Lots of bad news on today's BradCast for Trump and the Republican's in Congress as they head home for their long summer recess. And several astonishing followups to major voting-related stories we broke earlier in the week out of North Carolina and Georgia. [Audio link to full show is posted below.]

First up, several big stories out of Congress today, none of them good for the President or Republicans...

  • The GOP's only black U.S. House member, Rep. Will Hurd of Texas, says he won't run again in 2020. The stunning announcement Thursday night represents a huge pickup opportunity for Dems in a state slowing turning "blue", and just the latest in a quickly growing string of GOPers calling it quits in the House;
  • On Friday, Donald Trump abruptly pulled his 5-day old nomination of TX Rep. John Ratcliffe to become the nation's next spy chief. Ratcliffe, after attacking former Special Counsel Robert Mueller during hearings in the House last week, was tapped by the President to replace Director of National Intelligence Dan Coats, who publicly contradicted Trump on Russian interference in U.S. elections, Iran compliance with the landmark nuclear pact that Trump violated and pulled out of, and on the national security threat of climate change, among other things. Ratcliffe, however, was revealed to have had no previous intelligence experience, as required by statute for the DNI role overseeing the nation's 17 intelligence agencies, and was found to have lied about past claims to have prosecuted terrorists;
  • And, in more bad news for Trump on Friday, a majority of House Democrats have now publicly called for an official impeachment inquiry of the President. CA Rep. Salud Carbajal became the 118th out of 235 House Dems to publicly call for an inquiry to begin. With the majority of her caucus now supporting impeachment proceedings, it remains to be seen if House Speaker Nancy Pelosi will finally modify her current position to allow Dems only to "legislate, investigate and litigate". House Judiciary Chair Jerry Nadler recently filed a court motion seeking grand jury information from the Mueller investigation which, for the first time, referenced a need for the documents due to Congressional consideration of impeachment proceedings.

Then, several (occasionally amazing) follow-ups to stories we broke earlier in the week regarding the citizen-led fights for publicly overseeable elections and hand-marked paper ballots in two key swing states.

First, on Tuesday's program we detailed what appeared to be a "win", if a short-lived one, by election integrity advocates in North Carolina, after they'd convinced the state Board of Elections, in a 3 to 2 vote, to adopt a resolution effectively blocking the certification of a 100% unverifiable computer touchscreen Ballot Marking Device made by ES&S, the nation's largest (and sleaziest) private voting vendor. That vote, if finalized next month, would likely result in hand-marked paper ballots across the entire state in next year's crucial Presidential election. The powerful ES&S is currently the only voting system vendor certified to do business in the closely divided battle ground state.

But, in reporting that story on Tuesday, we also broke the news that one of the three "yes" votes on the resolution blocking ES&S, Republican David Black, had changed his mind, leading to a new meeting --- and a revote on the resolution --- called for Thursday. Black's reversal would mean a 3 to 2 vote in FAVOR of ES&S' new, 100% unverifiable touchscreen systems for counties currently serving some 2.5 million voters whose current, older 100% unverifiable touchscreen voting systems are set to be certified, by state law, at year's end.

But, a funny thing happened before the Thursday revote, after the state Board's Chairman, Democrat Robert Cordle --- who had voted against the resolution on Monday --- told a wildly inappropriate joke to open a state conference of some 600 election officials. He was subsequently forced to resign by the Governor, resulting in Thursday's re-vote becoming a 2 to 2 deadlock, leaving the initial vote, which could lead to hand-marked paper ballots for all NC voters, in place.

There will be yet another vote --- the formal vote on the resolution --- on August 23rd, when whoever Democratic Gov. Roy Cooper names as the new Chair to the beleaguered 5-person Board, will be able to cast the decisive vote to determine if the key swing state will have verifiable elections in 2020 or not. And, yes, we share the "dirty joke" in question, about a woman and a cow, on today's program;

Then, we also have a follow-up to a story we broke on Monday's BradCast, regarding the federal lawsuit seeking to ban Georgia's 100% unverifiable touchscreen voting systems in favor of hand-marked paper ballots before the 2020 Presidential election. On Monday, plaintiff Marilyn Marks of the Coalition for Good Governance, joined us on the show to describe a revelation from a court hearing latest last week in which a witness from Georgia's Sec. of State's office revealed that all voting machines across the state in 2018 were programmed, without oversight, by three independent contractors working for ES&S out of their garages, using unsecured home WiFi.

Last night, the UK's Guardian picked up the story about the state's fully-outsourced elections, confirming our reporting from earlier in the week and adding a number of additional disturbing details. Among those new details: Georgia's entire voter registration system was similarly outsourced to a private company which even contractually disallowed the Sec. of State's office from having access to the network. More alarmingly, however, as the Guardian's Jordan Wilkie reports, during security penetration tests, a third-party (fourth-party?) cybersecurity company contracted by the state, found that it was able to "take over the entire network". Moreover, in November of 2018, a year later, in a second round of testing just before last year's midterms, many of the vulnerabilities discovered during the initial test remained unresolved.

Until last week's hearing, when much of this information was revealed on the stand for the first time during questioning of the Sec. of State's chief information officer, the state had completely misled the federal court about all of the above and more.

Finally today, some very grim news out of the Arctic, where Greenland, over the past week, has gone through an extraordinary melt event, with record high temperatures --- 10 to 30 degrees above the normal average --- resulting in the loss of some 10 billion tons of ice over the past day or two, with nearly 200 billion tons of water pouring into the Atlantic Ocean during the month of July. How's that for a cheery way to end the week? You're welcome!

On today's BradCast, some potentially good news for Philadelphia voters (and, thus, voters across the entire country), after a citizen led effort has resulted in the state of Pennsylvania re-examining its certification of a shockingly vulnerable --- and wholly unverifiable --- new touchscreen voting system selected by the city earlier this year (under questionable circumstances) for use in upcoming elections. [Audio link to show is posted below.]

But first up, before we get to our guest today and the astonishing election integrity nightmare against which he is working with a coaltion on the ground in Philly to try and save democracy there, a few quick news items to start the show. Those include the now-deadly, climate change-fueled heat wave bearing down on dozens of states and millions of Americans and the latest on the dangerously intensifying disputes in the Persian Gulf --- thanks to Trump pulling out of the landmark 2015 anti-nuclear deal.

Then, last May, Sen. Ron Wyden (D-OR) introduced a bill in the U.S. Senate that would mandate HAND-MARKED paper ballots for every voter in the country, to help hedge against the possibility --- some may say likelihood --- of manipulated or erroneous elections results, and to help assure that results are publicly verifiable after elections. His bill, the Protect America's Voting and Elections (or PAVE) Act of 2019 now languishes in the Senate, despite passage of a bill in the House that also mandates HAND-MARKED paper ballots for all, thanks to Republican Majority Leader Mitch McConnell's vow to disallow a vote on any election-related bills that might make our democracy more secure and overseeable in advance of the 2020 Presidential elections.

The White House has been similarly disinterested in improving election security and oversight, though Trump-appointed Director of National Intelligence, Dan Coats, the nation's "top spy" announced a new initiative today said to help the Intelligence Community coordinate their response to potential election manipulation, at least from foreign threats. Domestic threats, including from election insiders --- such as contractors from the private vendors who run much of America's elections, as well as simple programming errors or other manipulation by elections officials --- remain both as serious and much more difficult to guard against. Election protection ultimately comes down to public oversight, at the local level, of verified election results.

To that end, an Election Integrity coalition in Philadelphia this week has successfully petitioned the state of Pennsylvania to reexamine the Commonwealth's previous certification of a wildly dangerous and vulnerable new computer Ballot Marking Device (BMD) made by the nation's largest (and, arguably, most failed) private vendor, Election Systems and Software, Inc. (ES&S). The company's new ExpressVote XL is a 100% unverifiable touchscreen BMD system recently contracted for use by the Philadelphia Elections Board for use in upcoming elections, beginning with municipal elections this November and the Presidential contest next year.

We're joined today by KEVIN SKOGLUND, election integrity expert and Chief Technologist for the non-partisan Citizens for Better Elections, which, along with others in the Protect Our Vote Philly coalition petitioned the state for a re-examination of the ExpressVote XL. The costly voting and tabulation system --- one must be purchased for each voter voting at the same time in every precinct --- is described as a "universal" or "all-in-one" system, because one computer in the system is used to mark and print a voters ballot, and a second computer in the same system is then used to optically-scan and tabulate that ballot.

The system, chosen under a mysteriously truncated process by the Philadelphia Commissioners earlier this year --- "without any public or expert input" and with "no criteria for things like security, and resilience, and accessibility" as Skoglund tells me --- also violates state election code in numerous ways, as detailed in the citizen groups' petition to the state filed on Tuesday. Most alarmingly, however --- especially given the importance of Philly's one million votes to be cast in the crucial Keystone State during next year's Presidential election --- is a remarkable security design flaw in the ES&S ExpressVote XL.

In short (Skoglund offers more details on the show), the system allows the Ballot Marking Device's printer to change votes on the computer-printed ballot summary card before it is tallied but after the voter has already been given the opportunity to approve what was initially printed on the ballot summary card by the computer! In other words, of all of the terrible, 100% unverifiable BMD voting systems that Pennsylvania's Democratic stronghold of Philadelphia could have chosen, its City Commission chose the absolute most dangerous and unverifiable one.

"After this machine was certified in Pennsylvania, security researchers determined that there was a big flaw in these machines. That flaw is that they have a single paper path. It takes the blank piece of paper, it sends it to a printer, you make your selections on the screen, it prints those on the piece of paper, puts them back in front of the voter so that the voter can look at them and say whether or not they're happy with those selections. And once the voter says 'Yes, this is the ballot that I intend to cast, I am happy with these selections' and they press the button on the machine, it sends that card back through the same printer again before it goes to to the tabulator," Skoglund explains. "That means the machine has the opportunity to mark on that ballot --- potentially changing votes on it, invalidating votes on it, adding votes to it, basically changing what the voter cast." And, of course, the voter would never know.

While recent studies have found that most voters do not even bother to verify computer-marked paper ballots, and that of those who do, many do not notice if the computer has changed their selections, "The voter can do everything that's asked of them, do everything right, they can verify that ballot, and it still might not end up being the vote that gets cast. This is a violation of a fundamental principle of being able to audit these paper ballots. It's the whole reason we're going to paper ballots, to have good evidence of what the voter intended."

Skoglund explains, however, that it's not just Philadelphia preparing to use these systems in 2020. Other counties in PA are considering them as well, even though they are at least twice the price of a paper ballot system. Similarly states such as New Jersey and Delaware are moving to these same, horrible, unsecure systems. Elsewhere, jurisdictions from Georgia to Ohio to Kansas to Texas to Los Angeles are all preparing to move to only slightly less vulnerable (if equally unverifiable) BMD systems for 2020. That, instead of simpler, cheaper and actually verifiable HAND-MARKED paper ballot systems.

All of that is just part of what we discuss with Skoglund today that will likely leave your jaw hanging open as you wonder what the hell these people are thinking, and why it is that McConnell has disallowed Wyden's PAVE Act --- requiring HAND-MARKED paper ballots for all --- from becoming the law of the land long ago...

On today's BradCast: Some encouraging news for democracy (at least in Georgia), some predictable lies from the Senate Majority leader, a gentle rebuke for Trump from both parties, and a call for intervention from the Senate Minority Leader, among other things.

Just some of the many stories covered on today's program...

  • Georgia Democrat and potential U.S. Senate candidate Stacey Abrams, who will be giving the Democratic response to the State of the Union Address on Tuesday, is set to run a television ad during Sunday's Super Bowl in Atlanta with a north Georgia Republican County Commissioner calling for HAND-MARKED paper ballots in the state!

    The ad is sponsored by Abrams' non-partisan voting rights organization Fair Fight, formed after Abrams is said to have very narrowly lost her contest to become the nation's first African-American female governor last November to Republican Secretary of State and champion vote suppressor Brian Kemp. Both he and his GOP successor are now calling for the state's 100% unverifiable touchscreen voting systems to be replaced with new, very expensive and also 100% unverifiable touchscreen systems that produce computer-marked, human-unreadable barcoded ballot summary cards, rather than hand-marked paper ballots which computer science and voting systems experts all agree [PDF] to be the most secure, auditable and overseeable way to carry out elections;
  • In the U.S. Senate, Republican Majority Leader Mitch McConnell offered a huge lie about the Democrats' "For the People Act" (HR-1), recently introduced in the U.S. House to call for a series of major election reforms. Among the many provisions in the measure --- such as universal automatic voter registration, expanded early voting, ending partisan gerrymandering and yes, ensuring a HAND-MARKED paper ballot for every voter --- it also seeks to declare Election Day as a federal holiday. Naturally, McConnell lied about what the bill calls for on that point, and absurdly describes the measure as a "Democrat power-grab". We respond;
  • Also in the U.S. Senate, Democratic Minority Leader Chuck Schumer sent a letter to Trump's Director of National Intelligence Dan Coats calling for him and the other Administration Intelligence Chiefs to "stage an intervention" with the Commander-in-Chief, after Donald Trump described his own top intel officials on Wednesday as "wrong", "naive" and needing to "go back to school!" on a host of foreign policy issues. Trump's remarks came in response to the Intelligence Community's new annual "Worldwide Threat Assessment" PDF. The report, and Senate testimony from the chiefs about it on Tuesday, argues that Trump is essentially wrong on everything from North Korea, to Iran, to ISIS to Syria and Afghanistan, and on his claims about an imagined "national emergency" at the U.S. -Mexico board.
  • But if Schumer really wants to "stage an intervention" with this President, his Democrats in the Senate and House could be calling for an immediate Impeachment inquiry. As detailed by Ernest Canning at BradBlog.com this week, the Nixon impeachment process reveals that it is both unnecessary and, arguably, unwise for Dems to wait for a report from the Special Counsel investigation before exercising their Constitutional duty;
  • Also today, Republicans and about half of Senate Democrats passed an amendment that (gently) rebukes the President by calling for U.S. troops to remain in both Syria and Afghanistan, in contrast to Trump's recent military directives;
  • An upside to the recent federal government shutdown? A beach in Northern California that had been closed will remain closed, because elephant seals have taken it over;
  • And, finally, Desi Doyen joins us for the latest Green News Report, with updates on the record bone-chilling --- and deadly --- Polar Vortex cold snap in the Midwest and Northeast, evidence that Trump's intervention in Venezuela is, of course, all about oil, and some good news out of Germany which is now on its way to quitting coal entirely...

On today's BradCast: Baby, it's COLD outside in much of the Midwest and Northeast. Record cold, in fact, with wind chills dipping near an unfathomable 60 degrees below zero in some parts of the country, as discussed with --- and explained by --- our guest today. But, first up: Donald Trump's own top intelligence chiefs --- the FBI and CIA Directors as well as his Director of National Intelligence and others --- all directly contradicted the Commander-in-Chief on matters of foreign affairs this week, from the nuclear threat posed by North Korea, to the continuing threat from ISIS in Syria and Iraq, to the cybersecurity threat to elections posted by China and Russia, and to the lack of nuclear threat from Iran or at the U.S.-Mexico border.

Testifying before the U.S. Senate Intelligence Committee on Tuesday, the intel heads --- appointed by Trump himself (not so-called "Deep State Obama Democrats") --- expanded on their newly published annual "Worldwide Threat Assessment" [PDF]. As it turns out, neither the new report nor the officials themselves cite border concerns as any sort of danger to the nation, despite Trump's persistent and unsupported claims to the contrary and his threat to declare a "National Emergency" if he's not given $5.7 billion for his southern border wall before the Continuing Resolution for government funding runs out, once again, on February 15. Today, in response, Trump mocked his own intel staff as "naive".

The testimony from Trump's own intel chiefs is likely to be used against the President in court, should he declare that "emergency", according to U.S. House Intel Committee chair Adam Schiff (D-CA). But, as Democratic Committee member Rep. Jackie Speier (D-CA), points out, House Republicans have yet to actually appoint their members to either that Committee or three others (on Climate Change, Ethics or House Administration, which handles election challenges, such as the one in North Carolina's 9th Congressional District, where the House seat is still empty due to a GOP absentee ballot election fraud scandal.) Those committees may not proceed with virtually any business until House Republicans appoint their members and end the purposeful slow-walking.

After that warm up, it's on to the sub-freezing temps that have kept even the U.S. Post Office from completing their appointed rounds in a number of states. Of course, the big chill has led the Fox "News" clowns and climate change Denier-in-Chief to have a grand old time avoiding the actual scientific explanation for the bone-numbing depression in the Polar Vortex which, yes, is tied to global warming.

We're joined today by "Climate Guy" GUY WALTON, a 30-year Weather Channel veteran meteorologist, for some actual science on what's going on. Walton pens a daily "Extreme Temperature Diary" and is co-author, with Nick Walker, of the new (joyfully snarky) children's book and climate primer World of Thermo: Thermometer Rising.

Walton explains why and how global weather patterns have changed in recent years to bring bitter cold snaps like the one experienced this week in parts of the U.S., even as the rest of the globe --- like Australia, where temps have neared 120 degrees Fahrenheit and touched off record bush fires in recent days --- continues to suffer from record heat, thanks to anthropomorphic Global Warming. This "Age of Weather Extremes" is precisely in line with what climate scientists have long predicted.

"Right now, as far as global warming goes, we're having a lot of warmth from the sub-tropics moving northward over the polar areas, where, prior to, say, the 1970s, we hadn't been seeing that as much," he tells me. "What we had in the past, when we had Arctic outbreaks in the 70s and 80s, we had a larger, colder Polar Vortex encompassing the Northern Hemisphere. Now we have a warmer Polar Vortex which is not quite as large, and it's having a tendency to pinch off pieces...when they do pinch off, they're quite cold, and you can get cold air, colder than what you have right now at the North Pole, sitting right over say, Chicago or Detroit."

As to Trump's recent tweet making light of "Global Waming [sic]" amidst the Arctic blast, Walton argues: "A lot of this is out of greed, and to perhaps make more money through the fossil fuel industry. And to some extent, it's just denial, in that they know deep down the Titanic is sinking, they're just not wanting to admit that the ship's going to go under the water, so to speak."

Finally, some encouraging news today from the world of science, which we could have told you about (and, in fact, did!) years ago. A new "seminal study" finds that e-cigs or vaping is more than twice as likely to lead smokers to kick the habit than the use of Big Pharma-approved nicotine delivery systems such as patches and gums. While that may be bad news for Big Pharma's billion dollar nicotine industry, it's good news for the world which sees more than 6 million die annually thanks to tobacco, including nearly half a million alone here in the U.S. Now, if someone would just inform the Democrats in Congress and around the U.S. who are working to make it harder, not easier, for people to quit smoking and dying by moving to vaping, it would be VERY much appreciated...

Important U.S. House Special Election next Tuesday in Columbus, OH; Trump, GOP Congress lying about election security; Admin announces deadly scheme to rollback mileage, air quality standards; More...

On today's BradCast, if you're waiting for the government to save us by protecting elections --- or anything else --- that's not going to happen. But you can save us, as I explain today. [Audio link to show follows below.]

First up today, voters in Tennessee head to the polls for their midterm primaries (yes, on a Thursday! --- perhaps that's one of the reasons the state has among the lowest turnout rates in the country?), as voters elsewhere are preparing for next Tuesday's primaries in Kansas, Missouri, Michigan and Washington.

Also next Tuesday will be the final major U.S. House Special Election of the year before the midterms. The race is in Ohio's 12th Congressional District, a normally very "red" district centered in Columbus, where Republican Troy Balderson had, as recently as last month, been favored by some 10 points over Democrat Danny O'Connor. The race, however, has now become a dead heat, according to new polling from Monmouth and others. So, we have a few very specific and important thoughts for our friends and listeners in Columbus (on WGRN 94.1FM!) today regarding that contest. In short, as I explain: this long-held Republican seat --- in a district which both Romney and Trump reportedly won by some 10 points --- is now flippable, but it will require all hands on deck to do it next week (yes, including independent and Green Party voters!)

In the meantime, Donald Trump's White House paraded out a bunch of their top intelligence community officials to try and convince us all that they give a damn about election security before the November midterms. Don't believe them for a second. I explain why. Similarly, do not believe the Republicans in Congress who now pretend that they give a damn about election security, since, on Wednesday, they proved once again they do not. Every Republican Senator present, with the exception of TN's Bob Corker, voted against an appropriations amendment to give $250 million for additional election security to states. All Democrats voted in favor of the amendment, which received a majority 50-47 vote. But that wasn't enough to overcome the 60 vote filibuster threshold (which Republicans could have waived). That, on the same day the GOP-majority Senate easily approved a $717 billion defense authorization package --- in case you're wondering where their priorities really are.

As explained in an impassioned rant today, in response to all of the above, it's unclear that more money thrown at our computerized election systems would even result in more secure elections or those that Americans can have confidence in. When it comes to our elections and our democracy, and so much more, one thing is clear: "We are not going to be protected by Congress, or the White House, no matter who is in charge of either. The government is not going to save us here. We are going to save us here. We are the only chance that we have."

I offer a number of ways for folks to do exactly that on today's show, which I hope you'll share loudly and broadly. [Update: Desi has transcribed a bit of today's rant for easier sharing right here.]

Speaking of, as we warned on a recent BradCast, the Trump Administration has now formally announced their new scheme today to roll back automobile fuel-efficiency standards that had previously been worked out in an agreement between the Obama Administration, automakers and states like California who have stricter air quality standards than the federal government's. Trump's EPA, however, is hoping to block those new standards --- which experts say will save 40,000 lives per year thanks to cleaner air --- in favor of dirtier air more costly gas mileage for consumers. The Administration justifies the change with a dubious assertion that 1,000 lives per year will be saved, because it will be cheaper for Americans to purchase newer, safer cars --- never mind the higher fuel costs (approximately $170 billion over all) they'll have to pay.

The Administration which pretends to believe in "states' rights" is also moving with their newly proposed regulation to block California's legal right under the federal Clean Air Act to determine their own air quality and mileage standards. The state, and 16 others, have already filed suit against the proposed regulation. A public comment period is now open in response to the measure at this Regulations.gov docket page.

With Trump's own intel agencies warning of election hacks and the White House contradicting them, disturbing new revelations of voting system vulnerabilities may help explain a 2011 BRAD BLOG exclusive report...

As noted at the top of today's BradCast, it's worth buckling up before listening. [Audio link to show follows below.]

We begin, gently enough, with the news of California's Supreme Court temporarily nixing a billionaire's statewide initiative from this November's ballot which, if adopted, would split the state into three. We explain why the Court removed the measure, for now, thanks to a challenge by an environmental group.

Then, with Donald Trump's own Director of National Intelligence, Dan Coats, warning this past week that "the system is blinking red" in a way that hasn't been seen since just before the 9/11 attacks, the multiple and ever-changing positions by the President of the United States in recent days, regarding whether Russia interfered in the 2016 election and is actively doing so in advance of the 2018 midterms, is all the more head-spinning. Coats was referencing warning signs being reported by U.S. intelligence agencies regarding ongoing attacks and intrusions on America's critical infrastructure --- including our wildly vulnerable electoral systems.

Moreover, new reporting on Trump being read into explicit source details weeks before he was inaugurated in early 2017 regarding Russia's alleged 2016 election intrusion measures, make his ongoing denials, ever-changing positions, and dizzying White House spin to explain them all following Monday's summit with Putin in Helsinki, all the more bewildering. Nonetheless, his own intelligence apparatus and appointees continue to contradict the President, even as the GOP-controlled Congress fails to take any substantive action to either place a check on Trump or even to help protect this November's crucial elections.

At the same time, after the FBI informed Maryland just days ago that its entire election system was being hosted on a private commercial server said to be owned by a Russian oligarch tied to Putin (as discussed in detail on yesterday's BradCast), we learn this week that the top U.S. election system vendor, ES&S, has been lying about remote access software and modems installed, for many years, on systems still used by a majority of U.S. voters.

The new revelations may help explain an exclusive special report published by The BRAD BLOG back in 2011, with an officially-commissioned independent analysis finding that, among other concerns, Venango County, Pennsylvania's ES&S election management system had been accessed by an unknown and unauthorized computer for "several hours" from a remote location. As we reported at the time, ES&S and the County's Board of Commissioners went to considerable lengths, after those revelations, to block a further, independent forensic analysis of the system.

And now, perhaps, we may know why. Kim Zetter reports this week at Vice's Motherboard that the company lied to her and New York Times' fact-checkers earlier this year in advance of her February article at the paper on the inclusion of modems and pcAnywhere remote access software included with the election management systems sold to customers from 2000 to 2006. After previously insisting the company had no "knowledge that our voting systems have ever been sold with remote-access software", ES&S reversed itself in a letter to U.S. Senator Ron Wyden, she reports. But they have refused to respond to the Senator's subsequent follow-up queries or to appear at recent Senate hearings on U.S. election system vulnerabilities.

As Zetter details, pcAnywhere was found to include multiple and serious vulnerabilities over the years, which would have allowed unauthorized intruders to change election results with little chance of detection. Moreover, she explains, many questions remain about why ES&S lied, which jurisdictions around the nation may still feature the same, easily-exploitable flaws, and about electronic voting and tabulation systems manufactured by the nation's other top vendors, believed by expert to likely have included similar remote-access vulnerabilities.

All of that (and more, including our latest Green News Report), just over three months out from this November's midterm elections. Told you to buckle up...

On today's BradCast: Donald Trump tries to walk back Helsinki, and Robert Mueller has more shoes to drop, according to a former federal prosecutor's analysis of recent indictments. [Audio link to show follows below.]

The fallout from President Trump's stunning comments in Helsinki on Monday continued on Tuesday, in response to the President of the United States taking sides against his own intelligence agencies and in favor of Russian President Vladimir Putin, who stood beside him at a joint press conference following their one-on-one summit. After more than 24 hours of unrelenting backlash from media, Democrats, former intelligence officials --- and even a number of largely gentle public critiques from some Republicans --- Trump attempted to clean up his overseas comments.

Working from written remarks at the White House today, he now claims he "accepts" the U.S. Intelligence Community assessments of various alleged Russian cyber-attacks on the 2016 election, and that he simply misspoke --- just one word --- when claiming during Monday's joint presser with Putin that he saw "no reason why it would be Russia" behind the 2016 attacks. He meant to say "wouldn't", rather than "would", he now says. Trump is hoping to dig out from under his denial just days after Special Counsel Robert Mueller filed new felony charges against 11 Russian military intelligence officials said to have been working on behalf of Putin, according to the indictment, when they infiltrated DNC and Hillary Clinton campaign computers to steal emails, release them to the public before the election, plant malware on state and local election official computers and steal voter registration data in 2016.

Mueller's Friday indictment preceded yet another one announced on Monday by the Dept. of Justice, concerning the Sunday arrest of a Russian national who allegedly infiltrated the National Rifle Association along with a Putin-connected oligarch.

We're joined today by former federal prosecutor MICHAEL J. STERN who explains how Mueller's Friday indictment of Russian military operatives was filed and written in a way that suggests there are more such indictments to come, particularly of Americans. Stern describes, from a prosecutorial perspective, how and why investigators working on sprawling conspiracy cases tend to work their way up from lower-level aspects of the case, toward their main targets, while trying not to prematurely tip their hand or reveal evidence they hope to keep under wraps before the later indictments.

He details how Mueller's Friday charges of the Russian military officials (and a number of Russian social-media scam artists earlier this year), serve to buy time for the Special Counsel probe, while establishing an understanding among the public for the larger crimes being investigated --- before other "shoes" are ultimately dropped.

"He was essentially allowed to have his cake and eat it, too. He was able to set forth the indictment and charge the Russian members of the conspiracy. But, because they're not in the United States and the likelihood of them being extradited at all is slim, he's able to continue his investigation without the pressure of having to deal with those defendants making appearances in court, etc," Stern tells me. "It's my sense of things that there was a calculation, a strategy on his part in doing that."

"There's a process, I think, that Mueller is going through to get, not only members of Congress, but more importantly, the public, to understand that what has been alleged --- the Russian interference with the 2016 presidential election --- has actually occurred," he argues. "Mueller knows exactly where he is going, and that what he's doing is dropping bread crumbs until he gets to the loaf of bread, which, I believe, will include Americans."

That, at the same time as many who have been longtime science deniers now seem to be coming around in several different interesting ways as well...

On today's BradCast, it was a day many have been anticipating for some time. Fired FBI Director James Comey testified in open session before the U.S. Senate Intelligence Committee on Thursday about his one-on-one meetings with President Trump, during which, he claims, Trump asked for "loyalty" during one meeting and asked Comey to help end the FBI's investigation into former National Security Adviser Michael Flynn in the other. Comey was fired by Trump shortly thereafter. [Audio link to show is posted below.]

During his written and opening statements, and subsequent Q&A with members of the Committee, Comey charged the Trump Administration with having "defamed" both him and the FBI, and lying about the reason for his firing, which he characterizes as an attempt to scuttle the Bureau's counter-intelligence probe into alleged Team Trump coordination with Russia both before and after last year's election.

Following today's testimony, Trump's personal attorney Marc Kasowitz claimed, once again, that Comey's testimony "completely vindicated" his client, and he otherwise vehemently rejected the assertion that Trump either demanded Comey's "loyalty" or sought to shut down the Flynn investigation.

Joining us for full analysis today is journalist and author Marcy Wheeler of Emptywheel.net. She offers a comparison to the breadth of this widening scandal and others she's covered in the past, such as the deliberate outing of covert CIA operative Valerie Plame during the George W. Bush Administration. "Dick Cheney was just so much more effective at coverup and abuse of power than Trump is," Wheeler quips.

Among many other points in our discussion today, Wheeler responds to Kasowitz' charge that Comey made "unauthorized disclosures of privileged communications" (he didn't, she explains); details the new revelations from Comey's testimony regarding his various meetings with the President and his contemporaneous documentation of those meetings; potential legal exposure for Attorney General Jeff Sessions and Vice President Mike Pence in this matter; whether we should have confidence in Special Counsel Robert Mueller's oversight of the still-widening probe; whether Trump himself is now being investigated for obstruction of justice (she says it's "clear" that he now is); whether any of it amounts to impeachable offenses; and the possibility --- raised several times during today's hearing --- that White House audio tapes of the Trump/Comey meetings may exist. "Lordy, I hope there are tapes," Comey declared today.

She also breaks down the bizarre testimony before the same U.S. Intelligence Committee on Wednesday, when the heads of the NSA and DNI, without any apparent legal basis or precedent, refused to answer questions about whether Trump had asked them to intercede into the FBI probe. "Just because Donald Trump is President," Wheeler tells me, "it has not changed the rule that you have Congressional overseers and you answer their questions."

Finally, near the end of today's show, news breaks out of the UK regarding Exit Poll results from Britain's parliamentary election, suggesting a stunning surprise loss of majority power for Conservative Prime Minister Theresa May and what is likely to be regarded as a huge victory for the Labour Party's Jeremy Corbyn, sometimes regarded as "Britain's Bernie Sanders"...

On today's BradCast, the Trump Administration introduces what economists --- on both the Right and Left --- are describing as a massive 2 trillion dollar accounting error (or, less generously, 'fraudulent' numbers) in their new budget proposal introduced today. And we get caught up on the latest late updates on yesterday's Manchester Bombing and the FBI's ongoing investigation of Team Trump. [Audio link follows below.]

As Trump continues his overseas trip, the White House released his Budget Policy plan in full, including some $1 trillion in cuts to social programs, billions of dollars of increases in defense spending and what they describe as deficit reduction measures over the next 10 years. The plan, if enacted, would deeply slash programs from Medicaid to Social Security Disability Insurance to food stamps to financial student aid to agricultural subsidies relied upon by an enormous number of Trump voters.

But, aside from those cruel cuts, as our guest today, former Obama Administration tax policy adviser Seth Hanlon explains, the budget includes a huge, $2 trillion accounting error. Actually, Hanlon described it last night in a Twitter rant as '[Bernie] Madoff-level accounting fraud...designed to fleece vulnerable people'. Others today, including conservative budget experts, also describe the gimmick Team Trump uses to hide the decline in revenue as fraudulent --- or "impossible magic math" --- in that it counts the same (questionable) claims for increased revenues from massive tax cuts twice! Once to pay for the $5.5 trillion in tax cuts themselves, and then again to pay for $2 trillion in revenue in the Trump budget.

As Hanlon details, it's quite a trick! An impossible one, in fact, which he doesn't believe to be an accident, describing it as a "$7.5 trillion lie."

"In their budget," he explains, "they just pretend that this $5.5 trillion in tax cuts does not exist. And then at the same time...they say that the economy is going to grow by a full percentage point every year, so the economy is going to grow by 3% a year...And because of that extra economic growth --- and there's not much basis to think there would be that growth --- that brings in an additional $2 trillion of revenue. So they include that extra $2 trillion of revenue in their budget, while at the same time not including...the tax cuts that are supposedly producing that magic growth that results in the $2 trillion."

Hanlon, now a Senior Fellow at Center for American Progress, previously served as special assistant to President Obama for economic policy at the White House National Economic Council, coordinating the Obama administration's tax policy. He calls the Trump scheme "a deliberate decision simply to wave a wand and take the entire $5.5 trillion cost of the tax cuts out of the budget," adding that he "can't find anybody who actually defends it," including so-called conservative deficit hawks. We also discuss the cruel nature of many of the cuts, despite its unlikeliness to get very far as written, even in the Republican controlled Congress.

Finally, Desi Doyen joins us for the latest Green News Report with details on the "slash and burn" environmental aspects of the budget plan and for some good news out of Switzerland. (We'll take it!)
