Desi Doyen is on the money at the end of today's BradCast when she cites a Twitter user who recently asserted: "The GOP has become a virus: it now exists solely to replicate itself." If you've yet to notice, the 160 days between now and the critical 2020 Presidential election will be about little more for Republicans than a desperate attempt to suppress certain voters; to game the results of those who do manage to vote; and, of course, to do anything possible to distract from the fact that more than 100,000 Americans have now tragically died on Trump's watch over just the past 3 months, tanking the economy in the bargain, thanks to his disastrously failed response to the coronavirus. We discuss all of those things on today's program. [Audio link to the full show is posted below.]

First, Trump today is pretending to be furious about the fact that Twitter placed a very polite "Get the facts about mail-ballots" link under two of his misleading tweets on Tuesday about absentee voting fraud. He is feigning outrage, claiming the company is biased against Republicans and that he has the power to shut them down. The RNC and Trump's campaign, of course, are all playing along with the phony fury, because they love playing both victim and strongman at the same time, and because it all helps distract the media from his ongoing unspeakable failures as President.

In fact, not only did Twitter do him a favor by placing those links on his tweets, helping to bring attention to his disinformation (which can also been seen as instructions for his followers on how to defraud the November election), but the company didn't even bother to label his most offensive recent tweets, such as the ones in which he accused MSNBC's Joe Scarborough of murdering a staffer who tragically died in the then-Florida Republican Congressman's office in 2001.

At the same time, Facebook is allowing the Trump Campaign to run hundreds of paid, false political ads making the same misleading claims, as that social media company simply allows false paid-for propaganda ads from politicians, even if they are meant only to disinform, distract and undermine the 2020 election itself.

It should also be noted anytime any media outlet reports on Trump's false claims about absentee voter fraud, that he is a voter fraud criminal himself, after voting by absentee in Florida where he has no legal permanent residence, in violation of state law.

As to voter suppression and Florida, we reported yesterday on the excellent ruling by a federal judge who gutted the GOP state legislature's new poll tax law over the weekend. The measure was enacted to undermine a Constitutional Amendment adopted by state voters in a 2018 mid-term landslide. Despite the enormous bipartisan voter support for Amendment 4, which could allow some 1.5 million former felons to vote in the Sunshine State for the first time, Gov. Ron DeSantis (who barely won his election that same year) has now announced plans to appeal the court's ruling that gutted the poll tax passed by Republicans in hopes of countering Amendment 4.

Florida, however, is hardly the only state in the union with GOP-controlled legislatures attempting to undermine recent bipartisan ballot box landslides. In Missouri, on the heels of the adoption of a landmark state Constitutional Amendment in 2018 meant to end extreme partisan gerrymandering in the Show-Me State, the gerrymandered GOP state legislature is rolling out what our guest today describes as REDMAP 2.0.

We're joined by FairVote senior fellow DAVID DALEY who, literally, wrote the book on the GOP's successful plan to take control of state legislatures in 2010 to implement crippling partisan gerrymanders during redistricting after that year's decennial Census. Now, as Daley detailed in a recent New York Times op-ed, MO Republicans are rolling out an even more invidious scheme to undermine the voters' intent with another Constitutional amendment on this November's ballot.

He describes the plot --- which includes an unprecedented plan to count only voting age citizens during redistricting --- as a "dress rehearsal" for GOP-controlled states in the rest of the country. The plan, which would "dramatically" shift voting power from Democratic-leaning urban areas to white, Republican-leaning rural areas, is being adopted for nationwide roll-out by the rightwing American Legislative Exchange Council (ALEC), he reports.

"It changes the definition of representation and it overwhelmingly tilts this in the direction of conservatives and Republicans," he tells me. "Total population has been the guiding standard that everybody has used for a long time. If you were to change this to say that the baseline that we're going to count is not everybody, but only citizens who are over the age of 18, then what you are doing is eliminating huge numbers of people. You are curating and manicuring an electorate that is older, more rural, more conservative, and of course, whiter."

As Dems are finally trying to win the last battle by rolling back what happened in 2010 a decade later, Daley argues they need to get ready --- immediately --- to figure out how to counter the GOP's newest ugly war on this front.

"I don't think Democrats are paying enough attention to this," he says. "This is a Presidential election year. Democrats are thinking about the White House, about the Senate, about holding on to the House. But there's so much more at risk in this election. This is the last election before these maps are going to be drawn for another decade. ... The Republicans are going to have a 2020 'REDMAP 2.0' plan, and if Democrats are not equally focused on playing offense and defense, they are going to get check-mated."

On today's BradCast: More chilling Khashoggi news, more maddening voter suppression, and the Republican deregulation of phone companies in Florida and at the FCC have deadly consequences in the Sunshine State. [Audio link to full show is at bottom of article.]

First up today, an update on the latest in the alleged Saudi murder of Washington Post journalist Jamal Khashoggi and the wildly unreported fact that he had "self-exiled" from Saudi Arabia after being banned by the Saudis from writing and appearing on television or at conferences back in December of 2016 --- for being critical of then President-elect Donald Trump! That point seems quite important, given the Trump Administration's continuing efforts to help cover up the assassination in coordination with the Saudis and their ruling Crown Prince Mohammed Bin Salman, after they repeatedly lied about the grisly killing of a journalist who had been mildly critical of Trump, as first reported in late 2016 and by the U.S. State Department in 2017.

Next, GOP voter suppression continues across many states in advance of the crucial November 6th midterms. Over the weekend on Twitter, President Trump lauded Georgia's Republican Gubernatorial candidate Brian Kemp, who as Secretary of State, has been working for years to suppress tens and even hundreds of thousands of disproportionately African-American voters in the Peach State. Kemp, as the state's chief election official, is overseeing his own election in a reportedly tight race for Governor against African-American Democratic candidate Stacey Abrams.

Trump also took the opportunity on Twitter over the weekend to falsely fan the flames of the GOP's phony claims of "VOTER FRAUD" in hopes, according to the Lawyer's Committee for Civil Rights Under the Law, of inciting government officials and law enforcement to intimidate minority voters before the crucial November 6 election. The Lawyer's Committee heads up the 866-OUR-VOTE hotline to answer question and help trouble-shoot voting problems, such as recent reports that early voters are being either turned away or forced to vote by provisional ballot --- rather than normal ones --- if the address on their ID does not match the one under which they are registered. Georgia's Photo ID voting restriction does not require registration addressees to match those on IDs (e.g. student voters who may not have in-state driver licenses or those who recently moved but have not yet updated their license.) Please contact the 866-OUR-VOTE hotline with questions about local voting laws or any problems at the polls --- and share that number far and wide over the next two weeks!

Finally, despite national media now focusing elsewhere, the devastation in Florida's Panhandle following the Category 4 Hurricane Michael two weeks ago continues and the official death toll is still rising. At the same time, power and phone service is still out in a number of rural areas, thanks in no small part to the deregulation of telecommunications company rules by Florida's Republican Gov. Rick Scott shortly after taking office in 2011, and by Donald Trump's FCC Chairman Ajit Pai.

We're joined today by Public Knowledge's Senior Vice President HAROLD FELD, who has been warning for years about exactly such a situation. Feld explains how Scott gutted almost all of Florida's telecom company rules when he signed the "Regulatory Reform Act of 2011" and how Pai went still further when he gutted Obama-era phone company regulations in November of 2017.

Scott's 2011 measure "was a complete deregulation of the telephone industry in Florida. It removed the state Public Service Commission from any sort of jurisdiction over residential telephone service. It removed something called 'Carrier of Last Resort,' which means there always has to be a telephone provider in the area. It even removed the ability of the Public Service Commission to take complaints from consumers," Feld tells me. He describes it as "one of the most radical deregulations in the country."

As to the federal regulations scrapped by Trump's FCC, that was in response to federal regulations enacted in the wake of the disastrous performance by Verizon following SuperStorm Sandy in 2012, when copper lines were swept away, and phone companies failed to restore them, claiming that the use of cell phones meant they were no longer necessary. Obama's FCC insisted that "no repairing was not an option," says Feld. But Pai "insisted that there was no reason for any of these regulations [and] that companies have private incentive to deploy these networks, despite everything that actually happened," particularly in rural areas, following Sandy.

The Government, he notes, largely for decades has recognized "that it's always going to be profitable [to ensure service] in the cities, [but] it's not going to be profitable once you get out into the rural areas." So, it's been a value and tradition "through each upgrade of our communication network --- when we went from letters to the telegraph, from the telegraph to the telephone" to ensure service to all. But that's no longer the case.

Like Gov. Scott's Florida, Feld describes, some 37 states have lifted similar decades-old telecommunications requirements, thanks to legislation encouraged by the American Legislative Exchange Council (ALEC), a privately-funded partnership between major corporations and (mostly) Republican state lawmakers.

The Republicans' deregulate-at-all-costs efforts to gut regulations --- regulations that Pai scoffed at before he became Trump's FCC Chairman --- may now be costing lives in Florida, as many in rural areas, as of late last week, remained unaccounted for, weeks after the storm. The non-partisan Public Knowledge group is suing for a reversal of those deregulations, and Florida's own Chief Financial Officer and State Fire Marshal, a longtime resident of the Panhandle himself, is now also begging Pai to consider a reversal...

Then it's excerpts from Angie's chat with Derek Cressman, about his book When Money Talks: The High Price of “Free” Speech and the Selling of Democracy.

Over the holiday weekend, Angie came face to face with her first "Miracle Water" TV commercial. She's only thirty years behind the curve, because charlatan Peter Popoff has been reaching through the TV screen and into the pockets of the most vulnerable since the early 80s. By the end of that decade, his schemes were publicly exposed, he was tarred, feathered, and bankrupt --- so how is he back on TV, making more money than ever? Guest: The Nation's John Nichols...

On today's BradCast, we begin with the sad breaking news about Jimmy Carter's illness and a few thoughts on the ailing former President. Then, it's onto a bit of fact-checking on "ObamaCare" and on Jeb's silly, fact-free foreign policy propaganda speech last night at the Reagan Library.

Next, Wisconsin's own John Nichols of The Nation joins us to explain new revelations about an old criminal investigation of Wisconsin Governor and 2016 GOP candidate Scott Walker and his remarkable ability to blatantly lie about that and so much more.

"Scott Walker is, frankly, better than just about anybody in American politics at gaming the media," Nichols, who has covered him for years in the Badger State, tells me. "At counting on the media to take his absolute denial and give it the same treatment as the accusations, the charges, rather than getting to the bottom of it to actually figure out whether something is there."

He explains that Walker is clever enough to realize that lying works with today's Rightwing electorate, who get their news from very selective sources that rarely bother to fact-check. "He is, in fact, the embodiment of where our politics is going," Nichols warns, citing a description of Walker as "more Nixonian than Nixon."

Then, Nichols, a long time supporter of Bernie Sanders, addresses the recent controversy concerning Black Lives Matter protesters confronting the Vermont Senator and quickly rising 2016 Dem candidate to suggest that, as he explains in detail at The Nation today, such protests have, in fact, made Presidents such as FDR and Kennedy much greater than they might have been otherwise. He argues that the BLM protests have already had a similar effect on Sanders' campaign.

"What we should understand is that pressure from activists often makes politicians into what we like about them, what we respect about them," he says. "What it means is that pressure from activists forces politicians --- and Presidents even --- to step up, to do what they should do, do what will make them more universal in their appeal."

Finally, some very good polling news for Sanders in New Hampshire and more embarrassing polling news for Bush, Walker and the rest of the Republican Party...

The videos were good for a barrel of laughs. The Director of Florida's Div. of Emergency Management, Brian Koon was forced to engage in verbal gymnastics so as to avoid violating a state ban on using the words "climate change."

In another clip, replayed by Comedy Central's John Stewart, former FL EPA employee Kristina Trotta uses the words, "nuisance flooding," to evade the ban on mentioning "sea level rise." That drew an amusing Stewart suggestion that, in order to evade mentioning that a global warming-connected rise in sea level could eventually lead to an underwater Miami, state employees could refer to "moisture inconvenience!"

The exchanges were hilarious. But there is nothing funny about the attempt to erect thought control regimes, first in Florida and now in Wisconsin. In both states, the practice is verging on that deployed by Oceania's Ministry of Truth in George Orwell's 1984. In that classic but ominous work of fiction, written accounts of inconvenient truths were incinerated inside "memory holes."

While ominous, the clumsy efforts at "thought control" are quite useful. They underscore the warnings we offered nearly five years ago that the real future offered by the so-called "Tea Party" and the Koch Brothers' brand of "libertarianism" includes "Fascism [and] Feudalism --- an authoritarian reality that has already come to fruition in states like Florida and Wisconsin where Charles and David Koch, along with other rightwing billionaires, have already tightened the reigns of oligarchic control over ostensibly "public" institutions...

Both election integrity advocates and dissembling GOP proponents of Photo ID voting restrictions were taken by surprise in late 2013 when 7th Circuit Court Judge Richard A. Posner said, during an interview with HuffPo Live, that the landmark 2008 Supreme Court decision on the matter "would have been decided differently" if the Court had known then "about the abuse of voter identification laws."

That, in and of itself, was a remarkable turn of events. What was ultimately to come was even more so.

Crawford v. Marion County Election Board is the case which Republican proponents of strict Photo ID voting laws now (incorrectly and often disingenuously) cite as giving them carte blanche to enact similar laws in other states, irrespective of the extent to which photo ID laws serve to disenfranchise demographic groups --- minorities, students, the poor, women --- that all tend to vote for Democrats.

Posner is not just any judge. He is a renowned legal scholar and Reagan appointee to the federal bench, who has served on the U.S. 7th Circuit Court of Appeal since 1981. More importantly here, Posner was the author of the 7th Circuit's opinion in Crawford. In that case, Posner rejected an allegation that Indiana's polling place photo ID restriction was unconstitutional. That decision was affirmed at the time by the U.S. Supreme Court.

Posner, who is, as Yale Law Professor Fred Shapiro notes, the most cited jurist of the 20th Century, was not alone in his view in 2013 year that Crawford "would have been decided differently" if the Court knew then what it knows now.

Former Supreme Court Justice John Paul Stevens, the author of the plurality opinion in Crawford --- an opinion that was joined by Chief Justice Roberts and Justice Kennedy --- told the Wall Street Journal following Posner's remarks at the time, that he "always thought that [dissenting Justice] David Souter got the thing correct, but my own problem with the case was that I didn't think the record [before the Court in 2008] supported everything he said in his opinion." Souter would have struck down the Indiana law as unconstitutional because, as he argued at the time, it "threatens to impose nontrivial burdens" upon the right to vote.

Joined by four other 7th Circuit jurists last October, Posner penned an extraordinarily powerful and compelling dissent [PDF] in Wisconsin's photo ID voting case. The previously missing evidence is now in, as the judge meticulously detailed in the opinion. GOP claims that photo ID restrictions are needed to combat "voter fraud", he wrote, are "a mere fig leaf for efforts to disenfranchise voters likely to vote for the political party that does not control the state government"...

There is only one motivation for imposing burdens on voting that are ostensibly designed to discourage voter-impersonation fraud, if there is no actual danger of such fraud, and that is to discourage voting by persons likely to vote against the party responsible for imposing the burdens.

Posner's carefully crafted dissent does more than establish why the U.S. Supreme Court should ultimately sustain the District Court's finding that Wisconsin's photo ID law is both unconstitutional and a violation of the Voting Rights Act --- a finding later echoed by a federal District Court in Texas as well. Posner's dissent obliterates the factual premise that had served as a pillar upon which his, and subsequently the Supreme Court's, decisions in Crawford were based.

Polling place photo ID laws do not promote voter confidence in the integrity of elections, as Posner and the Crawford Supreme Court plurality had erroneously assumed. The assertion that they do was a "mistake" --- Posner's mistake! --- and he now admits as much, with the support of devastating new data from recent studies to back him up.

His powerful dissent amounts to more than just a response to the Wisconsin GOP's new Photo ID voting law. It is an elegant plea that the U.S. Supreme Court finally right a grievous wrong that he was personally responsible for. Posner presents an astonishing, air-tight case for ruling that all "strict Photo ID laws," which, as he demonstrates, have only been enacted in states sporting GOP-controlled legislatures, must now be struck-down as unconstitutional...

Case is larger than Wisconsin, presenting a moment of truth for American democracy and at least two Justices on the high court...

On Thursday morning, the ACLU filed an Emergency Application to Vacate [PDF] with the U.S. Supreme Court to vacate a Sept. 14, 2014 stay of a U.S. District Court ruling that had, before the stay, permanently blocked enforcement of a Republican-enacted, Wisconsin photo ID voting law.

The civil rights organization argues that the emergency ruling is needed to prevent mass disenfranchisement and electoral chaos during the upcoming Nov. 4 election. It asks that the Court "leave that injunction in force pending the Seventh Circuit's issuance of a decision on the merits."

As the District Court judge had found, before his decision was overturned by a partisan ruling at the Appellate Court level, Wisconsin's attempted restriction on the voting rights of legally registered voters poses a real and present danger that some 10% of the Badger State's duly registered electorate will likely be prevented from voting in the rapidly approaching November 4 election.

The District Court's injunction had been stayed as a result of a deadlocked court, in which five bipartisan members of the ten-judge U.S. 7th Circuit Court of Appeal described in a Sept. 29 Opinion [PDF] as a "brazen" and "shocking" disregard of both precedent and the right of the minority to vote. That "shocking" position had been advanced by the attorneys representing Republican Gov. Scott Walker and first accepted by an all-GOP, three-judge panel that had issued an extraordinary, 11th hour decision to vacate the lower court's injunction.

The case now poses an enormous test for at least two key Justices on the high court. Will Chief Justice John Roberts and Justice Anthony Kennedy adhere to the very principles they signed on to when they joined the plurality opinion authored by former Justice John Paul Stevens in the landmark 2008 SCOTUS decision in Crawford v. Marion County Board of Elections? That case upheld Indiana's Photo ID law against a "facial" challenge solely because, in the words of the plurality opinion, there was no evidence before the court at the time to prove anyone would be disenfranchised or that their right to vote would be unduly burdened by the law.

In signing onto Steven's lead opinion, both Roberts and Kennedy agreed that election laws, including photo ID voting restrictions, are subject to the Anderson/Burdick test. That test mandates that courts, on a case-by-case basis, measure a law's potential damage to voters' right to vote against the specific claims made by the state as to why such additional burdens and restrictions are necessary. Given that the state has offered no legitimate reason for potentially disenfranchising as much as 10% of Wisconsin's lawfully registered voters, Roberts and Kennedy cannot refuse to lift the stay without a total abandonment of principle...
