{"id":3822,"date":"2006-11-20T16:45:41","date_gmt":"2006-11-21T00:45:41","guid":{"rendered":"http:\/\/www.bradblog.com\/?p=3822"},"modified":"2006-11-20T16:45:41","modified_gmt":"2006-11-21T00:45:41","slug":"california-supreme-court-rules-bloggers-immune-from-libel-suits-for-posting-defamatory-statements-made-by-others","status":"publish","type":"post","link":"https:\/\/bradblog.com\/?p=3822","title":{"rendered":"California Supreme Court Rules Bloggers Immune from Libel Suits for Posting Defamatory Statements Made by Others&#8230;"},"content":{"rendered":"<p>Phew&#8230;We&#8217;re firing our lawyers forthwith&#8230;<a href=\"http:\/\/www.msnbc.msn.com\/id\/15817955\">From MSNBC today&#8230;<\/a><\/p>\n<div class=\"media\">The California Supreme Court ruled Monday that bloggers and participants in Internet bulletin board groups cannot be sued for posting defamatory statements made by others.<\/p>\n<p>In deciding a case closely watched by free speech groups, the court said a federal law gives immunity from libel suits not only to Internet service providers, like AOL, but also to bloggers and other users of their services.<\/p>\n<p>&#8220;Subjecting Internet service providers and users to defamation liability would tend to chill online speech,&#8221; today&#8217;s unanimous ruling said.<\/p>\n<p>The decision (<a href=\"http:\/\/www.courtinfo.ca.gov\/opinions\/documents\/S122953.PDF\">http:\/\/www.courtinfo.ca.gov\/opinions\/documents\/S122953.PDF<\/a>) is a victory for Internet free speech advocates, who warned that a contrary outcome could have affected users of newsgroups, blogs, listservs, and bulletin boards who enter those forums to discuss the views of others.
