Also, Vast Majority of Dem Voters Would Consider a New Candidate Based on Iraq/Global Warming Positions of Current Crop...
By Brad Friedman on 11/1/2007 2:59pm PT

Last week we reported that a CBS poll finds Al Gore trailing Hilary Clinton by just 5% in the Presidential Primary race and is ahead of all of the others, even though he's not officially on the ballot.

Last month we reported that a Zogby "blind bio" poll of Republicans found that some unknown guy --- Ward Casscells --- who's not even running, led the Republican candidate field among GOP voters when no names, just summarized resumes, were given for each candidate polled.

Yesterday, Zogby released the results of their Democratic "blind bio" poll, showing that Al Gore is, hands down, in front of the pack with 35% support. His closest rival was Hillary Clinton at 24%.

Also in the poll, 60% of Dem voters would consider voting for someone other than the current slate of candidates, based on dissatisfaction with the positions on the Iraq War by the current official crop. 65% said they'd be open to supporting a new candidate based on the current candidates' global climate change positions...

Zogby Poll: Al Gore Leads Top Tier Dems in 'Blind Bio' Poll

Survey finds most Democratic likely voters would consider a new candidate given the current field’s views on Iraq and global climate change

A Zogby International “blind bio” telephone poll shows that former Vice President Al Gore is favored over the current Democratic frontrunners by likely Democratic Party voters nationwide – particularly among liberal Democrats.

When Democratic likely voters were given brief biographical descriptions of the top three Democratic candidates – New York Sen. Hillary Clinton, Illinois Sen. Barack Obama, and former North Carolina Sen. John Edwards – along with the biography of Gore, the former Vice President won 35% support, while Clinton won 24%, Obama won 22%, and Edwards trailed with 10% support. Gore’s bio was the top choice of both men (39%) and women (31%), and also most favored by younger voters. Self-described liberal Democrats strongly favored Gore’s bio (43%) over Clinton (21%), Edwards (17%) and Obama (12%). The bio selections of moderate Democrats closely mirror the choices of likely Democratic voters overall, with 36% giving the greatest preference to Gore’s bio.

After announcing last night (video here) that would not file to be on the Republican ballot, due to the exorbitant $35,000 filing fee ("I am not willing to write a $35,000 check to the Republican Party. ... I understand you have to keep a club exclusive but I paid less for my black-market liver"), Stephen Colbert said that he had filed the $2,500 required to be on the Democratic ballot in South Carolina's Presidential Primary.

The decision about whether the S.C. Dems would then allow him to be on the ballot was to be announced during tonight's broadcast. Politico beats him to the punch, however, with their report today that the S.C. Dems have rejected his application.

Washington Post Turns to Rightwing 'Nutroots' for 'Expert' Input...
By Brad Friedman on 10/28/2007 2:36pm PT

A "Game of Chicken" is how Washington Post describes the current standoff in the Senate concerning the FEC nomination of GOP "voter fraud" zealot/operative Hans von Spakovsky. The nomination is currently at a standstill, along with three other FEC nominations that Senate Republicans insist be voted on along with him, in the wake of a hold registered by Obama and Feingold.

Senate Majority Leader Harry Reid's D-NV) incredible "deal" to slide HvS's nomination through has, for now, thankfully come to a standstill. But the resultant standoff could mean no operational FEC in 2008 as only two commissioners are currently left, and a minimum of four are needed to vote on anything.

WaPo's piece includes supportive quotes, in favor of von Spakovsky, from hard right partisan and former FEC Chair Brad Smith. Yet it fails to point out how much of a rightwing bomb-thrower Smith --- who charged in his own Redstate blog item last week that HvS is "currently under attack for being a Republican" --- actually is. Would WaPo have given such prominence to someone on the other side of the political spectrum?

You'll note, in Smith's piece, written prior to WaPo's, that he refers to Democratic "nutroots" as being responsible for the hold, along with "the campaign finance zealotry of Senator Feingold." Smith, apparently, forgot to mention that Feingold's co-sponsor on that bill was John McCain, who --- last we checked --- is a Republican.

In short, Smith argues in his Redstate diatribe, that though HvS may have participated in GOP-backed voter supression efforts when he served at the DoJ, nobody has complained about actions during his tenure over the last many months as an absentee appointee at the FEC. To which we say, yes, after the Fox has overseen the mutilation of the chickens in the Henhouse, by all means, let's elect him as chief meat inspector for the USDA.

Beyond that, and in teeing things up for this Tuesday's heaings in the House Judiciary Committee, set to star John "Minorities Die First" Tanner, the outrageously still-employed chief of the Bush DoJ Civil Rights Division Voting Section, Christy Hardin Smith suggests the GOP may be "throwing Tanner under the bus" in favor of von Spakovsky. She catches us up with the latest today in "Hans Down".

Our friend Jacob Soboroff, from the election reform site Why Tuesday, is asking folks to vote up his video question for Barack Obama, so that the question might be one of 10 asked of the presidential candidate during an MTV appearance scheduled for Monday (10/29) at 1:30pm ET.

To help ensure Obama gets asked the direct question on Election Reform, please click the green "thumbs up" icon just above Jacob's short video question here.

It'd be nice if the media began asking the candidates such questions about the one issue that underscores all others: What the hell do they plan to do about our crumbling electoral system?

More specifically, we'd love them to answer one question directly --- and hope that those of you out there attending their live events might bring a video camera and ask them directly!: "Do you support a paper ballot --- not a 'paper trail' or a 'paper record,' but a paper ballot, and one that is actually counted --- for every vote cast in America?"

But in the meantime, the question to Obama on MTV would be a step in the right direction. Please take 40 seconds to click the video link above and then click that green thumbs up button!

Has Best Favorability Rating of All Front-runner Dems Among All Registered Voters...
By Brad Friedman on 10/26/2007 7:20pm PT

(CBS/WBEN) - Hillary Clinton continues to be the frontrunner for the Democratic nomination for president, and many voters say they’ll consider supporting her in November 2008 if she becomes the Democratic nominee.

Still, there are obstacles. Many voters think a Hillary Clinton presidency will divide the country rather than unite it. And when Al Gore is added to the list of Democratic candidates, he trails by only five points.
...
Although he has not declared his candidacy, this poll indicates that were he to enter the race, Al Gore could be a serious contender. Near the end of this questionnaire, his name was added to a short list of candidates vying for the nomination. He came in second among Democratic primary voters at 32% – just five points behind Hillary Clinton. Barack Obama trailed behind them in third place with 16% percent.

We note that his favorable/unfavorable rating among registered Democrats in this poll is currently at 46/29. That's better than than any of the others in the race (Clinton: 26/63 *43/41, Obama: 38/24, Edwards: 30/30)

Here are all the numbers from WBEN...

* UPDATE/ED NOTE 10/27/07: WBEN's favorable/unfavorable numbers for Clinton were incorrect, according to CBS's original numbers [PDF]. Gore still has the best favorable/unfavorable rating of all the Democratic candidates among all registered voters. However, WBEN's contention that Clinton's fave/unfave is at 26/63 is entirely wrong. It's 43/41, as we've now noted above. Their incorrect numbers on her, for that question, seem to be taken from an entirely different question in the poll. At least that's our best guess. Details on all of that now follow below...

The BRAD BLOG Speaks with Dennis and His Wife About Voting Rights, Election Reform, Impeachment, and the Need for an Outcry from the American People
Rep. Kucinich Vows to Use 'Privileged Resolution' to Force Vote on Impeachment of Cheney in U.S. House...
By Emily Levy on 10/24/2007 5:35am PT

Guest Blogged by Emily Levy

ED NOTE: The BRAD BLOG's Emily Levy sat down with Dennis Kucinich on Sunday, just before serving as a hand-counter for votes in the first Democratic San Mateo County Presidential Straw Poll. Results of that poll are below. Kucinich spoke about his plans to force a vote in the U.S. House on the Impeachment of Dick Cheney; on having officially removed his name as co-sponsor of Rep. Rush Holt's flawed Election Reform Bill; his interest in hand-counted paper ballots; and concerns about e-voting systems. As it turns out, however, his wife Elizabeth may have stolen the show with an impassioned speech on what America must do to restore "a rigged and a fake political system," which, she told Levy, is "very, very undemocratic."

===

Candidate Kucinich was surrounded by supporters after his speech to Democrats in San Mateo County, just south of San Francisco, over the weekend. One asked the U.S. House Rep (D-OH) about the failures of the current Congress to protect the Constitution. "If Congress did the right thing," he answered, "they would be talking … about impeachment."

At that point, I broke in with a question:

EMILY LEVY: What do you think it'll take for more of your colleagues to do the right thing?

REP. DENNIS KUCINICH: The American people: an outcry. That's what we ought to be talking about.

EL: What do they hear? What do they hear? I mean, I hear the American people screaming. How come they can't hear?

DK: They aren't. You're exactly right. You know, I introduced House Resolution 333 because I heard from the American people and they said they wanted some response to make Dick Cheney accountable for the statements that he made that took us into a war based on lies. And the statements he made that would take us into a conflict against Iran. Again, more lies.

The President is now openly invoking the specter of World War III with respect to Iran. He ought to be held accountable also. I'm the only member of Congress who stepped forward on the issue of making Dick Cheney accountable. And now we have 21 members who've joined me. That's a step in the right direction. But I'm going to go beyond that. I'm going to call a privileged resolution, at which point, would force a vote --- at least if it's only on a procedural motion --- members are going to have to confront this issue of impeachment. They're not going to escape it. This is a question of defending our Constitution. It really is.

(In a follow up phone call with the Congressman last night, I asked when he intended to introduce the privileged resolution in the House. He said it would happen in "the next few weeks," but couldn't be more specific. Now back to San Mateo...)

Kucinich burst into laughter when I showed him the teabag tag hanging from my shirt pocket. I praised his ingeniously deadpan appearance on The Colbert Report. He searched around in his jacket pocket for his mini-Colbert but was unable to produce the little guy.

While I waited for my turn to speak with Kucinich alone, I spoke with his wife, Elizabeth, who was "enjoying the last day of my twenties." (Happy birthday, Elizabeth.) I asked her the question that was really on my mind: Knowing what he knows about the theft of the last two presidential elections, why would her husband run for president?

After she said, "Are you kidding?" several times with increasing alacrity, I asked if I could turn on my voice recorder...

2008 Ballot Measure, Previously Declared Defunct, May Have Found New GOP Life...
By Brad Friedman on 10/23/2007 2:37pm PT

When we wrote of the reported "death" of the GOP initiative/scam to split California's Electoral College votes we urged caution, suggesting that these guys don't just give up that easily. Not just because they get caught. As they did when it appeared an out-of-state Rudy Giuliani supporter appeared to secretly be behind the attempt to see the measure placed on next year's ballot.

The initiative, if it gains enough signatures, would make its way onto the ballot in next February's Presidential Primary Election. If passed, it would require that California's enormous number of electoral votes be apportioned as based on Congressional district support. That, instead of the current winner-take-all system used in the state and in the vast majority of the country. Critics, not without appropriate justification, have viewed the initiative as an attempt to steal the 2008 Presidential Election for the Republicans.

Late last night, Sacramento Bee reported that the initiative may be back on track, having found new, deep-pocket funders. Today, "The Maven" at dKos offers many more details.

Email Sent to Supporters Describes Civil Rights Voting Chief's Comments as 'Pretty Unbelievable,' 'Last Straw'
Says: 'John Tanner has an obvious disregard for the voting rights of minorities and should not be in charge of protecting them'
By Brad Friedman on 10/23/2007 2:09pm PT

"This is pretty unbelievable," begins the email send from the campaign manager of Presidential Candidate Barack Obama to supporters today.

The email, from David Pouffe, calls on members of the public to demand the DoJ fire its Civil Rights Division Voting Section chief, John Tanner, in the wake of disturbing and inaccurate comments, video-taped and first reported by The BRAD BLOG, as made during a recent panel discussion at the National Latino Congreso in Los Angeles.

The email, which exhorts readers to send emails to DoJ via their new "John Tanner Must Go" campaign at http://Action.BarackObama.com/TannerMustGo continues thusly [emphasis in original]:

John Tanner, the top ranking voting rights official at the Justice Department, was caught on video claiming that photo ID requirements do not disproportionately disenfranchise minority voters because: "Our society is such that minorities don't become elderly the way white people do; they die first."

He went on to argue, irrationally, that these requirements actually benefit minorities because: "Anything that disproportionately impacts the elderly has the opposite impact on minorities."

The letter to supporters from Obama's campaign manager, David Plouffe, is posted in full here.

Last week, Obama had sent a letter to Acting Attorney General Peter D. Keisler, demanding he immediately fire Tanner. Our coverage, along with his full letter, is here.

"The situation is clear," Plouffe writes in today's email after detailing a number of concerns about Tanner's record at the DoJ. "John Tanner has an obvious disregard for the voting rights of minorities and should not be in charge of protecting them."

Plouffe concludes by charging that "His recent comments are the last straw --- he must go."

Hearings have been tentatively confirmed by The BRAD BLOG as scheduled in the House Judiciary Committee's Subcommittee on the Constitution, Civil Rights, and Civil Liberties for October 30th at 10:00am ET. Tanner will be called as a witness and likely presented with clips from the video tape that we delivered yesterday in D.C. to committee staffers.

The chairman of the sub-committee, Rep. Jerrold Nadler (D-NY), has said he's hopeful that Tanner "will be as willing to provide lawmakers with the same candid views he has been providing at various public venues."

The chairman of the full House Judiciary Committee, Rep. John Conyers (D-MI), a 78-year old elderly minority member who, contrary to Tanner's assertions has not, in fact "die[d] first," has expressed consternation recently and over the years about the DoJ's chief voting official, including a 2005 letter in which he said he was "flabbergasted" at Tanner's contention that the reason for long voting lines in minority areas in Ohio's 2004 Presidential election was due to African Americans coming to the polls later in the day than non-minority voters.

The twisted conclusions from Tanner's "investigation" of voting problems reported during the 2004 Presidential election, including his assertion that minority voters actually had more access than whites to voting machines, were detailed in a letter, posted here in 2005, which can only be described as an extraordinary (and literal) "white washing" of the facts on the ground that day.

Conyers and his staff published a comprehensive report, entitled "Preserving Democracy: What Went Wrong in Ohio," as based on their own, far-reaching investigation after the election. We look forward to his questioning of Tanner next week.

Yesterday, we detailed additional allegations likely to be faced by Tanner in hearings next week.

A quick, video-taped snapshot of Tanner's most offensive --- and inaccurate, according to his former DoJ colleagues --- comments from the October 5th National Latino Congresso panel in Los Angeles, follows below...

And Other Quick Observations on Last Night's Debate in Orlando...
By Brad Friedman on 10/22/2007 2:37pm PT

During the ninety full minutes of last night's lively Republican Debate on Fox "News" from Orlando, the word "Bush" was used only twice by the candidates. One time each by Ron Paul and then Fred Thompson.

The Fox "News" anchors used the word five times.

Everyone else? Apparently never heard of him.

(On the other hand, as Arlen Parsa notes, Hillary was mentioned some 34 times.)

A few of our other quick, amusing and/or notable observations and video clips follow...

From DREs to the ACVR to the DOJ, The Republican Alphabet Soup Blueprint for Disenfranchisement and Miscounting in Next Year's Election Has Been a Well-Crafted and Well-Funded Work, Long in the Planning...
By Bob Fitrakis and Harvey Wasserman on 10/21/2007 5:04pm PT

Special to The BRAD BLOG by Bob Fitrakis and Harvey Wasserman of The Columbus Free Press

ED NOTE: The following feature was originally published in the Autumn '07 print version of the Columbus Free Press. The comprehensive aerial overview --- connecting dots from 2000 to 2004 to the outlook for 2008, as based on a wide body of years-long investigative reportage and exposés as collected from a variety of sources, including The BRAD BLOG and many others --- offers such a useful round-up of "our story until now" that we thought running the piece in its entirety here would be a very good idea. We hope you agree.

With record low approval ratings for the Bush/Cheney regime and the albatross of an unpopular war hanging from the GOP's neck, do you think that a Democratic presidential candidate will win the White House, get us out of Iraq, and end our long national nightmare?

Think again – the mighty election theft machine Karl Rove used to steal the US presidency in 2000 and 2004 may be under attack, but it is still in place for the upcoming 2008 election.

With his usual devious mastery, Rove has seized upon the national outrage sparked by his electoral larceny and used it as smokescreen while he makes the American electoral system even MORE unfair, and even EASIER to rig. Thus the administration has fired federal attorneys when they would not participate in a nationwide campaign to deny minorities and the poor their access to the polls. It has spent millions of taxpayer dollars to install electronic voting machines that can be "flipped" with a few keystrokes. And under the guise of "reforming" our busted electoral system, it is setting us up for another presidential theft in 2008.

Thus it should come as no surprise that our exclusive investigations into the firings of eight federal prosecutors who refused to execute Rove’s plans for massive disenfranchisement of Democratic voters reveal a pattern of illegalities and fraud aimed at reducing the number of minority, poor and young voters at the core of Democratic support. In the wake of major news breaks, two felony convictions have come from the rigging of the illegal Ohio 2004 vote count and recount that gave George W. Bush a second illegitimate term. Stunning new admissions from county election boards that illegally destroyed voter records will almost certainly lead to new convictions. And the multi-million-dollar electronic voting machine scam that made possible the biggest electoral frauds in US history is under massive new attack, with key states moving to scrap the machines altogether in a desperate attempt to restore American democracy – but with the job far from done.

Rove, Ney and the Undead

Indeed, the Rovian theft engine is far from dead. The media groundwork has already been laid out for the Republicans to claim that hordes of illegal aliens have registered to vote. The Bush administration has been caught ordering public agencies – possibly in violation of the law – to cease registering voters. In an April, 2006 speech to the Republican National Lawyers Association, Rove openly alluded to the strategy of demanding photo ID and purging voter roles of poor, minority voters just as had been done in 2000 and 2004. And, as always with Bush/Rove, there is much more beneath the surface.

All that has happened to challenge the GOP death grip on the American vote count has been reported in the pages of Hustler and on the internet at FreePress.org, The BRAD BLOG and elsewhere, and is being seized upon by a national grassroots movement determined to restore American democracy next year.

Nowhere has that movement been more in evidence than with the high profile firestorm surrounding Bush administration Attorney General Alberto Gonzales’ firing of eight federal prosecutors without legitimate cause.

Evidence continues to surface from throughout the United States about this blatant Bush abuse of executive power. But we have traced the roots of the firings to an obscure Congressional hearing held at the statehouse in Columbus, Ohio, on March 21, 2005, and to a shadowy GOP operative named Mark F. "Thor" Hearne.

The hearing was conducted by none other than former US Rep. Bob Ney (R-18th OH). The once-powerful Ohio Congressman (who is now behind bars) was the godfather of the Help America Vote Act (HAVA), the national boondoggle that mandated electronic voting machines for the American electoral process.

That the machines would cost taxpayers billions was a big plus for Ney. They would come from Diebold and other companies that poured money into Republican coffers. Thanks largely to the manipulations of disgraced lobbyist Jack Abramoff, these e-voting machine companies would help guarantee the GOP’s ability to steal elections.

Ney’s hearing featured a marquee appearance by J. Kenneth Blackwell, the Secretary of State responsible for delivering Ohio’s decisive 2004 electoral votes to Bush. Blackwell was a key operative for the Bush election campaign in Florida in 2000 and co-chaired the Bush-Cheney 2004 re-election campaign in Ohio...

As a first announced last night on The Daily Show...

...And then, later in the evening, in a bit more detail, on "a more prestigious show"...

Will he have more of an actual effect on the race than, say, Pat Paulsen, the inveterate comedian-candidate of many a prior Presidential contest? We wager Colbert just might, actually.

New York Times has some details and Colbert himself brought CBS's Jeff Greenfield on for analysis of his impact on the race, "in the last three minutes," as seen in the following video...

As Clear Channel Signals a Flip to Sports, Only One Presidential Candidate Has Stepped up to Support Balance on the People's Airwaves in the Nation's 6th Largest City...
By Brad Friedman on 10/10/2007 2:45pm PT

In a letter sent to station management, as The BRAD BLOG reported in August, former Democratic Senator from Alaska, Mike Gravel, correctly wrote: "The increasing monopolization of the mainstream media today demands that we stand up for independent-minded, progressive voices out there like KLSD AM 1360 in San Diego."

He was the only Presidential Candidate, to our knowledge, to utter a word about it.

As reports emerge that progressive radio talker Ed Schultz' audience now matches Bill O'Reilly's, one has to wonder what the hell the Democrats --- specifically the rest of the Democratic Presidential candidates --- are thinking, as Clear Channel prepares to flip the only progressive talk station in the nation's sixth largest city over to an all-sports format any day now.

The busy Internet rumors suggest it could happen as early as this week. Station insiders have told The BRAD BLOG it's more likely to happen on November 1st "at the earliest", as the corporate bosses at Clear Channel get ducks in a row for what is currently seen as an "inevitable" flip.

It'll be one less major market for Big Ed, one of the Democratic party's biggest and most effective supporters. Though O'Reilly will, no doubt, remain on the air in San Diego, despite the damage and shame his irresponsible "reporting" brings to our Republic.

In late August, we detailed the first indications that corporate media behemoth, Clear Channel, was preparing to dump the progressive talk format at AM 1360 KLSD in San Diego. Citizens were outraged, signed petitions, wrote letters to station management, created websites and showed up at rallies to protest the imminent shut down of the station.

At the time, we suggested to both organizers of the protests and station personnel that they join with Air America (who has several shows airing on the station) to invite the Democratic Presidential candidates out to San Diego for an Emergency Debate focusing on one of the very reasons our country is in the mess that it is: Corporate Consolidation of the Public Airwaves.

It seems quite clear that such consolidation has not been in the best interest of the people who own the airwaves. And further, it seems clear that the corporate interests who lease access to that spectrum, from the people, don't give a damn about such interests.

And yet, to our knowledge, in the nearly two months since Clear Channel indicated they were preparing to flip the station format, only one Democratic Presidential candidate, Gravel, has understood the importance about speaking out against this outrage.

Tests Run in Riverside County On Sequoia Vote Counters Which May Be Purchased To Tabulate Future Voting
By Alan Breslauer on 10/10/2007 10:16am PT

KTLA News reports on the rush to prepare paper ballots for upcoming elections, including next February's California presidential primary now that Secretary of State Debra Bowen decertified electronic voting in 29 counties because the machines proved vulnerable to hackers.

The piece also features Riverside County election integrity activist (and hero) Tom Courbat of SAVE R VOTE who raises concerns about Sequoia's role in counting the paper ballots, "when these ballots go into electronic tabulating machines there is no way to tell whether or not they have been programmed to flip the vote and rig the election." While Registrar of Voters, Barbara Dunmore, agrees with Courbat about the vulnerability of electronic machines, she believes election officials have put in place safeguards that will ensure fair elections.

For more on Courbat's tireless efforts to protect democracy in Riverside County see this video mashup.

Incredibly, John Tanner Argues Restrictive Photo ID Laws at the Polls Actually Give Minorities a Greater Voice!
Rest of Panel, Audience Members at 2007 National Latino Congresso in Los Angeles Strongly Disagree...

Guest Blogged by Alan Breslauer with additional reporting by Brad Friedman

Unbelievably, the Chief of the Voting Section of the Civil Rights Division, U.S. Department of Justice, John Tanner, contends that while it's "a shame" that elderly voters may be disenfranchised by new Photo ID restrictions at the polls because many don't have driver's licenses, minorities don't have to worry quite as much. Why? Because "minorities don't become elderly the way white people do. They die first."

Yes, that's what Tanner said last Friday at the National Latino Congreso in Los Angeles and The BRAD BLOG was in tow with video camera to prove it...

Paul Kiel at TPM has an interesting late update on the Senate hold, by Obama and Feingold, on Hans von Spakovsky's nomination to the FEC, which we reported yesterday. New details/analysis on the "game of chicken" now in play in the Senate, along with the ramifications for the FEC in 2008 if a stalemate continues...and what Bush could do about it.
