{"id":7069,"date":"2009-04-13T17:09:49","date_gmt":"2009-04-14T00:09:49","guid":{"rendered":"http:\/\/www.bradblog.com\/?p=7069"},"modified":"2009-04-14T02:50:37","modified_gmt":"2009-04-14T09:50:37","slug":"breaking-mn-court-issues-final-ruling-detailing-franken-win","status":"publish","type":"post","link":"https:\/\/bradblog.com\/?p=7069","title":{"rendered":"MN COURT: FRANKEN WON; BUT AP REPORTS AS: &#8216;FRANKEN LEADING VOTE-GETTER&#8217;?!"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/BradBlog.com\/Images\/SenatorElectAlFranken.jpg\" hspace=\"6\" vspace=\"3\" border=\"0\" align=\"right\">That&#8217;s right, <a href=\"http:\/\/www.thedickinsonpress.com\/ap\/index.cfm?page=view&#038;id=D97HSMA81\">according to AP tonight<\/a>, following the just released <a href=\"http:\/\/www.mncourts.gov\/Documents\/2\/Public\/Civil\/41309%20coleman%20franken\/Findings_of_Fact_Conclusions_of_Law_and_Order_for_Judgment.pdf\">final ruling [PDF]<\/a> from the 3-judge election contest court in Minnesota, Senator-elect Al Franken (D-MN) is not the &#8220;winner&#8221; of the election. Rather, he&#8217;s merely the &#8220;leading vote-getter.&#8221;<\/p>\n<p><em>Are they kidding?!<\/em> &#8220;Leading vote-getter&#8221;?! Apparently not. <\/p>\n<p>Will that be how AP reports the results of elections on Election Nights from now on? The one with the most votes counted in the unofficial results will be the &#8220;leading vote-getter&#8221;? Somehow, we&#8217;ve got the feeling that AP&#8217;s headline refers only to <i>this<\/i> race, and only since it&#8217;s Franken, not Coleman, who actually <i>won<\/i>.<\/p>\n<p>As <a href=\"https:\/\/bradblog.com\/?p=7056\">The BRAD BLOG pointed out late last week<\/a>, Franken isn&#8217;t &#8220;leading&#8221; as the <i>New York Times<\/i>, MSNBC and others reported it last week after the court&#8217;s final tally of all lawfully cast ballots concluded. And he certainly isn&#8217;t the &#8220;leading vote-getter.&#8221; Franken <em>won<\/em>. After one of the most painstaking and transparent hand counts, and then one of the longest election contests in U.S. history, it has been determined that Franken received more lawfully cast votes than anybody else in the race. Period. Furthermore, he has no legal leg to stand on in his likely appeal(s), as we detailed last week. All of that makes Franken the <i>winner<\/i> of the election, and former Sen. Norm Coleman the <i>loser<\/i>.<\/p>\n<p>If Coleman wishes to try to overturn Franken&#8217;s <i>win<\/i> &#8212; and he&#8217;s promised an appeal to the MN Supreme Court at the very least &#8212; that&#8217;s up to him. But Franken <i><b>won<\/b><\/i> the election. Got that AP? <i>New York Times<\/i>, et al?! Is that so difficult to report accurately?!<\/p>\n<p><center><a href=\"http:\/\/www.thedickinsonpress.com\/ap\/index.cfm?page=view&#038;id=D97HSMA81\"><img decoding=\"async\" border=\"0\" src=\"https:\/\/BradBlog.com\/Images\/AP_FrankenLeadingVoteGetter_041309.jpg\"><\/a><\/center><\/p>\n<p><em><strong>UPDATE 5:41pm PT:<\/strong><\/em> The rest of the media, other than AP, appear to be doing better in reporting on Franken&#8217;s <i>win<\/i> tonight&#8230;<\/p>\n<p><center><img decoding=\"async\" border=\"0\" src=\"https:\/\/BradBlog.com\/Images\/AP_RestOfMediaBetterOnFrankenWin_041309.jpg\"><\/center><\/p>\n<p><i><b>UPDATE 7:13pm PT:<\/b><\/i> <em>NY Times&#8217;<\/em> headline: <a href=\"http:\/\/thecaucus.blogs.nytimes.com\/2009\/04\/13\/in-minnesota-another-blow-to-coleman\/\">&#8220;In Minnesota, Another Blow to Coleman&#8221;<\/a>. Apparently &#8220;the paper of record&#8221; continues it&#8217;s allergy to the word &#8220;win,&#8221; along with AP. Downplaying the facts of the matter, Adam Nagourney writes tonight:<\/p>\n<div class=\"media\">By any measure, this latest ruling &#8220;\u201c the latest in a string against Mr. Coleman &#8220;\u201c further diminishes his hopes of holding on to his seat.<\/div>\n<p>&#8220;<em>Further diminishes<\/em> his hopes of <em>holding onto his seat<\/em>&#8220;?! That, despite the rather clear pronouncement in the <a href=\"http:\/\/www.mncourts.gov\/Documents\/2\/Public\/Civil\/41309%20coleman%20franken\/Findings_of_Fact_Conclusions_of_Law_and_Order_for_Judgment.pdf\">MN court&#8217;s ruling today [PDF]<\/a>:<\/p>\n<div class=\"media\">Franken received the highest number of lawfully cast ballots in the November 4, 2008 general election for United States Senator for the State of Minnesota and is entitled to receive the certificate of election.<\/div>\n<p>Is that unclear?! In most worlds, other than the <em>Times&#8217; <\/em>and AP&#8217;s in 2009, that would mean Franken <i>has won<\/i>. But the <i>Times<\/i>, like AP, just can&#8217;t seem to say it.
