[<i>Audio link to show follows below.<\/i>]\n<p>Attorney and legal journalist <b>Mark Joseph Stern<\/b> of Slate joins us to break down the full 4th Circuit Court of Appeals&#8217; potentially <a href=\"http:\/\/www.slate.com\/blogs\/the_slatest\/2017\/02\/21\/appeals_court_holds_second_amendment_doesn_t_protect_assault_weapons.html\">landmark decision<\/a> upholding the state of Maryland&#8217;s ban on semi-automatic &#8220;weapons of war&#8221; and the U.S. Supreme Court&#8217;s <a href=\"http:\/\/www.slate.com\/blogs\/the_slatest\/2017\/02\/22\/supreme_court_buck_v_davis_decision_ineffective_assistance_of_counsel.html\">ruling<\/a> today on a race-based death penalty case out of Texas.<\/p>\n<p>On <a href=\"http:\/\/www.thestate.com\/latest-news\/article134088034.html\">MD&#8217;s ban<\/a> on military-style assault weapons, enacted by the legislature following the 2012 Sandyhook Elementary school massacre, the full court&#8217;s majority ruling, including a number of Republican-appointed judges, soundly rejected the opponents argument that, as Stern says, &#8220;once enough people own a certain type of gun, the 2nd Amendment magically begins to protect it.&#8221; He explains what may happen next with this case as it moves toward the Supreme Court and offers his thoughts on why GOPers and the NRA are suddenly unconcerned with their &#8220;states rights&#8221; arguments when it comes to guns.<\/p>\n<p>On the <a href=\"http:\/\/www.cnn.com\/2017\/02\/22\/politics\/duane-buck-supreme-court-death-row-ruling\/index.html\">SCOTUS death penalty case<\/a>, granting a repreive, for now, to a Texas man on death row since 1997, Stern explains how the case underscores that &#8220;people who are sentenced to death in this country get the worst lawyers sometimes&#8230;It&#8217;s really quite shocking.&#8221; Incredibly enough, Chief Justice John Roberts eloquently agreed &#8212; at least in this case.<\/p>\n<p>And more encouraging news also covered today&#8230;<\/p>\n<ul>\n<li>A federal court in Texas <a href=\"http:\/\/www.cnn.com\/2017\/02\/21\/politics\/texas-planned-parenthood-medicaid-injunction\/index.html\">blocks<\/a> the state&#8217;s attempt to defund Planned Parenthood;<\/li>\n<li>North Carolina&#8217;s Democratic governor moves to <a href=\"http:\/\/electionlawblog.org\/?p=91218\">withdraw<\/a> the state&#8217;s appeal to SCOTUS, filed by his Republican predecessor seeking to overturn a federal appeals court finding that the state&#8217;s election reform law <a href=\"https:\/\/bradblog.com\/?p=11780\">unconstitutionally discriminated<\/a> against African-Americans <a href=\"http:\/\/talkingpointsmemo.com\/dc\/north-carolina-cooper-voter-suppression\">&#8220;with surgical precision&#8221;<\/a>;<\/li>\n<li>An FEC commissioner <a href=\"https:\/\/talkingpointsmemo.com\/livewire\/fec-commissioner-i-will-not-be-silenced\">refuses<\/a> to back down in the face of legal threats from Koch Brothers&#8221; funded group after her demand to see Trump&#8217;s alleged evidence of thousands of illegal votes cast in New Hampshire&#8217;s 2016 Presidential election;<\/li>\n<li>Another new poll <a href=\"https:\/\/poll.qu.edu\/national\/release-detail?ReleaseID=2431\">finds<\/a> Trump&#8217;s approval ratings &#8220;sinking like a rock&#8221;;<\/li>\n<li>A Muslim group <a href=\"https:\/\/www.launchgood.com\/project\/muslims_unite_to_repair_jewish_cemetery#\/\">raises<\/a> $90 thousand (so far) to help repair the desecrated Jewish cemetery in St. Louis, MO;<\/li>\n<li>A people continue to exercise democracy, whether Republicans and Donald Trump like it or not, by showing up in huge numbers at Congress member town halls across the country&#8230;<\/li>\n<\/ul>\n<blockquote><p><img decoding=\"async\" src=\".\/Images\/Speaker_Icon_24.png\" style=\"width: 24px;
