Guest: The Nation's John Nichols...

On today's BradCast, we begin with the sad breaking news about Jimmy Carter's illness and a few thoughts on the ailing former President. Then, it's onto a bit of fact-checking on "ObamaCare" and on Jeb's silly, fact-free foreign policy propaganda speech last night at the Reagan Library.

Next, Wisconsin's own John Nichols of The Nation joins us to explain new revelations about an old criminal investigation of Wisconsin Governor and 2016 GOP candidate Scott Walker and his remarkable ability to blatantly lie about that and so much more.

"Scott Walker is, frankly, better than just about anybody in American politics at gaming the media," Nichols, who has covered him for years in the Badger State, tells me. "At counting on the media to take his absolute denial and give it the same treatment as the accusations, the charges, rather than getting to the bottom of it to actually figure out whether something is there."

He explains that Walker is clever enough to realize that lying works with today's Rightwing electorate, who get their news from very selective sources that rarely bother to fact-check. "He is, in fact, the embodiment of where our politics is going," Nichols warns, citing a description of Walker as "more Nixonian than Nixon."

Then, Nichols, a long time supporter of Bernie Sanders, addresses the recent controversy concerning Black Lives Matter protesters confronting the Vermont Senator and quickly rising 2016 Dem candidate to suggest that, as he explains in detail at The Nation today, such protests have, in fact, made Presidents such as FDR and Kennedy much greater than they might have been otherwise. He argues that the BLM protests have already had a similar effect on Sanders' campaign.

"What we should understand is that pressure from activists often makes politicians into what we like about them, what we respect about them," he says. "What it means is that pressure from activists forces politicians --- and Presidents even --- to step up, to do what they should do, do what will make them more universal in their appeal."

Finally, some very good polling news for Sanders in New Hampshire and more embarrassing polling news for Bush, Walker and the rest of the Republican Party...

Buckle up! On today's BradCast, we jump on board the crazy train to dissect last night's GOP/Fox 'News' Presidential Debate(s)!

My guests today are award-winning blogger/journalists Heather Digby Parton of Digby's Hullabaloo and Paul Rosenberg of Random Lengths News --- both also contributors for Salon.

Can Trump ever be derailed? Fox 'News' and Roger Ailes sure seems to be trying. And does any of it actually matter a year and a half out from the general election and more than six months before any votes are ever cast? We discuss all of the above (after "Digby" and I take short victory lap concerning Donald Trump!) and much more in today's post-debate roundtable!

"[Trump] has absorbed all of the rightwing tropes of the past 30 years and made them his own. He's ingested them, digested them, regurgitated them, played with them, shaped them into figurines, and just endlessly fascinated himself with them, and invited people to play along with him," Rosenberg tells me. "And people are happy to do so, because he is their ideal --- he is a super-wealthy person who is 'just one of us'."

For her part, Parton says the debate actually does matter, for one reason, "because what we're seeing are the contours and outlines of the Republican argument. I think it's pretty clear they're going to be running as war-mongering, tax-cutting, slash-and-burn politicians who are going to roll back everything that's happened in the last eight years. And they're going to do it all in the first day, so that's good."

A fascinating and fun discussion! Plus: Desi Doyen joins us for the latest Green News Report' on another new candidate in the GOP race and the pushback against the President's new rules for emissions cuts...

Guests: Peace activist David Swanson; Const. law expert Ian Millhiser

It was a much bigger show today than we had expected when we started it!

First up on today's BradCast, author, peace activist David Swanson joins us to discuss Obama's speech today at American University on the Iran Nuclear Agreement. While Swanson is (somewhat uncharacteristically) optimistic and encouraged by the deal, he has concerns about how Obama and other Dems are misleading Americans in order to sell it. "I love that, for once, President Obama wants peace. I love that, for once, he's using diplomacy rather than war. I wish he would use that in eight other places on earth," Swanson tells me. "But at the same time he's pushing the propaganda of his opponents."

Then, Swanson asks, "Why Won't Bernie Talk About War?" A new petition from RootsAction.org asks Democratic Presidential candidate Bernie Sanders to start speaking up against U.S. militarism which, as Swanson argues, the U.S. Senator from Vermont has, up until now, been very reluctant to do for some reason.

Then, as we went to break, huge news came in from the very conservative 5th U.S. Circuit Court of Appeal striking down the Texas GOP's polling place Photo ID restriction law. The opinion confirms most of a lower court judge's previously ruling finding the restriction to be in strict violation of the Voting Rights Act as well as the U.S. Constitution. Constitutional law expert Ian Millhiser joins us to explain the very encouraging opinion from the court --- which comes, incidentally, just one day before the 50th Anniversary of the Voting Rights Act of 1965 --- and what happens next.

"The court got that voter ID laws do not really serve the purpose that their supporters say they're supposed to serve," Millhiser explains. "The court got that this was an attempt to dress up something that looks like a legitimate voter regulation in order to really do something else, which was to prevent groups like racial minorities and low-income voters who tend to prefer Democrats over Republicans from casting a ballot."

But, he also warns, "this wasn't a total victory for the good guys." Listen to the show for all the details.

Finally, in the few minutes we have left, we squeeze in some Presidential politics in advance of tomorrow night's first GOP Presidential debate, as sponsored --- and rigged by --- Fox "News". And, yes, that Republican debate will take place, ironically enough, on the 50th Anniversary of the landmark federal Voting Rights Act which Republicans used to support...until they decided they couldn't win elections anymore if all those "people" (read: qualified American voters who tend to vote Democratic) were allowed to vote.

Award-winning journalist charges LAPD 'basically stole something out of evidence room ... to send a message to other reporters'

While the nation is getting more progressive by the day, it doesn't appear to be getting much easier for progressives in the corporate media. On today's BradCast, we talk about two progressive journalists both fired from two different corporate media outlets within the past week.

Award-winning syndicated editorial cartoonist, author and columnist Ted Rall joins us to discuss his bizarre firing by the Los Angeles Times last week after the LAPD leaked a 14-year old audio tape of Rall being ticketed for jaywalking to the paper. They claim it disproves a recent claim about the incident made by Rall in an LA Times column last May. Audio enhancement of the poor quality tape, however, suggests otherwise.

Why did the paper trust the LAPD without authenticating a 14-year old audio tape that appeared from nowhere? And was the firing about more than just that one column?

"Look, I pissed off cops. I've done many anti-LAPD cartoons and essays over the years. The LAPPL [Los Angeles Police Protective League] made clear in their blog that they have long been angered by me, and they are crowing about my dismissal. So, just at a bare minimum, think about how disturbing this is," Rall tells me. "The LAPD, or the LAPPL, passed illegally --- basically stole something out of the evidence room --- slipped it to the top editors at the LA Times, one of the biggest and most widely-respected metro-dailies in the United States, in order to get me fired. In order to send a message to other reporters, 'don't screw with cops'."

"This would be disturbing, even if I'd been lying," Rall explains. "Even if I'd been fibbing, this would be the nuclear option." He believes, however, that the professionally enhanced audio tapes completely exonerate him and tells me that the LA Times (who has yet to respond to my request for comment on this) has stayed mum since the professionally enhanced audio has been published.

"This is a huge story. This is an epic example of corruption at the highest levels of government and media. I don't want to use the 'c' word, conspiracy, but it might legally be considered a conspiracy," Rall believes. He tells me he is now considering his legal options against both the paper and the police.

Also on today's program, D.R. Tucker of The Washington Monthly (and, too occasionally, of The BRAD BLOG) joins us to discuss MSNBC's firing of Ed Schultz last week and the impact it may have on corporate coverage of both the TPP and of climate change, particularly following Schultz' remarkable reporting last year which subsequently led to his reversal on support for the Keystone XL pipeline.

"It's not often that you see somebody have a principled change of heart," Tucker explains. "And of course he was pilloried for that by the shills for the fossil fuel industry for daring to change his mind. But he stood his ground, and he basically maintained, right up until the day he was off the air, that the Keystone XL was a bad idea."

Finally, Desi Doyen joins us for the latest Green News Report on Obama's new EPA rules for slashing carbon emissions at power plants in a landmark action to fight global warming...

Last week, Federal Election Commission (FEC) disclosures for the 2016 Presidential contest confirmed that wealthy Super PAC donors are now spending more than three times as much as small donors. As Politico describes the "gusher of cash" now pouring into American elections from millionaires and billionaires, the "67 biggest donors, each of whom gave $1 million or more, donated more than three times as much as the 508,000 smallest donors combined."

At the same time as that obscenity plays out, a select few GOP Presidential candidates auditioned for the Koch Brothers and rich friends over the weekend in California, where Charles Koch compared their political fight to the Civil Rights Movement. Seriously. Politico's Tarini Parti, joins us on today's BradCast to discuss all of the above and Politico's own controversial role in the weekend confab.

Then, Chuck Lindell of the Austin American-Statesman joins us to discuss today's indictment and arrest of Texas' brand-new Attorney General Ken Paxton (R-Tea Party) on three felony counts related to securities fraud. Thanks to a law Paxton helped pass when he was a member of the TX House, he could now be facing life in prison if convicted on the charges being brought by Special Prosecutors (one of whom was formerly Republican U.S. House Majority Leader Tom DeLay's defense lawyer). The indictment is in response to a complaint filed by one of Paxton's fellow GOP statehouse members. None of that, of course, has kept the state's Republican Party from declaring the entire matter to be a partisan witch hunt.

Lindell also updates us on the status of Texas' even more notorious felony indictment, the one against the state's former Governor and current GOP candidate for the 2016 Presidential nomination, Rick Perry. The trial in that case, Lindells tells me, "could take place as early as December --- or right before primary season opens up" in January.

Finally today, President Obama unveiled the new EPA rules for cutting carbon emissions at power plants in all 50 states by some 30% over 2012 levels. Can you hear the wingnut heads exploding?...

On today's BradCast, we start where we left off on yesterday's show, regarding Thursday's amazingly corrupt and disturbing ruling in favor of Scott Walker and his cronies --- by the amazingly corrupt Wisconsin Supreme Court --- and how, if Republicans have their way, that ruling may soon enough become the law of the land for the entire nation.

As our producer Desi Doyen noted on today's show: "This is your early warning system." Ignore at your peril. Then it was on to a couple of quick items and updates, including dumb Confederate flag wavers in Oklahoma and Maine's even dumber Governor Paul LePage.

From there, we head to North Carolina, where "the most extreme anti-voter bill passed by any state since the Jim Crow Era", as we initially described it when it was passed by state Republicans back in 2013, is finally now facing trial against the NAACP, the ACLU, the DoJ and other democracy and voting rights advocates.

We are joined by The Nation's author/journalist Ari Berman, who was in the federal courtroom in Winston-Salem, NC this week as the trial finally got under way. The results of this trial are likely to head all the way to the U.S. Supreme Court, one way or another, and may well determine the future of voting rights in this country. The new voting restrictions were passed in 2013, just days after the U.S. Supreme Court demolished the provision of the Voting Rights Act that otherwise, says Berman, would have kept this law --- which is "already disenfranchising voters" --- from even taking effect.

"That's such a clear case study to me that the Supreme Court was wrong when it said that the special protections of the Voting Rights act weren't needed." Berman goes on to explain why he believes NC, a state which had made astounding progress in voting rights over the previous decade, has now become the new Selma, Alabama, where the bloody fight for voting rights led directly to passage of the federal Voting Rights Act in 1965.

"In North Carolina, they had seemingly everything," Berman tells me. "They had all these voting reforms --- early voting, same day registration, pre-registration for 16 &17 year olds. And it was all taken away or reduced" when the GOP took over both the state legislature and Governor's mansion for the first time since Reconstruction in 2013.

"What Selma in the 1960s and what North Carolina in the 2013-2015 era shows is how far these conservative white Southerners will go to protect political power. There aren't billy clubs. There aren't literacy tests. But they're saying this is how black turnout increased --- North Carolina went from 48th in voter turnout in the late 80s, to 11th in voter turnout in 2012 --- Republicans there basically said we're gonna tamp this turnout down."

And now it's left to the courts to find out if those rights, once granted, can be taken away by political whim --- and if NC, and other states with a history of racial discrimination in elections, will be forced once again to face preclearance from the federal government before they can enforce any new voting restrictions.

Berman has a lot of insight on all of this. His new book, Give Us the Ballot: The Modern Struggle for Voting Rights in America, will be published next month to coincide with the 50th Anniversary of passage of the VRA. As I note during the show, the book is an exhaustively researched and heart-wrenching documentation of the uniquely American and harrowing tale of the fight to vote in this country --- and the outrageously long and continuing effort to block it. That fight continues, sadly, to this day. Go buy his book!

Constitutional law expert Ian Millhiser...

Yes, Donald Trump is still leading in the national polls, but, after that, we turn to slightly more serious topics on today's BradCast, as a nuclear deal is finally struck between Iran, the U.S., China, Russia, France, Great Britain and Germany.

But, of course, those heads you hear exploding are (mostly) Republican Presidential candidates who, it seems, are either talking about another deal entirely or they haven't a clue how foreign policy actually works or maybe they've been living in a cave over the past 15 years. (Particularly the years from 2000 to 2008.)

Scott Walker, a very serious candidate for the Republican nomination, is particularly daft on the issue, opposing the agreement with Iran on absolutely ridiculous grounds. But his domestic policy is quite a different and far more disturbing matter. It includes a legal/political/Constitutional philosophy that, while once rejected by the courts and largely left for dead, is now "ascendant within the Republican coalition," as my guest, constitutional law expert Ian Millhiser explains on today's show.

"One thing that has transformed amongst the American right in the last several years is a desire to implement their agenda through any means necessary --- and if that means bypassing the democratic process and just getting their friends on the Supreme Court to implement it, they're happy to do that," Millhiser tells me while discussing one key dog-whistle offered during the Wisconsin Governor's announcement of his 2016 GOP candidacy on Monday.

"What they're doing here is they're trying to effectuate a wholesale transfer of power from the two branches of government that are elected to the one branch of government that is not elected," he says. "And I don't care what your agenda is, that's not something that should be done."

We have a number of encouraging items on today's BradCast, believe it or not, regarding elections and campaign finance for a change.

But first today, after an emotional debate in South Carolina, the Confederate flag will finally come down at the state capitol on Friday - clearing the way for debate on stuff that may actually reduce gun violence, racism and terrorism. But in the U.S. House, it's business as usual as the GOP fails on a Confederate flag-related amendment.

After that, another reminder why Internet Voting would be a disaster, and a bit of Trump news (which I know you crave every single moment --- don't lie!), some very good news today from the Florida Supreme Court on redistricting and even more good news from the U.S. Court of Appeals in D.C. on campaign finance.

Hamline University professor of political science and law David Schultz --- author of last year's Election Law and Democratic Theory and the upcoming Presidential Swing States: Why Only Ten Matter --- joins us to discuss those cases and four important steps he's laid out which could be taken immediately to reform our nation's campaign finance embarrassment. The best news: none of the steps require either a Constitutional amendment or our broken Congress! (Though it might require the President of the United States to step up.)

Among those steps, the FCC, for example, could immediately require free airtime for candidates over our public airwaves. "About 60-70% of all the money that will be spent in Presidential elections will be spent on media advertising predominantly on television," Schultz explains. "Forty years ago, the average time that a candidate got on the national news to describe his or her position was about a minute. Now it's down to about ten seconds."

"Requiring that free air time would be perfectly Constitutional" in exchange for licenses granted by the FCC. "If the FCC can move on Net Neutrality, it can move on this." But that's just one of several executive agencies which the President could instruct to take action without the need for Congress or amendments to the U.S. Constitution.

Today's landmark SCOTUS ruling on marriage equality was an extraordinary end to an extraordinary week. So, that what I was more than happy to cover on today's BradCast.

Rights win again, as the U.S. Supreme Court finally declares marriage equality to be a fundamental right to Americans in all 50 states in the union. We discuss the 5-4 opinion in Obergefell v. Hodges, its Constitutional basis, its fallout, its dead enders, and how we predicted it years ago --- even as the GOP was using "gay marriage" as a politicized weapon back in the 2004 elections.

Our guest is Raw Story's Mike Rogers, who, as a journalist, has been helping to lead the way in this fight for years and served as the inspiration behind Kirby Dick's 2009 documentary film, Outrage, "a searing expose of the secret lives of closeted gay politicians".

Rogers credits the Internet and the first-hand coverage of cases that it allowed, for shifting American opinion so quickly on the issue. It "gave us the opportunity to do the most important thing, which is to tell the stories in our own voices," he explains. "America hearing from those folks, and being able to more creatively use the media and the web --- to be able to move those stories of people with kids, people with spouses, people who were widowed like Jim Obergefell in his case, and what it will mean for him and his family now that his marriage is recognized in Ohio --- that happened because of a shifting change in the media. Change doesn't happen without that."

Mike has also been a long-time friend of the blog and the show, having joined us for our "Big Gay Hour" episodes years before such things were done in polite company over our nation's public airwaves. Guest: Dr. Laura Pressley, Austin City Council candidate...

On today's BradCast...The U.S. Supreme Court announces its decision [PDF] in King v. Burwell, a case that would have gutted the Affordable Care Act ("ObamaCare"). As usual, Justice Scalia, on the losing side once again, displayed his extraordinary hypocrisy in his dissent to a case that was stupid to begin with. I explain on today's show.

Then, the last election challenge of 2014 (as far as we know): Dr. Laura Pressley joins me explains why it's impossible to know whether the results of her runoff election for Austin City Council were accurately tabulated on the 100% unverifiable electronic voting systems used in Travis County, across much of the state of Texas and across much of our country.

"We're not just fighting this for our single city council district race. This is a bigger issue," Pressley explains. "Elections have to be verifiable. Candidates need to have the right to question and ask for validation. This is a tenet of our democracy."

Pressley charges that the unverifiable Hart-Intercivic eSlate voting systems actually violate the Lone Star state's own elections laws, even as they clearly undermine overseeable democracy. Remarkably, she says she is now facing a potential court fine of $100,000 for simply bringing her challenge, following some rather disturbing irregularities on the voting systems during her runoff and a complete inability to recount thousands of in-person electronic ballots despite an exact tie on the Vote-by-Mail paper ballots.

Her case was dismissed in state court, but she is appealing the decision and tells me: "One of the comments [in court] was, we needed to be punished as a candidate for challenging these electronic voting systems and that the sanctions should reflect a punishment to deter other candidates from bringing this forward."

Fallout continues --- much of it surprisingly encouraging, thankfully --- following last week's racist terrorist shooting at the Emanuel AME Church in Charleston.

In its wake, I spoke to Sean McElwee of Demos on today's BradCast about his new study comparing the racist views of white Fox 'News' viewers versus white non-Fox 'News' viewers, and self-identified "conservative" Fox 'News' viewers with "conservatives" who don't watch Fox.

He describes the findings as "a deep indictment of the way that Fox News portrays the news." The analysis also examines whether regular viewers of Fox' The O'Reilly Factor are more racist than Fox 'News' viewers who do not regularly watch O'Reilly. The results, as they'd say on The Factor, will shock you! (Or not.)

"It's very clear that Fox News is playing on the racism and the latent racial resentment of many whites in the country," McElwee tells me. "You can see that on their coverage of the 'ground zero mosque'. You can see that on their coverage of the Trayvon Martin case. It's very clear." But does that racist coverage rub off on their viewers or vice versa? We discuss, you decide.

Also on today's show, several Senate Democrats help Republicans and President Obama move "Fast Track" authority for TPP and other trade deals forward in Congress; FEC Commissioners are not 'persons', according to the FEC; And an update on the federal case against postal worker Douglas Hughes, who landed his gyrocopter at the U.S. Capitol in April (our interview with him at the time is right here) in hopes of bringing attention to the need for campaign finance reform...
