This is interesting. In a "blind bio poll" of Republican voters, conducted by Zogby, Ward Casscells polled as well as both Rudy Giuliani and Fred Thompson.

Who the hell is Ward Casscells? Some guy who's not even running for anything. But apparently Republican respondents liked his bio as much as they like Rudy, Fred, and all the rest, according to a new Zogby poll out today...

We've suggested that our friends at Why Tuesday? change their tagline ("Fixing our voting system, one question at a time") for what seems to us an obvious reason. They're doing good work so far on their new video blog site, but given the topics they're dealing with, we'd suggest our system is already "fixed" enough thanks.

That said, they recently issued a candidate challenge to all of the presidential candidates, asking them to respond to three specific questions concerning their plans for Election Reform.

We're hoping in the near future, they will add the following question to their challenge: "Do you support a paper ballot --- not a 'paper trail' or a 'paper record,' but a paper ballot, and one that is actually counted --- for every vote cast in America?"

In the meantime, we'd encourage those of you out there going to candidate events (both Republican and Democrat) to ask such a question of the candidates if you can, and capture it on video. Do that, and send us the clip (or a link to it on YouTube, etc.) and we'll get it up on The BRAD BLOG, and perhaps even on Why Tuesday? as well.

So far, the first response they've been able to get to their challenge is from Joe Biden when WT?'s Exec. Director Jacob Soboroff ran into him recently at a D.C. coffee shop. Biden's comments are at the right.

We'll note that, while not asked about it specifically, he first refers to a "paper trail," but later refers to a "paper ballot" and wants a standardized system used across the country. He also mentions that full public financing of presidential and congressional elections will do more than anything to reform the system as he sees it. Let us know what you think.




U.S. Rep from the Golden State Makes Unsubstantiated Claim at Last Week's Republican PBS Debate...

At last Thursday's Republican Debate --- the one which the four Republican front-runners refused to attend --- sponsored by PBS and hosted by (egad!) African-American broadcaster Tavis Smiley, the question of Photo ID restrictions on voters was raised by the Atlanta Journal-Constitution's Cynthia Tucker.

California Rep. Duncan Hunter's answer was interesting. And it's no small matter given that trying to disenfranchise Democratic-leaning voters seems to be Strategy #1 (once again, but moreso than ever) for the desperate GOP in 2008.

That's just one of the reasons why Barack Obama's block of the Dem "deal" to slide through the nomination of Bush's evil GOP anti-voter zealot, Hans von Spakovsky, to the FEC today is so important.

Tucker's question from last Thursday: "Many voting rights advocates are worried about rigid voter ID laws which require photo ID like a driver's license. Are you concerned that some eligible voters will be denied the right to vote simply because they don't have a driver's license?"

Hunter's imaginative answer: "We have right now a real danger of people that are illegally in the country being rounded up, herded into the polls, we've seen that in California, voting illegally. That disenfranchises everybody in that community."

Really? We've "seen that in California," have we? Undocumented (illegal) aliens being "rounded up [and] herded into the polls" and "voting illegally"?

Living out here in the Golden State, we hadn't heard of that one. And we do follow these issues fairly closely. So we checked with Hunter's campaign to find out if they could offer any examples of such illegal votes from herded aliens in our state...

Had Previously Claimed US Founded as 'Christian Nation'

Recently, John McCain gave an interview to a religious website called Beliefnet. The only topic of conversation was religion. At right is a short mashup of the most egregious moments from the interview.

As you can imagine, it's created, um, a bit of a hubbub. And rightfully so- the New York Times ran the headline McCain Casts Muslims as Less Fit to Lead; Carpetbagger went with McCain sees Constitution establishing a ‘Christian nation.’

In brief statement issued by his campaign, McCain is hoping to clear up any confusion. "I would vote for a Muslim if he or she was the candidate best able to lead the country and defend our political values," the Senator is quoted as now saying.

And yet, as can clearly be seen in the above video, McCain states the following about what he thinks the number one prerequisite for being president should be:

"I think the number one issue people should make [in the] selection of the President of the United States is, 'Will this person carry on in the Judeo Christian principled tradition that has made this nation the greatest experiment in the history of mankind?'"

And yet now he claims that he'd be okay with voting for a Muslim candidate?

As Steven Benen says today at TPM, apparently the Senator "was for discrimination before he was against it."

BREAKING NEWS: Electoral initiative backers give up

Plagued by a lack of money, supporters of a statewide initiative drive to change the way California's 55 electoral votes are apportioned, first revealed here by Top of the Ticket in July, are pulling the plug on that effort.

In an exclusive report to appear on this website late tonight and in Friday's print editions, The Times' Dan Morain reports that the proposal to change the winner-take-all electoral vote allocation to one by congressional district is virtually dead with the resignation of key supporters, internal disputes and a lack of funds.

The scam of the attempted Electoral College coup was best exposed in August by Hendrik Hertzberg at New Yorker and more recently found by SF Chronicle to have been backed by a mysteriously funded Missouri(!) front group tied to Rudolph Giuliani.

More at the Times' blog, though we'd urge caution. GOP attempts to steal 2008 any way they can will not end here, not by a long shot, even if this particular initiative really is dead.

A leading opponent of the measure, Democratic consultant Chris Lehane, told the Times, "We want to to make sure this is not the Freddie Kruger of initiatives...that comes back to life. We'll continue to monitor it."

As will we. Good on the Dems for (maybe) nipping this one in the bud...for a change.




Stumbles Though Odd Video Pitch Emailed to Supporters (or At Least, to Folks Who Ended Up on His Mailing List)

This is somewhat amusing.

Describing himself (without apparent intended irony) as "we, real people," former exceedingly powerful Republican House Majority Leader Dick Armey stammers and stumbles through a quick video pitch (seen at right) to members of his FreedomWorks mailing list for the awkwardly named "Pick Dick Armey’s YouTube Flick Contest."

The premise, if we're understanding the seemingly drunk Armey correctly, is for "normal" people to decide what question they will allow Armey to ask for them, on video, for the upcoming Republican CNN/YouTube debate. Or something.

It would seem the point of such a debate is for actual "we, real people" to submit questions without the help of bloated former Texas power brokers like Armey. So we'll hope that his question, whatever it ends up being, gets no preferential treatment from CNN, who selected a few dozen from among thousands submitted for the Dem version of their YouTube debate a couple of months ago.

That is, if he can even get through such a question. What really leaves us chortling aloud here, is that old Dick apparently couldn't get through his 48 second pitch without flubbing it up, several times, making this video funnier with each viewing. Hope you real people will enjoy it as much as we did.

Whatever they have to do to win. And given the odds against them in '08, expect them to pull out every stop imaginable between now and the election in order to "win."

Add this to our "DoJ is the New ACVR" article last week, describing how the DoJ has now institutionalized "vote caging" at the federal level via, among other things, a recent letter sent to 10 states ordering them to purge their voter rolls. While Thor Hearne's ACVR is no more (at least officially) and the RNC is barred from minority-targeted caging by a court-ordered consent decree, state parties can do whatever the hell they damn well please, according to our friend Greg Gordon at McClatchy today...

WASHINGTON — Ohio and Florida, which provided the decisive electoral votes for President Bush's two razor-thin national election triumphs, have enacted laws that election experts say will help Republicans impede Democratic-leaning minorities from voting in 2008.

Backers of the new laws say they're aimed at curbing vote fraud. But the statutes also could facilitate a controversial Republican tactic known as "vote caging," which the GOP attempted in Ohio and Florida in 2004 before public disclosures foiled the efforts, said Joseph Rich, a former Justice Department voting rights chief in the Bush administration who's now with the Lawyers Committee for Civil Rights.

Caging, used in the past to target poor minorities in heavily Democratic precincts, entails sending mass mailings to certain voters and then using the undelivered letters to compile lists of voters for eligibility challenges.

Asked whether they might employ vote caging in 2008, Executive Director Jason Mauk of the Ohio Republican Party and spokeswoman Erin Van Sickle of the Florida Republican Party said they couldn't discuss election strategy.

Five False Voter Signatures Gathered for 75 Cents a Piece in 2006...And Why It Matters in 2008 (And in Ohio!)

California Secretary of State Debra Bowen's Election Fraud Unit has just announced that felony charges have been filed against a Sacramento woman who appears to have forged the names of five voters while gathering signatures for a 2006 ballot initiative.

The initiative was sponsored by Pacific Gas & Electric (PG&E), which hired the woman to gather signatures for a petition to get the initiative onto the ballot. She earned 75 cents per signature, netting her a total of $3.75 from the allegedly fraudulent signatures, according to the press release just sent to The BRAD BLOG by the SoS's office. The signatures were excluded before the initiative qualified for the ballot, which eventually passed during the June 2006 election.

So why all the effort and resources expended to bring felony charges for such a paltry sum, for an election that's already over, particularly when the signatures weren't even used?

The reason, as we see it, is two-fold. And there are lessons to be learned from both explanations. And not just in California where powerful GOP operatives are hoping to gain enough signatures to put an Electoral College busting measure on the June 2008 ballot in desperate and cynical hopes of splitting the Golden State's electoral vote on a proportional basis in order to game the 2008 Presidential Election.

The new Secretary of State of Ohio would do well to take away the important lesson, once again from her sister in Sacramento...

Santa Cruz, California's Election Clerk Comes Back for Another Helping...

Santa Cruz County Clerk, Gail Pellerin joined us on the Peter B. Collins Show again tonight, live, to follow up on last week's interesting and rather spirited (at times, contentious-ish) hour.

Since last Friday's show, CA SoS Debra Bowen has pronounced that the voting machine "sleepovers" Pellerin told us she'd planned for her Sequoia voting systems again in 2008 "don't comply with the security requirements" for those voting systems in California.

As well, we've gotten the opportunity to chat a bit via email with Pellerin since then, and are encouraged that we can begin working more together than apart, as is necessary, I think, for Election Integrity advocates and Elections Officials. It's the voting machine companies who are the real villains in this matter, and they've been quite successful at driving an opportunistic wedge between advocates and officials.


UPDATE, AUDIO & TRANSCRIPT: The show went very well. Pellerin stuck around for the entire hour and it was a great discussion with several interesting and newsworthy revelations, along with some very good callers as well. Republicanists Using Their Politicized Big Government Tools to Fight Against Democracy in America
Voter Roll Purges Ordered for 2008 by DoJ in 10 Key States...

Gonzalez and Schlozman and Griffin may be gone, but the long-term politicization and damage at the DoJ was done and institutionalized long ago. The usual suspects --- Thor Hearne, Hans von Spakovsky, Joe Tanner, et al. --- are still plying their insidious anti-democracy trade with all of the tools of big Republican government at their disposal.

If you Dems think "nothing could possibly go wrong in 2008," you'd better think again. As Steve Rosenfeld at AlterNet reports, the Republicans aren't taking '08 lying down. Not by a long shot.

Earlier this year, the DoJ sent another round of threatening letters to 10 key battleground states, threatening to sue them if they do not purge their voter rolls. Yes, the Republicanists have found a "legal" way to use the DoJ to do the illegal vote-caging work the party and their phony well-funded "grass-roots" used to have to do. No wonder Thor's American Center for Voting Rights was able to go "out of business."

The DoJ is the new ACVR.

"They want more people showing up on Election Day and not finding their names," former DoJ Voting Section attorney David Becker, now of People for the American Way (PFAW), tells Rosenfeld. "They want people not voting."

Where Will Conny McCormack Finally Get Her Payoff From?

"I don't want to preside over the dismantling of voter services that have been successful and accurate," LA County Registrar of Voters Conny McCormack tells the LA Times this morning. "I suppose I do take that personally."

McCormack's systems were "dismantled" after ES&S, one of her vendors, refused to supply its source code in time for testing of her paper-based InkaVote Plus system, and after her other vendor Diebold's touch-screen machines were disallowed for use because they were found vulnerable to hacking. Only one such machine will now be allowed per polling place in order to marginally meet federal disability voter accessibility standards, and the paper trails from those machines, as per Bowen's orders, will have to be 100% hand-counted.

Though that didn't keep McCormack from signaling, in a Bush-style signing statement, that she didn't think she had to actually count them prior to the final certification of the election. In a a statement [PDF] posted on the LA County Registrar's website in reply to Bowen's order, McCormack wrote, "However, it is important to clarify that the SOS Order does not require the 100% manual count audit to occur prior to completion of the official results certification."

The link to that document from the front page of the site has now been replaced by McCormack's resignation statement.

The LA Times Hector Becerra goes on to report that McCormack "angrily accused Bowen of unfairly attacking the voting machines to gain political points."

While we're not sure what "political points" Bowen gains (she was elected last November on the promise of doing exactly what she's done, won't have to run again for another three years, and has come under considerable criticism in the media for her courageous, principled stand), it's little surprise that McCormack, who has been fighting for the voting machine companies instead of the voters for years --- even appearing on a Diebold sales brochure to sing the company's praises --- would bug out of the nation's largest county just a month before the first Presidential Primary Election in 2008, leaving the voters to whatever may happen.

McCormack's official statement of retirement [PDF] didn't mention her anger at Bowen for taking away her toys and those of the companies she's concerned about. Rather she claimed...

My decision to leave at this time is based on several factors:

I have been approached by several foundations and, at this stage of life, am interested in shifting my energies and experience to election administration research and consulting both within the U.S. and worldwide.

So the question we pose to you is...

Who will be LA County Registrar of Voters Conny McCormack's next employer?

Brad Friedman whose Brad Blog has taken a leading role in questioning the electronic voting machine companies, said McCormack seemed more concerned about the voting machine companies than whether their machines were vulnerable to fraud, particularly by people involved in the voting process. My name is Clint Curtis, and I am running for Congress in Florida’s 24th District because I am fed up with the corruption and incompetence that continues to plague us in Washington. I'm running because the people of this country deserve honest representation and strong leadership that reflects the true will of the people.

As long-time BRAD BLOG readers may remember, I have dedicated myself to the cause of election integrity ever since a corrupt congressman asked me to create a prototype vote-rigging software program while we were both working for the same Florida software company back in 2000.

Since then, I have stepped into the sunshine to tell the story, and have become one of the nation's leading advocates for election reform. Working with non-partisan election integrity groups across the nation, I have fought hard for legislation that mandates the use of paper ballots. The state of Florida just passed such legislation earlier this year --- an enormous victory for proponents of election reform and a great win, finaly, for the voters of Florida.

My district is bordered by Cocoa Beach, Kennedy Space Center, Daytona Beach and Orlando. It is a district of stark contrast between the haves and the have nots. Million dollar beachfront palaces sit just a scant few miles away from thousands who subsist in grinding poverty, bereft of hope. This is Florida’s Space Coast, a region of stunning beauty and spectacular innovation, but we have the misfortune to be represented by one of the most corrupt Republicans in Congress, the very same congressman who asked me to create that vote-rigging program: Tom Feeney.

Tom Feeney is the latest Republican congressman to fall under the shadow of the Jack Abramoff bribery and corruption scandal. Feeney is now under investigation by the FBI for his dealings with Abramoff. The writing is on the wall, making Florida’s 24th District one of the top three targeted races in the country.

But I will need your help in running against Feeney, and more importantly for the moment, helping the Democratic power structure in Washington D.C. understand we are ready, willing and able to take this seat and remove Tom Feeney once and for all.

For those of you who are new to The BRAD BLOG and may not be familiar with my story, up until just a few years ago I was a stereotypical, mild-mannered software engineer who would have never in a million years considered running for public office. As I said in a post last week, introducing myself to readers at Daily Kos, I’m just a ‘regular guy,’ a middle class citizen, working hard to make ends meet, like so many of you. And sad to say, for too many years, I bought into the myth that people like us can’t really make much a difference.

I've been a programmer since 1985. I've worked on projects as diverse as NASA to the Florida Fish and Wildlife Department. Although I was always an independently inclined voter, for years I identified more with Republicans than Democrats. I thought they shared my values of integrity, ethics, and honesty. I believe many of them still do. But that trust was shattered when I came to discover what shameless depths bad apple Republican politicians have now sunk to...

Results Delayed as Atleast 1500 Paper Ballots Re-Counted By Hand (Fortunately, There WERE Paper Ballots To Re-Count!)
Ron Paul Supporters Were Right to be Worried About Republican's Choice of Diebold to Tally Votes...

As we reported on July 15, Ron Paul's supporters were concerned that Diebold touch-screen voting machines were going to be used in the Iowa Republican Straw Poll. Well, it turns out the concerns about touch-screens were misplaced, as the GOP chose paper-based Diebold optical-scan machines instead. But their fears of Diebold may well have been justified as two of their op-scan systems failed and delayed the reported results.

While GOP candidate Mitt Romney may have walked away with a winning edge in the Iowa Straw Poll, Diebold was true to form as their voting system failed to count ballots correctly. As the Des Moines Register is reporting two of Diebold's optical scanners failed and 1500 paper ballots had to be manually recounted by hand...

Voting machine difficulties delayed the announcement of the vote totals. About 1,500 ballots needed to be recounted, said Mary Tiffany, a spokeswoman for Republican Party of Iowa.

Two machines caused the problem, said State Auditor David Vaudt. “What likely happened is someone submitted their ballot too quickly after the other,” he said. The ballots from those machines were hand counted, then re-fed into the system to recalculate the vote. A campaign poll-watcher said in one instance, a black box contained 500 paper ballots but the machine’s memory said it had scanned in 498.

At least there were paper ballots that could be hand counted when the machines failed. Had the Republican's used Direct Recording Electronic (DRE) voting machines --- as millions of Americans are forced to do each Election Day --- there would have been nothing to go back to when the machines failed.

UPDATE: The Atlantic is reporting the number of ballots which had to be "re-run" as "about 4,500".

Either way, there were reportedly 14,203 total ballots cast. So going by the Des Moines Register's reported numbers, more than 10.5% of the ballots had to be recounted. If we go by The Atlantic's reported numbers, nearly 32% of the ballots in the Iowa Republican Straw Poll had to be recounted by hand.

Looks like the Republican National Committee is getting a particularly early start in their attempts to steal next year's election. And from the looks of Paul Kiel's report on the deceptive RNC letter sent to a life-long Democratic voter in the Show Me State, once again Missouri may be ground zero in 2008.

All of which is swell, because we happen to be in Missouri this week, and plan to speak to folks in St. Louis next Thursday at an event sponsored by Missourians for Honest Elections (yes, there still are a few, including MO SoS Robin Carnahan, whose office contacted us to chat a bit yesterday upon seeing we'd be in town). We'll be causing trouble in Thor Hearne Country, firing up the troops, and taking questions, after a showing of Dorothy Fadiman's superb documentary Stealing America: Vote by Vote (which we're told is being submitted for Academy Award nomination).
