The fight to count every vote in FL and GA gets messier still, as Dems pick up yet another U.S. House seat; Also: Ernest A. Canning on CNN's lawsuit against the Trump White House...
By Brad Friedman on 11/14/2018 6:32pm PT

On today's BradCast: The electoral dysfunction --- and the fight to count every vote anyway --- continues today in Florida and Georgia, along with some new good news for Democrats elsewhere. At the same time, of course, the dysfunction of Donald Trump's White House never ends. [Audio link to full show is posted below.]

After a quick update today on several thousand newly tabulated votes in Georgia (most of which were for Democrat Stacey Abrams in her uphill battle for Governor against Republican vote suppressor Brian Kemp), we start today with news that another U.S. House seat has flipped from "red" to "blue" in California. As the counting continues in the Golden State, the AP and others declared first-time Democratic candidate Josh Harder the winner over four-term Republican U.S. Rep Jeff Denham in the previously GOP-leaning Central Valley.

That brings Dems to a 33-seat pickup, so far, in U.S. House contests this year. A number of other races in previously very Republican areas of California, such as Orange County, have already been declared as flipped to Democrats, with several others still undecided but trending towards Democrats. Those remaining undecided House races and a few in other states could ultimately result in a massive "Blue Wave" as large as 39 new seats in Congress, by my count, as votes from the November 6th midterms continue to be tallied.

In Florida, however, as the state's 67 counties scramble to complete an unprecedented three statewide computer "recounts" in the U.S. Senate, Governor and Agriculture Commissioner races (not to mention several other state legislative and local races) by this Thursday at 3pm, dozens of lawsuits are being filed in state and federal courts.

We cover some of the most notable today, including incumbent Sen. Bill Nelson's suit to extend the arbitrary "recount" deadline set for Thursday. At least one county, Democratic-leaning Palm Beach, has already said that it will be physically impossible to complete all of the machine rescans there in time, thanks to their aging computer tabulation system which can only scan one single race on 300 ballots at a time. Making matters still worse in the state's third most-populous county, those scanners reportedly overheated this week, leading to mismatched tabulations for the first batch of 174,000 ballots scanned (of some 700,000 total). That means that batch will need to be re-rescanned.

And all of that before a similarly absurd statutory Sunday deadline to complete any subsequent so-called "manual recounts" in races such as Nelson's U.S. Senate contest against Republican Gov. Rick Scott, where the margin is less than 0.25 percent. (It's currently reported to be just 0.13%, or 12,562 votes out of more than 8 million cast.)

Nelson has asked a federal court to extend the deadlines in all 67 Florida counties and, in separate filings, seeks to force a review of tens of thousands of absentee vote-by-mail ballots rejected across the state due to claims of signature mismatches and other unspecified "voter-caused error". Scott's hand-picked Sec. of State Ken Detzner is opposing those suits, and Scott has filed several of his own to try and halt the ongoing tabulation.

But not all Republicans oppose extending the deadlines and counting of all ballots, as we also note today, even as most of them, including the President of the United States, are calling for "recounts" to end and incomplete tallies reported from last weekend --- just days after the Tuesday midterms --- to be certified instead. (Friendly reminder here that Republicans held up a statewide hand-count in the 2008 U.S. Senate race in Minnesota for eight months in order to keep Al Franken from being seated in the Senate until July of 2009!)

Then, we're joined by BradBlog.com legal analyst ERNEST A. CANNING for the latest on the lawsuit filed by CNN this week (and supported by Fox "News" of all outlets!) against the White House for their removal of press credentials for White House Correspondent Jim Acosta. Not only is the White House in violation of the Constitution's First and Fifth Amendments, the complaint alleges, but the White House and Secret Service also reportedly blocked Acosta from a planned interview with French President Emmanuel Macron last weekend at an event marking the centennial of the WWI Armistice. That, even though the interview was approved by France...and Trump failed to even show up at the event!...

Cites violations of Constitutional First and Fifth Amendment rights...
UPDATE: Court temporarily reinstates Acosta press pass re due process; defers First Amendment decision...
By Ernest A. Canning on 11/14/2018 10:05am PT

On Tuesday, CNN, along with its Chief White House Correspondent, Jim Acosta, filed a federal complaint alleging President Donald J. Trump and high level White House personnel, including Press Secretary Sarah Huckabee Sanders and the U.S. Secret Service, violated their First Amendment free press rights to access White House press facilities.

They also allege the Trump administration violated their Fifth Amendment rights to due process when, without notice or a compelling reason for doing so, the White House rescinded Acosta's press credentials and seized his "hard pass" following a contentious November 7 Presidential press conference.

The complaint goes on to charge that the news organization's First Amendment rights were violated a second time on November 9, when Acosta traveled to France to cover the President's visit and to interview French President Emmanuel Macron during the centenary events commemorating the end of World War I. "The Secret Service refused to allow Acosta to attend an allegedly 'open' press event whose attendees included journalists from around the world," according to the CNN complaint. They did so even though "the French government issued credentials to Acosta." (Ironically, as they also note, Trump did not attend the event "due to inclement weather.")

Citing both facts and case law, the CNN complaint sets forth the argument that the President's actions against both Acosta and the news outlet amounted to an unlawful "attempt to censor the press and exclude reporters from the White House who challenge or dispute the President's point of view". However, that compelling argument, which is now supported by the White House Correspondents' Association, the ACLU and even by Fox "News", may not carry the day at the District Court level given that the case has been assigned to Judge Timothy J. Kelly, a Trump appointee...

Guest-host Angie Coiro with Trita Parsi, Julie Lythcott-Hamis...
By Angie Coiro on 5/8/2018 7:07pm PT

On today's BradCast, guest hosted by me, Angie Coiro, it's Iran Iran Iran - today's developments and (with help from the BradCast archive) historical context. Then a changeup - the second of our interviews about growing up a black woman in America.

Israel is one of the few supporters of Donald Trump's move to disengage from the 2015 international nuclear agreement with Iran. Up front in the show, a collection of less favorable - and sometimes frankly mystified - reactions from world leaders, mainstream media, and social media.

Then for invaluable context: Brad's October interview with Trita Parsi of The National Iranian American Council . They detail the runup to today's developments: how Congress addressed the issue, and the potential it has to start a war.

Finally, it's the second part of this week's look at growing up black and female in America. Today's perspective comes from academic and memoirist Julie Lythcott-Haims, with her book Real American. Her life with a black dad and a white mom makes an interesting contrast to yesterday's guest Morgan Jerkins, with Julie coming of age in the 1970s. That was a very different America (although not different enough, as you'll hear) from what Morgan experienced in the aughts.

You can hear both of those interviews uncut at the In Deep with Angie Coiro podcast page.

Teachers walk out in AZ, CO; Cosby found guilty; GOP Senate majority threatened; Pompeo confirmed as Sec. of State; Jackson withdraws as VA nom; EPA's Pruitt ducks responsibility in House; Macron slams Trump...
By Brad Friedman on 4/26/2018 6:38pm PT

At long last, we're beginning to see shades, shadows, clouds of accountability rolling in across D.C. and even elsewhere in the country. Many of those clouds seemed to roll in all at once today for some reason, but we cover as many as we can on today's BradCast. [Audio link to full show is posted below.]

Among the stories on today's busy program...

  • Huge explosions, a raging fire, and 10-mile evacuations at another oil refinery today, this time in Wisconsin;
  • Bill Cosby is found guilty on three felony counts of drugging and sexually assaulting a woman and now faces the rest of his life in prison;
  • Tens of thousands of teachers walked out in Arizona and Colorado on Thursday, demanding increased funding for education after years of slashed state budgets to help pay for tax cuts to the rich and corporations;
  • A spate of new polling suggest Senate Republicans may face a storm of accountability this November, with encouraging numbers for Democratic candidates in at least three different states --- Arizona, Tennessee and Nevada --- where they hope to flip "red" seats to "blue" to regain majority control of the upper chamber of Congress this fall. (And also in a fourth state, if you include Texas, where Sen. Ted Cruz' challenger Rep. Beto O'Rourke is now within "too close to call" striking distance, according to new polling, even as the Democrat is refusing corporate and super PAC funding, even from billionaire Tom Steyer);
  • No accountability to date, however, for the anti-gay, anti-Muslim, anti-environment, pro-war CIA Director Mike Pompeo, who was narrowly confirmed in the U.S. Senate today as Donald Trump's new Secretary of State;
  • The Senate Judiciary Committee voted to approve a bi-partisan bill to protect Special Counsel Robert Mueller from being fired by Trump, though obstructionism from GOP leadership in the full Senate and U.S. House will likely prevent the legislation from going any further;
  • Admiral Ronny Jackson, Trump's personal White House physician and his nominee to head the Dept. of Veterans Affairs finally withdrew his name from consideration following a host of damning allegations from current and former White House and military co-workers unearthed by Sen. Jon Tester (MT), the ranking Democratic member of the Senate Veterans Affairs Committee;
  • Trump's wildly corrupt and scandal-plagued EPA chief Scott Pruitt finally faced a bit of accountability, at least from Dems, as he testified before two separate House Committees on Thursday and refused to answer many direct questions, threw much of his staff under the bus, and denied responsibility for the mountain of personal corruption scandals he continues to face --- even as bi-partisan calls for his resignation continue;
  • And, finally, Desi Doyen joins us for the latest Green News Report, with more on Pruitt's anti-climate perfidy, French President Emmanuel Macron's blistering swipes at President Trump's environmental record during a joint session of Congress, and much more.

Yes, it was another insanely busy news day, but we gotcha covered, in one fast moving hour today. Buckle up!...

Guest: Journalist David Dayen of The Nation...
By Brad Friedman on 9/21/2017 6:09pm PT

On today's BradCast, the "fun" from this week's United Nations General Assembly continues today, with the leaders of both Iran and North Korea pushing back against incendiary comments by the U.S. President. And the "fun" in the U.S. Senate continues as well, as the GOP frantically attempts (again) to repeal 'ObamaCare' at the very last minute. [Audio link to show follows below...]

First up, in response to Donald Trump's threat earlier in the week at the U.N. to "completely destroy" his country, North Korean leader Kim Jong Un called Trump "deranged" and said he would "pay dearly" for those threats and, undoubtedly, for new financial sanctions Trump announced today via executive order. (We also discuss questions about Trump's claims regarding China with those new sanctions.)

For his part, Iranian President Hassan Rouhani lashed back at Trump's characterization of Iran as a "murderous regime" and a "corrupt dictatorship", calling the remarks "ignorant, absurd and hateful" and coming from "rogue newcomers to the world of politics." And, at the same time, Trump surprised his own top cabinet officials this week by claiming he'd made a "decision" regarding the anti-nuclear arms agreement struck in 2015 with Iran (and China, Russia, France, UK and Germany), even as the US, the other nations in the deal, and the International Atomic Energy Association (IAEA) all agreed that Iran had fully upheld its side of the bargain to date.

If Trump is seen as willing to break that multilateral international deal --- on the heels of withdrawing from the landmark global Paris Climate Agreement --- should any nation in the world, much less North Korea, even consider making a deal with the U.S. and Donald Trump? We discuss.

Then, Republicans in the U.S. Senate are frantically hoping to pass a bill to finally repeal the Affordable Care Act ("ObamaCare") before the end of next week, when Senate rules will make it much harder, if not impossible, to do so. The latest attempt, the Graham-Cassidy-Heller-Johnson bill, would take billions of dollars from so-called "blue states" that expanded Medicaid and radically increased the number of insured citizens under ObamaCare, and give those dollars to "red states" instead --- before tossing Medicaid recipients in all states over a cliff in 2027.

Financial journalist and author DAVID DAYEN of The Nation and The Intercept (and everywhere else) joins us today to detail what he describes as the "shocking dishonesty" of the particularly hypocritical sales pitch Republican sponsors of the legislation are deploying in hopes of boondoggling lawmakers and the public in a desperate bid to justify passage of the unpopular scheme. We also discuss/debate why the Senate GOP is so eager to pass legislation that will result in the loss of health care for millions, including many of their own voters, and whether Republicans in the U.S. House will be willing to go along with it.

Finally, Desi Doyen joins us for the latest Green News Report' following the record Hurricane Maria's devastating landfall on Puerto Rico, the latest catastrophic earthquake in Mexico, and more fallout from world leaders following Trump's address at the U.N...

Guest: Investigative journalist Rachel Leven | Also: Catastrophic Hurricane Maria in Puerto Rico, 7.1 M earthquake in Mexico...
By Brad Friedman on 9/20/2017 6:13pm PT

We shine a spotlight on a whole lot of hypocrisy --- both corporate and political --- on today's BradCast. [Audio link to show follows below.]

But first, we begin with the seeming unending string of natural disasters slamming North America of late. After a quick riposte from French President Emmanuel Macron in response to U.S. President Donald Trump's failure at the U.N. General Assembly to mention "climate change" or his withdraw from the Paris Climate Agreement on Tuesday --- even as yet another Category 5 hurricane was about to slam the U.S. --- we cover the latest on several ongoing disasters. In Mexico, hundreds are dead and as many as a thousand still unaccounted for following Tuesday's catastrophic earthquake. And, in Puerto Rico, the power is out across the entire island after the record winds and rain of Hurricane Maria slammed ashore early on Wednesday, putting some 3.5 million U.S. citizens in dire danger.

Then, amidst all of that, Republicans continue their last ditch frantic attempt to repeal and replace ObamaCare before a deadline will make it much more difficult to do so at the end of the month. That, despite the Affordable Care Act's continuing success in helping to provide medical care to tens of millions of Americans, and the fact that the latest GOP repeal scheme will seriously hurt those in both 'red' and 'blue' states with enormous cuts to health care funding and the gutting of many long-sought protections offered by the Affordable Care Act.

Most galling, perhaps, is the hypocrisy of Republican U.S. Sen. Bill Cassidy of Louisiana (pictured above), one of the new bill's lead sponsors and a doctor himself. Cassidy had publicly promised, during the last round of GOP attempts to gut ObamaCare, that he would vote against any scheme that did not pass what he dubbed at the time as "The Jimmy Kimmel Test". That was a reference to the touching story regarding the late night comedian's son who was born with congenital heart disease during the previous attempts by Republicans to kill the ACA earlier this year.

On Tuesday night, at the top of his show, Kimmel offered a sharp and very well-informed response to Cassidy's hypocrisy. We share that accurate response on today's show.

Finally, speaking of remarkable hypocrisy, we're joined by investigative journalist RACHEL LEVEN of The Center for Public Integrity to discuss her new exposé this week, with Jamie Smith Hopkins, documenting dozens of major U.S. corporations --- from Google to eBay to Walmart to Coca-Cola to General Electric and more --- who publicly declared their "opposition" to Trump's withdrawal from the Paris Climate Agreement, even while those very same companies invested millions of dollars in a Republican political group leading the fight to kill the Obama plan meant to meet the emissions reduction standards under the landmark global pact...

Guest: John Judis of TPM; Also: Hurricane Maria devastates Caribbean, new earthquake devastates central Mexico...
By Brad Friedman on 9/19/2017 6:09pm PT

Today on The BradCast, its yet another day with an impossibly huge number of important breaking news stories to cover. But we try. Along with some conversation about a potential ray of sunlight for Democrats. [Audio link to show follows below.]

First up, the President of the United States threatened to "totally destroy" North Korea and called its leader names from the dias, during his first address to a U.N. General Assembly today. Donald Trump went on to call Iran a "rogue nation", describing the deal struck between between Iran and six other nations (U.S., Russia, China, France, Germany and UK) to prevent Iran from developing nuclear weapons, "an embarrassment" and "the worst" agreement the U.S. has ever made.

Allies and adversaries alike pushed back at the U.S. President. * North Korea dismissed "impotent threats by international shouting magnate Donald Trump...as the twitchings of a Dog licking its flea-riddled scrotum"; Iran's President charged the U.S. would "pay a high price" if it withdraws from the nuclear pact by losing both "trust and credibility" with the rest of the world; and France's Emmanuel Macron chided Trump for failing to mention climate change (speaking of hard-fought agreements that Trump hopes to abandon) during his address, and said that if the U.S. renounced the nuclear deal with Iran, which the French President described as "essential for peace", it would be a "grave error".

Meanwhile, in D.C., Democrats and health care advocates are sounding the alarm about the latest frantic Republican attempt in the U.S. Senate to "repeal and replace" the Affordable Care Act before the option to do so with only 50 votes is over at the end of this month. The latest Senate GOP scheme is a bill that would end ObamaCare's premium subsidies and expansion of Medicaid by handing limited block grants to states who, they say, should decide how health care money is best spent. Despite that, one Republican Senator is attempting to add an amendment to the measure that would bar all states from using those federal grants for a single-payer type system, if they so choose.

All of that, just after Vermont's independent Sen. Bernie Sanders introduced a "Medicare-for-All" bill last week with the support of 16 Senate Democrats. We're joined today by TPM's Editor-at-Large JOHN JUDIS to discuss the politics behind Sanders' plan, whether its aspirational goals outweigh its "political dangers", and if it might serve to help the Democratic Party overcome the "thinktank incrementalism" in which, Judis charges, the party has long been mired.

"Health care is something that really should not be in the hands of private corporations that deal with health care in order to make a profit for their stockholders [and] raise the incomes of their executives," Judis argues. "And I think a lot of Americans are coming to feel that way. And, in fact, I think we've felt this way since 1948. It's a longstanding issue in America."

While detailing political perils that Dems will face in pressing the measure and noting that he doesn't believe that support of Medicare-for-All should necessarily be a "litmus test" for every Democrat running for office, Judis explains why "a vision, a horizon to look beyond" is very important to the Democratic Party which, he says, has "been bereft of a kind of visionary component" for many decades. It is the "responsibility of a party to put forward what people might want and not just what you could achieve in Congress over the next month, or year, or two years."

Finally, Desi Doyen joins us for the latest Green News Report, as Hurricane Maria devastates the Caribbean in Irma's path, Trump continues to deny the link between climate and extreme weather, his Administration prepares to shrink a number of national monuments, and as the UN celebrates 30 years since the wildly successful Montreal Protocol pact began curbing global CFC emissions that had been destroying Earth's ozone layer. Also, late news on the 7.1 magnitude earthquake that struck central Mexico today, collapsing buildings and, so far, killing at least than 120 people...

* CORRECTION: Oh, noes! Even I got punked this time on today's show by fake news! That quote above from the "DPRK News Service", as good and North Korean sounding as it may be, is actually from a parody account! Though, as Washington Post has reported, it's a very persuasive one that larger news outlets than me have taken as real in the past! So, I guess I'll take some solace from that. Sorry for the error!

By Brad Friedman on 6/7/2017 5:58pm PT

On today's BradCast, it's great to be back live at our flagship Los Angeles affiliate station, KPFK on the Pacifica Radio Network in Los Angeles after their recent fund drive. So we throw open the phones to listeners in celebration after several insanely busy news weeks! [Audio link to show is posted below.]

But, first, former FBI Director James Comey released his prepared statement [PDF] in advance of his much-anticipated testimony on Thursday before the U.S. Senate Intelligence committee. In the remarks, Comey details a number of his one-on-one meetings with and phone calls from Donald Trump, including the infamous "loyalty dinner" at the White House in late January and the similarly-infamous early-February meeting in the Oval Office, the day after National Security Adviser Michael Flynn was forced to resign, where Comey charges that he was asked by the President to end the FBI's investigation of Flynn.

We review the details of that prepared testimony, including Comey's confirmation that he did, in fact, indicate to Trump on three different occasions that he was not personally being investigated by the Bureau at the time. Trump's personal attorney cites that testimony to claim the President is "completely and totally vindicated" by it. Others, however, regard the testimony as "explosive" and as confirmation that Trump attempted to obstruct justice.

Also today, more on the leaked NSA analysis charging that Russian intelligence attempted to access the computers of election officials around the country after successfully sending spear-phishing emails to employees at a private voter registration firm. That rather rudimentary hacking effort just before last year's election, no matter who did it (as explained in much more detail on yesterday's show), may have allowed access for the intruders to the computers that program voting machines, results tabulators and voter registration systems around the country. Also, NSA whistleblower Edward Snowden's offers a response to the arrest of the alleged leaker, Reality Leigh Winner, and the charges filed against her under the 1917 Espionage Act.

Then, as just-retired Dir. of National Intelligence James Clapper charges "Watergate pales...compared to what we're confronting now," we take calls on all of the above and whether listeners believe Democrats should begin impeachment proceedings against Trump (as The Nation's John Nichols argued earlier this week on the show) or at least promise such proceedings if they are elected to the majority in Congress in 2018. We received some rather surprising answers to that question from callers, as well as in regard to the charges filed against Winner!

Finally, we're joined by Desi Doyen with the latest Green News Report on the swift and global fallout following Trump's decision to pull the U.S. out of the historic Paris Climate Agreement...
