"It's outrageous," says Francine Busby, "that this judge just said the state of California doesn't have jurisdiction over our own elections, over this election."

Busby's remarks, in a report today by William Finn Bennett in the North County Times, were a suprising departure from her previously guarded stance concerning the challenge of the June 6th U.S. House Special Election between herself and Brian Bilbray.

"What happened today should be of concern to all voters," Busby reportedly said.

Bennett's coverage of yesterday's debacle in the San Diego County courtroom where Judge Yuri Hoffman dismissed the election contest in support of the defendants' arguments that the U.S. House, not the voters or courts of California, have jurisdication to adjudicate election challenges after the House has already seated a member, is quite good. Indeed, it was a refreshing departure from previous sloppy, sometimes wholly inaccurate and occassionally entirely partisan North County Times reports and commentary on the case (see this embarrasing commentary from Jim Trageser for the most egregious.)

Bennett's report today, on the other hand, quite fairly describes the court's atrocious decision which we reported on in detail yesterday. Here's a sample from his coverage...

In addition to Emily Levy's coverage here on Friday night, and Winter Patriot's coverage last Thursday (which includes actual briefs and letters filed in the case), Miriam Raftery filed a superb summation at RAW STORY today of where the Busby/Bilbray CA50 Election Contest stands as of last Friday's hearing. She includes several details which the Guest Bloggers here hadn't previously touched on --- including details on the defendants' attempts at a frivolous "SLAPP suit" against the plaintiffs --- so we recommend giving her piece a quick read.

The Judge on the case in San Diego, Yuri Hofmann, is to decide tomorrow on the defense's argument that the case should be tossed out on jurisdictional grounds because, they argue, the Constitution gives the U.S. Congress --- not California voters or California courts --- the right to ultimately adjudicate such election challenges...even before, as in this case, the election was actually certified by the county or the state. No, seriously, that's what Brian Bilbray's attorneys are actually arguing. Out loud.

Astute BRAD BLOG readers will recall my last bout with the far-right "conservative" Crane Durham on St. Louis' 97.1FM Talk on his ironically named "Nothing But Truth" radio show. Durham had invited me for his "Tuesday Night Fights" on the Fox News Radio affiliate station in my old hometown. And though I had thought the conversation would be about Electoral Integrity, it was instead about the war and whether or not Valerie Plame was indeed a covert CIA agent. Last time around we cleaned Crane's clock --- in both our own opinion, and that of all of his far-right listener/callers to boot! Even Durham himself, to his credit, admitted that he'd been bested. "I feel like Foreman after Ali," he would say after I hung up. Some fun radio here if you missed it the first time.

As I'm now in St. Louis myself for a few more days, Durham's peeps have invited me back for an in-studio mano-a-mano this time around. And so, I look forward to getting it on once again, this Tuesday night at 10pm PT (Midnight in St. Louis, Wed. 1am Eastern Time). Please feel free to tune-in online to see how things go. Should be fun. Will he best me this time? We'll see. I've been on the road for about a month, and thus, infrequently online in the bargain. So perhaps he'll have an advantage. He could use it.

The BRAD BLOG Joins in the Endorsement Of Course...

I had to check in briefly for this one! Even while "out here" and still unable to do very much "in here". And especially with the Florida primary elections set for next Tuesday, September 5th.

The Daytona Beach News-Journal has endorsed Clint Curtis for next Tuesday's election over his primary candidate Dr. Andy Michaud who has shown up at almost ZERO campaign events over the last several weeks. He even failed to show up for a televised debate a week or two ago.

The News-Journal's full endorsement is fairly well done. They quickly cover Curtis' allegations (broken originally by The BRAD BLOG back in December of 2004) that Rep. Tom Feeney (R-FL) --- then the Speaker of the Florida House even while he was the registered lobbyist for the same computer firm Curtis worked at --- asked Curtis to create a computer vote-rigging prototype program back in 2000. Curtis now hopes to unseat the corrupt Feeney this November.

The last two grafs of their endorsement...

Curtis clearly is more than a one-issue candidate and has extensive knowledge on a wide range of issues. It is not surprising, though, that his highest priority is to "secure free, fair and trustworthy elections."

Some of Curtis' positions may be difficult to sell to Congress, such as creating a national health-care plan using tariffs on imported goods. But all of his stands are well-thought-out and imaginative.

· RECOMMENDATION: Clint Curtis for the Democratic nomination for U.S. House, District 24

As The BRAD BLOG has covered the Curtis/Feeney claims extensively over the past two years (a quick summary of his story is here) and has yet to find a hole in Curtis' story --- though we have found one after another in Feeney's considerable dodges and dances and smears and refusal to take a polygraph test (as Curtis did and passed!) --- we join the News-Journal in heartily endorsing Curtis in the upcoming election.

Given Feeney's huge money advantage, we also recommend you support clean elections by supporting Clint Curtis with a donation if you can afford it. Feeney, who was/is a huge supporter of Tom DeLay's, "Duke" Cunningham and Bob Ney, will have plenty of money, of course, as he's the only Congressman left in the House who went to Scotland to play golf on Jack Abramoff's dime now that DeLay and Ney have had no choice but to move on.

AP Reports Republican Hand Count Request, Continues to Ignore Busby/Bilbray Election Challenge...

As we wait for the results of the hearing today in the Busby/Bilbray CA50 Election Contest (see this story on the latest absurd claims from the defendants arguing that the U.S. House, not the voters of California get to decide who will be the "winner" of the election) and as I prepare to meet today with folks from the Missouri Honest Elections group, this story was brought to my attention.

No, it wasn't a "sore-loser" who requested the hand "recount" in Missouri's recent primary election for State Auditor. It was a Republican. As we know, only Democrats are "sore-losers" when they ask for such things.

To underscore that point, the following quotes are from an AP report on the matter. AP never bothered to report on the requested hand count in the Busby/Bilbray election, or even on the fact that a contest and lawsuit have now been filed in California Superior Court! We suppose that matter, since it was a Democrat who may have been screwed by the machines --- never mind that it was a federal race determing a new U.S. House member, versus a primary for a state election --- is just not to be considered newsworthy by the AP.

Anyway, Republican Jack Jackson reportedly came in second to Republican Sandra Thomas after the machine count of votes in the Missouri Republican Election to determine the Republican candidate for State Auditor. Jackson received a few reports of problems throughout the day, and so --- responsibly --- has asked for a full hand count and, according to AP says, "Whatever this recount shows, I will accept...[But] right now, I am still a candidate."

We agree.

Jackson said he had received about 15 calls from people who had trouble voting on the electronic equipment used for the first time at many polling places.

"It sent up enough signals that I thought a hand recount was appropriate, and it's so close," said Jackson, of Wildwood, who currently serves in the state House.

Does Jackson's opponent Thomas consider him a "sore-loser" for making the request? Of course not. Jackson's a Republican...

Thomas, currently the Platte County auditor, said she respects Jackson's right to seek a recount. Under state law, both Jackson and Thomas can submit names of people to help in the recount. The candidates or their attorneys can also be present for the recount, which will have to be done in each of Missouri's 116 voting jurisdictions.

Of course, Missouri has no idea what to do now. Does a recount mean they simply push the button to get the same numbers again from the same new electronic voting machines they used to get their numbers the first time? Or does it require a full manual hand count of the paper ballots and "paper trails" as the candidate has requested? Again, election officials find they have no laws for the new voting systems they have now irresponsibly decided to use.

The Democratic Secretary of State, Robin Carnahan, will decide. We hope she makes the right decision and allows for a full hand count. The voters of Missouri (my old hometown) deserve no less.

A First-hand Account from this Year's Annual Democratic National Party Gathering in Chicago

-- Donna Brazile to an Election Integrity Advocate at the annual DNC gathering last weekend in Chicago after being asked where the party was in Ohio after Election 2004.

Such were the contradictions and dysfunctions on parade last weekend in Chicago where I was invited to address a panel on Electoral Integrity at the DNC's annual gathering of state party chairs. What a mess.

The Rolling Stone piece referenced above, by the good Tim Dickinson, is not currently online. But it's from the Aug. 24 issue of RS on newsstands now. It asks "Will Democrats Fight Back?" The answer, as Dickinson reports, is a decisive maybe, probably not, things don't look so good, we hope so but kinda doubt it.

While it'd be nice to give you an encouraging report from the DNC meeting of how the Dems have finally figured out what the hell is going on here --- how they are going to get out in front of this electile dysfunction thing, take the offensive, become proactive and lead the way in becoming the party which stands for vigilance, Electoral Integrity and the assurance that every vote will be counted and counted accurately --- I can't give such a report.

Yes, there are some good things going on there. One of the most notable being Greg Moore who is now the Director of the DNC's Voting Rights Institute. He gets it. Moore was responsible for all of the Election Protection-related events over the weekend. It seems he's been fighting heroically from inside the power structure to wake the Dems up as to what is going on. He's the one responsible for the historic DNC statement a few weeks ago calling for a full handcount in the illegally administered Busby/Bilbray U.S. House Special Election in California's 50th congressional district. But it's clearly been a difficult fight. And last weekend's events made that crystal clear...

Poll Numbers, Statement Officially Released This Afternoon (UPDATE: Zogby Releases More Data --- see below)
Busby/Bilbray Election Contest Attorney Quoted...

As The BRAD BLOG reported two days ago, a new Zogby poll has revealed that a stunning 92% of Americans want their vote counted transparently and not by secret vote counting machines. That overwhelming majority crosses all political, social, religious and economic demographics.

Today, Zogby has released their official statement and numbers from the poll. Their statement quotes attorney Paul Lehto, who is busy fighting the election contest down in San Diego's Busby/Bilbray CA50 challenge in which voting machines, using secret software to count the results of that election, were compromised when they were sent home with poll workers on overnight "sleepovers" for days and weeks prior to the election, as we have been reporting since that special U.S. House election on June 6th.

Here's a quick snippet from Zogby's official release...

Asked whether Americans have the right to view and obtain information about how elections officials count votes, 92% of respondents concurred.

"The 92% support for the public's right to view vote counting and obtain information about it is a very strong political value of transparency and against secret vote counting outside the observation of the public," said Paul Lehto, a lawyer and sponsor of the survey. "To put this figure in context, support for election transparency exceeds the support for tax cuts, exceeds the approval of Pres. Bush immediately after 9-11, and virtually all other political values being measured." Mr. Lehto is counsel in the 50th Congressional District election contest in California.

Most of those surveyed— 80%—said they want votes to be counted in front of observers representing the public, and that elections officials should not rely solely on the proprietary software that operates electronic voting machines that are presently being installed all over the United States.

The survey also says that some 60% of respondents "have heard news reports of flaws in new electronic voting equipment." So I guess someone is doing the job of getting this information out to the American people.

Apparently the news hasn't yet reached the DNC, however. More on that, and my personal experiences addressing folks at the DNC's annual gathering last weekend, in a report to come shortly today...

If You're Near Chicago This Weekend, Please Stop by and Say Hello!

Yes, I'm still on the road and will continue to be until at least the end of this month. Still travelling across the country for various double-super-secret meetings and projects, and even the occasional (very occasional, unfortunately) day spent off the grid entirely to catch up on some rest and enjoy the waning days of summer. There's a lot going on in the background --- fortunately or unfortunately, depending on how you may see it --- so despite my best efforts, I haven't found much peace and quiet, even while not blogging here regularly. Oh, well. At least I've got it better than Stephen Heller, who really may be "taking one for his country" (see below.) Much to come on those background developments in the coming weeks and months in either case.

For now though, a couple of quick points...

8/17/2006: UPDATE! POSSIBLE SCHEDULE CHANGE!: Incredibly late in the game, the DNC has now invited me to address some of their people at a Saturday afternoon round table, which occurs at the same time as the event in DuPage County! Having not (yet) figured out how to clone myself, and now making the difficult decision that a few minutes time speaking directly to the DNC about the mess on our hands may ultimately be more fruitful than emceeing the DuPage event, I may now be either late or a no-show at the Illinois Ballot Integrity Event! Depending on what time I finish with the DNC event in downtown Chicago, I'll then speed out to the DuPage event to make it for at least some of that event...if at all humanly possible. Dr. Andy Michaud Misses Another Event...Is Contest Now a Direct Race Against Feeney?

As has been his practice over the last several months, the primary election opponent to vote-rigging whistleblower turned congressional candidate Clint Curtis was a no-show in a recent televised debate.

Curtis spoke about election fraud (vis a vis Tom Feeney), the Iraq War and the price of gas. Needless to say, he won the "debate" hands down.

With his primary election opponent, Dr. Andy Michaud, failing to appear at events across Florida's 24th Congressional District, does this mean the good Doctor is giving up? Or is there something going on that we don't know about?

The primary is September 5th. Should Clint win, he'll be going mano-a-mano against the well-monied and impossibly corrupt Rep. Tom Feeney --- the very man he claims had asked him to create vote-rigging software back when they both worked at the same software firm (even while Feeney was Speaker of the Florida State House of Representatives.)

For the record, Feeney is now the only Republican congressman who was with lobbyist Jack Abramoff on those golfing junkets to Scotland, now that both Tom DeLay and Bob Ney have dropped out of this November's election. Feel free to donate to Clint Curtis as he takes on Feeney, one of the GOP's top-tier money behemoths!

Allegations of 2005 Mistatements of Revenue Concerning Voting Machines, Long-term Service Contracts by Truth-Challenged, Anti-American Company...

Apologies in that normally this would have been a siren-worthy item on the day it broke (last Thursday) here at BRAD BLOG had I not been on the road and looking the other way for the most part (as I still am). Particularly since we've been following Diebold's financial malfeasance closely for some time, including breaking the original report of both the Securities Fraud Class Action suit against the company last December, and the SEC's original "informal" (now formal!) investigation of Diebold in May.

Hat-tip to Warren Stewart of VoteTrustUSA.org for picking up news of the now-formal investigation late last week (and to John Gideon who, naturally, noticed in last Thursday's 'Daily Voting News')...

Reuters is reporting that the U.S. Securities and Exchange Commission has begun a formal investigation into how Diebold recognizes revenue. In a public filing in May, Diebold has acknowledged that SEC staff had begun an informal inquiry but the company’s latest filing on July 27 reported that the investigation had been converted into a formal nonpublic investigation.

SEC investigations typically begin as informal inquiries. A formal inquiry is one in which the commission authorizes the staff to look at whether laws have been broken and carries the power to subpoena witnesses and documents.

Though both Diebold spokesman Mike Jacobsen and SEC spokesman John Nester declined to comment on the investigation, it was clear that the focus of the inquiry relates to Diebold's election division, Diebold Election Systems, Inc.

We've been "off the grid" for the last three days, so we're a few days late in reporting that...The BRAD BLOG congratulates George W. Bush for outlasting former President Richard M. Nixon in office!

Despite proven crimes against both his country and the U.S. Constitution which he swore to protect and defend (not once, but twice), Bush has managed to out-trick Tricky Dick as BRAD BLOG readers have likely noticed while our countdown clock (formerly posted in our right hand sidebar, a screenshot of which is now posted at left) had been tracking for many months.

It has been no easy feat to out-slick Tricky Dick, but with the help of a compliant rubber-stamp congress and a castrated roll-over media, Bush has managed to get away with a contempt for his country in a way that Nixon could only have dreamt of. As the legendary and mysterious Freeway Blogger has previously pointed out, we're all wearing the blue dress now.

Thanks to all of the parties involved, Bush has faced no accountability whatsoever as self-proclaimed Commander-in-Chief up until now. That, despite an administration of unprecedented corruption. So a hearty congratulations is due The Decider! Nixon would be impressed, Joseph Stalin would be in awe-filled appreciation and The BRAD BLOG extends its "thanks" to Bush for supplying us with not a single day since we've been in "business" in which we haven't had something to write about.

Would that thousands of more Americans were still alive, but for Bush's loathesome, irresponsible, deadly and illegal policies, to give him that same "thanks."

Staff Writer/Columnist Jim Trageser Flails Against the Wind...and the Facts

UPDATE: Trageser sends us a one line reply to the following article (instead of bothering to return our call): "Thanks for the traffic bump!" was all that he wrote. To which we replied: "Thanks for not giving a damn about your country." We also realize we neglected to post Jim's contacts previously so you can thank him yourself. Letters to his editor may be sent to: letters@nctimes.com, though that's likely the same editor who allowed his factually incorrect and evidence-free article to be published in the first place, so who knows how much they actually give a damn about such things at The North County Times.

I've been completely off line for nearly a week, only to return briefly enough to find Jim Trageser's sad attempt at a column from Wednesday in the North County Times wherein he bashes the Busby/Bilbray election contest as nothing more than "a political stunt."

The evidence for his conclusions? Apparently he has none. Other than the "facts" he has simply made up out of whole cloth without, seemingly, bothering to speak to a single source involved in the contest.

Add to that several pieces of out-and-out incorrect information (he says that Bush beat Gore in 2000 and that "every post-election recount...all upheld Bush's narrow win in Florida" --- Here's the actual numbers from the studies you cite, Jim. Don't bother to read them, we'd hate to destroy your rich fantasy life) and you've got the perfect picture of everything that is wrong with today's lazy, faux media.

At one point, Trageser actually has the temerity to hunt and peck the following words out of his keyboard...

Just a quick personal blog item to touch base from out here on the road. I'm currently in St. Paul for just a few more moments. We drove up Friday (from St. Louis) to tape two episodes of John Forde's Mental Engineering for PBS. Not certain when these episodes will air (some time this fall, I believe) but I'll try to let you know when I find out.

I was honored to sit on a four-person panel with the brilliantly hysterical comedian Tom Rhodes, the delightful and smart media literacy professor Renee Hobbs from Temple University and the lovely and deviously clever actor Desi Doyen (DISCLOSURE: Desi is also my girlfriend)...

In addition to the previous article mentioned in Florida, more Voting Machine 'Sleepover' coverage today, this time from Marc Songini in ComputerWorld...

A lawsuit has grown out of alleged breaches in security procedures around electronic voting machines in San Diego County after a hotly contested congressional election, throwing a spotlight on the reliability of the machines themselves.

The suit, filed on Monday, requests that a special election on June 6 to fill the 50th Congressional District seat be invalidated. It also seeks a complete hand recount of the paper ballots, said Paul Lehto, an Everett, Wash.-based attorney handling the case. The suit was filed in Superior Court in San Diego and names Mikel Haas, county registrar of voters, and Brian Bilbray, the winner of the seat, as defendants.

San Diego voters used AccuVote optical-scan and TSx touch-screen systems from Diebold Election Systems.

Whatever the specific merits of the suit, it could heighten some citizens' concerns about e-voting technology if critics' claims of the inherent security deficiencies get debated in court during the run-up to the fall elections.

One of the main points raised by the suit is the so-called sleepover policy, under which Haas directed that all the machines be released to poll worker supervisors before the election. These sleepovers lasted from three days to more than a week.

"During these sleepovers, the voting machines were unsecured, subject to access by innumerable neighbors, strangers and family members, and stored without records or proof of actual chain of custody, eliminating the ability of any person to detect whether or not fraud or improper access to the voting machines occurred," according to the lawsuit.

"The sleepover issue is fairly egregious," said Lehto. Tampering with one card in one device conceivably could change race results.

This lawsuit is an example of what could happen in upcoming contests, said Brad Friedman, who covers e-voting issues in his blog. "Is this the sort of thing we want to see happen in 435 House races, 33 Senate races and 20-something gubernatorial races around the country on Nov. 7 this year?" said Friedman.

Secure ballots fuel races

Verifiable elections also tops the list of issues on the Web site of Titusville Democrat Clint Curtis, who is challenging Oviedo Republican incumbent Tom Feeney for U.S. Congress. Feeney's Web site also touts paper ballot legislation he advanced last year.

Another voting issue making rounds is "sleepovers."

The practice of having precinct clerks store machines just before Election Day is used in Volusia and Flagler counties so the machines can be distributed to polling places in the wee hours before polls open at 7 a.m. The machines are sealed to make sure they're not tampered with, and supervisors say it's safer to have them at a sworn elections worker's home than at a polling place.

The practice is particularly common in large counties where polling places are far from elections offices, said Sterling Ivey, a spokesman for the Florida Department of State.

John Chagnon, a Democrat from St. Augustine who is challenging Winter Park Republican John Mica for his Congressional seat, raised the "sleepovers" issue in a letter to the state Division of Elections last week.

"A lot of people just don't know about this," he said. "When they find out about this, they get upset."
