Yes, everything, even wildfires in California, are now political, as proven over the weekend when I tweeted out a non-political video I captured of a fire that broke out on a hillside in the San Fernando Valley, threatening the iconic Hollywood sign just on the other side of the hill. Callers ring in today --- as we were able to open the phones for the first time in weeks --- on a bunch of stories covered on today's BradCast.

Among those stories...

  • Trump loses yet again in court as a federal judge on Monday dismissed his lawsuit filed in D.C. hoping to, preemptively, prevent Congress from using New York state's newly adopted law which allows the U.S. House Ways and Means Committee to request copies of the tax returns of New York residents (read: Donald Trump's). It was just another loss in the long list of frivolous lawsuits brought by Trump to try and keep his tax returns from becoming public, for some reason;
  • Over the weekend Republicans submitted a list of requested witnesses for the upcoming public hearings in the Trump impeachment matter regarding his attempt to extort Ukraine by withholding military assistance in exchange for his demand that Ukraine announce an investigation into Joe Biden, his son Hunter and a conspiracy regarding Ukraine interference in the 2016 election. The House GOP's request list includes both Hunter Biden and the whistleblower who first brought the Ukraine matter to light. Rep. Adam Schiff, the Democratic Chair of the Intelligence Committee holding the public hearings this week responded by saying that he will not allow the proceedings to be used to promote the already-debunked theories that Trump was attempting to force Ukraine to spread in his unlawful effort to strong-arm the nation's new President into helping Trump on his 2020 reelection campaign;
  • We review some of the remarkable comments I received over the weekend after I tweeted a completely non-political news video of a wildfire in Burbank which broke out while I was there. Did you know they were caused by socialist homeless pedophiles? Who knew? Trump fans on Twitter do, apparently!;
  • And, speaking of both fires in CA and the 2020 elections, I share the response I recently received from the L.A. County Registrar-Recorder/County Clerk's office seeking comment about their contingency plans to deal with preemptive power outages should they occur during the general election next year at the same time as the ones California power companies imposed this year in hopes of not sparking wildfires during climate change-fueled hot, dry and windy conditions.

    Now that Los Angeles is moving to 100% unverifiable electronic touchscreen voting systems and electronic pollbooks, such an outage could prove disastrous for voters on Election Day and during early voting next year. Unfortunately, while the Registrar's office here replied to my queries on this (tune in to hear their response), they failed to reply to follow up questions;

  • All of this is decidedly NOT an academic issues, given the disasters that occurred last week during Off-Year municipal elections in George and Pennsylvania, where, for the first time, counties in those states deployed brand-new touchscreen voting systems akin to the ones that Los Angeles will be forcing voters to use at voting centers next year, rather than hand-marked paper ballots and paper pollbooks (neither of which require electricity or the Internet).

    The results were catastrophic in many PA and GA polling places with some voters unable to vote at all, many forced had to wait up to an hour during the sparsely attended off-year election, and computer-reported results showing some candidates receiving 0 votes at several precincts, even though they'd received thousands. And, yes, a power outage prevented voters from voting at one precinct. All of this serves as a chilling preview of what could well await the nation in 2020 during the most critical Presidential election in our nation's history.

Finally, we then open the phone lines, at long last, on all of the above. And our listeners have a LOT to say about it all, including a few who believe global warming is a hoax, and that the President should NOT be impeached for either extortion or obstruction of justice. On today's BradCast, in an historic vote, the U.S. House officially adopted formal rules and procures to govern the ongoing impeachment inquiry of Donald J. Trump. We also do a bit of helpful Impeachment 101 to explain how it works, and what we know historically about the process from the three prior Presidential impeachment proceedings against Andrew Johnson, Richard Nixon and Bill Clinton. [Audio link to program is posted below.]

Then, it's on to today's vote in the U.S. House, undercutting a limp Republican argument --- already undercut by a federal court last week which determined no such vote was actually required by the Constitution to proceed with impeachment --- a sharply divided House adopted a resolution [PDF] by a 232 to 196 vote, setting out official rules for how the inquiry will proceed. All present members of the GOP voted against the measure and all but two Democrats (conservative ones, from districts won by Trump in 2016) voted in favor. So did former Tea Party Republican turned Independent Rep. Justin Amash of Texas.

The resolution sets the ground rules for upcoming public hearings in the House Judiciary Committee with witnesses who have testified to members behind-closed-doors in recent weeks. The adopted procedures allow the President and his attorneys to participate and cross-examine witnesses in those hearings, as well as request subpoenas for their own witnesses and other evidence, as long as they do not obstruct the proceedings or continue to withhold evidence. The Democrats are targeting a timeline that could see a vote on Articles of Impeachment in the Judiciary Committee and then the full House by Christmas, unless it is further derailed by continuing White House obstruction.

We cover the historic floor arguments today in favor of the resolution offered by Democrats from House Speaker Nancy Pelosi to Intelligence Committee Chair Rep. Adam Schiff to several rank-and-file members, along with arguments against the resolution from members like House Minority Leader Kevin McCarthy and Minority Whip Steve Scalise.

Even as today's vote was carried out, both Democratic and Republican impeachment investigators from the Intelligence, Foreign Services and Oversight Committees continued taking depositions behind closed doors on Thursday, from witnesses testifying about Trump's quid pro quo pressure campaign against Ukraine, which is at the center of the current effort to consider official Articles of Impeachment against the President. Testifying in the House today was the top Russia expert on the White House's National Security Council, Tim Morrison, who was hand-picked by his immediate superior, the extremely right-wing then National Security Advisor John Bolton (who Democrats have also summoned to offer testimony in coming days.) Morrison reportedly corroborated accounts by other senior Administration officials that Trump did, in fact, personally push to withhold $391 million in Congressionally-allocated security assistance to Ukraine in exchange for a commitment from its new President to open an investigation into Joe Biden and a conspiracy theory that Ukraine (not Russia) attempted to manipulate the 2016 U.S. Presidential election.

AG Barr ordered to hand over grand jury transcripts, exhibits redacted from the Mueller Report to Congress by October 30

In her landmark, 75-page decision filed on Friday, U.S. District Court Judge Beryl A. Howell did much more than simply grant a motion filed by the House Judiciary Committee (HJC) to compel the U.S. Department of Justice (DOJ) to provide it with grand jury materials from Special Counsel Robert Mueller's probe that had been previously concealed. In that same order, the court systematically demolished every quasi-legal objection the DOJ and White House have raised in their specious efforts to interfere with an ongoing and lawful impeachment inquiry.

The core question raised by HJC's motion was whether the court should order the DOJ to release pertinent grand jury materials in accordance with Rule 6(e) of the Federal Rules of Criminal Procedure. Although grand jury testimony and exhibits are ordinarily kept secret, Rule 6(e) authorizes a court to order the disclosure of such materials "preliminarily to" or "in connection with a judicial proceeding" when there is a "particularized need" for disclosure.

Judge Howell suggested that a House impeachment inquiry, in and of itself, may be considered a "judicial proceeding". She concluded, however, that the court did not have to reach that issue because the HJC was correct in its assertion that its impeachment inquiry was "preliminary to" a judicial proceeding.

In her erudite decision, Howell cited historical practice, the Federalist Papers, the text of the Constitution, and both Supreme Court and binding DC Circuit Court of Appeals precedent. All of these make it abundantly clear: U.S. Senate impeachment trials are "judicial proceedings". Indeed, the DOJ's contrary position is not only at odds with the appellate decision in Haldeman v. Sirica (1974) but also with the DOJ's own legal position in that Watergate-era decision. The DOJ was unable to satisfactorily explain why, under Attorney General William P. Barr, it had changed its previous, long-standing legal position.

The "particularized need" to release the materials arises, in this instance, because Mueller, in deference to the opinions of the DOJ's Office of Legal Counsel (OLC) that a sitting President may not be indicted,* refrained from reaching conclusions about the legality or illegality of the President's conduct. "This," the court observed, "leaves the House as the only federal body that can act on allegations of presidential misconduct." Yet, the court observed, "under the DOJ's reading of Rule 6(e), the Executive Branch would be empowered to wall off any evidence of presidential misconduct from the House by placing that evidence before a grand jury."

The DOJ's contentions were, thus, not simply wrong but untenable. "In carrying out the weighty constitutional duty of determining whether impeachment of the President is warranted," Judge Howell observed at the outset of her opinion, "Congress need not redo the nearly two years of effort spent on the Special Counsel's investigation, nor risk being mislead by witnesses, who may have provided information to the grand jury and the Special Counsel that varies with what they tell HJC."

Had she stopped there, Judge Howell's ruling would be significant. Her demolition of every argument against the validity of the impeachment inquiry that has been presented by the DOJ, by the White House and by some Republican members of Congress, however, was nothing short of breathtaking...

In nearly seven hours of long-awaited, halting responses from the former Special Counsel, the need for impeachment became clearer than ever...

As documented by today's BradCast special coverage, former FBI Director Robert Mueller finally offered his long-awaited testimony in the U.S. House during nearly 7 hours of hearings before both the Judiciary and Intelligence Committees. [Audio link to show is posted below.]

The Republican former Special Counsel confirmed key details of his two-volume, 448-page report [PDF] on Russia's alleged interference in the 2016 election, the Trump Campaign's coordination with that effort and, in most detail, multiple instances of both indictable and impeachable criminal corruption of justice laid out by the report. In frequently halting and often terse responses to members of the two House panels, Mueller, as promised, refused to stray from the "four corners" of his report, issued earlier this year following his two-year probe.

Nonetheless, as heard on today's program, his responses made clear that both Donald Trump and Attorney General Bill Barr --- not to mention the bulk of the Republican Party and their rightwing media outlets --- have been completely misleading the American public with their claims that Mueller's report somehow "exonerated" the President. It did anything but.

"Did you actually totally exonerate the President?" Judiciary Chair Jerrold Nadler asked during his opening round of questions. "No," Mueller flatly replied, later adding that "the President was not exculpated for the acts that he alleged committed." When Rep. Adam Schiff, the Democratic Chair of the Intel Committee, asked, "Your investigation is not a witch hunt, is it?," Mueller dryly responded: "It is not a witch hunt."

In fact, as Mueller's testimony made clear to those who watched --- especially to those who didn't bother to read his actual report --- any other American who committed the crimes detailed in the Special Counsel's report would have been indicted on multiple felony counts, as more than 1,000 former federal prosecutors have now stated. But for the Dept. of Justice Office of Legal Counsel's (unsupportable) opinion that a sitting President cannot be indicted, Trump would most likely have been charged long ago for his repeated, unlawful attempts to quash the Special Counsel's investigation.

Moreover, near the close of today's long hearings, Mueller offered a chilling warning about what he describes as still-ongoing efforts by Russia and other foreign powers, "as we sit here", to interfere with and manipulate upcoming U.S. elections.

It may not be our most hilarious show of all time, but I think it's a very important one and includes more than a few righteous rants. [Audio link to full show is at end of article.]...

Among the stories covered on today's BradCast...

  • The New York Times finally figures out, almost a week later, that they may have been duped by Trump Attorney General William Barr's 4-page summary of Special Counsel Robert Mueller's long-awaited report, as the incurious "paper of record" confirms the full report from Mueller runs at least 300 pages. Nonetheless, Trump and his cult-member Republicans in Congress are running with the Times' original false and/or misleading assertions published the day after Barr's deceptive summary was released on Sunday. For example, the Times' top-of-page, ALL-CAPS screaming headline "MUELLER FINDS NO TRUMP-RUSSIA CONSPIRACY" and "A Cloud Over Trump's Presidency is Lifted".

    Of course, we still have no idea how many pages are in Mueller's confidential report delivered to Trump appointee Barr last Friday, or what it actually says about the two-year probe into alleged Russian interference in the 2016 election, the Trump Campaign's potential cooperation with them, or Trump's apparent attempts to obstruct the probe. But the summary compiled in less than 48 hours by Barr and then inaccurately reported by many to have somehow "exonerated" Trump, after being written by a man appointed to the job specifically because of his expressed opposition to the Special Counsel, should have been viewed much more skeptically by the Times and many others in the corporate media --- as we've been pointing out since Monday.
  • Among the fall-out from the Times' (and others') terrible and irresponsible coverage on all of this, GOP members of the House Intelligence Committee on Thursday demanded Rep. Adam Schiff (D-CA) step down as Chair and Trump is demanding his resignation from Congress. Schiff, however, is (appropriately) having none of it;
  • Speaking of not-particularly-funny behavior from Congressional Republicans, Majority Leader Mitch McConnell (R-KY) held a sham stunt vote earlier this week on the Green New Deal resolution [PDF] proposed by Sen. Ed Markey (D-MA) in the Senate and Rep. Alexandria Ocasio-Cortez (D-NY) in the House. Their landmark resolution calls for a wartime-like effort to move the U.S. economy from fossil fuels to zero-carbon energy over a decade, while creating millions of jobs in the clean energy sector and supporting those in legacy industries like coal mining to ensure new jobs and protection of their pensions from bankrupt, predator coal companies. During "debate" for McConnell's mock GND vote --- on an issue which would greatly help many coal mining constituents in Kentucky and Utah alike --- Sen. Mike Lee (R-UT) offered an embarrassingly unfunny speech that mocked the resolution, dismissed climate change as a concern, argued the Green New Deal is somehow "part of the problem" and that the real solution to deadly and ever-more costly global warming was "churches" and "babies";
  • Sen. Sheldon Whitehouse (D-RI) was not amused, as his own small coastal state directly faces a very serious threat posed from global-warming fueled rising sea levels which threaten to turn Rhode Island "into an archipelago" in coming years. "As a small state, we don't have a lot to give back to the ocean," Whitehouse rails on the Senate floor. "This is deadly serious for us."
  • But, if you think Whitehouse sounded angry, wait until you hear Ocasio-Cortez' response to the belittling of climate change concerns from Republicans in the House during an epic rant in the U.S. House Financial Services Committee, after Rep Sean Duffy (R-WI) mocked the GND as "an elitist fantasy";
  • Underscoring how NOT funny all of this is, a recent, heart-breaking special report from AP detailed how Trump, McConnell and the coal industry have conspired to allow a small tax on coal to expire, which, since the 1970s, has helped to cover the extraordinary healthcare expenses of miners suffering from deadly Black Lung Disease, as well as support for their widows. A new Black Lung epidemic has been striking younger and younger coal miners in recent years, and Republicans, including Trump, allowed the tax that funds the Black Lung Disability Trust Fund to expire during the Government shutdown at the beginning of the year.

    That, despite promises from McConnell (who represents the coal state of Kentucky) and from Trump (who has used miners endlessly as props during political rallies, while claiming to "love" them) to ensure the crucial Trust Fund doesn't go broke. Instead, both men have broken their promise and appear to be siding instead with the coal industry owners who have donated millions to them, and do not wish to see the life-saving and now-lapsed tax renewed. All of this, of course, on the same week that Trump reversed positions to support killing the Affordable Care Act entirely, while claiming "Republicans will soon be known as the party of health care";

Among the many stories worth your while covered on today's program...

  • Democratic House Speaker Nancy Pelosi seems to take impeachment "off the table", just as she did back in 2006 during the George W. Bush regime, asserting this time that, "Impeachment is so divisive to the country that unless there's something so compelling and overwhelming and bipartisan, I don't think we should go down that path, because it divides the country. And he's just not worth it." It was a mistake during the Bush era, and its a mistake now. Perhaps not a political one --- at least as she and many Democrats may see it --- but a mistake for the nation and its long term well-being. We discuss and explain why;
  • While he may (or may not) be safe from impeachment, Donald Trump's legal troubles are getting no better. New York state's recently elected Attorney General has now reportedly subpoenaed Duetsche Bank and other financial institutions related to a number of Trump projects where, according to recent testimony by his former personal lawyer Michael Cohen, Trump exaggerated his wealth on financial statements in order to fraudulently borrow money for real estate and other projects;
  • Speaking of subpoenas, federal investigators are now said to finally be investigating Republican election fraud in North Carolina, where a GOP absentee ballot fraud scheme resulted in the nullification of last November's U.S. House election --- and a new one now scheduled --- in the state's 9th Congressional District. The State Board of Elections had requested a federal probe following apparent GOP absentee fraud in the 2016 election, but Trump's U.S. Attorney in NC appears to have ignored the request, paving the way for the same fraud scheme to be repeated during 2018 cycle. McCrae Dowless, the contractor who carried out the fraud, as hired by GOP candidate Mark Harris, has already been indicted on state charges. But Harris, so far, has escaped accountability at both the state and federal levels. His campaign has now been subpoenaed by the feds. Stay tuned;
  • The Trump Administration evacuated the last of the remaining U.S. diplomats in Venezuela on Monday night, saying their presence in the country has become a "constraint" on U.S. policy there, whatever that may ominously mean. Top Trump officials have been threatening the administration of President Nicolas Maduro for several months since opposition leader Juan Guaido declared himself to be President of the nation in turmoil. Since late last week, power outages have crippled the country, with each side blaming the other and Maduro charging the U.S. has sabotaged the power grid with cyberattacks.

    But some excellent reporting by the New York Times over the weekend reveals, yet again, that many of the claims against Maduro being made by Trump Administration and supportive Republicans in Congress like Sen. Marco Rubio, are based on completely false information. On Sunday, the Times published a video report revealing that claims by Trump officials from National Security Advisor John Bolton to Sec. of State Mike Pompeo to Vice President Mike Pence and, yes, Rubio, charging that Maduro's forces set fire to aid trucks coming from Colombia are inaccurate. In fact, as the Times' unearthed video reveals, it was protesters in support of Guaido on the Colombian side of the border who caused the fires. This is just one more reason to be skeptical about Trump's intentions in the troubled South American nation (and media reports of same) as his own political fortunes worsen at home.

    And, in case you don't find Rubio wrong enough in his false claims about the aid trucks, just wait until you hear what the dumb cluck charged over the weekend regarding an explosion at the 'German Dam' in Bolivar State!;
  • Finally, Desi Doyen joins us for the latest Green News Report, with news on the oil, gas and mining lobbyist Trump has now officially nominated to head the U.S. Interior Dept; news on Wyoming Republicans bailing out their coal industry; how Bernie Sanders was right about climate change and the media as long ago as 1989; and this Friday's plans for school children in more than 90 countries to strike in demand of action on climate change, thanks to the inspiration of Swedish teen climate activist Greta Thunberg...

On today's BradCast: Baby, it's COLD outside in much of the Midwest and Northeast. Record cold, in fact, with wind chills dipping near an unfathomable 60 degrees below zero in some parts of the country, as discussed with --- and explained by --- our guest today. [Audio link to full show posted below.]

But, first up: Donald Trump's own top intelligence chiefs --- the FBI and CIA Directors as well as his Director of National Intelligence and others --- all directly contradicted the Commander-in-Chief on matters of foreign affairs this week, from the nuclear threat posed by North Korea, to the continuing threat from ISIS in Syria and Iraq, to the cybersecurity threat to elections posted by China and Russia, and to the lack of nuclear threat from Iran or at the U.S.-Mexico border.

Testifying before the U.S. Senate Intelligence Committee on Tuesday, the intel heads --- appointed by Trump himself (not so-called "Deep State Obama Democrats") --- expanded on their newly published annual "Worldwide Threat Assessment" [PDF]. As it turns out, neither the new report nor the officials themselves cite border concerns as any sort of danger to the nation, despite Trump's persistent and unsupported claims to the contrary and his threat to declare a "National Emergency" if he's not given $5.7 billion for his southern border wall before the Continuing Resolution for government funding runs out, once again, on February 15. Today, in response, Trump mocked his own intel staff as "naive".

The testimony from Trump's own intel chiefs is likely to be used against the President in court, should he declare that "emergency", according to U.S. House Intel Committee chair Adam Schiff (D-CA). But, as Democratic Committee member Rep. Jackie Speier (D-CA), points out, House Republicans have yet to actually appoint their members to either that Committee or three others (on Climate Change, Ethics or House Administration, which handles election challenges, such as the one in North Carolina's 9th Congressional District, where the House seat is still empty due to a GOP absentee ballot election fraud scandal.) Those committees may not proceed with virtually any business until House Republicans appoint their members and end the purposeful slow-walking.

After that warm up, it's on to the sub-freezing temps that have kept even the U.S. Post Office from completing their appointed rounds in a number of states. Of course, the big chill has led the Fox "News" clowns and climate change Denier-in-Chief to have a grand old time avoiding the actual scientific explanation for the bone-numbing depression in the Polar Vortex which, yes, is tied to global warming.

We're joined today by "Climate Guy" GUY WALTON, a 30-year Weather Channel veteran meteorologist, for some actual science on what's going on. Walton pens a daily "Extreme Temperature Diary" and is co-author, with Nick Walker, of the new (joyfully snarky) children's book and climate primer World of Thermo: Thermometer Rising.

Walton explains why and how global weather patterns have changed in recent years to bring bitter cold snaps like the one experienced this week in parts of the U.S., even as the rest of the globe --- like Australia, where temps have neared 120 degrees Fahrenheit and touched off record bush fires in recent days --- continues to suffer from record heat, thanks to anthropomorphic Global Warming. This "Age of Weather Extremes" is precisely in line with what climate scientists have long predicted.

"Right now, as far as global warming goes, we're having a lot of warmth from the sub-tropics moving northward over the polar areas, where, prior to, say, the 1970s, we hadn't been seeing that as much," he tells me. "What we had in the past, when we had Arctic outbreaks in the 70s and 80s, we had a larger, colder Polar Vortex encompassing the Northern Hemisphere. Now we have a warmer Polar Vortex which is not quite as large, and it's having a tendency to pinch off pieces...when they do pinch off, they're quite cold, and you can get cold air, colder than what you have right now at the North Pole, sitting right over say, Chicago or Detroit."

As to Trump's recent tweet making light of "Global Waming [sic]" amidst the Arctic blast, Walton argues: "A lot of this is out of greed, and to perhaps make more money through the fossil fuel industry. And to some extent, it's just denial, in that they know deep down the Titanic is sinking, they're just not wanting to admit that the ship's going to go under the water, so to speak."

Finally, some encouraging news today from the world of science, which we could have told you about (and, in fact, did!) years ago. A new "seminal study" finds that e-cigs or vaping is more than twice as likely to lead smokers to kick the habit than the use of Big Pharma-approved nicotine delivery systems such as patches and gums. While that may be bad news for Big Pharma's billion dollar nicotine industry, it's good news for the world which sees more than 6 million die annually thanks to tobacco, including nearly half a million alone here in the U.S. Now, if someone would just inform the Democrats in Congress and around the U.S. who are working to make it harder, not easier, for people to quit smoking and dying by moving to vaping, it would be VERY much appreciated...

On today's BradCast: The boondoggles continue --- from the Pentagon to the U.S. House and American elections --- as we can't look ahead to the new year without the continuing unresolved muck from this year. [Audio link to full show is posted below.]

When Democrats take the majority in the new Congress after the first of the year, one of their first orders of business will be determining who actually is allowed to be seated following the November 2018 midterm elections. There could be as many as three (and possibly more) seats challenged in the 116th Congress, thanks to the burgeoning GOP absentee ballot election fraud scandal in North Carolina, an admission by a newly-elected Florida Republican that he "may have" violated federal campaign finance laws, and a lengthy hand-count process in Maine's first-ever Ranked Choice Voting election for a U.S. House seat.

In NC's 9th Congressional District, Mark Harris --- the GOP candidate whose uncertified 905-vote "victory" is now being probed by state and federal officials after the emergence of evidence of absentee ballot fraud by a GOP contractor Harris hired in both the primary and general elections --- has said he'd agree to a new election, but only if evidence surfaces that the fraud in question would have changed the final results. That's a much higher bar than called for by state law, which allows the State Board of Election to take any necessary actions to "assure that an election is determined without taint of fraud or corruption."

In FL, Ross Spano, the Republican who is said to have won the race in the state's 15th Congressional District, now admits he received nearly $200,000 in personal loans for his campaign from two friends, in violation of the $2,700 per person federal contribution limit. One of those friends, despite having no official government role, is today reported to be helping to select Spano's Congressional hires. In both the NC and FL cases, it's not just Democrats crying foul. Tthe Republicans who were defeated in the primaries by Harris and Spano are also joining the public outcries.

In ME, a "recount" request by ousted Republican Rep. Bruce Poliquin in the 2nd Congressional District could result in a vacant seat for a while, as a hand-count of the complicated RCV counting process --- initially carried out after the election by a computer algorithm --- is a lengthy and onerous one that could stretch beyond January 3, when the new Congress is sworn in.

In non-election related news today, Donald Trump will reportedly call for an unprecedented $750 billion budget next year for the Pentagon after his previous increases to military spending. That, despite his description of Defense Department spending last week as "crazy" and previous vows to cut DoD's budget by 5 percent. The Administration's proposal for $750 billion is reported to be a "negotiating tactic" to ensure the $733 billion requested by the Pentagon, which is a far cry from the $700 billion Trump had called for previously and a substantial bump from the "crazy" $716 billion allocated for the current fiscal year.

We're joined today by investigative journalist DAVE LINDORFF to discuss the decades-long "accounting fraud" being carried out by the Pentagon, as detailed in his new exclusive exposé for The Nation. Citing whistleblowers, Inspector General's reports and a recent admission by the private accounting firm Ernst & Young that the Pentagon's books were so poorly documented that they simply cannot be audited, Lindorff explains how the DoD continues to seek --- and receive --- more tax-payer dollars year-after-year, even without needing or spending all they received in previous years. Rather than returning unpsent funds to the federal Treasury, DoD accounting gimmicks ("nippering" and "plugs") ensure endlessly increasing budgets and payments to Defense Contractors. The unchecked spending --- which amounts to trillions of dollars --- also helps to ensures that services Americans may actually need and want --- like healthcare, education and maintenance for infrastructure --- continue to be on the chopping block every fiscal year, even as Defense spending now accounts for 54 cents out of every federal tax-payer dollar collected.

"What the Pentagon does is they ask for more money than they need. They don't spend it all, and then they tuck away what isn't spent in ways that it won't be found --- violating the Constitution, by the way --- then that unspent money becomes a slush fund that's available to use however they want," Lindorff tells me.

"They've known about this stonewalling by the Pentagon for 26 years, which includes a lot of Democratic Congresses. Nobody has ever called them to the carpet on this," he charges. Despite Inspector General reports detailing the gimmicks and unaccounted for budget holes, "Nobody has been prosecuted for this. Nobody has been fired for this....If it's signed off on by the proper authority in the chain of command then it's 'supported' whether or not there's evidentiary material to back it."

Lindorff also argues that, with one recent exception, Democrats --- including progressives from Bernie Sanders to Beto O'Rourke --- have been largely silent on what he describes as a massive account fraud.

Finally today, Rep. Adam Schiff (D-CA), who will chair the U.S. House Intelligence Committee after Dems take over Congress next year, argued over the weekend that new filings from federal prosecutors on Friday suggest "There’s a very real prospect that on the day Donald Trump leaves office, the Justice Department may indict him" and "that he may be the first President in quite some time to face the real prospect of jail time." Schiff was referencing, among other things, details from a sentencing memo filed by federal prosecutors in New York on Friday charging that Trump "directed" a criminal conspiracy with his former attorney Michael Cohen to pay hush money to two women with whom Trump had affairs, in order to effect election results in violation of federal campaign finance laws...

On today's BradCast, the Super Bowl victory for the Philadelphia Eagles on Sunday was fantastic, but the victory for all of Pennsylvania (and, indeed, voters across the entire nation) on Monday was even better! [Audio link to show follows below.]

U.S. Supreme Court Justice Samuel Alito rejected Pennsylvania Republicans' request to block, overturn, deny, or delay the state Supreme Court's recent order to redraw all U.S. House districts in the key swing-state immediately and in time for the upcoming 2018 mid-term elections. The state's highest court found two weeks ago that the GOP-controlled state legislature had unlawfully gerrymandered the Keystone State's U.S. House maps following the 2010 census in such a way that the GOP ended up with 13 seats to the Democrats' 5, despite Democratic registration and voting far out-pacing Republicans statewide.

The PA GOP's request for SCOTUS to intercede in a state constitutional matter was denied on Monday. That is also very good news for the country, as discussed on today's show.

But the SCOTUS decision has yet to stop the state GOP from refusing to follow state court orders on the matter. Moreover, while the state GOP is demanding that its state Supremes overturn their own ruling, new reporting over the weekend reveals that a Republican state Supreme Court Justices who voted against the order to redraw U.S. House district maps, received several undisclosed donations --- including a huge one from the state Senate President Pro Tempore, as well as from two Republican U.S. House members effected by the ruling --- when she ran for a 10-year term last year. The donations were given to her after the challenge in the gerrymandering case had already been filed, yet her campaign now admits she failed to disclose those donations until they were revealed over the weekend.

Then, we move on to a number of late developments in the failing attempt by the chair of the U.S. House Intelligence Committee, Rep. Devin Nunes (R-CA), to undermine Special Counsel Robert Mueller's investigation of Team Trump, by using specious claims about the self-generated GOP House Intel Committee memo released on Friday. Both Nunes and Trump (and other Republicans) had claimed the memo supposedly reveals some sort of partisan bias in the FBI/DoJ and now Special Counsel probe. One GOPer even went so far as to claim the memo revealed "evidence of treason". (It doesn't. Not by a long shot.)

In fact, as we detail today, even statements by other Republican members on the same committee --- including Trey "Benghazi" Gowdy --- over the weekend, seriously undermine the claims made by Nunes and Trump himself over the weekend and again on Monday.

And, as we detailed at length on Friday's show, Nunes --- who now claims that former Trump Campaign advisor and suspected Russian intelligence asset Carter Page's rights were somehow violated by the procedure used by the FBI to obtain a warrant to eavesdrop on his communications --- showed no such concerns about the FISA law used to obtain that warrant when he voted in favor of extending it and expanding it for 6 more years just weeks ago. Trump also signed that extension.

Oh, and the Dow had its worse day since 2011 and largest all-time point drop today.

On today's BradCast, Here come more hurricanes, political and otherwise. [Audio link to show is posted below.]

Hurricane Maria, on a similar path to the devastating Hurricane Irma just over a week ago, has now strengthened to a deadly Category 4 before its projected landfall on many of the same Caribbean islands still reeling from Irma. But Maria is hardly the only storm swirling right now in the Atlantic and the Pacific (including Jose, Norma, Lee and Otis!).

Then, while Republicans and so-called "conservatives" last week pretended to be furious about the suggestion that Trump was working out an agreement with Democrats to protect some 800,000 kids of undocumented immigrants --- previously protected by DACA until Trump reversed it --- from deportation, in exchange for non-Border Wall border security, it turns out they're not all that angry after all. Evidence to support that argument --- along with the GOP's stated intention to balloon the national debt with massive new tax cuts and military spending --- underscores, yet again, that Republicans, like their President, have no real ideology, other than saying and doing what they believe is necessary to stay in power.

Yes, even anti-immigration zealot Rep. Steve King (R-IA) who claimed, after the deal between Dems and Trump was made public last week, that Trump's base was "blown up, destroyed, irreparable, and disillusioned beyond repair," said over the weekend that he was "gonna stick with President Trump".

Speaking of a lack of "convictions" (pun intended there), we're then joined by former Asst. U.S. Attorney RANDALL D. ELIASON, now a blogger and professor of law at George Washington University, to explain the ongoing corruption trial of sitting U.S. Senator Bob Menendez (D-NJ). Given the recent constraints the U.S. Supreme Court has placed on charges of bribery and public corruption by officials (see SCOTUS' dismissal last year of the guilty convictions against Republican Virginia Gov. Bob McDonnell and the limits on quid pro quo political bribery detailed by Citizens United and related rulings), can prosecutors successfully make charges stick against Menendez, who is charged with a number of felony counts relating to taking a huge amount of "gifts" from a physician friend, allegedly in exchange for "official acts" by the Senator.

"It's basically an exchange for these luxury trips, and jet trips, and pretty large political donations over the years, that Senator Menendez was working on these various things on Dr. Melgen's behalf," according to federal prosecutors, explains Eliason. "What the government has to prove is that there was a corrupt link between the two, that it was because of the gifts that the Senator was doing this."

Eliason, who headed up the Public Corruption/Government Fraud section at the U.S. Attorney's District of Columbia office for many years, walks us through the legal weeds of the case, which has received shockingly little attention in the corporate media, as storms --- both political and climatic --- have sucked up a lot of press attention in recent weeks.

And, though the investigation into Menendez was begun under Obama (on the heels of a completely fake news story, published by a Rightwing "news" outlet), are there any lessons we may take from this prosecution as it relates to potential charges being investigated against Team Trump? As it turns out, there are, as the always-insightful Eliason details today.

Finally, Trump's Homeland Security Advisor H.R. McMaster claimed over the weekend that Trump might be willing to rejoin the Paris Climate Agreement, but only if the there were better terms for the U.S. Our own Desi Doyen has a thought or two in response to that claim...

In August of 1822, James Madison, one of this nation's Founding Fathers, famously argued: "Knowledge will forever govern ignorance: And a people who mean to be their own Governors, must arm themselves with the power which knowledge gives."

On the other hand, on January 6, 2017, a joint Intelligence Community Report ("IC Report"), entitled "Assessing Russian Activities and Intentions in Recent US Elections" explained: "The Intelligence Community rarely can publicly reveal the full extent of its knowledge or the precise bases for its assessments, as the release of such information would reveal sensitive sources or methods and imperil the ability to collect critical foreign intelligence in the future."

There is a core conflict seen in those two quotes. What we see proclaimed in the IC Report is a direct collision between self-proclaimed national security interests and the public's right to know.

There is no question that Congress has both the Constitutional right and obligation to investigate "Russia-gate". It does so in accordance with its exceedingly broad powers of oversight that include the ability to "provide new statutory controls over the executive," executive accountability and to exercise its exclusive power of impeachment.

It is really not controversial to suggest, as did The Chicago Tribune, Sen. John McCain (R-AZ), and Adam Schiff (D-CA), that Congressional hearings be conducted either by an independent or select committee. But even if a reasonable level of investigative objectivity and integrity is achieved, the thorny question remains as to the extent to which such hearings, and testimony from witnesses, should be carried out in public.

It is a difficult issue that pits the public's right to know against (a) avoiding disclosure of classified information, and (b) compromising the ability of federal prosecutors to secure criminal convictions in their own parallel investigations...

Guest: Marcy Wheeler on the public testimony from FBI, NSA chiefs in the U.S. House Intel Committee, and the many still-unanswered questions...

On today's BradCast, FBI Director James Comey and NSA chief Mike Rogers testified for more than five hours today before the U.S. House Intelligence Committee, confirming the existence of an FBI counterintelligence probe into alleged Russian interference in the 2016 U.S. Presidential election, and batting down charges by President Trump that then-President Obama wiretapped Trump Tower before leaving office. We're joined by national security journalist Marcy Wheeler of Emptywheel.com for analysis of today's long-awaited public hearing, with a focus on the many still-unanswered questions surrounding the charges of collusion between Trump and Russia and of the leaked classified information documenting a phone conversation between Trump's National Security Advisor Mike Flynn and the Russian ambassador to the U.S. Why was Flynn's part of the conversation captured and transcribed by the Intel Community in the first place, before the content of that discussion, concerning sanctions against the former Soviet Union, was leaked to media? Why wasn't Flynn's side of the discussion "masked" or "minimized", as many Americans believe is the case when it comes to the capture of information from U.S. persons during foreign counterintelligence investigations?

"Since 2008," she explains, "it's been permissible for the FBI, in whatever intercepts they get directly, to be able to go back in and look up stuff without distinction of whether the somebody is a US person or a foreigner. This is why the Republicans are so buggy about this."

"What many people are discovering, for the first time, is that the FBI can do backdoor searches. It means they do not need a warrant...where some analyst in the FBI or the NSA has decided someone is of foreign intelligence interest. The FBI doesn't need a warrant for that at all. They access that stuff without any criminal evidence against Americans. If they get a tip on you, they can look you up by your name, just on that tip alone."

Wheeler goes on to detail the legal statutes on that, the lack of public evidence concerning the alleged "cutout" between stolen DNC emails and WikiLeaks, why it took so long for Comey to inform Congress about his investigation at all (he said it's been under way since last July), questions about whether Trump and others in his Administration are susceptible to compromise by foreign agents, and whether or not she has confidence in the Congressional and FBI investigations into all of these matters.

Also today: Trump's approval rating hits a new low, and a federal appellate court protects a Constitutional right in Mississippi by blocking another GOP attempt to close the state's last remaining abortion clinic...
