On today's BradCast: What you need to know about the stolen national security documents retrieved by the FBI at Mar-a-Lago and the trouble Trump is in. And, about the known results of the strange-world-we-now-live-in primaries and special elections yesterday. [Audio link to full show is posted below this summary.]

First up, those elections, as based on incomplete and/or unverified results in both states.

The biggest story of last night, of course, was conservative Republican Rep. Liz Cheney's loss to a Trump-backed GOP primary challenger in Wyoming for the state's single, at-large House seat. As expected, Cheney lost bigly to former Never Trumper turned MAGA 2020 election denier Harriet Hageman. What does it all mean going forward for Republicans who wrongly hate Cheney and Democrats who wrongly love her and for the Republican Party itself? Cheney offered some hints, as we discuss, in her graceful concession speech on Tuesday night, promising once again that she "will do whatever it takes to ensure that Donald Trump is never again anywhere near the Oval Office."

Then, incomplete results from Alaska, where it has always taken a long time to tally them and will take even longer following election reform adopted by state voters in 2020. They now have an open primary system, where the top four vote-getters go on to general elections which become Ranked Choice Voting (RCV) contests among those candidates.

Like Wyoming, Alaska has just one at-large U.S. House district. But there were two elections for it on Tuesday following the death, earlier this year, of Republican Rep. Don Young. He held the seat for 49 years. One was a Special Election to fill the remainder of Young's term through the end of the year, the other was an open primary for a full term beginning in January.

On the Special, Democratic candidate Mary Peltola currently leads Republicans Sarah Palin (yes, that Sarah Palin) and Nick Begich with about 70% of votes tallied as of airtime. However, because it's an RCV election --- in which none of the candidates received more than 50% of first choice votes --- once the first round of counting is complete, the candidate in last place will be removed and their voters' second place choices will be redistributed to the other two candidates. The entire race is then tallied again. We are unlikely to know the final winner until the end of August, but if Peltola wins, she'd be the first Alaskan native to be elected to Congress.

In the open primary for the full House term beginning next year --- featuring nearly 30 candidates --- it appears that all three of the candidates in the Special will also advance to November's general election. The fourth candidate in that contest has yet to be determined as counting continues. In the state's U.S. Senate race, Republican Lisa Murkowski --- who, like Liz Cheney, voted against Trump in his second impeachment --- will advance to the November general, where she will face Trump-backed Kelly Tshibaka and two other candidates still to be determined, with just over 70% tallied.

Then, longtime, really smart, independent national security journalist MARCY WHEELER of Emptywheel returns to the show for the first time since the FBI's seizure of highly sensitive and classified national security documents at Mar-a-Lago last week, as stolen from the White House by Donald Trump upon leaving office last year.

As usual, we have a lot to cover with Wheeler, who was busy explaining on Twitter last week before anyone else that we know of --- before the unsealing of the FBI's search warrant detailing "probable cause" of three federal statutes violated by Trump --- that the Dept. of Justice was almost certainly investigating the former President for violations of the Espionage Act. As usual, after the warrant was unsealed, she was proven correct.

Also as usual when Marcy's on, you'll need to tune in for the full story. There is simply no way I can detail all of the critical insight and helpful information she has to offer here. But, among the points she helps clarify and explain along with key context from her years of covering similar cases dealing with the Espionage Act, obstruction of justice and the theft of government documents...

• What each of the three U.S. Criminal Code statutes cited in the warrant means, and the evidence that Trump appears to have blatantly violated each of them.
• Were there, or were there not, documents including nuclear records found and/or sought in the search, as reported by Washington Post before the warrant and inventory list of retrieved items was unsealed.
• Are documents sought by the National Archives and DoJ still missing after the search? And/or have they been mutilated or destroyed in violation of federal statutes?
• Despite a signed declaration by one of Trump's attorneys that all of the highly classified documents and other material stolen from the White House had been returned to the government as of June, in fact, that was proven untrue. Who is the insider that tipped off the DoJ?

Wheeler argues that Trump is likely far more concerned about obstruction charges than even violations of the Espionage Act. Why? "We know that some of the documents that were responsive to subpoenas regarded January 6," she tells me, before suggesting reason to believe that some of the documents Trump was trying to withhold might be related to other crimes of his from farther in the past, such as: obstruction of justice in the Robert Mueller/Russia investigation; his attempt to bribe the Ukrainian President ("We know that the White House counsel didn't provide Congress the fullest version of the 'Perfect Transcript' of the Trump call with Volodymyr Zelenskyy. So that's an example of concealing a document that should have been released."); or the transcript regarding the classified Israeli intelligence that Trump gave to the Russian ambassador during an Oval Office meeting ("the documents got altered and disappeared.")

She has much more, including this fresh tidbit regarding obstruction: "There was a leak by one of the rightwing journalists [covering this story] that said, 'People close to Donald say he doesn't have to give [certain documents] over because the Archives will just give it to the January 6 Committee.' I'm like, 'That's a confession of obstruction! He just literally confessed to the elements of the offense for obstruction!' And honestly, Brad, this is something that virtually everyone is missing --- this is the one that Trump is terrified of."

There are many details we still don't not know and more disturbing revelations to come. As Wheeler notes several times, this all likely to get much much worse for Trump. But, she emphasizes, just based on what we already know it's already really really bad for him.

"Every half hour or so," she says, "this flash goes through my brain, and I go, 'Oh my God, Donnie has really, really screwed himself .' There are ways that I can imagine this snowballing that people aren't even grasping at this point. And that is all separate from the question of whether he's taken the nuclear codes and given it to [Saudi Crown Prince] Mohammed bin Salman. You don't really need to get ahead of the game here to figure out things are pretty bad."

Among the stories covered on today's BradCast...

• The stock market soars on the barest of evidence that a vaccine could be on the way. Eventually. But irrational exuberance is...well...irrational;

• Trump fired the State Department Inspector General on Friday night. It was the fourth independent executive agency watchdog that Trump has axed over the past six weeks as he continues to dismantle all governmental oversight of the Executive Branch and what is virtually the last firewall against corruption by the most corrupt Administration in the history of the nation. In this case, the firing seems to have been carried out unlawfully by the President at the request of Sec. of State Mike Pompeo who is under investigation by the IG for forcing agency personnel to run personal errands for him and his wife, as well as for his part in funneling some $8 billion in arms sales to Saudi Arabia under the guise of Trump's phony "Emergency Declaration". The sales are in contradiction to a bipartisan vote by Congress last year, specifically denying the appropriation;

• Former Republican Rep. Justin Amash of Michigan decided over the weekend that he will not run for President on the Libertarian Party ticket after all;

• In Missouri, under pressure from an ACLU lawsuit, the GOP-dominated state legislature passed a law on Friday allowing all registered voters to vote with an absentee ballot if they so choose. That's good. However, those who are not either ill or at "high risk of serious complications from COVID-19" must still have their ballot verified by a Notary Public before it may be sent or counted. So, yeah, voters will still be forced to put themselves at risk in order to vote in the Show-Me state this November;

• Meanwhile, just before air today, California Governor Gavin Newsom announced the relaxation of certain criteria for counties to reopen businesses across the state;

• And in Long Island, New York, anti-lockdown protesters threatened a journalist reporting on their protests by running at him without masks on. "No," one of the jackasses is seen saying as he charges the reporter, "I got hydroxychloroquine! I'm fine!";

• We then open the phones to listeners to ring in on all of the above as well as on an interesting question the BBC posed to its audience over the weekend: "If you could go back to the start of the year and give yourself some pre-lockdown advice, knowing what was about to happen, what advice would that be?". Six more states are voting today (Michigan, Washington, Missouri, Mississippi, Idaho, North Dakota). We'll have results tomorrow, as we're still trying to figure out who actually won and lost, in some cases, last week on Super Tuesday, particularly in Texas and California. Nonetheless, today, like last week, has already revealed more problems with electronic pollbooks that resulted in voters leaving without voting, and there is more likely trouble on the horizon in several states set to vote in the next several weeks. Among the stories covered on today's BradCast...

• A fire at Venezuela's National Electoral Council warehouse over the weekend has resulted in the destruction of 50,000 touchscreen voting machines and 582 computers. We swear we didn't do it! The unverifiable voting machines in question have been used during questionable past elections and are made by Venezuelan-based Smartmatic...the same company with a dodgy background of failed elections who also made the new touchscreen voting systems which failed so disastrously in Los Angeles County on Super Tuesday last week. But, again, we didn't do it!;

• Closer to home, voters today in St. Louis County --- Missouri's most populous --- were turned away from the polls for an hour or so this morning from at least 50 of the county's 400 polling places. Though St. Louis has finally moved to hand-marked paper ballots, they are using a print-on-demand system that uses electronic pollbooks (yes, more computers) to instruct the printers which ballot should be printed. Those e-pollbooks, apparently, were failing this morning until the company that makes them issued an update. In the meantime, there is also a manual print mode that pollworkers could have used to print ballots for voters when the e-pollbooks weren't working, but many appear to have not known that or just panicked and forgot. Also, in MO, Kansas City's African-American Mayor was turned away from the polls after his name was not found on the voting rolls. Later in the day, they figured out why;

• Both Bernie Sanders and Joe Biden cancelled campaign rallies set for Ohio today (where early voting has already begun for next week's primaries in the Buckeye State), due to coronavirus concerns, in what may foreshadow still more trouble for this year's elections, including how to include enough hand-sanitizer for polling places, especially those which use touchscreens. (People can usually bring their own pens to polling places that use hand-marked paper ballots.) We may end up seeing Vote-by-Mail elections for the entire country this November if the virus continues to spread, despite the steady leadership of stable genius Donald Trump;

• Some good news for voters (finally!) out of Georgia today, as the state has reached a settlement with the Democratic party in federal court that requires voters be immediately notified about absentee ballots that are rejected by county officials due to perceived signature mismatch or some other infirmity, allowing them time to come in and cure the problem so their votes may still be counted;

• But there is also less good news out of Georgia, where last week's "good news story out of Georgia" was the fact that Athens-Clarke County's Board of Elections had voted to ditch the new, state-mandated unverifiable touchscreen voting systems for hand-marked paper ballots instead. The Board found that the touchscreens on the new Dominion ImageCast ballot marking devices (BMDs) were so large and bright that they violate voters constitutionally-mandated right to a secret ballot, as others could see how they were voting from 30 feet across the room, according to a related lawsuit filed in a separate GA county. But now, GA's Republican Secretary of State Brad Raffensperger has called an emergency hearing in Athens, charging that the County's Board is violating state law by not using the new, unverifiable voting systems. Now why would he want do that?;

• Meanwhile, in Texas, ballot scans stored on 44 thumb-drives from the new Ballot Marking Device systems used for the first time during last week's Super Tuesday primaries in Dallas County apparently were not included in previously reported results. As many as 7,000 ballots could be missing from the current results. The County's Election Director was required to get permission from a court to "recount" the computer-marked ballots scanned in the county to include those previously left out of the count. A Dallas court, on Tuesday, gave permission to do so, but the order is limited to a computer-scan of the computer-marked paper ballots that were previously not included in last week's results;

• Finally, Desi Doyen joins us for our latest Green News Report, with news on the coronavirus and an oil price war, both affecting the stock market (and banks and fossil fuel-reliant communities) this week, a new troubling report on air pollution caused by fossil fuels, and some good news as New York state's disposable plastic bag ban finally kicks in...

Her press conference this week gives a sentence-by-sentence master class in piercing your opponent with a smile, undermining his bombast with grace, and evincing humility while kicking him where it hurts. I walk you through her best-landed blows in today's show.

Then I go over Trump's court losses this week, the specter of impeachment, and even the possibility of Trump pardoning himself with DAVID LEVINE of UC Hastings Law. Spoiler about the self-pardon: no one knows how that would play out, because it's never happened before.

Putting this week's slam on Harriet Tubman into perspective is ELIZABETH COBBS of Stanford. Bottom line: she was a better person and patriot than he could ever pretend to be.

On today's BradCast, as the nation awaits Trump Attorney General William Barr's release of some redacted version or another of Special Counsel Robert Mueller's report on Thursday morning, Barr was busy announcing new immigration policies to add to the Administration's ongoing success in creating havoc and a humanitarian crisis on our southern border. [Audio link to show is posted below.]

But first today, a few other news items of note and another reminder of how neither the media nor the Democrats in Congress are prepared to adequately respond to the "creeping authoritarianism", as media analyst Eric Boehlert too-generously describes it, that has turned outrageous, impeachable actions by a sitting President into little more than another "wacky Trump story of the day" over the past two years of his chaotic and criminal Presidency.

On Tuesday night, the war-mongering Trump vetoed a bicameral, bipartisan War Powers Resolution adopted by Congress --- for the first time since the 1973 War Powers Act largely delegated Congress' Constitutional war-making power to the White House --- demanding an end to U.S. military aid for Saudi Arabia's war against Yemen, where thousands of civilians have been killed and millions are facing famine. That, despite the murder last year of Washington Post's Saudi journalist and U.S. resident Jamal Khashoggi at the alleged command of Saudi crown prince and Trump ally Mohammad bin Salman.

Meanwhile, as federal prosecutors seek up to 10 months in prison for actress Felicity Huffman in the college admissions scandal after her recent guilty plea (please note my "Full Disclosure" during the program regarding my personal history with Huffman and her husband William H. Macy), the actions taken by Trump last week alone, as highlighted by Boehlert, are a veritable litany of impeachable offenses.

Nonetheless, while the actress may face jail time for a foolish and illegal offense on behalf of her daughter, our lawless President runs free --- and few, if any, in the media or Congress appear capable of taking on his Constitution-endangering lawlessness with the gravity warranted. Even several of the outspoken progressive freshman Democrats in the House, while supporting calls for impeachment in general, appear to be pulling punches in deference to fearful party leadership. As I argue today (yet again), there is more than enough --- even without whatever findings may come from Mueller --- to, as columnist Dan Savage has long argued, "ITMFA".

Next, we're joined by immigration attorney SARAH PIERCE, Policy Analyst at the Migration Policy Institute to discuss Barr's newly-announced immigration policy changes revealed Tuesday evening. The new measures would bar asylum seekers who have already demonstrated a "credible fear" of return to their home countries to immigration officials from being allowed to seek bond for release until their asylum case can be heard. The process would, she explains, keep such individual in detention for months and even years, despite an already-existing lack of space in ICE detention facilities which has led to their current so-called "catch and release" policies.

The new measures, Pierce explains, would not apply to families seeking asylum or children traveling alone (even as thousands of asylum seeking children remain separated from their parents in the wake of Trump's previous AG Jeff Sessions' so-called "zero tolerance" policies.)

Pierce details what Barr's new policy measures will and won't do; why Barr has the authority to enact them; how they differ from Executive Actions undertaken by the Obama Administration (which Republicans used to object to as "unconstitutional unilateral actions"); why the new policy is likely to be challenged in federal court; how almost all of Trump's border policies are exacerbating the very problems he claims to want to solve; and why he continues to take such extreme and often unlawful and/or unconstitutional measures.

"This Administration just doesn't seem that interested in resolving this systemic problem. Instead, they just want to deter asylum seekers from arriving at the southern border. They want to limit how many ultimately apply for asylum, and then limit how many ultimately receive it," she tells me. "There is a political incentive for this President to look like he's active on immigration, to show that he's engaged in the fight, and fighting for the policies that his base is interested in --- and maybe less of a political interest in actually having results on the ground." Pierce surmises that Trump wishes to "keep hammering in these harsh policies, whether or not they're actually going to stand up in court or be effective."

Finally today, some listener comment in response to my rant yesterday regarding the $700 million raised overnight (now up to nearly $1 billion), from a handful of billionaire families and corporations, to restore the fire-ravaged, 850-year old Notre Dame Cathedral in the heart of Paris...

They were just baby steps. Though perhaps notable ones. Time will tell. But Thursday may prove to be a landmark in a potential and greatly-overdue claw back of Congressional powers ceded long ago --- long before Trump --- to the Executive branch. Whether the actions taken by Congress (including no small number of Republicans) on three separate issues today signal a sea change in the way Congress regards its own Constitutionally co-equal mandates and powers remains to be seen. But their rebukes of President Trump were surprisingly clear. Three different Congressional votes on three different matters covered on today's BradCast underscore this issue. [Audio link to show follows below.]

1) On Wednesday night, the GOP-controlled Senate voted once again in support of a resolution to end financial and military support to the U.S.-enabled, Saudi-led war on Yemen that has resulted in an unparalleled humanitarian crisis. The effort amounts to the first Congressional rebuke of a President under the War Powers Resolution since its adoption in 1973. But the invocation of a resolution under the legislation which cedes Congress' sole Constitutional power to declare war may not be enough to prevent the Trump Administration's promised veto and continued support of war-making with the murderous Saudi regime and its Crown Prince Mohammad bin Salman.

2) On Thursday morning, the Democratic led U.S. House voted unanimously(!), 420 to 0, on a resolution to demand the public release of the final report by Special Counsel Robert Mueller, whenever that may happen, after it's delivered to Attorney General William Barr. The statute guiding the duties of the Special Counsel was adopted by Congress in 1999, but mandates only that the Special Counsel deliver a "confidential" report to the AG. Congress failed to specify whether that report must ever be released to the full Congress, much less the public.

3) After recent passage in the Democratically controlled House, the U.S. Senate on Thursday voted 59-41 --- including all Democrats and 12 Republicans --- to reject Trump's "National Emergency" declaration to steal money appropriated by Congress to the military in order to build his southern border wall. It's the first time since the National Emergencies Act of 1973 that Congress has exercised its option to try and block such a declaration. The effort comes after a week of intense lobbying of Senate Republicans by the White House to block the resolution, and by Senate Republicans to convince Trump to accept a compromise alternative or face an embarrassing rejection from his own party. Nonetheless, Trump has vowed to veto the resolution and there are not currently the two-thirds of members in each chamber to override Trump's veto. The matter will most likely be settled in court and, as we argue today, very likely in favor of the President, given the way the Act was written (also ceding more Congressional powers to the Executive Branch.)

If the nation is lucky, however, today could mark a turning point after decades of Congress giving away its powers. But our nation hasn't been very lucky of late.

• And, in Wisconsin, still more (shameful) evidence that Republican Photo ID voting restrictions were adopted as little more than a (successful) scam to suppress the Democratic-leaning vote in the Badger State. A new report from all of Wisconsin's county election clerks finds just 24 cases of potential voter fraud out of some 2.7 million votes cast over the past year. ZERO of those cases, according to the Wisconsin Elections Commission, would have been prevented by the state's Photo ID voting restrictions. On the other hand, as we learned back in 2017, some 23,000 legal voters in just two WI counties alone were deterred from voting by the suppressive law in 2016. That was the year that Donald Trump reportedly won the state by 22,748 votes.

On today's BradCast: A preview of the unimaginably worse dysfunction that awaits us all after Democrats take over the U.S. House majority in January and Donald Trump becomes even worse and more dishonest at his job? [Audio link to show follows below.]

First up today, some quick news headlines, including Time Magazine's announcement that several journalists, killed or imprisoned, are "Person of the Year" for 2018, and a life sentence plus 419 years recommended by the jury for the neo-Nazi who murdered activist Heather Heyer by plowing a car into counter-protesters during the August 2017 "United the Right" rally in Charlottesville, Virginia.

Also, the Washington Post Fact Checkers have been forced to create a new category to describe Donald Trump's dozens of endlessly repeated lies, such as his claims that Mexico would pay for his border wall (he's demanding U.S. tax-payers do so instead) and that his tax cuts were the largest in U.S. history (they weren't. They were the 8th largest.) The new category will be called "Bottomless Pinocchio" and will apply to lies that repeated more than 20 times after they've long been debunked by the fact-checkers as a falsehood. To date, Trump is the only politician to merit such a rating. At least 14 of his most frequently repeated lies have already earned the dubious new distinction.

Then, Trump's bizarre on-camera pageant in the Oval Office today with presumptive, soon-to-be Speaker of the House Nancy Pelosi and Senate minority leader Chuck Schumer. During a media avail before what was to be a meeting regarding the impending federal budget deadline, the three bickered about Trump's threat to shut down the U.S. Government if a budget deal fails to include billions for his southern border wall. "If we don't get what we want," Trump threatened the Democrats during the lengthy and bizarre televised negotiation, "I will shut down the government."

Pelosi and Schumer tried to convince the President to accept one of two bi-partisan deals they say could be immediately passed by both the House and Senate. But Trump, the great deal-maker, failed to budge --- so far. Trump's threat to shutdown the U.S. Government despite the costs to Americans and the economy, comes even while Republicans still control both chambers of Congress. Things are likely to get much uglier once Dems take over the House with their (at least) 40-seat majority on January 3.

Speaking of which, we've got a few more new details today on the GOP election fraud scandal in North Carolina's still-uncertified 9th Congressional District race. Republican Mark Harris is said to have won the election in November by just 905 votes over Democrat Dan McCready. But evidence of absentee ballot fraud by a GOP contractor hired by Harris (in both the general election and Republican primary) has delayed certification of the race by the State Board of Elections. They will decide whether to order a new election or declare one of the two candidates the winner. The Board had planned to review evidence from the ongoing investigation by December 21, but has now told a state court they they may need more time, given that the Harris Campaign has been slow in responding to documents subpoenaed by the Board.

Also, new evidence this week reveals that election workers in Bladen County (one of two NC counties at the center of the probe), illegally tabulated early vote results and leaked them to non-election officials (the Harris campaign?) several days prior to the close of polls on November 6th.

Meanwhile, election officials in Florida have now revealed that more than 6,600 vote-by-mail absentee ballots sent and post-marked by Election Day went uncounted in the Sunshine State's midterm election. Those numbers don't yet include ballots from Palm Beach County, a Democratic stronghold. The untabulated ballots might have effected a number of close races in FL, including those tallied in statewide "recounts" for U.S. Senate, Governor and Agricultural Commissioner. While state law allows ballots post-marked by Election Day from overseas military votes to be included in the tally if they are received up to ten days after the election, all other "late" ballots are ignored.

Finally today, Desi Doyen joins us for the latest Green News Report with news from COP24, the U.N. climate conference in Poland, where the U.S. has joined Russia and Saudi Arabia in an "Axis of Oil" and is, literally, being laughed at for pushing coal while youth protesters demand fossil fuels be kept in the ground. Back home, the Trump Administration is now planning to reclassify high-level nuclear waste at the Hanford Nuclear Reservation in Washington state (and other facilities) in order to avoid billions of dollars in clean-up at the nation's most polluted former nuclear weapons site...

We start with a round-up of news, including three abortion stories (yes, politicians in Ohio want you dead if you get or give an abortion); three tales of adults adulting, even in DC; and a story out of Saudi Arabia that makes it even more astounding that Trump loves the Crown Prince (and Saudi-tied profits) so dearly. Plus a look at Robert Reich's antitrust take on Facebook, Google, and Amazon.

Then long-time historian/journalist ADAM HOCHSCHILD discusses his book, Lessons from a Dark Time --- a collection of his work from over the decades. (A warning here for those who are sensitive to sexual assault discussions, as that does come up.) We talk about prison reform, redefining gun issues, and how far the Nazi Germany metaphor might play out in the US.

Housing activist and journalist RANDY SHAW has a book, too, and it has an unusual take on the urban housing crisis: it's a generational thing. Generation Priced Out documents his investigations in twelve major US cities, seeking both factors and fixes. In addition to the more universally-recognized culprits, he sees a less-discussed one: Baby Boomer resistance to housing the next generations.

It's another very busy show on today's BradCast (for a change), exactly two weeks out from this year's crucial midterm elections. Among the stories covered [audio link to show is posted below]...

• After Trump describes the Saudi lies about their assassination of WaPo journalist Jamal Khashoggi as "the worst" coverup "in the history of coverups" (who would know coverups better?!), the Administration announces they will revoke visas for some of those involved. Good thing those guys only chopped up a journalist instead of showing up at our border to legally claim asylum or they'd have been thrown in jail without their children for months!;

• We finally found the "angry left wing mob"! Apparently one of them put a bomb in the mailbox of Democratic funder George Soros. That seems an odd thing for "the left" to do, doesn't it? (Happily, nobody has attempted to bomb either the Koch Brothers or the many other Republican funders like Sheldon Adelson who give far more money to GOPers than Soros has ever given to Dems.);

• Florida's Republican gubernatorial candidate Ron DeSantis really doesn't want to answer any actual questions. On Sunday, he dodged just about everything asked of him during his debate with Democratic candidate Andrew Gillum on CNN and on Monday he cancelled an hour-long interview with the Editorial Board of the USA TODAY NETWORK - Florida;

• Rolling Stone releases audio of Georgia's Republican Sec. of State and gubernatorial candidate Brian Kemp, from a private campaign fundraising event last Friday, in which Kemp, the state's chief election official, is heard lamenting that his Democratic opponent Stacey Abrams is spending millions on GOTV efforts which, he says, "continues to concern us, especially if everybody uses and exercises their right to vote."

  Little wonder Kemp has spent years trying to keep Georgians from voting, supports the state's easily-hacked, 100% unverifiable touchscreen voting systems, and is being sued by at least five different voting rights organizations for the myriad ways the state has been working hard to prevent voters --- particularly African-American ones, like Abrams --- from voting;

• In Texas (as in Georgia, Nevada, and elsewhere around the country), early voting turnout is breaking records over previous midterm elections and even nearing Presidential election numbers in some cases. But Democrats would be wise not to make too much of those numbers for a host of reasons that we discuss in detail today. Among them: evidence suggests GOP enthusiasm is up as well and lines shouldn't be as long as they are, with hours-long waits in some places, suggesting unprepared election officials and failing voting equipment which could make for a nightmarish Election Day;

• Finally, Desi Doyen joins us for the latest Green News Report, with more global warming-fueled hurricanes coming (including Hurricane Willa now crashing into Mexico and gunning for Texas and maybe later this week, the East Coast, as well as Typhoon Yutu barrelling towards the Marianas and Guam), more new global heat records, and some reasonably encouraging news about debates taking place around the country in advance of the November 6 midterms, where candidates are finally being asked by journalist moderators about their positions on climate change!...

On today's BradCast: More chilling Khashoggi news, more maddening voter suppression, and the Republican deregulation of phone companies in Florida and at the FCC have deadly consequences in the Sunshine State. [Audio link to full show is at bottom of article.]

First up today, an update on the latest in the alleged Saudi murder of Washington Post journalist Jamal Khashoggi and the wildly unreported fact that he had "self-exiled" from Saudi Arabia after being banned by the Saudis from writing and appearing on television or at conferences back in December of 2016 --- for being critical of then President-elect Donald Trump! That point seems quite important, given the Trump Administration's continuing efforts to help cover up the assassination in coordination with the Saudis and their ruling Crown Prince Mohammed Bin Salman, after they repeatedly lied about the grisly killing of a journalist who had been mildly critical of Trump, as first reported in late 2016 and by the U.S. State Department in 2017.

Next, GOP voter suppression continues across many states in advance of the crucial November 6th midterms. Over the weekend on Twitter, President Trump lauded Georgia's Republican Gubernatorial candidate Brian Kemp, who as Secretary of State, has been working for years to suppress tens and even hundreds of thousands of disproportionately African-American voters in the Peach State. Kemp, as the state's chief election official, is overseeing his own election in a reportedly tight race for Governor against African-American Democratic candidate Stacey Abrams.

Trump also took the opportunity on Twitter over the weekend to falsely fan the flames of the GOP's phony claims of "VOTER FRAUD" in hopes, according to the Lawyer's Committee for Civil Rights Under the Law, of inciting government officials and law enforcement to intimidate minority voters before the crucial November 6 election. The Lawyer's Committee heads up the 866-OUR-VOTE hotline to answer question and help trouble-shoot voting problems, such as recent reports that early voters are being either turned away or forced to vote by provisional ballot --- rather than normal ones --- if the address on their ID does not match the one under which they are registered. Georgia's Photo ID voting restriction does not require registration addressees to match those on IDs (e.g. student voters who may not have in-state driver licenses or those who recently moved but have not yet updated their license.) Please contact the 866-OUR-VOTE hotline with questions about local voting laws or any problems at the polls --- and share that number far and wide over the next two weeks!

Finally, despite national media now focusing elsewhere, the devastation in Florida's Panhandle following the Category 4 Hurricane Michael two weeks ago continues and the official death toll is still rising. At the same time, power and phone service is still out in a number of rural areas, thanks in no small part to the deregulation of telecommunications company rules by Florida's Republican Gov. Rick Scott shortly after taking office in 2011, and by Donald Trump's FCC Chairman Ajit Pai.

We're joined today by Public Knowledge's Senior Vice President HAROLD FELD, who has been warning for years about exactly such a situation. Feld explains how Scott gutted almost all of Florida's telecom company rules when he signed the "Regulatory Reform Act of 2011" and how Pai went still further when he gutted Obama-era phone company regulations in November of 2017.

Scott's 2011 measure "was a complete deregulation of the telephone industry in Florida. It removed the state Public Service Commission from any sort of jurisdiction over residential telephone service. It removed something called 'Carrier of Last Resort,' which means there always has to be a telephone provider in the area. It even removed the ability of the Public Service Commission to take complaints from consumers," Feld tells me. He describes it as "one of the most radical deregulations in the country."

As to the federal regulations scrapped by Trump's FCC, that was in response to federal regulations enacted in the wake of the disastrous performance by Verizon following SuperStorm Sandy in 2012, when copper lines were swept away, and phone companies failed to restore them, claiming that the use of cell phones meant they were no longer necessary. Obama's FCC insisted that "no repairing was not an option," says Feld. But Pai "insisted that there was no reason for any of these regulations [and] that companies have private incentive to deploy these networks, despite everything that actually happened," particularly in rural areas, following Sandy.

The Government, he notes, largely for decades has recognized "that it's always going to be profitable [to ensure service] in the cities, [but] it's not going to be profitable once you get out into the rural areas." So, it's been a value and tradition "through each upgrade of our communication network --- when we went from letters to the telegraph, from the telegraph to the telephone" to ensure service to all. But that's no longer the case.

Like Gov. Scott's Florida, Feld describes, some 37 states have lifted similar decades-old telecommunications requirements, thanks to legislation encouraged by the American Legislative Exchange Council (ALEC), a privately-funded partnership between major corporations and (mostly) Republican state lawmakers.

The Republicans' deregulate-at-all-costs efforts to gut regulations --- regulations that Pai scoffed at before he became Trump's FCC Chairman --- may now be costing lives in Florida, as many in rural areas, as of late last week, remained unaccounted for, weeks after the storm. The non-partisan Public Knowledge group is suing for a reversal of those deregulations, and Florida's own Chief Financial Officer and State Fire Marshal, a longtime resident of the Panhandle himself, is now also begging Pai to consider a reversal...
