On today's BradCast: The hack of over 100 million personal financial records of those who applied for credit cards at Capital One, one of the nation's largest financial institutions, underscores yet again how insane it is that we are relying on proprietary, un-overseeable computer systems "overseen" by Mr. and Ms. County Clerk to safeguard free and fair elections with results that can be known by the public to be accurate. The Capital One hack did not take a nation-state like, say, Russia, to accomplish. It was allegedly pulled off by one woman hacker who lives with cats in an apartment in Seattle. But if Capital One can't protect its data --- even from a lone hacker in Seattle --- what chance do you really think your local county clerk or even state election official has in protecting the votes of millions of voters? Should you be concerned about those three guys who, according to testimony last week in federal court from a Georgia Sec. of State's official --- as discussed on our show yesterday --- program every voting machine in the state, without oversight, from their garage?

Georgia, of course, is not the only swing state right now considering the purchase of millions of dollars of new, if 100% unverifiable, computer voting systems for use in the crucial 2020 Presidential election. The closely divided North Carolina is doing the same. Thanks to public pressure from a lot of folks on the ground in NC, however, the State Board of Elections appeared, as of Monday night, to be on the verge of a resolution that would effectively mandate hand-marked paper ballot systems across the state.

That decision however, as we report today --- with some new details from those carrying out the fight locally in the state --- may now be on very shaky ground after possible pressure on State Board officials applied by ES&S, the nation's largest voting vendor and, currently, the only vendor certified to do business in the Tar Heel State. A new meeting is now scheduled for Thursday to consider rescinding the motion passed by the Board on Monday night.

The fight for free, fair and publicly overseeable elections in North Carolina, Georgia and many other states and counties around the country is taking place right now. As in previous years, waiting until after the election will be, once again, too late to do anything about whatever may happen. We try to give you the information you need every day here to fight for your publicly overseeable democracy. What you do with that information, however, in your own locality, is up to you. And you are really needed right now.

Meanwhile, after Florida Republicans recently undermined a landmark state Constitutional Amendment adopted in a landslide by voters last November to restore voting rights to some 1.5 million former felons, a similarly popular state Constitutional Amendment adopted in 2018 by Michigan voters is also now under fire by Republicans. Amendment 2, adopted by 61% of statewide voters last November, creates an independent redistricting commission to draw fair state legislative and U.S. House maps after the 2020 Census. The effort came in response to the state's wildly gerrymandered 2011 maps which have kept Republicans in the majorities in the state legislature and U.S. House delegations, despite receiving fewer votes than Democrats statewide. Though federal courts found MI's maps to be unconstitutional, an opinion by the stolen Republican majority on the U.S. Supreme Court killed that ruling in June, with Chief Justice John Roberts declaring federal courts may have no say in partisan gerrymandering cases, while citing, among other things, the citizen-led effort to create an independent redistricting commission last November in Michigan as an alternate solution to unfair partisan maps.

But, on Tuesday, a Republican group led by Wisconsin's former Gov. Scott Walker --- who approved similarly gerrymandered maps in that state before eventually being voted out of office last November --- filed suit in federal court to kill Michigan's Prop 2. The group claims the Amendment violates the Free Speech and Equal Protection clauses of the U.S. Constitution. We explain and discuss.

Finally, Desi Doyen joins us for the latest Green News Report, with some good news for California in its fight against Donald Trump over new vehicle mileage and emissions standards; cable networks announce 2020 Democratic climate change forums; and professional Republican climate change denier and pollster Frank Luntz announces he has a change of heart...

After our two-day Special Coverage of the first 2020 Democratic Presidential Debate last week (Night ONE here, Night TWO here), we begin on today's BradCast to get caught up with some of the important news that we were unable to adequately focus on last week. (Even it may take a few days to get fully caught up, if ever!) [Audio link to show is posted below.]

First up today, we're joined for one last time this SCOTUS term by MARK JOSEPH STERN, the great legal reporter at Slate who has helped us make sense of the Court's most recent term under its stolen Republican majority, including many of the oral arguments since last Fall in a bunch of important cases and all of the subsequent rulings handed down in the past several weeks. The last of those rulings were, perhaps, the most consequential, and both came smack dab in the middle of Nights ONE and TWO of the Dem debate last week.

Today, Stern details the Court's horrendous (if not unexpected) 5 to 4 partisan ruling finding partisan gerrymandering to be perfectly Constitutional, despite all of the lower federal courts which have found otherwise. That, even though the practice, taken to new computer-precision extremes by the Republican Party following the 2010 Census, has bastardized the notion of fair representation at both the state legislative and Congressional levels. (eg. See North Carolina, which largely votes 50/50 for U.S. House members over the past decade, but has been represented in the House by just 3 Democrats and 10 Republicans over all of those years!) Stern describes the majority ruling, penned by Chief Justice John Roberts, as a "crushing defeat for voting rights" and a "fiasco for democracy". He explains how the rightwing majority ruling debunks the Chief Justice's own claim that he is the Court's "most aggressive defender of the First Amendment" in that extreme partisan gerrymandering blatantly robs voters of their First Amendment rights by punishing Americans for their partisan leaning, stripping them of the ability to be fairly represented.

"Partisan gerrymandering is uniquely evil and difficult to fix," Stern argues, "because it attacks the foundations of democracy. It entrenches a certain political party's power almost indefinitely, and creates a map that will hold even if the state votes against that party." Now, says Stern, the legal battle to rollback rigged election maps moves to the state court level instead, since SCOTUS has now determined that federal courts have no say in the matter (even though they long ago found racial gerrymanders, if not partisan ones, to be a violation of the Constitution.) "That's why this is the 'nightmare' scenario," he tells me. "Because if the legislature can't fix it --- and why would it fix it, they love what they've done --- you really have to rely on the courts to step in and fix it. And now Chief Justice Roberts has said that the federal courts are not going to hear these claims, that they're shut out forever. That leaves few avenues for relief for voters in these states."

We also get Stern's thoughts --- and callers who ring in on the topic as well today --- on whether Democrats, in states which they control after the 2020 Census should similarly use extreme partisan gerrymandering tactics to balance the scales by keeping Republicans out of power in such states, given that the High Court has granted its blessing for such tactics.

And, speaking of the Census, the other major ruling dropped last Thursday by SCOTUS was on whether or not the Trump Administration may add a question on citizenship to the 2020 Census. In that case, Roberts joined with the Court's liberals to reject the government's claim that they were simply hoping to add the question at the request of the Dept. of Justice in order to better enforce the Voting Rights Act. That transparently false claim was rejected by Roberts who wrote that it "appears to have been contrived".

In fact, it was, as several lower courts have ruled, even before the evidence from the hard drive of a recently deceased GOP gerrymandering expert revealed the entire charade was specifically meant to decrease the response rate by Hispanic and other immigrant communities in order to shift federal funding and voting power to Republicans and non-Hispanic whites. So, that decision was the good news. The not-as-good-news is that Roberts also left the door open for the Administration to try again with a less pretextual reason for adding the question, if they can come up with one. Or, as Stern sums up Roberts' directive in four words today: "Lie better next time." Whether the Trump Administration can do so before the deadline to send the Census to the printer (which, the Admin previously argued in court was a hard deadline of July 1, but now says "well, maybe October would be fine?") remains to be seen.

Next we open up the phone lines to listeners on last week's Democratic debate in Miami. Who do listeners feel did better than expected? Who did worse? The first polling is out today from CNN following last week's debate, finding a pretty huge shift among the Dem and Dem-leaning electorate. The survey finds Senators Kamala Harris and Elizabeth Warren are up 9 and 8 points respectively, while Joe Biden has fallen 10 points since the last CNN poll. That places Harris, Warren and Sen. Bernie Sanders (whose support dropped a few points) all now within just over 5 points from the former Vice President and perceived "front runner" for the Democratic nomination. That pretty seismic shift all comes after just one single debate...with about 11 more to come in the months ahead...

Among the many (largely) Trumpless stories on today's BradCast...

• A 30-acre "coal-cleaning" facility has been left abandoned by its owners in Utah, with outstanding fines, unpaid taxes and a whole lotta toxic waste that tax-payers are left on the hook to clean up. Just another example of privatizing the profits and socializing the losses which the GOP has supported for years when it comes to the long-subsidized dirty fossil fuel industry;

• The U.N.'s Deputy High Commissioner for Human Rights blasts the recent spate of anti-abortion laws adopted by GOP-controlled U.S. states. She describes the epidemic as a "crisis," equating the new restrictions as akin to "torture" and "gender-based violence against women". She describes measures such as rightwing-backed, so-called "Born-Alive Abortion Survivor Protection Laws" supported by folks like Donald Trump (because Fox "News" told him to) as "an assault on truth, science and universal values and norms";

• One such law, North Carolina's "Born-Alive Survivors Protection Act" was vetoed recently by the state's Democratic Governor Roy Cooper. The attempt to override the Governor's veto by the Republican-controlled state legislature failed on Wednesday, following the GOP's loss last November of the gerrymandered, veto-proof super-majority they've enjoyed for six years. Cooper, in his now-sustained veto message, said the bill was "needless" and would "criminalize...a practice that simply does not exist." Wisconsin's GOP-gerrymandered legislature also passed its own similar measure this week which that state's Democratic Governor has similarly vowed to veto;

• And, in Texas, where new evidence published this week reveals that Republican Gov. Greg Abbott may have been behind a push to create a phony "non-citizen" voter roll purge, the Governor may have earned new ire from Republicans and Democrats alike on Wednesday, after vetoing a widely supported bill to protect domestic violence victims;

• Meanwhile, in today's Constitutional Crisis and Impeachment Update, House Democrats are reportedly planning a vote next week to make it easier for Committees to bring contempt charges straight to court, without requiring a full House vote first, for Trump Administration officials who defy lawful subpoenas for documents and testimony. And, House Speaker Nancy Pelosi continued to block her caucus from beginning an official impeachment inquiry against the criminal President of the United States, explaining that she'd prefer to see Trump "in prison". But nothing in the Constitution bars an impeached President from being indicted in a court of law after removal from office. In fact, it says just the opposite (see: Article I, Section 3, Clauses 6 and 7). So, Pelosi's claim only seems to muddy the waters as to what her strategy to continue investigation of the Administration --- but without an official impeachment inquiry, for now --- is actually meant to accomplish;

• Finally, Desi Doyen joins us for the latest Green News Report detailing several new climate proposals from 2020 Democratic hopefuls, Trump's idiotic remarks regarding climate during his trip to the UK, and a disturbing new study about what will happen if the U.S. fails to meet the emissions reduction targets of the Paris Climate Agreement.

• Also, very quickly at the end of today's show, disturbing news on a record heat wave in India, where the mercury has topped 120 degrees Fahrenheit for a bunch of days in a row now, and a cheery warning from the U.S. Forest Service that some 1 billion acres are at risk of catastrophic wildfire this summer. (So, naturally, Trump wants to cut their fire fighting budget!)...

On today's BradCast, new details from Special Counsel Robert Mueller's report supporting the argument we've been trying to make for the last two years: Nobody ever checked the results of the 2016 election to make sure they were correct! [Audio link to show is posted below.]

But, first, we open with an avalanche of important news headlines breaking today and over the weekend, including the deadly Easter bombings in Sri Lanka; A TV comedian becoming the next President of Ukraine by a landslide; Trump's latest vow to impose sanctions on allies who purchase oil from Iran; Woefully unqualified Federal Reserve Board candidate and alleged sexual harasser Herman Cain withdrawing his name from Trump's consideration; The GOP's stolen Supreme Court announcing plans to take up cases to determine whether LGBTQ people may be covered by anti-discrimination civil rights employment laws this Fall; and Massachusetts Congressman Seth Moulton jumping into the crowded Democratic Presidential nomination contest.

Then we move to our all too brief commemoration of Earth Day's 49th Anniversary on Monday, wherein our own Desi Doyen details how and why the annual celebration first came about beginning in 1970. Of course, as we like to say on our Green News Report, every day is Earth Day for us! Nonetheless, sticking with that theme today --- for those who only notice it once a year --- we share "A Message from the Future from Alexandria Ocasio-Cortez" in which the freshman NY Democratic Congresswoman, from a couple of decades in the future, looks "back" on the world-changing successes of her Green New Deal program, as recently introduced with veteran Sen. Ed Markey (D-MA). The charming animated video, with illustrations by Molly Crabtree, is a thought experiment of sorts worth watching and/or listening to, as it helps explain how the GND would work to curb many of the worst effects of climate change, while providing millions of jobs and healthcare for all, as climate scientists have repeatedly warned the world must do within the next decade or face unstoppable consequences that threaten the entirety of human civilization.

Then, we move on to the revelation from the redacted Mueller Report [PDF] which has caused my Twitter feed to go somewhat bonkers since I cited it over the weekend. As the Special Counsel's report reveals (Vol. 1, pages 51-52, in the section entitled "Intrusions Targeting the Administration of U.S. Elections"), Russian intelligence operatives at the GRU targeted and infiltrated "individuals and entities involved in the administration of the [2016] elections. U.S. state and local entities, such as state boards of elections, secretaries of state, and county governments, as well as individuals who worked for those entities. The GRU also targeted private technology firms responsible for manufacturing and administering election-related software and hardware, such as voter registration software and electronic polling stations."

In other words, voter registration databases AND voting systems, such as voting machines and tabulators. Mueller's report goes on to concede that though the GRU was successful in implanting malware on a number of the targeted computers, "the [Special Counsel's] Office did not investigate further [and] did not, for instance, obtain or examine servers or other relevant items belonging to these victims." Instead, as Mueller writes, "The Office understands that the FBI, the U.S. Department of Homeland Security, and the states have separately investigated that activity".

Only problem with that? As we have reported repeatedly over the past two years, Jeanette Manfra, the top DHS official in charge of overseeing cyber-intrusions of critical infrastructure such as voting and tabulation systems, conceded during a June 2017 Senate Intelligence Committee hearing to Sen. Ron Wyden (D-OR) that her department had not, in fact, conducted any forensic analyses of computer voting and tabulation systems or servers following the 2016 Presidential election. We play a clip from her Senate testimony to that end.

As far as we can tell, this means that nobody has ever conducted such an analysis, despite the stunning results of the 2016 Presidential election. That remains very troubling, considering that Trump reportedly won, very narrowly, by less than 80,000 votes total in the key swing-states of Michigan, Wisconsin and Pennsylvania, none of which had voted GOP in a Presidential election for decades until 2016. The margins --- as reported by computers, but never verified by humans --- were close enough in each of those states that, had an average of just two votes in each precinct in each of those states been recorded for Hillary Clinton instead of Donald Trump, she, not he, would be President now.

Moreover, as the Mueller Report also documents, Trump's then Campaign Chairman Paul Manafort offered briefings and internal polling data to his business associate Konstanin Klimnik, a Ukrainian national tied to Russian intelligence, "on the state of the Trump Campaign and Manafort's plan to win the election," including what Manafort's partner Rick Gates described to the Special Counsel as "discussion of 'battleground' states, which Manafort identified as Michigan, Wisconsin, Pennsylvania, and Minnesota."

So, at this point, that means nobody still knows whether Donald Trump was actually the legitimate choice of the voters who comprise the Electoral College. (We already know he lost the popular vote by some 3 million votes.) Most of those very same computer systems will be used once again in the 2020 Presidential election, though some --- for example in Philadelphia, the entire state of Georgia, Los Angeles County and elsewhere --- are being replaced with newer systems that are even more difficult for the public to oversee to ensure reported results reflect actual voter intent.

And, with all of that today, we open up the phone lines to listeners for thoughts on whether --- given the findings of the Mueller Report, including Trump's well-documented and repeated attempts to unlawfully obstruct the investigation itself --- Democrats in Congress should begin impeachment hearings or not. So far, Democrats are somewhat split on the issue, with a number of freshmen in the House calling for impeachment proceedings to begin and, so far, only Sen. Elizabeth Warren (D-MA) among the current Presidential candidates offering a clarion call for members of Congress to meet their Constitutional duties by officially investigating Trump's alleged high crimes and misdemeanors via an impeachment inquiry in the U.S. House and a vote on whether to convict and remove Trump from office in the U.S. Senate. Our callers offer somewhat mixed feelings as well, as you'll hear on today's very busy and fast-moving BradCast!...

On today's BradCast, finding light on a very dark news day, and making sense of Devin Nunes' bizarre new legal attack against a well-respected media outlet. [Audio link for today's show is posted below.]

You know the news is dark on a day when the brightest spot seems to be the first-ever photographic evidence of a black hole in a galaxy that is 53 million light-years from Earth, as constructed by an international consortium of scientists from 20 different countries employing an array of observatories around the world to construct a virtual "telescope" the size of the planet itself. The assembled image of the supermassive black hole is the first such glimpse of such an object in space (theorized by Einstein over a century ago, but directly proven today for the first time) containing the same mass as 6.5 billion suns and so dense that nothing, not even light, can escape its gravitational pull.

Sounds a lot like the Trump Administration. But we (mostly) avoid that today, even as we discuss one of its biggest supporters in Congress, California Rep. Devin Nunes, and his increasingly mysterious (and troubling) new legal gambit.

But, before we get there today, an update on last week's razor thin race for a key seat on Wisconsin's Supreme Court. With computer-reported results from last week's election showing progressive-aligned Judge Lisa Neubaeur fell less than half of a percentage point shy of defeating far-right Judge Brian Hagedorn for a seat on the state's high court being vacated by a retiring progressive-leaned Justice, Neubauer decided on Wednesday against seeking a recount which she would have had to pay for under state law. Her concession today --- despite unofficial and unconfirmed computer tallies showing a loss by just about 6,000 votes out of some 1.2 million cast statewide --- means that progressives will be unable to regain a majority on the court until 2023 at the earliest. The new 5 to 2 rightwing majority all but scotches hopes for rolling back former Republican Governor Scott Walker's anti-union measures and GOP voter suppression laws, and could handicap the state's Democrats during the inevitable redistricting fights following the 2020 census. (Have we mentioned lately that elections matter?!)

Also today, more on the incoming and "potentially historic" "bomb cyclone" developing over plains states and the upper Midwest, where blizzard warnings have now been issued in 6 states, snowfall as high as two feet is predicted in some areas, and the threat of more major flooding is plaguing several states still fighting to recover from billions of dollars in damage from the last "bomb cyclone" which erupted just weeks ago. This latest evidence of the increasingly dangerous threat of catastrophic climate change comes on the same day as Donald Trump signed two new Executive Orders intended to make it more difficult for environmental regulations at the state level to prevent the construction of new oil and gas pipelines (which serve to exacerbate man-made global warming.)

Then, we're joined by veteran media analyst and author ERIC BOEHLERT to discuss the latest bizarre lawsuit, which seems to challenge the First Amendment itself, as filed by Nunes this week.

Several weeks ago, the California Congressman and top Trump ally in Congress filed a $250 million lawsuit against Twitter, the owners of two anonymous parody accounts (@DevonCow and @DevonNunesMom), as well as Republican strategist and Nunes/Trump opponent Liz Mair for defamation. This week, the GOP Congressman filed suit against Mair again, along with the 162-year old McClatchy Company, a news consortium which publishes the Fresno Bee, the hometown paper in the Nunes' central California district. His latest complaint seeks $150 million in damages, charging defamation based on an article published by the Bee last year detailing the settlement of a lawsuit after a charity yacht cruise which reportedly included cocaine and underage prostitutes, according to court documents cited by the paper. The cruise was auctioned off by the philanthropic arm of the Alpha Omega Winery, in which Nunes is an investor.

But where his Twitter suit seemed absurd, this new suit --- like the first one, originally reported by Fox "News", of course --- suggests a darker and more nefarious effort to undermine Constitutionally-protected freedom of the press. Who is funding these efforts by Nunes and why? Might it have anything to do with Trump's repeated assertions that libel laws need to change to make it easier for public figures like himself to challenge reporting that celebrities like himself don't care for?

Boehlert offers insight on what may be going on here: "The Republican Party has decided that Google, Twitter and Facebook are the new targets. And they're using the exact same playbook that they used on the traditional media for four decades, which is you work the refs, you scream and yell over these fake phony allegations of 'liberal media bias'. And it works! Facebook has bent over backwards to make sure Republicans are happy. Twitter could have easily banned Donald Trump two years ago and saved this country an enormous amount of pain, because he obviously violates the rules all the time. So it works."

But there may be even more behind all of this, as we discuss, along with his concerns about ongoing corporate media failures in the wake of Trump AG William Barr's handling of the still-secret Mueller Report and other related matters as we head into the 2020 Presidential election cycle.

Finally, we close with some listener mail regarding our ongoing discussions of how Dems should move forward as they attempt to remove both Donald Trump from office next year and the nation itself from the black hole we continue to sink into under his increasingly dark reign...

There were a number of important elections held around the country on Tuesday, so on today's BradCast, we've got some of the reported results from the key races, including both good and bad news for Democrats and progressives. Oh, and some stuff happened in D.C. today as well. [Audio link to show is posted below.]

We start with the good news out of Chicago, where former federal prosecutor Lori Lightfoot will become the Windy City's first black female Mayor, as well as the city's first openly gay chief executive. Lightfoot, who has never held elective office, ran as a progressive reformer to clean up Chicago's notorious old-school, insider politics after Democratic Mayor Rahm Emmanuel chose not to seek a third term. She is said to have easily bested Toni Preckwinkle, another African-American woman and a longtime elected official. by a nearly 50-point margin in Tuesday's final runoff contest.

There was still more good news for Democrats in the key swing-state of Pennsylvania on Tuesday, where Democratic Navy vet and former Dept. of Veterans Affairs official Pam Iovino is said to have defeated Republican D. Raja in a special election for a state Senate seat representing a suburban district outside of Pittsburgh. Republicans have held that seat for most of the past half-century, and the district (which uses 100% unverifiable touchscreen voting systems) reportedly went to Donald Trump by 6 points in 2016, when he took the state's 20 electoral votes for the first time since 1988.

Iovino's 4-point victory over Raja is being regarded as a potential bellwether for next year's Presidential contest when Democrats will need to win back Pennsylvania, Michigan and Wisconsin --- all of which went to Trump in 2016 before electing Democratic Governors during statewide elections in 2018 --- if they hope to take back the White House.

While there was good news for Dems in Pennsylvania, the news out of Wisconsin on Tuesday was decidedly less good...at least as of this hour. Progressive-aligned state Supreme Court candidate Judge Lisa Neubauer had been widely expected to win the seat of a retiring progressive-aligned state Justice, but appears to have fallen just short against GOP-aligned Judge Brian Hagedorn, according to unofficial results.

Hagedorn, who has likened homosexuality to bestiality, derided Planned Parenthood as a "wicked organization" and called the NAACP a "disgrace to America", declared victory in the early Wednesday morning hours after computer tallies gave him a lead of just under 6,000 votes out of just over 1.2 million cast across the state. Neubauer's campaign announced the race was "too close to call" and "almost assuredly headed to a recount", stating that "Wisconsinites deserve to know we have had a fair election and that every vote is counted".

With the margin less than 1% (it is currently one-half of 1%), she will be entitled to request --- and pay for --- such a "recount". State law, however, currently leaves it up to local jurisdictions to decide whether they wish to tally the state's mostly hand-marked paper ballots manually or simply run them through the same computer scanners that tallied them (correctly or incorrectly, who knows?) on Election Night.

Tuesday's state Supreme Court contest in the Badger State was particularly important for Democrats who, even if they had won, would have retained a 4 to 3 minority on the state's high court. But, with a conservative-aligned Justice retiring next year and the replacement election to be held on the same day as the state's 2020 Democratic Presidential Primary, they had hoped to finally flip the court to a more Dem-friendly 4 to 3 majority next year for the first time in years. That majority would be particularly important following the 2020 census and the inevitable subsequent court battles over redistricting in one of the most extremely GOP-partisan gerrymandered states in the country, not to mention hopes for rolling back a host of rightwing initiatives enacted under Republican Gov. Scott Walker now that voters sent him packing last November.

We're joined today by Wisconsin's own JOHN NICHOLS, Washington Correspondent for The Nation and associate editor of Madison, Wisconsin's Capital Times, to help us make sense of Tuesday's stunning reported results that appear to have taken both Democrats and Republicans alike off guard.

How and why did it happen, given Neubauer's huge fund-raising advantage over the toxic, Koch-supported former Walker protege who many Republicans chose to stay away from? Did a last minute infusion of out-of-state Republican cash make the difference? While turnout increased for both parties compared to the state's last Supreme Court election in 2018 (when the Dem-aligned candidate won by a full 12 points!), why did turnout appear to increase more for the GOP this year? And what happened that dampened turnout in Milwaukee?

Does a potential "recount" have any chance of reversing the currently reported results? And what should all of this --- an objectionably flawed rightwing candidate seen as having little chance of winning in Wisconsin, before he then goes on to narrowly win the state --- tell Democrats as they head into the crucial 2020 Presidential election looking to flip WI back into the D column? We discuss all of that and much more with the ever-wise Nichols today, who offers this "number one lesson" to progressives: "Do not assume Donald Trump is doomed."

Finally, there was also a lot of stuff that happened in Congress today for a change as well: The House Judiciary Committee voted to approve subpoenas for the Department of Justice to require Trump's Attorney General William Barr to turn over the full, unredacted Mueller Report, including its exhibits and underlying evidence; In the Senate, GOP Majority Leader Mitch McConnell unilaterally invoked the so-called "nuclear option" to change Senate rules, after failing to do so via regular Senate votes, in order to reduce the time needed to install Trump appointees to executive agencies and lifetime positions on the federal bench. The new rule will now require just 2 hours of debate, rather than 30, before holding a vote on such appointees; And, late in the day, the Democratic U.S. House Ways and Means Committee Chairman Richard Neal sent a letter to the IRS formally requesting the past 6 years of Donald Trump's tax returns as well as those for eight of his business entities. The House actions are certain to face challenges from the White House and likely end up being decided in court...

Among the many stories covered on today's program...

• It's Election Day in a number of places today, including for a very important state Supreme Court seat in Wisconsin, where the results will have ramifications (for the state and nation) for the next decade. And voters are also at the polls near Pittsburgh, Pennsylvania today for a special election for that state's Senate in a contest which may serve as a bellwether before the 2020 elections. We'll have reported results and other analysis of that and others contests, no doubt, on tomorrow's program;

• More disaster today near Houston, Texas where yet another deadly chemical fire broke out, killing one as of airtime, with two others airlifted to hospitals. Emergency officials issued shelter-in-place warnings to schools and residents within a 1-mile radius, advising residents to stay indoors, turn off all ventilation systems and seal all doors and windows. It's the second major toxic chemical plant explosion near Houston within as many weeks. Given the state's shameful history with chemical facilities --- and a dangerous, years-long lack of transparency, even for first responders --- the latest tragic incident is, sadly, not all that surprising;

• Donald Trump's latest nominee to head the Dept. of Interior is near confirmation in the U.S. Senate after his confirmation hearing last week in the Energy and Natural Resources Committee. But David Bernhardt --- currently Deputy Secretary and Acting chief of the agency following the resignation of Trump's first disgraced and corrupt Secretary Ryan Zinke --- is a longtime, top lobbyist for the oil and gas industry and has been instrumental since arriving at the agency in 2017 in reversing loads of environmental regulations long opposed by the fossil fuel and chemical industry.

  In fact, as a recent investigative report by Reveal illustrated, at an executive meeting of the Independent Petroleum Association of America (IPAA), a top industry group, after Bernhardt was tapped to be the top Deputy at Interior in 2017, the hundred or so oil industry executives at the conference were caught on tape laughing and applauding after the IPAA's CEO bragged about Bernhardt as "the guy that actually headed up" their legal team challenging federal endangered species rules being "now the No. 2 at Interior," adding, "So that's worked out well." Now Bernhardt will be No. 1 at Interior.

  We share some of the audio from last week's Senate Committee hearing in which Bernhardt said he would decline to recuse himself from issues at Interior involving companies for whom he lobbied, because, he said, he'd be "basically handcuffed and not in the game for the American people if I am recusing myself" and prevented from unleashing his awesome "skillset" on behalf of "the American team". Bernhardt, of course, is just one of many deeply-conflicted swamp creatures now inhabiting Trump's "drained" swamp;

• Speaking of which, a whistleblower with 18 years of experience in the White House Personnel Security Office, where she worked for Democratic and Republican administrations alike, has stepped forward to expose what she describes as at least 25 Trump appointees who failed security clearance checks, but were ultimately granted clearances anyway after intervention by more senior officials. According to Tricia Newbold's recent testimony to the U.S. House Oversight Committee, many Administration security clearances had been rejected for a number of reasons including "foreign influence, conflicts of interest, concerning personal conduct, financial problems, drug use, and criminal conduct."

  She testified that two currently-serving Senior Officials in the White House were granted clearances despite failing their background checks. Though the names of the officials whose security clearances were granted only after intervention were not specified, House Oversight Committee Chair Elijah Cummings has sought "adjudication summaries" from the White House for Trump's son-in-law Jared Kushner, his daughter Ivanka Trump, former National Security Advisor Michael Flynn, currently National Security Advisor John Bolton and a host of other top appointees.

  On Tuesday, the Committee voted to subpoena Carl Kline, Newbold's superior, believed to be behind a number of the questionable approvals. White House Press Secretary Sarah Huckabee-Sanders today described the Congressional oversight of the matter in partisan terms, bizarrely characterizing it on Fox "News" today as "sad and shameful" and, somehow, ironically enough, "dangerous" to national security;

• That statement came just hours before court documents were released today revealing that the Secret Service arrested a Chinese national at Mar-a-Lago over the weekend, during the President's latest visit to his Palm Beach resort, with four cell phones, two Chinese passports, a hard drive, and a computer thumb-drive said to contain "malicious malware". Court documents describe the woman telling the Secret Service, after she had initially been allowed inside the resort, that she was sent there by a Chinese friend who instructed her to travel from Shanghai to make contact with a member of Trump's family. But, why worry about security checks for those family members, eh?;

• Finally, Desi Doyen joins us for the latest Green News Report, with more on Bernhardt's enormous conflicts of interest, the White House's latest unprecedented scheme to jump start the stalled Keystone XL pipeline, more bad news for Trump's environmental rollbacks in federal court, and the Green New Deal has its first town hall discussion...

On today's BradCast, some facts --- real ones, not Mitch McConnell's --- about our nation's healthy history of changing the number of seats on the U.S. Supreme Court, which we have done seven different times over the past 238 years since our founding. [Audio link to full show is posted below.]

But, first up quickly today, Donald Trump has taken yet another hit from the courts on his attempt to undermine the Affordable Care Act and the U.S. healthcare system. It's the second such court loss he's faced over the past week, with the first court nixing his attempt to allow work requirements under Medicaid in Kentucky and Arkansas, and the second on Thursday night finding his allowance of cheap health insurance policies that don't meet the standards of the Affordable Care Act ("Obamacare") to be unlawful. That second ruling comes courtesy of a well-respected George W. Bush-appointed federal judge who is rarely reversed by appellate courts.

Next, a preview of a very important election on Tuesday in Wisconsin for its state Supreme Court. Its the first of two elections to the high court in the Badger State (one on Tuesday and the other next year on the same day as the Democratic Presidential primary election in WI) that could result in a progressive-leaning majority, at long last, being restored to WI's high court. Control of that court is wildly important for both the state and the nation on a number of fronts, which we discuss today, including voting rights before the 2020 election, redistricting for the next decade after the 2020 Census, and the rollback of a host of anti-union and other hard-right policies enacted during the gerrymandered Scott Walker years.

Tuesday's match-up is between progressive-backed Judge Lisa Neubauer and Koch Industries/Chamber of Commerce-backed Judge Brian Hagedorn, a protege of former Republican Gov. Scott Walker. Hagedorn has called Planned Parenthood a "wicked organization" devoted to "killing babies", described the NAACP as "a disgrace to America", and argued "The idea that homosexual behavior is different than bestiality as a constitutional matter is unjustifiable."

But while voters in WI directly select their Supreme Court at the ballot box (which I am no fan of), the U.S. Supreme Court is a different matter. After Senate Republicans stole what should have been a Democratic majority on the court in 2016 by refusing to even hold a vote on Judge Merrick Garland, Barack Obama's nominee to replace the late Justice Antonin Scalia, GOP Senate Leader Mitch McConnell held the seat vacant for a year before unilaterally changing Senate rules to do away with the filibuster to allow Neil Gorsuch to be seated on the high court. Later, under those same changed rules, the far-rightwing, accused sexual-predator Brett Kavanaugh was similarly added to the Court, likely cementing a generation of GOP-control.

In response, many progressives --- even Presidential candidates --- are now calling for the expansion of SCOTUS if Democrats can regain control of the U.S. House, Senate and White House next year, in order to restore a liberal-leaning majority that arguably should have been theirs in 2016. Naturally, McConnell is already decrying the idea, describing it on Thursday, ironically enough, as "an unprincipled power grab...that would threaten the rule of law and our American Judicial system." He cites the attempted court packing by Franklin D. Roosevelt in the 1930s to support his notion that changing the size of the Court is "a thoroughly discredited idea".

We're joined today by Wisconsin attorney and former state Supreme Court nominee TIM BURNS for both thoughts on Tuesday's crucial election in the state ("The stakes are huge," he explains) and the little-known history of "court packing" in the U.S. More specifically, Burns, who wrote about the issue recently at The New Republic, discusses the seven different times since the founding of our republic when the number of seats on the U.S. Supreme Court has been changed by Congress, including under one of our founders Thomas Jefferson and even under Republican Party icon Abraham Lincoln.

Burns, who serves on the board of the progressive Wisconsin Justice Initiative and the national board of the American Constitution Society, argues that contrary to misleading claims by McConnell and fellow Republicans, changes made to the size of SCOTUS by the Legislative and Executive Branches, as called for by the U.S. Constitution, have been healthy for the nation, often coming "hand in hand with some of the most vibrant periods of our democracy," and in response to the out-sized growth of corporate power.

"There have always been these predictions of the utter ruin of our democracy if the size of the Court is changed," Burns tells me. "The truth is, the Court's been viewed favorably even after its size has changed." And while he says that it's "entirely possible" that Republicans could then do the same thing once they regain power, "that doesn't spell the doom of our democracy. It says that our democracy is working. The political power rests with the voter instead of nine lawyers, judges on a Supreme Court."

Perhaps that's why Senate GOPers this week have introduced a measure calling for a Constitutional Amendment to keep the number of seats on the Court at nine. Good luck with that, boys.

Most interesting, however, may be Burns' fascinating recounting of what happened when FDR attempted unsuccessfully to expand the Court in what McConnell falsely described as an historic event that resulted in the idea of "Court Packing" becoming "synonymous in American history with the idea of an unprincipled power grab". What actually happened in the 1930s, and why the Court was ultimately not expanded under FDR is a fascinating bit of lost history and quite different from the way it has been described in lore. The truth places new calls to expand the Court today, during this period of unprecedented partisanship and class-divide under a hard-Right SCOTUS, into a very different light and perspective as this debate kicks off both in the nation and among Democrats vying for the 2020 Presidential nomination....

• New Zealand bans military-style assault weapons less than one week after a white supremacist terrorist massacred 50 worshiping Muslims at two mosques in Christchurch. That was easy. Must be nice to not be enthralled to decades of NRA propaganda and the tens of millions of dollars they are allowed to use to bribe politicians in the U.S., where even a Congressional vote on background checks has been verboten by Republicans;

• Record flooding continues to swamp the upper Midwest, as the National Weather Service warns the catastrophic floods will be moving south and inundating states as water makes it way toward the Mississippi Delta where some areas have already been fighting with rising waters since last month;

• All of that before we even get to the spring rainy season, about which the National Oceanic and Atmospheric Administration (NOAA) warned on Thursday could bring widespread "unprecedented flooding" to most of the nation amid climate change-accelerated storms;

• But there is much better news out of a court in Wisconsin where a state judge today blocked the GOP-controlled state legislature's unprecedented lame duck power-grab passed during an "extraordinary session" called last December to take power from the incoming Democratic Governor and Attorney General following the defeat of Republican Gov. Scott Walker by state voters in November. The judge ruled the session itself, called by just eight Republicans in the state House and Senate, unconstituionally declared and therefore, the three sweeping power-grab bills and last-minute confirmation of 82 Walker appointees before Democratic Gov. Tony Evers and Attorney General Josh Kaul could take over, are all now struck down. The victory for state voters and democracy lovers also means the Badger State may now withdraw from a multi-state lawsuit joined by the previous GOP administration challenging the Constitutionality of the Affordable Care Act ("ObamaCare"). GOPers in the state legislature have promised to appeal the ruling;

• The Commandant of the U.S. Marine Corps issued blistering memos this week warning that Donald Trump's deployment of troops to the U.S.-Mexico border and his "emergency" declaration has undermined troop readiness, national security and placed the well-being of the Corps at an "unacceptable risk". Gen. Robert Neller charges, according to the documents obtained and published today by the L.A. Times, that "unplanned/unbudgeted" deployment to the border last year and the shift of funding to border security efforts has resulted in cancellation of military exercises across the globe and has compromised "combat readiness and solvency". The unusually strong comments, according to military experts, critically cite the delay of urgent repairs needed at bases damaged by hurricanes last year in North Carolina and Georgia, with the new hurricane season just months away for "Marines, Sailors, and civilians working in compromised structures". All of that as Trump touted his support for the military on Wednesday night at a plant in Lima, Ohio which manufacturers tanks that the Pentagon has said they neither need nor want;

• All of this also follows on Trump's announcement last month that he is pulling the U.S. out of the 30-year old Intermediate-Range Nuclear Forces (INF) Treaty struck between Reagan and Gorbachev in 1987, leading to the destruction of thousands of nuclear-tipped missiles on both sides after the landmark Cold War era pact was signed. Russia has said they will now follow Trump's lead in abandoning the treaty and, according to Pentagon officials, the U.S. is now preparing flight tests this summer for two types of non-INF compliant missiles that would have been long-banned under the treaty. Let the arms race begin again!;

• Finally, Desi Doyen joins us for the latest Green News Report on the staggering cost to date of the deadly flooding in the upper Midwest, the toxic chemical inferno this week in Houston, Trump's new EPA chief blowing off concerns of global warming, 2020 Dems demanding action on same, and a very encouraging ruling on oil and gas drilling in Wyoming from a federal judge who has ordered that the government reconsider its environmental assessment of drilling on public lands to account for the cumulative threat of fossil fueled climate change due to man-made greenhouse gas emissions...

They were just baby steps. Though perhaps notable ones. Time will tell. But Thursday may prove to be a landmark in a potential and greatly-overdue claw back of Congressional powers ceded long ago --- long before Trump --- to the Executive branch. Whether the actions taken by Congress (including no small number of Republicans) on three separate issues today signal a sea change in the way Congress regards its own Constitutionally co-equal mandates and powers remains to be seen. But their rebukes of President Trump were surprisingly clear. Three different Congressional votes on three different matters covered on today's BradCast underscore this issue. [Audio link to show follows below.]

1) On Wednesday night, the GOP-controlled Senate voted once again in support of a resolution to end financial and military support to the U.S.-enabled, Saudi-led war on Yemen that has resulted in an unparalleled humanitarian crisis. The effort amounts to the first Congressional rebuke of a President under the War Powers Resolution since its adoption in 1973. But the invocation of a resolution under the legislation which cedes Congress' sole Constitutional power to declare war may not be enough to prevent the Trump Administration's promised veto and continued support of war-making with the murderous Saudi regime and its Crown Prince Mohammad bin Salman.

2) On Thursday morning, the Democratic led U.S. House voted unanimously(!), 420 to 0, on a resolution to demand the public release of the final report by Special Counsel Robert Mueller, whenever that may happen, after it's delivered to Attorney General William Barr. The statute guiding the duties of the Special Counsel was adopted by Congress in 1999, but mandates only that the Special Counsel deliver a "confidential" report to the AG. Congress failed to specify whether that report must ever be released to the full Congress, much less the public.

3) After recent passage in the Democratically controlled House, the U.S. Senate on Thursday voted 59-41 --- including all Democrats and 12 Republicans --- to reject Trump's "National Emergency" declaration to steal money appropriated by Congress to the military in order to build his southern border wall. It's the first time since the National Emergencies Act of 1973 that Congress has exercised its option to try and block such a declaration. The effort comes after a week of intense lobbying of Senate Republicans by the White House to block the resolution, and by Senate Republicans to convince Trump to accept a compromise alternative or face an embarrassing rejection from his own party. Nonetheless, Trump has vowed to veto the resolution and there are not currently the two-thirds of members in each chamber to override Trump's veto. The matter will most likely be settled in court and, as we argue today, very likely in favor of the President, given the way the Act was written (also ceding more Congressional powers to the Executive Branch.)

If the nation is lucky, however, today could mark a turning point after decades of Congress giving away its powers. But our nation hasn't been very lucky of late.

• And, in Wisconsin, still more (shameful) evidence that Republican Photo ID voting restrictions were adopted as little more than a (successful) scam to suppress the Democratic-leaning vote in the Badger State. A new report from all of Wisconsin's county election clerks finds just 24 cases of potential voter fraud out of some 2.7 million votes cast over the past year. ZERO of those cases, according to the Wisconsin Elections Commission, would have been prevented by the state's Photo ID voting restrictions. On the other hand, as we learned back in 2017, some 23,000 legal voters in just two WI counties alone were deterred from voting by the suppressive law in 2016. That was the year that Donald Trump reportedly won the state by 22,748 votes.

On today's BradCast, good news for voters in Wisconsin and Michigan, not nearly as good news for Donald Trump. [Audio link to show follows below.]

First up today, the White House is desperately scrambling for new distractions from Trump's unpopular, nearly month-long federal government shutdown and, of more pressing import for the President on Friday, an explosive report published Thursday night by BuzzFeed News. The otherwise uncorroborated article alleges that Trump instructed his former personal lawyer Michael Cohen to lie to federal investigators about the Trump Organization's proposed deal to build a Trump Tower in Moscow. The story cites two unnamed sources as "federal law enforcement officials involved in an investigation of the matter" and claims that Special Counsel Robert Mueller's office learned about the directive "through interviews with multiple witnesses from the Trump Organization and internal company emails, text messages, and a cache of other documents."

Cohen has admitted to lying to Congress and federal investigators about a number of matters and was sentenced last November to three years in prison after cooperating with Mueller's probe. If the story proves true that Trump instructed him to lie about the project --- which was reportedly still being worked on by Trump through June of 2016, much later than he had initially admitted --- it would, according to Democrats today, amount to evidence of the subornation of perjury as well as obstruction of justice, both impeachable offenses.

We also share the reaction today from Trump and the White House, neither of which denied the reporting initially, choosing to attack Cohen and BuzzFeed instead. Later, Trump's attorney Rudy Giuliani asserted that "Any suggestion --- from any source --- that the President counseled Michael Cohen to lie is categorically false." [POST-SHOW UPDATE: In a rare and carefully worded statement issued late Friday evening by Mueller's office, after we got off air, they disputed BuzzFeed's "description of specific statements...and characterization of documents and testimony obtained" by the Special Counsel.]

In other news today, a federal judge in Wisconsin on Thursday made short order of a challenge to new limits on Early Voting and allowable polling place IDs in the state after Republicans rammed through new restrictions during an extraordinary lame-duck session of the legislature last December, following Governor Scott Walker's re-election loss in the November midterm election. Thanks to heavy turnout, including record Early Voting numbers, Democrats won every statewide contest on the ballot and 54% of the votes for the State Assembly. But, thanks to partisan gerrymandering by state Republicans, they won only one third of its seats.

In a terse, 5-page ruling [PDF] on Thursday, U.S. District Judge James Peterson ruled it was "not a close question" that the GOP's newly enacted voting restrictions were an unconstitutional violation of voting rights, just as he had found nearly identical provisions to be, as passed by GOP lawmakers in 2016.

We're joined today by ANALIESE EICHER, one of the named plaintiffs from One Wisconsin Now's lawsuit challenging both the 2016 law and the late 2018 lame-duck version which Walker signed just days before leaving office. In addition to that court victory on Thursday, the non-partisan group had another on Friday, when a different court ruled that Republican lawmakers were in violation of the First Amendment by blocking the organization and others on Twitter. (Heads up, Alabama Sec. of State John Merrill!)

In neighboring Michigan, the new Democratic Sec. of State Jocelyn Benson announced she was seeking a settlement with Democratic challengers to the legislative and Congressional districts drawn by Republicans in that state. The previous Sec. of State, a Republican, was preparing to defend what Dems describe, with very good evidence, to be an extreme and unconstitutional partisan gerrymander after the 2010 Census. (One such piece of evidence are emails from GOP lawmakers discussing districts mean to "give the finger" to a former Democrat Congressman, and to "cram ALL the Dem garbage" into four districts so Republicans could control more seats across the state.)

A settlement with the newly seated SoS could result in new district maps drawn before the 2020 election. Last November, MI voters approved a ballot initiative that would put an independent redistricting commission in charge of drawing maps following the 2020 Census.

The federal government continue to spiral towards utter dysfunction under a President on the precipice of (take your pick). But one freshman Congresswoman provides a bit of a light at the end of the Trump tunnel. [Audio link to today's complete BradCast is posted below.]

Among the stories covered on today's program...

• Donald Trump's former personal lawyer Michael Cohen admits he paid a guy from Jerry Falwell Jr.'s Liberty University to rig online polls for Trump before he announced his candidacy in 2015. That, as Cohen is reportedly reconsidering his decision to testify to Congress next month in advance of his three year prison sentence, due to threats (witness tampering? intimidation?) by the President against him and his family. Trump failed to report the $50,000 payoff to rig polls to the FEC, which is yet another potential federal felony and/or article of impeachment for the sitting President. While the story should surprise no one at this point (remember, he also paid extras to cheer him on while announcing his candidacy at Trump Tower that year), its somehow still stunning and disturbing as yet another indication of just what Trump was likely willing to do, at any cost, to win in 2016;

• Speaking of what Trump and his campaign were willing to do, his new personal lawyer, Rudy Giuliani, may have broken the Internet after his appearance on CNN Wednesday night, in which he moved the "collusion" goal posts by falsely claiming that neither he nor the President ever claimed his campaign --- if not Trump himself --- "colluded" with Russia. In fact, contrary to Giuliani's ridiculous assertions, both men claimed repeatedly that nobody on the Trump Campaign was involved in such an activity. As of Wednesday night, it seems, Trump's lawyer is officially backing off that claim on behalf of the President...for some reason;

• Reverberations and consequences of Trump's nearly-month long federal government shutdown continue. As House Speaker Nancy Pelosi and a Congressional delegation were preparing to leave today for a secret trip to visit U.S. troops in Afghanistan, Trump, in retribution for Pelosi's threat to postpone his scheduled State of the Union Address during the shutdown, rescinded permission for the use of a military plane set to take Pelosi and the others on the overseas trip. You'll also be shocked to hear he lied about it all too;

• Meanwhile, as more Congressional Republicans --- and even a top former Administration official --- are questioning the wisdom of shutting down the federal government over Trump's demand for $5.7 billion to begin building his southern border wall, senior citizens and people with disabilities are facing the threat of potential eviction in HUD and USDA subsidized housing across the country;

• At the same time, the Administration is calling some 50,000 furloughed federal employees back to work without pay at agencies such as the FDA, FAA, and at the IRS as tax season begins;

• But, speaking of taxes, there is a reason that Republicans are freaking out --- and lying --- about the recent proposal floated by Rep. Alexandria Ocasio-Cortez (D-NY) to raise the nation's top tax bracket to 70% on those earning more than $10 million: the proposal is wildly popular --- by double-digit margins --- across virtually every demographic and every area of the country. Thus, folks like Wisconsin's failed former GOP Gov. Scott Walker was out bragging on social media this week about lying to school children about how AOC's proposal would actually work, who would and wouldn't be affected by it, and by how much;

• Finally, Desi Doyen joins us for the latest Green News Report, as Dems grill the Administration's new nominee/coal lobbyists tapped to head an Environmental Protection Agency (EPA) where pollution prosecutions have plummeted since Trump took office, while Australia faces yet another record heat wave, and as the business world slowly begins waking up to the mounting threat of climate change...

The effects of the federal government's partial shutdown, now in its third week, continue to worsen, even as the effects of last year's 'blue wave' election continue to make things much better for Americans across the country. Among the stories covered on today's BradCast [audio link is posted below]...

• The shutdown is causing "a mess" for potentially tens of thousands of American families who live in properties subsidized by the Dept. of Housing and Urban Development. They may soon face rent increases or eviction due to HUD's failure to renew thousands of contracts before and during the agency's closure;

• Vice President Mike Pence made the media rounds in advance of Trump's Tuesday night prime-time Oval Office remarks (which TV networks didn't allow for Obama), in hopes of drumming up support for the Administration's false claim there is a national security crisis on the border which may precipitate a Presidential declaration of a "national emergency". Pence offered a number of false claims in the bargain, which even some GOPers were scoffing at today;

• With Trump having boxed himself into this protracted shutdown mess, a "national emergency" declaration may be his only face-saving way out of it. It would likely result in Republicans allowing a vote in the Senate for reopening the government, even as the declaration would face court challenges over its legality and, essentially, do little more than steal tax-payer money from national defense as U.S. troops are tasked with building Trump's southern border wall;

• The U.S. Supreme Court has decided to hear two partisan gerrymandering cases this session (from Maryland and North Carolina), which may not be good news following the retirement of Justice Anthony Kennedy;

• But, in better news from SCOTUS today, the Court rejected a plea from Virginia Republicans to delay a lower-court mandated remapping of districts for its House of Delegates in advance of this November's off-year legislative elections in the state. Twelve of those districts were previously found by the lower court to be unconstitutional racial gerrymanders;

• Meanwhile, last year's midterm 'blue wave' is already yielding dividends for the nation. In Maine, the nation's dumbest now-thankfully-former Governor Paul LePage certified what he declared to be a "stolen election" for the U.S. House on his way out the door, and the state's new Democratic Governor Janet Mills signed legislation on her first day on the job that will finally give access to healthcare to some 70,000 Mainers under the Affordable Care Act (Obamacare) Medicaid Expansion that had been blocked for some eight years by the former Republican Governor;

• And, in further good news following last year's midterms, Florida's Amendment 4, adopted by nearly 65 percent of voters in November, kicked in on Tuesday to allow as many as 1.4 million former felons the right to vote in a state that is notorious for its close elections. Despite claims by some Republicans that "implementing language" may need to be enacted, County Supervisors of Elections began allowing registrations under the new Amendment for most former felons who have served their time. The result could be a sea change for the state in 2020, not to mention for the rest of the nation where Florida's electoral votes are key to Presidential elections;

• Finally, Desi Doyen joins us for the first Green News Report of 2019, where last year's 'blue wave' is also being positively felt on the environmental front at both the state and federal level, even as Trump's shutdown is trashing national parks and blocking important scientific research...

On today's BradCast: Lock him up! Plus a whole bunch of November 6 midterm fallout, follow-up and fraud. [Audio link to show follows below.]

Yes, despite his many desperate and ever-shifting attempts to explain (lie) his way out of it, all evidence demonstrates that Donald Trump quite clearly committed a major, indictable, campaign finance felony in his hush-money payoffs before the 2016 election to women with whom he had had sexual affairs. We're joined today by longtime campaign finance expert CRAIG HOLMAN of Public Citizen for a very sober, clear, point-by-point explanation of Trump's apparent crime in this matter and what can (or, at least should) be done about it.

Holman methodically debunks each of Trump's various claims --- offered via both Fox "News" and on Twitter --- in the wake of the criminal sentencing in federal court on Wednesday, of his longtime personal attorney and "fixer" Michael Cohen. Cohen pleaded guilty for, among other things, facilitating the illicit, covert payoff scheme "directed" by Trump to cover up the trysts so they wouldn't adversely effect his 2016 election chances. Holman elaborates on how any other elected federal official would "absolutely" be indicted for the exact same unlawful scheme.

"Every other government official is subject to the laws of the nation, just like you and I. And we have seen many members of Congress, for instance, and other Executive Branch officials face indictment, prosecution and even imprisonment for this type of felony behavior," he tells me.

The only thing preventing similar accountability for Trump, Holman argues, is the controversial opinion from the Justice Department's Office of Legal Counsel (OLC) which states that a sitting President may not be indicted on criminal charges. But, Holman says, citing recent arguments from Richard Nixon's former counsel John Dean, that's precisely what the U.S. Constitution's 25th Amendment was already designed to handle.

"The entire rationale behind [the OLC opinion] it is that indicting a President would incapacitate the Executive Branch, and therefore you just can't indict a sitting President," he says. But "we've got the 25th Amendment in the Constitution, and that sets up an entire transition period if the President becomes incapacitated. So there is no incapacitation. We know the transition. So the president should be subject to indictment."

Beyond the protection of the OLC opinion, Holman notes one very narrow potential argument that Trump might otherwise be able to use to avoid try and avoid legal accountability. But, he concludes, "The evidence is overwhelming that our President committed a felony."

In other news today, Wisconsin's rejected Republican Gov. Scott Walker signed a sweeping host of bills --- adopted with lightning speed by the gerrymandered GOP state legislature in an extraordinary lame duck session --- designed to undermine the Executive powers of incoming Democratic Governor-elect Tony Evers, and Attorney General-elect Josh Kaul, as well as the state's voters. At least one lawsuit in response has already been announced to challenge the new provision that restricts Early Voting in the state. A similar provision was ruled unconstitutional by the federal courts in 2016 (as we discussed recently with the plaintiff in that case.)

In Michigan, Republican Gov. Rick Snyder, also soon to be replaced by a Democrat, signed several bills on Friday that similarly undermine voters.

In North Carolina -- where Republicans invented these very types of unprecedented lame duck power grabs back in 2016 --- the GOP absentee ballot election fraud scandal that has, so far, prevented the certification of Republican Mark Harris' reported 905-vote "victory" over Democrat Dan McCready in the state's 9th Congressional District, may be spreading to a completely different U.S. House District. In Columbus County, in the state's 7th CD, there was reportedly an even larger percentage of mysteriously unreturned absentee ballots from Democratic voters than that which originally sparked the 9th CD's ongoing election fraud probe. In Columbus, a Republican candidate for Sheriff is said to have unseated the Democrat Sheriff by by just 37 votes after hiring the same GOP contractor at the center of the NC9 absentee ballot fraud allegations. As we've been reporting, evidence revealed during the ongoing investigation in NC9 will, almost certainly at this point, result in a new U.S. House election there.

Finally today, in Maine, incumbent Republican Rep. Bruce Poliquin saw his Constitutional challenge to the state's new Ranked Choice Voting system rejected by a Trump-appointed federal judge on Thursday. On Friday, he called off the ongoing hand-count he had requested in his 2nd Congressional District race. Poliquin, after winning the most votes in the first computer tally by more than 2,200 votes, failed to win a majority. In the next round of counting, after voters' second place choices were redistributed to other candidates according to the computerized RCV algorithm now used to tally ballots in the state, Democrat Jared Golden was declared the winner of the November 6th contest. The complicated RCV hand-count began last week and, until ended by Poliquin today, was otherwise expected to continue for several more weeks. The outgoing Republicans says he is still mulling an appeal to the federal court ruling.

No, Iraq hasn't (yet) announced plans to invade North Carolina to help spread democracy. But, on today's BradCast, it's starting to look like it might not be a bad idea. [Audio link to show is posted below.]

Just before air today, Dan McCready, the Democratic candidate in NC's 9th Congressional District U.S. House race tainted by evidence of GOP absentee ballot election fraud, withdrew his concession offered last month. McCready charges that Republican Mark Harris "bankrolled criminal activity" in the district in the hiring of contractor McCrae Dowless who appears to have gamed absentee ballots in Bladen and perhaps Robeson Counties, resulting in the 905-vote margin by which Harris had previously been thought to have won.

At the same time, NC-9's incumbent Republican Rep. Robert Pittenger, who Harris reportedly defeated in the primary last May, tells Washington Post that his concerns about fraud during that race --- when he lost to Harris by just 828 votes (more than half of them absentee ballots from Bladen) --- were shared with both state and national GOP officials at the time. Nonetheless, despite years-long claims of concern about fraud leading to passage of often unconstitutional GOP laws that restrict the ability of many Democratic-leaning voters to cast ballots, Republicans took no action after the primary. In fact, similar concerns about absentee ballot fraud by the same contractor surfaced after the 2016 election in the state as well.

The Charlotte Observer has now called for the 2018 election in NC-9 to be started over, from scratch, beginning with the primary. "Evidence demands it," their editorial board opined this week. We've got a whole bunch of late-breaking news related to the burgeoning NC-9 election fraud scandal today (along with my completely irresponsible prediction about how this entire thing ends).

Also, in related news, a newly emerging election fraud scandal in New York, where Republican and Independence Party leaders have now been charged with forging signatures on nominating petitions in order to boost chances for GOP candidates. (If that sounds familiar, it's because Republicans, apparently --- including very high-profile ones --- do that quite a bit.)

Meanwhile, GOP lawmakers in Wisconsin and Michigan this week continued their efforts to undermine the will of the midterm voters in the wake of disastrous performances in the November elections. In Wisconsin, where the GOP-gerrymandered legislature on Wednesday adopted unprecedented measures during an extraordinary lame duck session to remove power from the Governor, the Attorney General and voters in advance of Democratic Governor-elect Tony Evers and AG-elect Josh Kaul taking office next month, state lawmakers also confirmed 82 appointees of outgoing Republican Governor Scott Walker to state positions in one single day. Several of the positions had reportedly been vacant for as long as a year, and more than 30 of the new appointees have had no public hearing whatsoever in the state Senate. That power grab is particularly hypocritical for Walker, who warned his Democratic predecessor in 2010 to avoid all new appointments in the final two months of his term.

In Michigan, GOP lawmakers have proven similarly disdainful of voters during the lame duck session. Earlier this year, they adopted two voter-initiated ballot measures concerning increases to the state's minimum wage and paid sick leave for workers in order to prevent the proposals from appearing on the November ballot. But, this week, during the lame duck period before Democrat Gretchen Whitmer can be sworn in, Republican lawmakers gutted the measures they had just adopted in September. They would not have been able to do that had they been voted on by voters. The controversial --- and perhaps unconstitutional --- effort was given the green light by outgoing Republican AG Bill Schuette, who lost his bid for Governor in November to Whitmer.
