Apparently, our week of GOP debunkery continues on today's BradCast. I have a feeling we may be at it for quite some time, as Republicans are just getting started with their crash and burn majority control of the U.S. House. [Audio link to full show follows this summary.]

On yesterday's program, we shared a few clips from interviews this week with the new Republican Chair of the House Oversight Committee, Rep. James Comer of Kentucky. He explained why he was dead set on his committee investigating the connection between classified documents found by Joe Biden's aides at his Delaware residence (and immediately returned to the federal government) and concerns about "influence peddling" by the President and his family. That, despite any actual evidence to support the allegations.

Comer also made clear he had no interest in his Committee investigating the former President, despite the hundreds of classified documents he'd stolen from the White House (and refused to return, with many still missing) and mountains of evidence of influence peddling by Donald Trump and many of his children, including son-in-law Jared Kushner who received $2 billion from the Saudis just after Trump left office.

There was one point Comer focused on, however, in an effort to buttress his case. "There's one email that's been identified that is suspicious, that we want to look into," he explained. "We want to make sure that this one email that was on Hunter Biden's laptop wasn't one of the classified documents" found at Biden's residence in DE.

This claim seems to stem from an allegation first published by a New York Post columnist, apparently. GOP Senators have also been citing the same claim of late. Sen. Ron Johnson (WI) recently argued on Fox Business that an email from 2014, said to have been found on what Republicans have long claimed to be an "abandoned" laptop from the President's son contained "a very detailed analysis of what's happening in Ukraine." Sen. Ted Cruz (TX) alleged on a podcast that information in the email "could easily have come from a classified briefing."

Washington Post's Glenn Kessler examined the allegation and the evidence today. He found that the facts stated in the 22-point email said to be from Hunter actually lined up with information that was not only on the public record at the time, but published by major news outlets just weeks before the date of the email. "Laptop email suggests Hunter Biden read newspapers, not classified documents," Kessler's headline reads today. He awarded "Three Pinocchios" to the claims from Johnson and Cruz, as echoed by Oversight Committee Chair Comer on Sunday.

At the same time, Hunter Biden, after years of staying quiet about all of this, appears to now be pushing back. His attorneys recently sent legal letters to Fox "News" and Tucker Carlson, for example, demanding they retract and apologize for what the letters characterize as defamatory statements. They've also sent letters seeking criminal investigations by both state and federal authorities into the dissemination of his personal data by folks like Rudy Giuliani in the run-up to the 2020 election, making clear that while some of the data discovered was his, he neither authorized its public release, nor dropped off an allegedly abandoned laptop at a repair shop, as the GOP story, initially spread by Giuliani, goes.

Much more on all of the above today. But if Republican members of Congress believe that House investigations into this sort of stuff is what voters want them to do, after months of campaigning on claims of out-of-control crime, record inflation, high gas prices, etc., they are likely very wrong. At least according to a new report on focus groups of independent voters in Wisconsin, Virginia and Texas.

Next up today, we share some of the remarks by Rep. Ilhan Omar (D-MN) from the House floor today before a vote by House Republicans to remove her from the Foreign Affairs Committee based on comments they regard as anti-Israel four years ago. In truth, the move by House Speaker Kevin McCarthy --- who was finally able to scrounge up the minimum number of votes needed to remove her (all Dems voted in her favor) --- was clearly revenge for Democrats removing Reps. Marjorie Taylor Green (GA) and Paul Gosar (AZ) from their committee assignments during the last Congress. That, after they each posted violent threats against Democrats. (For example, Green promoted a comment from a supporter calling for the assassination of then House Speaker Nancy Pelosi. Gosar posted a video in which he is depicted as decapitating Rep. Alexandria Ocasio-Cortez and attacking President Biden with a ninja sword.)

Then, Desi Doyen joins us for our latest Green News Report, as Big Oil profiteers announce all-time record profits after a year or two of inflating gas prices; and the Biden EPA announces some very good news for longtime opponents of what would have been a toxic mining project in a pristine part of Alaska.

Finally today, a programming announcement for The BradCast! We will be moving to a four-day-a-week, Monday through Thursday schedule (with rebroadcasts scheduled for Friday) for the foreseeable future. While there are no emergencies, as noted on the program, there are several reasons for this change. Catching up on some long overdue health issues (physical, emotional, mental) is just one of them. We're fine. But, after moving from a weekly to a daily schedule back in early 2015, in order to cover the 2016 elections, and then staying with that schedule thanks to the "surprise" ending of that election, and then continuing on through four years of Trump and a years-long pandemic...well, we've got a lot to catch up with here and hope you will both understand and forgive us for our need to take Fridays off for a while. On today's BradCast: More shameful GOP responses to America's continuing mass shooting epidemic; one step closer to some accountability for our corrupt former President; the Republican Party's shameful response to a very close primary election in Pennsylvania; and an unmitigated election disaster for voters continues to hold up a critical U.S. House race two weeks after Oregon's midterm primaries. [Audio link to full show is posted below this summary.]

Among the stories covered on today's program...

  • This week in Uvalde, Texas, 19 fourth graders and two teachers were murdered after the shooter at Robb Elementary School had no problem purchasing two semi-automatic rifles and hundreds of rounds of ammo just days after his 18th birthday this month. The state's Republican Gov. Greg Abbott --- who is up for reelection this November --- declared after the massacre that the problem was mental illness and Texas must "do a better job with mental health." But last month, Abbott slashed $221 million from the department overseeing mental health programs in the state which, according to a new study, ranked 50th last year for access to mental health care. That, after Abbott signed bill after bill making it easier for Texans to buy, carry and kill as many people as possible, with high-powered, military-style weapons. (Did I mention that Abbott is up for reelection this November?)
  • It's not only Texas Republicans working hard to make it as easy as possible to kill fellow Americans. Just days after back-to-back-to-back mass shootings in America, Senate Republicans on Thursday blocked a bill in the U.S. Senate meant to help to prevent domestic terrorism. The measure was already adopted by Democrats in the House. Not one single Republican Senator voted in favor. (Several of them will be on the ballot this November.)
  • In somewhat brighter news, a federal judge on Wednesday rejected a lawsuit by gun manufacturers, distributors and retailers which had attempted to block New York's new law allowing those in the firearms industry to be sued by the state, cities and individuals for endangering the public's safety and health. NY Attorney General Letitia James said the judge's ruling offers "a moment of light and hope" following the American carnage of the past two weeks. The trade group representing the domestic terrorism industry, The National Shooting Sports Foundation (NSSF), vowed to appeal.
  • In more good NY/Letitia James-related news, a four-judge state appeals court panel today upheld a lower court ruling that Donald Trump and his children Ivanka and Don Jr. must sit for a deposition in James' civil investigation examining the Trumps' "fraudulent" valuation of properties in bank, tax and insurance filings. The Trumps claimed their comments under oath could be used against them in a parallel criminal investigation by the Manhattan District Attorney into many of the same issues. The court agreed. But noted that that's why the Fifth Amendment right against self-incrimination exists. If the Trumps want, they may invoke it during their depositions, in the same "disgraceful" way, according to Trump, that "only mobsters" use it. Some difficult choices await in the very near future for our disgraced former President.
  • In Pennsylvania, nearly two weeks ago, Trump-endorsed celebrity TV doctor Mehmet Oz and former hedge-fund CEO Dave McCormick battled to a virtual tie for the GOP U.S. Senate nomination. The winner will run against Democratic nominee, Lt. Gov. John Fetterman. As of today, Oz leads McCormick by fewer than 1,000 votes out of more than 1.3 million cast in the Keystone State's GOP primary. This week, McCormick sued in federal court to assure that all legal ballots are counted, including mail-in ballots that arrived on time but have a missing or incorrect date on the secrecy envelope. Another court recently ruled such ballots are valid and must be tallied. The RNC and Pennsylvania Republican Party, however, are intervening against McCormick to prevent those lawful, valid ballots from being tallied in the U.S. Senate primary and are attacking their own candidate, McCormick, for daring to enfranchise all Republican voters. On Wednesday, the state announced there will be an automatic statewide recount in the race, with about one-tenth of one percentage point currently separating the two leading candidates in the unofficial results. The official winner should be named by June 9.
  • Another midterm primary election held on the same day in Oregon, on May 17, has far worse problems. The closely watched U.S. House race in the state's 5th Congressional District between grassroots-supported Democrat Jamie McLeod-Skinner and conservative Democratic Rep. Kurt Schrader caused much excitement on Election Night, when McLeod-Skinner appeared on her way to unseating the incumbent Congressman. Then, with about 68% of the vote in, pretty much all of the counting stopped and hasn't moved much, if at all, since then.

    What happened? We're joined today by one of Oregon's longtime Election Integrity activists SHERRY HEALY --- co-founder of the California Election Protection Network, and, more recently, the Chair of the Oregon Democratic Party's Election Integrity caucus --- to explain the disaster in Clackamas County, OR which has held up the tally.

    As she details, a printing problem on the barcodes (used to identify party and precinct) on tens of thousands of the County's vote-by-mail ballots means they cannot be run through the computerized tabulation system. But, rather than count those ballots publicly by hand, the County's longtime beleaguered County Clerk, Sherry Hall (pictured above), decided that those tens of thousands of otherwise valid ballots should be "remade" by hand --- duplicated by election officials --- on separate ballot sheets so they can then be running through the optical scanners for tabulation.

    "This county clerk has a long history of bungled elections," Healy explains. "But this is the Hiroshima of botched elections." Healy details how Hall failed to adequately test the ballots for this problem after receiving them from the printer before sending them out to voters. Moreover, the decision to remake tens of thousands of ballots, rather than simply count them by hand, "imperils" the entire election, she charges.

    Healy calls Hall's decision "absurd" and "insane," explaining that a simple hand-count "would take less time and be more efficient and accurate" than recreating "in excess of 66,000" ballots.

    Hall, a Trump supporter elected to the job back in the Tea Party days about a decade ago, has a long history of problems in her office. Way back in 2012 we reported on an election official in Clackamas who was indicted on six felonies and two misdemeanors after she was found to have secretly filled in unvoted races for Republican candidates on incoming mail-in ballots.

    When Hall announced that the printing error on the ballots made them unscannable, she claimed that it was new deadlines adopted by the state legislature for the receipt of incoming mail ballots that would hold up her county's tally, as opposed to her own failure to test ballots before sending them out. More recently, she denied that she gave permission for a Schrader campaign observer to enter the counting room an hour early, before observers from the McLeod-Skinner campaign had arrived. Then security camera footage was obtained through a public records request revealing she had lied about that.

    It's unknown when the tabulation in Clackamas will finally be complete. The 5th Congressional District primaries on both the Democratic and Republican side remain uncalled, with just over 70% tallied in each almost two weeks after Election Day. (More have come in since air time today.) For now, McLeod-Skinner remains almost 15 points ahead of Schrader. But that could change. In the meantime, there are a whole lot of lessons to be learned from this entire mess, as we discuss with Healy today. (And, yes, Hall is also up for reelection this November.)

Get ready for another roller-coaster ride on today's BradCast, which also happens to be Recall Election Day in California. [Audio link to full show is posted below this summary.]

As of airtime on Tuesday, we heard of no major reports of voting problems at the polls across the Golden State, though that may be thanks to so many already having voted by mail or during early voting. But, while pretending to support "election integrity" during an interview on MSNBC, Larry Elder, rightwing talk show host and GOP front-runner to become Governor if popular Democratic Gov. Gavin Newsom loses on the ballot's first question, was busy lying about "fraud" and the "twisted results of this 2021 Recall Election" on his "Stop CA Fraud" website, before any results are known whatsoever. Oh, and he's also threatening the use of the "ammo box" if the results don't go his way.

(And, in related comment, we discuss why these "Will you accept the results of the election tomorrow?" questions are really unfair and unhelpful gotcha questions, that it would be really nice if media stopped asking.)

In far brighter news, a group of eight U.S. Senators --- representing the broad political spectrum across the Democratic caucus in the upper chamber and including Joe Manchin --- announced a "compromise" election reform package with a ton of really really good stuff in it. Among the huge number of long overdue reforms in what they have dubbed the "Freedom to Vote Act": Automatic and same-day voter registration for all; restoration of voting rights for former felons; federal minimum standards for absentee voting, drop boxes and early voting; an end to partisan gerrymandering; curbs on dark money in elections; the prevention of the ability of partisan state legislatures to overturn results derived by non-partisan election officials; new cybersecurity standards for computerized voting systems; and much much more.

The devil is often in the details, and I've yet to review the actual legislative text as of airtime, but from the summary description made available by Sen. Amy Klobuchar, chair of the Senate committee that oversees federal elections and campaign law, almost any one of the items included in this proposed bill would be hugely good news. I'll need to review the specific language on the measure's requirements for hand-marked paper ballots to sign off on that part of the bill, but even the proposed requirements for Voter ID are very good ones. They will serve to force states with purposely restrictive Photo ID voting restrictions (enacted to suppress the vote, not to protect against fraud) to be much less onerous, while avoiding new restrictive mandates in the majority of states which already have reasonable ID rules or few at all.

The legislation is based on Manchin's personal "compromise" version of the For the People Act and John Lewis Voting Rights Advancement Act, both of which have already been passed by the House. Manchin is one of the eight Senators who worked out this proposal, and is said to be reaching out to bring Republicans on board. Of course, even if all 50 Senators who caucus with the Dems vote in favor, as appears likely (Schumer says he is scheduling a vote for next week), it seems unimaginable that any Republicans will join them, much less the 10 that would be required to overcome a Senate filibuster. But with Manchin as a co-sponsor, it will now be on him to get the GOP votes needed for passage or face the prospect of no long-overdue election protection at all...UNLESS he is willing to support a "democracy reconciliation" carve-out to the Senate filibuster. It should be a very interesting, maddening and/or fantastic week or two. We'll be following it all very closely, of course.

And, as Dems are trying to improve representative Democracy in the U.S., Republicans are still, apparently, in the business of simply trying to kill as many Americans as they can to make some sort of twisted political point.

Yet another fervent, anti-vaxxer rightwing radio and TV host died from COVID over the weekend, the fifth in the past month and a half. And while we've had a modicum of sympathy for some of the others who have recently passed, as we explain, this one, 62-year old Bob Enyart, is very difficult to feel anything but contempt for.

We have slightly more sympathy, however, for the wildly misinformed and brainwashed 64-year old anti-vax QAnon supporter and highway overpass activist and YouTuber, Veronica Wolski who bragged last month on her final video about never having worn a mask in her life, and about the need to "NEVER COMPLY" with any COVID public health measures in order to "never give up your freedoms" so "you never have to fight to get them back."

She won't be fighting for anything anymore. Wolski died over the weekend from COVID-related illness in the ICU, but not before the QAnon dupes, led by disgraced Georgia attorney Lin Wood, sicced supporters on the hospital trying to save her life and threatened its workers with "murder" charges unless they agreed to treat her with Ivermectin, the horse deworming medicine not approved for treatment of COVID. That, before Wood declared on his Telegram channel to his more than 800,000 followers: "Now, we go to war."

Unfortunately, deadly climate change (not to mention COVID) is what wingnuts should be going to war against. As Desi Doyen explains in our latest Green News Report today, yet another massive tropical storm, Hurricane Nicholas, is now knocking out power (again) and drenching the U.S. Gulf Coast with some 20 inches of rain in parts of Texas flooded out in 2017 by Hurricane Harvey and sections of Louisiana that were already still under water following last week's Hurricane Ida. President Biden, meanwhile, is pushing for action on climate in his $3.5 trillion budget reconciliation bill, and his EPA is taking several long-overdue actions on behalf of clean, non-toxic drinking water across the U.S., and an age-old salmon fishery in Alaska...

The news, as you may have noticed, continued to be somewhat grim. But we do manage to find a bit of encouraging news here and there on today's BradCast. [Audio link to full show follows this summary below.]

Among the stories covered on today's program...

  • Good news in the long (very long!) battle to protect Alaska's nearly-pristine Bristol Bay and its native run, $2 billion a year salmon fishery industry from the ecological devastation of a huge, open pit gold and copper extraction operation known as Pebble Mine. Biden's EPA is invoking a section of the Clean Water Act to block the project. Hopefully it will stay blocked for good this time, but we'll see.
  • New jobs numbers from the Department of Labor are encouraging today, with unemployment rates now at a pandemic low and reaching pre-pandemic levels. That's cautiously good news, given the effect that the Delta variant is now beginning to have on the economy. But, because it's largely encouraging news which works against Republican hopes for a disastrous economy, you probably didn't hear too much about today's numbers. We also explain why this largely good, if under-reported, news also undercuts Sen. Joe Manchin (D-WV)'s argument for undercutting Joe Biden's proposed, landmark $3.5 trillion budget reconciliation bill.
  • More encouraging news (before we get to the less encouraging news today): It turns out we do have an Attorney General and he is capable of acting quickly and decisively...at least when he's pushed to do so. The Dept. of Justice today announced a federal lawsuit to enjoin the state of Texas' new law undercutting the Constitutional right for women to have an abortion, as per the previously-settled, nearly 50-year old precedent established by Roe v. Wade. Whether the DOJ's "relatively novel theories developed in reaction to a novel law" will be successful, given the GOP's stolen and packed U.S. Supreme Court, remains to be seen.
  • Remember back during the summer of 2009, when rightwingers were instructed by Fox "News" and the Republican Party to be outraged about "death panels" in President Obama's then-proposed Affordable Care Act that would lead to the rationing of health care and decisions by government bureaucrats about who should live or die? The argument was all nonsense at the time, as there were no such "death panels" in ObamaCare that would kill granny. But, guess what? States around the country are now beginning to ration healthcare and are deciding who gets to live or die. That is thanks to the very same Republicans who were told to be outraged about phony "death panels" in 2009, now being told to be outraged about life-saving vaccines and mask mandates. Thanks to those idiots, COVID infections, hospitalizations and death rates are skyrocketing, particularly in GOP-run states with low vaccination rates. And, because of it, and the lack of ability to handle the surge, the state of Idaho has announced new "crisis standards of care." That means they are now literally forced to ration health care, as they try to save those with the highest chances of survival, while wishing the best of luck and "comfort care" to everyone else. Kentucky and other states are now on the brink of doing the same, as hospitals continue to be overwhelmed in states with low vaccination rates.
  • COVID infection, hospitalization and death rates were, incredibly --- and completely unnecessarily --- 2 to 3.5 times higher this Labor Day, then they were over Labor Day last year, in 2020.  Moreover, infection, hospitalization and death rates are also skyrocketing among children right now, with kids now comprising more than a quarter of all new cases.
  • Despite the alarming rates of sickness among children, twisted GOP Governors in states like Texas and Florida are still fighting tooth and nail to block local school districts from determining what is best for their students and staff alike. Florida's largest school district, Miami-Dade, announced this week that 13 staffers have died since mid-August. All of them were unvaccinated. But, in brighter news, a state judge has --- for now --- blocked Gov. Ron DeSantis' appalling authoritarian attempt to ban mask mandates and punish school districts who defy him.
  • Amid all of this today, President Biden announced new federal directives to try and curb the deadly pandemic by mandating vaccination or regular testing for as many as 100 million workers nationally. In remarks sharply critical of those who have chosen to remain unvaccinated, Biden also announced that Executive Branch employees and contractors who do business with the federal government will now have to be vaccinated, with no option to test out of it.
  • Late today, Los Angeles School District, the second largest in the country, voted to implement a mandatory vaccination regime for those older than 12.
  • Finally, Desi Doyen joins us for our latest Green News Report, as Biden pushes for infrastructure resiliency and "building back better" after the deadly devastation of Hurricane Ida, and much more...

Guest: Const'l Attorney John Bonifaz on reversing 'the road to tyranny' (and also on how to get foreign corporate money out of U.S. elections)...

Writing at Washington Monthly today, asking "Why Is Merrick Garland Defending Bill Barr's Policies?," law professor and Free Speech for People (FSFP) Board Member Jennifer Taub quips: "This is Merrick Garland's Tylenol moment, and by which I mean he has more than a headache but a poisoning on his hands." Yup. Today's BradCast won't cure his headache, but it may offer an antidote for the poisoning...if he pays attention. [Audio link to full show follows below.]

The new Attorney General spoke at the Dept. of Justice on Tuesday about his national strategy to focus on the rise of domestic terrorism, particularly carried out by white supremacists in the wake of the Trump-incited January 6th attack on the U.S. Capitol. Garland described such incidents as "attacks on all of us collectively, aimed at rending the fabric of our democratic society and driving us apart," adding: "We have an enormous task ahead, to move forward as a country, to punish the perpetrators, to do everything possible to prevent similar attacks and to do so in a manner that affirms the values on which our justice system is founded and upon which democracy depends."

Garland's remarks follow on his announcement Friday that he is doubling the number of DoJ attorneys focused on enforcing voting rights at the federal level in light of new vote suppression laws being adopted by Republicans in states around the country.

So, he seems to understand at least two major threats to the values "on which our justice system is founded and upon which democracy depends." But is he really prepared to punish all of the perpetrators?

Every day now it seems that stunning new information is revealed as to just how poisoned our Dept. of Justice had become under the Trump Administration, as the former President used the nation's once widely respected law enforcement agency for his own personal purposes, to protect himself from legal accountability (as in former AG Bill Barr's use of the department to block Trump from criminal accountability for obstruction following Special Counsel Robert Mueller's findings and from civil accountability in the defamation case filed by Trump's alleged rape victim, E. Jean Carroll, both of which Taub writes about today); to wield power against his perceived political enemies (as we learned last week, when it was revealed that the DoJ secretly obtained phone, email and text message records from Democratic lawmakers and several media outlets in 2018); and, in futile efforts to keep himself in power (as we learned today, based on emails obtained by the House Oversight Committee revealing Trump tried to order the DoJ to file briefs in the U.S. Supreme Court in support of his evidence-free big lie that the 2020 election was stolen from him).

As more and more emerges, it's difficult to keep up with it all. But, sadly, what we know so far is likely only the tip of the iceberg. That's why, back in February, a group of non-partisan government watchdog groups penned a letter [PDF] to then Judge Merrick Garland, prior to his confirmation as AG, calling on him to form a task force at the DoJ immediately after being confirmed, "to investigate any potential federal criminal or civil violations that may have been committed by former President Trump, members of his administration, or his campaign, business, or other associates."

The letter, which has now been signed onto by more than 200,000 Americans, according to FSFP, asks Garland to convene the task force to probe Trump's "flurry of unethical, unconstitutional, and often criminal activity, culminating on January 6, 2021, with the seditious insurrection on the United States Capitol incited and encouraged by former President Trump and his allies."

"If we are to begin the process of restoring the integrity of the Department of Justice and the rule of law to our nation," the groups write --- before detailing at least five different categories of "potential offenses" by the previous administration --- "it is essential that the Department thoroughly investigate these actions and, where warranted and appropriate, hold accountable those who have violated the nation's laws."

That DoJ task force, however, has yet to be formed. And Garland, according to our guest today, Constitutional attorney and longtime voting rights champion JOHN BONIFAZ, co-founder and President of FSFP, has yet to reply to the February letter.

On today's show, Bonifaz explains why "it's critical" that this task force be stood up, and why such a group of prosecutors need to be convened in this matter, rather than an independent commission formed by Congress, a blue ribbon panel formed by the White House or even another Special Counsel investigation launched by DoJ.

While he supports Congressional oversight in general, he explains: "The reason why we believe a task force is the best way to go over a Special Counsel is we do think this should not be assigned outside of the Department to someone who then is seen, as Robert Mueller was, as the sole arbiter of this." While disagreeing, as many scholars do, with the notion that a sitting President cannot be criminally indicted, Bonifaz explains that Mueller's report "was very clear that once the President was out of office, he would be free to be prosecuted for those crimes."

"That's just one example of many as to why this task force needs to be created," he tells me. "There are multiple investigations that need to proceed, and potentially multiple prosecutions. It would be an outrage for this Administration to claim that it's going to turn the page, it's not going to conduct that kind of accountability for those that have engaged in such lawless behavior in the last Administration. That's what happens on the road to tyranny. If we're to protect our democracy and our Constitution, it's critical that we hold Donald Trump and his associates accountable for the violations of federal criminal law they may have committed."

We discuss a number of the already known issues currently crying out for real probes by federal prosecutors if the DoJ is ever to be restored; concerns about Trump associates still burrowed in at Justice; the many investigations known to have been shut down by Barr which should quickly be re-opened; and the question of "why is the Biden Justice Department continuing the work of the Barr Justice Department" when it comes to attacks on press freedoms via only-recently lifted gag orders on secret subpoenas of reporters' private records and "the intervention that the Barr Justice Department started in the E. Jean Carroll case --- both of these decisions were clearly made with Garland's knowledge."

I also ask Bonifaz for his opinion on whether he believes Garland is actually up to the gargantuan task of dealing with the ongoing and increasing problems that DoJ must now handle regarding all sorts of criminal and civil matters, even while bringing both accountability for the unprecedented corruption of the previous Administration and the necessary reforms at DoJ to avoid the same or worse abuse of the nation's top law enforcement agency in the future.

"I think this is a moment for the Department of Justice, but also for democracy and our Constitution. And they need to get it right," he explains.

In a separate matter, FSFP --- which was founded in the wake of the Supreme Court's 2010 'Citizens United' ruling that opened the floodgates to corporate money in American elections --- is now working at the state level to enact model legislation that would bar corporations with foreign investors (which is a whole lot of them!) from being allowed to spend money in state and municipal elections.

Finally, we're joined by Desi Doyen, as new temperature records are being smashed during the year's first major (and very early) heat wave, for our latest Green News Report. Beyond the bad news about climate change, we've got some very good news to close with today, particularly for folks up in Alaska...

Attorney General Bill Barr may now be in big trouble with Donald Trump at the DoJ. One of Trump's personal attorneys may be in big trouble with the D.C. Bar. And Trump's attempt to game the Census and Apportionment of Congressional seats for the next 10 years may be in big trouble at his stolen and packed U.S. Supreme Court. All of that big trouble and more on today's BradCast! [Audio link to show is posted below summary.]

First up, Attorney General Barr has undoubtedly infuriated his boss today by admitting to The Associated Press that "to date," the Justice Dept. has "not seen fraud on a scale that could have affected a different outcome in the election."

Uh, oh. The last senior Administration official who said something similar --- Chris Krebs, Trump's Director of the Cybersecurity and Infrastructure Security Agency (CISA), the new DHS agency that oversees elections infrastructure --- was fired just days later after his federal agency and others (along with several voting machine vendors, so take it with a grain of salt) announced that the 2020 election was "the most secure in American history."

Speaking of Krebs, he was interviewed by CBS' 60 Minutes on Sunday, where he stood by that assessment and chalked the success of the 2020 election up to "paper ballots."

"Paper ballots give you the ability to audit," he told CBS' Scott Pelley, "to go back and check the tape and make sure you got the count right. That's really one of the keys to success for a secure 2020 election. That gives you the ability to prove that there was no malicious algorithm or hacked software that adjusted the tally of the vote."

Well, he was so close. "Paper ballots" don't protect elections, HAND-MARKED paper ballots protect elections. And there is a big difference. Krebs goes on to cite, for example, Georgia's terrible new Dominion Voting Systems touchscreen computers that voters are forced to vote on at the polls, and the subsequent statewide hand-count of ballots to make his case. But Georgia's systems, as we've long reported in great detail, print out computer-marked paper ballot summaries which can never be known after an election to reflect the intent of any voter. As we explain yet again today, studies show that the vast majority of voters do not check their computer-printed summary, and that 93%(!) of them do not notice if the computer has changed one of their votes. We offer much more detail --- yet again --- on today's show.

But Krebs, a lifelong Republican who has been bravely outspoken in attempting to debunk false claims about fraud both before and after the election, is certainly a hero for his efforts. The fact that Joe diGenova, one of Donald Trump's personal lawyers, took to the air on Monday to call for Krebs to be murdered --- literally --- is a chilling sign of our times and should result in disbarment for Trump's latest Fox "News" TV attorney for hire. "Anybody who thinks this election went well like that idiot Krebs," diGenova said on a wingnut radio program yesterday, "that guy is a class A moron. He should be drawn and quartered, taken out at dawn and shot."

Krebs suggested to NBC News today that he is likely to take legal action. But you know who else "thinks this election went well," apparently? Bill Barr! We'll see if diGenova calls for him to be executed now as well, or which of the two Trump lackeys will be fired by Trump first.

Next up, we're joined by DAN VICUÑA, National Redistricting Manager at Common Cause, one of the good-government immigration advocacy groups that sued the Trump Administration after a Presidential Memorandum from Trump last year directed U.S. Census apportionment data to leave out "illegal aliens" despite the Constitution's mandate to include the "whole number of persons in each State" for purposes of determining how many U.S. Congressmembers each state shall have for ten years following each decennial Census.

Four different lower courts largely agreed with the plaintiffs challenging Trump's decree --- which would increase political power for rural, white, Republican-leaning districts and take it away from more urban, Democratic-leaning, minority heavy jurisdictions --- finding it to be illegal and/or unconstitutional. On Monday, Trump's stolen and packed U.S. Supreme Court heard oral argument in the matter, and Vicuña reports today on how things went. In short, it appears to have not gone well for the Administration, even with three Trump-appointed Justices now packed onto the bench.

Vicuña, notes that "citizenship status has never been used as a determining factor in whether a person will be counted." He also explains the dangers of Trump's unprecedented decree and how his attempt to bastardize the "plain language" of the U.S. Constitution and "two centuries of precedent" to instead use only "voter-eligible" citizens in counts to determine apportionment in the U.S. House, endangers not only the immigrant population, but everyone else in America, even in so-called "red" states.

"The Administration's lawyers are dancing a strange dance," he tells me while describing Monday's hearing. "The President's memo very clearly states what the President wants, which is to exclude every undocumented person living in the United States --- undocumented people who contribute billions to the economy, who pay taxes on things that they may never see [like] Social Security. The President's attorneys are going into court and saying, 'Well, we're only going to do this within the strictures of what's allowable by law, so for that reason, you shouldn't even rule on this case now. There's no need to address the plaintiffs' challenge, because we don't exactly know how we're going to implement the President's goals' --- even though the President states them clearly --- 'so you should punt.'"

Whether the Court will go along with the Administration on this, and how the incoming Biden Administration may make all of this moot anyway, is all discussed on today's program.

Finally, we're joined by Desi Doyen with our latest Green News Report, in which the Trump Administration actually does something that is not only NOT horrible, but very very good for folks in Alaska who have been challenging the creation of the controversial Pebble Mine for more than a decade. I'll try to keep my BradCast summary as short and sweet as possible, as tonight's Presidential Debate in Cleveland begins shortly --- with full special coverage of it on tomorrow's program! [Audio link to today's full show is posted below.]

Among the stories covered today, beginning with some good news and slowly sliding downhill from there...

  • At around 7 points, Joe Biden's current lead in the national polling average against Donald Trump is the largest since Bill Clinton's re-election in 1996. But don't get too excited just yet. We don't run national elections. We run 50 state-by-state elections and it's the Electoral College votes of each of those states that matters, not the popular vote...except for this year, when the popular vote actually could end up making a huge difference in who becomes the next President. I explain why;
  • Biden's pre-election polling lead in the crucial battleground state of Pennsylvania, according to a new WaPo/ABC News poll, is now at a substantive 9 points. With the poll's margin of error factored in, however, it could be a much tighter race that that number suggests in Biden's birth state, which is being seen of late, by both campaigns, as the potential tipping point state for the Electoral College this year. But the news is much more good than bad for Biden in the key battleground, in that he is outperforming Hillary Clinton's 2016 lead over Trump in the noteworthy Dem-leaning parts of the state, and has substantially cut into Trump's 2016 margins in the Republican regions of the state and among voters (for example, white without college degrees) that Trump would need to repeat his very narrow reported victory in the Keystone State four years ago;
  • There are, however, many "X Factors" this year that should prevent anyone from thinking they know anything about how all of this could ultimately play out based on either national or battleground state polling numbers --- from the pandemic and the unprecedented number of absentee ballots this year, to the US Postal Service slowdowns, to new, unverifiable touchscreen voting systems in many locations, to the GOP's stolen U.S. Supreme Court and how those "Radicals in Robes" could still help game the system between now and Election Day (and in the days after), particularly if Republicans are able to steal an even larger the majority by ramming Trump's SCOTUS nominee Amy Coney Barrett onto the Court before Election Day, as Senate Republicans currently intend;
  • One of those "X Factors," for example, is playing out right now in New York City today, where the Board of Elections has an apparent disaster on its hands after their vendor sent out tens of thousands of mail-in ballots with the wrong names and addresses printed on the accompanying return envelopes. The BOE claims they will make good on the problem by getting corrected envelopes to voters in time to vote, but once again, chaos reigns for voters in Brooklyn, who are asked by the BOE to contact Apply4Absentee@boe.nyc or call 1-866-VOTE-NYC if they received an absentee ballot with the incorrect name or address on the return envelope;
  • Meanwhile, ballot battles continue in both state and federal courts regarding, among other things, how long after Election Day that mail ballots in swingstates like Pennsylvania, Wisconsin, Michigan and North Carolina may arrive at County headquarters to still be included in the final results. We're joined today by BRAD BLOG's long-serving legal analyst ERNEST A. CANNING to discuss some of those cases and how the U.S. Supreme Court's so-called "Purcell Principle" may serve to overturn (or uphold) rulings in both lower federal courts and in state Supreme Courts. Canning also offers some thoughts on Trump's nomination of Barrett to SCOTUS and how the latest Federalist Society-backed judge to be packed onto the high court illustrates the sweeping lurch to the radical right on our federal court system over the past 40 years;
  • Finally, we close with Desi Doyen and our latest Green News Report. The news she's got today is pretty grim...but don't blame Desi. There ain't much good news out there to work with these days...

I'll be brief in today's BradCast summary, because I've got to head back into Day 2 of the bizarre dystopian nightmare known as Donald Trump's Republican National Convention. We're watching it so you don't have to. You're welcome. [Audio link to full show is posted below.]

Among the stories covered on today's program...

  • Two nightmare storms slamming the Gulf Coast in the same week as the biggest and more dangerous of the two, Hurricane Laura, is gunning for the Louisiana/Texas border, likely as a Category 3;
  • A Florida judge puts the brakes on Gov. Ron DeSantis' demand that all public schools open five days a week for in-person classes by the end of this month. He says the state's plan "disregards safety" amid a still roiling --- if slightly easing (for now) --- pandemic in the Sunshine State;
  • Highlights (low lights?) from Day 1 of the RNC, in which every speaker sounded as if their remarks were either written by the same person, or simply ripped straight off of Fox "News". As ridiculous as the evening was --- featuring enough dangerous lies about Trump's mishandling of the COVID crisis that MSNBC had to break in with a doctor for some serious fact-checking; a couple of accused felons warned Democrats will "“abolish the suburbs altogether"; a seemingly stoned Don Jr. and his seemingly insane former Fox "News" host girlfriend Kimberly Guilfoyle --- we determined that ridicule was the best was to cover it. So we called in Stephen Colbert for some assistance.
  • Good news, for now, for voters in Pennsylvania. A Trump-appointed federal judge forced the Trump Campaign to make fools of themselves by demanding they present evidence of voter fraud via secure absentee ballot drop-boxes in Pennsylvania, where they are suing to prevent the use of the convenient devices during this year's general election. The plaintiffs were unable to to present any such evidence.
  • Finally, Desi Doyen joins us for our latest Green News Report with more on the twin storms pummeling the Gulf Coast and the raging fires in California (both amid a global pandemic making evacuating shelters very tricky for social distancing), the Trump Administration puts a pause on it's approval for the controversial Pebble Mine in Alaska after Don Jr. and Fox "News" decide maybe they're against it after all, and a quick review of last week's virtual Democratic National Convention where Joe Biden and many others promised action on climate change...

We're getting our sea legs back n today's BradCast, after a few days off (thanks, Nicole Sandler for filling in for us!) Luckily it's been a slow few new days since we last spoke. Sigh... [Audio link to full show is posted below summary.]

Anyway, among the stories covered on today's program...

  • How pathetic is malignant narcissist, Donald Trump? So pathetic that he completely made up an invitation to throw out the first pitch at a Yankees game after the nation's top infectious disease expert, Dr. Anthony Fauci, was invited to toss the first pitch at the Washington Nationals' home opener last week;
  • Well, that didn't take long. Now 17 members of the Florida Marlins are said to be infected with the coronavirus, leading Major League Baseball to suspend the Marlins' season through at least this Sunday along with the cancellation of three games this week between the Yankees and Phillies. All of this comes just days after MLB opened for a truncated 60 game season. They didn't make it past Day 3 without an outbreak;
  • If MLB and its billions of dollars can't keep its player safe, how do you suppose your local school district is gonna fare next month if they are ordered to re-open for in-person classes? That is still the plan for Florida Governor Ron DeSantis who is bravely risking the lives of his state's children and their teachers in hopes that somehow that will help Donald Trump get re-elected in 98 days. We wonder if he's noticed that the infection and hospitalization rate for KIDS in the hot-spot Sunshine State is now exploding, with more than 31,000 cases of COVID-19 for Floridians under the age of 18 as of late last week --- a 34% increase in cases and a 23% increase in hospitalizations since the week prior. More than 300 children in Florida are now hospitalized with the virus, with one-third of them between the ages of 14 and 17, and 67 cases of hospitalization for those younger than one year old. That, after Donald Trump told the nation last week at a White House coronavirus briefing that school age kids "don’t catch it easily; they don’t bring it home easily";
  • Meanwhile, on Capitol Hill, the nation's most corrupt Attorney General in history, Bill Barr, testified for the first time ever before the U.S. House Judiciary Committee on Tuesday, as federal troops wreak chaos on American streets and after interceding in criminal cases on behalf of Trump's convicted felon friends, former National Security Advisor Michael Flynn and GOP dirty trickster Roger Stone. Both were found guilty of lying to federal investigators during Robert Mueller's Special Counsel probe into Russian interference in the 2016 election. It was a contentious hearing that seems to have accomplished little. Though it did include a moment when Barr, who pretended to be concerned about the rule of law, seemed to suggest it might be just fine for the President to solicit and/or accept foreign assistance in an election. For the record, that remains illegal --- at least for those who actually do care about the rule of law --- whether Barr actually enforces such things or not;
  • Then, the disinformation wars continue, as led by the President of the United States and his more-than-willing accomplices. One of which, naturally, is his eldest son and namesake Don Jr., who ended up in "Twitter Jail" today for retweeting a video by Breitbart "News" that Twitter, Facebook and YouTube consider to be "false information about cures and treatments for COVID-19."
  • But, of course, Trump Sr. has many such accomplices in the rightwing media. Unfortunately, that isn't limited only to wingnut propaganda cable channels like Fox "News" or Internet propaganda outlets like Breitbart. It also includes the second largest owner of local television stations in the nation. Late last week Sinclair Broadcasting Group, which is allowed to own nearly 200 local stations in more than 100 markets, was shamed into temporarily pulling an episode of American This Week, as hosted by disgraced and fired Fox "News" personality Eric Bolling. (While texting unsolicited photos of one's genitalia is apparently enough to get ya fired by Fox, Sinclair doesn't seem to mind it all!)

    The episode in question featured an interview with a dubious, self-proclaimed "expert in virology" who, among other thing, claims that wearing a mask causes COVID-19, that Dr. Fauci "manufactured" the virus and sent it to Wuhan, China for some reason, and that an eventual coronavirus vaccine will "kill millions". After light was spread on the false claims featured in the episode, Sinclair pulled it for retooling. Today, CNN reports, they will not be airing it at all anymore. The Media Matters Senior Researcher who first exposed the Sinclair conspiracy propaganda, ZACHARY PLEAT, joins us on today's show to explain what happened and why Sinclair's pro-Trump propaganda --- hidden in plain sight, often coming out of the mouths of your favorite trusted local news anchors --- is arguably more insidious than even Fox "News".

    Moreover, that rightwing propaganda is being spread over OUR PUBLIC AIRWAVES in dozens of mostly southern and midwestern states across the country, on stations owned by Sinclair with frequencies licensed (for free) to them by the federal government in exchange for serving "in the public interest". Hopefully the FCC, during the next Administration, will take a long hard look at Sinclair's licensing agreements next time they come up for renewal;

  • Finally, Desi Doyen joins us for our latest Green News Report, with two surprise hurricanes in two different U.S. states over just one weekend; more environmental destruction by the Trump Administration on (hopefully) their way out the door; and the installation of the world's largest battery now set to power tens of thousands of homes with clean, renewable energy in Southern California...
