Greetings from the coronavirus zone, aka planet earth. It's NICOLE SANDLER back today to guest host the BradCast.

We're in the middle of a universally shared experience unlike anything in our lifetimes. People all over the world are dealing with the same crisis-- this new, very contagious and quite deadly disease for which there is no vaccine, no cure, and no prescribed treatment. All over the world, we're practicing social distancing and trying to stay safe.

Worldwide, we're coping in various ways; many are harnessing their creativity and the power of music and the internet and creating some fun and very funny music parody videos. Today, with the belief (which apparently even AP agrees with) that laughter is the best medicine, we'll share some that I've discovered over the past week or so with you. As an added bonus, I'll post the videos of the songs featured on the show today at the bottom of this article.

Now for the serious stuff. Last weekend marked the 10th anniversary of the passage of the Affordable Care Act. I was on the air at Air America while that legislation was being written, rewritten, and debated ad nauseum. It was during that time that we first met WENDELL POTTER, still the only former health insurance industry executive with the integrity to come forward to admit what he had done and try to fix the very flawed system.

Today, Wendell Potter is president of both Medicare for All Now and Business For Medicare For All, and he joins me to talk about the lack of progress in the past 10 years, and how the coronavirus crisis proves how necessary Medicare for All is for our survival, telling me: "People are going to avoid getting the care they need because they just simply don't have the money to pay for treatment even if they have insurance because of the high deductibles that most of us are in now. And it’s important to note that we're alone in the developed world in having a system like this. ... Yes, other countries are dealing with this crisis too, but we have this particular problem of having almost 30 million people in this country who don't have insurance, another 60 million who are underinsured, who don't have enough money in the bank to cover the out-of-pocket expenses even with insurance to get the care that they need."

Setting politics aside, why the evidence-free Trump/GOP claims about Ukraine and the 2016 election actually make no sense whatsoever...

Sometimes, when faced with an insidious canard, it isn't enough to either expose the true source of a conspiracy theory or the absence of any facts to support it. In order to thoroughly demolish it, one can identify a reductio ad absurdum --- "a form of argument in which a proposition is disproven by following its implications to absurd conclusions".

It is indeed important that, throughout the recent public impeachment hearings, House Intelligence Committee Chairman Adam Schiff (D-CA) referred to allegations that CrowdStrike and the Ukrainians hacked the Democratic National Committee (DNC) server in 2016 as a "debunked" conspiracy theory and that none of the State Department and National Security Counsel (NSC) officials who testified during the impeachment hearings could identify any evidence that would support that "debunked" theory. It is also important that, in her opening statement, Dr. Fiona Hill, Trump's own former NSC Senior Director of Russian and European Affairs, proclaimed that Russian intelligence agencies were the source of that "fictional" canard.

While there is ample evidence to support the conclusions offered by Dr. Hill and Chairman Schiff, one can deliver the coup de grâce to the baseless but insidious theory that Ukraine and CrowdStrike hacked the DNC by asking "why" they would do that?...

Our special BradCast coverage of the ongoing impeachment hearings of Donald J. Trump continues today, as 33-year foreign service veteran, Ambassador Marie Yovanovitch was sworn in as a witness in the U.S. House Intelligence Committee's public hearings. [Audio link to show is posted below.]

Yovanovitch, whose parents fled both Stalin's Soviet Union and Nazi Germany offered riveting testimony about being ousted, without explanation, by Trump, amid a smear campaign against her, propagated by Trump's attorney Rudy Giuliani, ousted corrupt Ukrainian officials and the President of the United State himself. The coordinated campaign against the virulently anti-corruption Ambassador appears to have been at the center of Team Trump's need to move her out of the way in April of this year so they could try to force Ukraine to announce state probes into Donald Trump's political rivals in exchange for $391 million in military assistance apportioned by Congress and unlawfully withheld from the embattled nation by the White House.

Even as the hearing on Trump's apparent high crimes and misdemeanors played out in the U.S. House Intelligence Committee on Friday afternoon, Trump seems to have added a new potential Article of Impeachment by attacking Yovanovitch on Twitter during her testimony. Committee Chair Adam Schiff, a former federal prosecutor himself, characterized the remarkably brazen attack on the longtime, well-respected Ambassador as attempted "witness intimidation". Even top Fox "News" reporters and anchors were stunned by Trump's attack.

We're joined today once again by award-winning opinion and analysis journalist HEATHER DIGBY PARTON of Salon and Hulaballoo as we analyze, explain and try to make sense of Friday's hearing, along with the aid of several extended clips from the proceedings.

ALSO TODAY: Even as the hearings played out, Roger Stone, a longtime Republican dirty trickster and close Donald Trump ally, was found guilty on all 7 criminal counts for which he was facing trial in federal court as part of the Robert Mueller investigation into Russia, Wikileaks and Team Trump interference in the 2016 election. The charges Stone was found guilty of include lying to Congress and witness tampering and could net the 67-year old GOP operative up to 20 years in federal prison...unless he is pardoned by his friend Trump. He is the sixth top Trump associate to be found or have pleaded guilty to federal felony charges.

At the same time, the Wall Street Journal today is exclusively reporting that Giuliani --- who was at the center of the Yovanovitch smear campaign and what Democrats describe as the bribery scheme to force Ukraine to announce an investigation of Joe Biden and his son who served on the board of Ukrainian natural gas company Burisma --- is himself now being criminally investigated by federal prosecutors in relation to a Ukrainian natural gas scheme.

Yes, it is all that insane, but we do our best to try and make sense of it today nonetheless...

On today's BradCast, it was (another) very bad day for Donald Trump, but a good day for Hillary Clinton, if anybody was able to notice, thanks to another shameful weekend by the mainstream corporate media. [Audio link to show follows below.]

Our stable genius President didn't make it any easier on himself by beginning his day with a grotesquely offensively comparison of his ongoing Constitutional impeachment inquiry to "a lynching". But it got far worse for Trump (if nowhere near as bad as an actual lynching), when his top diplomat in Ukraine, Bill Taylor, testified before impeachment investigators in the U.S. House. The veteran diplomat and foreign policy elder statesman spelled out, in no uncertain terms --- based on copious, contemporaneous notes --- that Trump had personally tied the release of nearly $400 million in military assistance for Ukraine to a quid pro quo requirement that Ukraine's President publicly commit to investigating Trump's 2020 political rival Joe Biden.

The testimony, according to House impeachment investigators, directly contradicts Trump, numerous top White House officials, and a number of Trump-appointees who offered earlier testimony. It also included a 15-page opening statement from Taylor, accurately described as "damning" by a number of Democrats.

Then, while you may or may not have heard about the news which was buried deep inside weekend papers on Saturday, the State Department --- Trump's OWN State Department --- concluded its years-long probe of emails sent to and from Hillary Clinton's private email server. The report, sent to Congress with little or no fanfare from either the media or the Trump Administration, found "no persuasive evidence of systemic, deliberate mishandling of classified information" by Clinton or anybody else in the Department.

The faux "scandal" that Trump, his campaign and his party disingenuously used to help propel him to office in 2016 has officially ended with a barely imperceptible whimper. That, even as top White House officials from daughter Ivanka Trump to son-in-law Jared Kushner to Steve Bannon to Stephen Miller to Executive Agency heads like Education Secretary Betsy DeVos have all since been found to have carried out government business on private email servers and have even reportedly shared classified information on private texting apps.

We're joined today by longtime media analyst ERIC BOEHLERT to discuss not only the phony "BUT HER EMAILS!" scandal that Trump falsely described during his campaign as "worse than Watergate" --- and which even today results in "Lock her up!" chants at his unhinged campaign rallies --- but the corporate mainstream media's dreadful failure and stunning "whitewash" of its own role in colluding with the Trump Campaign by constantly over-hyping the baseless charges in the run up to the fateful 2016 Presidential election.

"The email story does not exist without the Beltway press," Boehlert tells me, noting their coverage of the end of State Department's probe on page 16 (NYT) and 6 (WaPo) on Saturday. "Most of the network newscasts never even reported on the story over the weekend.

"This email story ran from March 2015 to November 2016," he rails. "This story rolled for months and months. If you take one peek, in September 2015, on average, if you look at the Washington Post --- print and online --- they were publishing two Clinton email stories every day for the month of September 2015. We forget how bad it was. Pick your adjective. Mind-boggling. Numbing. Irresponsible. Reckless. And what's important [is] to not let this happen again."

But, of course, it will, especially given the lack of contrition for this failure evidenced by the story's coverage this weekend. "These are smart people," he says. "They play dumb on an epic scale." Boehlert aptly compares the media's failure in becoming "hugely investigated in this story from the get to" to their similarly reckless coverage of the Bush Administration's claim that Iraq had WMD in the run-up to our disastrous war there beginning in 2003. He also goes on to offer warnings about the Administration's schemes to use the very same playbook in 2020.

"If you're concerned that we're going to have a repeat because the press not only refuses to learn any lessons from 2016, but doesn't even admit there are any lessons to be learned --- look at Joe Biden and the Ukraine. It's happening again. Not as bad as the other, because Trump has inadvertently impeached himself by publicly confessing to colluding with a foreign power. But we saw it in the beginning of this story, a lot of headlines, "Trump and Biden both tainted by Ukraine'. No, they're not. Let's not do that," he pleads.

We discuss why this seems to happen over and over (remember how the media fell for the John Kerry "Swiftboat scandal" in the 2004 campaign?) when it comes to the media's coverage of Democrats, what the media should have done both in 2016 and today, and what Americans can do to help avoid being taken for another predictable ride in 2020.

As you know, it's been an insane few weeks in the news. I begin each show with an update on the latest from Trumpland and Impeachment World. Today, we witnessed a Trump meltdown that started with presidential profanity on Twitter in the wee hours of the morning, and continued through two media moments with the president of Finland looking on, horrified!

We had two great guests today. I wanted to get a whistleblower's take on what's happening, so I reached out to JOHN KIRIAKOU, who served 23 months in prison for blowing the whistle on the US torture program during the Bush years, who brings a unique perspective to the story. He's written three great books on his experience.

Then, I went the academic route, and called on HARVEY J. KAYE, author and professor of Democracy and Justice Studies at the University of Wisconsin, Green Bay, to get his thoughts on this moment in history.

It's another busy day on the BradCast, with me, NICOLE SANDLER, holding down the fort while Brad and Desi deal with his father's catastrophic medical emergency.

If you only got your news from the mainstream, corporate media, you probably wouldn't know that almost 50,000 GM workers are on strike because they're virtually ignoring the story. Thank goodness for independent media. MIKE ELK is a long-time labor reporter who finally founded his own, reader-supported outlet, Payday Report. He's on the road covering the strike and the strikers who've had their health insurance cancelled by GM!

Also today: we're finally getting a handle on a strange and disturbing story that's been simmering for the past week or so. GREG SARGENT who writes The Plum Line blog for the Washington Post joins me to explain the story of the whistleblower who, we've now learned, took his or her concerns about a communication between the president and a foreign head of state in which Trump allegedly made a "promise" to the Inspector General of the Intelligence Community. The IG deemed the complaint credible and was a matter of urgent concern, and turned it over to the Acting Director of National Intelligence to give to the Senate and House Intelligence Committees, as dictated by law. The problem is, the Acting DNI refuses to do so!

And, with the news that Benjamin Netanyahu appears to have gone down to defeat in Israel's elections this week, I decided to place a cold call to Israel to chat with a random person about the outcome. It's always a crapshoot when I make these types of calls, but this one was a keeper!

In nearly seven hours of long-awaited, halting responses from the former Special Counsel, the need for impeachment became clearer than ever...

As documented by today's BradCast special coverage, former FBI Director Robert Mueller finally offered his long-awaited testimony in the U.S. House during nearly 7 hours of hearings before both the Judiciary and Intelligence Committees. [Audio link to show is posted below.]

The Republican former Special Counsel confirmed key details of his two-volume, 448-page report [PDF] on Russia's alleged interference in the 2016 election, the Trump Campaign's coordination with that effort and, in most detail, multiple instances of both indictable and impeachable criminal corruption of justice laid out by the report. In frequently halting and often terse responses to members of the two House panels, Mueller, as promised, refused to stray from the "four corners" of his report, issued earlier this year following his two-year probe.

Nonetheless, as heard on today's program, his responses made clear that both Donald Trump and Attorney General Bill Barr --- not to mention the bulk of the Republican Party and their rightwing media outlets --- have been completely misleading the American public with their claims that Mueller's report somehow "exonerated" the President. It did anything but.

"Did you actually totally exonerate the President?" Judiciary Chair Jerrold Nadler asked during his opening round of questions. "No," Mueller flatly replied, later adding that "the President was not exculpated for the acts that he alleged committed." When Rep. Adam Schiff, the Democratic Chair of the Intel Committee, asked, "Your investigation is not a witch hunt, is it?," Mueller dryly responded: "It is not a witch hunt."

In fact, as Mueller's testimony made clear to those who watched --- especially to those who didn't bother to read his actual report --- any other American who committed the crimes detailed in the Special Counsel's report would have been indicted on multiple felony counts, as more than 1,000 former federal prosecutors have now stated. But for the Dept. of Justice Office of Legal Counsel's (unsupportable) opinion that a sitting President cannot be indicted, Trump would most likely have been charged long ago for his repeated, unlawful attempts to quash the Special Counsel's investigation.

Moreover, near the close of today's long hearings, Mueller offered a chilling warning about what he describes as still-ongoing efforts by Russia and other foreign powers, "as we sit here", to interfere with and manipulate upcoming U.S. elections.

We hold most of the commentary and analysis on all of this for another day in order to bring you extended excerpts on today's program from the detailed questions and answers with members of Congress from both parties and in both the Judiciary and Intelligence Committees. Guest: In exclusive interview, cyber security expert Chris Vickery details his startling discovery of NC's exposed files before the 2018 elections...

On today's BradCast, we've got an exclusive interview with CHRIS VICKERY, Director of Cyber Risk Research at the cyber security firm UpGuard. Vickery revealed late last week on Twitter that he discovered files, including administrative master passwords for voting systems, at the North Carolina State Board of Elections website that were left vulnerable and available online for anyone to download, prior to the 2018 election. Today he explains the evidence that suggests these files may have been available as early as February of 2016, months before that year's controversial Presidential election. The files were found by Vickery unencrypted and with no password needed to retrieve them from the site. He tells me today that there were so many files and screenshots (see a redacted snippet from one of the password screenshots in the graphic above), that he's not even sure if they number in the hundreds or thousands.

The longtime cyber security researcher says he promptly notified state officials of the discovery last year, before the 2018 elections, and that the state, shortly thereafter, set the files in question and their directories to "private". In response to a commenter on his short Twitter thread revealing the potential security breech late last Friday, however, he notes that "someone would have had to actively choose to make the file repository available to the entire world. It is not unprotected by default."

He tells me today that he is "very concerned" about the exposure and would "like to know who the data was intended for. If you put it up somewhere, you're intending it to be accessed by somebody. So who did they aim this for? I would love to know that." Indeed, he also shared an email with me over the weekend that was posted in the same directory as the passwords screenshot, in which a State Board of Elections official notes: "The attached screen shots should show just about all of the settings you will need for contests and candidates" in the ES&S iVotronic Image Management program, part of the computer voting system which defines where candidates selected by voters are placed on the electronic ballots and optical-scan systems.

Vickery says he decided to go public with the disclosure following the Washington Post exclusive last week reporting that federal investigators at the Dept. of Homeland Security have finally agreed to work with NC on a forensic investigation of the state's voter registration computers which inexplicably failed during the 2016 Presidential Election, on Election Day, in parts of the state. That announcement via the Post comes on the heels of Robert Mueller's redacted report [PDF] (see Volume 2, page 50, "Intrusions Targeting the Administration of U.S. Elections"), in which the Special Counsel briefly details how Russian Military Intelligence operatives were able to penetrate the voter registration systems of "at least one" county in Florida. Just over a week ago, the new Republican Governor of Florida announced he was notified by the FBI that, in fact, two counties had, in fact, been penetrated via a spearphishing attack on VR Systems, the private vendor contracted to run those voter registration systems.

VR Systems also supplies similar systems in about half a dozen other U.S. states, one of them being North Carolina. But, as Vickery notes, the password files that he found exposed on the Internet last year were not for registration systems, but for the state's computer voting machines, scanners and tabulation systems made by private vendor ES&S (the nation's largest), as used across most of the state of North Carolina. And ALL of this comes after we have been trying to point out on The BradCast for the last two and a half years that nobody --- not the FBI, not DHS, not the states themselves, nor even Mueller's Special Counsel team, as he admits --- ever carried out a forensic investigation of the computer voting, registration or tabulation systems in use in any of the states in 2016, despite that election's surprise ending in which Donald Trump purportedly won by a razor thin margin.

In his first broadcast interview on these new revelations, Vickery explains how he discovered the files, how the state responded when he told them about the vulnerability last year, whether the DHS has contacted him since he revealed his findings on Friday, and how serious of a potential security breech this is, especially given the extraordinary effort that the U.S. Intelligence Community and the Mueller Report claim Russia expended in hopes of interfering in the 2016 Presidential election. "When you have computers, and software, and firmware updating passwords and modems all mixed in together, you have the capability to do a lot of crazy stuff," he says, in response to my question about whether these passwords could have been used to alter or upload false results. "It's not out of the realm of possibility, but I have no specific reason to believe that happened. But that is kind of a frightening concept to realize that all of the ingredients are there."

Disturbingly, Vickery's report is startlingly similar to one revealed last year by Kim Zetter at Politico in the state of Georgia, regarding a security researcher who found millions of voter registrations along with voting system administrative passwords online and vulnerable to download without a password, prior to the Peach State's 2016 elections.

Broken U.S. goes from grim to grimmer...

Today's BradCast, not unlike today's news, goes from grim to grimmer...But we find a reason or two to smile every now again. Really! I promise! [Audio link to show is posted below.]

Among the tales told of our broken country on today's program...

  • Breaking right at the top, Trump's Dept. of Justice announces 17 new charges filed against WikiLeak's Julian Assange, "including a virtually unprecedented move to charge him with publishing classified material," which serves as a very serious threat to the First Amendment rights of all journalists and media outlets;
  • Breaking over night, 13 tornadoes were confirmed across Missouri, including a "violent" twister that ripped through its capital of Jefferson City. One near Joplin lead to the deaths of three, eight years to the day after a tornado, one of the deadliest in U.S. history, killed 160 in the southwest MO town. In total, there have been more than 130 tornadoes over about a half-dozen states in just the past week...for some reason;
  • A breakthrough in the Senate on Thursday as the White House finally agreed to support a long-awaited disaster relief bill that does not include more money for Trump's border projects. But it does include $19 billion in actual disaster relief funding to hurricane, tornado, flooding, and wildfire ravaged states in the Southeast, Midwest, California, Puerto Rico and elsewhere after Trump held up the measure for months in hopes of border money and to block much-needed funds for Puerto Rico where communities were wiped out and thousands of Americans killed following 2017's Hurricane Maria;
  • The Trump Administration announced another $16 billion giveaway to farmers --- on top of the $11 billion bailout they were given last year --- as compensation for Trump's ongoing trade war with China that has broken import/export markets around the world, hitting Trump supporters in farm country particularly hard. As it has become clear that President Stable Genius' trade war with China shows no sign of ending any time soon ("They're really easy to win!," he has repeatedly said) and as the cost of his import tariffs (new taxes on Americans) continue to add up, world financial markets are "buckling" again today;
  • And, as all of that is ongoing, Trump appears to be coming even more unglued by the day, as the noose of his own criminality continues to tighten. Witness his insane tweets attacking his own former Sec. of State Rex Tillerson, who he described on Twitter today as "'dumb as a rock' and totally ill prepared and ill equipped to be Secretary of State." Maybe. But whoever would hire such an ill-prepared dolt for such an important job must be even dumber, apparently. Trump's comments were in response to testimony the former Secretary of State and Exxon-Mobil CEO gave to Congress this week, in which he detailed for hours how embarrassingly unprepared Trump was for a two-hour meeting with Russian President Vladimir Putin during the 2017 G-20 summit;
  • And yet, with all of that, House Speaker Nancy Pelosi, who charged on Wednesday that Trump was "engaged in a cover-up", vowed at her weekly press conference on Thursday that House Democrats were "not on a path to impeachment". She further suggested that Trump was too unstable to govern and offered prayers once again for him while "wish[ing] that his family or his Administration or his staff would have an intervention for the good of the country." If only there was a way for CONGRESS to somehow "intervene for the good of the country". Maybe Pelosi will come up with something...anything that could be done on that score. In the meantime, she did note that the use of the Constitution's 25th Amendment, which allows a President's cabinet to remove a President who is, for any reason, "unable to discharge the duties of the office" would be "a good idea." But really, if only there was SOMETHING a majority led by Pelosi in the House could possibly do for the good of the country?! We discuss;
  • Next, as if you didn't think this Presidency could get any grimmer, Trump is now said to be considering a Memorial Day weekend pardon of a passel of U.S. military war criminals who were either convicted of horrific crimes via military court-martial or who have been charged and are facing upcoming trials. We detail some of those horrendous crimes and the likely reason that Trump is now reportedly turning the Presidential pardon process on its head to grant unprecedented get-out-of-jail-free cards to war criminals while insulting his own military and breaking his own military justice system in the bargain. (Hint: Fox "News");
  • Finally, Desi Doyen joins us for the latest Green News Report, with more on the week's terrifying tornado swarms and flooding in the beleaguered Midwest, a disturbing new study on sea level rise, Louisiana's plan to retreat from the coast, and some good news and bad (mostly bad) from Trump's EPA...

It seems that even Republicans in Florida have finally been forced to notice/admit what we've been pointing out about the 2016 election for years now. And our guest on today's BradCast, a longtime county elections chief from the Sunshine State, is none too happy about any of it. He offers several serious-as-a-heart-attack warnings about 2020 in the bargain. [Must-listen audio link to show is posted at end of article.]

But, first up today, the nation and world continue to pay a dangerous and painful price for whatever did or didn't happen that resulted in the election of Donald Trump in 2016. The Administration continued to ratchet up their threats of war against Iran on Wednesday by ordering all nonessential U.S. Government staff out of Iraq, citing unspecified and publicly unsupported claims of threats from Iran. The face-off clearly comes from Trump's ill-considered decision to pull out of the 2015 Obama Administration-brokered, seven-nation nuclear agreement which had effectively ended Iran's nuclear program. Though even the Trump Administration conceded Iran has been faithful to the anti-nuclear pact, Trump withdrew the U.S. and re-imposed crippling sanctions. He's now threatening war, for reasons that nobody seems to understand, and has deployed war ships and bombers to the tinder-box region.

Back at home, Trump's stolen U.S. Supreme Court has inspired dozens of new anti-abortion laws in state after state. On Wednesday, Alabama Gov. Kay Ivey signed the most draconian measure yet, a bill that would outlaw almost all abortions, including in cases of rape and incest, while jailing doctors who perform the (currently) Constitutionally-protected procedure for up to 99 years. The new law, adopted on Tuesday by the male-dominated state Senate and signed less than 24 hours later, would not only force women to carry the child of their rapists, it could also penalize doctors more harshly than the rapists. The ACLU has vowed to challenge the law which would require even pregnant 11-year old rape victims to carry their baby to term.

In North Carolina on Tuesday, Republican primary voters selected their candidate to run against Democrat Dan McCready in the do-over election for the state's 9th U.S. House Congressional District after the Republican candidate and Baptist Minister Mark Harris was discovered to have hired a GOP contractor who carried out a massive Absentee Ballot Fraud Scheme last November. The 10-candidate GOP primary resulted in hard-right, Trump-loving state Senator Dan Bishop being selected to run against McCready in September's do-over election. Bishop is the author and lead sponsor of NC's infamous 2016 law restricting bathroom access for transgender people.

But, as the nation and world continue to pay the price for Trump's nightmarish Presidency, new questions emerge (or, at least, are finally being noticed by Republicans) regarding his own supposed 2016 election victory. On Tuesday, Florida's new Republican Governor Ron DeSantis acknowledged the FBI notified him that election systems in at least two different Florida counties were infiltrated by by Russian intelligence in advance of the 2016 election. He says the FBI has barred him from publicly stating which two counties those are.

The news comes on the heels of similar (and similarly vague) allegations detailed in the redacted Special Counsel report [PDF] from Robert Mueller (see Volume II, page 50, "Intrusions Targeting the Administration of U.S. Elections"), as well as public claims in 2018 made by Florida's then Democratic U.S. Senator Bill Nelson. Nelson's assertions about Russian access to the state's elections systems were publicly ridiculed at the time by then Gov. Rick Scott and other GOPers, even though Florida's Republican U.S. Senator Marco Rubio was told about the same information at the same time as Nelson in the Senate Intelligence Committee. Scott would go on to narrowly defeat Nelson for the Senate seat in 2018 and Republican DeSantis is said to have narrowly edged out Democratic gubernatorial candidate Andrew Gillum on the same day. Both races were so close they resulted in unprecedented statewide "recounts".

However, as our guest today, 30-year veteran Leon County, FL Supervisor of Elections ION SANCHO explains, "recounts" in Florida amount to little more than running the same paper ballots through the same optical-scan computers which tallied them --- either correctly or incorrectly --- in the first place. Sancho, the legendary elections chief in Tallahassee, the state's capital, was so well-respected by all sides that he was tapped in 2000 to oversee FL's notoriously aborted Presidential recount that year. He is furious today about DeSantis' announcement, the secrecy behind which are the counties that were penetrated (he retired after the 2016 election), and explains that he was lied to by the FBI when he was told, during a then confidential conference call with Bureau officials in 2016, that "no county had been hacked" in the run-up to the election.

"The Justice Department has continued to obfuscate and lie about this situation from the very beginning. I was on a confidential call on September 30, [2016] in which all 67 election officials here in this state, and the state election officials, were informed by the FBI that no county had been hacked. The state hadn't been hacked. They told us that. And we now know, from the documentation that's been released through The Intercept and Mueller, that was false. We now know from the documentation, some time in early August [of 2016], the successful penetration occurred."

Sancho also now questions whether there were more than two counties penetrated and says he has no reason to trust the claims by either DeSantis or federal officials that election results were unaffected by the attack. "Here's the crazy thing about it," he tells me, "the Russian GRU knows which counties they've penetrated. The only people that don't know are the election officials and the citizens and voters of the state...it's time the American citizenry, particularly Floridians, figured out that information."

He also hails NSA whistleblower Reality Winner as a "heroine" for alerting the world to documents revealing that the Russian GRU had penetrated elections systems in Florida (and possibly elsewhere) via coordinated spear-phishing attacks that allowed them access to voter registration and website election results reporting systems made by VR Systems, a private election systems vendor with contracts in dozens of U.S. states. Winner is currently serving 5 years in federal prison for having leaked those documents to The Intercept in 2017.

Sancho demands to know "why Homeland Security decided to keep critical information from state and local election officials" for so many years. "Why weren't we told?" He also furious at Rubio and other Republicans for their treatment of Nelson when he tried to blow the whistle himself last year. "Nelson was vilified as being old and senile for saying such a ridiculous thing. And actually he was right...And quite frankly, the individual whose stock falls in my eyes is Senator Rubio, who confirmed what Sen. Nelson said, only after the election. He could have told the truth, and said that Sen. Nelson is raising a valid point. He kept his mouth shut. He put his party over this nation, and we are poorer for it today."

As to the security of the state's election systems as we head into 2020, he warns that "Florida is not well protected," adding a chilling note: "You do a reconnaissance before a major attack," he tells me, "and I don't think we've had the major attack yet."

Sancho has plenty more to say regarding Florida's move to unverifiable computer-marked paper ballots in advance of the upcoming Presidential election, and much more that I hope you'll click below to tune in for. There's simply too much to fully summarize here.

But one last point for now. Sancho also offers his thoughts today on the recent measure passed by GOP state lawmakers to undermine Florida's Constitutional Amendment 4 which was adopted by nearly 65% of statewide voters last November, allowing some 1.5 million former felons in Florida who have completed their prison sentences as well as all parole and probation, to have their voting rights restored. The new GOP measure, which awaits DeSantis' signature, would bar those newly-eligible voters --- including more than 20% of the states African-American voting-age population --- from registering to vote unless all court-imposed fines and fees are paid.

"What the Republicans did was reprehensible," Sancho rails, arguing that the bill contradicts "the overwhelming, clear language" of the statewide constitutional ballot measure. Many have described the new GOP bill as a poll tax. Sancho calls it more "cash register justice", as it will allow those with money to vote, but not those without. "This is clearly restricting the right to vote based upon who can afford to pay. Jim Crow has been reestablished in Florida."

Among the related stories on today's program....

  • The House Oversight Committee moved on Tuesday to vote on contempt charges against Carl Kline, former White House Personnel Security Director, who refused to show up to testify at the Committee on Tuesday despite being issued a lawful subpoena by Congress ordering him to do so. His attorney said he didn't show on the advice of the White House who directed him not to. Kline, on apparent orders from the President, had approved "top secret" security clearances for dozens of White House officials, including Trump's son-in-law Jared Kushner, after career security officials rejected those applications for numerous reasons, according to 18-year White House personnel office veteran Tricia Newbold, who revealed the cases during whistleblower testimony to the House panel last month;
  • Maryland's two-term Republican Governor Larry Hogan said in New Hampshire this morning that he is considering a primary run against Trump, after describing the revelations of the redacted Mueller Report as "very disturbing" and criticizing his own party for being "afraid" of challenging the President. If he jumps in, Hogan would be the second GOP Governor to try and win the nomination over Trump in 2020, along with Massachusetts' William Weld who has already declared;
  • In news of still other Republicans willing to courageously stand up to a scofflaw President from their own party, J.W. Verret, a former Trump transition team official and professor of law at George Mason University, unleashed an op-ed today making the case for impeachment in the wake of Trump's "criminal conduct," citing "roughly a dozen separate instance of obstruction of justice" revealed by the Mueller Report as his "tipping point";
  • But while a handful of Republicans may be willing to take on the President, Democrats in Congress, for their part, are still timidly moving ahead with extraordinary caution. On a conference call with and a letter to the Democratic House caucus on Monday, Speaker Nancy Pelosi reportedly vowed that the House would continue Congressional investigations to "uncover the truth" about Trump's "highly unethical and unscrupulous behavior in his alleged attempts to obstruct justice," while attempting to keep a lid on the growing calls for impeachment from her caucus. She did not rule out impeachment, but said "we aren't going to go faster, we are going to go as fast as the facts take us";
  • On Monday night, however, in what many have somewhat mischaracterized as Presidential hopeful Sen. Kamala Harris "calling for impeachment," the California Democrat, during a CNN town hall, did call for Congress to "take steps toward impeachment." We contrast Harris' exceedingly cautious approach to the clarion calls for equal justice under the law and impeachment proceedings as a Constitutional duty issued by Massachusetts Sen. Elizabeth Warren in recent days. She has been calling for same, in no uncertain terms, on the Presidential campaign trail since the release of Mueller's redacted report late last week, and said on Monday night on CNN, in response to charges that impeachment would distract from the 2020 campaign: "There is no political inconvenience exception to the United States Constitution."

    A number of other Democratic hopefuls have been far more cautious and/or circumspect than either of those two, including Vermont Sen. Bernie Sanders who says he worries a focus on impeachment could backfire on Dems and South Bend, Indiana Mayor Pete Buttigieg who concedes Trump "deserves impeachment", but that it's up to Congress, not him, to take action in that regard;

  • With the noteworthy exception of Warren, many Dems (and media geniuses) have cited the fact that Republicans in the Senate are unlikely to vote to convict the President, as a reason to shy away from impeachment proceedings entirely. (A simple majority is needed to approve articles of impeachment in the Democratic-controlled House, but a two-thirds vote is needed for conviction and removal of the President in the GOP-majority Senate). Playing slave to that conventional wisdom, however, largely allows Republicans a veto on which Presidents may or may not be impeached.

    Moreover, the convention wisdom should be challenged here, particularly given the statements that many of the currently seated Republican Senators have offered, on the record, in support of impeachment and removal from office for a President who has attempted to obstruct justice by witness tampering and lying to the American public. Trump was documented as having done so as many as ten different times, as per Mueller's Report.

    Of course, the Senators who we quote directly today on the need to remove a President for those very same crimes were speaking against President Bill Clinton during his impeachment proceedings back in 1998. But their arguments against Clinton apply directly to Trump. So, will those very same Senators --- there are 11 who voted in '98 and would be required to vote here --- hypocritically vote against conviction this time around, under arguably far more criminal circumstances, when confronted with their own words on the topic? Maybe, maybe not. We won't know, of course, unless Dems do the right and Constitutional thing by voting in favor of the rule of law and moving to impeach this lawless President. Even the clear demonstration of blatant GOP hypocrisy would be helpful to expose to the American people before the 2020 election, and perhaps serve to make specious impeachments against Democrats in the future more unlikely;

  • Finally, Rep. Elijah Cummings, Chair of the House Oversight Committee, said after the release of the redacted Mueller Report that he is "begging the American People to pay attention" and contact their members of Congress about this in order to save democracy for future generations. "At the rate we're going," he warns, "it won't be there." We are urging the same. You can reach your member of Congress at 202-224-3121...

On today's BradCast: You get an indictment! You get an indictment! You get an indictment! Everyone gets an indictment!!! Well, not everyone. At least not everyone who deserves an indictment. But a bunch of folks got indicted today in a bunch of separate federal cases. [Audio link to full show is posted below.]

One time Democratic hero and former Stormy Daniels attorney Michael Avenatti was charged in a 36-count federal indictment in California for allegedly stealing from clients, not paying his taxes, and committing bank fraud. Former Obama White House Counsel Greg Craig was charged by prosecutors in D.C. for lying to federal agents regarding his lobbying work in Ukraine, a case that came out of the Robert Mueller Special Counsel probe (where Trump Campaign chair Paul Manafort was previously found guilty of very related charges).

And, of course, WikiLeaks founder Julian Assange was finally arrested in the U.K. after being kicked out of the Ecuadorean embassy in London (where he's claimed asylum for the past seven years) before being found guilty by a British judge of skipping out on bail while facing extradition for charges of sexual assault in Sweden back in 2012. The Swedish charges have since been dropped, but Assange now faces both prison time in Britain and an extradition request from the U.S. where prosecutors unsealed a one-count indictment [PDF] against him today, as filed under seal in March of 2018.

For now, that charge is an allegation of "conspiracy to commit computer intrusion". Federal prosecutors in the Eastern District of Virginia claim he attempted to help crack a password for a classified Defense Department computer system to assist then U.S. Army Pvt. Chelsea Manning in hacking documents. That, after Wikileaks had already released hundreds of such documents --- many containing evidence of serious U.S. crimes --- taken by Manning, back in 2010. Freedom of the press advocates, however, warn today that the charges being brought by Trump's Dept. of Justice against Assange could be expanded to include normal journalistic activities, which could threaten the Constitutional rights of many media outlets and journalists alike.

We detail today what we know --- and don't --- about the indictment; what we know --- and don't --- about what Assange and WikiLeaks have done (including the release of documents stolen from the DNC and Hillary Clinton campaign in 2016); and what all of this may --- or may not --- mean for U.S. press freedoms as the case moves forward.

Also today: Some good news regarding the death penalty in New Hampshire; Some quick updates on Trump Treasury Dept. Secretary Steven Mnuchin's refusal (so far) to turn over Trump's tax returns to Congress in violation of the law; Trump Attorney General William Barr's obnoxious, hypocritical, and (so far) evidence-free claim that the Obama Administration was "spying" on the Trump Campaign in 2016; And more disturbing details on the perfidy and corruption of David Bernhardt, the longtime oil and gas industry lobbyist who was shamefully confirmed today by the U.S. Senate as Trump's new Interior Department Secretary.

Finally, Desi Doyen brings us the latest Green News Report on Trump's newly signed Executive Orders authorizing himself to, among other things, authorize new oil and gas pipelines without approval from other federal agencies, and to remove states' rights to block energy infrastructure that threatens local water supplies; the second bomb cyclone in weeks to likely bring billions in damages to a number of Midwestern states; and several troubling new studies regarding the acceleration of climate change and glacial ice melt now outpacing previous scientific predictions...
