That Would be Wrong!"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/BradBlog.com\/Images\/DoJ_Seal_Capitol_Texas_Perry.jpg\" hspace=\"6\" vspace=\"3\" border=\"0\" align=\"right\">From UC Irvine election law professor <a href=\"http:\/\/electionlawblog.org\/?p=54115&#038;utm_source=feedburner&#038;utm_medium=twitter&#038;utm_campaign=Feed%3A+electionlawblog%2FuqCP+%28Election+Law%29\">Rick Hasen&#8217;s blog last night<\/a>&#8230;<\/p>\n<div class=\"media\"><b>Only in America<\/b><\/p>\n<p><a href=\"http:\/\/electionlawblog.org\/sblog.s3.amazonaws.com\/wp-content\/uploads\/2013\/08\/Texas-reply-on-Sec.-3-of-VRA-8-5-13.pdf\">Texas defends itself<\/a> against claims it discriminated against minority voters by claiming it discriminated against Democrats (p. 19):<\/p>\n<blockquote><p><i>DOJ&#8217;s accusations of racial discrimination are baseless. In 2011, both houses of the Texas Legislature were controlled by large Republican majorities, and their redistricting decisions were designed to increase the Republican Party&#8217;s electoral prospects at the expense of the Democrats. It is perfectly constitutional for a Republican-controlled legislature to make partisan districting decisions, even if there are incidental effects on minority voters who support Democratic candidates.<\/i><\/p><\/blockquote>\n<\/div>\n<p>Lovely, Texas.<\/p>\n<p>Our own <a href=\"https:\/\/bradblog.com\/?p=10157\">Ernie Canning covered<\/a> the DoJ&#8217;s recent federal court filing seeking to require preclearance for all new election laws in Texas, given their recent history of racial discrimination in election-related laws. The move by DoJ comes on the heels of the <a href=\"https:\/\/bradblog.com\/?p=10094\">Supreme Court&#8217;s June decision in <i>Shelby County v. Holder<\/i><\/a> which otherwise tossed out the list of racially discriminating jurisdictions (Texas had been one of them) previously covered by the Voting Rights Act&#8217;s pre-clearance requirement.<\/p>\n<p><a href=\"http:\/\/www.scotusblog.com\/2013\/08\/texas-fights-new-voting-supervision\/\">Lyle Denniston at SCOTUSblog<\/a> offers a very good summary of both the case and Texas&#8217; response filed this week.<\/p>\n<p><a href=\"http:\/\/electionlawblog.org\/?p=54118&#038;utm_source=feedburner&#038;utm_medium=twitter&#038;utm_campaign=Feed%3A+electionlawblog%2FuqCP+%28Election+Law%29\">Hasen characterizes<\/a> the Texas response as an &#8220;overreach&#8221; in their attempt to hide behind the <i>Shelby County<\/i> decision.
