We've got some interesting follow-up on today's BradCast, following the disturbing story we broke on air earlier this week regarding the "master passwords" for North Carolina electronic voting systems --- and more --- found online, unprotected, and downloadable by anybody since at least early 2016, at the NC Board of Elections website. [Audio link to show is posted below.]

But first up, some quick news updates: A second U.S. House committee has now voted to hold Donald Trump's new Attorney General and fixer William Barr in contempt. The House Oversight Committee on Tuesday voted to recommend holding both Barr and Commerce Secretary Wilbur Ross in contempt for refusing to turn over subpoenaed documents regarding the lies told by both Commerce and DoJ about adding a question on citizenship to the 2020 U.S. Census. Ross previously claimed he was asked by DoJ to add the question to help better enforce the Voting Rights Act, but new documents from the hard drive of a recently deceased GOP gerrymandering operative reveal the real intent was to shift resources and Congressional districts to white Republican jurisdictions.

In other Constitutional Crisis news, Hope Hicks, Trump's former Communications Director and longtime aide --- before his run for office, during the campaign and transition, and while in the White House --- has reportedly agreed to testify before the House Judiciary Committee next week about her cooperation with Special Counsel Robert Mueller's two-year probe. Hicks was a key witness on a number of the criminal obstruction charges detailed in Mueller's report. She has agreed, however, to testify to Judiciary only behind closed doors next week, presuming the White House doesn't move to block her in some way.

In elections news, new Quinnipiac polling shows six of the current top contenders for the 2020 Democratic Presidential nomination --- Biden, Sanders, Harris, Warren, Buttigieg and Booker --- all handily defeating Donald Trump in a head-to-head match-up in NATIONAL polling, if the election were held today. That new poll and others out today still show Biden atop the pack in the primary contest, though slipping since he entered the race last month. Two new polls show Warren leaping into second place above Sanders since last week. We offer some thoughts and WARNINGS about all such polls today.

And then, some surprisingly good news for progressives in Virginia, where two criminal justice reformers ousted long time state prosecutors in elections on Tuesday.

Next, we're joined by Dr. WILLIAM BUSA of EQV Analytics, a Democratic campaign consulting and technology firm in North Carolina, though Busa is likely better known to many on the Internets as "DocDawg" from Daily Kos. Busa has been doing some excellent follow-up work on the startling recent disclosures by cyber risk researcher Chris Vickery, who explained on Monday's BradCast how he discovered "master passwords" for some of NC's electronic voting systems, and much more, on the state Board of Elections website last year. Hundreds of files and screenshots, he said, were all left vulnerable on the Internet, in a directory set as public, to anyone who felt like downloading them, at least since early 2016 in advance of that year's Presidential election and its stunning, razor-thin conclusion.

Busa, as a well known elections maven in NC, tells me he was contacted following Vickery's revelations this week by the SBOE's spokesperson with a vague explanation for the exposed files --- which were subsequently set to private after Vickery notified the Board about the vulnerability last year in advance of the 2018 mid-terms. But, as he documented at Daily Kos on Tuesday, the explanation by the Board's Public Information officer Pat Gannon only made the case "murkier". Gannon, according to an email he sent to Busa, claimed the files were old passwords that were no longer in use and that, in any event, they were encrypted when posted online. Busa studied the claims regarding encryption and finds them to be untrue based on evidence revealed by the unencrypted screenshot of the passwords posted by Vickery.

For his part, Vickery --- who previously told me he found evidence the passwords had been in other jurisdictions as well as the one county the state claims --- politely suggested that Gannon appears to be uninformed about the details of what was left online. "Both of these issues," Busa observes, "being told that they were encrypted when clearly they're not encrypted, being told they were posted in 2012 when pretty clearly they were posted in 2016 --- goes to the question of 'Are we being told what's going on?'"

Moreover, Busa hits on what he describes as "the most troubling part of this.". The larger question --- one that we've been trying to make clear since the night that Trump was supposedly elected: Nobody --- not the states, not Mueller, not the FBI, not the DHS --- nobody has done a forensic analysis of the computer voting and registration systems and tabulators used in 2016 to assure they were not manipulated in some way, despite the many claims made by the U.S. Intelligence Community and the Special Counsel's office that Russia attempted to interference with elections systems in as many as 21 states before the 2016 Presidential contest.

If "white-hat good guys like Vickery" were able to find these vulnerable files, surely black-hate bad guys could easily have done so as well. "If DHS didn't find those things, then DHS is not as good as Chris Vickery. And if it's not as good as Chris Vickery at finding the chinks in our armor, then it's certainly not as good as Russia's GRU is," notes Busa. So, why didn't the DHS --- which, the U.S. Government has claimed has taken unprecedented steps to work with states to help them protect our elections from vulnerabilities --- already find these files and notify the state about the serious breech long before Vickery did? Both Busa and I are still asking.

"With McConnell blocking any meaningful election cybersecurity legislation in the Senate, DHS's 'band-aid' approach to 'Well, we're going to consult with the boards of elections in the fifty states and give them some assistance, it really is just that --- a band-aid. It doesn't give me any confidence whatsoever, especially now with what we've seen from the Vickery information."

Also today, since we've been covering so much GOP corruption in NC of late, (Busa quips: "North Carolina has become such an embarrassment that South Carolina is considering changing its name to 'North Georgia'), the NC elections expert and campaign consult rings in with helpful insight on the crucial, upcoming, SCOTUS opinion expected anytime now regarding unlawful GOP partisan gerrymandering of the state's U.S. House districts ("we have very little voice in North Carolina today because of those gerrymanders"); two upcoming U.S. House Special Elections in the state (one in NC-03 to replace the late GOP Rep. Walter Jones and the other to fill the NC-09 seat, which is still vacant following last year's GOP Absentee Ballot Fraud scandal that left the state BOE unwilling to certify results last November); and an important project Busa developed last year at NCGoVote.org called "Reg Watch", to automatically notify voters if their registrations have been changed or deleted for some reason. It would be very nice to see that project scaled up to all 50 states if possible! We discuss...

• First up today, Virginia's Democratic Governor Ralph Northam announces a plan to convene a special session of the state legislature this summer to respond to last Friday's massacre at a municipal building in Virginia Beach which killed twelve people. Republicans, who have long controlled both chambers of the gerrymandered state legislature, have nixed a panoply of popular gun safety measures year after year in subcommittees, such as measures to place limits on extended magazines like the type used in Friday's shooting, barring the purchase of more than one hand-gun per month, and background checks for all gun sales. Northam says he is asking for "votes and laws, not thoughts and prayers" from state lawmakers just months before the entire General Assembly will be on the ballot for the Commonwealth's November 2019 off-year elections;

• The GOP establishment appears to be pushing back hard today against Donald Trump's promised new tariffs on all goods imported from Mexico, which Sen. John Kennedy (R-LA) recently predicted Trump won't actually implement. "He 's been known to play with fire, but not live hand-grenades," Kennedy opined regarding a new 25% tax that Americans would have to pay on all products from Mexico under the President's promised new scheme to, somehow, stop immigration across the southern border. Even members of his own Administration, however, don't appear to understand how Trump's proposed trade war would lead to an end of migration. But, in London today, Trump said it would be "foolish" to try and stop his plan to declare another "national emergency" to unilaterally impose the tariffs. Republicans are indicating they may have enough votes to override a Presidential veto. (We'll believe it when we see it.);

• Meanwhile, our Constitutional Crisis continues, as the White House has now instructed former White House Communications Director Hope Hicks and former White House Counsel Chief of Staff Annie Donaldson to defy a Congressional subpoena for documents by claiming Executive Privilege over materials that have already been shared with Special Counsel Robert Mueller (and thus, have already had Privilege waived). With the persistent drumbeat calling for an official impeachment inquiry growing louder each day against the scofflaw President while the White House fights "all of the subpoenas" as per Trump's instructions, Democrats are preparing a number of votes in a number of Committees to hold current and former Administration members in contempt. In addition to possible votes of contempt in a number of committees, Dems have votes scheduled next week for the full House to declare both Attorney General William Barr and former White House Counsel Don McGahn in contempt;

• In 2020 Presidential election news today, Joe Biden released a 22-page, $5 trillion climate plan that includes $1.7 trillion in federal spending over the next ten years, to be paid for by reversing the GOP's 2017 $1.5 trillion tax cut and ending subsidies for fossil fuel companies. We share Biden's introductory video for the plan, which vows to create millions of jobs and protect the retirement and pensions of fossil fuel industry workers. And we compare it to those of other 2020 candidates, including Elizabeth Warren who released her own "aggressive" $2 trillion plan to take on our climate crisis today as well. Biden's new proposal to make America carbon neutral by 2050 is receiving mostly high marks from environmentalists and comes in the wake of a much-derided recently reported comment from a campaign spokesperson claiming that the former Vice President was seeking a "middle ground" on climate that might be joined by Republicans. Climate hawks and supporters of Rep. Alexandria Ocasio-Cortez' Green New Deal resolution characterized Biden's new proposal as an encouraging response to activism and pushback from their ranks;

• Finally, Desi Doyen joins us for our latest Green News Report, with news of Republican obstructionism finally giving way to a long-awaited $19 billion disaster relief package in Congress, the Trump Administration's newest scam to try and suppress climate science, Colorado's new plan to go big on renewable energy, and....yes...the Administration's promise of "freedom gas" for the world!...

We're happy to have the long-overdue return of great legal journalist MARK JOSEPH STERN of Slate on today's BradCast! As usual, we cover a whole bunch of important topics at lightning speed [Audio link to today's show is posted at end of article.]

But first, some quick news headlines on the record flooding of the Missouri River now wreaking havoc, evacuations and several deaths in parts of Nebraska, Iowa and Missouri. Damage has also affected a number of military bases, despite Donald Trump's recent plans to form a "Blue Ribbon Commission" of climate science deniers to rebut military assessments about the serious dangers of climate change posed to national security and military facilities.

Also, some interesting background info today on 2020 Democratic Presidential primary candidate Pete Buttigieg, Mayor of South Bend, Indiana as well as his position on climate change and the Green New Deal. And, some news today that recently-declared 2020 Presidential hopeful Beto O'Rourke raised a jaw-dropping $6.1 million in the first 24 hours after entering the race last week, exceeding Bernie Sanders' previous record haul of $5.9 million a few weeks earlier. Both candidates blew away all other current Democratic contenders so far with those numbers --- for what it's worth.

Then, we're joined by Stern to catch up on a boatload noteworthy legal issues moving through the federal and state court systems. Among them...

The 5th U.S. Circuit Court of Appeals, late last week, upheld lower court rulings ordering a State Senate district in Mississippi found to have been a racial gerrymander to be redrawn before the state's off-year 2019 elections. That, as the U.S. Supreme Court today heard a confusing oral argument regarding 11 racially gerrymandering districts in Virginia, where lower courts have already ordered new maps to be drawn in advance of 2019 state legislative elections likely to determine whether Democrats regain majorities in either or both chambers of the state legislature.

And all of that comes in advance of a SCOTUS hearing next week regarding partisan gerrymanders in several others states before the 2020 elections, when control of both Congress and many state legislatures will be up for grabs before the redistricting that will follow the 2020 Census to help determine balances of power in all 50 states and Congress for the next decade.

Stern describes all of this as the nation finding itself in the middle of an all-out "gerrymandering brawl...a kind of legal convulsion over how much our lawmakers can draw partisan district lines to swing elections in their favor." He cautions that racial gerrymanders --- long ago found to be unconstitutional --- may not be found as such anymore in the GOP's new, stolen Court. And that the question of partisan gerrymandering, which Justice Anthony Kennedy could have ended before retiring, is now a complete unknown. "The whole thing is upside-down, inside-out," he tells me, warning to "be afraid. Be very afraid" of Justice Clarence Thomas' varying and bizarre "back and forth" positions on these matters.

Stern offers slightly better news for us regarding the last-ditch appeal of a previously blocked law created by disgraced GOP "voter fraud" fraudster Kris Kobach, the former Sec. of State of Kansas and failed 2018 Republican Gubernatorial candidate. That law, repeatedly found by lower courts to be unconstitutional, had blocked tens of thousands of legal Kansas voters from being able to register to vote without presenting proof of citizenship first. All, as the trial court judge found in 2016, to prevent what amounted to 11 votes by non-citizens cast between 1999 and 2013 out of tens of millions of votes cast by the state's 1.76 million registered voters.

Meanwhile, in Connecticut late last week, the state's Supreme Court made what Stern describes as a "stunning" ruling in a suit brought by parents of children killed in the 2012 gun massacre at Sandy Hook Elementary School. The case is filed against gun manufacturer Remington, makers of the Bushmaster AR-15 style weapon used to gun down 20 school kids and 6 adults. The court held, as Stern explains, that plaintiffs may move forward with their suit against the company, despite a unique federal law that otherwise grants completely immunity to gun manufacturers for the use of their deadly products. The suit is being brought under a state statute which, plaintiffs argue, allows them to sue Remington for irresponsibly dangerous advertising of the Bushmaster rifle. The state high court's ruling will now allow the case to continue and for plaintiffs' important discovery access to internal communications by the manufacturer, the gun industry and its advertising firms.

We also discuss a recent disturbing ruling from the 6th U.S. Circuit Court of Appeals on an Ohio state GOP law that blocks all funding to Planned Parenthood. Stern describes the ruling as a foreboding omen for what he sees as the likely full dismantling of Roe v. Wade at SCOTUS, already under way, he charges, by "a thousand cuts" at the lower court level in several states where Trump appointees are quickly filling vacancies on federal benches.

And, finally, the most important issue of all today (obviously): "The evils of Standard Time", the awesomeness of Daylight Saving Time, and those who are completely wrong in hating it, as well as the many, as Stern recently reported, who do not seem to even have an understanding of what it is! (Versus Standard Time that actually ruins everybody's lives for months on end by keeping us all in dangerous and debilitating darkness all winter long!)...

Among those many stories...

• Oregon U.S. Sen. Jeff Merkley, former NYC Mayor Michael Bloomberg and former Senator, Sec. of State and 2016 nominee Hillary Clinton all announce they will not be running for the Democratic Presidential nomination in 2020. That's mostly good news, as we discuss;

• A southern Indiana election board is considering using hand-marked and hand-COUNTED paper ballots in an upcoming local primary election. That's definitely good news;

• North Carolina's State Board of Elections announces the dates for the redo election(s) in the state's 2018 U.S. House race for the 9th Congressional District. The first one was nullified a week or so ago, due to Republican absentee ballot election fraud by a GOP contractor on behalf of the disgraced candidate and Baptist preacher Mark Harris. The Democratic candidate, Marine vet and businessman Dan McCready, has already announced he will be running again, and only one Republican, so far, has announced his intention to run in the do-over contest. That one candidate, Union County Commissioner Stony Rushing --- endorsed by Harris (ouch) --- turns out to be a real peach, as we explain with some help from Daily Kos' Jeff Singer;

• Also in NC, the judge who nullified two state Constitutional Amendments, one of which would have imposed disenfranchising Photo ID voting restrictions, stands by his recent ruling to nix the measures on the basis that the state legislature that placed them on the ballot had been "illegally constituted" by unlawful racial gerrymanders in several NC legislative districts;

• And, speaking of GOP election fraud, in Virginia, the criminal investigation into (now-former) Republican Rep. Scott Taylor and his paid campaign staffers who forged petition signatures to place an independent candidate on the ballot in 2018, continues. The GOP scheme, exposed before the election last year, included what a judge described as "out-and-out fraud" via forged signatures from people who had long ago died or moved. The failed scheme was meant by the Republicans to dilute the votes of Taylor's Democratic challenger, now-freshman Rep. Elaine Luria, in VA's 2nd U.S. House District;

• A huge majority of American voters now believe, 64 to 24%, that Donald Trump committed crimes before becoming President, with a smaller plurality believing he also has committed crimes since becoming President, according to new polling from Quinnipiac.

• Meanwhile, Trump characterized the new House majority Democrats' several burgeoning investigations into his and his associates myriad apparent crimes as a "big, fat, fishing expedition", "PRESIDENTIAL HARASSMENT!", "nonsense" and "a disgrace to our country" today. He charged the "real crime is what the Dems are doing." But, as we discuss today, the long, LONG overdue exercise of Congressional oversight into an unprecedentedly corrupt Presidency is anything but. We list an astonishing number of potential crimes now under the Democrats' microscope thanks to the House Judiciary Committee's massive document requests sent Monday to more than 80 Trump associates, family members, organizations and institutions. That, as we also note, is just the tip of the iceberg for what is still to come, thanks to voters who put Democrats back in charge in the House last November;

• Finally, Desi Doyen joins us for our latest Green News Report with tragic news out of Alabama, stupid news out of CPAC, and important news at the EPA and from the latest Democratic candidates entering the 2020 Presidential contest...

On today's BradCast: It seems like we've been here before. Donald Trump is out lying about his border wall, Congress is days away from another potential government shutdown over Trump's demands, and various scandals continue to rock Virginia's elected Democratic leadership with calls for resignations both continuing and waning. [Audio link to show is posted below.]

Among the stories covered on today's show...

• During his State of the Union address, Trump offered false assertions about a border fence in El Paso, Texas, claiming it turned the state from one of the most dangerous cities in the country to one of the safest. The assertions have been debunked and re-debunked over and again since then by, among others, El Paso's sheriff and the city's mayor. Nonetheless, the President is holding a campaign rally in El Paso on Monday to repeat the lies;

• Potential Democratic 2020 Presidential candidate Beto O'Rourke --- whose hometown is El Paso --- holds a rally at the same time as Trump's to debunk the lies, after more Democrats (Senators Elizabeth Warren of MA and Amy Klobuchar of MN) announced their intention over the weekend to run for President;

• Congressional negotiations teetered on the edge of disaster over the weekend, as Republicans and Democrats work to avoid yet another federal government shutdown as of this Friday at midnight. That, even as many federal employees furloughed or working without pay during the previous shutdown that ended just two weeks ago are still waiting to be fully paid;

• Meanwhile, in Virginia, Lt. Gov. Justin Fairfax insists he has no plan to resign, even after a second accuser stepped forward on Friday to charge that he sexually assaulted her in the early 2000s when they were undergrad students. Fairfax is demanding "due process" in the form of, among other things, an FBI investigation into the serious allegations which he maintains were consensual incidents;

• At the same time, Virginia's Governor Ralph Northam insists he will not resign either, following the revelation of a racist photo published on his medical school yearbook in 1984, which he says he knew nothing about until it was recently publicized by a Rightwing website. Following fierce calls for Northam to resign last week and subsequent concerns about Fairfax's own fitness for office (he is next in line to succeed Northam if he steps down), some African-American leaders in the commonwealth have announced they have forgiven Northam and are calling for him to remain in office and make amends by working on policy and legislation important to the black community. Also, new polling reveals that a large majority of African-American voters in the state do not want Northam to step down;

• Also, I'm sad to report, iconoclastic Rep. Walter Jones (R-NC) died Sunday, on his 76th birthday.

And, with all of those messes continuing concurrently, we open the phone lines today and receive some --- um --- fairly wild calls, including one from someone who claims to be black, but is calling for segregation in the U.S. (yes, really) and another from a guy who insists Trump should get due credit for a booming economy. (I disagree.)

On today's BradCast: Yes, Virginia, there is a problem with race (and hate) in the Commonwealth. But Democrats would be wise to take a breath and notice what's really going on there before making critical political decisions out of fear. [Audio link to show follows below.]

The media are all over the astonishing crisis that has overtaken VA state politics in the past week, since a Republican website revealed a racist photo on Governor Ralph Northam's 1984 yearbook page, and a serious sexual assault allegation leveled against Lt. Governor Justin Fairfax, while Attorney General Mark Herring subsequently announced that he had donned blackface while dressing as one of his favorite rappers for a party 40 years ago when he was 19. The political futures of all three Democrats now hang precariously in the balance, with top Dems (and media elite) both inside and outside of VA demanding Northam resign, despite the complete lack of evidence to suggest he is a racist in the 35 years since the photo was published. As we discussed on Monday's program, Northam claims he knew nothing about the photo until last week, as he hadn't purchased the yearbook.

But with Fairfax --- an African-American and first in line to succeed the Governor, should he step down --- facing a serious assault allegation (which he has repeatedly denied) and some calls for Herring --- second in the line of succession --- to step down, echoing those leveled against the Governor, the next state official in the line of succession is Republican House of Delegates Speaker Kirk Cox.

Cox is in that role, thanks only to a questionably "tied" Delegate election in 2017 that left the GOP in control of the House, after a Republican election judge changed his mind in order to create the tie, and a subsequent lot was drawn from a ceramic bowl to break it.

Far more notably, and far less reported, is that a decade of unconstitutionally gerrymandered House of Delegates districts drawn by the GOP to dilute the voting power of African-Americans gave Republicans as many as 8 more delegates in the House than they likely would have won with fair districts. One of those districts was "won" by Speaker Cox himself, according to a new district map ordered for use in this year's 2019 House elections by a panel of federal judges just weeks ago. Without the racial gerrymander, he likely wouldn't be in the House at all, much less in a position to become the next Governor, replacing a guy who admitted only that he put shoe polish on his face to dress as Michael Jackson in a dance contest 25 years ago.

We break down the entire mess today to, hopefully, shed some light on the FULL story of what's going on there, and how Democrats' fearful and breathless rush to avoid charges of hypocrisy may be serving to simply do themselves in for no good or even smart reason.

Also today: Republicans are freaking out about wildly popular ideas such as increasing taxes on the wealthy and a "Green New Deal" (a resolution officially introduced today by Democratic freshman Rep. Congresswoman Alexandria Ocasio-Cortez [D-NY] and veteran Senator Ed Markey [D-MA]). They are so alarmed that over at Fox "News", anchors are describing increased taxes on rich people as an attack on Capitalism itself, and programs like the Green New Deal as "Venezuela-styled socialism". But the laugh out loud part is when one wingnut Fox personality explains why, he claims, that such programs are now so popular among voters of all political persuasions. AOC's Twitter response was priceless.

On today's BradCast, should Virginia's Democratic Governor Ralph Northam resign after his 1984 medical school yearbook was revealed late last week to have featured a photo of a man in blackface standing next to a man in a KKK costume? Don't answer that too quickly. Or, at least listen to today's show first. [Audio link to show follows below.]

After apologizing on Friday night for the appearance of the photo --- calling it "clearly racist and offensive", but failing to specify which of the pictured two men he actually was --- the Governor said at a bizarre Saturday press conference that he was neither man and that he had never even seen the photograph before, since he hadn't purchased that year's yearbook. He says the photograph hit him "like a ton of bricks" on Friday night. However, he told the media that he did remember an instance around the same time when he darkened his face to dress up as Michael Jackson for a dance contest. He said he remembered the contest outfit very specifically, discussing it publicly for the first time on Saturday, while insisting that he never recalls dressing up in either minstrel show blackface or as a Klansman, as depicted in the mystery photograph.

One of the two African-Americans in the same medical school class that graduated with Northam told AP the explanation is plausible, as he didn't purchase the yearbook either and found the racist photo on Northam's page to be out of character. Despite Northam's record of working closely with the African-American community and still being a member of a predominately black church in the town where he grew up, top Democrats from Virginia to D.C. and beyond continued their loud calls on Sunday for him to step down and allow his Lt. Gov. Justin Fairfax --- an African-American Democrat --- to replace him.

But should he? And should he be shunned for something that may have never happened? Or, if it did, happened 35 years ago and appears completely inconsistent with his record since then? The answers to those questions are both "absolutely yes" and "no, not so fast", as we discuss with callers today, focusing on Northam's remarks at the strange, yet seemingly earnest Saturday presser in which he stated that acquiescing to calls to step down would allow him to "spare myself from the difficult path that lies ahead," adding: "I could avoid an honest conversation about harmful actions from my past. I cannot in good conscience choose the path that would be easier for me."

We endeavor to have a least part of that "honest conversation" with tons of callers on today's program, including some discussion about key civil rights figures (from Lincoln to Justice Hugo Black to LBJ) whose own histories of racism arguably allowed them to lead on a number of landmark civil rights issues from Emancipation to Brown v. Board of Education to the Civil Rights of 1964 and Voting Rights Act of 1965.

Also today: While I was happy to see MSNBC, on Friday night, highlight a Super Bowl ad buy in Georgia markets by former Democratic gubernatorial candidate Stacey Abrams' voting rights group Fair Fight, calling for "hand-counted paper ballots," the news outlet's Rachel Maddow Show maddeningly cut the :30 commercial off when reporting the story, just before the crucial line calling for "hand-marked paper ballots"! (Made, in the spot, by Republican Commissioner of Habersham County, GA Natalie Crawford, by the way.) Maddening. Especially since, unless the voters rise up to protect overseeable elections and stop them, the state of Georgia, along with counties in key states like Ohio, Pennsylvania, and Texas --- not to mention Los Angeles County and neighboring Ventura County! --- are all now planning moves to expensive, unauditable touchscreen Ballot Marking Devices (BMDs) before the 2020 Presidential election. Those systems print out computer-marked and barcoded paper ballots which are 100% unverifiable after an election has ended.

Add MSNBC's failure there to a list of disappointments over the weekend from the mess in Virginia to the loss of the L.A. Rams at the Super Bowl...

Donald Trump's tantrums and partial federal government shutdown continue on today's BradCast, with no end in sight for either of them. [Audio link for today's show follows below.]

On Tuesday night and again on Wednesday, Democratic Senate Minority Leader Chuck Schumer accused Donald Trump of governing "by temper tantrum". The first reference came in Tuesday's Democratic response, with House Speaker Nancy Pelosi, to Trump's televised prime-time Oval Office address meant to gain public support for his demand of $5.7 billion for a southern border wall. The money is needed, Trump claims, to respond to what he described during his 9-minute speech as an immigration and humanitarian "crisis". But the address offered no new policies or information and, at times, parroted word-for-word rightwing anti-immigration, pro-wall commentary from Sean Hannity and Lou Dobbs' programs on Fox 'News'.

The second reference to a Trump "tantrum" came today after the President reportedly stormed out of a White House negotiation meeting with Congressional Democrats as the partial federal government shutdown over funding for his wall continues in its third week. The cost of that shutdown to some 800,000 federal workers is rapidly intensifying. Paychecks will not be issued this week for many workers who are already facing extraordinary hardship thanks to the shutdown which Trump has threatened to continue for "months or even years" unless Democrats agree to his border wall demand.

But, if nothing new was offered in his Tuesday night prime-time address, why did the television networks agree to clear the time for him to litter our public airwaves with false claims and long-ago debunked propaganda? Particularly since the same networks refused President Obama's request to air his own remarks on actual new immigration policy back in 2014?

We're joined today by Media Matters' Senior Fellow MATT GERTZ who charges that the "networks got played." He describes their capitulation to Trump as "cowardly" with the result being "exactly what we said was going to happen: the President used the time to lie to the public."

"I don't understand why there's such an urgency to just put the President on television when all of the people involved in producing the news know that he's a liar who is going to lie," he tells me. "It's the most predictable thing in American politics right now --- if the President is talking, he's lying."

So why did the networks give up that valuable airtime to allow it to happen? And, were the attempts by media outlets at debunking and fact-checking Trump's false claims during or after the speech actual helpful to the public? We discuss that and the larger challenge for media: "How do you respond to a President who is deliberately deceptive and is constantly trying to make people believe in a reality that is different from the actual one?"

Also today: The 2018 electoral 'blue wave' continues into 2019, as Dems in Virginia win very big (by 40 points!) in the first Special Election of the year. And Donald Trump announces, via misspelled tweet, that he is cutting off FEMA wildfire recovery aid to California, following the worst and most deadly fires in state history. Whether he will follow through with that threat is a separate question, of course, and his absurd explanation as to why he claims to be doing it is, as usual, nonsense...

The effects of the federal government's partial shutdown, now in its third week, continue to worsen, even as the effects of last year's 'blue wave' election continue to make things much better for Americans across the country. Among the stories covered on today's BradCast [audio link is posted below]...

• The shutdown is causing "a mess" for potentially tens of thousands of American families who live in properties subsidized by the Dept. of Housing and Urban Development. They may soon face rent increases or eviction due to HUD's failure to renew thousands of contracts before and during the agency's closure;

• Vice President Mike Pence made the media rounds in advance of Trump's Tuesday night prime-time Oval Office remarks (which TV networks didn't allow for Obama), in hopes of drumming up support for the Administration's false claim there is a national security crisis on the border which may precipitate a Presidential declaration of a "national emergency". Pence offered a number of false claims in the bargain, which even some GOPers were scoffing at today;

• With Trump having boxed himself into this protracted shutdown mess, a "national emergency" declaration may be his only face-saving way out of it. It would likely result in Republicans allowing a vote in the Senate for reopening the government, even as the declaration would face court challenges over its legality and, essentially, do little more than steal tax-payer money from national defense as U.S. troops are tasked with building Trump's southern border wall;

• The U.S. Supreme Court has decided to hear two partisan gerrymandering cases this session (from Maryland and North Carolina), which may not be good news following the retirement of Justice Anthony Kennedy;

• But, in better news from SCOTUS today, the Court rejected a plea from Virginia Republicans to delay a lower-court mandated remapping of districts for its House of Delegates in advance of this November's off-year legislative elections in the state. Twelve of those districts were previously found by the lower court to be unconstitutional racial gerrymanders;

• Meanwhile, last year's midterm 'blue wave' is already yielding dividends for the nation. In Maine, the nation's dumbest now-thankfully-former Governor Paul LePage certified what he declared to be a "stolen election" for the U.S. House on his way out the door, and the state's new Democratic Governor Janet Mills signed legislation on her first day on the job that will finally give access to healthcare to some 70,000 Mainers under the Affordable Care Act (Obamacare) Medicaid Expansion that had been blocked for some eight years by the former Republican Governor;

• And, in further good news following last year's midterms, Florida's Amendment 4, adopted by nearly 65 percent of voters in November, kicked in on Tuesday to allow as many as 1.4 million former felons the right to vote in a state that is notorious for its close elections. Despite claims by some Republicans that "implementing language" may need to be enacted, County Supervisors of Elections began allowing registrations under the new Amendment for most former felons who have served their time. The result could be a sea change for the state in 2020, not to mention for the rest of the nation where Florida's electoral votes are key to Presidential elections;

• Finally, Desi Doyen joins us for the first Green News Report of 2019, where last year's 'blue wave' is also being positively felt on the environmental front at both the state and federal level, even as Trump's shutdown is trashing national parks and blocking important scientific research...

On today's BradCast: Debunking the myth of "secure" Internet Voting schemes --- even with "blockchain" technology --- as West Virginia allows overseas military voters to use their mobile phones to vote for the first time in a general election. What could possibly go wrong? [Audio link to show follows below.]

But first up today, plenty is already going wrong for voters hoping to participate in midterm elections, whether via hand-marked paper ballot or, as in Georgia, where early voting began this week, on 100% unverifiable touchscreen voting systems at the polling place. We've been closely following voting in the Peach State recently, given the many voter suppression schemes that have come to light in the state this year, such as the recent purging of hundreds of thousands of voters from the rolls, the suspensions of more than 50,000 registrations for failing to exactly match names or addresses, down to the letter or punctuation, and an abnormally high rate of rejected absentee mail-in ballots.

Thus, it was disturbing to see a busload of elderly African-Americans from a county-run senior center blocked from voting on Monday (someone didn't like the "Black Voters Matter" bus they were using) in Jefferson County, and three-hour long lines to vote near Atlanta, on just the third official day of advance voting in the state. While some may see the reportedly huge early turnout as good news, there are also reasons to be concerned that state election officials, led by Republican Sec. of State and Gubernatorial candidate Brian Kemp, are under-prepared for what could be enormous turnout on Election Day. Several new lawsuits have now been filed against Kemp charging racially discriminatory election practices, as his race for Governor against Democrat Stacey Abrams, an African-American, is believed to be very tight.

Meanwhile, in North Dakota, Native American voting rights advocates say they will be posted outside of polling places with laptop computers in hand, ready to assign official addresses and new Tribal IDs to thousands of Native Americans who will now not otherwise be allowed to vote. The effort is in response to a U.S. Supreme Court ruling last week which permitted a last minute change to ID requirements sought by state Republicans hoping to unseat Democratic U.S. Senator Heidi Heitkamp this year. Some 5,000 voters who live on tribal reservations using P.O. boxes, rather than street addresses, are now blocked from voting under the new law, enacted in the wake of Heitkamp's 2012 victory by less than 3,000 votes.

But in West Virginia, officials believe they've got a sure-fire way to make sure overseas military voters are able to cast votes this year: Internet Voting via smartphone! The state is the first in the nation to allow such voters to cast a ballot via smartphone --- on a mobile app called Voatz, created by a private Boston-based technology firm --- in a live (and crucial!) general election. But, don't worry! The state and the Voatz company are quick to claim that their scheme is completely secure, since it "employs blockchain technology to ensure that, once submitted, votes are verified and immutably stored on multiple, geographically diverse verifying servers."

Blockchain, in short, is a widely distributed public ledger, or database, that is used to track Bitcoin and other cryptocurrencies. But, as long time voting system expert and Internet Voting critic DR. DAVID JEFFERSON of Livermore National Laboratory and of Verified Voting explains on today's show, the technology solves none of the many problems with using the Internet to cast votes in American elections, as he recently detailed at the non-partisan Verified Voting site.

Jefferson, an internationally recognized expert on voting systems and elections technology, has spent much of the past two decades advising five successive California Secretaries of State on voting technology. He has also been instrumental in helping to block a number of attempted Internet Voting schemes, including one he helped analyze (and stop in its tracks) as devised by the Pentagon during the George W. Bush era.

Today, he explains why use of blockchain technology, which he describes as a "fad", fails to make the Internet any more secure or auditable when it comes to American democratic elections. "All of the most serious threats to Internet voting occur before the ballot even ever gets back to the database or the blockchain," he tells me, detailing how malware on smartphones can change votes, how the authentication of the voter is also endangered by the use of such schemes and how, despite claims to the contrary by advocates of such technologies, the accuracy of results based on votes cast via the Internet can never be audited by the public after an election.

He's hardly the only technologist to decry the scheme. TechCrunch for example, recently called the Voatz app "a terrible, horrible, no-good, very bad idea", and Vanity Fair cited experts who describe the plan as a "horrifically bad idea". But, none of that has stopped either WV or Voatz from pressing ahead, even with this year's midterms (and potentially control of the U.S. House and Senate) on the line.

"The blockchain back end of it doesn't do anything more to secure an election than any of the other technologies do," Jefferson argues. "It doesn't even play a role until the very last stage of balloting --- after you've authenticated yourself, after you've made your ballot choices, after you've transmitted them back, only then does the blockchain play any role." And by then, he says, your vote may have been tampered with, and it's unlikely that you or anybody else would ever know.

"What if there is malware on the phone or the computer that the person is voting from? Malware that is exposing the person's vote to some third party, or is modifying the vote, or is just throwing the vote away without telling the voter, making him think he's voted but he hasn't voted. That malware is not affected by, and cannot be detected by, the blockchain or the back end at all."

"That vote may be blocked or thrown away, or otherwise disturbed by a denial of service attack, for example, on the server. A blockchain server is no more invulnerable to a denial of service attack than any other service," he warns, adding "there just isn't any possibility of auditability in any online voting system, and blockchains don't change that fact."

Jefferson's preferred technology for elections: "Hand-marked paper ballots." He details why on today's program, and also notes that newer technologies, such as Ballot Marking Devices (BMDs) that require voters to use touchscreen computers to print out their selections on a paper ballot --- which many jurisdictions (including Los Angeles, the largest in the nation) are moving towards --- present similar dangers when it comes to the authentication and public auditability of election results.

"I endorse your idea that if you're going to vote in person at the precinct, the best system is to use is hand-mark a paper ballot," he explains near the end of our conversation, allowing --- as I do --- that some voters may need assistive technology to vote, but that most voters do not. And worse, as we saw today at early voting cites near Atlanta, when computers are needed to vote, it can result in long lines and suppressed votes at the precinct.

"Only three or four voters per precinct can be voting simultaneously when you only have three or four ballot marking devices. With hand-marked paper ballots, you can get twenty voters voting in parallel if you have cardboard privacy booths around, and twenty cheap pencils. There are far fewer lines built up, and the cost is so radically reduced."

Finally today, a word or two from some older voters who would really REALLY prefer if young people did not bother to vote at all this year...

On today's BradCast: A multitude of terrifying threats from Hurricane Florence loom large across at least four states in the Southeast, as millions of Americans hunker down or evacuate on the final week of primary elections in the U.S. before the crucial 2018 midterm elections. [Audio link to show follows below.]

First up, after a quick warning to ignore the President of the United State's assertion that the federal government is "totally prepared" for the damage that awaits the still-growing Hurricane Florence (while citing his Administration's response to last year's Hurricane Maria that killed nearly 3,000 citizens in Puerto Rico as "an incredible unsung success"), we head to New Hampshire for the penultimate federal primaries of the season. (Rhode Island voted today and New York holds state and local primaries on Thursday.)

On Tuesday, voters in the Granite State went to the polls with, happily, few problems reported so far, beyond the larger than anticipated turnout, particularly in a number of the state's many college towns. That may signal good news for Democrats, at least until the state GOP's new law making it much harder for college students to register to vote kicks in in 2019 (unless its blocked by courts before then). We fill you in on the noteworthy reported results today, including the single mom, Molly Kelly, who won the Democratic primary for Governor, the openly gay man, Chris Pappas, who defeated 10 other Democrats (including Bernie Sanders' son) to win the U.S. House nomination in one of the swingiest swing districts in the country, and 27-year old refugee from Afghanistan, Safiya Wazir, who unseated a four-term incumbent Democrat and appears poised to become a NH state Representative just 9 years after leaving her war-torn country for a better life in these United States.

Then, all eyes (pun intended) on the disturbing amount of cyclonic activity churning across the globe --- not just off the Eastern U.S. seaboard --- at the peak of hurricane season. The "monster" storm, Hurricane Florence grew in size today, as its movement continues to slow, and as it's trajectory appears to have taken a slight turn toward the southwest. The storm's brutal winds, surging waters and threat of days of unforgiving rainfall, now pose a grave threat to some 10 million residents of North Carolina, South Carolina, Virginia, and, as of Wednesday's latest predictions, Georgia.

But, while Florence may be the fiercest and most immediate threat to Americans, it's hardly the only storm worth keep an eye on, as nine --- count 'em --- nine storms across the globe are now either hurricanes, typhoons, tropical storms or depressions, or otherwise threatening to become one of the above at any moment. Among the most immediate non-Florence threats are Tropical Storm Olivia, slamming into Hawaii today (just two weeks or so following Hurricane Lane's record 50 inches of rainfall dumped on some parts of the island), Category 5 Typhoon Mangkhut, which just slammed Guam and now heads toward The Philippines and Hong Kong, and another storm currently brewing in the record warm Gulf of Mexico waters that could visit Texas and/or Louisiana by this weekend, even as Florence wreaks its own separate havoc on the East Coast. (Is Trump's FEMA "totally prepared" for all of that also?)

According to our guest today, 30-year veteran Weather Channel meteorologist, "Climate Guy" GUY WALTON this amount of cyclonic activity is not normal, and much of it is attributable to warming waters and highly unusual weather patterns in a climate-changed world.

"As you get more heat, you'll get more storms, and that's exactly what we're seeing," says Walton who points to sub-tropical storm Joyce, which was just named today, taking its place along with Hurricanes Helene and Isaac behind Florence in the Atlantic. "That will make four in the Atlantic basin alone. And if you look at the Gulf of Mexico, there could be a potential fifth, I guess named Kirk. If we have five simultaneous named systems in the Atlantic basin, that would be a record."

As to Florence, he warns: "Meteorologically, the greatest concern is the slowing of the storm and stalling right off the Carolina coast, right around Wilmington, and then very, very slowly moving south or southwest back towards Charleston. If that's the case, you could have winds and waves for many, many hours, if not for two or three days, just lashing at the shore. And that could produce more damage than, say, a Category 4 Hugo," in 1989, which killed 27 in South Carolina, left nearly 100,000 homeless and wreaked nearly $10 billion in damage.

"These things usually move northeast, they don't move southwest or west. If it does, that would be highly unusual. And devastating," he tells me.

Walton explains how climate change-fueled weather patterns are resulting in slower moving storms causing much more rainfall and flooding in recent years and why he believes some broadcast meteorologists --- versus climatologists --- are still either climate deniers or simply fail to connect the dots of increasingly extreme weather to global warming. He also discusses his upcoming children's book on climate, with Nick Walker, The World of Thermo: Thermometer Rising.

Finally today, we bounce off of Will Bunch at the Philadelphia Daily News today with a few thoughts on talking about the rapidly increasing dangers of climate change, even while a major storm imperils millions of American citizens. As Bunch observes, many of them live in southern states with political leadership that has ill-served their residents by lying to them about climate change science over a shameful number of years, even as they now find themselves at the center of some of its most threatening and deadly effects...

We catch up with quite a bit on today's BradCast, after being buried for much of last week in the U.S. Senate Judiciary Committee hearings for dishonest and disingenuous GOP operative, Judge Brett Kavanaugh, as Donald Trump's pick to replace Justice Anthony Kennedy in the "swing vote" seat on the GOP's already-stolen U.S. Supreme Court. We discuss that as well today (and whether Democrats should pack the Court if they ever return to power, as we discussed with David Faris on last Wednesday's show) and much more with tons of callers.

But first, we lead off with the latest on the fearsome Category 4 Hurricane Florence now barreling toward the U.S. Eastern seaboard, fueled by record warm waters, and currently projected to slam the Carolinas with, potentially, as much as four feet of rain as the storm is predicted to stall near the coast.

At the same time, Hawaii is facing down Hurricane Tropical Storm Olivia this week, just two weeks or so after Hurricane Lane dumped record rainfall on the islands, in the second worst rainfall event in recorded U.S. history (second only to Hurricane Harvey in Houston just last year.)

We also have some much brighter news, however, for our climate-changed world out of California today, as Gov. Jerry Brown signed SB-100, a landmark measure to require the state (with the world's fifth largest economy) to transition to 100 percent carbon-free electricity by 2045. Along with it, Brown also signed an executive order that would result in carbon-neutral energy production and use for the entire state (including cars!) by 2045 as well!

With that bit of brief, albeit very good news out of the way, we turn to catching up with an Administration (still) in crisis upon the release of Bob Woodward's new book, FEAR: Trump in the White House and the anonymous op-ed purported to have been penned by a senior Trump Administration official last week, claiming that senior insiders have been secretly blocking the worst of Trump's most dangerous impulses and, last year, even considered invoking the 25th Amendment to remove the President.

We open up the phone lines today to all of the above, for tons of interesting thoughts from listeners on the op-ed (is the writer a hero or a coward --- or a scammer?), the Kavanaugh hearings and the Democrats' surprisingly unified response to the GOP rush to confirm him before they may lose their slim Senate majority in the upcoming midterms, and much more, as Hurricane Donald continues to lay waste --- or, at least, tries to --- to much of our nation...

Everything --- EVERYTHING --- is not normal right now. From an imploding Presidency to the GOP's unprecedented withholding of documents for a SCOTUS nominee, to the more "normal" abnormalities we've become shamefully accustomed to, like mass shootings, election fraud and voter suppression in advance of another huge election and, yes, a global climate in crisis. Among the related stories covered on today's very busy BradCast [Audio link to show follows below.]...

• At least four were killed, including the shooter, in another mass shooting today, this time in downtown Cincinnati. Shamefully, the bloodbath barely cracks today's national headlines."This is not normal, and it shouldn't be viewed as normal. This is abnormal. No other industrialized country has this level of active multiple shootings on a regular basis," Cincinnati Mayor John Cranley said at a news conference today;

• It was day 3 of U.S. Senate Judiciary Committee confirmation hearings for Judge Brett Kavanaugh, Donald Trump's nominee to the U.S. Supreme Court. Republicans continue to rush through his confirmation while withholding tens of thousands of documents from both the Senate and the public, leading Democratic U.S. Senators Cory Booker (NJ), Mazie Hirono (HI) and others today to risk expulsion by releasing several "committee confidential" documents which are being withheld from the public. The documents being withheld, as suggested by several of the Senators, either reflect poorly on Kavanaugh or show him as having misled Congress in previous Senate testimony during his years as a George W. Bush staffer. "We are in uncharted and unprecedented territory here that the process has broken down, reflecting what is happening in our nation generally," warned Sen. Richard Blumenthal (CT);

• The White House is reported to be in "total meltdown" and the President "absolutely livid" after Wednesday's publication of a bombshell New York Times op-ed said to have been written by "a senior official in the Trump administration". The explosive piece claims the President is unstable, out of control, and that a group of Administration insiders have been working to contain the worst of his impulses. One top Administration official after another on Thursday denied penning the column, as Trump has suggested it to be "TREASON", called for the Times to turn over the writer's identity to "government at once", and as a former CIA Director (and Trump critic) John Brennan warns the situation is "dangerous" and "will get worse before [it] gets better."

Then, after a short remembrance for the late Burt Reynolds, who died today at 82, we move to the one thing Americans can and must do to try and restore a semblance of normality to the nation: participate in the November 6th midterm elections! To that end, we have several items of note regarding election integrity...

• In Texas, the 2018 dirty tricks are officially under way. An infiltrator into Rep. Beto O'Rourke (D)'s surging campaign to unseat Sen. Ted Cruz (R) used the campaign's text messaging system to send fraudulent messages regarding bringing "undocumented immigrants to polling booths" and "the dangers of socialism";

• In Michigan, two white, male, Republican-appointed federal appeals court judges overturned a lower court judge who, after a full trial, blocked the state GOP-majority legislature's ban on straight-ticket voting, finding the measure "a disproportionate burden on African Americans' right to vote". Both the lower court judge who previously blocked the measure and a third appeals court judge who dissented from her fellow appeals court panelists, were African-Americans appointed by a Democratic President. The U.S. Supreme Court, in the recent past, has blocked a host of court rulings that change election law just before elections, even when they might have protected thousands of voters from disenfranchisement. Will they step in to block this late federal court ruling?;

• In Virginia, Shaun Brown, an independent candidate for the U.S. House in the Commonwealth's 2nd Congressional District, was removed from the November ballot after a judge determined fraudulent petition signatures were used to place her on the ballot in hopes of peeling off votes from Democratic candidate Elaine Luria. Staffers from the office of first-term incumbent GOP Rep. Scott Taylor are said to have submitted many of those fraudulent signatures. Five of Taylor's staffers invoked the Fifth Amendment in the case, refusing to answer whether they were acting on Taylor's instructions. (We also take the opportunity to review just a few of the similar cases of election and signature petition fraud from former top GOP officials, such as Newt Gingrich, Thaddeus McCotter and Mitt Romney).

And, finally today, Desi Doyen joins us for our 900th(!) episode of the Green News Report! In which we cover the dangers posed by Kavanaugh to the environment as illustrated during his Senate confirmation hearings, and a round-up of the latest havoc being wreaked around the globe from our climate in crisis.

On today's BradCast: Details on the extraordinary court ruling out of North Carolina on Monday, and the judicial coup being staged in West Virginia. But first, voters went to the polls for Tuesday's primary elections in Arizona and Florida and in Oklahoma for primary runoff elections. It did not go well in Arizona. [Audio link to full show is posted below.]

Maricopa County (Phoenix)'s paper ballot optical-scan computer systems failed in at least 100 precincts, according to the County Recorder. Many polling places were closed entirely this morning, and it was nearly noon before the systems were said to finally be working in all precincts. It's still unclear what the precise failure was, but the new County Recorder Adrian Fontes (who won his election after the previous, long-time Recorder was booted out for shutting polling places during the 2016 Primaries), tied it to pre-election tests that failed on Monday, and then a lack of contractors from the voting machine company (Dominion Voting) on hand to properly set up the systems before polls were to open today. "The contractor responsible for the voting machines was supposed to provide more than 100 technicians to assist with issues, but only 70 were available," the Arizona Republic reports Fontes as telling them at a news conference this morning. If we learn more, of course, we'll share it on tomorrow's show along with noteworthy problems and results in all three states holding elections today.

Then, following up on a story that broke minutes before airtime on Monday, we're joined today by Slate's excellent legal reporter MARK JOSEPH STERN to detail the extraordinary ruling issued by a three judge federal court panel finding all of North Carolina's U.S. House districts --- for a second time --- to be partisan gerrymanders in violation of the U.S. Constitution. Remarkably, the judges are considering ordering new maps to be drawn up before this November's elections, after already having found last January that Republicans had unlawfully gerrymandered the state's U.S. House districts. That ruling, however, was appealed to the U.S. Supreme Court which punted in June by ordering the lower court to review matters of standing. After having done so, the three-judge panel found the same Constitutional infirmities.

"The real villain here, in a sense --- aside from the Republicans, who obviously drew these incredibly gerrymandered maps --- is the Supreme Court and Justice Anthony Kennedy," says Stern. "A virtually identical ruling came down in January, at which point the US Supreme Court could have and should have acted on this question of partisan gerrymandering. Instead, the Supreme Court punted [and] sent this case back down for reconsideration. Now the [lower] court has reached the same conclusion it did in January."

The map in question was the one drawn up in 2016 after the state's previous GOP-drawn map, used in 2012 and 2014, was found to have been an unlawful racial gerrymander. So, Stern explains, the federal judges in North Carolina seem to have had enough and may now order new maps "on this incredibly compressed timetable where the election is looming" in just over 70 days, ballots need to go out to overseas voters 45 days in advance, and the state's primaries were already been held in May.

The unconstitutional maps have resulted in a wildly unbalanced 10 to 3 GOP majority in the state's Congressional delegations, despite North Carolina's status as a very divided swing state which narrowly elected Obama in 2008, Trump in 2016, and a Democrat to be its Governor in that same election. If the matter is appealed to SCOTUS by the state (as it almost certainly will be), the Supremes could deadlock 4 to 4, if Justice Kennedy's seat has yet to be filled, and the lower court ruling would stand. We could be in for a lot of chaos ahead (as if we need any more this year.)

Stern also explains the astonishing situation in West Virginia, where that state's Republican-majority House of Delegates recently impeached all four sitting members of the state's Supreme Court. (Its 5th member had already resigned after been charged with a felony crime.) The move, Stern reports, was timed in such a way to avoid allowing voters to replace the justices at the ballot box this year. That means the previously 3 to 2 Democratic-leaning court may soon become a 5 to 0 Republican court, and stay that way through 2020. Following impeachment trials of the justices in the state Senate, any vacancies will be filled by the appointments of Trump-loving Republican Gov. Jim Justice, a Democrat when he ran and won the Governor's race in 2016, but who flipped parties shortly thereafter.

"There are no good guys, per se, in this story," Stern notes. However, it serves as yet another example of Republicans blatantly hoping to pack the courts, and could prove to be another useful example that Democrats could cite in the future. If they ever re-take control of the U.S. House, Senate and White House, they'll be able to cite such moves when and if they decide to move to add seats to the U.S. Supreme Court in order to restore a majority that should have been theirs, until Senate Republicans stole a vacant seat in 2017 after holding it open for nearly a year following the early 2016 death of Justice Antonin Scalia.

Speaking of that stolen U.S. Supreme Court, Stern also offers his thoughts on whether Senate Democrats will be able to block --- or even stall --- the seating of Donald Trump's second nominee to the Court. Judge Brett Kavanaugh's Senate Judiciary Confirmation hearings are currently scheduled to begin next week and, Stern argues, "he owes an explanation as to why he thinks it's perfectly valid and legitimate and acceptable to be nominated by a racist and openly corrupted President to the Supreme Court."

Finally, we're joined by Desi Doyen for our latest Green News Report on, among other things, the record rainfall in Hawaii following Hurricane Lane over the weekend, and the complicated climate legacy of the late Republican U.S. Senator and former GOP Presidential nominee, John McCain.

On today's BradCast, we have not one, but two important and separate warnings for Donald Trump and the Republican Party, as pulled from the deep audio archives of 1988. Both of which --- on two separate topics from two separate people --- they seem to be completely ignoring, even as one of those warnings comes from their supposed idol Ronald Reagan. [Audio link to show posted below.]

First up today, the Trump-caused child immigration crisis continues to unfold with several disturbing new reports of unspeakable abuse at two separate federally-contracted facilities, based on filings in new federal court cases. One from Associated Press on beatings and more at a youth facility in Virginia and the other from the Center for Investigative Reporting on the forced injection of psychotropic drugs at a facility near Houston. That, as an Executive Order signed by the President on Wednesday, reversing part of his Administration's policy, fails to speak to family reunification for more than 2,300 children separated from their parents in recent weeks under Trump's "zero tolerance" border policy, and an Administration request to the Pentagon for space to house some 20,000 migrant children.

While all of those American nightmares have been unfolding over the past week, the effects of Trump's growing trade war have been quietly playing out in the background, as the Dow has dropped some 600 points over the past four days, with China and friendly allies like Canada, Mexico and the EU vowing massive and swift retaliation for ill-considered tariff's on foreign imports instituted by Trump. Among the hardest-hit victims of his new trade wars: farmers who were among some of biggest supporters of Trump's candidacy in 2016.

Perhaps that explains why, as share in an audio clip from 1988 today, Ronald Reagan warned: "We should beware of the demagogues who are ready to declare a trade war...all while cynically waving the American flag."

Next, we're joined by MARK JOSEPH STERN, legal reporter at Slate, and our "Supreme Correspondent" this month, as the U.S. Supreme Court slowly releases a bevy of decisions in advance of their planned Summer recess, on a number of major cases heard at the high court over the past term. Among the cases we discuss today:

• On Thursday, SCOTUS released a 5 to 4 decision allowing states to impose sales taxes on all online purchases. The ruling found some very strange bedfellows in both its majority and minority opinions, but both Stern and I agree, the decision makes sense, and will be good for local retailers, jobs, the economy and state budgets where, particularly in "red" states, tax cuts in recent years have lead to the gutting of education, infrastructure and other important social services. The 1967 SCOTUS ruling struck down today, was "a totally capricious standard that the Court created itself," Stern argues. "This was the Court fixing a problem that it made."

• Stern also details an exceedingly troubling --- if little reported --- case out of South Dakota, where a man was found guilty of murder and sentenced to death, according to jury members themselves, they feared, as a gay man, he might enjoy life in prison too much. Seriously. Perhaps the most disturbing part of this matter: the Court declined to hear the case at all. Even the liberal Justices failed to offer a written dissent to the Court's decision.

• We also discuss the SCOTUS' regrettable punts this week on two partisan gerrymandering cases in Wisconsin and Maryland. (More on those cases earlier this week, with author David Daley on Monday's BradCast.)

• And the seemingly unprecedented federal court smack down of Kris Kobach, notorious GOP "voter fraud" fraudster and Kansas Secretary of State. His "Proof of Citizenship" voter registration law was struck down by a George W. Bush-appointed federal judge, and he was slapped for his contemptible performance in the courtroom --- where he represented both himself and the state of KS --- with more humiliating sanctions that include an order to attend six hours of legal classes. Moreover, as Stern reports, Kobach appears to be in still more violation of court orders, as he has yet to remove the requirement for citizenship documentation for voter registration from the KS Sec. of State website, as the judge ordered him to do "immediately" in her ruling on Monday.

  "I think that there is a decent chance that we could see even more sanctions for Kobach after this," Stern tells me. "Kobach is such a clown that this judge is going to finally have to bring down the hammer and I think it's going to be a glorious sight." (More on that case, with Sophia Lakin, one of the ACLU trial attorneys on the case, from Tuesday's BradCast.)

• Previewing the cases still to come before the end of the month, Sterns warns: "I think the Supreme Court is going to hobble public sector unions by preventing them from collecting dues from no-union members. I worry the Supreme Court is going to uphold the [Muslim] travel ban. I do think the Court may put real limits on the government's ability to collect information about where your cell phone has been from your provider. That's going to be a bright spot, I hope. But I also think the court's going to end up striking down California's disclosure requirements for crisis pregnancy centers. So, this is s not going to be a good term for progressives. I think everyone needs to just buckle in and focus on November."

Finally, Desi Doyen joins us for the latest Green News Report on a number of important issues that the Trump Administration did quietly this week as the rest of the nation and media were consumed with the child immigration story, and the 30th anniversary of Dr. James Hansen's first dire warning to Congress --- also in 1988 --- about the then-looming menace of global warming due to the unprecedented release of greenhouse gasses, such as carbon dioxide from the manmade burning of fossil fuels, into the atmosphere...
