On paper, Donald B. Verrilli, Jr., who was appointed by President Barack Obama to replace now Supreme Court Justice Elana Kagan as the U.S. Solicitor General, appears to be an experienced litigator with a distinguished background.

It is a background that includes having served as a law clerk for former U.S. Supreme Court Justice William Brennan, Jr. and having participated in over 100 cases before the U.S. Supreme Court. However, Verrilli's participation in Supreme Court oral arguments --- earlier with respect to the Affordable Care Act (ACA, or "ObamaCare") and, recently, in the challenge to Section 5 of the Voting Rights Act, as well as U.S. v. Windsor, with respect to the Defense of Marriage Act (DOMA) and in Hollingsworth v. Perry pertaining to California's Proposition 8 --- raises some disturbing questions.

Either Verrilli lacks the professional competence to assume primary responsibility for supervising and conducting litigation on behalf of the U.S. Government before the Supreme Court, or Verrilli, and the Obama administration, are so politically fearful of staking out principled positions that they have opted for a muddled middle ground. Perhaps it's a little of both.

Regardless, if the Windsor and Hollingsworth cases should establish a constitutional right of same-sex couples to marry, as urged by attorneys Ted Olson (R) and David Boies (D) in their Prop 8 Supreme Court brief [PDF], it will be despite the half-baked arguments presented by the Solicitor General, not because of them...

A week or two ago, after seeing Attorney General Eric Holder, in Senate testimony, pretend that he was "concerned" about a lack of prosecution of big banks due to their being too large, I described his claims, in a bit of a rant here as "complete bullshit".

Before things turn too ugly this week, let's take a moment to flag four great progressive things --- arguably, four great conservative progressive things --- which all happened on Friday.

The first two items got a fair amount of notice, the second two, not so much. But since they all happened on the same day, and that day was Friday, when such stories tend to disappear all together, they are all worth briefly flagging here to make sure you're aware of them...

  • Sen. Rob Portman (R-OH), a co-sponsor of the unconstitutional "Defense of Marriage Act" (DOMA) in 1996, became the first sitting Republican Senator to come out in favor of marriage equality for all. It took him learning that he had a gay son two years ago before he was finally able to do the right thing, but we'll take what we can get. It's another in a string of victories and very encouraging signs for conservative progressivism, specifically the right of equal protection under the law for all.
  • The Maryland legislature voted to ban the inhumane, abhorrent, expensive, ineffective and unequally applied Death Penalty. They become the 6th state in as many years to do so, and the 18th state overall. As Governor Martin O'Malley (D) notes in an op-ed today: "Across our ever-more-closely connected world, the majority of public executions now take place in just seven countries: Iran. Iraq. The People’s Republic of China. North Korea. Saudi Arabia. Yemen. And the United States of America." This is another clear victory for those who believe in the Constitutional value of equal justice for all under the law and who hate Big Government --- the biggest --- allowing itself to kill its own citizens.
  • A federal court ruled that the use of so-called "National Security Letters" --- essentially, a warrantless statement from the FBI handed over to banks, libraries, phone companies, etc., demanding unlimited private information about a specific person for supposed "national security purposes" --- is unconstitutional. Specifically, the gag order on those banks, libraries, phone companies, etc., disallowing them from notifying the target about the intrusion on their privacy, is what the judge found in violation of the First Amendment. The case brought by the Electronic Frontier Foundation(EFF). The use of these letters have been one of the most insidious and abused elements of the PATRIOT Act for a very long time, ever since its passage following 9/11. The court ruling is likely to be appealed by the DoJ, but the finding is, for now, a positive step in the right direction --- at least for those of us conservative progressives who give a damn about unwarranted search and seizure, freedom of speech, etc. AP notes that "the FBI made 16,511 national-security-letter requests for information regarding 7,201 people in 2011" alone.
  • A federal appeals court has re-instated a case filed by the ACLU arguing that the CIA must, at the very least, respond to Freedom of Information Act (FOIA) requests concerning the use of the drone strikes. The FOIA requests in question had sought information on "the legal basis for carrying out targeted drone killings; any restrictions on those who may be targeted; any civilian casualties; any geographic limits on the program; the number of targeted killings that the agency has carried out; and the training, supervision, oversight, or discipline of drone operators." Even if the ACLU is ultimately victorious in this case, the CIA would not necessarily have to provide the information sought in those requests, but they would at least have to respond to them and state which responsive documents they may have and why they are not responding. The ACLU notes that the drone program "has already been responsible for the deaths of more than 4,000 people in an unknown number of countries."

After the two court rulings above on Friday, former Constitutional attorney and civil liberties champion Glenn Greenwald tweeted wryly: "Wow ... it's like we have a 3rd branch or something."

Much of this nation's government, all three branches, are largely stuck and broken in the muck and mire of partisan, corporate-sponsored quagmire or worse. So the fact that we had four important, not-horrible, arguably excellent things happen within that quagmire all on the same day on Friday are worth, at least, noting here for the record.




Or, What's Wrong With the Entire Goddamn System in 2 Short Videos...

This exchange --- by Congressional committee proxy --- got a bit more buried than it deserved to be amidst a week of important (Rand Paul's drone filibuster) and not so important (Presidential/Congressional dinner dates!) news items last week.

You may have already seen both of these clips. But just in case you haven't, the remarks made during two different Congressional hearings last week illustrate the very heart of the most broken part of our broken government, so I wanted to be sure to at least flag these two short videos here.

The first was Attorney General Eric Holder's remarkable admission last week, when asked about why one the world's largest banks, such as HSBC --- which admitted to some $881 million dollars in drug cartel money laundering and working with regimes in a number of countries around the world in blatant violation of human rights sanctions against them --- have not been brought to trial by the Obama Dept. of Justice...

"The concern that you have raised is one that I, frankly, share," Holder responded to Sen. Chuck Grassley (R-NE). "I am concerned that the size of some of these institutions becomes so large that it does become difficult for us to prosecute them when we are hit with indications that if you do prosecute, if you do bring a criminal charge, it will have a negative impact on the national economy, perhaps even the world economy. And I think that is a function of the fact that some of these institutions have become too large."

"It has an inhibiting influence --- impact --- on our ability to bring resolutions that I think would be more appropriate," he continued. "So, the concern that you raise is actually one that I share."

With all due respect to AG Holder --- and he is due very, very little --- what he just said is, to the best of my knowledge, complete bullshit. While I'm not an expert in financial law, I am familiar with no clause in any of those laws which offers a "get out of jail free card" to institutions who have become so large that prosecuting them would have "a negative impact on the national economy, perhaps even the world economy."

I know of no provisions in the criminal code which says that if your corporation has become large enough that facing criminal prosecution might make the world markets jittery, you don't have to face prosecution for those crimes. In fact, we still have anti-trust laws on the books to deal with exactly those situations --- cases in which corporations have become so powerful, have such a monopolistic effect on the market, that they may be broken up by the Dept. of Justice, or even taken over and then sold off piece meal to bring the company back into manageable size again.

The next day, in another U.S. Senate hearing, Sen. Elizabeth Warren (D-MA), expressed a similar sentiment, in a must-see video clip, absolutely slamming U.S. Treasury regulators for their lack of willingness to take action against some of the most criminal corporations, such as HSBC.

"What does it take to get you to consider shutting down a bank for money laundering?!," she asked the regulators who couldn't respond as to the last time a bank had been prosecuted for this sort of thing. "How many billions of dollars before somebody says we're shutting you down?"...

So what do the Chinese Government and the Rightwing mega-lobbying group calling itself the U.S. Chamber of Commerce have in common? Apparently, they are both interested in hacking into the computer networks of their perceived political opponents and appear to be using very similar techniques and tools to do so, as The Nation's Lee Fang reported on Monday.

A computer security expert cited by Fang notes "lots of overlap" between the recent documented Chinese military cyber hacks and tactics proposed for use by federal contractors working with the U.S. Chamber and their attorneys to discredit their enemies.

Readers of The BRAD BLOG will likely remember the emails hacked by Anonymous in February of 2011 revealing that three U.S. government defense contractors had been working with U.S. Chamber of Commerce attorneys from the Washington D.C. lobbying/law firm of Hunton & Williams to develop a $12 million scheme to target their political opponents --- such as unions and progressive organizations --- by hacking into their computer networks, infiltrating the groups, planting false information in hopes of discrediting them, and using other sophisticated computer tools developed for the "War on Terror" by the three cyber-security firms.

One of the perceived political opponents targeted by the Chamber, we would learn from the hacked emails, was I. Personal details about myself and my family showed up in both the emails and a PowerPoint presentation for the U.S. Chamber prepared by "Team Themis," the name used for the illicit project by the three government contractors, HBGary Federal, Palintir, and Berico.

Lee Fang, who was then a reporter for Think Progress, and Scott Keyes, who still is, originally broke the revelations from the hacked HBGary Federal emails there. A slide in one of the presentations prepared for the U.S. Chamber scheme described the effort to "Discredit, Confuse, Shame, Combat, Infiltrate [and] Fracture" the progressive organizations with online tools, hacking and other dirty tricks in order to "mitigate [the] effect of adversarial groups."

Another slide included a photograph of me, and other personal details meant to target VelvetRevolution.us, a not-for-profit good government group (co-founded by The BRAD BLOG) which has long called for accountability for the Chamber and its mafia-like political tactics.

The news of the hack and its revelations quickly garnered front-page headlines in the U.S. and around the world as an international scandal, even as the Chamber denied having knowledge of the specific cyber-terror threat clearly being created on their behalf by the three defense contractors, and even as neither they nor their attorneys have yet to face any accountability for the scheme to terrorize public organizations and private individuals, such as myself and my family. An official Dept. of Justice investigation into the matter --- and even a brief attempt to do so by Democrats in Congress --- was no doubt crippled by both the enormous power of the Chamber, and the fact that it was the DoJ itself which had referred Bank of America to the very same defense contractors in a parallel scheme mirroring the Chamber's, as revealed by the same email hack. That scheme was being prepared to target perceived supporters of WikiLeaks at the time, including journalist Glenn Greenwald.

"[W]ho better to develop a corporate information reconnaissance capability than companies that have been market leaders within the DoD and Intelligence Community," read one of the proposals [PDF] created by "Team Themis," as delivered to the U.S. Chamber of Commerce's law firm Hunton & Williams.

In Monday's report at The Nation, Fang details how recent cyber attacks against U.S. interests, which appear to be emanating from the Chinese Military, mirror tactics used by the U.S. Chamber's thugs in the eventually aborted 2010/2011 attempt to pull off what Fang describes as "one of the most brazen political espionage efforts in recent memory."

Here is the 'white paper'. With a few tweaks and a more creative title --- like "Murder With Your Hands Clean" --- this memo could sell a lot of copies.

And why not? Either there's a whistleblower in the Department of So-Called Justice about to be charged with espionage, and NBC is about to face the same persecution as WikiLeaks, or this is one of those "good" leaks that the White House wanted made public in an underhanded manner --- perhaps as an imagined boost to morality-challenged CIA director nominee John Brennan who faces his Senate Rejection Hearing on Thursday.

The white paper, which is thought to be a summary of a longer memo, says the United States can murder a U.S. citizen abroad (abroad but somehow "outside the area of active hostilities" even though killing him or her seems rather active and hostile) if three conditions are met:

1. an informed, high-level official of the U.S. government has determined that the targeted individual poses an imminent threat of violent attack against the United States;

The memo goes on to base its claims on the supposed powers of the President, not of some random official. Who is such an official? Who decides whether he or she is informed? What if two of them disagree? What if he or she disagrees with the President? or the Congress? or the Supreme Court? or the U.S. public? or the United Nations? or the International Criminal Court? What then? One solution is to redefine the terms so that everyone has to agree. "Imminent" is defined in this memo to mean nothing at all. "The United States" clearly means anywhere U.S. troops may be.

2. capture is infeasible, and the United States continues to monitor whether capture becomes feasible;

And if a high-level official claims it's infeasible, who can challenge that?

3. the operation would be conducted in a manner consistent with applicable law of war principles.

When a U.S. drone strike killed Anwar al-Awlaki and Samir Khan, no one had shown either of them to meet the above qualifications.

When a U.S. drone strike targeted and killed 16-year-old Abdulrahman al-Awlaki, no one had shown him to meet the above qualifications; I don't think anyone has made such a claim to this day. And what about his cousin who died for the crime of being with him at the wrong time?

The sociopaths who wrote this memo have "legalized" the drone-killing of Americans with the exception of all the Americans known thus far to have been murdered by our government with the use of drones.

So this happened quietly last week:

A federal judge approved a settlement resolving the class action lawsuit filed on behalf of demonstrators who were pepper-sprayed at UC Davis in 2011.

U.S. District Court Judge John Mendez on Wednesday gave the final approval for the $1 million settlement, initially filed in September.

As part of the settlement, the university has agreed to pay $30,000 to each of the 21 plaintiffs, a total of $250,000 to their attorneys and a total of $100,000 to 15 other claimants.

The settlement also stipulates that UC Davis Chancellor Linda Katehi issue a formal written apology to the students and alumni who were pepper-sprayed. It also calls for the university to develop new policies regarding student demonstrations and use of force.

In the very same week...

• A military judge agreed that U.S. Army Private Bradley Manning's pre-trial confinement, for having allegedly leaked classified diplomatic cables, was excessively harsh, but refused to dismiss the charges against him. Instead, the judge reduced 4 months from Manning's potential life sentence that he hasn't even received yet while being jailed for 2 years and 8 months, so far, waiting for his day in military court. The judge also delayed the start of his trial for another 3 months in the bargain.

• 26-year old activist and Internet prodigy and pioneer Aaron Swartz killed himself after what his family describes as bullying by a federal prosecutor who filed 13 felony charges against him --- with potential penalties of nearly 50 years in prison --- for something that has never been a crime and has no victims.

Meanwhile, just a few weeks earlier...

• Britain's largest bank, HSBC, was slapped on the wrist with a $1.9 billion settlement (a few weeks of profit) for having knowingly laundered billions of dollars for drug cartels and terrorist organizations and rogue states after federal prosecutors in the U.S. decided that any harsher punishment --- such as larger fines or taking them to court or, God forbid, sending any single one of their employees or board members to prison for even a day --- would potentially result in bankruptcy for the "too big to jail" international bank.

And, a few weeks before that...

• Oil giant BP pleaded guilty to 11 counts of manslaughter and other criminal charges related to the massive oil spill and deaths of 11 men on the Deepwater Horizon oil rig in the Gulf of Mexico in 2010. They agreed to pay $4.5 billion in fines (they made more than that in profit alone in the third quarter of 2012) over a five year period. Nobody would face any jail time in the settlement.

Yet, all the while...

NRA stooges continued to pretend that their big bad assault weapons are responsible for keeping this country safe from big government tyranny.

What the fuck is wrong with this picture, those people, this Administration, our Dept. of Justice, and this country?

Susan Rice and the Democrats once again succumb to the demands of terrorists.

• Whodathunkit? But questions arise about the legitimacy of the claims made by Fox' latest wannabe James O'Keefe, about that video purporting to show an "unprovoked attack" by "union thugs" outside the capital building in Lansing, MI this week. The most amazing part? Someone at The New York Times --- yes, that New York Times --- is one of those actually noticing the big honkin' edit in the middle of the video, rather than just reporting it all as unquestioned fact.

Eric Holder spoke about the need to protect voting rights at the John F. Kennedy Presidential Library. We have more than a few bones to pick about it, but we'll just point you to the actual speech for the moment.

• What's the difference between this and just stealing? House Republicans secretly --- secretly --- authorized $500,000 in tax payer dollars to defend the unconstitutional "Defense of Marriage Act". More of that small government "conservatism", apparently.

• Finally, for now, the critically acclaimed Zero Dark Thirty, the new theatrical film about the manhunt for Osama Bin Laden, reportedly glorifies the torture that led to his capture and killing, even though no torture whatsoever actually led to his capture and killing.

So who will head up the CRIMINAL investigation? Karl Rove?...

Florida's Republican Governor Rick Scott's announcement yesterday would be somewhat akin to George W. Bush asking then FEMA Chief, Michael "Heckuva Job" Brown to head up a review of how FEMA and the Federal government performed in responding to Hurricane Katrina. Or, perhaps asking Karl Rove or Dick Cheney to get to the bottom of that whole Valerie Plame outing thing.

The only worse, less independent person who could possibly be chosen to head up a "review" of what went wrong in this year's disastrous election in Florida would be Scott himself.

But since his hand-picked Sec. of State Ken Detzner carried out every single one of Scott's horrendous, un-American orders to restrict voting and voter registration and to try and toss eligible voters off the rolls this year, resulting in even active-duty military voters getting purged, all while ignoring actual, massive voter registration fraud carried out by the Republican Party of Florida itself (until it could no longer be ignored), it may as well be Scott himself in charge of this so-called "review" in which Detzner has been assigned to tell us all why it was that, among other things, voters were still in line trying to cast their votes at 2am on Wednesday morning in Miami-Dade, even as the President of the United States was delivering his re-election victory speech in Chicago.

Heckuva job, Scottie!

Scott has already, repeatedly since Election Day, declared that he did "the right thing" by slashing Early Voting from 14 days to just 8 in Florida this year, and then refusing to expand those hours on the weekend before the election --- unlike both of his Republican predecessors Governors Charlie Crist and even Jeb Bush --- once it became clear that voters were standing in line for 6, 7 hours and longer simply trying to cast their vote...

More progressive talk pushed off OUR PUBLIC AIRWAVES and, again, in one of the nation's most progressive cities...

[UPDATE: As of 6:00pm PT, the KPOJ website has now flipped to "Fox Sports AM 620 Portland".]

This is horrible. Tonight, without warning, Clear Channel Communications-owned 620 AM KPOJ in Portland, Oregon, one of the most progressive cities in one of the nation's most progressive states, has flipped from its years-long progressive news and talk format over to Fox Sports as of 5:30pm local time.

KPOJ was the only commercial progressive talk radio station in Portland. The city will still have several other Rightwing talk radio stations, including one owned by Clear Channel, and they already have two sports stations, but the Bain Capital-owned media conglomerate is now killing yet another progressive voice from our publicly-owned airwaves.

An earlier piece today in The Oregonian had reported that the station would be flipping as of Monday. An UPDATE in the Willamette Weekly, however, reports that the station, which had long featured Ed Schultz, Randi Rhodes, Mike Malloy, Thom Hartmann (who had broadcast for years out of KPOJ until moving his show to Washington D.C.) and other progressive talkers, will change to its Fox Sports format as of this evening.

The BRAD BLOG can now confirm that KPOJ has flipped its programming format and website to Fox Sports as of 6:00pm PT tonight.

When one company owns "competing" talk radio stations in the same town, and gets to decide which one enjoys a stronger signal and which one receives promotional dollars (and which one doesn't), "competition" in the market place is a mirage. It's the equivalent of a Coca-Cola distributor owning the sole rights to distribute both Coke and Pepsi in the same town. Which one do you think is going to sell better there? That's precisely what talk radio is like in almost every major market in the country now. One company, usually Clear Channel, generally owns both the "Right" and "Left" talk stations. (In Portland, Clear Channel owns Rightwing talk outlet KEX as well as KPOJ.) Promoting one station would likely decrease listeners and ratings --- and, thus, ad dollars --- for the other. Thus, there is no "free market" competition in talk radio.

This is hardly the first time that Clear Channel has done the same thing, in very progressive cities, underscoring yet again that there is no real, "free market" competition in talk radio over our publicly-owned airwaves. The market place is decidedly rigged...

On Friday, the U.S. Department of Justice announced that its Civil Rights Division will be deploying "more than 780 federal observers and department personnel to 51 jurisdictions in 23 states for the Nov. 6, 2012, general election."

Their news release, posted in full below, notes that "The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group."

"The observers and department personnel will gather information on, among other things, whether voters are subject to different voting qualifications or procedures on the basis of race, color, or membership in a language minority group; whether jurisdictions are complying with the minority language provisions of the Voting Rights Act; whether jurisdictions permit voters to receive assistance by a person of his or her choice if the voter is blind, has a disability, or is unable to read or write; whether jurisdictions allow voters with disabilities to cast a private and independent ballot; whether jurisdictions comply with the voter registration list requirements of the National Voter Registration Act; and whether jurisdictions comply with the provisional ballot requirements of the Help America Vote Act."

The announcement also includes DoJ contact numbers and websites for voters who have problems on Election Day. It also specifies the county and state jurisdictions where DoJ monitors will be on hand across the country.

Please note, however, that no matter how many monitors and attorneys and poll watchers are on hand, none of them can see inside an electronic voting system --- either touch-screen system, or paper-based optical-scan system --- to determine whether those computers have accurately tabulated the intent of the voters.
