{"id":5468,"date":"2007-12-21T11:27:28","date_gmt":"2007-12-21T19:27:28","guid":{"rendered":"http:\/\/www.bradblog.com\/?p=5468"},"modified":"2007-12-21T13:32:00","modified_gmt":"2007-12-21T21:32:00","slug":"diebold-now-also-under-doj-investigation-as-stock-price-hits-five-year-low","status":"publish","type":"post","link":"https:\/\/bradblog.com\/?p=5468","title":{"rendered":"Diebold Now Also Under DoJ Investigation as Stock Price Hits FIVE-YEAR Low!"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/BradBlog.com\/Images\/Diebold_2007StockPlummet.gif\" hspace=\"6\" vspace=\"3\" border=\"0\" align=\"left\">The death spiral for the 131 year-old company, once respectfully known as Diebold, continues, as its stock price falls to a <strong>5-year low<\/strong> today, near year&#8217;s end (currently $29.23\/share and still sinking, from a 52-week high of $54.50\/share), along with <a href=\"http:\/\/www.crainscleveland.com\/article\/20071221\/FREE\/892434399\/1090&#038;Profile=1090\">the additional news<\/a> that the U.S. Department of Justice has now joined the SEC in an investigation concerning the company&#8217;s &#8220;Enron-like&#8221; bookkeeping tricks&#8230;<\/p>\n<div class=\"media\">Diebold Inc. (NYSE: DBD) said it has learned that the U.S. Department of Justice is conducting an investigation that parallels a previously disclosed investigation by the Securities and Exchange Commission into the company&#8217;s discontinued practice of recognizing certain revenue on a &#8220;bill and hold&#8221;\u009d basis.<\/p>\n<p>Diebold announced in early October that it has been engaged in an ongoing discussion with the SEC&#8217;s Office of the Chief Accountant regarding its former use of the &#8220;bill and hold&#8221; method of recognizing revenue.<\/p>\n<p>Under bill and hold, ownership of a product contractually passes to a customer and revenue is recognized by the supplier prior to delivery of the product to the customer.<\/p>\n<p>Diebold said it&#8217;s in continuing talks with the Office of the Chief Accountant so that it can determine what the company termed &#8220;the most appropriate revenue recognition method&#8221;\u009d to replace its bill and hold practice.<\/p><\/div>\n<p><a href=\"http:\/\/www.BradBlog.com\">The BRAD BLOG<\/a>, of course, originally reported on the <a href=\"https:\/\/bradblog.com\/?p=2805\">SEC&#8217;s investigation into Diebold&#8217;s book-keeping chicanery<\/a> back in May of <em>2006<\/em>, just a few months after our <a href=\"https:\/\/bradblog.com\/archives\/00001838.htm\">first exclusive report<\/a>, based on information from a company insider we dubbed DIEB-THROAT, preceded a 20% stock-price plunge just days afterward.<\/p>\n<p>At the time, back in late September 2005, the stock price plunged to a 52-week low of about $44.37\/share (which we&#8217;re sure they&#8217;d kill for now &#8212; not that we wish to give them any ideas) and DIEB-THROAT <a href=\"https:\/\/bradblog.com\/?p=1853\">told us<\/a> in response to the related news: &#8220;the last time this kind of deception occurred it was called Enron.&#8221;<\/p>\n<p>Then came a class action securities fraud suit against the company in December 2005, as <a href=\"https:\/\/bradblog.com\/?p=2154\">first broken by The BRAD BLOG natch<\/a>, before the parallel SEC investigation first became public.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/BradBlog.com\/Images\/DieboldAd_HappyTrails.jpg\" hspace=\"6\" vspace=\"3\" border=\"0\" align=\"right\">Since then, following one independent <a href=\"https:\/\/bradblog.com\/?p=3467\">study<\/a> after <a href=\"https:\/\/bradblog.com\/?p=4914\">another<\/a> after <a href=\"https:\/\/bradblog.com\/?p=3135\">another<\/a> after <a href=\"https:\/\/bradblog.com\/?p=3719\">another<\/a>, finding their electronic voting systems to be virus-prone, hackable, unreliable and inaccurate, the company finally <a href=\"https:\/\/bradblog.com\/?p=2150\">dumped<\/a> it&#8217;s controversial CEO who had infamously <a href=\"http:\/\/www.commondreams.org\/headlines03\/0828-08.htm\">promised<\/a> in a Republican fundraising letter that he was &#8220;committed to helping Ohio deliver its electoral votes to&#8221; George W. Bush in 2004, before attempting again to fool the American public by <a href=\"https:\/\/bradblog.com\/?p=4962\">renaming<\/a> its election division &#8220;Premiere Elections Solutions&#8221; (same pig, fresh lipstick), just after stock prices <a href=\"https:\/\/bradblog.com\/?p=4951\">plummeted again<\/a> in August of this year to $47.60 as <a href=\"http:\/\/www.BradBlog.com\">The BRAD BLOG<\/a> noticed what appeared to us, and at least one financial analyst, to be <a href=\"https:\/\/bradblog.com\/?p=4972\">possible insider trading<\/a> among a number of company officials.<\/p>\n<p>Prices have continued to fall ever since &#8212; a lucky coincidence, no doubt, for those executives who just happened to unload a bunch of stock near the year&#8217;s high at $53.05 &#8211; to today&#8217;s 5-year low of $29.20. <\/p>\n<p>Additional bad news arrived last Friday for Diebold when a <a href=\"https:\/\/bradblog.com\/?p=5443\">new study by the state of Ohio<\/a> found their systems to be easily hackable (again), with better news coming last Tuesday as the state of <a href=\"https:\/\/bradblog.com\/?p=5451\">Colorado&#8217;s own certification tests<\/a>, surprisingly, gave their their machines a pass while decertifying many others. Yesterday, however, the reason for the inexplicable get-out-of-jail card they received in CO may have <a href=\"https:\/\/bradblog.com\/?p=5467\">become a bit clearer<\/a>: As it turns out, the Republican Secretary of State who oversaw the new certification testing, Mike Coffman, is running for Congress, and his campaign shares the same consultants as Diebold\/Premier in the state. Go figure.<\/p>\n<p>Diebold\/Premiere&#8217;s spokeshole, Chris Riggall <a href=\"http:\/\/www.rockymountainnews.com\/news\/2007\/dec\/20\/jeffco-appeal-voting-machine-decision\/\">told the <em>Rocky Mountain News<\/em><\/a> in response yesterday, that the company just had no idea about the extraordinary conflict of interest. But with the mission already accomplished, he announced to the paper: &#8220;Effective tonight that relationship is terminated.&#8221;<\/p>\n<p>With their stock-price still spiraling this morning, Diebold is <a href=\"http:\/\/www.crainscleveland.com\/article\/20071221\/FREE\/892434399\/1090&#038;Profile=1090\">quoted by<\/a> <em>Crain&#8217;s Cleveland Business<\/em> today as saying the company &#8220;anticipates [the DoJ] review will be completed in the first quarter of 2008&#8221; &#8230; Though rest assured, <a href=\"http:\/\/www.BradBlog.com\">The BRAD BLOG&#8217;s<\/a> review of the company <em>won&#8217;t<\/em> be completed by then.
