With Trump's own intel agencies warning of election hacks and the White House contradicting them, disturbing new revelations of voting system vulnerabilities may help explain a 2011 BRAD BLOG exclusive report...

As noted at the top of today's BradCast, it's worth buckling up before listening. [Audio link to show follows below.]

We begin, gently enough, with the news of California's Supreme Court temporarily nixing a billionaire's statewide initiative from this November's ballot which, if adopted, would split the state into three. We explain why the Court removed the measure, for now, thanks to a challenge by an environmental group.

Then, with Donald Trump's own Director of National Intelligence, Dan Coats, warning this past week that "the system is blinking red" in a way that hasn't been seen since just before the 9/11 attacks, the multiple and ever-changing positions by the President of the United States in recent days, regarding whether Russia interfered in the 2016 election and is actively doing so in advance of the 2018 midterms, is all the more head-spinning. Coats was referencing warning signs being reported by U.S. intelligence agencies regarding ongoing attacks and intrusions on America's critical infrastructure --- including our wildly vulnerable electoral systems.

Moreover, new reporting on Trump being read into explicit source details weeks before he was inaugurated in early 2017 regarding Russia's alleged 2016 election intrusion measures, make his ongoing denials, ever-changing positions, and dizzying White House spin to explain them all following Monday's summit with Putin in Helsinki, all the more bewildering. Nonetheless, his own intelligence apparatus and appointees continue to contradict the President, even as the GOP-controlled Congress fails to take any substantive action to either place a check on Trump or even to help protect this November's crucial elections.

At the same time, after the FBI informed Maryland just days ago that its entire election system was being hosted on a private commercial server said to be owned by a Russian oligarch tied to Putin (as discussed in detail on yesterday's BradCast), we learn this week that the top U.S. election system vendor, ES&S, has been lying about remote access software and modems installed, for many years, on systems still used by a majority of U.S. voters.

The new revelations may help explain an exclusive special report published by The BRAD BLOG back in 2011, with an officially-commissioned independent analysis finding that, among other concerns, Venango County, Pennsylvania's ES&S election management system had been accessed by an unknown and unauthorized computer for "several hours" from a remote location. As we reported at the time, ES&S and the County's Board of Commissioners went to considerable lengths, after those revelations, to block a further, independent forensic analysis of the system.

And now, perhaps, we may know why. Kim Zetter reports this week at Vice's Motherboard that the company lied to her and New York Times' fact-checkers earlier this year in advance of her February article at the paper on the inclusion of modems and pcAnywhere remote access software included with the election management systems sold to customers from 2000 to 2006. After previously insisting the company had no "knowledge that our voting systems have ever been sold with remote-access software", ES&S reversed itself in a letter to U.S. Senator Ron Wyden, she reports. But they have refused to respond to the Senator's subsequent follow-up queries or to appear at recent Senate hearings on U.S. election system vulnerabilities.

As Zetter details, pcAnywhere was found to include multiple and serious vulnerabilities over the years, which would have allowed unauthorized intruders to change election results with little chance of detection. Moreover, she explains, many questions remain about why ES&S lied, which jurisdictions around the nation may still feature the same, easily-exploitable flaws, and about electronic voting and tabulation systems manufactured by the nation's other top vendors, believed by expert to likely have included similar remote-access vulnerabilities.

On today's BradCast: We continue our coverage of fallout following this past Tuesday's midterm primary elections in eight states, as the counting and canvassing moves forward. [Audio link to show follows below]

In California on Wednesday night, Sec. of State Alex Padilla (D) sent a stern letter to Los Angeles County's Registrar Recorder/County Clerk Dean Logan demanding answers and actions following a still-unexplained "printing error" that resulted in the names of more than 118,000 registered voters (including Fonzie!) being left off the printed rosters at more than 1,000 polling places.

Voters found missing from the rolls were to have been given provisional ballots on Tuesday, according to Logan, but there are questions as to whether all of them were. Also, there are concerns about whether those provisional ballots will all, in fact, be counted (or tossed for bad reasons, as some provisional and vote-by-mail ballots are), and if those ballots will be included in the county's 1% post-election manual "spot check", meant to determine whether hand-marked paper ballots were tallied as per voter intent by the county's computer tabulators. A new state law adopted last year exempts both provisional ballots and late vote-by-mail ballots post-marked by Election Day (which may arrive several days after the election and still be included in tallies) from that mandated 1% "random audit". We've got a bit of exclusive news on that front today.

That disaster was not the only problem for voters on Tuesday in L.A., the nation's largest voting jurisdiction. One blind voter reports on her failed attempt to vote on four separate audio voting systems for disabled voters at three separate polling places. All four machines failed to work, echoing a very similar problem that I had while attempting to vote on those very same systems in L.A. ten years ago. In a 2008 primary, 4 out of 12 of my own votes were misprinted by the computer-marked paper ballot audio voting system. (Luckily, I'm not blind, so was able to notice the computer-printed failure before casting the ballot!) Two years later, in 2010, when I tried the system again, it failed to work altogether on two different machines.

Also in CA on Tuesday, voters in a recall election successfully removed a state judge who had issued a controversially lenient sentence to a Stanford University athlete last year following his sexual assault of an unconscious woman. Another recall election, engineered by state Republicans, resulted in the removal of a Democratic state Senator for having voted in favor of a gas tax hike last year. The successful recall strips Dems of their two-thirds super-majority in the state Senate, which is required for the passage of any new state taxes or fees.

In Alabama, the unbalanced Republican Sec. of State John Merrill --- who blocked me on Twitter last December for being correct about the state's computer tabulation systems, before sending a barrage of insanely bizarre emails to me last week --- won his primary for re-election on Tuesday.

And Joseph Siegelman, son of the former Democratic AL Gov. Don Siegelman, (both guests on the show over the years) won his primary for Attorney General in the state. Depending on the results of a primary runoff on the GOP side, Siegelman may be running this November against a former AL Attorney General who was part of the GOP cabal who helped imprison his father on seemingly trumped up bribery charges more than a decade ago. (Tune in for a wild summary of the incredible GOP corruption in that state around all of that, which still echoes throughout state politics today. And, with all of the madness I quickly summarized on the show, I now realize I forgot to mention, incredibly enough, that the George W. Bush-appointed federal judge who convicted and sentenced Gov. Siegelman was later forced to resign after being arrested for beating his wife!)

And, in South Dakota, some remarkable fallout from a Sheriff's race in one county, underscoring, yet again that elections have consequences and that so-called "Right-to-Work" states are anything but.

Then, after a smart observation from longtime BRAD BLOG reader "Dredd", who points out that more Americans appear to have been killed by one climate event --- Hurricane Maria in Puerto Rico --- than in our (so far) 17-year long war in Afghanistan, Desi Doyen joins us for the latest Green News Report. Among other things in today's report, still more outrageous corruption news revealed from EPA Administrator Scott Pruitt. But, we had more on that front than we could fit into our GNR today --- and more that has broken since recording it Wednesday morning --- so we follow up with that additional news about Trump's kleptocratic EPA chief, including a Republican U.S. Senator who has some choice words for the shockingly still-employed Pruitt...

An entire new decade of government control hangs in the balance...

Don't get me wrong. The bold move by the Pennsylvania Supreme Court in adopting a Congressional map that, according to an analysis cited by the Wall Street Journal, could see PA Democrats picking up as many as six Congressional House seats now held by Republicans, bodes well for those of us who value small "d" democracy and the rule of law.

So does the recent mind-boggling 85-point swing from "red to blue" in Kentucky, where Democrat Linda Belcher, in a Special Election, defeated her Republican opponent by 36 points in a state House district that Donald Trump carried by 49 points in 2016.

There are multiple indices of a public revulsion in response to Republican overreach that is much greater than that displayed in 2008 when Democrats rode a "Blue Wave" to victories that placed them in control of the White House, the U.S. Senate and the House of Representatives.

Last year, polls revealed as little as 12% support amongst the American electorate for Republican efforts to repeal and replace Obamacare. Another poll revealed that only 24% of Americans supported the GOP tax cut measure. (Though more recent polling suggests it's growing in popularity.) This year, a Quinnipiac poll, taken in the wake of the massacre at a Parkland, Florida high school, suggests that 2/3 of Americans have finally lost their patience with NRA-funded Republicans and their feckless "thoughts and prayers".

These surveys suggest a likelihood that Democrats in 2018 can recapture a majority in the U.S. House and potentially even the U.S. Senate --- a result that is critical to fending off the threat to democracy, political and economic equality and the rule of law now posed by the Trump/GOP oligarchic/kleptocratic agenda.

But a number of recent court rulings on extreme partisan gerrymandering reveal that the 2020 election will ultimately be of far greater significance than 2018, and not simply because it will be a Presidential election year…

When needed to prevent catastrophe and preserve the rule of law, impeachment is both a necessity and a superior political strategy...

Earlier this month, billionaire Democratic Party donor Tom Steyer unleashed his $10 million nationwide "Need To Impeach" campaign (1-minute video ad is posted below). He recently purchased another $10 million in ad time, bringing the campaign total to $20 million.

In targeting Donald Trump for accountability, according to the Los Angeles Times, Steyer "raised the ire of both President Trump and the president's Democratic nemesis, House Minority Leader Nancy Pelosi."

"The president," the Times reported, "lashed out at Steyer in a tweet, deriding him as 'wacky & totally unhinged'." Trump also appears to have managed to convince Fox "News" to stop running the ad on his favorite channel, which claimed it was banning the spot "due to the strong negative reaction...by our viewers."

Trump's distain for the ad is understandable. Pelosi's opposition, however, while consistent with her historical record, should be regarded as unacceptable.

Avoiding real accountability for this President --- and calling on others in her party to do the same --- is deeply flawed and misguided political calculus, calling to mind the admonition of Edmund Burke: "The only thing necessary for the triumph of evil is for good men to do nothing".

In this case, impeachment is needed to preserve the rule of law and prevent a humanitarian catastrophe. Contrary to Pelosi's calculations, it is both a necessity and good political strategy...

On today's BradCast: Is something happening here? Finally? [Audio link to show follows below.]

Following Donald Trump's insane press conference at Trump Tower on Tuesday, during which he vociferously equated neo-Nazis and White Supremacists with those who oppose them --- just days after the murder of a counter-protester by an apparent White nationalist in Charlottesville --- even some Republicans are finally condemning him. Sort of. But not nearly enough.

At the same time, Confederate monuments are being removed around the country and business leaders who claim to be furious have withdrawn from Trump's two different business councils, which he has now been forced to shut down. Nonetheless, despite their half-hearted protestations, Republicans continue to intentionally suppress minority voting in state after state. Another Federal Court determined as much this week in Texas, finding --- for the 11th time in recent years --- that state Republicans intentionally suppressed minority voters there.

Another such state is Vice President Mike Pence's Indiana, where a new analysis from the Indy Star finds that early voting sites were shuttered in Democratic counties and expanded in Republican counties after Obama won the state in 2008, and as Pence served as Governor. The strategy worked. Republican turnout increased in counties where voting rights were expanded and Democratic votes decreased in the state's largest and most Democratic leaning counties, where voting sites were shuttered. Now Pence heads up Trump's so-called "Election Integrity" Commission.

In two separate federal lawsuits, Common Cause v Marion County Board of Elections (May 2, 2017) and Indiana NAACP v. Lawson (Aug. 9, 2017), both challenging restrictions on voting rights in Indiana, civil rights organizations have sought to block what they describe as unconstitutional Republican schemes that, with "surgical precision", seek to depress the vote in large minority, Democratic-leaning counties while contemporaneously enhancing voter turnout in white, Republican-leaning counties.

The lawsuits entail two sets of laws. One of the lawsuits seeks to block a law that specifically targets Lake County --- and only Lake County --- for precinct consolidation and/or elimination. Lake County sports the state's second largest African-American population and its largest Hispanic population. The other lawsuit challenges a voter suppression scheme that significantly reduces early absentee voting sites for a significant number of African-American (Democratic) voters in Marion County, even while mostly white (Republican) voters in neighboring counties benefit from a significant expansion in the number of available early absentee voting sites.

Both sets of laws, as observed by Slate's Mark Joseph Stern, are part of the still-ongoing Republican response to the 2008 Presidential Election in which Barack Obama narrowly defeated John McCain 49.85% to 48.82% in long-Republican Indiana. That narrow victory was secured, in part, because, in the two populous counties that are the subject of these lawsuits, Lake and Marion, Obama received 66.7% and 63.8% of the vote totals, respectively.

That was a bridge too far for many Republican officials in the Hoosier State...

On today's BradCast: The newly insane cost for a "recount" in Wisconsin and the even more jaw-droppingly insane voting system and "recount" laws in Pennsylvania. [Audio link to today's show is posted below.]

Barriers against citizen oversight of 2016 Presidential election results continue, even as the campaign of the Green Party's Jill Stein works with tens of thousands of citizens to try and overcome them in three different states where she is seeking "recounts". (For the record, if you're wondering, The BRAD BLOG generally uses quotes around the word "recount" to denote post-election hand-counts of ballots which have never actually been counted by human beings, but rather, only tabulated by computers during the official tally. It's impossible to know whether those computers actually tallied votes accurately unless paper ballots are examined by hand.)

The WI Election Commission informed the Stein campaign (and independent candidate Rocky De La Fuente, who has also filed for a "recount" there) yesterday that she will have to pay $3.5 million to even begin counting paper ballots in the state. I've confirmed with her campaign that she intends to do so, even after state election officials had originally estimated the fees to be $1 million for a statewide recount. That, even as state law has recently changed to allow counties to use computers to "recount" ballots, rather than public hand-counts. As we've long reported, similar barriers are often erected to block citizen oversight of elections, begging the question again: What good are hand-marked paper ballots if nobody is actually allowed to count them?

But the situation is far worse in Pennsylvania, where voters in most of the state are forced to vote on 100% unverifiable touch-screen systems and the state's arcane "recount" statutes require tens of thousands of voters to file affidavits (3 in each precinct) asking for such counts.

Longtime election integrity champion and VotePA.us founder Marybeth Kuznik joins us with details on what is now going on in the Keystone state towards that end, and to help explain the insanity of the state's unverifiable voting systems and the near-incomprehensibility of its "recount" laws.

"Pennsylvania election law is so convoluted," she tells me, while explaining the requirements for three voters in each of the state's 9,163 precincts (that's 27,489 voters!) to file a complaint in order to have a statewide voter-initiated count. She also explains the second route towards such a count, which requires 100 voters to file in the Commonwealth Court.

In either case, since much of the state uses unverifiable touch-screens, there is often nothing at all to count, even if a count is allowed! "They'll print out the Election Night tapes. They'll bring out some sort of a printout from the central tabulator. Usually they just bring out results. They look at the precinct tape, they look at the precinct printout, they go 'Hmm, that looks the same to me!', and everything's good. That's the recount!," Kuznik explains. "The thing is, of course it's going to be 'good'. The same software that counted on Election Night and printed out that tape is what's counting and printing out this result paper that they compare. It's nuts. It's just crazy."

As you'll hear, it's even worse than I've described it here. But, that's how it still works (or doesn't) in PA, after all of these years, and even in light of a forensic analysis by computer scientists of just one PA county voting system in 2011, after vote-flips were reported and candidates received zero votes in several elections in heavily-Republican Venango County. (See our exclusive special report and documents here.) That landmark study found, among other disturbing things, as we reported at the time: "unexplained, out-of-sequence activity log entries in the computer tabulation system, indications that the system was mounted several times with a 'USB flash drive' device, and, perhaps most troubling, evidence that the system was repeatedly accessed by an unidentified remote computer, for lengthy periods of time, on 'multiple occasions.'"

Those same systems --- and even worse ones --- are still used today across the state in 2016, as the fate of the world relies on them. Yes, as we've been warning you for more than a decade: "It's just crazy."

From Smartmatic to Diebold: Responding (yet again) to partisan worries of vote flips and voting machine ownership...

It's that time of the election cycle again. Happens every four years. (Every two, actually.) On today's BradCast: That moment when partisans on the Right declare Democrats are stealing the election with voting machines owned by George Soros and Democrats worry that Republicans are doing the same via private companies actually owned by big GOP supporters. [Audio link posted below.]

Both sides see votes flipping on touch-screen systems to their opponents. Both sides declare it only happens to their chosen party. Both sides have reason to worry about private ownership of our electoral systems. Both sides tend to be very selective about their concerns. And both sides do nothing about it until it's time to start freaking out again just before the next election.

The old, previously debunked charge that the progressive billionaire Soros is somehow controlling voting machines across the U.S. re-appeared yet again in the Rightwingosphere over the weekend, only slightly modified from its 2012 version. This time it has resulted in a petition to WhiteHouse.gov --- so far, signed by more than 70,000 since it was posted late last week --- demanding "congress meet in emergency session about removing George Soros owned voting machines from 16 states."

But, of course, as we noted back in 2012, when Democrats were concerned about the actual ownership of voting machine company Hart Intercivic by associates of Mitt Romney, Soros does not own any companies with voting machines in the U.S. He doesn't own any companies with voting machines used elsewhere either, to my knowledge. But the original seed for the persistently false rumor seems to have been planted, in no small part, by The BRAD BLOG's exclusive coverage way back in 2008 of a Venezuelan voting machine company named Smartmatic --- once believed linked to Hugo Chavez --- and their secret ownership of the Intellectual Property (IP) used in voting machines made by Sequoia Voting Systems. Many of those machines are still used in about 15 states across the country.

Sequoia has since been purchased by a Canadian firm named Dominion Voting, which, like Sequoia before it, lied about Smartmatic's ownership of IP used in Sequoia's machines. But, as I explain on today's program, it could hardly be further removed from Soros who, as it turns out, has absolutely no stake in Smartmatic or any of the other vote counting companies deployed in the U.S..

But, like Democrats, Republicans have every right and reason to be concerned about the obscene private corporate ownership of our nation's public voting and tabulation machinery. (Please petition Whitehouse.gov about that!) As I noted to a reporter seeking comment about the concerns about Romney's ties to Hart Intercivic around this same exact time before the 2012 Presidential Election...

Once again, we're reminded of the dangers of the privatization of our once-public electoral system. The company's ties to Romney aren't the only disturbing ones we've seen with similar companies over the years. The fact is, that nobody other than the public should have any sort of control of our elections. The proprietary voting systems now in use in all 50 states, whether owned by Romney associates, a George W. Bush associate (as with Diebold in 2004) or even a company tied to Venezuela's Hugo Chavez (as with Sequoia Voting Systems which blatantly lied about that tie to public officials, and the Canadian firm Dominion which purchased Sequoia and also immediately lied about the fact that Intellectual Property of their voting systems used all across the U.S. is still owned by the Venezuelan firm), continue to be a grave threat to American democracy and confidence in U.S. Elections.

And, like similar clockwork, once again this year we are now hearing the shouts about touch-screen voting machines flipping Democratic to Republican and Republican to Democratic --- and the claims from partisans on both sides that "this only ever happens to Republicans/Democrats!" --- as early voting gets underway in a number of states. Is there legitimate reason to worry about such votes flipping? The answer is both yes and no, with reason for all of us to be ashamed, as I explain on the show today.

For our analysis of the final --- and, by our count, 25th! --- debate of the 2016 cycle, I'm joined once again by award-winning journalist Heather Digby Parton of Salon and the Hullabaloo blog, and by David Dayen, of Fiscal Times and author of Chain of Title: How Three Ordinary Americans Uncovered Wall Street's Great Foreclosure Fraud.

As you probably expect, we spend some time focusing on Trump's dishonest claims that the election is being "rigged" and his refusal to promise a peaceful transfer of power. But we also discuss the, at times, disingenuous outrage about it all from the media as well as both Republicans and Democrats, each of whom seem to have developed more than a bit of convenient amnesia about recent elections, about the mechanics of our electoral system, and even very recent assertions about all of the above.

Yes, election fraud and election integrity are topics about which we have some familiarity around here. And, while nuance and complexity and facts may not play well in the corporate media or among angry partisans near the end of an insane election cycle, no small amount of each are called for today. We do our best.

"Digby" and Dayen also bring insight on a number of the other surprisingly substantive issues raised at the debate (as well as important issues that, once again, were not), many of which have been largely overlooked in the wake of Trump's latest embarrassing tantrum(s)...

Today on The BradCast: Where the Presidential race stands as we head into the debates and how an ingenious GOP scheme in 2010 may have served to undermine (small-d) democracy in the U.S. for a decade or more. [Audio link posted below.]

As Hillary Clinton and Donald Trump prepare to face off in their first Presidential debate, national polls are now, largely --- and amazingly --- a dead heat, with Trump beginning to take the lead in several key states that would give him the Presidency.

Meanwhile, as Dems struggle to hold on to the White House and fight long and longer odds to regain control of the U.S. Senate, a majority in the U.S. House, once again, remains seemingly out of grasp entirely for Democrats despite their candidates and policies being far more popular amongst the national electorate.

David Daley, until recently the Editor in Chief at Salon, now a Fellow at the University of Georgia's Grady School of Journalism, joins me on today's BradCast to discuss his new book, Ratf**ked: The True Story Behind the Secret Plan to Steal America's Democracy. In it, Daley documents "Operation REDMAP", the insidious (and brilliant) Republican scheme carried out with a few million dollars and a handful of GOP operatives back in 2010 that succeeded in putting the U.S. House out of reach for Democrats for a decade --- while they were still celebrating their 2008 victory and barely paying attention to what Republicans were up to.

"It is nothing short of the most audacious political heist of our time," Daley tells me. "The Republican State Leadership Committee, they realize that 2008 might have been a wipe-out for the Republicans, but that did not matter if they could win in 2010. Because the census requires that you redraw every district line in every state legislature and in the Congress every ten years they came up with a brand new idea."

That successful idea in 2010 resulted in Democrats receiving 1.4 million more votes than Republicans for their U.S. House candidates in 2012, while still losing control of the chamber to Republicans by 33 seats. "The party completely fell asleep at the wheel," he says, allowing "an overwhelming avalanche of dark money and negative ads, into these small little towns" that would determine control of state legislatures, followed by an unprecedented computer-aided gerrymander of every GOP controlled state in the nation. That, in turn, led to the seemingly uncrackable Republican majority in the House that has served to bastardize so much of our national politics through today.

"The Democrats didn't have the imagination to come up with this idea," Daley argues. "It is entirely legal. However, it is also entirely and deeply undemocratic." The GOP came up with "a partisan hammer to take control and hold it," in what Daley describes as nothing short of a "political moneyball" plan that would "lock in partisan control of a chamber [of Congress] for a decade or more."

On today's BradCast, the Des Moines Register joins the fray to declare "something smells" in Iowa's Democratic caucus results and procedures. Bev Harris of Black Box Voting joins us to examine the concerns about "caucus integrity" on both the Democratic and Republican sides --- what we know, what we don't, and what we should. [Link to the complete audio of the program is at the bottom of this article.]

With partisans on the Right and Left now charging, appropriately or not, that the caucuses were "stolen", and both the Register and Sanders' camp calling for state Democrats to release raw vote totals, Harris notes: "Really, the bottom line is, if they won't disclose stuff, then it smells. If they disclose it, everybody can see for themselves."

"People say, well, there's problems in every election," she continues. "My mantra is: That may be true, but let's see the problems. All I'm saying is let us see them, and let us address them. Most people I talk to --- even if they're very partisan --- they say, 'If I can see it and we lost fair and square, I will accept that.' It really ticks people off when you say, 'we won, and we aren't going to show you how.'"

I ask her about the (now infamous, for some reason) coin tosses, videos revealing chaos and/or miscounts at certain locations, charges that the election was "stolen" for Hillary Clinton and much more, including Donald Trump's charge that Ted Cruz "stole" the election from him and that it amounted to "voter fraud".

"They call everything voter fraud!," Harris tells me. "It's so odd! Even Trump is claiming that when one of the candidates spreads some gossip that wasn't true about another candidate, that that was voter fraud! How is this voter fraud? Can we just call it was it is, which is a problem with election integrity, or in some cases election tampering. But it's not about the voters. Why are we pointing fingers at the most idealistic level, the voters?"

We go on to discuss worries about the even less transparent New Hampshire Primary, where most of the state still uses the same Diebold paper ballot optical-scan computer systems to tally votes that were seen flipping a mock election in HBO's Emmy-nominated 2006 documentary Hacking Democracy. (Watch how it was done right here, and feel free to be concerned when the 100% unverified results are reported next Tuesday night.)

Among the recommendations Harris offers for those concerned about Election Integrity next week (and for the rest of the year, frankly): "One thing I think is really important --- is for people to get out their mobile phones, take a picture of the results at the polling place [at the end of the night] and they can text it to themselves, to a friend, put 'em on Facebook, Tweet it." She says that puts a timestamp on the graphic image of results as they were produced by computers at the precinct, which can later be compared to the results reported by the state on the web. "I think that's one thing that's pretty important this time. Just photograph the paperwork. It's not hard. Ship it off electronically somewhere, which will automatically timestamp it."

That's particularly important in places like New Hampshire where, she explains, the state "very quietly, and actually wrongfully, passed a law in 2003 so that we cannot go back and look at [paper ballots after the election] ... In New Hampshire, they put an amendment on an unrelated bill, the dark of night, and quietly said 'ballots are not a public record anymore'. So while they may say, 'we have ballots and anyone can look', that's not true. I tried."

Finally, we discuss another heartbreaking loss this week to the Election Integrity community. Last night, we lost Riverside County, California's longtime EI champion, Tom Courbat. A Vietnam-era vet stationed in South Korea, Tom heroically battled multiple myeloma related to Agent Orange exposure for years. As I note on today's show, I spoke with Tom on the phone several times throughout those years about EI issues, even when he was literally in the hospital receiving chemo therapy.

Tom appeared on air with me on a number of occasions over the years, and was often an important source for many blockbuster stories here at The BRAD BLOG. (For example, the 2006 discovery of the infamous "Yellow Button" on the back of Sequoia touch-screen systems that allow voters to cast as many votes as they like until physically restrained from doing so; the 2007 "hack" challenge to the cowardly Riverside County Board of Supervisors who fought in favor of 100% unverifiable voting systems; the blocked recount of CA's anti-GMO initiative, Prop 37, in 2013; And the 2013 law he successfully shepherded through the CA legislature to require that counties release election results in downloadable formats; Those are just some of the reasons why, in 2007, we called Tom a "Hero of Democracy" who is "one of many such quiet, and usually unrecognized, heroes around the country, to whom our nation owes a debt of gratitude which can never be adequately repaid.")

Rest in peace, my friend. You deserve it. I miss you already, but will always remain inspired by you...
