Guest: Martin Longman of Washington Monthly and Progress Pond...
By Brad Friedman on 1/22/2020 6:31pm PT

Our special coverage of the ongoing U.S. Senate Impeachment Trial of Donald John Trump continues on today's BradCast following Tuesday's marathon session that ended at nearly 2am in the nation's capital, before beginning again with opening arguments on Wednesday. [Audio link to full show is posted below.]

On Tuesday, Republicans voted repeatedly along party lines to block 11 different amendments proposed by Democrats to allow for various first-hand witnesses to Trump's alleged High Crimes and Misdemeanors and documents being withheld by the White House that underscore other evidence in the two Articles of Impeachment.

Republican Senators blocked amendments proposed by Democrats to subpoena documents from White House Chief of Staff Mick Mulvaney; Documents from the State Department detailing the President's call with Ukrainian President Vlodymyr Zelinsky, as Trump withheld military assistance and a White House meeting in hopes of strong-arming Ukraine's new anti-corruption President to announce (not to carry out, just to announce) investigations into Trump's potential 2020 political rival Joe Biden; Documents from the Office of Management and Budget (OMB), which the President illegally ordered to withhold nearly $400 million in Congressionally-appropriated military assistance; Documents from the Pentagon where officials were reportedly troubled about potential violations of law in withholding the funds; a subpoena for Mulvaney himself to give testimony in the trial; A subpoena to two OMB staffers who carried out the hold on military assistance to the war-torn country; A subpoena for Trump's own former National Security Advisor John Bolton, who regarded Trump's Ukraine scheme as a "drug deal" and who has said he'd be willing to testify if subpoenaed by the Senate because, as he claims, he knows more about all of this than is currently publicly known.

In vote after vote, Republicans voted as a block, with 53 votes, to deny every Amendment offered by Democrats, even against ensuring votes for subpoenas at a later date or to have the Chief Justice authorize subpoenas if the Republican-appointed John Roberts, who presides over the trial, felt any particular witness or document would have probative value by being relevant to the case. "One side is not afraid of a fair trial," lead House Manager Adam Schiff argued, "one is terrified" that the truth might come out.

Meanwhile, Trump offered false comments to reporters overseas at the World Economic Forum in Davos, Switzerland, where he echoed his previous lies that he would "love" to have Bolton and Mulvaney and his Sec. of State Mike Pompeo and former Energy Secretary Rick Perry testify at the Senate trial, but he just can't allow it due to "national security" and "executive privilege" concerns.

Back home, the White House team's public defense at the first day of the trial was not well received, even by Republicans, including Chris Wallace of Fox "News" (which is now, unlike actual news outlets like CNN and MSNBC, breaking away during trial coverage for commercials and regular programming, while leaving the impeachment proceedings in a little silent box in the corner of the screen), the House Republicans' own Constitutional law expert Jonathan Turley, and George Conway, the longtime Republican attorney and activist husband of Trump's Senior White House Counselor Kellyanne Conway.

In a blistering interview with CNN on Wednesday, George Conway charged that Senate Republicans "don't want to hear the evidence because they know the truth, they know he's guilty"; that the charges against Trump are "much, much more serious" than those against Bill Clinton during his impeachment (on which Conway worked); that Trump is a "pathological liar" who "needs to be removed now" from office, because he is "thoroughly unfit for office". Kellyanne's husband also said that he is "deeply saddened" by what has happened to his Republican Party, but sees this historic event as a "moment of reckoning" for the nation and his party.

We're joined today by MARTIN LONGMAN (long known as "BooMan" to many old time progressive blog readers) from Washington Monthly and Progress Pond, for commentary as the Democratic House Managers begin their first day of opening arguments (which could also be their closing arguments if Republicans vote again next week to block witness subpoenas following the White House attorneys' opening argument). We also discuss the rules for McConnell's "scam trial" and why it is that Republicans seem to "lose every round and still win on the scorecard" --- not just in this matter, but going back as far as the Florida 2000 election.

Finally, we close with a few audio clips from Tuesday, when Democratic House Manager Rep. Jerrold Nadler accurately charged that Trump's lawyers "lie and lie and lie and lie", and White House Counsel Pat Cipollone said in response --- with a straight face --- that "President Trump is a man of his word." The heated late-night exchange resulted in a reprimand for both sides as Tuesday's marathon 13-hour session drew toward its close.

But we close today with a clip from Rep. Schiff's opening argument, citing a chillingly apt warning from founder Alexander Hamilton about "a man unprincipled in private life desperate in his fortune, bold in his temper, possessed of considerable talents...despotic in his ordinary demeanour [and] known to have scoffed in private at the principles of liberty [who] is seen to mount the hobby horse of popularity—to join in the cry of danger to liberty --- to take every opportunity of embarrassing the General Government & bringing it under suspicion --- to flatter and fall in with all the nonsense of the zealots of the day --- It may justly be suspected that his object is to throw things into confusion that he may ‘ride the storm and direct the whirlwind."

Debunking the 'impeachment is a disaster for Democrats!' lie with actual, independently verifiable facts for your use over the holiday...
By Brad Friedman on 11/27/2019 5:15pm PT

On today's BradCast: A few holiday morsels that we hope may come in handy over your Thanksgiving weekend with friends and family. [Audio link to show follows below.]

Donald Trump, along with his cowardly Republican apparatchik and dishonest rightwing media machine, have all been busy pretending over the past several days that the first two weeks of public impeachment hearings in the U.S. House Intelligence Committee were somehow "a disaster for Democrats." Even mainstream corporate media have been helpful in spreading that fake news.

Polling, however (among other things), suggests the opposite --- unless 50% majority support for impeachment and removal of the President of the United State from office, according to CNN [PDF], and steadily increasing support for impeachment over each week of public hearings, according to Reuters/Ipsos, is somehow "a disaster for Democrats".

By way of comparison, at the height of Bill Clinton's impeachment in 1998, support for the GOP effort among Americans was never higher than 29%. And yet, 50% want Trump out already, after just two weeks of public testimony. (It took nearly a year of impeachment inquiry before the worst evidence against Richard Nixon even became apparent, by the way.)

At the same time, even since the first round of hearings concluded last week, there has been a constant drip, drip, drip of increasingly damning information against the President, shoring up an already overwhelming amount of evidence that Trump directed a quid pro quo bribery scheme against Ukraine by withholding a White House meeting and hundreds of millions in military aid in exchange for the announcement of a Ukraine investigation into his 2020 political rival Joe Biden and a debunked, nonsensical theory that Ukraine, not Russia, interfered in the 2016 election on behalf of Hillary Clinton, not Trump.

In just the few hours since our previous BradCast, newly released testimony from a top official in the White House Office of Management and Budget reveals that two OMB officials quietly resigned over the summer due, at least in part, to their concerns about the legality of Trump's order to withhold Congressionally-allocated military aid to Ukraine for personal political purposes.

Also, the New York Times has reported that Trump had been briefed about the complaint from the whistleblower that kicked off this impeachment inquiry before he finally unfroze military aid for Ukraine in September. Moreover, that report helps to explain Trump's strange insistence to his EU Ambassador that "there is no quid pro quo!" long before the phrase had even made it into the public discussion of the matter.

So, as things get worse for the President, somehow it's "a disaster for DEMOCRATS"?

As many Americans today are heading home for the holidays and may have to discuss all of this with their Trump-lovin' relatives over the holiday table, we thought it'd be helpful to supply a bit of (non-lethal) ammunition. While various blockbuster revelations from witnesses received most of the attention over the first two weeks of lengthy public hearings in the House, the closing summations each day and at the end of the series of hearings by Intelligence Chair Rep. Adam Schiff received far less attention. That's a pity, as the Congressman --- a former prosecutor who served as Asst. U.S. Attorney in the Los Angeles U.S. Attorney's office before being elected to Congress --- gives one helluva closing summation.

Today, we share two of those closing arguments, as they nicely wrap up both what this impeachment is about, how damning the evidence already is against the President, and what the stakes are for the country.

Our mission, as journalists, is to help educate and inform the electorate. That's not easy these days in a post-truth world full of fake news, a lying President, and still far too much corporate media hackery. We hope today's program might help you to help ALL of us find our way out of this otherwise very dark hour in American history. We ALL must play a part in that, right now, if our republic is to survive this unprecedented attack.

Oh, and Happy Thanksgiving. Somehow...

Guest: David Roberts of Vox; Also: Trump's terrible tariffs; Good news for voters in WA and CA; U.S. Senators query U.S. voting system vendors...
By Brad Friedman on 3/8/2018 6:09pm PT

On today's BradCast, so many great cons to debunk, so little time. But we've actually got some good news for voters today as well. [Audio link to full show is posted below.]

First up today, Trump unleashes his massive and wildly unpopular --- and, yes, job-killing --- new taxes on imported steel and aluminum.

Then, some voting news, most of it good. The state of Washington is the ninth state in the union to adopt automatic voter registration, and a federal court has ruled that California must inform Vote-by-Mail voters before their ballots are tossed out when election officials decide that the signature on the ballot doesn't match the one on the voter's registration form. According to the ACLU's lawsuit, as many as 45,000 voters in the state were disenfranchised, without their knowledge, thanks to California's horrible practice, carried out by the whim of officials who are anything but handwriting experts.

Meanwhile, two Democratic U.S. senators have sent a letter to the nation's top three election vendors, ES&S, Dominion, and Hart Intercivic, asking if they have shared the source code from their computerized voting and tabulation systems with Russia. We discuss what this actually means and doesn't. (For example: No, it's not necessary for Russia or anybody else, including elections officials, to have access or familiarity with proprietary source code from voting and tabulating systems in order to manipulate computer-tallied elections!) We also call out Reuters for continuing to spread the evidence-free claim in their report on this that "voting machines were not directly affected" by meddling during the 2016 election.

Next, we're joined by Vox.com's environment and politics writer DAVID ROBERTS to discuss a new report [PDF] released by the Trump Administration's own Office of Management and Budget(!) which, as he writes, "demolishes the GOP’s deregulatory claims." In short, it finds that benefits to the public of federal regulations far outstrip their costs in pretty much every imaginable way.

The aggregate costs of major federal regulations (those with an impact of $100 million or more) between 2006 and 2016, according to the annually mandated report released late on a Friday night for some reason, "were somewhere between $59 and $88 billion. And the aggregate benefits were somewhere between $219 and $695 billion," says Roberts. "So, even if you take the highest possible estimate of costs, and the lowest possible estimate of benefits, the benefits are still well over double what the costs were, in the most conservative analysis."

While Donald Trump has attempted to cut hundreds of rules and regulations across federal agencies --- repeatedly boasting about doing away with a record number of "job-killing regulations" and bureaucratic red-tape --- the fact is, as his own OMB (headed up by the far-right, Tea Party, regulation-hating Mick Mulvaney!) detailed in their report, those regulations do not "kill jobs" or cost the government money. In fact, killing those rules costs the government far more, particularly the environmental rules being radically gutted by this Administration.

But, as Roberts argues, the "job-killing" mantra has been so often repeated by Republicans since the days of Ronald Reagan --- and gone largely unchallenged by corporate media --- much of the public now simply accepts those false assertions as reality.

"Just to be clear, we've known this about federal regulations for a long time," Roberts notes. "These things have been subjected to cost-benefit analysis out the wazoo for years and years. Not only by the federal government, but by outside analysts. They all more or less converge on this same answer, which is that the public health and social and employment benefits of these things wildly outweigh the costs, and have for years."

"The reason Republicans hate this is because, when you see it in aggregate like this, it's almost enough to convince you that government can be an agent of good, that it can improve public health and welfare while still maintaining economic growth."

"It's revealing, I think, that this is treated as a revelation," he tells me. "It ought to be commonplace by now. It's the consensus of the experts. We just don't accept it, because Republicans, just through the sheer weight of repetition, have been saying 'job-killing regulations', 'burdensome regulations', etc., etc., for so long, that that's just sort of baked into the cake as one side of the debate, even though there's no support for it. There's no analysis that supports that."

We discuss why that is and who actually benefits from the GOP's great con. (Hint: It isn't the bulk of the folks who voted for Donald Trump!) Robert's also goes on to argue why he believes that Democrats are at least partly to blame for this con having taken such a death grip on the American conscience as self-defeating "conventional wisdom" over the past several decades.

Finally, Desi Doyen joins us for the latest Green News Report for yet another demonstration of how the decades-long scam to gut regulations continues to threaten the nation and the world...
