..it's obvious to anyone who thinks about it that the voting machines were rigged. Hey, it's just another small part of this bizarre US prezidential experience. Wonder if cheney had the voting machine dudes over for 'visits',..oh yeah, cheney's claiming he's not part of the 'executive branch', ain't he the no.2 legally in there?... and I think 9/11 was done so 'they' can put your troops into iraq to guard their quickly built pipeline to kuwait(since 2003,popular mechanics etc.)They can weather all this stuff as they're stashing the cash, waiting for the post prezidency, illuminati-world-domination-stuff to commence, eugenics anyone?....

John,
You and I know that this type of action is what is needed to get the RICO infested electronic election machine industry back to American reality.
Their reality heretofore has been one of a banana republic, not a reality of how the US has traditionally worked.
The Secretary of State of California has taken off the kid gloves because that is the only way to effectively deal with the corporate brats that screw the public.
I nominate the Honorable Debra Bowen (Sec. State - California) for Chairman of the FEC and the Honorable Jerry Brown (Atty. Gen. of California) to replace Alberto Gonzales as Atty. Gen. of the US.
PS. Everyone get ready for surprises when experts look at the source code and freak out. I suspect it will be the wrong version (not the one certified) and be substantially in non-compliance. Buggy too.

I'm not an attorney, and don't play one on tv, but it occurs to me that if the machines in question don't perform reliably and correctly, can't they be returned for refund under the law of merchantability, where stuff is supposed to work the way it's supposed to work?

As you can see here, its been going on forever.
Our forefathers pulled our ass out of the shit before, and youse guys, I'll rate you up there with them.
[...]Accordingly the Rhode Island legislature, realizing that the proposed convention was nothing more than an attempt to organize a coup by which the Cincinnati could take power, refused to have anything to do with the proposed convention; from which arises the fact that the present Constitution of the United States had no signatures from Rhode Island"
[...]the ex-rebels were so greatly feared in Massachusetts that they were able to get a strong foothold in the convention in spite of all plans by the capitalists to the contrary. Thus the convention opened, amid hot attacks on the proposed constitution for the new centralized government. The general tenor of these attacks can be summed up in a speech made by Singletary, one of the ex-rebels in the convention: "These lawyers, and men of learning and moneyed men that talk so finely, and gloss over matters so smoothly, and make us poor illiterate people swallow down the pill, expect to get into Congress themselves; they expect to be the managers of this Constitution, and get all the power and all the money into their own hands, and then they will swallow up all us little folks, like the great Leviathan....just as the whale swallowed up Jonah."
"But one noteworthy point is that long before the electoral votes were counted it was taken for granted that George Washington would be the President, and he actually started for New York before there was a chance to count the votes!"

Dan, how could you forget Ms McKinney on your short list ? (kidding)
After I'd read that Chapter of the Cincinnati above and the one before that, I'm getting the feeling that the oligarchs of today are trying to force another "Constitutional Crisis" so they can re write that document without the pesky provisions that impede their greed, you know, like the ones they were adding before under duress, like the "Bill o' Rights and all the others that followed that are good for the general population.

Floridiot,
before considering just the conspiracy theory aspect of the Cincinnati, additional historical perspective might help you obtain a clearer picture. I myself, who was completely unfamiliar with the Cincinnati, found this bit of underreported history to be absolutely fascinating.
Here is a good read

Yesterday on KPBS-TV's "Full Focus" program, Gloria Penner, distinguished graduate of the Baba Wawa School of Hard-Hitting Broadcast Journalism, interviewed Deborah Seiler, San Diego County's new Registrar and former Diebold Sales Rep.
The interview was very enlightening. Diebold has clearly been selling substandard equipment for voting, because it is evident that the company has created a lifelike robot called Deborah Seiler.
I have not yet located any video of this interview, but if you have a chance to see it, you will immediately understand what I am talking about.

Seiler, Cellar, Seller ... all sounds the same.
Seilering, cellaring, and selling "a bill of goods" to the public.
Sounds like the bottom of the barrel to me.
Debra can handle her.

Good stuff Dan (99 could you fix Dans link ?)
Without those conspiracys, I think our country would be a lot different than it is now IMO. The voting machines are a prime example, so is Cheney saying his office is not a part of the executive, which is bullshit.
I wouldn't ever have heard of all of this Cincinnati stuff if not for family lore that someone in our tree had a "little problem a while back "as my Grandpa would say to my mom.
I started digging in April and a couple of weeks ago, out popped Capn Daniel Shay(s) to my shock.

I'm not 99 but Dan's broken link is now fixed.
I want to point out what I think may be the reason for ES&S not wanting to give out the InkaVote Plus source code.
ES&S markets InkaVote. They don't own it. InkaVote is owned by Unisyn Voting Systems. Unisyn Voting Systems is a wholly owned subsidiary of International Lottery and Totalizator, Inc. a Malaysian company that is heavily into gambling enterprises amongst other industries.
{Thanks John! I've been on another planet today. --99}

Phil, I don't think the CMSM blackout on e-vote machines is going to go away. But they DO cover this on Free Speech TV and LINK-TV, and quite often, too. The masses have to switch to these 2 channels for their TV news.

Commercials = corporate control = NOT news in YOUR best interests...
Ever see "Weapons of Mass Deception"? You'd never watch ANBCBSNNX again! Important TV news for informing American citizens is dead...except for Free Speech TV and LINK-TV. And personally, I don't think that's going to change. It's wishful thinking, I think we have to move on to FSTV and LINK-TV. We're lucky they're even available to watch!

Funny, I was just thinking about the ideal people for office in the next Dem administration and I've thought Bowen would be great, but for some reason it didn't occur to me to put Brown in as AG. Obvious choice really.
Michael Moore to head next 9/11 Commission.
Ralph Nader to head Product & Consumer Safety Commission.
Bill Clinton to be US Ambassador at Large
Wes Clark for Sec. of Defense
There are many obvious great choices.

Oh joy, now we realize who screwed up the whole thing is. Not only is it crooked, but foreigners are involved in screwing us over. But, it's probably just a front for an Abramoff operation with the real strings being pulled from here and there all over the globe, but with the final string being held by Karl Rove (obviously).

I am unhappy that:
""
It was my understanding that all currently deployed voting systems approved in California were to be reviewed. It sounds more like LA County is afraid of being caught using a voting system that was never submitted for approval or went through the state certification process.
LA County in September 2003 asked the SoS if they could get "administrative approval" of a new election management system (EMS) that they had co-developed with Diebold under a million dollar + contract. Conny McCormack claimed that their old EMS (the MTS) was DOS based and could not be used for any future elections starting in 2004. There is correspondence between her and the Elections Divison throughout the fall of 2003. In her original letter in September she claimed that the new EMS had been tested and was fully functional, and wanted to use it in an upcoming small election. The SoS refused to approve it administratively, but wanted it subjected to the entire approval process (as of December 2003). During this same time frame she claimed that to develop an alternative form of their existing MTS system would take many months.
Suddenly in early January 2004, less than a month later, LA County suddenly has a new MTS (Micro Tally System) version that they want administrative approval of. The very system that in the early fall was DOS based. Now it is using a Microsoft Windows 2000 operating system. The state technical consultant tells the Elections Division that because of this major change in the operating system the MTS should be subject to testing and examination. It is not.
In early February the new MTS version is granted administrative approval in a letter, without any examination or testing by the state, all based upon assurances by LA County.
Also in February 2004 Bob Urosevich send s a letter to the SoS asking for special permission to use another Diebold/ LA County created a software patch for use in the March 2004 election. To illusrate how it will be used he sent some screenshots of LA County's main election management server's desktop. On the desktop shows various icons of installed programs, including GEMS (Diebold's election management system) version 1.18.18 (the only one approved at that time) and most interestingly, a GEMS folder labeled GEMS 2. Conspicuously absent was ANY MTS folder. It also contained other programs on the desktop such as Microsoft Access, the data management program that has been shown capable of going into the GEMS data files containing votes and being able to change the vote totals without a trace. It also contained other programs that never should be on an election related server.
In the 2006 election cycle computer technicians under a provision of the California election code were able to obtain a walkthrough of the main server room in LA County. They found multiple Dell computers in a cabinet running GEMS 2. They were told the county was only testing it and didn't use it in elections, even though on Election night 2006 they were on. This was TWO YEARS after Conny McCormack had told the SoS that they had already successfully tested their new Diebold/ LA County EMS.
I would suggest there is a very valid reason LA County does not want anyone examining their new MTS EMS. Perhaps they merely applied the name of an old system with a new version number to obtain administrative approval for a new cross-bred system that the SoS would not approve without a thorough examination.
This is the whole problem with electronic voting. Once the voting systems are in the field no one has any idea what additonal programs might be installed, what ports might be accessed, or just what the EMS might be networked with. The efforts in California by many election officials to prevent technicians or citizens from exercising their legal right to examine and observe the counting of our votes going on inside these computers is telling. If they have nothing to hide, why do they keep hiding that process?
LA County should not be able to hide any facet of the voting systems they have been using for the last several elections. I think they are afraid of getting caught and that is why they do not want to be scrutinized. The Secretary of State needs to send in investigators, and a grand jury start obtaining testimony. This is no different than a burgler not wanting to allow the police to search their home because of what they might find.
It is my opinion that there are several counties in this state in which computer literate investigators need to go in and review how the current systems are deployed, what are they connected with, what programs are or have been installed, and review audit and event logs.
When so-called public servants want to hide what they are doing, especially our elections, is exactly when the public needs to demand opening up the process. This is not an issue of too many pot-holes. The issue of our confidence that we are governed by those chosen by the electorate is foundational. If any election official wants to hide what they do they should be replaced, and an investigation begun.

Comment #25 was supposed to start with this paragraph:
Los Angeles has decided NOT to have their home grown InkaVote+/MTS system reviewed. Los Angeles will be able to use that system for the rest of 2007, e.g. for the special election June 26, 2007, to fill the Congressional seat vacated due to the death of Rep. Juanita Millender-McDonald. However, the current Los Angeles system will NOT be used in 2008 or thereafter.

June 20th has past and gone. If the State does not have the source code than it should sue or prosecute to the full extent of the law immediately! How do they know whether or not the source code is being altered or replaced while they wait? A court order should be sought to release the code and Iron Mountain should be held in contempt if it refuses to abide by the order.
