There is nothing wrong with citizens --- no matter how partisan or misinformed --- demanding to know for themselves that election results have been accurately recorded and reported. That's true even in cases where they have been blatantly lied to by, say, a disgraced, failed President of the United States. But post-election audits must be done in full public view from top to bottom, with all processes and evidence from the election kept within a transparent, well-documented, secure chain-of-custody at every step. Two ongoing post-election audits from the 2020 election are currently underway. One offers an example of exactly how not to do such a probe, the other one is shaping up to be a model for the nation.

Among the stories covered on today's BradCast [Audio link to show follows this summary]...

  • Ohio Gov. Mike DeWine's scheme to hold a $1 million lottery each week for the next five weeks for any Buckeye Stater 18 and over who has received at least one COVID vaccine shot, appears to be working. While we've got a few suggestions on how it could have been done more effectively, at least it appears to have slowed and even reversed (for some ages) the state's recent drop-off in the number of folks getting their shots. As it turns out, Ohioans seem to like DeWine's plan to offer federal government-sponsored cash prizes (yes, socialism!) courtesy of the America Rescue Plan in exchange for receiving life-saving inoculation from a deadly disease. More states should consider the same and the federal government oughta just pay people to get their shots! We suspect a crisp $100 bill in exchange for a shot in the arm would do the trick. (By the way, Ohioans need to opt-in for the lottery, at OhioVaxAMillion.com, to be eligible for the prizes!)
  • Another direct benefit for Americans from the American Rescue Plan (Biden's emergency pandemic relief and stimulus bill adopted by Democrats while being VOTED DOWN BY EVERY SINGLE REPUBLICAN IN CONGRESS), is the expanded child tax credits which will, beginning in July, send monthly checks of $300 per child under 6, and $250 for kids between 6 and 17, to parents making less than $150,000 over the next year. If Americans liked the Democrats' $1,400 individual payments from the ARP, they may love its expanded child tax credits which start this summer. Experts say the payments are likely to help cut child poverty in half this year. Hopefully, Dems will remember to loudly remind Americans of all parties which party it was that made those payments possible, and which party attempted to prevent them. Democrats are not usually very good at that. And hopefully they'll be able to extend those payments through at least 2025 as Biden has proposed in his American Families Plan --- which Republicans also oppose.
  • Then it's back to the clown show "audit" theater in Maricopa County, Arizona, where the county's 2.1 million public ballots from the 2020 Presidential and Senatorial elections last year are being inspected, in secret, by a private company with no experience in elections, voting systems or audits named Cyber Ninjas. Now, it seems, the Ninjas and a number of their allegedly false claims made about the materials turned over to them by the County (as ordered by a state court in response to the Republican-controlled state Senate's mandate) were the final straw for the majority GOP Maricopa County Board of Supervisors and its new Republican County Recorder.

    On Monday, the 5-person Board (4 Rs, 1 D), denounced the audit as a "sham" and a "con," lamenting the "spectacle" that they say "is harming all of us" and turning Arizona into "a laughingstock". The new Republican County Recorder, Steven Richer, now in charge of elections in one of the nation's largest counties, blasted the Ninjas for what he describes as blatantly false claims that election databases were unlawfully deleted and for ensuring attacks on his new staff. The Board also sent a blistering 13-page letter [PDF] to the state Senate's President detailing their anger, frustration and embarrassment, calling for the audit to be ended, while responding to charges they claim to be lies coming out of process. The Maricopa "audit" is now in it's third week in Phoenix, but reportedly nowhere near complete.

  • Meanwhile, by way of a critical contrast, another post-election forensic audit is underway in Windham, New Hampshire, led by actual experts in post-election audits and voting systems. Unlike the evidence-free claims of fraud in AZ, there is reason to be alarmed by the results of a state House of Representatives race in the town of 14,000 people. There, on election night last November, in an 8-person race (4 Ds and 4 Rs) for 4 seats in the state House, all four Republican candidates won. According to the computer tabulations, they were the four top vote-getters for those seats, with the Democratic candidate, Kristi St. Laurent, coming in 5th by just 24 votes.

    Last November, after she requested a hand-count of the town's hand-marked paper ballots --- previously tallied only by 20-year old, easily manipulated, oft-failed Diebold optical scanners --- it was discovered that the 4 Republicans actually received about 300 more votes each than the tabulators had reported on Election Night. And St. Laurent, the hand-tally found, actually received 99 fewer votes than initially credited with. So what explains the discrepancy between the computer count and the hand count? That's what the auditors began to investigate last week in one of the most open, professional, well-documented and transparent such processes I've ever seen in my nearly twenty years on this beat.

    This week, the auditors explained --- via the live streaming audio and video coming out of the audit room, their own Twitter feed, as well as in interviews with local media --- their leading working theory that could explain the numbers seen one way (incorrectly) by the computer scanners and another way (correctly) by the hand-counters last November. Their working theory, if it bears out, would explain the disparity between the two separate tallies last November. We explain that theory today. And, no, unlike our disgraced former President's recent false claims about both Arizona and New Hampshire, the reasonable hypothesis does not involve "massive election fraud" with "thousands and thousands" of newly "found" ballots. It involves the scanners misreading folds on mail-in ballots as votes.

    But, of course, most critically, the side-by-side comparison of the clown show "audit" theater in Maricopa, which the public (and even local officials) are not allowed to fully oversee, versus the methodical, transparent, public process being carried out in Windham, should be an illustrative model for all future such probes. In the case of Windham, we are likely to have an answer to the mystery that everyone can agree with when all is said and done in the next few weeks. In Maricopa, I think its safe to say, little is expected to be settled one way or another after this ill-considered exercise is finally finished...if it ever is.

On today's BradCast: There is at least one thing Republicans are very good at. Whenever possible, they leverage their rightwing policy agenda --- such that they have one --- however they can in order to shift political power to their advantage. They do this both inside government and in their external communities, such as media, law enforcement agencies and corporate industry. Our guest today suggests that Democrats must learn from the Right to do the same thing...but completely differently. [Link to full audio of today's show is posted below this summary.]

They shouldn't adopt policies to prevent their opponents from being able to vote, as Republicans do. But the progressive policy agenda should be constructed to expand the base of progressive voters. While Democrats are unlikely, at this point, to win the hearts and minds of many Trump supporters after their years of brainwashing by the Republican/Fox "News" propaganda industrial complex (including a weekend full of lies falsely claiming that Joe Biden's climate policy includes a ban on red meat --- or, as Trump's former WH Economic Advisor warned on his Fox show over the weekend, Americans may soon only be be allowed to drink "plant-based beer" on July 4...yeah, seriously), Democrats can expand their own electorate through both smart legislation and executive actions.

We're joined today to explain all of this by City University of New York's Distinguished Lecturer of Urban Studies and Roosevelt Institute Fellow DEEPAK BHARGAVA who, with Dorian T. Warren last month at The American Prospect, detailed what they describe as the "Progressive Multiplier" effect. A way, they argue, to defeat Trumpism, as long as Dems take the right lessons --- not the wrong ones! --- from Republicans.

"When rightwing governments take hold, when the Republicans take power, they of course care about their policy agenda, like tax cuts and deregulation," Bhargava tells me. "But they start with the premise that in order to get all that done, they have to take the knees out from under their opposition. They're first order of business --- even though they often don't run on these issues because they're manifestly unpopular --- their very first orders of business are typically to weaken unions. That's often number one. Number two is to weaken voting rights, targeting people of color especially, and young voters who lean Democratic. And number three is to change the rules of the political game through gerrymandering and other means, so that they are making an electorate that is more favorable to them.  By doing these things, by passing these things first, conservatives and Republicans create a situation where they have more power in the next legislature and the one after that, to do more and more conservative policy, to take the state or the country in a more extreme direction."

Bhargava is clear, however, the lesson for progressives must not be to prevent their opponents from access to the ballot box, as Republicans do, but to expand their own pool of voters. "This is the crucial distinction. I do want Democrats to be ruthless. But I want them to be ruthless about expanding democracy -- Republicans have been ruthless about restricting democracy --- democracy at the workplace, meaning unions, democracy at the polls, meaning voting rights. I want the Democratic Party to be ruthless about expanding everybody's participation. That means Republicans, too. But making it easier to participate, easier to join a union, easier to vote, easier to participate in all kinds of ways in civil society. So, this is the crucial difference. Yes, it will redound to Democrats' favor and progressives' favor if more people are able to be part of our democracy."

"The underlying agenda here is to expand democracy in America," he reiterates, "and that's why the two strategies don't have any equivalence."

How can that be done via legislation and --- as the GOP has taken obstruction of legislation to an art form --- via Executive Actions by the President? We discuss all of that, including many examples --- from labor policy to policing to immigration enforcement and much more --- on today's program.

One key example Bhargava offers today, among many --- as also discussed in his new book, out today, called Immigration Matters: Movements, Visions, and Strategies for a Progressive Future --- is that the Biden Administration could add millions of new voters to the rolls, almost overnight. "There are nine million people who right now are legal permanent residents with green cards who could become citizens if we aggressively did outreach, lowered the prohibitive fees, undid all the barriers Trump created. Nine million new people by 2022 could be voting. And, as it happens, the vast majority of those will turn out to be Democrats."

Of course, Republicans know this, which is why Trump's executive policies were "hugely strategic in making it much, much harder for people to become citizens and vote. They increased fees, they made the questions harder. They lengthened the time you had to wait. They did everything they could to throw roadblocks in the way." The Biden Administration could, and should, reverse all of that immediately, Bhargava argues.

Also on today's program, several examples of both the GOP's institutionalized and well-funded rightwing agenda machine --- courtesy, in this case, of Fox' phony "Biden burger ban" lie all weekend long, across all of their shows, and the upcoming extreme gerrymandering by several states where Republicans are picking up House seats after the 2020 decennial Census, where they control the entire redistricting process. While several Democratic-leaning states are picking up seats as well, none of them have processes completely controlled by Dems. But Democrats are not completely unaware of these ideas, as illustrated today by President Biden's Executive Order raising the minimum wage for federal contract workers to $15/hour and automatically indexing the new wage to inflation for the future. That will be hundreds of thousands of Americans who will have Democrats to thank for a nearly 50% raise. Dems, however, as Bhargava agrees, need to get much better at letting those Americans know who is responsible for their newly increased fortunes.

If only lawmakers in GOP-run states gave as much of a damn about their own residents as they do for the corporations which fund their campaigns. If only those corporations gave as much of a damn about their own customers as they do about the possibility of being boycotted and losing profits. Or, as my dad used to say, if only the Queen had balls she'd be the King. [Audio link to today's full BradCast is posted below this summary.]

It's a very busy and very lively show today. Among the stories we cover, if you are clever enough to tune in...

  • The growing cost of climate change continues, as California, just a few years after the end of a punishing five-year drought, appears to be headed back into another. Thanks to investments and conservation techniques enacted last time, perhaps this one won't be as bad. We'll see. But it won't keep the wingnuts from whining about it and trying to falsely blame Democrats anyway.
  • Emails obtained by Documented and reported by NBC News today reveal that talking points circulated by a climate change denying fossil fuel industry lackey were behind the misinformation spread by Texas officials falsely blaming wind and solar energy when the state's power system froze up and collapsed during a winter storm in February. The false claims were spread at lightning speed by Republican Gov. Greg Abbott, the fully captured Commissioners on the state's utility board, the wingnut media and, of course, other oil and gas lobbyists. Aside from billions of dollars in damages, the state's own failures in deregulation and privatization (and lack of winterization) of its electric grid, resulted in the deaths of at least 111 Texans according to the state's newly revised --- and nearly doubled --- death toll. Many of them died from hypothermia in their own homes. And no, it was not the fault of clean, renewable energy in any way.
  • Meanwhile, in Georgia, pushback against a massive voter suppression law enacted in record time last week by Republicans in the state legislature is bringing shame not only to GOP lawmakers and Republican Gov. Brian Kemp, but to the major corporations --- some headquartered in the state --- which failed to take action to speak out against the democracy-undermining measure until it was too late. Or, at least until boycott efforts against the companies began to emerge. Over the past 24 hours, following a statement of outrage by more than 70 Black corporate executives decrying GA's new law, companies such as Delta Airlines, Coca-Cola, Microsoft and Apple have all begun falling over themselves to express the "outrage" they failed to muster before passage of the bill --- or even in the full week since it was signed into law. In the wake of the new corporate blowback, rather than take actions to rollback the voter suppression, Republican state legislators have decided to attack the companies for (belatedly) coming out in support of democracy. The GOP-dominated state House of Representatives even went so far as to abuse their power on Wednesday night to adopt a punitive tax increase on one of the GA-based companies which belatedly decided to speak up against voter suppression.
  • Even as the blowback came fast and furious against Georgia's Republicans over the past 24 hours, the great, deregulated state of Texas decided they wanted some of that "love" as well. Republicans in their state legislature are now moving to enact similar voter suppression schemes to the ones decried in the Peach State. Will the corporations stand up against such laws in the Lone Star State and elsewhere before they're adopted this time? We hope so, but we'll see. Obviously these politicians don't give a damn about their actual constituents. But maybe they'll pay attention to their corporate funders who have now been forced by those constituents to at least pretend they give a damn about democracy.
  • Finally, Desi Doyen joins us for our latest Green News Report, with special coverage of President Biden's popular, new, sweeping, long-overdue, "once in a generation", $2.25 trillion infrastructure, jobs and climate proposal introduced on Wednesday as the American Jobs Plan...

On today's BradCast: Joe Biden has been winning quite a bit lately. Today was no exception. So, can he turn that winning streak into a win for labor unions and keep his campaign promise to be "the most pro-union President you've ever seen"?  As of now, he's on track for that as well, according to historians and labor leaders --- even if that's admittedly not a very high bar. [Audio link to show is posted below summary.]

On Wednesday, Biden saw three more of his cabinet picks nominated on a bipartisan basis in the U.S. Senate.  Rep. Marcia Fudge of Ohio will become the first African American woman to lead the Dept. of Housing and Urban Development in 40 years, after vowing to address systemic racial inequities at the federal agency. Michael Regan was confirmed as the first black man to head up the Environmental Protection Agency. And Merrick Garland received his long awaited confirmation as our new Attorney General, as the widely-respected, veteran federal judge takes on the tall task of fulfilling Biden's promise to restore independence to the Dept. of Justice.

None of those, however, were Biden's biggest wins of the day, as the U.S. House gave final approval for his $1.9 trillion American Rescue Plan. The massive COVID relief and stimulus package now heads to the White House for his signature on what some describe as one of the most progressive bills to ever come out of Congress. $1,400 checks to individuals and a $300/week extension of unemployment benefits is just a small part of the bill, which also includes annual payments of up to $3,600 per child, in a provision which policy experts say will cut child poverty in half and adult poverty by a quarter. It will reduce the overall poverty rate in 2021 by more than a third, lower the rate for Black people by as much as 42%, 39% for Hispanics and 34% for white people. In addition, the measure will send $130 billion to reopen schools safely, $34 billion will expand Obamacare subsidies to many more people, $25 billion for emergency rental assistance, and $14 billion will help to speed vaccine distribution, among many other such initiatives. That, on a day that Biden also announced he was securing another 100 million vaccine doses from Johnson & Johnson.

No wonder Republicans have no clue how to oppose the plan (other than with obviously ridiculous and silly lies), after the package received zero votes from GOPers in either the House or Senate. Democrats own this one, and they should do so loudly and proudly. The additional good news here for now is that even Chuck Schumer finally seems to "get it". There is no upside to negotiating with Republicans if they are going to be doing so in bad faith, as they did on the stimulus bill under Obama in response to the Great Recession.

But the central focus of our show today is on a couple of moves by the President that labor leaders, experts, and academics are citing to describe Biden as, so far, the most pro-worker, pro-labor, pro-union President in decades, and maybe ever.

Last week, he surprised a lot of folks on the left by tweeting a direct, unambiguous video message of support for workers who are now voting on whether to unionize at an Amazon warehouse outside of Birmingham, Alabama. It would be the first such facility to do so in the nation. Biden's two and a half message lauded unions for creating the middle class and spoke to American workers' rights under the law to organize for collective bargaining without corporate interference.

And this week, he issued a direct, unambiguous statement of support for the Protecting the Right to Organize (PRO) Act before its passage in the House on Tuesday. Labor leaders describe the initiative as the most progressive, pro-union bill in 80 years. Of course, now all it has to do is overcome a filibuster in the Senate.

We're joined today by longtime labor historian and author NELSON LICHTENSTEIN, Distinguished Professor at UC-Santa Barbara, where he directs the Center for the Study of Work, Labor, and Democracy. Lichtenstein explains both the importance of the PRO Act and the ongoing vote to unionize Amazon down in Alabama. He also addresses the question as to whether Biden could become the most pro-union President in modern times, or even in history.

"The bar is very low," Lichtenstein concedes, in comparing Biden to recent Presidents who may have supported unions with words --- though none as directly as we've seen from Biden to date --- but not necessarily with their actions. "Biden is saying all the right things, but this will all fade unless there actually is legislation that is passed in some form" that turns "the reality on the ground" into a "revival of trade unionism."

"It's one thing to say terrific things --- and I'm not being cynical, all power to him  --  but history will judge him by whether or not there is in fact an increase in real wages, an increase in union membership, an increase in the power of organized labor."

The colorful professor has much more to say that I can possibly do justice to here, so please tune in. But, after we discuss how it just so happens that the most prosperous period in history for the American middle class also coincides with the era when trade unionism and collective bargaining were at their zenith, I ask if there is any actual historical economic data in support of the notion that unions are somehow either bad for business or workers, as folks on the right would have you believe, and as all too many in this country have fallen for after decades of corporate, anti-union propaganda.

"No," Lichtenstein answers emphatically. "There is no support for that. It is good both economically, in an immediate sense, and even more important, politically, because it helps sustain a social democratic ethos and policy block in the country." He goes on to add: "One of the reasons for the deterioration in America of everything --- from race relations to stagnating living standards --- is because of the weakness of unions in the last forty, fifty years."

Guest: Public Citizen's Matt Kent on the Congressional Review Act's closing window; Also: IA, GA Repubs pass vote suppression bills; Palm Beach resident Trump votes by absentee...again...

On today's BradCast: Democrats could roll back dozens of toxic and/or corrupt Trump-era regulations, many of which had, themselves, rolled back previous regulations. And they can do it with a simple, filibuster-proof majority vote in the U.S. Senate. But they must act quickly. So, what's the hold up? [Audio link to full show follows below summary.]

First up today, however, some quick elections news. Donald Trump, who decried absentee voting for everyone but himself while he lived at the White House and voted by mail unlawfully using Mar-a-Lago as his voting address, had previous claimed it was just fine that he voted by absentee, since he was legitimately not in Palm Beach, Florida to cast his vote.  Well, Palm Beach is holding municipal elections today, and guest which current resident of the town has requested an absentee ballot to vote?

Meanwhile, the post-2020 GOP attempt to roll back access to the ballot is gaining speed in state legislatures across the country. The Brennan Center for Justice cites more than 200 such measures proposed in more than 40 states as of mid-February.  One of them, a bill in Iowa that shortens Early Voting days and polling place hours, among other restrictions, was signed into law by the state's Republican Gov. Kim Reynolds on Monday.  On Tuesday, civil rights groups filed suit.

Down in Georgia, a massive number of restrictions on voting --- most notably, mail-in voting --- are being quickly passed by both chambers of the state General Assembly.  As in Iowa, it's all being done with party line votes, with furious Democrats voting in opposition. On Monday, the GA state Senate passed a bill that, among other things, ends no-excuse absentee voting for most voters, even as 1.3 million took advantage of the convenient (and, during a pandemic, safer) way to vote in last year's Presidential election. But after Democrats won that election in November and both U.S. Senate runoffs in January, Republicans are now hoping to reverse the no-excuse mail-in voting law they themselves passed with their GOP-majority back in 2005. Shamefully, that is not the only new restriction that Republican state lawmakers are trying to enact in the Peach State, with many of the new restrictions aimed at suppressing minority voters.  And, as in Iowa, despite a lack of evidence of any voter fraud in their elections, Republicans are pretending that these new suppression tactics are necessary to prevent voter fraud.

Many provisions of the restrictive bills being pushed through state legislatures would be blocked by the Democrats' major voting rights bill, H.R.1, the "For the People Act" at the federal level.  The bill has already been passed in the U.S. House (with zero GOP votes), but unless the Senate filibuster rules are reformed --- or Joe Manchin comes to his senses (or both) --- the bill will almost certainly fail to overcome Republican opposition in the upper chamber.

At the same time, however, while Democrats are forced to look forward to protect upcoming elections, there are scores of corrupt, dangerous, Trump-era federal regulations that can now be rolled back with a simple majority vote in both chambers of Congress. No need to get 60 votes in the Senate! But Democrats have to act fast to overturn these Trump rules before the clock runs out on the 60 legislative days since the new Congress began which allow for rolling back a previous Administration's regulatory rules under the Clinton-era Congressional Review Act (CRA).

There is an enormous number of measures that Democrats could reverse immediately, enacted at the last minute by the Trump Administration at dozens of federal agencies such as the EPA, Dept. of Interior, Dept. of Energy, USDA, NOAA, Dept. of Justice, Dept. of Transportation, Dept. of Labor, HUD, HHS, the Veterans Administration, DHS and others. But, as Public Citizen has been reporting, the window to repeal parts of "Trump's deregulatory legacy" is quickly closing before an April 4th deadline to introduce simple resolutions for each specific regulatory action they wish to roll back.

We're joined today by MATT KENT, Regulatory Policy Associate at Public Citizen who, with Amit Narang, has been furiously attempting to sound the alarm about all of this (and about the regulations that the Trump Administration screwed up when issuing them, making it even easier for Biden to reverse on his own.)

"Anything completed within 60 legislative days of the end of the preceding Congress --- so, for our purposes, anything the Trump Administration finalized after August 21, 2020 --- anything after that is available to be undone by this Congress," Kent explains. "There's a real opportunity here for the Biden Administration and the Democratic Congress to more or less supercharge their efforts to use the CRA, to really expand the scope of regulations that are available to be removed --- deregulatory action is a better way to put it."

"This is a filibuster buster," he tells me. "This is something you can use to really get around a huge roadblock in the Senate. That's the way it was designed by the Republicans who created the law."

While the non-partisan government watchdog Public Citizen has long opposed the CRA, Kent argues turnabout is fair play. While the law was little used until Trump came to office, Republicans too advantage of it to overturn more than a dozen Obama-era rules. Kent advises it should be used here again, and then "pull up the ladder" to abolish it.

"The sands are moving through the hourglass here," he says, referencing the upcoming CRA deadline before offering some bewildering news: "So far, there have not been any Congressional  Review Act resolutions introduced at all. I am a little surprised that no Democrat has introduced a disapproval resolution."

He predicts "we'll probably see some in the next few weeks, but the pace has definitely been slow." What could possibly explain the hold up? We discuss.

Finally, Desi Doyen joins us for our latest Green News Report, with some more news about rollbacks to Trump-era rollbacks, specifically, in this case, at the Dept. of Interior. That good news, as usual in the GNR, is balanced by some decidedly less good news --- on another bankrupt coal company hoping to pass its toxic mess on to the tax-payers, and a sleazy (and so far, successful) effort by the natural gas industry to block any and all changes to city building codes, meant to combat climate change, around the nation...

Some pretty huge news on today's BradCast, for the American economy and for the continuing prospects for human civilization. So, yeah, pretty huge news. [Audio link to show is posted below summary.]

Among the stories covered on today's program...

  • General Motors announced on Thursday that it will end the production of all gasoline and diesel powered cars and SUVs by 2035. The announcement signals a potential sea change (both figuratively and literally) in American automobile production --- and not a moment too soon;
  • That news comes on the heels of President Biden's ambitious climate action agenda announced on Wednesday, which includes plans to replace the entire federal fleet of about half a million cars with electric vehicles, fueling about a million new jobs in the industry, and a rapid move away from dangerous, dirty, expensive fossil fuels towards cheaper, cleaner renewable energy. He also called for a carbon emissions-free national power grid by 2035 and full carbon neutrality by 2050. Naturally, fossil fuel-captured Republican officials and Fox "News" dupes are freaking out about the bad news for their industry funders (even if it's great news for their constituents!);
  • The potential boost to jobs and the economy comes not a moment too soon, as federal government numbers released on Thursday reveal that 2020 saw the biggest collapse of the American economy since World War II. The numbers also signal the end of the longest economic expansion in U.S. history (11 years! Thanks, Obama!) and that the average annual GDP growth under President Obama far outpaced that of supposed business genius Donald Trump. Just like the last Republican President before him, Trump inherited a booming economy from a Democratic President and subsequently tanked it for the next Democratic President to have to clean up after him;
  • That next Democrat, President Biden, continued his Executive Order flurry on Thursday by rolling back Trump's efforts to prevent Americans from receiving healthcare coverage. Biden re-opened the Healthcare.gov exchange to allow millions of Americans who lost their jobs during the pandemic to obtain affordable health insurance, which Trump refused to do. (Did I mention we are still in the middle of the worst healthcare crisis in 100 years? Made even worse by the failures of the former President?);
  • Despite all of that --- a new Democratic President working to create millions of new, good paying jobs and provide healthcare and vaccines to all --- there are still a whole bunch of brain-poisoned MAGA wingnuts so misinformed that they are plotting to kill Democratic officials and overthrow the American government. And here I thought dealing with one President in a single hour on The BradCast was tough. Now we've got the previous one on trial after his second impeachment and a new one unveiling an ambitious new agenda to begin cleaning up the other guy's horrific mess, particularly on climate today...and not a moment too soon! [Audio link to full show is posted below summary.]

First up today, the Department of Homeland Security issues a new warning about ongoing threats of violence by domestic, home-grown terrorists in the U.S., many of whom have been radicalized by Donald Trump's many lies about the 2020 election having been stolen.

Then, It's been only three weeks since Trump encouraged his MAGA Mob to march down Pennsylvania Avenue and "fight like hell" to prevent the formal counting of Electoral College votes by the U.S. Congress. The attempted insurrectionists violently broke into the U.S. Capitol, called for the hanging of the Vice President, succeeded in shutting down the tally for several hours and sent lawmakers fleeing for their lives into secured locations. Five people were killed, including a Capitol Police officer, in the ensuing violence. One week later, then President Trump was impeached by the U.S. House for a second time, this time for "Incitement of Insurrection", though the Senate's then Majority Leader Mitch McConnell refused to convene a trial. One week after that, Joe Biden was successfully sworn in as President. And today, just three weeks to the day since the Trump-incited mob's murderous attack on the Capitol, with Democrats now officially in the Senate majority, Trump's second Impeachment Trial has officially begun.

While the arguments in the trial will not be presented in full for another two weeks, Republican Senator and pretend Constitutionalist Rand Paul forced a vote on Tuesday, just after Senators were sworn in as "impartial jurors", to try and dismiss the entire matter by falsely claiming that an Impeachment trial after a President is out of office is "unconstitutional". (Though he repeatedly argued that "private citizens" cannot be impeached and that "If the accused is no longer President - where is the constitutional power to impeach him?")

Joining us today to answer to the clearly false and almost-certainly disingenuous argument proffered by Paul --- and, incredibly, supported by 45 of the Senate's 50 Republicans who voted in favor of his resolution on Tuesday --  is Constitutional law expert RON FEIN of the non-partisan government accountability group Free Speech for People. Fein, with John Bonifaz and Ben Clements, authored the 2018 book, The Constitution Demands It: The Case for the Impeachment of Donald Trump

"The obvious flaw," in Paul's argument, Fein explains, is that Trump WAS impeached while he was President, and then McConnell stalled the process of the Senate trial by refusing to allow it to be held until Trump was already out of office." But on the broader issue, as he tells us, impeachment trials may absolutely be held after an official is out of office. "Congress has done it before and explicitly considered that exact question."

"If their argument was allowed to go forth, then what it would say is that any President can do whatever they want in the last couple of weeks of their term, because by the time they would get impeached, and by the time the Senate could convene for a trial, they'd be out of office already," he persuasively argues. "Disqualification from future office is an important remedy and penalty for impeachment. It is important to have that hanging over the head of a President even in their last couple of weeks in office."

We also discuss whether the votes of 45 GOP Senators --- including McConnell, who just last week conceded that Trump "provoked" the riot at the Capitol --- to dismiss the trial, signals that it will be impossible to win over the 17 Republicans needed to win the two-thirds vote necessary for a conviction; whether a vote can be held to prevent Trump from holding future office even without conviction; whether a second failure to win a conviction in a second impeachment would redound to Trump's benefit; and whether a resolution to censure the disgraced former President would serve as any kind of deterrent for similar behavior in the future (by Trump or other future Presidents), in the event that he is not convicted once again.

Fein also rings in with his thoughts in response to the GOP's stolen and packed U.S. Supreme Court which, on Monday, dismissed two cases regarding Trump's alleged violation of the Constitution's Emoluments Clause as "moot" since he is no longer in office and why it took so long for the cases to even reach the high court. We also discuss whether Fein believes that Trump actually did pardon himself, but is keeping that pardon a secret, somehow, until he's actually charged with a federal crime.

Finally, in far less maddening news, it was "Climate Day" in Joe Biden's new White House on Wednesday! And the new President unveiled an historically ambitious climate agenda that will, among many other things, if successful, result in carbon emissions-free power, nationally, by 2035. Declaring that "we can't wait any longer" to address our worsening climate crisis, Biden detailed his new Executive Orders and Directives to "supercharge" the United States' efforts to combat global warming by pausing new oil and gas leases on federal lands, ending fossil fuel industry subsidies, and creating millions of new jobs in the electric car market and renewable energy industry, and by capping and closing old, unused mines and wells across the nation. His new Climate Envoy, former Sec. of State John Kerry and new White House National Climate Advisor, former EPA Administrator Gina McCarthy, also responded to media questions (naturally framed by rightwing talking points) during a White House briefing. We share some of their remarks, and the entirety of Biden's historic announcement during today's very busy BradCast...
