More than 600,000 lawfully registered voters will be disenfranchised during 2015-2016 elections unless the 5th Circuit Court promptly acts...

Early last month, a three-judge, U.S. 5th Circuit Court of Appeal panel affirmed the lower District Court's finding that Texas' draconian polling place Photo ID restriction (SB14), which threatens to disenfranchise 608,470 legally registered voters (and many others not already registered), violates federal law.

That ruling marked the third occasion in which a federal court has expressly found that the TX Republicans' strict ID law disparately impacted minorities and the poor. "Hispanic registered voters and Black registered voters," the 5th Circuit appellate panel observed in their recent ruling, "were respectively 195% and 305% more likely than their Anglo peers to lack [the requisite Photo] ID" now required to cast a vote at the polls under SB 14.

While the ruling ostensibly struck down SB14, finding it in violation of Section 2 of the Voting Rights Act (VRA), as we have previously explained, those 600k+ lawfully registered voters remain at risk of disenfranchisement during this Fall's 2015 elections and the 2016 Presidential cycle because the appellate panel failed to lift an "emergency" stay of the District Court's original permanent injunction intended to prevent enforcement of an unlawful Photo ID statute.

The failure of the appellate court to lift the stay on the lower court's no-uncertain-terms ruling may not have been problematic if, as contemplated by the 5th Circuit decision's mandate, the case were to be promptly returned to the District Court, which it directed to re-examine a separate issue --- whether the TX Legislature had a "discriminatory purpose" when it enacted SB14. That prompt remand would have permitted the District Court to fashion an interim remedy. Indeed, in its decision, the appellate panel suggested that the District Court issue an order directing TX to accept valid voter registration cards, in lieu of a very narrow handful of state-approved Photo ID, for all voting-related purposes. The 5th Circuit panel also, perhaps somewhat naively, called upon TX to cooperate in the prompt fashioning of that remedy.

Oh, that silly 5th Circuit panel...

Six-term Republican Congressman Bob Inglis (SC) was my guest on today's BradCast, fresh off of being honored with the John F. Kennedy Foundation's Profile in Courage award earlier this week.

After 12 years in the U.S. House, the very conservative Rep. Inglis was primaried out in 2010 by the Tea Party after he dared change his position from being a climate change denier to wanting to take action after consultation with scientists and even his own children.

Inglis has since founded the Energy and Enterprise Initiative at George Mason University, "guided by the conservative principles of free enterprise and economic growth, limited government, liberty, accountability and reasonable risk avoidance to solve our nation's energy and climate challenges."

We discussed whether he has any regrets about how things worked out in Congress; about his appearance in the new documentary Merchants of Doubt, which exposes how the denial industry works (and how the same sleaze merchants who denied the harm of cigarette smoke in previous decades on behalf of Big Tobacco are now using the very same tactics today. Watch the trailer.); why Republicans have become science deniers and whether he is optimistic that will change any time soon; and his plan for a revenue-neutral carbon tax to fight global warming by both reducing emissions and correcting what he (accurately) describes as the "market distortion" that allows polluters to socialize the cost of pollution and, essentially, pollute for free.

"One of the key philosophical underpinnings of conservative thought is that humans are responsible moral actors," Inglis told me. Yet, he says, the fossil fuel industry is being allowed to get away without taking responsibility for the damage they are causing to both people and the planet. "That's where we are on climate. We're allowing people to socialize their soot and they will get away with it as long as we let them get away without accountability." He says that was is currently lacking is "accountable transparent marketplaces."

"If we could get through the denial and get to the debate," it would be a good thing, explains Inglis, who describes global warming as a "crucial issue, vital to the future of our children and grandchildren" as he offers a surprisingly optimistic outlook for the future. How optimistic? He even believes some non-denier Republicans may enter the 2016 Presidential primary race! I'm dubious --- but we'll see. It was a fascinating conversation.

City official dismisses reports as 'least effective conspiracy in history'...

At In These Times, author and journalist Rick Perlstein covers reports from some Chicago voters claiming that they received paper ballots today that were pre-marked for Mayor Rahm Emanuel (D) in his runoff election against the more progressive Cook County Commissioner Jesus "Chuy" Garcia (D):

Around 10:30 this morning, Sam Dreessen, a 26-year-old unemployed DePaul University graduate (and former In These Times intern) who's been voting in Chicago since 2006, walked into his polling place at Kozminski Community Academy on 54th and Drexel, a mostly black neighborhood in the city's 5th Ward. He approached the election judge at the table and, like thousands of Chicagoans on this mayoral election day, received a paper ballot and a felt-tip pen. But, he says, one of the two blanks-the one you fill in to vote for Mayor Rahm Emanuel-was already filled in. Dreessen, a volunteer for Emanuel's opponent, Jesus "Chuy" Garcia, smelled a rat.

"I just said to one of them, the one who gave me the ballot, 'This has already been filled out. I want one that's blank.' And he acted surprised. He said, 'I don't know how that happened.' And he even said there had been other ballots with similar problems.' He gave me one that was blank, and I told him more than once that they should look at all the ballots, the ones that hadn't been handed out yet, to see if this happened."

Dreessen says he was too shocked to even take a picture. "And I thought, 'I don't know, this must be happening to other people.' It just seemed to be so crude."

Perlstein details a few other similar reported incidents of pre-marked ballots from around the city in the election which the local CBS affiliate is now calling for Emanuel. The Chicago Board of Elections website currently shows Emanuel leading Garcia 56% to 44% with over 79% of precincts reporting at this moment.

The website DNAInfo, however, dismisses the reports as "Facebook rumors", bluntly describing them as "false", based largely on a response from a Board of Elections official...

'Major security hole' could allow attacker to read, change votes...

Another new Internet Voting system, another major vulnerability to massive election fraud discovered along with it. This time in Australia, as reported by ABC:

A "major security hole" that could allow an attacker to read or change someone's vote has been discovered in the New South Wales online iVote platform, security experts say.

The iVote system allows people to lodge their votes for Saturday's state election online, instead of visiting a physical polling station.

It aims to make voting easier for the disabled or for people who live long distances from polling booths.

However computer security researchers said they found a critical issue and alerted the NSW Electoral Commission on Friday afternoon.

The commission said the problem was fixed over the weekend and it expected 200,000 people would use the system in the lead up to the election.

Well. If the people who run it said it was fixed, why worry? (Just because they also said it was secure in the first place? Silly you.)

"Just because they've patched this particular bug that they've been specifically notified of does not mean that they've fixed the fundamental questions around the security and verifiability of the system," said University of Melbourne's Vanessa Teague, who discovered the security vulnerability. "If anything the existence of this one particular bug serves to bolster the argument that these kinds of bugs are probably inevitable in these kinds of systems"...

I am prepping for today's KPFK/Pacifica Radio BradCast, so don't have time to offer much detail at the moment. But, as so many have been dropping me email asking for my thoughts on yesterday's election in Israel --- and, specifically, the disparity between the reported final results and the earlier Exit Polling numbers --- I just wanted to say, I've been poking around to see what, if anything, I can make sense of.

I never like to go off half-cocked on issues like this, so, as usual, I won't have anything here unless it's hard and independently verifiable.

For the short term then, please see Josh Marshall's take on the Exit Poll/Final Results disparity here. (That's not an endorsement, just a link to one person's take. One person who, though he has some history of being not-skeptical-enough about polling numbers and election results, has been following this election and its polls very closely for some weeks. Moreover, he had at least some limited access to data from the Exit Polls in Israel as they were coming in yesterday. So his insight is useful.)

Also, for those asking about about Israel's voting system --- specifically, how they cast and count votes and whether they use an e-voting system --- my understanding is that all voters are still using the country's hand-counted paper ballot system, though some plans are in the works to move to an electronic system in the near future.

To my knowledge, however, yesterday's election used Israel's paper ballot system --- in which a paper card representing one of the parties on the ballot is selected by the voter, enclosed in an envelope, placed in a cardboard box, and then counted by hand at central headquarters after polls close --- rather than the e-voting system referenced in the news article above from December of 2014.

Court's decision on whether to hear a challenge to the Wisconsin GOP's 'unconstitutional' voting restriction is a moment of truth for democracy...

As we find ourselves smack dab on the 50th anniversary of the Bloody Sunday march for voting rights in Selma, Alabama, there are some key decisions from the U.S. Supreme Court, coming very soon, which may well determine whether millions of otherwise lawfully registered and disproportionately Democratic-leaning African-American and Hispanic voters will be prevented from voting in the 2016 elections.

The decision that emerges from the Supreme Court's March 20, 2015 Conference in the Wisconsin polling place photo ID case, Frank v. Walker, could well be dispositive in that regard. It also may be the last chance to avoid the legal chaos that plagued the 2014 elections, during which similar voting restrictions, in state-after-state, were implemented, struck down, restored, or, with respect to Wisconsin, blocked again. Where, last year, the Court's eleventh hour decisions preserved the right to vote in Wisconsin, that same Supreme Court, on the eve of the 2014 mid-term, eliminated the right to vote for hundreds of thousands of predominantly African-American and Hispanic voters in Texas and North Carolina. The failure of the Supreme Court to take up the issue now could produce an even darker cloud of doubt over the integrity and legitimacy of the 2016 Presidential Election.

The immediate issue now before the Court is not whether SCOTUS agrees with a U.S. District Court judge and half the judges on the 7th Circuit Court of Appeal that WI's law (aka Act 23) is both unconstitutional and violative of Section 2 of the Voting Rights Act. As those judge found, Act 23, if implemented in the Badger State, could disenfranchise more than 300,000 lawfully registered Wisconsin voters.

Rather, the immediate issue at the March 20 Conference is whether the Supremes will grant an ACLU petition for a writ of certiorari (aka "cert petition") and schedule oral arguments on the Constitutionality of the Republican-enacted law. Or whether, as urged by the attorneys representing WI's Republican Governor Scott Walker, the Court will defer its decision until similar legal challenges to strict photo ID laws in other states, such as North Carolina and Texas, wind their way through the trial and appellate courts.

In other words, do they hear the Wisconsin case now, as urged by the ACLU and other voting rights advocates? Or do they wait to combine the matter with several other challenges to substantively identical voting restrictions implemented by Republicans in other states, as urged by one of the men who stands to benefit from delaying such a decision as long as possible?

That decision whether to hear the case now, rather than later, may well have a huge impact on who will serve as the next President of the United States...

Statute's vague language concerns some election watchdogs...

When California state Sen. Lou Correa (D) authored SB 29 last year, allowing Vote-by-Mail (VBM) ballots to be accepted and counted even if they arrive at county election headquarters up to three days after Election Day, some state Election Integrity advocates were concerned.

Somewhat vague language in part of the bill might allow for a case where, in the event of a very close margin announced on Election Night, unvoted absentee ballots could be quickly filled out after the fact and delivered to election officials inside the new three day post-election window.

If a race was close enough, late arriving ballots --- either legitimately voted on or before Election Day, or, depending on how local election officials choose to interpret the statute, illegitimately voted and delivered after Election Day --- could actually reverse the results of such a contest.

Little could Correa have known, however, as he was successfully moving his bill through the California state legislature last year, to take effect in January 2015, that the very first election of the year --- and the very first to be decided by a small enough margin that it could be directly affected by late ballots now allowed under SB 29 --- would be...Lou Correa's...
