Trying to make sense of all the different court rulings in Wisconsin on their partisan Photo ID voting laws? We'll try to unpack that for you.

The short version: Two different state trial courts found the GOP's Photo ID restriction on voting to be a violation of the state constitution's right to vote. A federal trial court (aka U.S. District Court) similarly found the law to be a violation of various parts of the U.S. Constitution.

The partisan WI state Supreme Court recently overturned the decisions in the two state cases --- literally re-writing the law as they did so (yes, actually legislating from the bench on behalf of Republicans). Wisconsin's Republican Governor Scott Walker, whom recent polls suggest is in a virtual dead heat with his Democratic challenger Mary Burke, then asked the federal appellate court to immediately overturn the U.S. District Court's injunction, which still blocks implementation of Wisconsin's Photo ID law.

Last week, the federal appellate court turned down Walker's request that it immediately overturn the federal injunction. Wisconsin election officials are, at present, still barred from enforcing the controversial law in the Badger State.

Specifically, last week, the U.S. Seventh Circuit Court of Appeal issued an order [PDF] in which it refused an emergency stay of the federal court decision permanently enjoining Wisconsin's partisan Photo ID law prior to oral arguments on the merits of the state's federal appeal. Yes, the state not only appealed the adverse ruling in the two state cases (successfully), but they also appealed the initial federal court decision as well.

The permanent injunction in federal court was issued earlier this year by U.S. District Court Judge Lynn Adelman who, in a landmark 90-page decision and order [PDF] following a full trial, found that the Republican-enacted Photo ID law violated the U.S. Constitution and that it was "absolutely clear" that it "will prevent more legitimate votes from being cast than fraudulent votes."

Last month, following the issuance of the two decisions by the sharply divided and extraordinarily partisan Wisconsin Supreme Court which lifted the state court injunctions in two different state cases --- Milwaukee Branch of the NAACP vs. Walker [PDF] and League of Women Voters of Wisconsin v. Walker [PDF] --- Walker filed his Expedited Motion for a Stay Pending Appeal of the Permanent Injunction [PDF] in the federal appellate court.

In it's ruling last week, the 7th Circuit upheld the portion of the Wisconsin Supreme Court decisions which changed the law by directing the state's Department of Motor Vehicles to issue Photo ID cards sans requiring documents, such as birth certificates, for which the elector had previously been required to pay a fee to a government agency. That issue, however, is only one of the reasons why U.S. District Court Judge Adelman initially found the polling place Photo ID law constitutionally infirm. While we will have to await a final decision --- and even that decision will, no doubt, make its way to the U.S. Supreme Court eventually --- the current ruling issued last week suggests that the 7th Circuit did not see that one single issue as sufficient to immediately stay Judge Adelman's permanent injunction in federal court.

The 7th Circuit will hear oral arguments on September 12 --- less than two months prior to the November General Election. It is likely the 7th Circuit will expedite its decision. Stay tuned!

The case against Wisconsin Gov. Scott Walker (R), charging that he ran a "criminal scheme" by coordinating his 2012 recall election campaign with about a dozen "outside" groups, is about much more than just Walker and his corruption.

On this week's BradCast on KPFK/Pacifica Radio, I spoke with Brendan Fischer, general counsel at the Center for Media and Democracy about what could be the very last piece of campaign finance law to fall in the wake of 2010's Citizens United and 2014's McCutcheon rulings by the U.S. Supreme Court. Depending on how the challenge against the case against Walker goes, there may be nothing left that keeps candidate campaigns from putting unlimited, undisclosed millions to work in buying our elections. In short, as I discussed with Fischer, democracy could well become even more hosed than it already is in this country. Who knew that was even possible, at this point?

Wisconsin's Walker is at the center of what state prosecutors described as an extensive "criminal scheme" to illegally coordinate his 2012 recall campaign effort with about a dozen "conservative" political action committees, according to documents unsealed today in the Badger State.

And New Jersey's Christie is, according to another report today, said to be the ultimate target of federal prosecutors in a sprawling conspiracy case that appears to include all manner of improprieties --- not only limited to the infamous George Washington Bridge closure, but branching out from it to a number of his top political appointees and cronies who are reportedly said to face "near-certain indictment"...

County Clerks vow to begin marriages immediately, while Republican AG warns them not to, pending appeal

To head into the weekend with some good news, a federal judge has now overturned Wisconsin's ban on marriage equality. So freedom comes to the Badger State, despite its Governor, Scott Walker's continuing effort against such freedom, and against Constitutionally conservative values. It's hardly the first time Walker has been on the wrong side of the Constitution, the wrong side of conservatism, and the wrong side of history.

"Quite simply, this case is about liberty and equality, the two cornerstones of the rights protected by the United States Constitution," U.S. District Judge Barbara Crabb wrote in her 88-page ruling [PDF] striking down a state constitutional amendment passed in 2006, finding it in violation of the U.S. Constitution.

There's a bit of a legal skirmish ongoing tonight in the state, as Crabb did not stay her ruling pending the inevitable appeal, though suggested she might do so later after hearing responses from both sides of the lawsuit which was filed by the ACLU on behalf of eight gay couples.

State Attorney General J.B. Van Hollen has vowed to appeal, just as he did recently after losing the federal challenge to state Republicans' polling place Photo ID voting restriction. That statute, enacted by self-described "conservatives", was found by U.S. District Judge Lynn Adelman to have placed draconian and discriminatory restrictions on yet another American freedom (the right to vote) in violation of both the Wisconsin state and federal Constitutions.

"Current law remains in force," Van Hollen says tonight about the ban on marriage equality, though few seem to be listening or agreeing. According to the Journal Sentinel, County Clerks in Dane and Milwaukee Counties have announced they will begin issuing marriage licenses to same sex couples immediately...

The 2014 FCC has now spoken [PDF] in response to a complaint filed by my not-for-profit, the Media Action Center (MAC). Unfortunately, their response comes as little surprise.

It might, however, come as a surprise to the 1972 FCC. That year, the Federal Communications Commission discussed a ruling that became known as the "Zapple Doctrine". The rule extended the federal agency's interpretation of the equal time provisions, Section 315 of the Communications Act, to apply to supporters of candidates, as well as candidates themselves. If airtime was granted to a candidate over the public airwaves, equal time had to be made available to his or her opponent, if it was requested.

Zapple expanded the equal time provision to apply to supporters of candidates as well. It only made common sense, as the FCC explained in 1972...

What we were stating in Zapple was simply a common sense application of the statutory scheme. ... If the DNC were sold time for a number of spots, it is difficult to conceive on what basis the licensee could then refuse to sell comparable time to the RNC. Or, if during a campaign the latter were given a half-hour of free time to advance its cause, could a licensee fairly reject the subsequent request of the DNC that it be given a comparable opportunity? Clearly, these examples deal with exaggerated, hypothetical situations that would never arise. No licensee would try to act in such an arbitrary fashion.

"Exaggerated, hypothetical situations that would never arise?" Really? "No licensee would try to act in such an arbitrary fashion"?

Hey, 1972 FCC, please meet the 2014 FCC.

On May 8, 2014, the FCC, issued their response to MAC's complaint, filed after we discovered that two Milwaukee, Wisconsin powerhouse radio stations were giving millions of dollars in free airtime to supporters of GOP gubernatorial candidate Scott Walker, and not allowing supporters of his Democratic opponent any free airtime at all --- all in rather clear violation of the FCC's Zapple Doctrine...

Just over a week ago, The BRAD BLOG's legal analyst Ernie Canning posited that the decision by a federal court in Wisconsin to strike down that state's polling place Photo ID law could signal "the beginning of the end" for such disenfranchising, Republican-enacted laws around the nation.

Since that landmark ruling in the Badger State, new signs from top elected Republican officials in Pennsylvania and Iowa, and even in Wisconsin, suggest that the (at least) decade-long GOP "voter fraud" fraud may have finally peaked, and will now begin the inevitably long slide into abandoned, historical shame.

We don't want to be too quick to declare the demise of this insidious attempt at reviving Jim Crow with a sophisticated and nefariously misleading legal patina, but after covering this beat for a decade --- long before much of the general public, much less the Democratic Party itself, seemed to notice --- it seems that the recent landmark court ruling in WI, followed by last week's towel toss in Pennsylvania and embarrassing revelations in Iowa, may be seen in the not-too-distant future as the moment that the GOP "voter fraud" fraud finally began to permanently unravel...

UPDATED: Wisconsin Republicans will appeal to 7th Circuit...

This week's federal court decision to strike down Wisconsin's polling place Photo ID law has national significance and does not bode well for Republicans who have been attempting to advance such electoral schemes in recent years, as based on misleading "facts", wild claims and dishonest interpretations of case law and court precedent.

The court's landmark decision in the Wisconsin case contains a methodology for testing the law's constitutionality that, if applied by other courts in similar federal challenges to similar laws in other states, would likely mark the beginning of the end for Republican-enacted, polling place Photo ID restrictions. We describe that possibility as "likely", given that a careful reading of prior case law suggests that six of the Supreme Court's nine Justices have already subscribed to legal opinions that are consistent with the methodology used by the federal court in Wisconsin.

In late 2011, shortly after the filing of the first of the two federal cases that resulted in this week's ruling finding that Wisconsin's polling place Photo ID law (Act 23) violated both the U.S. Constitution and Section 2 of the Voting Rights Act (VRA), The BRAD BLOG explained why the issues before the federal bench in Wisconsin "could reverse similar laws nationwide."

The 90-page decision and order [PDF] that U.S. District Court Judge Lynn Adelman meticulously crafted, not only after a full trial on the merits, but over a span of more than 3 1/2 months following it, suggests that our earlier prediction may have been an understatement.

In declaring Wisconsin's Republican-enacted Photo ID law unconstitutional and a violation of federal law, Judge Adelman applied a very specific test for the law, one called for by the U.S. Supreme Court back in 2008. That same test, measuring the potential benefits of such laws against their possible harm to voters' rights, if similarly applied elsewhere, would likely invalidate most, if not all of the similar restrictions which have been rammed through numerous GOP-majority state legislatures over the past six years.

While stopping short of describing Republican "justifications" for such laws as a mere pretext for voter suppression, Judge Adelman's decision persuasively finds that the core GOP claims about the supposed need for polling place Photo ID restrictions cannot withstand judicial scrutiny when tested against a fact-based reality in a court of law. The judge found, in no uncertain terms, that such laws are constitutionally infirm because, without legitimate state interests for such restrictions, they serve only to disproportionately disenfranchise the poor, the elderly and minority voters...

Finds Republican restrictions on voting violate both the U.S. Constitution and Section 2 of the Voting Rights Act...

Very big news out of a federal court in Wisconsin today, where the state's polling place Photo ID law (Act 23) has now been struck down as both a violation of the federal Constitutional as well as under Section 2 of the Voting Rights Act.

While similar laws, all enacted by Republicans, have been struck down by state courts before --- indeed, Wisconsin's, was already found in violation of the state constitution in state court --- and in federal courts under Section 5 of the Voting Rights Act, today's ruling is the first to strike down such a law under Section 2 of the VRA.

The landmark ruling will almost certainly have national implications for federal challenges in other states against similar restrictions recently enacted by Republicans.

Last summer, the U.S. Supreme Court gutted the heart of the VRA by making Section 5 unenforceable until Congress passes new legislation to determine which jurisdictions must pre-clear new elections laws with the U.S. Dept. of Justice before they are put into effect, due to a history of racial discrimination in elections in those jurisdictions. Section 2, however, bars discrimination in all 50 states, even though, unlike Section 5, it cannot be applied until after the new law in question goes into effect.

Judge Lynn Adelman's ruling [PDF] today, finding WI's version of the law discriminatory and in violation of both Section 2 and the 14th Amendment of the federal Constitution, is likely to have an impact on federal challenges to similar laws in states such as Texas and North Carolina, where federal cases are pending to block similarly discriminatory polling place restrictions.

Moreover, the judge placed the racial and class discrimination and disenfranchisement that would be caused by this law in stark terms, in regard to how many otherwise legal voters in Wisconsin might lose their right to vote, and how such a law might have directly affected the results of the state's 2010 election, had it been place at the time...

Says 'not willing to defend them anymore, I'm embarrassed by this'
Accuses colleagues of 'trying to suppress the vote'...

Last week we told you how Wisconsin's Republican Gov. Scott Walker considers implementing a polling place Photo ID restriction in his state to be so "pressing" that he would call a special session of the state legislature to do it. He says it's the only such matter "pressing" enough to merit such extraordinary action this year, in advance of the November 2014 election --- when Walker himself, just coincidentally, faces a very tight re-election race.

That, despite the fact that two state courts have already found the Republicans' existing polling place Photo ID voter restriction law to be a violation of the state constitution and that expert testimony during one of the two trials detailed how there is only one single known case of voter impersonation fraud in WI over the past 10 years that might have possibly been deterred by such a law. At the same time, tens of thousands of perfectly legal voters will likely be barred from voting under such a law.The state Supreme Court is currently deciding on the state's appeal to the lower courts' rulings.

Republicans pretend that implementing such a law is not about voter suppression, but now at least one of them, to his great credit, strongly and loudly disagrees.

This week, Republican state Sen. Dale Schultz accused his own party of "trying to suppress the vote" and said that he is "not willing to defend them anymore. I'm just not and I'm embarrassed by this."

Schultz also decried the current WI GOP effort to suppress the vote --- one which would likely effect many elderly as well as minority and student voters --- as an insult to veterans, calling it "a slap in the face at the very least to some of the people who gave some of the most vital years of their life in the service of their country"...

Ever since the situation in Ukraine began to blow up (again), I've been trying to figure out what's really been going on. It hasn't been easy. And the U.S. corporate media has not been particularly helpful (again).

My attempt to sort out fact from fiction after last weekend's '97.6%' referendum vote in Crimea is just one example of finding the facts running counter to the U.S. MSM narrative.

We pick up that thread on this week's KPFK/Pacifica Radio BradCast, as I was joined by investigative reporter Robert Parry of ConsortiumNews.com to try and sort much of it out. His must-read article, "Mainstream US Media Is Lost in Ukraine", tying together blatant media failures on Iraq and Syria and now in Ukraine, begins to crack the nut of what the U.S. media is failing to tell us about the entire fine mess, including some startling audio evidence that we play on the show suggesting that certain narratives --- for example, the one about now former Ukraine President Viktor Yanukovych's police gunning down protesters --- may be much less (or, at least, much different) than has been generally reported in this country.

Parry explains how "The U.S. mainstream news media is reaching a new professional low point as it covers the Ukraine crisis by brazenly touting Official Washington’s propaganda themes, blatantly ignoring contrary facts and leading the American public into another geopolitical blind alley."

Meanwhile...Back up in Wisconsin, where two different courts have already found the Republicans' polling place Photo ID restriction law to be in violation of the state constitution, a decision on an appeal waits at the state Supreme Court.

But, no worries, if that Court also agrees that it's unconstitutional to deny WI voters their right to vote, Gov. Scott Walker is ready to call the state legislature back into an emergency session to try to pass another such law, according to the Journal Sentinel...

Gov. Scott Walker said Tuesday he would call a special legislative session if courts this spring do not uphold the state's voter ID law, which has been blocked since soon after it was enacted.

Shortly after taking over all of state government in 2011, Republicans passed a law requiring voters to show photo ID at the polls. In 2012, two Dane County judges blocked the measure.

Those cases are now before the state Supreme Court, which is expected to rule by June. Separately, U.S. District Judge Lynn Adelman is considering two other cases that argue the voter ID law violates the U.S. Constitution and federal Voting Rights Act.

Despite the fact that an expert on voter fraud testified during one of the trials last year that there was only one single case of voter impersonation in WI that might have been deterred by such a law over the past 10 years, the Wisconsin State Journal reports that Walker sees this issue as very very urgent --- the only one, in fact, that is urgent enough that he would find it necessary to call for a special session of the legislature, for some reason...

In a nation already at war with itself...

By now, you've certainly heard of the outrageous 9-hour detention of Guardian journalist Glenn Greenwald's partner David Miranda at Heathrow Airport under Great Britain's supposed "Terrorism Act" over the weekend. As Rachel Maddow amazingly, but justifiably, found it necessary to point out loudly last night, "journalism is not terrorism", and both the British government and U.S. government (which has admitted receiving a "heads-up" about the planned detention by British authorities in advance, but didn't stop it from happening) should be ashamed of themselves and held accountable for the outrage.

Many have opined, since the detention of Miranda, what an outrage something like that would have been had a similar harassment and the seizure of personal property of, say, a New York Times journalist doing his or her job, occurred in this country or by a country so closely allied with the U.S.

Well, before we took our short break last week, I had been covering some of the increasing citizen protests in several states around the U.S. in reaction to the extreme and radical Republican policies being put in place by states where the GOP has recently taken control of state government. I covered the ensuing arrests of an 83-year old Korean War vet peacefully demonstrating for voting rights in NC (as he did with MLK in Selma, AL in 1965) and of an 80- and 85-year old couple in WI arrested in a crackdown by Republican Gov. Scott Walker's Capitol Police for participating in a daily protest sing along in the state capitol building.

While I was gone, it seems, things have gotten worse in Wisconsin, as an elected official was also arrested for singing along, and even the editor of a progressive news magazine was arrested for having attempted to record it...
