Given the rationale behind the recent SCOTUS decision in Department of Homeland Security v. Texas, Governor Greg Abbott's election year efforts to block the U.S. Border Patrol's access to the Rio Grande in Texas amount to defiance of a federal court order.

President Joe Biden can and should assure State compliance with federal law by taking a page from previous Presidents by exercising his power to federalize both the TX National Guard and any members of the FL National Guard who are now impeding Border Patrol access along the pertinent stretch of the U.S. border with Mexico.

The Court's decision to "vacate" a 5th Circuit Court of Appeals injunction, pending appeal, did a great deal more than simply affirm the right of federal Border Patrol agents to remove razor wire erected by the Texas National Guard along 29-miles of the Rio Grande.

By granting U.S. Solicitor General Elizabeth Prelogar's emergency Application in the case, SCOTUS affirmed the federal government's contention that, under the Supremacy Clause of the U.S. Constitution, "state law cannot be applied to restrain...federal agents from carrying out their federally authorized activities".

I'm guessing my use of his name in the headline will get me even further downgraded on Twitter/X when posting today's BradCast there. So be it. It's just one more example of how bad it has become. [Audio link to full show follows this summary.]

That is not just hyperbole. Ask the guy in Berlin who is now suing Twitter to have his account reinstated on the social media site after data he compiled was used by the New York Times and CNN to detail how Twitter restored accounts of far-right extremists after Elon Musk purchased the company last year. More on Musk in a moment.

The nonpartisan Congressional Budget Office (CBO) found [PDF] on Wednesday that Republican House Speaker Mike Johnson's proposal to "pay for" $14.3 billion in emergency aid to Israel amid its war with Hamas by "offsetting" the cost with cuts to the IRS budget would cost the U.S. tens of billions in revenue and increase the federal deficit. The plan, according to the CBO, would prevent the IRS from enforcing tax laws against the wealthy and corporations to the tune of $26.8 billion in lost revenue and would add $12.5 billion to the deficit over the next ten years. The White House describes proposal as a "non-starter" and has vowed to veto it if it should ever show up on his desk. It won't. In the meantime, a bipartisan plan for emergency aid to Israel, Ukraine and for the U.S. southern border continues to move forward in the Democratic-controlled Senate.

The U.S. House is hardly the only dysfunctional Republican-run legislative body these days. On Tuesday, Wisconsin's Democratic Governor Tony Evers filed suit at the state's Supreme Court against the gerrymandered GOP state House and Senate, accusing them of failing to carry out basic government functions, like signing off on previously-legislated pay raises for some 35,000 University of Wisconsin employees; blocking new state agency rules for updating commercial building codes and ethics standards for licensed social workers, therapists and other professional counselors.

Compared to the ongoing disaster in the Middle East, however, perhaps those issues are small potatoes. The death toll in Gaza continues to quickly escalate in the wake of Israel's unrelenting response to Hamas' barbaric attack on October 7. But, as bad as it all is, it has been made unnecessarily worse thanks to a flood of disinformation on social media, most notably, on Elon Musk's rebranded Twitter/X.

We're joined today by longtime investigative journalist RUSS BAKER, now Editor-in-Chief of Who, What Why and publisher of the "Going Deep" newsletter where he recently described Elon Musk as "Chaos Agent #1". (Don't tell Trump. He might sue for the title!)

"Let's be realistic about what X, formerly known as Twitter, is," Baker argues today. "It is the world's largest public address system ... Essentially, what has happened here is that the P.A. system has been taken over by the school bully. Normally, the school would never allow such a thing. But that's all gone out the window" now that the bully --- one of the richest men in the world --- actually owns the whole school!

We've discussed just some of the disinformation that has been flooding out from Twitter of late, and the increasing danger of disinformation via social media with expert Lee McIntyre in recent weeks. But what, if anything, can --- or even should --- be done about it? There are a lot of tricky Constitutional issues here, at least in the U.S. The EU, on the other hand, has recently begun to crack down on Musk for failing to moderate the increasing tidal wave of disinformation since he purchased Twitter, and the tsunami which has followed in the wake of the Israel-Hamas war.

Aren't our hands largely tied here because of the First Amendment? Says Baker: "I am a person who doesn't just automatically accept any such claims, including those who say we can't fix the Electoral College, we can't do anything about the Constitution. I think all of those things are up for discussion. I am not an expert, but I believe there are ways, if there is a will, that there are forms of regulatory relief, issues about monopoly practices, there are many, many things that could possibly be applied to him. I would like to see a discussion happening now about this."

And so we have such a discussion today. Or begin one. On the possibility of an outside council of news organizations and social media organizers, to develop best practices for social media and content moderation. On the necessity of independent media to counter disinformation both on social media and from governments. And what FDR and JFK had to say when it became clear that the "concentration of wealth and unbridled power, and our society's failure to address the threat that represents to the public interest" needed to be addressed in their times as well...

The U.S. economy, of course, has been rigged for years. The pandemic, in the meantime, has now made that clearer than ever. Not that the corporate media is bothering to explain it to Americans. So, w try to do so on today's BradCast. [Audio link to full show is posted below this summary.]

But, first up, results from several, eagerly awaited new lab studies on the effectiveness of the mRNA vaccines from Pfizer and Moderna on the Omicron variant have been released over the past 24 hours. Two independent studies, one from South Africa and another from Sweden, along with a press release on findings of a study by Pfizer, all suggest that getting a booster shot as soon as possible is the best way to avoid severe illness both from Omicron and all of the other previously-known variants. We walk you through the details and explain the findings today.

The upshot: Two vaccine doses and natural immunity from COVID is way better against Omicron than just two vaccine doses. Two vaccine doses and a booster shot is as good or better than two doses and COVID. So, unless you want to try your luck by getting COVID to protect yourself against it, a booster shot, right now, is your very best best. That, as infections, hospitalizations and deaths are all beginning to sky-rocket again, as the nation is on the verge of 800,000 COVID deaths.

Next, we've been reporting for the past several weeks on the lousy job the corporate media have been doing in covering what is, overall, a surprisingly robust economic recovery in the first year of the Biden Administration, as the nation (and world) struggles to emerge from our nearly two-year pandemic.

One of the media's worst and most misleading points of coverage has been on the matter of inflation. And, while our regular, global supply chains have certainly become knotted up, leading to legitimate upward price pressures, much of the added costs for goods and services is now thanks to good old profiteering and price fixing by companies which have been enjoying record profits, even during the worst of the pandemic and subsequent supply chain snarls.

As our guest today, author and financial journalist DAVID DAYEN, Executive Editor of The American Prospect recently reported, "In a time of high inflation, you hear a lot about companies 'passing costs' on to customers. In order for companies to maintain their God-given right to earn a profit, they must raise prices to offset the cost of producing goods and getting them into peoples’ hands. And thanks mostly to the hidden risk, exposed by the pandemic, of neoliberal gospels like just-in-time logistics, deregulation, and offshoring, prices really are going up."

"But," he continues, "there’s something else mixed in with this latest bout of inflation. Companies aren’t just passing costs onto us. With corporations using inflation as a cover for raising their prices, you and I are passing profits onto companies."

Dayen, author of the new book Monopolized: Life in the Age of Corporate Power, details how companies are not only profiteering, price-fixing and colluding to do so, they're actually bragging about it, out loud, on corporate earnings calls. That is sending up both stock prices and profits up for hundreds of the most profitable public corporations, many of whom have monopolistically been allowed to corner their markets, giving consumers few, if any, cheaper alternatives for the products and services they sell. Companies that don't play ball --- like Target, which announced they would not be raising prices --- have been punished, in turn, by Wall Street for daring to do so.

"The problem is that we have a business climate today where people have locked in their customer base. Your customers can't escape, because we have a series of consolidated companies that have a stranglehold on market share, and we don't even know that it's happening. You stroll down a grocery aisle and you see hundreds of items, but you don't know that the same handful of companies have created all of them," Dayen explains today. "And that's why you have large companies like Proctor & Gamble and Unilever saying 'We know we can raise prices on people...and we don't have to worry about any kind of material reaction.'" The same is true, of course, with many other companies, such as the Big Oil cartel, which is raking in record profits as raw materials fall, but failing to reflect those falling costs at the pump.

So, what, if anything, can be done about it? Are Presidents and their Administrations actually able to take actions that might roll back the corporate profiteering? Yes, Dayen explains, at least some, both with the use of the bully pulpit --- which, in the model of JFK, Biden has begun to try and do --- and also with the use of existing anti-trust and anti-price-fixing laws that are still on the books today, if rarely enforced.

"It is price-fixing," Dayen tells me. "But we don't spend a whole lot of time on that anymore in America. It's still unlawful. It's still occasionally prosecuted. And now we do have a different regime at places like the Federal Trade Commission, and the anti-trust division at the Justice Department." He believes that several key, progressive Biden appointments at both may be able to "turn the tide" back against corporate mergers and unapologetic (and potentially unlawful) corporate greed. "There is certainly a faction within the White House that feels like this is a serious problem and that we have to do everything possible to stamp it out," he says, but "they're swimming upstream, as it were."

There is a lot on these points to discuss with Dayen today. As well, we also get his reaction to the announcement today that Biden is withdrawing his nomination of Saule Omarova as Comptroller of the Currency, a key banking regulator, after red-baiting by Republican Senators (she was born in the Soviet Union) and concerns from conservative Democrats that she might be too tough on big banks. He also offers his two cents on our complaints, of late, about the terrible job that corporate media are doing in covering both Joe Biden and the economy.

Finally, after months of pretend complaints by Republicans and Democratic Senator Joe Manchin that spending $1.75 trillion in paid-for taxpayer dollars to expand health care, education, child care, elder care, and fight climate change over the next ten years in the Build Back Better bill is just too much money to spend for a poor country like ours, the House on Tuesday night, in record time, passed its latest annual defense spending bill with a lopsided bi-partisan vote in favor (opposed largely only by progressive Democrats). It'll cost nearly one trillion dollar ($768 billion, $24 billion more than the Biden Administration even asked for) for one single year of military spending --- much of which will go to stuff we never use and/or literally blow up.

Priorities.

On today's BradCast, how corporate media control of our public airwaves helped elect Donald Trump, and a decades-long, top-level CIA intelligence briefer of U.S. Presidents responds to concerns about Trump skipping Presidential Daily Briefings and on, so far, evidence-free, anonymous claims that Russia hacked and manipulated the U.S. election.

First up today, speaking of questioning "conventional wisdom", there is no doubt that the stranglehold of our public airwaves by corporate media helped elect Trump. But a new report suggests their helping hand may have been even worse than we knew, as Sinclair Broadcasting, the infamously rightwing media behemoth and largest single owner of television stations in the nation, apparently struck a deal with the Trump campaign to provide non-critical coverage on its scores of television "news" outlets in the South, Midwest and elsewhere.

Then I'm joined by 27-year CIA analyst, Ray McGovern, who served as Chief of the Soviet Foreign Policy Branch and prepared and personally delivered the CIA's Presidential Daily Briefings (PDBs) each morning to American Presidents from Kennedy to Clinton. Since leaving the agency, he has become an outspoken anti-war advocate and peace activist and co-founder of Veteran Intelligence Professionals for Sanity (VIPS), a group which includes esteemed former intel officials, analysts, experts, and whistleblowers such as Daniel Ellsberg, Coleen Rowley, William Binney, Thomas Drake, John Kiriakou, Karen Kwiatkowski, Col. Ann Wright and others. He is also a contributor at Consortium News and his writings and appearances can also be found at RayMcGovern.com.

I invited him back on today to offer insight as to how the preparation and delivery of PDBs to Presidents and Presidents-Elect have changed over the years and how important they are. McGovern offers some fascinating insight and inside Presidential stories on all of the above. But I wanted to talk to McGovern about this specifically in the wake of Trump's somewhat alarming recent admission that, he rarely attends the briefings because he's "smart", and doesn't "have to be told the same thing in the same words every single day for the next eight years." Instead, Trump says, he sends his national security team to attend what McGovern describes as "the acme of the intelligence cycle, just to give you an awareness off how important the process is."

But our conversation soon moved to the various allegations --- still without evidence and said to be from unnamed intelligence sources citing secret National Security Estimates (NIEs) that some respectable critics say don't necessarily make a lot of sense --- charging that Russia hacked DNC and other emails during the campaign in hopes of helping Trump defeat Hillary Clinton.

In short, McGovern and his fellow team of longtime intelligence analysts, experts and whistleblowers believe the allegations are, in McGovern's words, 'a crock'. He explains why he and his colleagues recently released a memo explaining their dispute with the charges, and what they actually believe is at the root of the thousands of leaked emails. While I agree with Ray on the lack of evidence presented at this time in support of the claims against Russia, I am also skeptical of VIPS' assertions about what they believe really happened, as we discuss on today's show as well.

But, of course, I am always skeptical of anything that cannot be independently verified, especially when it comes to anonymous claims and secret evidence used to lead us into wars. McGovern offers some fascinating details and reminders on the show today as to why such skepticism is a very good idea! Unfortunately, similar skepticism seems to be all too rare these days in much of the rest of our media. Either way, I'll look forward to your thoughts on today's program...

2016 GOP Presidential candidate Ben Carson's recent assertions that a Muslim must "renounce Islam" before he'd consider them qualified to be President of the United States is just one example that echoes a similar sentiment about Catholics earlier in this country's history.

"It can seem like something 19th century, something really distant, but as recently as half a century ago, there was a pretty sustained debate in our mainstream political media, our body politic" Railton tells me, "of the genuine concern on behalf of many that any Catholic --- including John F. Kennedy, the candidate for President --- would owe a first allegiance not to anything within the United States, not to America, not to the American government or the American people, but to that entity, that foreign scary place, the Vatican and the Pope and the Catholic Church."

"Many of the fears that are directed at Muslim-Americans and Muslim communities are directed at the idea of these communities and their customs and beliefs, themselves representing an internal threat," he explains, while going on to remind us that, even with a well-established Muslim community in the U.S. at its founding ("We have Muslim-American communities going back to the Revolutionary Era...so fears of religious 'others' do date back to the very beginning"), this country's Constitutional framers determined there would be no religious test for the highest office in the land.

Railton's message is ultimately a very an encouraging one --- we have, it seems, finally moved beyond our fear of a Papal takeover in this country, after all, so we are likely to do the same with Muslims --- but is that historic comparison an appropriate analogue given the threat so many feel of an actual hostile takeover by Islamic extremists? We discuss.

Citing a related-ish piece of mine last week over at Salon, Paul H. Rosenberg attempted to slay yet another Zombie Myth that just won't die over the weekend: The myth that JFK "stole" the 1960 election from Richard Nixon, and that Nixon was just too much of a gracious statesman to challenge the results.

It is, of course, all bullshit, as Rosenberg is forced to detail once again. Nonetheless, the enduring myth remains part and parcel --- and, often, False Exhibit #1 --- of the very same scam that Republicans still use to this very day in attempting to deligitimize their Democratic opponents through phony claims of "voter fraud".

Some 250,000 classified cables and embassy dispatches from the State Department are being released today via WikiLeaks latest, and reportedly largest, document dump ever. Within the last hour, news reports based on those documents have begun to be published by various world media outlets that are said to have been given advanced access.

Among the very first revelations to emerge, as quickly highlighted on Twitter via search hashtags #WikiLeaks and #CableGate this morning, are details on the U.S. having pleaded with Germany in 2007 to not prosecute CIA operatives who kidnapped and tortured a terror suspect, Yemeni officials covering up U.S. drone strikes in their country, Saudi officials encouraging U.S. to take attack Iran, the U.S. spying on UN diplomats, as well as various, potentially embarrassing State Department assessments of allied world leaders. There will be much more to come.

You can review more of the coverage yourself at the UK Guardian, the New York Times, German's Der Spiegel, and Israel's Haaretz among many others to emerge over the next several hours and, indeed, days. The Nation's Greg Mitchell is live blogging the release, and rounding up many of the key links.

As this information becomes public, and as the U.S. Government continues to scramble to mitigate what the White House is calling today a "reckless and dangerous" leak, condemning it "in the strongest terms" as an alleged threat to national security, it's worth keeping in mind, for valuable perspective, what the 1970s legendary "Pentagon Papers" whistleblower Daniel Ellsberg wrote in an op/ed for The BRAD BLOG in early 2008...

Many, if not most, covert operations deserve to be disclosed by a free press. They are often covert not only because they are illegal but because they are wildly ill-conceived and reckless. "Sensitive" and "covert" are often synonyms for "half-assed," "idiotic," and "dangerous to national security," as well as "criminal."

As well, John F. Kennedy's April 1961 speech on what he described as this nation's abhorrence of secrecy, and the necessity of a free press --- as delivered to the American Newspaper Publishers Association at the Waldorf-Astoria Hotel in New York a year or so before his death --- is rather astonishing, and more than a bit ironic, in light of today's leaks and, as directly, the actions of the Executive Branch and its enablers in this country --- in Congress, in the mainstream media and in the public --- over the past dark decade. JFK's remarks include these thoughts among others that must be heard or read...

The very word "secrecy" is repugnant in a free and open society; and we are as a people inherently and historically opposed to secret societies, to secret oaths and to secret proceedings. We decided long ago that the dangers of excessive and unwarranted concealment of pertinent facts far outweighed the dangers which are cited to justify it.

And there is very grave danger that an announced need for increased security will be seized upon by those anxious to expand its meaning to the very limits of official censorship and concealment.
...
And no official of my Administration, whether his rank is high or low, civilian or military, should interpret my words here tonight as an excuse to censor the news, to stifle dissent, to cover up our mistakes or to withhold from the press and the public the facts they deserve to know.
...
No President should fear public scrutiny of his program. For from that scrutiny comes understanding; and from that understanding comes support or opposition. And both are necessary.

Sibel Edmonds' recent on-air revelation that, prior to 9/11, Osama bin Laden was relied upon by the Bush administration as a Central Asian asset, added one more disturbing piece to an incomplete puzzle, which, as could be expected, lent itself to a number of comments asking whether 9/11 was "an inside job." These, in turn, were summarily dismissed in another comment as "conspiracy theory."

Where does this concept of dismissing inquiry into momentous events as "conspiracy theory" come from?...
