lot of problems for voters across the country today...

(Reuters) - Voting machine and voter identification problems emerged in some U.S. states on Tuesday when Americans went to the polls in midterm elections that will shape the final two years of Barack Obama's presidency.

Although a full picture of the problems was not yet clear, officials and voting rights advocates reported machine failures in North Carolina and Texas, polling breakdowns in a key Florida county and an overall increase in the number of people reporting they were turned away for lack of proper identification.

They go on to summarize election problems and failures in a bunch of states, most of which we covered in one form or another earlier today (including many more). But we missed this really bizarre case of still-unexplained very dirty tricks out of Chicago earlier today...

Some poll workers reportedly attempting to enforce GOP voting restriction found unconstitutional by state Supreme Court...

Arkansas Times' Max Brantley reports tonight there are "Voter suppression reports from all over," including a "steady stream of complaints...from voters who say election officials around Arkansas demanded a photo ID before they could vote today."

"The law requires election officials to ask your identity --- name, age address. But they may NOT require a photo ID. That's unconstitutional," he writes.

In fact, the Arkansas GOP's Photo ID voting restriction law was struck down by the state Supreme Court after it was found in violation of the state constitution's right to vote provisions in October.

Brantley writes that, nonetheless, "reports come in that high-handed officials are requiring the photo ID and performing checks of driver licenses against voter books, which also is not allowed. This is not universal at all polls. Some have gotten the word"...

  • Catch any problems at the polls on photo or video? Upload it to YouTube and social sites, and tell us and the rest of the world about it!
  • Be at the polls when they close and photograph and video tape the results tapes that are printed out from electronic systems. Results have a way of changing between the time they're printed out at the close of polls and the time they show up on the web. Your photographic evidence could help save an election!
  • Watching results on the web throughout the night? Take screenshots, save them as you go, and include a timestamp in the filename when you do. Those web results also have a way of changing, sometimes in the wrong direction, throughout the night. Your evidence could help save an election!

Over the weekend we noted a few of the heartbreaking stories about some of the born and raised Texans and 93-year old veterans and others who are now being turned away from the polls, unable to vote for the first time, many of whom have also been unable to obtain a supposedly "free" Election Identification Certificate (EIC) from the state, though not for lack of trying, in most cases.

That's all thanks to the Texas Republicans' new Photo ID restrictions at the polls. Before the new law, the state, since 2003, already required ID for every single voter at the polls without a problem. But they've now changed the law to make it much harder to vote, by requiring a small handful of very specific types of state-issued Photo ID to vote in the Lone Star State. The law will help to suppress the votes of some 600,000 registered voters who disproportionately tend to vote for Democrats, as determined during a year-long trial process finding the law "purposefully discriminatory" and an "unconstitutional poll tax".

Though the U.S. Supreme Court did not disagree with the findings of the U.S. District Court that the law is likely to disenfranchise thousands of perfectly legal voters, they allowed its use this year anyway, because the lower court's findings were determined too close to the start of voting to change the rules. (A reason that that Justices Ginsberg, Sotomayor and Kagan rightly found absurd in their stinging dissent.)

While state-issued Photo ID like hand-gun permits are now allowable for voting, Photo IDs issued by the state university system are not. The voter disenfranchisement resulting from that new law is already becoming clear, even if it's largely lost amongst the "horse race" coverage offered by much of the media...

Congratulations, Texas Republicans! Mission accomplished! Ya'll kept this guy from being able to cast his vote this year!...

The TX GOP has also kept a 93-year old veteran from being able to vote (because, ya know, fuck him and his "freedom") along with a whole bunch of others this year that we'll get to in a moment, thanks to their new polling place Photo ID law which was found to be both "purposefully discriminatory" and an "unconstitutional poll tax".

Unfortunately, despite the U.S. District Court judge's well-documented findings after a year-long trial process, the U.S. Supreme Court is allowing the law to be implemented this year anyway. Their apparent reason: the lower court struck down the law due to illegalities and unconstitutionalites of the Photo ID scheme, but that determination happened just too close to this year's elections to be allowed to stand this year.

But that 93-year old vet and the man pictured above, 45-year old Eric Lyndell Kennie, are hardly the only ones losing their right to vote in the Lone Star State election this year due to the Republican voter suppression scheme. The unconstitutional law, for now, replaces the state's previous Voter ID law which had already required every single voter to present an ID at the polls before voting. That's right, that was already the law since 2003, and during the trial, state Republicans were only able to demonstrate two cases of polling place impersonation over the past decade out of 20 million votes cast in the same period.

Nonetheless, with the new, much more draconian version of the law threatening some 600,000 legally registered voters who do not have the new type of ID required to vote, all sorts of disenfranchisement is already underway.

With the latest KPFK/Pacifica Radio fund drive behind us, it was great to be back on the air live today with The BradCast!

Just in time for Election Day next week, we got everybody up to date on all of the terrible SCOTUS rulings in regard to GOP voter suppression from over the past several weeks --- in OH, NC, WI and TX (and an important Photo ID ruling by the state Supreme Court in AR) --- for those who may have missed our coverage during the fund drive. Now it's up to the voters to try like hell not to be disenfranchised, particularly in TX, where it won't be easy this year.

Plus, our musical tribute to touch-screen vote-flipping now taking place all over the country --- yet again! And, the latest Green News Report with Desi Doyen as the future of climate change is on next Tuesday's ballot.

State's chief election official stands to benefit from unlawful new process in re-election bid against Dem Maggie Toulouse Oliver...

No doubt this is precisely the sort of thing that Chris Christie, New Jersey's governor, chair of the Republican Governors Association and 2016 Republican Presidential hopeful, was talking about last week when discussing the need for Republicans to be in charge of the "voting mechanisms" in 2016.

New Mexico, certain to be a key swing state once again in the 2016 Presidential election, currently has both a Republican Governor, the popular Susana Martinez, and a Republican Secretary of State, Dianna Duran. Both are up for re-election this year. Duran is in a neck-and-neck race against her Democratic opponent Maggie Toulouse Oliver.

Duran is one of those GOP "voter fraud" fraudsters who likes to pretend there is a massive epidemic of voter fraud that needs correcting via polling place Photo ID restrictions, even though such measures prevent far more legal (largely Democratic-leaning) votes from being cast than fraudulent ones --- and even though she's been able to find next to none since taking office four years ago.

At the same time, Duran appears to be slow-walking thousands of perfectly legal new voter registrations from being processed by the state Motor Vehicle Department (MVD), despite a 2010 court order issued after a settlement with the federal government requiring New Mexico to comply with the 1993 National Voter Registration Act, the so-called "Motor Voter" law.

On Monday, the Santa Fe New Mexican offered this distressing report from Brian Sweeney, a state voter, or, at least, someone who has been trying to be one for months without success...

When I moved to Santa Fe this summer, one of the first things I did was apply for a New Mexico driver's license. At the same time, I registered to vote using a paper form. This week, I learned from the secretary of state's registration information website that my voter registration was never processed. I received no notification of any problems with my registration.

On the stump this week for Republican candidates, NJ's Gov. Chris Christie said GOP governors need to win this year, so they can be in control of the "voting mechanisms" during what he believes might be his own run for President in 2016. He cited three races in particular, in three states that would be crucial to him as the GOP nominee, as reported by New Jersey's The Record...

Governor Christie pushed further into the contentious debate over voting rights than ever before, saying Tuesday that Republicans need to win gubernatorial races this year so that they're the ones controlling "voting mechanisms" going into the next presidential election.

Republican governors are facing intense fights in the courts over laws they pushed that require specific identification in order to vote and that reduce early voting opportunities. Critics say those laws sharply curtail the numbers of poor and minority voters, who would likely vote for Democrats. Christie - who vetoed a bill to extend early voting in New Jersey - is campaigning for many of those governors now as he considers a run for president in 2016.

Christie stressed the need to keep Republicans in charge of states - and overseeing state-level voting regulations - ahead of the next presidential election.

"Would you rather have Rick Scott in Florida overseeing the voting mechanism, or Charlie Crist? Would you rather have Scott Walker in Wisconsin overseeing the voting mechanism, or would you rather have Mary Burke? Who would you rather have in Ohio, John Kasich or Ed FitzGerald?" he asked.

Great questions, Governor Christie! Let's take a crack at offering some answers for ya...
