On today's BradCast: More evidence that the rightwing billionaire Koch network really needs a better security plan. And Republicans really need a more popular agenda. [Audio link to show follows summary below.]

We now have still more audio that has leaked out of a super-secret Koch Network event. The latest is embarrassing yet again for them, as it reveals that even Republican voters want corrupting "dark money" out of politics. Sorry, Koch folks like Mitch McConnell and all of the other elected GOPers who owe their corrupt careers (and votes in Congress) to whatever it is that the Koch Network wants from them! Looks like they'll need to rely on out-and-out lies about what is actually in the Democrats' popular election and campaign finance reform bill known as H.R.1 (the For the People Act) in order to undermine it. But they've become very good at that sort of thing by now.

On Monday, The New Yorker's Jane Mayer published a story about audio she obtained from a super-secret conference call in which the guy running a Koch-backed effort to figure out how to message against H.R.1 concedes that even "conservative" voters appear to like the proposal, which includes disclosure requirements for donations larger than $10,000 to "dark money" non-profit groups like the dozens of "non-partisan" groups run and funded by billionaire donors to the Koch Network.

As Mayer reports: "The speakers on the call expressed alarm at the broad popularity of the bill's provision calling for more public disclosure about secret political donors. The participants conceded that the bill, which would stem the flow of dark money from such political donors as the billionaire oil magnate Charles Koch, was so popular that it wasn't worth trying to mount a public-advocacy campaign to shift opinion. Instead, a senior Koch operative said that opponents would be better off ignoring the will of American voters and trying to kill the bill in Congress."

The research director for a Koch-run advocacy group is heard explaining on the call, which reportedly included a partisan representative from McConnell's office, that when even "conservative" voters hear that the legislation "stops billionaires from buying elections," they support it. "Unfortunately," he tells the group somewhat sheepishly, "we've found that that is a winning message, for both the general public and also conservatives."

We share the full audio disclosed by Mayer on today's program. (And, since I referenced it it today, here's a link to my 2011 exposé of the Koch Brothers' super-secret billionaire confab at a resort near Vail, CO. The first, to my knowledge, to include audio from one of the group's meetings. The several-part exposé I published at Mother Jones and at The BRAD BLOG at the time included audio I obtained revealing the undisclosed keynote speech by NJ's then Gov. Chris Christie, as well as remarks from Charles Koch and others at the highly secured --- but not highly enough secured --- event.)

Also today, Axios reports that economists are very excited about the approximately $3 trillion infrastructure, jobs and, yes, climate plan that Joe Biden is set to roll out in Pittsburgh on Wednesday. He previewed a bit of that plan during his press conference last week. The plan, in theory, will create millions of new, high paying jobs repairing, improving and building roads, bridges, electrical grids and other infrastructure that has been dilapidating for years, while hardening it all for climate resilience in a dangerously warming world. The Koch Network and Congressional Republicans are likely to have a hard time messaging against that long-overdue proposal as well. But we'll find out as much after Biden introduces the plan tomorrow.

Then, a bit of a follow-up to my conversation with Caren Short, Senior Voting Rights Attorney at the Southern Poverty Law Center (SPLC) on Monday's show, about Georgia's sweeping new voter suppression bill. Yesterday, I had asked Short whether SPLC was planning to join either of the so-far two different lawsuits filed by civil rights groups just after the controversial GOP measure was passed by both houses in the state legislature and signed by Republican Gov. Brian Kemp last Thursday, all within a 7-hour time span. She told me the group was looking closely at the suits, but had made no decision yet. Today, SPLC touched base with the news announcing a third suit [PDF] now filed in federal court against the GA law. This one has been filed by the Southern Poverty Law Center, the ACLU, the NAACP Legal Defense and Education Fund and others on behalf of several Black, Latino and Muslim organizations in the Peach State.

AP and others are reporting that President Obama plans to nominate, for FBI Director, Republican James Comey, former Deputy Attorney General under then AG John Ashcroft, during some of the darkest days of the George W. Bush Administration.

The news offer a moment to revisit what a real White House scandal looked like --- back when Republicans had no interest in them and back when there were real investigative Congressional hearings and no need to create pretend "whistleblowers" in order to gin up political "outrage" and "scandal"!

For those of you who believe Benghazi is an actual scandal, or even that the IRS idiocy has anything to do with "tyranny" or "abuse of power", you need only look back to Comey's riveting, could-hear-a-pin-drop, 2007 testimony before the U.S. Senate Judiciary Committee, as he described publicly, for the first time, a very real Executive over reach and astonishing abuse of power that concerned not only the federal government spying on all Americans without warrant or cause, but a White House willing to secretly take advantage of a critically ill Attorney General in order to get approval for a program by having it "certified as legal", even when it clearly was not.

That's what Comey described in his May 15, 2007 testimony --- during hearings on the U.S. Attorney Scandal (another very real one) --- about a remarkable event that took place on the night of Wednesday, March 10, 2004, which threatened to result in the mass resignation of the Attorney General, his Deputy AGs, much of their top-level staff, as well as the Director of the FBI. When asked during the hearing why he had determined to submit his resignation after what he saw and what had happened on that fateful night, he responds to Sen. Chuck Schumer: "I believed that I couldn't stay if the Administration was going to engage in conduct that the Department of Justice said had no legal basis. I just couldn't stay."

His testimony describes the night that the Bush's NSA warrantless eavesdropping program was set to expire, as then AG Ashcroft lay in a hospital Intensive Care Unit with a critical case of pancreatitis. Comey, designated as Acting AG during the AG's illness, had refused the White House demands to certify the NSA program as "legal", as was needed for it to continue. The White House was said to have been furious about it, so Dubya, reportedly, personally called Ashcroft's wife to inform her that his own legal adviser Alberto Gonzalez (who was not yet AG) and Chief of Staff Andy Card, were on their way over to the hospital to have the ailing AG personally sign off on the program.

What happened next, as Comey describes it in his testimony below, was an astonishing moment in a very real Constitutional crisis...

This is the second of our three-part series advancing the hypothesis that one must turn to economics to make sense of the so-called 'War on Drugs' and the U.S. government's seemingly irrational obsession with shutting down something as innocuous as medicinal marijuana dispensaries.

PART 1 examined both historical and recent links between the CIA and the illicit drug trade. It explored the extent to which the so-called 'War on Drugs' has been used as cover for the CIA's covert import of narcotics, both into the U.S. and other nations, in order to fund the mischief the Agency engages in on behalf of U.S. Empire. It postulated that the government’s opposition to controlled legalization, taxation and medical, educational and psychological assistance in avoiding substance abuse is the product of an illicit supplier shutting down the competition.

Lee Fang at Think Progress offers devastating coverage in response to Sen. Rand Paul (R-KY)'s recent claim to The Street's Mallory Factor (video here) that those who pollute streams with benzene should be thrown in jail.

"I don’t want to pollute the water. I don’t want to pollute streams," said Paul, "If you dump benzene in the stream, I want you to go to jail."

Really, Senator? Are you calling for the billionaire Koch brothers --- likely two of your biggest and wealthiest fans --- to be thrown in jail then?

As Fang details, Koch Industries was indicted by the DoJ in 2000 for knowingly dumping "at least 91 metric tons of uncontrolled benzene in its liquid waste streams" at its Corpus Christi refinery, and for conspiring to cover it up in an attempt to deceive regulators.

After George W. Bush took office in 2001, however, "his Attorney General John Ashcroft dropped 88 counts against Koch for the benzene spill and cover-up" in exchange for a guilty plea to falsifying documents and a $20 million fine (a settlement from $350 million in potential fines.)

The Kochs made out pretty well in exchange for their $32,200 contribution to the 2000 Bush campaign. The job killing Koch brothers are making out even better under Barack Obama. But more on that later. [UPDATE: Those thoughts now here.]

Suffice to say, neither the Kochs, nor anybody who works for them, went to jail for "dump[ing] benzene in the stream," as Paul is calling for, even as he calls for doing away with even more environmental regulations in his remarks to The Street.

As we've been highlighting of late, the Republicans have been on a tear against clean air and water regulation by the EPA recently, and have shown themselves willing to partner with their various front groups in the media, at the U.S. Chamber of Commerce, and with folks like the Koch brothers to simply make stuff up about such regulations "killing jobs", in their 2012 "mother of all wars" to retake the White House.

Details panic inside the Bureau, executive effort to 'keep this whole thing quiet' when matter first came to light in 2002
Further confirms FBI translator/whistleblower's allegations, credibility...

An 18-year Counterintelligence and Counterterrorism Manager for the FBI has called for a Special Counsel to be appointed to investigate the allegations of FBI translator-turned-whistleblower Sibel Edmonds. John M. Cole, who now works as an intelligence contractor for the Air Force, made his comments during an audio interview released late last week with radio journalist Peter B. Collins.

He also offered a detailed insider's look at the concerns among high-level officials inside the Bureau as Edmonds' disturbing allegations began coming to light back in 2002, before they would be quashed for seven long years by the Bush Administration's unprecedented use of the so-called "State Secrets Privilege" to gag her.

Earlier last week, following the publication of a remarkable American Conservative magazine cover story interview with Edmonds --- detailing a broad bribery, blackmail, and espionage conspiracy said to have been carried out between current and former members of the U.S. Congress, high-ranking State and Defense Department officials and covert operatives from Turkey and Israel, resulting in the theft and sale of nuclear weapons technology on the foreign black market --- Cole had been quoted by the magazine confirming one of Edmonds' key allegations.

"I am fully aware of the FBI's decade-long investigation of" Marc Grossman, he said in response to the AmCon article/interview. Grossman had served as the third-highest ranking official in the Bush State Department and was alleged by Edmonds in the interview, and in a sworn, video-taped deposition a month earlier, to have been the U.S. ringleader for a massive Turkish espionage scandal reaching through the halls of power and into top-secret nuclear facilities around the country to the benefit of allies and enemies alike. Cole said that the FBI's counterintelligence probe "ultimately was buried and covered up," and that he believes it is "long past time" for an investigation of the case to "bring about accountability."

In his subsequent interview with Collins last week (audio and text excerpts posted below) Cole elaborated on those comments in much greater detail, noting that Edmonds has been "one hundred percent right on the money, on the mark" and confirming the existence of an "ongoing and detailed effort by Turkey to develop influence in the United States" through various illegal activities.

"Yes, I can confirm that," Cole told Collins, "That's true."

The FBI veteran executive also offered an insider's account of the panic that ensued inside the highest echelons of the bureau following Edmonds' first disclosure of information in 2002, recounting how an executive assistant director admitted to him at the time, just after the story first broke, "Well, all I know is that everything that Sibel is stating is true. I read her file. Everything she stated is, in fact, accurate."

Cole further describes how the concerns about Edmonds ultimately led to the Bush Administration's two-time use of the Draconian "State Secrets Privilege" in hopes of keeping her extraordinary information from becoming public. "Everybody at headquarters level at the bureau knew that what she was saying was extremely accurate."

"I know they didn't want her to go out and speak about it at all," Cole revealed, "and I know they were trying to figure out ways of keeping this whole thing quiet, because they didn't want Sibel to come out."

He also offered information which directly counters one of the criticisms of Edmonds' allegations as frequently offered by skeptics. Namely, that as a short time FBI contract translator --- even though she was tasked to review some seven years of counterintelligence wiretaps made from 1996 to 2002 --- she couldn't have had enough understanding of the full scope of the investigations to understand what was really going on.

"The thing is," Cole explained to Collins, "the position that Sibel was in, she had access to extremely sensitive information. The translators have access to some of the most sensitive information that we receive."

He detailed how first-hand information goes first from the translators to the investigators who then act on it, as some of the most important information collected by FBI language specialists could have "implications that may affect even the White House, or policy."

"So what I'm saying is, I know she had access to some very sensitive stuff, and I could see why the Bureau would squirm over her coming out and speaking about some of the things that were going on."

The interview concluded with Cole's reiteration of both his confidence in Edmonds' credibility, and his call for accountability.

"I would love to see, especially with the allegations that Sibel has come out with, her allegations --- which I believe are in fact true, I have no reason to doubt what she's saying --- I would love to see somebody take that, a Special Counsel or whatever, some group of people that you could trust, have them investigate those allegations and have people's feet held to the fire. Have them be held accountable for their actions --- and prosecuted if they've done wrong."

"You know, no one's above the law, and no one should be above the law," he added, along with one more chilling thought: "You know, it really irritates me that people are getting away with murder, in some cases. They should not be allowed to get away with that. There needs to be accountability. And that's what I'd love to see."

Unclassified version of Congressionally-mandated report indicates very few in Bush WH, DoJ knew about unprecedented surveillance of American citizens
Full extent of program still unknown...

Imagine --- just imagine --- the outrage we'd be hearing from every side of the Rightwing blogo-mediasphere if the report [PDF], just out today from the Inspectors General of five different U.S. intelligence agencies, found that President Obama was carrying out a clandestine "Presidential Surveillance Program" that only he, a handful in the White House, and just two or three officials at the DoJ were aware of.

They would, of course, be appropriately outraged (for a change), and even justified in calling for Obama's impeachment over an apparently unprecedented, illegal intrusion into the private lives of American citizens, justified only by a single "legal finding" of one low-level attorney at the DoJ's Office of Legal Counsel.

But will the wingnuts say a word about the report out today showing that Bush/Cheney's criminal outfit did exactly that? Will those who have found our site of late, having come here to justify crazy Sarah Palin's decision to abort in her first term, condemn Bush for any of this, as they surely would had it been found that Obama had been doing the exact same thing? We'll see.

Finally, we're beginning to receive some details on what former Deputy AG James Comey's incredibly dramatic Congressional testimony (video here, transcript here)-- describing his late-night sprint to Ashcroft's hospital bedside to intercept White House officials (Gonzalez and Card) coming over to strongarm him into signing an extension for the still not-fully-disclosed spying program --- was all about.

McClatchy Newspaper's excellent Greg Gordon moves the ball forward again on the Bush White House's insider politicization of the DoJ to achieve electoral advantages via gaming of phony "Voter Fraud" claims and the pursuit of voter suppressing Photo ID laws at the polls.

His article covers the inside moves of the Bush-appointed operative Hans von Spakovsky after he was assigned to the DoJ's voting rights unit, and the games he played in the post, including an anonymously published essay on "Voter Fraud" and Voter ID laws; overriding of career civil rights attorney recommendations against a Georgia Voter ID law (while refusing to recuse himself, despite his past service as a Georgia official), a law which was later found by a federal judge to be unconstitutional and akin to a Jim Crow-era poll tax; and attempts to influence the U.S. Elections Assistance Commission (EAC)'s studies on Voter Fraud and the effects of Photo ID at the polls.

Last year, Von Spakovsky was recess-appointed by Bush to head the FEC, though he will face what could be an interesting Congressional confirmation hearing in the Senate on June 13.

Aside from the many familiar faces (at least to BRAD BLOG readers) who come into play in the story, from Georgia to Arizona to Missouri, one aspect of Gordon's report is a bit of a surprise and so particularly catches our notice...

Assistant A.G. Refused to Renew NSA Program in 2004

The New York Times reports that in 2004 Deputy Attorney General James Comey refused to sign off on renewal of Bush's warrantless NSA spying program. Instead of addressing Comey's concerns, Bush Administration officials took the desperate move of actually visiting Attorney General Ashcroft in the hospital to get his authorization for renewal of the program. Ashcroft was, at the time, in intensive care recovering from pancreatitis.

Comey refused to approve renewal of the program based on concerns over "whether the president had the legal and constitutional authority to conduct such an operation."

In light of these new revelations, Senator Charles Schumer, appearing on Fox News Sunday, demanded that Bush Administration officials testify before congress.

Mitch McConnel, who appeared along with Schumer, chastised The Times for continuing to report on details of the wiretap program. While Schumer said that any investigation should consider a possible whistle-blower status for anyone who leaked this information, Senator McConnel was more interested in punishing the whistleblower.

Because the NSA shared the wiretap information with many federal agencies, it will be very difficult to assign blame to a specific leaker.

Both Attorney-General John Ashcroft and Commerce Secretary Donald Evans were booted resigned just moments ago.

And they were so darn effective! What a shame that, like Fallujah (where at least 16 American troops have been killed in the last 48 hours), this terrible news just happened to break after the election! What luck!

UPDATE: In related news...in case you didn't notice...The "Orange" security alert in both D.C. and NYC was lowered back to "Yellow" for the first time the day after the election and today pedestrian traffic was once again re-opened on Pennsylvania Ave. in front of the White House. The timing for all of these events should continue to not be noticed in any way. Thank you.

UPDATE: Looks like Ashcroft submitted his resignation on Nov. 2. Election Day. But, always in the service of politicizing justice, he remarked in his resignation letter:

It would be my pleasure to structure the announcement of this resignation and the ensuing transition in conjunction with you so that your administration and the cause of justice are served optimally.

I have handwritten this letter so its confidentiality can be maintained until the appropriate arrangements mentioned above can be made.

But rest easy! He also informed the "President-Elect":

The objective of securing the safety of Americans from crime and terror has been achieved."

Phew! Thank you Mr. A-G!

And now, ladies and gentlemen, for (hopefully) the last time...The Attorney General sings.
