It is now a bit fun watching some previously silent news organizations fall all over themselves as they suddenly recognize that our election process is seriously flawed. Today CNN reported, and many smaller organizations picked up the report, that the GAO released a report this week on voting system testing that finds that the Election Assistance Commission [EAC] has not notified election officials across the country about electronic voting machine failures.

This has been no secret within the Election Integrity community and has been one of our main complaints about the EAC. Voting systems fail and the EAC does nothing about it. They argue instead that none of the voting systems were certified by the EAC so they have no right/mandate to do anything about them. The GAO recommends that congress step in with legislation to force this issue.

We agree but dislike the fact that we have to wait on a snail-slow congress to do anything. CNN also reports on the CommonCause/Century Foundation report that was also released this week and that points to 10 states that they believe will have problems in Nov. My guess is that the “ten states” will grow substantially to 40 or more by election day and on beyond.

Also in the news is that the re-re-recount of ballots in Palm Beach Co Florida is taking place today and tomorrow. One can only guess what they are going to find. Ballots from 2004? Punch cards with hanging chads?

And a member of the Washington DC council has subpoenaed Sequoia for records that may reveal what really happened in the recent primary. Could it be that the council will find that the Sequoia spokeswoman, Michelle Shafer’s, declaration that the company is not at fault; “No, no, no” is really “Yes, yes, yes”? ...

Tribune Media Services' Bob Koehler was one of the first voices, from within the corporate mainstream media, to speak about the bastardization of our current electoral system. He did so, beginning way back in the darkest days of 2005, when writing and/or saying such things aloud got folks fired, spiked, and otherwise Dixie Chicked for daring to speak such truths in a country which once claimed to believe in "freedom of speech" and "freedom of the press."

From Ohio's 2004 abberation of democracy, to voting systems that don't work, to those who would do anything to win, such as keep voters from voting however they can, Koehler has continued to bang the drum, no matter the heat he has taken in return.

This week he continues to beat that drum, and offers us a few kind words in the bargain, yet again. Here's a few key grafs from his latest, headlined "Goo Goo Government"...

Local Democratic Party Chair Seems Clueless About Republican Attempt to Disenfranchise His Voters...

TALLAHASSEE — A new pitch for John McCain's presidential campaign aimed at older Democratic voters is causing complaints by Democrats and concern by elections officials.

The piece, paid for by the Republican National Committee and authorized by McCain, tells voters it is seeking to double-check their "unconfirmed" party affiliations while asking for money. A letter signed by McCain tells the Democrats: "We have you registered as a Republican."

"I was a little bit shocked and a little bit surprised," said recipient Bill Smith, 81, of Tampa, who calls himself a lifelong Democrat and has been registered at his current address since 2000.

The RNC declined to discuss the mailer, which Democrats said has landed in five counties: Duval, Hillsborough, Collier, Miami-Dade and Escambia.

The article goes on to note that FL's Republican SoS Kurt Browning believes the mailing is "confusing" and "unfortunate", but does not note whether or not he plans to do anything about it. We're not holding our breath. Neither are we holding it for Democrats down there to do much about it either.

The mailings sent to registered Democrats appear to be classic "caging" letters, marked as "Do Not Forward", so that they will then be returned to the GOP if there is any problem with delivery. Those returned letters will likely then be used as a basis to challenge the legitimacy of those particular voters on Election Day....

Reporter Holds Irresponsible DuPage County, IL Board of Election Feet to the Fire...

Here's a welcome sign that at least some in the corporate media are finally beginning to understand the complicated threat to democracy that is the boondoggle of electronic voting.

Bill Mego, in the Naperville Sun, asks all of the right questions (and granted, they are complicated ones to understand, unless one tries) about the junk Diebold voting system irresponsibly employed, at great tax-payer expense, by the DuPage County, IL Board of Elections.

One could as easily replace "Diebold" in the above sentence with any other voting system vendor, and "DuPage" with almost any other county in the nation (even though DuPage features one of the worst Election Boards in the country, and you'll be hearing still more about them soon). But the "good news" for today: at least a few in the media --- okay, at least Bill Mego --- finally "get" it, and are beginning to serve their readership well.

Let's get a few hundred more and we'll be in business. (And I'd be out of it! Happily!)

Can you blame them?

Nope, and Eric Boehlert explains why. After years of having abdicated their Constitutionally-guaranteed role as watchdog for the public, the corporate media's too-little, too-late, temporary stint at actually reporting is now regarded as little more than a joke. And one that not even McCain/Palin feel they need to take seriously. What they've sowed, so shall we reap.




On Once-'Quixotic' E-Vote Coverage From BRAD BLOG: 'We're Watching History Bend Their Way'

Over at HuffPo, Nancy Scola files a nice piece asking whether or not "New Media's obsessiveness" can save democracy, given that "Elections in the U.S. involve countless moving parts and...so many different players [that] Improving the way we vote demands sustained, focused attention --- not exactly the strong suit of the American Press."

It's a job for bloggers, she suggests, since the corporate media have, at least so far, not proven up to the task. She may be right, even though the thought simply exhausts me more than I am already.

She goes on to mention a few of us (yes, she names me specifically) who have been fighting this battle for quite some time. "From the sidelines, their campaign often seemed quixotic," she writes, "But [as electronic voting machines are now being scrapped for junk, recycled and/or sold on eBay] we're watching history bend their way."

Nice. Though not as nice as the following turn of phrase, so well writ that I had to share it:

When it comes to injustice, there are the "overlooked Americans": soldiers and other overseas Americans voting still have to hop over hurdles to cast their vote. (While I'm on this point, it's inconceivable to me that someone serving in Iraq or Afghanistan should have anything less than a ballot served to them on a silver platter that's then carried directly to the ballot box in the beak of a bald eagle.)

Game, set, match. Well done, Nancy.

With that, one friendly critique for her if I could be so bold: Paperless electronic voting is not the problem --- as she suggests in the piece --- as if adding "paper trails" to touch-screens makes a damned bit of difference (this article and its accompanying video from the Computer Security Group at UC Santa Barbara should make that crystal clear, no matter what some computer scientists like Princeton's Ed Felten and Verified Voting's David Dill keep saying out loud.) The problem is that democracy in this country demands nothing short of the transparency offered by a hand-marked paper ballot --- one that is actually counted, and counted accurately --- for every vote cast in America. Period.

And that point should be served from a silver platter, and carried directly to every election official and election official in the country, in the beak of a bald eagle.

Continuing where Bush/Cheney left off in '04, it's clear that the John McCain campaign will say and do anything to "win." Their latest knowing lie, in an attempt to fool America (again): a new campaign video released today. The ad is a complete lie, and of course, they know it. But they don't care. It's politics first, country last for the McCain/Palin ticket.

The ad not only misrepresents Obama's comments about "lipstick on a pig," it also purposely misrepresents comments from Katie Couric on "sexism." Worse still, the shameless McCain/Palin campaign inaccurately displays the text of the ad on their website, furthering the misrepresentation of Couric's comments on sexism in "this election," as the actual ad says, even though the comment is represented as being on "the election" in the campaign's transcript of the ad.

Breaking it down to answer to the several purposeful lies and distortions within, here's the first part of the ad's script as posted this morning on McCain's website...

The wealth of material on Sen. John McCain's Veep pick, Alaska Gov. Sarah Palin, just keeps getting richer. Apparently the old saying that you can never be too rich or too thin applies to resumes.

Last night, Brad covered a wide-range of recently emerging issues and concerns about Palin --- and McCain's judgment in having chosen her --- and asked whether she can even survive on the ticket through November 4th. Today, the New York Times front pages an Elisabeth Bumiller report revealing that McCain seems to have only begun vetting Palin last week, after his two preferred selections, pro-choice advocates Sen. Joe Lieberman and Gov. Mark Ridge, were nixed by the party's right wing.

So as Republicans scramble to vet their choice far too late, additional revelations continue to emerge (notably, beginning in the blogosphere, long before the MSM finally catches up.) The latest latest comes via Liz Arnett at Daily Kos, and includes videos in which the Alaska governor is seen as a member and supporter of the fringe Alaskan Independence Party (AIP), which aspires to secession from the union.

Steve Benen regards this latest information about Palin's past as perhaps "the most politically detrimental" of all the recently emerging discoveries about the little-known-until-now Governor of Alaska...

We had the chance to interview former Alabama Gov. Don Siegelman inside the Pepsi Center on Wednesday, during the Democratic National Convention.

Our concise conversation ranges from the Congressional Democrats' failure to call for a full House vote on Contempt of Congress by Karl Rove, Siegelman's 2002 election which he believes was "stolen electronically," the corporate media's inability to investigate or report on it, and the concern about whether or not Democrats will be in a forgive and forget mode after this session of Congress if Obama is successful in his quest for the White House.

On Rove: "If we do not vote the contempt citation, Karl Rove is simply going to get in his getaway car and thumb his nose at the Constitution, Congress, and the American people. It creates almost two systems of justice: one for the powerful, those connected to the White House, and then another system for you and me and the rest of the people."

On Democrats: "Democrats are so magnanimous in victory, as they were after Watergate, they did nothing. After the Iran-Contra scandal, they did nothing. But what Democrats are going to want to do is get on with positive programs, to fix the damage that has been done by the Bush administration...But I view this as part of that positive change. Finding out who hijacked the Department of Justice and who used it as a political weapon."

On his 'stolen' 2002 election: "I went to bed the winner. The media had been sent home. The pollworkers had been sent home. The party chairmen had been given their copies of the election results. And then after midnight a light went on in the basement of the capitol, the basement of the courthouse, in the sheriff's office, and 5,200 votes that were mine were shifted to my opponent."

U.S. Attorney Troy Eid's Curious Definition of 'True Threat,' His Links to Goodling and Abramoff, and the Media's Failure to Serve and Protect

Was the U.S. media admirably discreet or just plain ineffectual in covering news of the arrest of three men suspected of plotting to assassinate Barack Obama during his acceptance speech at Invesco Field?

First, consider the evidence: One of the men arrested, Nathan Johnson said the other two men, Tharin Gartrell and Shawn Robert Adolph, "had planned to kill Barack Obama...on Thursday...," which was why they were in Denver, and that "Adolph was going to shoot Obama from a high vantage point using a 22-250 rifle which had been sighted at 750 yards." According to the FBI, "Johnson was directly asked if they had come to Denver to kill Obama and he responded in the affirmative." The Denver police found in their possession two high-powered rifles with scopes, 85 rounds of ammunition, a bullet-proof vest, walkie-talkies, wigs, fake I.D.s, hotel reservations near the convention and 4.4 grams of methamphetamine, an amount, however, too small to be charged with more than simple possession. (Yet, for some reason, Colorado U.S. Attorney Troy Eid put a much greater focus on this relatively little amount of meth and their use of it than on the other apparent highly incriminating pieces of evidence obtained, including Johnson's statements). All three men have long criminal records, are suspected of having ties to white supremacist groups, and one of the men, Adolph, who was on the Weld County, Colo., sheriff department's "Most Wanted" list for burglary, larceny, aggravated motor vehicle theft and other charges, has a violent criminal history and is being held on $1 million bond for outstanding warrants.

During U.S. Attorney of Colorado Troy Eid's peculiar press conference Tuesday night, he characterized the men as "just a bunch of meth heads," framing his question-and-answer session with reporters more like an anti-drug campaign sloganeer than a chief law enforcement official: "You know, I don't know, uh, bunch of meth heads get together, I don't know what they do, I don't get inside their brain. But we take them very seriously what they do. I have to just emphasize this is a group of people, there were a number of people, that are using meth. I don't know how many of you know meth, anyone here not know about meth? This is a really terrible drug. People do all sorts of stupid things on meth." He followed that response with: "There is no credible threat right now and there was no credible threat based on the evidence that we have to Senator Obama or anybody else related to what we know about this case." Asked what the weapons could be for (not to mention the ammo, bullet-proof vest, wigs, fake I.D.s, etc.), Eid answered only, "You know, I don't know what they were for and we'll keep looking into that." Eid went on to say, "You know, they didn't, they didn't reveal a plan. I think what you can see in the affidavit was, uh, a lot of racist rantings and a lot of dislike for the idea of Senator Obama as an African-American person of color being able to pursue that office."

But Eid's statement appears to be patently false. As reported by the Associated Press:

Johnson later told a federal agent that the men talked about assassinating Obama only because he was black, according to a federal arrest affidavit. Johnson said he also heard Adolf say that he wanted to kill Obama "on the day of his inauguration" and that he would "find high ground to set up and shoot Obama," the affidavit said.

That's not merely, as Eid called it, "the racist rantings of drug abusers." Rather, coupled with the arsenal found, it shows motive, intent and a plan. And, to be clear, contrary to what Eid told the press, it was in the affidavit.

Arizona's Jon Kyl Shows Up at the Democratic Convention in Denver to Friendly Faces in the Media...Until We Try to Do Something About That...

Here's an object lesson in so much that's wrong with the corporate mainstream media.

U.S. Senator Jon Kyl, the Republican from Arizona, showed up at the Democratic National Convention on Wednesday night. He was mobbed by "reporters" from the corporate media (people with large video cameras and microphones who turn them on, point them towards famous people, and allow them to say whatever they want without ever challenging them in any way) out front of the Pepsi Center in Denver.

I happened to be there as well, with a much smaller video camera rolling, and the willingness to actually try to hold Kyl's feet to the fire.

First he had mentioned John McCain's "experience" in foreign policy that allowed him to deal with situations like the Russia/Georgia conflict in a way that Barack Obama couldn't. The "reporters" asked no follow-ups in response to Kyl's unsupported talking point, so I tried to ask him how McCain could deal with the two parties as an honest broker, given that he has senior campaign staffers who are paid lobbyists for Georgia. Kyle dodged the question and quickly moved onto something else. I tried to follow up, but he ignored me.

Then, when one of the "reporters" asked Kyl a hard-hitting question about whether he had "seen anything this week that made [him] cringe," he referred to Bill Clinton's convention speech, made within the past hour that night. Responding to the compliant, smiling media zombies he charged that Clinton had cited "statistics...that are not accurate." However, the Senator gave no evidence for those allegations, and the zombies didn't press him, so I decided to do so.

Here, then - with my polite pauses, allowing him to ramble on in answer to other inane questions from the zombies, edited out for time --- is what it looked like...

The following video report, as seen live on Fox "News" yesterday, demonstrates that the far-right "news" channel has no clue what the words "raucous", "out of control" or "freedom of speech" actually mean, as "reporter" Griff Jenkins is seen taunting DNC Convention demonstrators, only to receive chants of "Fuck Fox News", live on air, in the bargain...


The video also demonstrates (again) that, to Fox, "far left" is anybody who doesn't cow-tow to Fox's fringe kook extremist Republicanist agenda. That is, unless wanting to keep U.S. troops in Iraq forever, and launching yet a third war with Iran is the mainstream American view, and only "leftists" are against such things.

We'll be in Denver later today, and we'll try to look for Jenkins to find out if he wishes to explain his performance. If not, clearly it'll be because he "doesn't believe in freedom of speech".

UPDATE: The following longer clip (hat-tip BRAD BLOG commenter "Floridiot") shot by a citizen "off air", shows that this place could be a tinder-box with Fox, apparently, more than willing to light the match if needed. With temperatures set to reach 90 degrees later today in Denver, we'll hope things stay cool and Fox thinks better of their strategy of taunting peaceful demonstrators...

Justin Elliot of Mother Jones and Talking Points Memo Takes the Easy Way Out in His 'Review' of 'Uncounted'...

Everyone has different tastes, and hey, if you aren’t moved after watching Uncounted that’s your prerogative. But an uniformed and half-assed review that tries to nail the 80-minute movie on one ten-second factoid - like the one delivered to Mother Jones readers by former MJ Senior Online Fellow and current TPM Media News Editor, Justin Elliott - is inexcusable.

In the review, Elliot references the following that briefly appears on screen: “Two voting machine companies --- ES&S and Diebold --- electronically counted 80 percent of the votes in the 2004 presidential election. Both companies have extensive ties to the Republican party.” He then runs the 80% number by Kimberly Brace, “a respected voting expert with the consulting firm Election Data Services” who calls it “totally wrong.” And that’s it. Proof by assertion. No follow up. End of review.

In Fact, He Criticized the Bill As 'Too Generous' To Troops - And Did Not Even Show Up for the Vote...

Events in the campaign this week offer a case study in how Fox "News" assists the right wing --- in this case, the McCain campaign --- to disseminate disinformation:

Monday: Speaking before the Veterans of Foreign Wars, John McCain falsely claimed credit for supporting the 21st Century GI Bill, which was sponsored by Sen. Jim Webb (D-Va.) and Sen. Chuck Hagel (R-Neb.):

As a political proposition, it would have much easier for me to have just signed on to what I considered flawed legislation. But the people of Arizona, and of all America, expect more from their representatives than that, and instead I sought a better bill. I'm proud to say that the result is a law that better serves our military, better serves military families, and better serves the interests of our country.

In reality, the bill McCain "sought" was not Webb-Hagel, which he opposed because its tuition benefits were "too generous" to the troops. The version he sought was a different bill that he co-sponsored, and which "in no way resembles" the bill which was ultimately passed, as noted by ThinkProgress...
