(Seriously.)"},"content":{"rendered":"[<i>This article now <a href=\"http:\/\/www.progressive.org\/judge-recants-own-recanting-of-key-voter-id-ruling\">cross-published by <\/i>The Progressive&#8230;<i><\/a><\/i>]\n<p><img decoding=\"async\" src=\"https:\/\/BradBlog.com\/Images\/JudgeRichardPosner_glasses_double.jpg\" hspace=\"6\" vspace=\"3\" border=\"0\" align=\"right\">Okay. Now this is beginning to get <i>completely<\/i> absurd.<\/p>\n<p>In an article at New Republic headlined <a href=\"http:\/\/www.newrepublic.com\/article\/115363\/richard-posner-i-did-not-recant-my-opinion-voter-id\">&#8220;I Did Not &#8216;Recant&#8217; on Voter ID Laws&#8217;,&#8221;<\/a> published Monday, 7th Circuit Appellate Court Judge Richard Posner now claims he <i>hasn&#8217;t<\/i> actually disavowed his landmark majority opinion in <a href=\"http:\/\/epic.org\/privacy\/voting\/crawford\/7cir_010407.pdf\"><i>Crawford v. Marion County Election Board<\/i><\/a> after all!<\/p>\n<p>The record will show, however, the Reagan-appointed judge may have a bit of a faulty &#8212; or, at least, selective &#8212; memory.<\/p>\n<p>The <i>Crawford<\/i> case is the now-infamous 2007 challenge to Indiana&#8217;s then new polling place Photo ID restriction law which Posner voted to uphold in a 2 to 1 decision. The law was subsequently upheld by the U.S. Supreme Court in 2008. It is the only high-profile case to uphold such laws as Constitutional, even though Justice John Paul Stevens, who wrote the controlling opinion at SCOTUS, <a href=\"http:\/\/online.wsj.com\/article_email\/SB10001424052702304384104579141701228734132-lMyQjAxMTAzMDEwNzExNDcyWj.html?dsk=y\">now believes<\/a> dissenting Justice David Souter &#8220;got the thing correct.&#8221;<\/p>\n<p>Despite <a href=\"https:\/\/bradblog.com\/?p=10303\">recent comments by Posner<\/a>, in both <a href=\"http:\/\/www.amazon.com\/gp\/product\/0674725085\/ref=as_li_qf_sp_asin_tl?ie=UTF8&#038;camp=1789&#038;creative=9325&#038;creativeASIN=0674725085&#038;linkCode=as2&#038;tag=tbb-20\">his new book<\/a> and at HuffPo Live, appearing fairly clearly to suggest he now believes he was wrong about his original decision in the case (which is often <a href=\"https:\/\/bradblog.com\/?p=10226\">incorrectly cited by Republican supporters<\/a> of such disenfranchising laws); and his expressed belief that the 7th Circuit Court of Appeals dissenter Judge Terrence Evans &#8220;was right&#8221;; <i>and<\/i> his assertion that such laws are &#8220;now widely regarded as a means of voter suppression rather than fraud prevention,&#8221; Posner now appears to be wobbling <i>back<\/i> again in his <i>latest<\/i> response to his own controversy&#8230;<\/p>\n<p><!--more--><\/p>\n<p>According to this week&#8217;s Richard Posner&#8230;<\/p>\n<div class=\"media\">I did not say that my decision, and the Supreme Court&#8217;s decision affirming it (written, be it noted, by the notably liberal Justice Stevens), were wrong, only that, in common with many other judges, I could not be confident that it was right, since I am one of the judges who doesn&#8217;t understand the electoral process sufficiently well to be able to gauge the consequences of decisions dealing with that process.<\/div>\n<p>Read <a href=\"http:\/\/www.newrepublic.com\/article\/115363\/richard-posner-i-did-not-recant-my-opinion-voter-id\">Posner&#8217;s full essay<\/a> for all of his latest nuance. Better read it quick before it changes again! <\/p>\n<p>His reverse reversal, such as it is, comes on the heels of smears from some on the right &#8212; as we noted Monday both <a href=\"https:\/\/bradblog.com\/?p=10329\">at The BRAD BLOG<\/a> and <a href=\"http:\/\/www.salon.com\/2013\/10\/28\/renowned_reagan_appointee_disavows_his_own_voter_id_ruling\/\">at Salon<\/a> &#8212; in response his initial disavowal of his original opinion in the case. It is that original opinion, of course, that is, for now, the law of the land.<\/p>\n<p><a href=\"http:\/\/blogs.wsj.com\/law\/2013\/10\/28\/judge-posner-i-never-said-my-opinion-was-wrong\/\">Jacob Gershman at <i>Wall Street Journal&#8217;s<\/i> Law Blog observes<\/a>, correctly, that this entire mess began in response to a line from Posner&#8217;s new book which reads: &#8220;I plead guilty to having written the majority opinion (affirmed by the Supreme Court) upholding Indiana&#8217;s requirement that prospective voters prove their identity with a photo ID&#8221;\u201da type of law now widely regarded as a means of voter suppression rather than of fraud prevention&#8221;.<\/p>\n<p>In turn, Gershman pulls then pulls the chair out from under the flip-flop-flippy jurist with his own words:<\/p>\n<div class=\"media\">The line didn&#8217;t get much attention until HuffPost Live&#8217;s Mike Sacks asked Judge Posner about it <a href=\"http:\/\/live.huffingtonpost.com\/r\/segment\/judge-richard-posner-live-interview\/524ced9502a76017d900006a\">in an interview that aired Oct. 11<\/a> (fast-forward to the 8:40 mark). The reporter read the passage to the judge and asked him if he and the court had gotten the case wrong. &#8220;Yes, absolutely,&#8221; Judge Posner replied. Judge Posner doesn&#8217;t mention the interview in his New Republic piece.<\/div>\n<p>So, <i>judge<\/i> for yourself. UC Irvine law professor Rick Hasen already has.
