The Florida election official so well-respected by Republicans and Democrats alike in 2000 that he was tapped to oversee that year's historic Presidential "recount" between George W. Bush and Al Gore in Florida (until it was stopped by the U.S. Supreme Court), tells us today that it is likely impossible for the state to complete three statewide recounts --- for U.S. Senate, Governor and Agriculture Commissioner --- in time to meet the state's ridiculously arbitrary statutory deadlines. Run by Republicans for decades, the state "puts a premium on speed", rather than accuracy, ION SANCHO, the 28-year former Leon County (Tallahassee) Supervisor of Elections tells me on today's BradCast. "This is, by no means, a system geared toward finding the truth." [Audio link to show follow below.]

Sancho explains how it is currently unlawful to add any vote to the totals as based on a hand examination of ballots by human beings, as he details the process now officially under way in the Sunshine State for a machine "recount" in the gubernatorial race between Democrat Andrew Gillum and Republican Ron DeSantis (who, the computers report, leads by about 0.41%) and a supposed "manual" count in the U.S. Senate contest between incumbent Democratic Sen. Bill Nelson and term-limited FL Gov. Rick Scott (which Scott is said to be leading by 0.15%, or less than 15,000 votes out of more than 8 million cast.) Sancho details how even in a "manual" count in FL, ballots are first fed through tabulation computers and only ballots determined by the computers to be over- or undervotes are then re-examined. But, even those ballots are, yes, "remade" by officials onto a fresh ballot paper so that it can can then be run through a computer tabulator.

Given the limitations on the so-called high-speed tabulation systems made by companies like ES&S, still used across the state --- which only accept "300 ballots at a time" --- the scanners used in counties like heavily Democratic-leaning Palm Beach "cannot physically do this job" before statutory deadlines run out. All ballots must be "recounted" by Thursday (even though overseas and military votes aren't due until this coming Saturday!) It's a system, Sancho describes, that was put in place before the very popular no-excuse absentee Vote-by-Mail system was allowed in Florida, along with provisional voting and other election practices that require time-consuming ballot-by-ballot evaluation to determine whether it's eligible for tabulation in the first place.

As noted on today's program, Florida will have "counted" and "recounted" its ballots (correctly or incorrectly, we will never know) less than a week and a half after last week's midterms, several weeks before California even announces completion of its initial count in early December.

All of this, as Scott and even the President of the United States are falsely charging election fraud is ongoing in the state's two largest counties (Broward and Palm Beach), despite a complete lack of evidence to support any such claims. Scott's own Secretary of State and Florida Dept. of Law Enforcement --- who Scott oversees and who both have authority to oversee elections and election crimes in all 67 Florida counties --- concede they have no evidence to support the GOP claims. Sancho also responds to the "laughable" charges of "fraud" being made by Scott and the "truth-free statement" tweeted by Trump on Monday morning, which falsely claims that "ballots showed up out of nowhere, and many ballots are missing or forged" in Florida.

A couple of points worth underscoring here, as the Republicans have been busy dusting off their 2000 playbook to lie about "fraud" occurring in Palm Beach and particularly in Broward, in hopes of shutting down the tabulation of legitimate ballots altogether, once again, in Florida: 1) Brenda Snipes, the Supervisor of Elections in Democratic-leaning Broward County, which has had a number of election failures over the years, was appointed by Republican Gov. Jeb Bush in 2003; 2) Current Republican Gov. Rick Scott appointed his hand-picked Sec. of State Ken Detzner, who has tasked officials from his own office to oversee Broward's election office this year; 3) Nobody from Detzner's office or Florida Law Enforcement has seen or alleged any criminal wrong doing in the county. None of that, however, has prevented GOPers from claiming otherwise.

"Everybody's vote needs to be given the same weight," Sancho, a longtime election integrity champion who has taken on both the state and the voting machine companies argues during today's conversation. "It shouldn't depend upon whether you're in a competent or incompetent jurisdiction. Your vote should count if you cast them properly and you've made no errors."

Also today: Desi Doyen on California's horrific, deadly wildfires which have, to date, killed 31 across the state with hundreds more still unaccounted for; Georgia's Democratic gubernatorial candidate Stacey Abrams, in a still too-close-to-call race against GOP Sec. of State and notorious vote-suppressor Brian Kemp filed a new lawsuit over discarded absentee and provisional ballots on Sunday; Democrat Kyrsten Sinema appears to have defeated Republican Martha McSally to win the the U.S. Senate being vacated by Republican Sen. Jeff Flake in Arizona; And 15-term Orange County, CA Republican Rep. Dana Rohrabacher has reportedly been unseated by Harley Rouda in one of the state's most GOP districts. That would bring the net pickup for Democrats in the U.S. House to 32, with results for more than ten seats in CA and elsewhere still said to be too close to call...

We're getting tired of being right about this stuff. The political apocalypse we predicted for the day(s) after the 2018 midterm --- from problems counting ballots to Trump's "burn it all down" response to the results --- appears to be playing out in a number of ways today. We have several big news items today regarding reported results in Florida, Arizona and Georgia on today's BradCast. [Audio link to full show posted below.]

But first today, we needed to hit several disturbing breaking news headlines...

  • 12 people were killed in a mass shooting at the Borderline Bar & Grill in Thousand Oaks, CA, a wealthy suburb just outside of Los Angeles in Ventura County, during it's popular country music college night. The shooter, who took his own life, was reportedly a 28-year old white male Marine combat veteran thought to be suffering from PTSD. Victims are said to include the bar's security guard, an armed Sheriff's deputy, and a survivor of the October 2017 massacre in Las Vegas that killed 58 and left more than 800 wounded;
  • 85-year old U.S. Supreme Court Justice Ruth Bader Ginsberg was reportedly hospitalized on Thursday, after fracturing three ribs in a fall in her office;
  • A three-judge panel on the 9th Circuit U.S. Court of Appeals ruled that the Trump Administration's attempt to kill President Obama's 2012 DACA program was likely done so in violation of the law. For now, the protection from deportation for hundreds of thousands of immigrants brought here as children will stay in place, though the Administration has filed for a quick ruling from the U.S. Supreme Court;
  • The White House has barred CNN's Jim Acosta from the White House, after the President's bonkers post-election press conference on Wednesday. The White House lied about their reasons for doing so, despite video of the presser revealing their blatant lie;
  • And Trump's firing of Attorney General Jeff Sessions on the day after the midterms is quickly leading to a full-on Constitutional Crisis, as he has named Matthew Whitaker, a former political operative and opponent of Robert Mueller's Special Counsel investigation, as Acting AG responsible for overseeing that probe. Normally, the Deputy AG --- Rod Rosenstein, who had been overseeing it following Sessions' recusal --- would fill that role. It's feared Whitaker, a Trump loyalist, is likely to move to scuttle the Mueller investigation at any moment.

Meanwhile, the fight to count votes continues to grow predictably uglier in several states following Tuesday's contentious midterms. Democrats are now said to have picked up at least 31 seats in the U.S. House, taking back control of the chamber from Republicans, with analysts forecasting that they could end up winning as many as 38 new seats, as votes continue to be tabulated and canvassed across the country. But there are growing concerns about computer-tabulated results in U.S. Senate and Governors races in at least three different states tonight...

  • In Florida, a "recount" now appears inevitable in the U.S. Senate race between incumbent U.S. Senator Bill Nelson and his Republican challenger Gov. Rick Scott, with the margin between the two at less than 0.22% as of airtime. That would trigger an automatic statewide hand count in the Sunshine State. But there remain many questions about uncounted provisional and absentee ballots, as well as tens of thousands of suspicious undervotes in the Senate race reported by the paper ballot computer tabulators in Broward County. Some 25,000 voters, according to the computers, voted for down-ticket races like Agricultural Commission, but failed to vote in the top-of-the-ticket U.S. Senate race?

    In the state's gubernatorial election, Republican Rep. Ron DeSantis' lead over Democratic Mayor Andrew Gillum, has now fallen to 0.47 percent. If it stays below 0.5 percent, it would trigger an automatic machine "recount" statewide. (The margin must be below .25 percent for a hand count in Florida.)

  • In Arizona, there are nearly three-quarters of a million completely uncounted ballots across the state, leaving the results of the highly-contested and very close U.S. Senate race between Republican Martha McSally and Democrat Kyrsten Sinema in doubt. Arizona sources tell me that this many still-uncounted early and absentee ballots is now unusual for the state. But with all eyes on whether Democrats can flip the seat of retiring Republican Sen. Jeff Flake blue, a lot more people are now noticing. Sinema currently leads McSally by about one-half of a percentage point, according to the latest computer-tabulated numbers.
  • And in Georgia, attorneys for Democratic gubernatorial candidate Stacey Abrams held a news conference today, in which they offered a blistering response to Sec. of State Brian Kemp's declaration of victory in the Governor's race, and his belated resignation as SoS along with it. Team Abrams charges there are thousands of wrongly rejected and still-uncounted ballots in the state, though --- thanks to Kemp's horrific administration of the election --- they are unable to know how many there actually are and how many voters were unlawfully prevented from voting at all. They forcefully repeated Abrams' Election Night vow to fight to assure that every vote is counted, even if legal action is required to ensure it.

On today's BradCast: Yet another mind-blowing adventure in attempted election oversight. This time regarding the complete destruction of all paper ballots in the middle of a Florida lawsuit, following an election between two Democrats, one of them a powerful member of Congress. [Audio link to show follows below.]

But first: Deadly and costly disasters, natural and otherwise, top the news headlines on today's program. Among them: the catastrophic Amtrak train derailment on a brand-new line near Seattle, the second straight week for still-raging apocalyptic wildfires in Southern California, and the continuing disaster in Puerto Rico where, three months after Hurricane Maria came ashore, one-third of the island is still without power and the Governor has finally conceded that the official death toll of 64 may be off...by as much as 1,000!

All tolled, hundreds of billions will be needed to rebuild from those deadly disasters, and yet Republicans in Congress are still hoping to pass a $1.5 trillion tax cut, largely for wealthy Americans, before Christmas. Their scheme took a troubling turn over the weekend, as a new provision was added to the legislation during reconciliation of the House- and Senate-passed versions late last week. The new provision, it was revealed by David Sirota at International Business Times, would give special tax breaks to owners of large real estate holding LLC's like President Donald Trump, House Speaker Paul Ryan and, most curiously, Sen. Bob Corker who, on Friday, mysteriously reversed his previous opposition to the bill after the new provision was tacked on, in what many are now calling the #CorkerKickBack.

Then, we're joined by journalist, documentarian and election integrity advocate LULU FRIESDAT to discuss the remarkable turn of events recently revealed in response to multiple public records requests she has made over the past year in hopes of reviewing hand-marked paper ballots from the Democratic primary election last year between Rep. Debbie Wasserman-Schultz and her Bernie Sanders-endorsed challenger Tim Canova.

Just weeks after being forced to step down as chair of the DNC amidst the release of stolen emails from party officials, Wasserman-Schultz soundly defeated Canova in the first primary she'd faced in her six terms as a member of Congress. But, unexplained vote count numbers --- such as hundreds of more voted ballots than voters signed in to the poll books in the 23rd Congressional District race in Broward County, FL --- led to Friesdat's attempt to examine the paper ballots by hand, in hopes of determining if they were tallied correctly by the county's computer tabulators during the August 2016 Democratic primary. Eventually Canova himself filed a lawsuit against the county's Supervisor of Elections Brenda Snipes, after Friesdat says she was continually denied access to the materials.

In November of this year, well over a year after Snipes certified the contest, both were finally invited to inspect the Broward County ballots only to learn upon arrival that all of them had actually been destroyed by the county in the middle of the lawsuit. Only digital images of what were purportedly the original ballots were available for examination, according to Snipes, in what appears to be, according to Politico's survey of election experts, a clear and stunning violation of federal election law requiring all such materials be retained for 22 months after an election.

Friesdat tells me that neither her nor Canova had any idea the ballots were destroyed before showing up to review them. "If you're looking at digital scans, and you don't have the original ballots to turn to, at that point you have no way of verifying that ballots haven't been switched out, that ballots haven't been added, that ballots haven't been taken away --- you don't have any verification that those are the original ballots."

Oddly enough, she explains, "in the very first public records request in November [of 2016], I requested all of the digital ballot scans for the election, and I was told that they didn't have them, that they didn't exist. And then it turned out that they did exist. So the county was duplicitous in regard to that information."

As to what's really going on here, Friesdat demures from speculation, but says, based only on what is already known on the public record, that "according to Politico, seven legal experts that they consulted all agreed that the ballots being destroyed was illegal."

It is of a piece, she observes, with the recent revelations in Racine County, WI, in November of this year, when multi-partisan election transparency advocates were finally allowed to review some of the computer-scanned paper ballots from the 2016 Presidential election. After months of similar public records request, they were allowed to view original paper ballots, only to find that, in the precincts they examined, anywhere from 2 to 6% of perfectly valid Presidential votes had been ignored by the computer tabulators entirely. That, in an election where Trump is said to have pulled off his shocking statewide victory by less than 1%.

"What's going on here is actually just a representative sample of the problems that we have with our elections, and which you have been reporting on for over a decade," Friesdat says. "We're heading into the 2018 primaries. We at least now have a growing understanding and awareness that, in many cases, our election results may or may not be accurate, and that the protocols we are using in order to get those results are not secure." She offers many other troubling observations on all of this during our conversation today.

Finally, four U.S. Senators --- two of whom had previously called for Sen. Al Franken to resign amidst allegations of inappropriate conduct --- are now, according to a new report today, said to be hoping that he might reconsider his previously-announced plans to resign "in the coming weeks", before the Senate Ethics Committee has even investigated the charges against him...

Broward County, FL, has dropped all charges against a local Election Integrity advocate whose arrest, described by an election official and other colleagues at the time as "outrageous," was captured on video tape late last year.

Ellen Brodsky, who had been a non-partisan candidate for Supervisor of Elections in last November's election, was arrested at the apparent behest of the office of the county's current Supervisor of Elections --- Brodsky's Democratic opponent in the race --- Dr. Brenda C. Snipes, while trying to view public, post-election counting and canvassing of ballots.

She was charged, at the time, with "disorderly conduct" and "trespassing," forced to spend the night in jail, and not released until nearly 6:00am the next morning, even though her son had posted the required $25 (twenty-five dollar) bail for her by 8:30pm on the evening of her arrest.

The "disorderly conduct" charges were dropped some time later, following the release of a video tape of the incident as posted by The BRAD BLOG in the days following the arrest. The tape, reposted again at the bottom of this article, revealed that Brodsky's conduct had been anything but disorderly when the county police were summoned by Fred Bellis, a deputy election official from Snipes' office, and Brodsky was thrown into handcuffs and hauled away.

While Brodsky's trial on a "trespassing" charge had been set to start today, a last-minute offer to drop all charges, in exchange for admissions by Brodsky that she would not be disruptive in the future, was sent to her last night from Snipes' attorney.

"There was no way I was gonna agree to such demands," Brodsky told The BRAD BLOG today, following the county's dismissal of the court case. "We offered our own compromise," she said. "We will accept a withdraw of all charges, and will, as I've always done, agree to follow Florida law regarding public meetings." It was an oral agreement.

Her attorney, Tanner Andrews, echoed her sentiment. "We agreed to do what we're already doing. We'll obey the law," he explained during a phone call this afternoon. "I could agree not to rob the bank next Sunday and it'd have the same legal effect," he added...

Counter Charges for 'False Arrest' Still to Come...

It's been more than a full month since the November 13th arrest of Broward County, FL's election integrity advocate Ellen Brodsky and the state has still failed to file formal charges or supply her with discovery documents.

As The BRAD BLOG reported in detail following the arrest, Brodsky was taken into custody, seemingly at the behest of her opponent in the election, after attempting to oversee the public counting of ballots for the election in which she ran as a candidate for Supervisor of Elections.

The arrest for "disorderly conduct" (according to police records) was caught on tape and posted here last week. The tape shows fairly clearly that there was no such disorderly conduct by Brodsky, despite the order for the arrest having apparently been issued by the office of the current Broward Supervisor of Elections, Dr. Brenda Snipes.

Today's South Florida Sun-Sentinel picks up the story with an update noting that Brodsky, a month since her arrest, has been forced to seek a judge's order demanding that prosecutors explain why she was arrested in the first place.

The BRAD BLOG has also obtained a copy of a motion to compel discovery exhibits, which have similarly not been given to her, as filed by Brodksy's attorney earlier this month.

According to the Sun-Sentinel:

Ellen Brodsky has asked a judge to order prosecutors to explain why she was arrested at the election office warehouse.

The case is open but no charges have been filed, State Attorney's Office spokesman Ron Ishoy said Tuesday.

Her lawyer, Tanner Andrews, denies wrongdoing. He wants to know what exactly his client is accused of doing and who made the accusation on Nov. 13.

"Why they arrested her would be a really good start," he said.

Ellen Brodsky's Attempt at Peaceful Observation of Ballot Counting, Led to Overnight Detention in Broward County Jail, Apparently Orchestrated by Election Opponent...

Last month we reported the story of the arrest of Broward County, FL, election integrity advocate and independent candidate for Supervisor of Elections, Ellen Brodsky. She was handcuffed and arrested, according to the police report, for "disorderly conduct" and "trespass/structure or conveyance" while trying to observe post-election ballot counting and canvassing procedures in the county.

After her arrest, orchestrated by her opponent, Supervisor of Elections Brenda Snipes, Brodsky was held overnight in the county jail until 5:45am the next morning, despite her son having posted bail for her --- a grand total of $25 --- at 8:30pm the night before.

Brodksy has an impressive record of finding serious problems with counting and election procedures in Broward County, which undoubtedly helped foster the animus from her opponent Snipes. Shamefully, as we pointed out in our original coverage, Brodsky is only the latest in a string of EI advocates around the country who have been arrested recently while trying to peacefully carry out public observation of our public elections.

Here now is the video tape of the incident that results in her arrest, as captured on a small flip camera provided by election watchdog organization VideoTheVote.org. The man seen on the phone, at the beginning of the tape, calling the police, is Snipes' deputy Fred Bellis. It's clear that Bellis, in cahoots with Snipes --- again, Snipes was Brodsky's election opponent --- clearly seems to have been choreographing the entire arrest.

As you'll see in the video below, the fact that she was arrested at all, much less for "disorderly conduct," is absolutely incredible and clearly without merit. Our original report offered a great deal of background and context, as well as comments from Brodsky and a number of both EI advocates and a state election official from a different county who have all worked with her. They all, almost uniformly, described the turn of events at the time as "outrageous" and an "abuse of power."

Ellen H. Brodsky Jailed Overnight After Being Barred From Oversight Several Times by Incumbent SoE Brenda Snipes
Third Such Arrest of an EI Activist Since Summer...

A candidate for Supervisor of Elections in Broward County, FL, was arrested yesterday, following threats and orders from her opponent, the current Broward SOE, Dr. Brenda Snipes.

Ellen H. Brodsky, the county's first non-partisan candidate for SOE, had previously been barred from public counting and oversight on a number of occasions, at the county's official Canvassing Board site and voting machine warehouse in Lauderhill, Florida.

After being taken into custody yesterday afternoon by three uniformed police officers, Brodsky was held overnight at the Broward County Jail even though the $25 --- that's twenty-five dollar --- bail had been posted for her by her son by 8pm last night. She was finally released well after 5am this morning.

(Note: An account of the arrest posted this morning on the South Florida Sun Sentinel's blog incorrectly reported that Brodsky was "released on bail Thursday evening." A report later filed on their website by the same reporter correctly noted that she "was released from jail at 5:40 a.m. Friday.")

Brodsky is a longtime member of a number of election integrity advocacy groups in Florida, including the Broward Election Reform Coalition, which she also founded. Earlier this year, she determined to run against Snipes as a non-partisan candidate.

Brodsky is the latest in a string of election integrity advocates around the country who have been arrested in the course of attempting oversight of our election procedures --- although she is the first, to our knowledge, who also happens to be a candidate on the ballot.

The action has brought condemnation from a number of other election watchdogs and even other election officials in Florida who have characterized the arrest to The BRAD BLOG as an outrage and an abuse of power by Snipes and her office...

'Unofficial Results' on County Website Shows Turnout Exceeds Registered Voters in Precinct D001
Officials Have No Explanation for Now, Said to Be 'Still Reviewing That Information'...

Turnout at Broward County, Florida's precinct D001 was excellent in last Tuesday's primary election, according to the "unofficial results" posted on this county webpage.

With 1,028 ballots cast, and 930 registered voters at the precincts, voters having turned out, the turnout was an impressive 110.54%!

The BRAD BLOG called the Broward County Supervisor of Elections office to find out if there was any explanation for these numbers. We spoke with Patricia McCallister, an assistant to Supervisor Dr. Brenda C. Snipes...
