I was hoping for at least some optimism from my guests on today's BradCast regarding the future of the landmark Voting Right Act of 1965. I'm sorry to say, I didn't get much in that regard. But I learned a lot. [Audio link to full show follows this summary.]

The corrupted U.S. Supreme Court held a nearly three-hour Oral Argument this week after the activist Republican Supremes actually asked plaintiffs from a case last year in Louisiana to come back this term and argue something else entirely: Essentially, whether one of the last standing sections of the Act barring discriminatory election practices, Section 2, somehow violates the Constitution itself.

The case is Louisiana v. Callais. Its origins are complicated, though one of our guests explains it quite simply today. Basically, following the 2020 Census, the Republican legislature in Louisiana drew a U.S. House Map that all but ensured no less than 5 Republican Congressional Districts and just one that might be won by Democrats, because it has been packed with a large majority of the state's Black voters. But Louisiana's voting population is more than 30% Black. So voting rights advocates sued for a second majority-minority district under Section 2 of the VRA. They won. But now a group of White voters in the state (several of whom didn't even know they were listed as plaintiffs!) are attempting to turn the VRA on its head, arguing --- as Mark Joseph Stern summarizes it, that "it's racist to remedy racism" --- by claiming that minority voting opportunity districts amount to an unlawful racial gerrymander violating the rights of the white voters under the 14th and 15th Amendments of the Constitution.

By way of reminder, those Amendments, in brief, bar discrimination against voters on the basis of race, and allow for Congress to adopt laws enforcing the Amendments by protecting all voters. Almost a century after the Amendments were ratified, Congress finally passed the Voting Rights Act in 1965 to do exactly that. Republicans, including now Chief Justice John Roberts, have spent the better part of the last five decades or so trying to roll back the protections for minority voters afforded by the VRA and the post-Civil War Amendments.

After working for the Reagan Administration in the early 80s (unsuccessfully) to try and weaken the Act, in 2013, John Roberts, as Chief Justice, wrote the Shelby County v. Holder Opinion that gutted Section 5 of the VRA. That Section mandated that jurisdictions with a history of racial discrimination at the polling place must preclear all new election-related laws before they went into effect to make sure they were not discriminatory. In 2019, in a case known as Rucho v. Common Cause, Roberts' Opinion for the Court's majority held that gerrymandering for partisan purposes was perfectly legal under federal law, leaving only racial gerrymanders protected against. Now, he and the rest of the far-right activists on the High Court are gunning for Section 2, which is meant to protect voters in all 50 states, including from racial gerrymanders of the kind that Louisiana was found to have engaged in after the 2020 Census.

We're joined today by two experts in election law and redistricting, from both the legal and political sides to try and make sense of all of this. Professor JOSHUA A. DOUGLAS teaches election law at the University of Kentucky College of Law. His latest book is, appropriately enough, THE COURT v. THE VOTERS: The Troubling Story of How the Supreme Court Has Undermined Voting Rights. DAVID DALEY is a Senior Fellow at FairVote.org, whose latest book, appropriately enough, is ANTIDEMOCRATIC: Inside the Right's 50 Year Plan to Control American Elections.

In addition to breaking down Wednesday's oral argument, we discuss why this case is being heard again the first place; how it demonstrates how much Section 2 of the VRA is still very much needed; why there is no specific time-limit after which legally-mandated, race-based solutions to discriminatory violations of the law and Constitution must be ended (as Justice Kavanaugh and others suggested); what is likely to happen if Section 2 is killed or merely eviscerated (at least a dozen minority members of Congress will almost certainly lose their seats in short order); and both if and, crucially, when the Court may issue its Opinion in this matter.

We dig into a lot of details and angles on all of this, so I'm not even going to try to summarize our conversation here. Please tune in for that. You'll be much smarter in the bargain. But, suffice to say for now, Daley, who has written several books on Rightwing gerrymandering, notes that, if Section 2 is struck down, it "would be an electoral bonanza for the Republican Party." He characterizes what will follow as an "unprecedented Gerrymander Armageddon".

Douglas, who also has a podcast and newsletter titled "Democracy Optimist", is not much more optimistic. "I think we are going to see a lot more states engage in this so-called mid-decade redistricting. We're already seeing some states do this in response to President Trump trying to make sure that he doesn't lose the House in the midterm elections," Douglas explains. "I think you're going to see a lot more states, Louisiana included, redraw their maps. And what this is going to mean is that you're going to have a much more partisan skew. It is going to be even that much harder for Democrats to take back the House in 2026, just because race and party are so closely aligned in many states, particularly in the South."

Daley believes a ruling is likely to come as early as January, in time for states largely in the old Confederate South, to rewrite maps before the 2026 primaries begin to prevent Black voters from being able to elect a candidate of their choosing next year.

Douglas, a self-described "glass-half-full kind of person" sees the potential for a bit of wiggle room on both the release date of an Opinion, and how it might be tempered by the ongoing Gerrymandering Wars already underway, thanks to Trump's desperation to avoid a humiliating loss of Congress next year.

On today's BradCast: The War in Gaza may be in the middle of a very fragile ceasefire, but the Wars both For and Against Democracy in America continue apace today. And, according to our guest, the effort underway in one otherwise very "red" state today is heartening. [Audio link to full show follows this summary.]

FIRST UP... Some news following our brief respite yesterday...

  • After the good news yesterday, regarding the release of all living Israeli hostages held by Hamas as part of a cessation of hostilities in Gaza brokered by the U.S. and a number of other countries, a few violent flair-ups and Israel pulling back on several elements of the deal offer worrisome signs for the nascent, fragile peace deal. Israel reportedly killed six Gazans on Tuesday, and Hamas reportedly murdered a number of fellow Palestinians as the military arm of the group began to retake control of the war-torn enclave amid Israel's partial retreat.
  • Back here at home, Democrats saw another big (and, according to Newsweek, "shock") victory up in Fairbanks, Alaska, where Democratic Mayoral candidate Mindy O'Neall ousted Republican-backed Mayor David Pruhs. It is both the first Democratic mayoral victory and first time that a sitting Mayor has been unseated in about a decade in Fairbanks. And yet, it is another instance of a huge shift by the electorate toward Democrats in special and local elections since Donald Trump took office again, just nine long months ago.
  • Little wonder then that Trump has called on GOP-controlled states to gerrymander their U.S. House maps in hopes of flipping "blue" seats to "red" before a single vote is even cast in next year's critical midterms. Texas redrew their already-gerrymandered earlier this year in hopes of stealing five "blue" seats next year in majority-minority districts. And lawmakers in North Carolina announced plans on Monday for a mid-decade redistricting there as well, to take away yet another seat from Democratic voters in the closely divided state. NC had a fair, 7 to 7 court-drawn U.S. House map in 2022, only to see Republicans take control of the state Supreme Court, which allowed a redrawn, 10 to 4 gerrymander in 2024. On Monday, state Republicans announced plans to redraw the map again for 2026, to steal one more seat from Democrats. That, of course, rather than simply change their policies to ones actually supported by the majority of voters.

BUT AFTER... Texas and before North Carolina, it was my old home-state of Missouri whose Republican Governor and state Legislature last month moved to undermine voters with an unprecedented mid-decade gerrymander of the Show-Me State's U.S. House Map.

While Republicans already control 6 of 8 Congressional Districts in the state, with just two Democratic seats left --- one in St. Louis in the Eastern part of the state, the other in Kansas City in the West --- state lawmakers recently voted to split up the Kansas City district held for the past 20 years by Democratic Rep. Emanuel Cleaver II.

Pro-democracy groups and voters, however, are pushing back. Several lawsuits have been filed challenging the new map as a violation of the state constitution. And a coalition of democracy advocates called People Not Politicians (PNP) is fighting back in another way: with a referendum that, if allowed on next year's statewide ballot, would immediately stop the gerrymander from moving forward in 2026, as a "citizens veto", until the entire state was able to ring in on the legislation at the ballot box.

Today, we're joined by PNP Policy Director RICHARD VON GLAHN, who has worked on 10 previous Missouri ballot initiatives, including the successful ballot campaign last year to raise the minimum wage and provide workers paid sick leave in the state. It was adopted with 58% of the vote. He seems very confident about the group's ability to get this referendum before voters next year.

"We can let the people decide if the legislation passed by the General Assembly should go into effect or if they should have to start over," he tells me. "We have done this 27 times in Missouri's history, and 25 of those 27 times that an issue has been put up for a vote, citizens have over-ridden what the legislature has done."

Von Glahn says the coalition is "not just on pace, we are ahead of pace" to qualify for the ballot, which would immediately restore the state's previous Congressional map for next year. "In the 72 hours after the legislature first passed this, we had over 2,000 Missourians volunteer, saying, 'Put a clipboard in my hands, I'm ready to go out and hit the streets and talk to my neighbors.'"

Of course, the state's Republican Attorney General and Sec. of State are already pushing back, attempting to disqualify about 25,000 signatures that were gathered even before the state's Republican Governor Mike Keyhoe signed the new law. Von Glahn explains today why he's confident that their objections will not stand. They are currently challenging the AG's determination in court. But, even if they lose that legal battle, he argues, they will qualify for the ballot anyway with well over the 110,000 or so signatures needed.

"It is a completely frivolous action by the Attorney General," he says, asserting that the AG "just made up words in the [state] constitution to try to thwart this." Nonetheless, the seasoned ballot initiative organizer vows: "We are also going to turn in such an overwhelming number of signatures, that whether the signatures from the first two weeks are counted or not is not going to be a factor."

He also notes that volunteers gathering signatures are not just Democrats in the otherwise supposedly "red" state where voters, just last year, voted for adding a right to abortion in the state's constitution after Republican state lawmakers adopted a near-total ban. "Voters don't ask us, 'Well, will this benefit Republicans or Democrats?' Because this is actually about centering VOTERS in our democracy. No one wants to feel like a political pawn or that our elections are manipulated behind our backs. That's why, as we are out working on this and talking to voters, it is not a PARTISAN message. It is really, like the name says, people, not politicians should be the center and focus of our democracy."

Elections, crime and voter suppression. Three of our favorite topics here on The BradCast, all of which we cover in several different ways and several different cases on today's show. [Audio link to full show follows this summary.]

As I described as a virtual certainty on yesterday's program, the federal government did indeed shutdown this morning as of 12:01am. Republicans, who control the White House and both chambers of Congress --- and who could keep the government open all by themselves --- have chosen to shut it down, rather than negotiate with Democrats. For their part, Democrats want to prevent Republicans from spiking health care costs for tens of millions of Americans as of January 1. Short of a deal to prevent that, Dems seem determined to avoid helping Republicans pass a new spending bill. (Which, did I already mention, Republicans could do all by themselves? Even in the U.S. Senate.)

This is likely to go on for a while. The Trump Administration is hoping to hurt as many Americans as possible in the bargain, and is violating federal law by posting notices on every single page of federal government websites (which are supposed to be strictly non-partisan), like the Dept. of Housing and Urban Development (HUD), falsely claiming: "The Radical Left in Congress shut down the government." Completely unlawful. But, as we know by now, Donald Trump doesn't care about Law and Order or the Rule of Law.

In the meantime, voters may have something to say about all of this in several states next month and in all 50 states next year. So, rather than offer policies the American people might like, Republicans at Trump's corrupted, weaponized Dept. of Justice are hoping to help him rig next year's midterm elections instead.

In the battleground state of Nevada, Trump's U.S. Attorney, Sigal Chattah, according to an exclusive report last night from Reuters, is asking DOJ to help Republicans by investigating "voter fraud" claims made by the state Republican Party and to investigate organizations that help to elect Democrats. Chattah was formerly the state Republican Party Chair. She is also seeking to drop the cases against the GOP Fake Electors in Nevada, who tried to help Trump steal the 2020 election. Chattah was the personal attorney for one of those Fake Electors, even as she, as a federal prosecutor, is now trying to undermine the case against them rather than recusing, as required by DOJ ethics rules, from such cases.

Tune in for more of Chattah's corruption today. But amusingly, a George W. Bush-appointed federal Judge ruled just last night that she is unlawfully serving as the top federal prosecutor in the state as Acting U.S. Attorney beyond the 120 days allowed for someone to hold that position without Senate confirmation.

And, speaking of the failed GOP attempt to steal the 2020 Presidential election, a federal judge late last week found that MyPillow CEO and conspiracy theorist Mike Lindell defamed the election technology company Smartmatic at least 51 different times while falsely asserting that the election vendor interfered with the 2020 election to steal votes from Trump and give them to Joe Biden. The only jurisdiction in the entire nation where Smartmatic's voting systems were used that year was in Los Angeles County, where Biden won 71% of the vote. Smartmatic and another company, Dominion, have either won or struck multi-million settlements in every defamation case that each has brought so far against three different rightwing media outlets (Fox, Newsmax and One American News) and several of Team Trump's 2020 MAGA election deniers, such as Lindell. (In a side note, the MyPillow dude says he is now preparing to run for Governor in Minnesota next year against Democratic Gov. Mike Walz! That should be fun!)

AND THEN... Earlier this year, Trump's DOJ ordered 27 mostly Democratic-controlled states to turn over their entire, unredacted statewide voter registration databases to the federal government for unspecified reasons. The Department's Civil Rights Division (which has been turned on its head under Trump) is demanding the entire files, including unredacted personal and sensitive information such as Social Security and Drivers License numbers, etc., for every registered voter. The reasons are unclear, and most states have refused to turn the files over. But now the Department is suing at least eight of those states, including California, Maine, Michigan, Minnesota, New Hampshire, New York, Oregon and Pennsylvania for those files.

Our old friend ARI BERMAN, best-selling author and National Voting Rights Correspondent at Mother Jones, has been covering this story and joins us today to help us try to make sense of it.

The DoJ is claiming in their lawsuits that the states in question are somehow violating the National Voter Registration Act (NVRA), the Help America Vote Act (HAVA), and the Civil Rights Act of 1960. We discuss all of this today with Berman, who describes the weaponization scheme as of a piece with the GOP's broader "voter-suppression agenda" (which he details in full in MoJo's cover story this month.) Among the questions I've got for him today...

Guest: Matt Gertz of Media Matters; Also: MO Repubs advance rigged U.S. House map and a scheme to block citizen-led ballot initiatives...

On today's BradCast: Apparently, the high price of lying to MAGA viewers about the 2020 election has been totally worth it for rightwing "news" outlets, according to a newly released trove of insider documents. [Audio link to full show follows this summary.]

Two years ago, Fox "News" agreed to pay more than three-quarters of a billion dollars to Dominion Voting Systems to make the voting equipment vendor's defamation lawsuit against them go away. Fox' on-air personalities and their guests had falsely, repeatedly, and without evidence, claimed Dominion used their voting systems to steal the Presidential election from Donald Trump in 2020. Many of the top Fox hosts and executives knew the claims were not true at the time. But they ran with them anyway, as MAGA viewers were fleeing to other, even farther right media outlets like Newsmax and OAN, which were even more shameless in their promotion of evidence-free claims that the election had been stolen for Joe Biden.

Those outlets were forced to pay up as well for their knowing, on-air lies. Newsmax settled with Dominion for $67 million and with Smartmatic for $40 million. OAN similarly settled with Smartmatic --- whose only voting systems in the U.S. were in Los Angeles County in 2020 --- for an undisclosed amount. In every such legal case, to date, the rightwing media outfits chose to pay up rather than face public scrutiny in a court of law, and to see their "news" personalities take the stand to defend claims that emails and text messages revealed during discovery proved that even they didn't believe.

Now Smartmatic's $2.7 billion defamation lawsuit against Fox is on the verge of going to trial early next year. Last time, Fox agreed to pay $787.5 million to Dominion to avoid a trial where the jury members had already been selected and journalists, including our guest today, were waiting in the courtroom for the trial to begin.

Late last month, a trove of hundreds of pages of "damning filings" were made publicly available in Smartmatic's case against Fox. Media Matters for America Senior Fellow MATT GERTZ, who joins us on today's show, plowed through them. The documents reveal, among other things, Fox personalities like Jesse Watters and Greg Gutfeld, discussing "how incredible our ratings would be if Fox went ALL in on STOP THE STEAL"; prime time stars Sean Hannity and Laura Ingraham worrying about backlash from viewers for failing to cover phony claims about fraud enough; Bret Baier, the network's supposed "straight news" anchor trying to convince the network to reverse its (accurate) call that Arizona had gone to Biden, given how furious that fact had made Trump and the outlet's MAGA viewers.

"I think we certainly filled in some gaps after the Dominion suit that have been answered to one degree or another through the Smartmatic one," Gertz tells me today, summarizing the newly released documents in the Smartmatic case. "More broadly, what the suit shows is they knew. Fox News' top executives and hosts were well aware that Donald Trump lost the election, that there had not been massive voter fraud, as he had claimed, that kept him from being re-elected, and they went out and said the opposite to their viewers. Night after night, segment after segment. For weeks. They did it because they were worried about losing portions of their market share to outlets like Newsmax and OAN that were perceived as more willing to push those lies."

While Fox has paid a price for that to Dominion, and may have to do so again with Smartmatic, Gertz asserts the lesson for Fox seems to be that it was all worth it. "They have, in the days since then, demonstrated that they are absolutely willing to do it again if the Republican nominee in 2028 tries the same con that Donald Trump did in 2020," he argues, citing the fact that those who tried to tell the truth about 2020 have since been pushed out at the network, while those who were willing to lie are still there, have received promotions, or are now members of the Trump Administration itself.

"What happens is that, because Donald Trump lies so much, he forces his supporters to make their peace with either letting the lie go past and ignoring it, or running with it. There are very few who are willing to say, 'This thing is not happening.'"

Much more on all of that with Gertz today, along with what Monday's agreement among the family heirs to 94-year old Fox owner Rupert Murdoch's business empire likely means for the far-right politics of Fox "News" going forward after he dies. And, far more troubling, the news this week that a far-right Trump supporter and donor with no experience in the news business whatsoever, will now serve as the ombudsman for CBS News as part of the recent concessions made by CBS-owner Paramount to win approval from Trump's FCC for its merger with Skydance.

"CBS News has instituted an ombudsman because its parent company was trying to convince the FCC that if he approved their merger, the network's coverage would change in a way he liked," explains Gertz. "They didn't pick a journalist with a reputation for integrity and neutrality. They picked a rightwing think-tanker and Republican donor who has no newsroom experience, but will give Donald Trump what he wants, which is a CBS News that moves its political coverage to the right."

"They are leveraging the power of the Executive Branch through Trump appointees who are willing to corruptly do the President's bidding, in order to force those companies to do so," he asserts. "They are changing the incentives for media outlets so that they need to kneel to the Republican Party's diktats if they want their mergers completed, or if they want to avoid criminal investigations, even. It's certainly a step towards authoritarianism, toward the treatment that Victor Orban of Hungary enforces on media outlets in his country. Orban is someone Trump has said is a model for what he's trying to do."

In other cheery news on today's show...

  • The GOP-controlled Missouri state House voted today to approve a new U.S. House map that will likely steal one of the two remaining Democratic seats in the state for Republicans in next year's midterms. They also approved a measure that would make it harder to adopt citizen-led Constitutional ballot initiatives by mandating that measures must win a majority of voters in each of the state's eight Congressional districts, rather than a simple statewide majority as currently required. The move comes in the wake of state voters recently approving ballot initiatives that establish abortion as a state Constitutional right; for the legalization of marijuana; and for the expansion of Medicaid under the Affordable Care Act. Both measures adopted by the MO House on Tuesday now head to the state Senate where they are expected to be approved before going to MO's Republican Governor for his signature. The ballot initiative amendment, however, must be approved by voters under the existing, simple statewide majority rules before being added to the state Constitution.
  • Finally, Desi Doyen joins us for our latest Green News Report, as both electricity usage and prices spike across the country, even as Trump continues to shut down much-needed windfarms and other renewable energy sources around the nation...

We're back on today's BradCast after a much-needed, "end of Summer" break. That's either good or bad news depending on how you (or I) might see it. [Audio link to full show follows this summary.]

The good news for me, I suppose, is that we missed one of the most insanely busy news weeks of Trump's second term. The bad news is that I need to get both you and me caught up on "our story so far", so everything makes sense (or, as much as is possible amidst this insanity) going forward into the Fall (and pending government shutdown at the end of this month.)

To that end, we've got a day-by-day, blow-by-blow, collected summary of much --- if not all --- of the key news from over the last week today. From many of the ongoing losses for Trump in the (lower) courts, to some very encouraging electoral news on several fronts for Democrats, to Americans pushing back (effectively) against the regime on several levels, to some of the not so good news, including natural and man-made disasters and tragedies, and the ever-ongoing, non-stop, self-destructive idiocy of the Trump Administration.

Also, Desi Doyen is here with our latest Green News Report, catching you up with some maddening and important stuff there as well!

It doesn't make too much sense for me to go into the details here. I'd be writing and linking all night. So tune in to get caught up on a lot of the unofficial "end of Summer" news to help get yourself buckled up for all the madness that most assuredly lies ahead...

GOPers demand 'fair maps'...but only in Dem-controlled states...

To Right-Wing Billionaire Charles T. Munger, Jr.: Despite the fact that you, along with former Republican Governor Arnold Schwarzenegger, supported the 2008 ballot measure that created an independent redistricting commission for California state legislative offices and the 2010 ballot measure that extended the independent commission's jurisdiction to California's Congressional elections, "cynical hypocrisy" now be thy name.

After being approved by both chambers of the California state Legislature, on August 21, Governor Gavin Newsom signed the "Election Rigging Response Act", a ballot measure (Proposition 50) that will come before the entire California electorate in a Special Election this November 4 for an up or down vote.

The measure, as the Golden State governor explained, calls for a "temporary" shift of the power to redistrict California's Congressional seats from the state's constitutionally mandated independent redistricting commission to the super majority Democratic Party-controlled State Legislature. This, Newsom asserts, is necessary to counter the extreme partisan gerrymander that, at the express request of President Donald J. Trump, was adopted by the GOP-controlled TX state Legislature. Newsom is of the view that a "temporary" departure from California's non-partisan redistricting is necessary to counteract Republican rigging of the 2026 Congressional election. (In this writer's view, Prop. 50 is needed to prevent this nation from devolving into a full-blown fascist dictatorship.)

Note: Prop. 50 does not alter the continued use of the independent redistricting commission with respect to Golden State legislative offices.

Even before Newsom signed the Election Rigging Response Act into law, Californians, statewide, received a slick, 4-page mailer from a group calling itself "Protect the Voters First Act". At the bottom of the last page, the mailer reveals that Munger is its principal funder.

Munger's mailer accurately describes California's independent redistricting commission system that he helped to create as a "landmark election reform"; one that "has become a national model for independent redistricting." But the right-wing billionaire's deceptive mailer fails to mention that, in 2021-22, every Congressional Republican opposed federal legislation that would have extended California's "national model for independent redistricting" to all 50 States.

Instead, the mailer falsely goes on to proclaim that California's Prop 50 is a threat to democracy...

Guests: Heather Digby Parton of Salon, 'Driftglass' of 'Pro Left Podcast'...

It's been a while, but they're back for today's BradCast to help send us off with a smile --- and just a little bit smarter --- for a brief, much-needed holiday break from the program next week. [Audio link to full show follows below this summary.]

First up today, however, a few late news headlines...

  • Don't be fooled by either bad corporate media headlines or Donald Trump's false claim of "TOTAL VICTORY". In fact, a New York appeals court on Thursday affirmed last year's civil fraud conviction against the nation's criminal-in-chief, but finds [PDF] the nearly half billion dollar fine charged against him for his years of cooking his company's books with faked, artificially inflated financial statements to be 'excessive'. So, the bank and tax fraud verdict holds, the amount of the fine is to be redetermined, and all other penalties against Trump, his company and his two eldest sons remain in place.
  • Kilmar Abrego Garcia, the El Salvadoran Maryland man "mistakenly" sent to a gulag in El Salvador by the Trump Administration, will be released from a Tennessee prison on Friday. He has been held in the facility since returning to the U.S. to be be slapped with Trumped-up charges meant to save face for the Administration. The court has now issued several orders to prevent Abrego Garcia from being scooped up by ICE and deported again after he is freed...but we'll see if the Trump Administration has any respect left whatsoever for the courts and the Rule of Law.
  • The Gerrymandering Wars continue. Shortly after airtime on Wednesday, the Texas state House --- delayed more than two weeks by state Democratic lawmakers leaving Texas to break quorum --- adopted a newly gerrymandered U.S. House Map to steal five seats from Democrats in next year's midterms. The Lone Star state Senate will soon pass same and the heist will be signed by the state's corrupt Governor. In the meantime, here in California, our state Legislature, by a 2/3rds vote, adopted Gov. Gavin Newsom's "Rigged Election Response Act" today. The measure, quickly signed by the Governor, will ask state voters in November for permission to temporarily waive the Congressional map created by the state's Citizen Redistricting Commission to replace it with a new one that is likely to flip five "red" U.S. House seats to "blue" next year, in response to Texas' obnoxious mid-decade redistricting at the command of Donald Trump.

We pick up on those stories and many more today with our old OG blogger pals, the great HEATHER DIGBY PARTON of Salon and Digby's Hullabaloo and the notorious 'DRIFTGLASS' of the Professional Left Podcast. Both join us today for a wide ranging conversation that takes a few surprising (and amusing) twists and turns along the way.

On today's court ruling in NY on Trump's fraud fine, Digby finds it "unfortunate that the headlines that are coming out are backing Trump's contention that this is some kind of a vindication. It is not." She observes "there is probably going to be a fine, and it will be a painful fine, it's just not going to be half a billion dollars."

Driftglass has an additional idea. While Trump is "still guilty," he notes, "I will take a straight-up swap: zero fines in exchange for the Epstein Files. How's that? There's a deal!"

We spend quite a bit of time today on the next steps in the Gerrymandering War begun by TX. Both Digby and Driftglass support CA's response to it. Says Driftglass, an Illinois resident: "I think what California has done, and I hope Illinois does, is show them that nuclear deterrence is the only way we can keep these people in a box. We'd rather not. But if you're going to bring a knife, we are going to bring a gun." As to what his already Democratic-gerrymandered state plans to do? Well, tune in for Drifty's assessment.

Digby, a fellow L.A. resident, is "hopeful" that voters will approve the statewide ballot measure on November 4th, despite a big money campaign already underway to defeat it. "Trump has treated California like garbage," says Parton. "We've been through a lot of trauma in this state. The way that he talks about the Governor, the way he talks about all the politicians here, I think Californians are sick of it."

"Essentially," she rages, "we're here to provide federal money for Trump's red states, including Texas. I think there's this sense that alright, it's time to fight back," She and Driftglass are also both veryfond of Newsom's new, wildly popular Trump trolling routine on social media. We compare our favorite Newsom trolling meme's (one of them is pictured above) before today's show is over.

Other items covered with D&D today include Trump's pathetic, pretend show of force with the deployment of the National Guard in D.C. and elsewhere. ("He is performing acts of fascist theatre" for the benefit of his MAGA supporters, charges Driftglass.); whether any of the Trump/Republican wildly unpopular policies are working or liked by voters and, if not, why the hell do they continue to double down?; and much more.

Okay. So, now Republican elected officials who pretend to oppose "Big Government", are literally locking up their elected opponents in the state capital. (Insert eye-roll emoji here.) That's just one of the insane stories --- and disturbing signs of American democracy on the authoritarian precipice --- on today's BradCast. [Audio link to full show follows below this summary.]

  • On Monday, Democratic state lawmakers returned to Texas after two weeks of out-of-state quorum breaking meant to prevent Texas Republicans from stealing five U.S. House seats with a new map drawn up at the insistence of Donald Trump and Gov. Greg Abbott. But, before they were allowed to leave the capital building in Austin, the Republican House leader required Dems to sign a permission slip to be escorted 24/7 by Texas state troopers to ensure they return to vote on the new map on Wednesday. Democratic state Rep. Nicole Collier refused to sign away her freedoms, and was disallowed from leaving the House chamber, where she has effectively been held prisoner on the floor of the House by Republicans. She was was forced Monday night to sleep under bright lights at her desk House floor desk. [See photo above.] As of today, Collier is still being held prisoner by fellow elected officials from the state's rightwing authoritarian majority party. Lots of details on this remarkable story today, and how it serves as more shameful evidence of what Republicans have allowed American "democracy" to become.
  • Out here in California, meanwhile, state Democrats are moving ahead with their plan to counter Texas' attempted heist by redrawing the Golden State's U.S. House map to remove five Republican seats from the map next year, in what Gov. Gavin Newsom describes as "fighting fire with fire". In CA, however, it won't be up to partisan state officials. No imprisonment of the opposition should be necessary. Here, the voters of the state must decide in a special election on November 4th as to whether they wish to temporarily set aside the U.S. House map created by the state's independent redistricting commission. The effort is meant to counter Texas Republicans undermining democracy --- and the odds of Dems winning back the House to put the brakes on Trump's authoritarian agenda --- in the 2026 midterms. I have been supportive of the CA response, called the "Election Rigging Response Act", despite my years-long record in opposition to gerrymandering by either party. One longtime listener calls me out via email today for my new position on this matter, charging that "If you fight fire with fire the fire grows stronger and then spreads." I share his well-meaning thoughts and my response to them on today's program.
  • Speaking of corrupting democracy, the Trump-supporting Republican propaganda outlet Newsmax has agreed to pay $67 million to settle the defamation lawsuit filed against it by Dominion Voting Systems. After Trump lost the 2020 election, Newsmax --- along with Fox "News" and other dishonest GOP propaganda outlets --- advanced evidence-free claims that the election was rigged by, among other things, voting machine companies like Dominion. Documents that would have been shown to jurors at trial --- had Newsmax not agreed to settle --- reveal that officials at the fake news outfit knew Trump's claims about a stolen election were BS, but ran the phony conspiracy theories anyway to win duped MAGA viewers. The Newsmax settlement follows a similar $787.5 million defamation settlement with Dominion by Fox "News", and a reported $40 million paid by Newsmax to Smartmatic, another voting equipment vendor falsely accused of fraud by Trump-supporting outlets after the 2020 election.
  • On yesterday's show, we detailed how the Dept. of Homeland Security is now using literal Nazi and neo-Nazi text and references and imagery in their new recruitment campaign for ICE. Today, both NOTUS and The Independent detail pretty good evidence to suggest that the unnamed Nazi-loving social media creator at DHS may be a guy named Eric Lendrum, who has a long public history of both Nazi-like political statements and claims that "conservatives" are being ostracized like slaves, or as Jews were in Nazi Germany. Lendrum now works in the DHS Public Relations office, which does PR for the largest law enforcement agency in the world, and evidence suggests he may be responsible for the relentless recent flood of DHS social media posts using Nazi memes, slogans and images.
  • We tried to warn you. Though, for some, it could be the last timely warning they receive. E&E News' is reporting that public radio and TV stations are now scrambling to keep their local disaster-warning systems alive after Trump and Republicans in Congress rescinded all federal funding for the Corporation for Public Broadcasting, which helped fund hundreds of local NPR and PBS stations. In many areas around the U.S., those stations are --- or, historically, were --- a literal lifeline for local residents, particularly in rural areas. Emergency alert warning systems now at risk include those for hurricanes and tropical storms on the Atlantic Coast; for winter storms across the Northern Plains; tsunamis in Alaska; earthquakes in rural Northern California; tornadoes in states across the Great Plains; and flash flooding just about everywhere these days. Yes, elections have consequences. And now, potentially very deadly ones, including for many rural Trump voters.
  • Finally, Desi Doyen joins us for our latest Green News Report on Hurricane Erin smashing records off the Atlantic Coast; Climate change driving record humidity levels; Deadly rains in Pakistan and a heatwave in Scandinavia intensified by the burning of fossil fuels; and the collapse of a U.N. plastics pollution conference, thanks to nations like the U.S., Russia, and a bunch of Middle Eastern states who undermined a landmark agreement on behalf of the plastic-producing fossil fuel industry at the recent conference in Geneva...

But, if they're gonna use actual Nazi book titles and Nazi fonts in their ICE recruitment ads, they can hardly be offended, much less surprised, if they are called Nazis, right? Also, if they're going to undermine democracy the way the Nazis did, yeah, they're gonna get called out as Nazis! [Audio link to full show follows this summary.]

  • We kick off with a new tune at the top of the show called "Join ICE", by brilliant young folk singer Jesse Welles. You'll enjoy it. If I'm right, and you wanna hear it again, or see what Jesse looks like, the video of his new song is right here.
  • Next, they're not even trying to hide it anymore. As the nonprofit news site Religious Dispatches points out, it's "less of a dog whistle than a bullhorn" at this point. The outlet cites two recent cases of the Dept. of Homeland Security tweeting out ICE recruitment propaganda with both purposeful Nazi references --- that might only be fully appreciated by actual Neo-Nazis --- and a "Join ICE" recruitment video that uses "the very same gothic lettering, or Frakturschrift, used by Nazis in their publications --- including on the cover of Mein Kampf"!
  • Speaking of police states now in America, Democratic state lawmakers returned to Texas on Monday after breaking quorum in the state Legislature for the past two weeks. Their goad had been to block the adoption of a newly gerrymandered U.S. House map for Texas in advance of next year's midterm elections. We discuss why the Dems say they have returned and what that means for the fight against the new map in Texas and for democracy across the U.S. But the Republican's state House caucus leader has now ordered the Democrats who returned from out of state to be escorted "around-the-clock" by Texas state troopers to prevent them from fleeing again, until the new Special Session called by Gov. Greg Abbott (at Donald Trump's order) is over. Or, at least until they've used their rightwing legislative muscle --- and state troopers --- to deprive voters in five blue-leaning U.S. House districts of their right to be represented by a candidate of their choosing.
  • Then, Donald Trump is really hoping you'll forget about his failure to strike a ceasefire "deal" with Vladimir Putin in Alaska last Friday (any his failure to apply "severe" consequences, as promised, against Russia if he didn't). Of course, Trump continues to hope that you'll be too outraged about everything else, to remember that he is still refusing to release the Epstein Files that he is featured in. Today's latest attempted distraction was a long post Monday morning on his failing social media site, vowing to end the use of "MAIL-IN BALLOTS" and get rid of "VOTING MACHINES", by Executive Order, before the 2026 midterm elections. Of course, he has no Constitutional authority as President to do any of that and, naturally, his rambling, at-times ALL CAPS screed announcing his plans was filled with one false claim after another, which we break down on today's show. The biggest takeaway, however, is not only that Trump is hoping to undermine democracy, but that he is now putting in place excuses to blame for his party's trouncing in next year's midterms. Presuming, of course, that they are trounced. If so, he'll be able to claim it was the "MAIL-IN BALLOTS" and "VOTING MACHINES" that dunnit, without any actual evidence to support his claims --- other than his previous tweets "warning" about same. It's his 2020 sore loser act redux. Much more on all of this on today's show.

FIRST UP... At a lively rally at the Democracy Center here in Los Angeles on Thursday, California's Democratic Governor Gavin Newsom unveiled the "Election Rigging Response Act", legislation meant to push back against Donald Trump and the state of Texas' attempted mid-decade gerrymander of its already-gerrymandered U.S. House map. The new TX map, if enacted, would steal five Democratic House seats from largely minority voters in the Lone Star State in next year's midterms.

"We can't stand back and watch this democracy disappear district by district all across the country," Newsom declared at the boisterous rally, announcing his plan to ask the Golden State legislature to quickly approve a ballot measure for November 4th that would allow CA to temporarily override the state's U.S. House map. Unlike in Texas, our maps are drawn by an independent redistricting commission. If Newsom's scheme overcomes several hurdles, a new map would be drawn by the Legislature to flip five currently Republican seats in CA. The Act must first be approved by two-thirds of the CA state Legislature. It would then have to pass muster with voters on November 4, and wold only take effect if Texas successfully rigs their map.

The attempted heist in Texas is currently on hold, with state Democratic lawmakers breaking quorum by leaving the state. But Republican Gov. Greg Abbott has insisted that he will call Special Session after Special Session until he is able to rig the map for Trump and Republicans who fear they will otherwise lose their slim U.S. House majority next year.

"We are not bystanders in this world. We can shape the future," Newsom told the crowd on Thursday, adding: "Donald Trump, you have poked the bear and we will punch back."

"We're giving the people of this state the power to save democracy, not just in California, but all across the United States of America. I hope we are waking up to this reality. Wake up, America. Wake up to what Donald Trump is doing," the Governor concluded. We share his remarks in full on today's show.

THEN... We're joined by veteran, award-winning journalist turned media reform champion SUE WILSON of the Media Action Center, for an update on a remarkable story she has been covering at The BRAD BLOG for at least five years.

Wilson initially reported in 2020 on a citizen Petition filed at the Federal Communications Commission (FCC) seeking to deny renewal of Sinclair Broadcasting's TV stion license in Baltimore. The complaint alleged that Sinclair, one of the nation's largest (and most right-leaning) station owners, was violating FCC rules that limit the number of stations that can be owned in a single market by secretly controlling two other television stations in Baltimore. Those two stations are run, according to the well-documented Petition, by sock-puppet companies actually controlled by Sinclair.

Filed in late 2020, the Petition wasn't heard by the FCC during the remaining months of Donald Trump's first term. Over the ensuing four years, for reasons we discuss today, Joe Biden's FCC failed to review the matter as well. In the meantime, in 2023, the Petitioner passed away. Another Baltimore resident was quickly substituted on the paperwork.

Fast-forward to 2025 and the FCC in Trump's second term, now led by his hand-picked Chair Brendan Carr, dismissed the original complaint on the basis that the substitute Petitioner missed the chance to file a petition on her own back in 2020. Her substitution for the man who waited five years for a hearing --- and died waiting --- was not allowed, Carr ruled, even though the well-documented facts of the matter hadn't changed. The Sinclair stations in question have since been re-licensed, despite the companies apparent violations of both FCC rules and federal law.

The lawyer for both the late Petitioner and his substitute, has filed an Application for Review, hoping to appeal the Commission's absurd ruling. Wilson detailed the latest remarkable chapter in this long-running story at The BRAD BLOG this week, and joins us to both break it down, and light up a warning about the next scheme that the FCC's Carr now has in place to undermine federal ownership rules of local television stations nationwide.

Guest: Fred Bauer of 'Rounding Up'; Also: Big Gov't Tyranny: U.S. troops in D.C. as Trump's pointless L.A. deployment faces trial...

Sadly (or happily, as you may see it), we don't have many Republicans as guests on The BradCast these days. That's largely because so many are now crazy, brainwashed and/or liars, as I see it, and we don't like platforming crazy, brainwashed lies on this program. But today, I'm delighted to be joined by someone from the Right who appears neither crazy, brainwashed nor a liar, as we try to find common ground to end the worsening Gerrymander War touched off by Trump and Republicans in Texas of late. First up, a few more thoughts today on the Big Government Tyranny that Republicans used to claim to oppose...until they found a Big Government Tyrant that they are happy to get behind, I guess. The U.S. National Guard was deployed to the streets of the nation's capitol yesterday, at the order of Donald Trump, to supposedly help fight crime in a city where violent crime is at a 30-year low, and has dropped by 26% since this time last year.

Those troops in D.C. may wish to look to those deployed out here in L.A. in early June, where they apparently did virtually nothing over their 60-day deployment away from their families, jobs and homes. The show of federal force was merely meant as a performative tough guy move by our pretend tough guy President. The same is true, no doubt, in D.C. today.

Trump's federalization of the California National Guard against the wishes of the state's Governor and L.A.'s Mayor, may also have been unlawful. A three-day bench trial is wrapping up today in L.A. on that very matter, but Liberal Redneck Trae Crowder already has his verdict on much of this today, some of which we share.

THEN... it's back to the ongoing gerrymandering war, as Democratic Texas state lawmakers are still breaking quorum by fleeing the state in hopes of blocking Republican Gov. Greg Abbott from stealing at least five "blue" U.S. House Seats from majority minority districts before next year's midterm elections. At the orders of Donald Trump, Abbott has convened a special session of the state Legislature to carry out a rare, mid-decade redistricting of the already gerrymandered state. A proposed new map would include, for example, a current House District in the state's liberal capital of Austin being broken up and added to a rural District that expands more than 300 miles from Austin.

Democratic state Governors, like California's Gavin Newsom, have vowed to respond in kind if Texas is successful. Other GOP-controlled states are now considering new gerrymanders in turn, as still more Dem states prepare to do the same if needed and if possible.

Where does it all end? We're joined today by writer FRED BAUER who has an idea or two on how it all could end, optimistically, in a way that "both sides" might support.

In his op-ed at Washington Post this week, headlined "There’s a way to end Texas’s redistricting war where everyone wins", Bauer, a Republican, makes the case for expanding the U.S. House by about 140 seats in almost every state before next year's midterms, in a way that, he argues, might be seen as benefiting both parties.

I've got lots of questions, as you may imagine. While I appreciate the idea of better representation of voters (one Member currently represents nearly 800,000 voters in each Congressional District of the "People's House"), I'm not sure that expansion alone will result in much more than still more gerrymandering, but in all 50 states with more Members.

Bauer has a few additions to his proposal, such as banning mid-decade redistricting and perhaps even mandating "continuous and compact" districts once again, as had been required by a Congressional apportionment law during the early part of the 20th Century.

"The key question I'm trying to think about here is how can we shift our Congressional districts from being engines of polarization to better be engines of representation," Bauer asserts. I share his hope.

And then there's the idea that Bauer seems open to of proportional representation. What does that mean? Well, tune in if you're unfamiliar. Or even you're not. But the point here is that I'm very happy to have a serious conversation with someone from the Right about how to find common ground to eventually end this mad race to the partisan bottom.

Can it happen in some sort of bipartisan way? Or will one party or the other eventually have to simply establish new rules for all? As usual, there is a lot to discuss on today's show. But we gotta start the Second Reconstruction somewhere...

Today on The BradCast: Donald Trump's latest attempt to make himself feel powerful by deploying U.S. military troops on American streets --- against Americans --- has nothing to do with Law and Order. It has everything to do with a need for authoritarian control by a very small wannabe tyrant. It also has to do with distracting from the fact that he's in the Epstein Files and won't release them, as previously promised. [Audio link to full story follows below this summary.]

Among our stories today that help make that case and a few others...

  • The 30-year old (white) Georgia man who attempted a mass shooting at the CDC headquarters in Atlanta on Friday fired some 200 shots at its glass windows, smashing bullet holes into about 150 of them. He was also misinformed by the nation's health secretary Robert F. Kennedy, Jr., and others who spread the same nonsense, that his depression was due to a COVID vaccine shot. Kennedy took 18 hours before issuing a tepid statement in response to the shooting that killed a responding (black) police officer. Donald Trump has yet to say anything about it...much less deploy the U.S. National Guard to Georgia.
  • At the top of Rachel Maddow's program Monday night, she told a harrowing story about a convicted triple ax-murderer. Turns out he is a (white) American citizen who is now roaming the streets of the nation after Donald Trump just sprung him from prison. The National Guard will not be deployed to Florida to hunt him down, because Trump wants him to be free.
  • Meanwhile, in D.C., Donald Trump, a 34-time convicted felon and adjudicated sexual abuser, announced on Monday that the U.S. National Guard would be deployed to the nation's capital, where violent crime is at a 30-year low, according to the U.S. Attorney's office there. The announcement follows a recently attempted 3am carjacking of a (white) guy who used to work on Trump's so-called DOGE project. Like Los Angeles, where Trump previously deployed National Guard and U.S. Marines for no legitimate reason, and in likely violation of the law, D.C. has a black female Mayor. More easy pickins as tough-guy Trump sees it, I suspect. But none of this has anything to do with the Rule of Law or being Tough on Crime. At his Monday presser, Trump also suggested he would soon be deploying both National Guard and even active duty military troops to a number of other Democratically-run American cities, if not to GOP-controlled states like Georgia or Texas, despite a number of recent mass shootings in both. But, again, none of this is about Law and Order. It's about authoritarian control by a tiny, petty tyrant.
  • In that same vein, Washington Post reports today on a Pentagon plan to create a permanent military "reaction force" that would allow Trump to deploy U.S. military troops to U.S. cities within an hour on either side of the Mississippi, for whatever bullshit authoritarian reasons he wanted to dream up. Bullets would already be flying in the streets of the U.S. against the U.S. Government had any recent Democratic President carried out anything like all of this. Apparently, Republican "opponents" of Big Government Tyranny only oppose Big Government Tyrants they didn't vote for.
  • One of Trump's other recent attempts to distract from the fact that he's in the Jeffrey Epstein files --- and is therefore, refusing to release them --- is also failing miserably. A U.S. District Court judge in New York on Monday, denied the Trump Dept. of Justice's motion to release Grand Jury transcripts from the 2020 indictment on sex trafficking and abuse of minors by Epstein's accomplice Ghislaine Maxwell. The judge excoriated DOJ for its attempt at misleading the public about what is (or, in this case, isn't) in those transcripts, writing in his scathing ruling that "the Government’s motion for their unsealing was aimed not at 'transparency' but at diversion --- aimed not at full disclosure but at the illusion of such."
  • Down in Texas, meanwhile, Gov. Greg Abbott is still trying to have his GOP-controlled state legislature steal five U.S. House seats from Democrats in next year's midterm elections by redistricting the state's map again, in the middle of the decade, at the order of Donald Trump. State House Dems are still not letting them. They continue to break quorum in the state House by remaining in other states. On Monday, TX' corrupt Attorney General and U.S. Senate candidate Ken Paxton asked the state Supremes to expel 13 of the absent Democratic members. On Monday night, Abbott took to Fox "News" to threaten to rewrite the maps to steal not five but 10 seats if California's Governor dares to respond to the TX heist by rewriting maps to flip five Republican seats in the Golden State in turn. And on Tuesday, Abbott announced that the 30-day Special Legislative Session would be concluded this week, with a new one started immediately thereafter. There is still no indication that Dems plan to show up for it, as state Repubs continue to hold disaster relief hostage following the deadly July 4th flash floods if Dems refusing to allow them to steal next year's U.S. House elections.
  • Finally, Desi Doyen joins us for our latest Green News Report, as flash flooding and record heat continues across the Midwest and around the world; and as the Trump Administration continues to raise energy prices for Americans by gutting renewable energy production in the U.S., even while announcing plans to build a nuclear reactor...on the Moon!...

For better or worse (mostly worse), Texas plays a role in almost every story we cover today...

It's a tough call on today's BradCast as far as which is worse: the stupidity or the outrage in response. (It's the stupidity, stupid.) But we report, you decide. [Audio link to full show follows this summary.]

Donald Trump's many wars on America, Americans, American democracy, American values and the rest of the world, including livability on the planet itself, continued this week, as one of this nation's greatest accomplishments turns 60 years old, even as it founders under years-long GOP assault. And, coincidentally, the state of Texas plays a part in just about every one of our stories today...

  • We kick things off with some goodish news. Following the unspeakable tragedy last month when at least 135 people, including dozens of camping school children, were killed during flash flooding on the banks of the Guadalupe River in Texas Hill Country, the Trump Administration is finally allowing the National Weather Service to hire new meteorologists and other critical staffers. That, after Trump's DOGE scam resulted in the firing and early retirement of hundreds at the now hollowed-out NWS.
  • As another heat wave broils much of Texas this week, cheap, clean, renewable energy --- including wind and solar (as well as battery storage for when it's dark or the wind isn't blowing) --- has helped prevent collapse of the state's grid under extraordinary demand, even as some of its coal and gas plants were taken off line due to the climate change-intensified heat.
  • Nonetheless, the Trump Administration has been doubling down this week on its war against cheap, clean, renewable energy, such as wind and solar, on behalf of the fossil fuel industry which has captured it. Former fracking CEO turned Trump's Energy Secretary Chris Wright was making the media rounds this week, attempting to justify the Administration's Orwellian removal of Congressionally mandated National Climate Assessments from government websites. He told CNN it's simply an effort to "fix" the science contained in those reports, released every four years after being compiled, peer-reviewed and fact-checked multiple times over several years prior to publication by hundreds of scientists and more than a dozen federal agencies. Wright is hoping to counter the peer-reviewed science on climate change in those landmark quadrennial reviews with a "report" released by the Dept. of Energy last week, as authored in two-months time by five notorious climate science deniers hand-picked by the former fracking executive. Wright's denialist, AI-assisted slop is now being used as the basis for the Administration's effort to scrap every federal climate change-related regulation enacted since 2009.
  • Meanwhile, the GOP's War on Democracy continued on Thursday, as Texas state lawmakers remained in other states to try and save it. They are breaking quorum in the Lone Star State's House of Representatives in order to prevent passage of a new U.S. House map, ordered by Gov. Greg Abbott at the direction of Donald Trump, which would steal five seats currently held by Democrats in majority minority districts in next year's midterms. Republican state officials --- from its Governor to its corrupt Attorney General to its U.S. Senator to its Republican House Speaker --- are hoping to enlist Trump's FBI to hunt down, round up and arrest the fleeing Dems in other states, despite no criminal charges against them and a state Constitution that allows them to break quorum (according to the state's all-Republican Supreme Court.) That, as California advances its own effort --- to be placed before voters this Fall --- to counter Texas' attempted mid-decade gerrymander. We get you all caught up with the latest in this harrowing ongoing saga today.
  • The Republican attack on democracy --- including on U.S. House districts drawn by federal court order to correct Texas districts found in violation of the Voting Rights Act --- comes on the very same week that the landmark Act, which added tens of millions to to the voting rolls since its passage, turns 60 years old. The VRA has been under successful attack by Republicans in recent years. But today we mark the law's 60th anniversary with some of the remarks upon its signing by heroic President Lyndon Baines Johnson...of Texas.
  • Finally, born and bred Texan Desi Doyen joins us for our latest Green News Report, detailing some of the remarkable actions taken this week by the Trump Administration --- remarkably, as energy costs and demand are quickly rising --- to roll back successful efforts to incentivize cheap, clean, renewable energy. Among the new fronts in his war this week: An absurd "energy density" requirement for power sources; an attempt to rescind $7 billion appropriated by Congress during the Biden era to help defray the cost of residential rooftop solar in low- and middle-income communities; orders to shut down on-going wind energy projects; and Trump's ridiculous mandate that wind farms may no longer be built any closer than a mile from roads and railways...

Dem lawmakers flee TX to block GOP theft of five U.S. House seats; CA focuses on November voter measure in response; Callers ring in...

Today on The BradCast: Democratic state lawmakers from Texas are, right now, fighting for democracy for all of us, no matter where we live and which party we belong to --- or even if we belong to no party at all. So what can you and I do to help? [Audio link to full show follows this summary.]

Democratic members of Texas' state House of Representatives fled the Lone Star State on Sunday to deny Republicans the quorum needed in a special session of the state legislature to redraw U.S. House maps in the middle of the decade. The GOP hope is to steal five seats from Democratic-leaning voters by redrawing district lines. Governor Greg Abbott called the special session at the demand of Donald Trump, who clearly feels his agenda is on the ropes, as Dems appear set to retake the U.S. House majority next year. That, he fears, will put an end to his unfettered authoritarian agenda.

Republicans, apparently, don't feel they can win by offering policies that voters like. So they are going to cheat, to rig the 2026 midterm elections in their favor if they can. It is now easier than ever for them to do so, thanks to recent rulings by the corrupted, activist Republican U.S. Supreme Court majority. Partisan lawmakers are now allowed to rig elections by implementing partisan gerrymanders. SCOTUS has said that federal courts must not intercede in such matters. At the same time, the rightwing Supremes are now gunning to allow racial gerrymanders as well, despite its prohibition in the Voting Rights Act.

All of this has combined for a toxic mix of rightwing extremism that has opened the door for Republicans to simply rewrite Congressional maps to prevent Democrats from winning seats at all in states where the GOP controls both the legislature and governor's mansion. Texas is now trying to do it. Democrats in the state are trying to block them by leaving the state. And states controlled by Democrats are looking to respond in kind, if necessary.

Yet, as we discussed on the show a couple of weeks ago, it's not so easy for Dems to push back for a number of reasons. One of them is that many Democratically controlled states have implemented nonpartisan or bipartisan independent redistricting commissions. That means that partisan legislatures cannot simply game the maps as easily as Republicans can in states that they control.

I have fought against such undemocratic efforts for years, whether it is done by Republicans or Democrats. However, given the Republican capture of the High Court and their apparent determination to simply steal an authoritarian-friendly majority forever by gaming the state maps, it would also undermine democracy itself if Democrats failed to step up to meet the moment in response.

New York Governor Kathy Hochul now describes what is happening as a "war". She says she intends to rewrite state maps as well. But due to state constitutional restrictions she wouldn't be able to do so until 2027 earliest. Illinois Governor J.B. Pritzker --- who is helping to house Texas lawmakers who have fled their state to break quorum and avoid their Governor's threat of arrest and expulsion from the legislature --- is similarly exploring options to rewrite the U.S. House map in the Land of Lincoln before the 2026 midterms.

In California, with some of the most competitive districts in the nation --- thanks to our constitutionally mandated independent redistricting commission --- maps could be redrawn in a way that Democrats could almost certainly win all 52 seats in the state's U.S. House delegation. They currently hold 43 of them. California's Democratic Governor Gavin Newsom threatens to do exactly that if Texas Republicans are able to proceed with their partisan redistricting scheme. (Republicans in other states, such as Ohio, are threatening to to follow in Texas' footsteps with their own mid-decade gerrymanders.)

But in California, a vote of the people would be required to temporarily waive the U.S. House map drawn by the state's constitutionally-mandated independent redistricting commission. Newsom has said he preparing to push for exactly that in the first week of November this year if Texas stays on course.

"We will go to the people of this state in a transparent way and ask them to consider the new circumstances, to consider these new realities," Newsom told reporters last week. "This is not going to be done in a back room. This is not going to be done by members of some private group or body. It's going to be given to the voters for their consideration in a very transparent way so they know exactly what they’re doing and they can go back in 2030 to original form with our independent redistricting intact."

So, will Golden State voters support such a move this November at the ballot box if it comes to pass? We open up our phone lines today to find out how our live Southern California listeners feel about it. The responses may surprise you as much as they surprised me. Tune in to find out why...

Trump has mastered it. YOU are already paying for it.; Also: TX Repubs move ahead with scheme to steal five U.S. House seats next year...

As discussed on today's BradCast, there are a few things you should know about all of these supposed Donald Trump "trade deals" you have been hearing about in recent days, in advance of his iron-clad August 1 deadline (until he changes it again --- oops, too late, and too late again) for implementing new tariffs on imports into the U.S. from the rest of the world. [Audio link to full show follows this summary.]

Among those things...

  • Any Trump "trade deal" that includes tariffs on another country is actually a sales TAX on your purchase of the tariffed goods from that country. The foreign nation does not pay the tariffs on those goods. You do.
  • These "deals" aren't actually trade agreements. They are frameworks, of a sort, for potential trade agreements, at best. Trade agreements take years to sort out. At least if they are real ones, which the ones being announced by Trump may not even be. (That is true even when a foreign head of state is by his side when the "deal" is announced.)
  • The frameworks announced as "deals" by Trump and the White House to date, may or may not include things that the foreign nation has actually agreed to during negotiations. Trump just makes shit up. (Last weekend's supposed "trade deal" with the European Union --- including laughable claims of promises for $750 billion in energy purchases and $600 billion in unspecified "investments" --- provides just one great example.)
  • All of these corrupt "deals", or lack thereof, that include new sales taxes on goods from other nations, may ultimately be found unlawful if only because Trump may not have the statutory authority as President to unilaterally issue tariffs of this sort. (Though you'll be paying them anyway, as the courts work that out.)

Also today...as discussed last week with gerrymandering expert and author Dave Daley, Texas Republicans are now officially moving ahead with their sleazy undemocratic scheme to create a new U.S. House map for the state in the middle of the decade. The newly proposed map in the GOP-controlled state legislature would wipe out Democratic districts on their already-gerrymandered map in hopes of stealing as many as five new seats for Republicans in next year's midterm elections. Dems plan legal challenges in Texas, and continue to ponder whether or not they should do the same sleazy, anti-democratic thing to Republican-held districts in states that Dems control. (I argue, regrettably, that they should. Immediately.)
